I

n my first article, I spoke about how our industry is the (unintentionally) best kept secret – well we didn’t want our new Association Executive to be the next best kept secret! So, I took some time and sat down with Emily Blair, CAE to “pull back the curtain” so-to-speak; and shed some light on our new Executive, in hopes you get to know her beyond her official bio. In asking about how Emily sees her role at the Association, she talked about the image of an hourglass. Just like the sand flowing from one side to the other – so does information and ideas in an organization. Imagine the hourglass being turned repeatedly, in the same pattern. Whether is the Board in the top glass bulb and

members in the lower one; or committees in one bulb and the AAA team in another – whatever combination, she

through the hourglass marks the passage of time so does the information flow enable innovation and movement forward. But how did she arrive here? Just like I wasn’t a kindergartener saying, “when I grow up, I will be an apartment manager,” Emily wasn’t exactly listing “association executive” among the aspired professions of teacher, nurse and fireman most widely held at a young age. Emily Blair wanted to be an interior designer. She wanted to follow in the footsteps of her grandmother who had an amazing artistic design eye (with great style) who designed all the homes her grandfather built. Alas, after one art class in college – and a very honest counselor – she was told she should probably find


another line of study. So, Emily decided to try an alternate path in business and marketing. While in college in Michigan, her internship with the local Home Builders Association affiliate was the spark she needed to pursue the nonprofit path. Her years of experience with HBAs in Michigan and Austin led her to continuing her interest in advocating for and advancing housing – and now in multifamily here with Austin Apartment Association. Emily has numerous goals, but her guiding vision for AAA is always to be prepared for the next year and be relevant in five years. As an example, the way we communicate now is different than how we communicated ten years ago, and it stands to reason it will also be different five years from now. She wants to ensure that members can offer feedback in whatever method is most convenient to them. She also wants to make sure that we gather the data from that feedback accurately. She is essentially a data nerd with no artistic ability. Outreach and Public Relations are two specific areas where Emily would like to focus her efforts for the Association. She wants to elevate the profile of the Austin Apartment Association by increasing our involvement and partnership with other community, chamber and nonprofit groups. She wants to facilitate those connections by attending meetings and cultivating individual relationships. Additionally, she wants to join in the lively discussion and collaborate with TAA, NAA in bringing more positive press for our industry to the Austin market. Her plan is to develop and source more stories within our association that can be presented to local news organizations as a complete package. Just as we do as industry professionals, Emily is hoping that the members give her the opportunity to build trust and offer a willingness to take on the challenges of new opportunities. At the AAA office, she hopes to maintain an open-door policy with staff and members alike – much like the open funnel of an hour glass – keeping information flowing between the two groups to optimize communication and collaboration. She also promises not to do any re-decorating.

All Eyes Turn to Housing

The housing “stuff” the council wants to do goes far beyond what has been done in the past.

A turn of events in late 2018 has the City of Austin eying big plans to spur the development of more housing, especially attached-wall rental housing of all shapes and sizes, in 2019 and beyond. The housing plans and programs on the horizon bodes well for property owners and rental property managers, and the Austin Apartment Association is poised to provide input and perspective as the housing plans and programs unfold. The sharp turn toward housing began this past August when Austin Mayor Steve Adler announced his intention to scrap the re-write of the Austin Land Development Code, known as CodeNEXT. The city council subsequently voted unanimously to end CodeNEXT shortly after the Mayor’s announcement. The decision to abandon the effort was monumental because the city had spent more than five years and about $8.5 million on several drafts of the new code that would have guided what could be built in Austin and where it could go.

Exactly why the city pulled the plug vary, but it was clear to many that the code re-write was dividing the city between those that wanted bold changes in the rules to streamline more housing developments and those that were leery of new and diverse housing in older, more established neighborhoods. The proponents of neighborhoods stability even went so far as to force a ballot proposition calling for public vote on any new land development code drafted. This proposition was ultimately defeated in the November election. When the city council took its action to scuttle CodeNEXT they gave instructions to City Manager Spencer Cronk to create a path forward in 2019 to implement changes to the land development code. Cronk’s plans have yet to be revealed, but the most active participants in the original ill-fated process think that separating the process into smaller, more digestible parts is the only path forward and is a path that will produce quick results. However, even with a new revamped process there will still be many residents working hard to keep

multifamily rental housing from being developed in, or even nearby, existing neighborhoods. At this juncture, the only thing that is certain is that the existing land development code has many pitfalls and is ill-suited to accommodate the demand for housing in this booming city. A new code, or major re-write of the existing code will happen. In November, the public voted to pass seven separate bond propositions carrying a total price tag of $925 million. The largest proposition among the seven was a $250 million affordable housing bond. The city broadly outlined how the money authorized under the housing bond would be spent, with the largest portion, $100 million, going toward buying land. The remaining funds will be used as follows: 94 million for rental housing development assistance, $28 million for a home ownership program and $28 million for a home repair program. In conjunction with the bond passage, two new city council members were elected. The campaigns of the two new council members promised new vision on existing problems. This new council vision was acknowledged by Mayor Adler when he stated “I think the new council members lean away from the status quo and into making change….On the campaign trail, there were voices that argued more for the status quo and against change, and most of those voices did not do well in the election. I think people indicated they want us to actually be doing stuff.” The housing “stuff” the council wants to do goes far beyond what has been done in the past. The last affordable housing bond totaled $65 million and was passed in 2013. Those funds helped fund the creation of 2,253 housing units at rates affordable for people with incomes less than 80 percent of the median for Austin. About $2 million also was spent on land acquisition.

With a new city council, a renewed effort to re-write the Land Development Code, and $250 million in new funds to address affordable housing issues it is easy to see that the city council will be focused on housing policy, and this is sure to impact Austin Apartment Association members. In order to insert the AAA into the dialog, small group meetings with the Mayor and two council members have already been held with more meetings with city council members being planned. The discussion at these meetings focus on finding solutions to several lingering issues such as the collection of personal information when obtaining annual swimming pool permits, the always-increasing city fees, permits and taxes and the cumbersome enforcement of the Repeat Offenders Program. At the same time, we are reminding them that AAA members have unique rental property expertise and perspective that could be instrumental when refining housing policies or when crafting new housing plans and programs. As this edition of WINDOW was going to press, the National Apartment Association was preparing to host industry professional from all across the county for meetings on Capitol Hill with all U.S. Senate and House members to discuss problems and solutions facing the apartment industry.

Apartment owners and operators are required to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford a person with a disability equal opportunity to use and enjoy a dwelling unit or common space. Similar to the airline industry, a lack of clarity in the law governing reasonable accommodation requests in housing has created a loophole for bad actors to abuse the system, creating a cottage industry of online outlets that produce the verification required by law for the right price. The AAA receives numerous calls on this issue and has presented many training seminars on the topic.

Flood Insurance The National Flood Insurance Program (NFIP) FIP is especially important because there is largely no readily available private flood insurance market to most property owners. The NFIP ensures that affordable flood insurance is available at all times in all market conditions for every at-risk rental property. This will be particularly important in Austin because the city is establishing new floodplain boundaries and that may require more properties to obtain flood insurance. Evolution of AAA’s Community Outreach BY JENNIFER COX AAA Director of Marketing & Communication

S

ome projects have come and gone (bingo at the retirement home, trail of lights, cell phone drives and Operation K.I.S.S.), some are in response to current events (hurricane and wildfire relief ), and others have stood the test of time – most notably the Doc & Gayle Young Food Drive. For the past few years, our association has chosen to focus on four main outreach endeavors: Brady’s Bridge, AISD Back to School Bash, the Red Cross, and the Food Drive. We throw the majority of our volunteer hours and financial backing to these four projects. As the theme for this year’s Window magazine is “Evolution,” let’s see how our Community Outreach projects have evolved over time to get us to where we are today. Toys for Tots, an annual toy drive held by the U.S. Marine Corps in December has now evolved to our support of Brady’s Bridge. Brady’s Bridge is a local non-profit created by a former member of AAA to provide individualized care in a group setting for kids of all abilities. Since 2016, AAA volunteers have raised funds around the holidays to support Brady’s Bridge and their Christmas Tree Drive, an effort to provide little decorated Christmas trees to children who must spend their holiday in the hospital. Operation K.I.S.S., a summer-long school supplies drive donated to area charities, has changed to our support of AISD’s annual Back to School Bash, a citywide program that donates supply-laden backpacks to Austin ISD students through

Family Resource Centers, the International Welcome Center and the Refugee Family Support Office. Families and students also receive free haircuts, eye exams, booster seats, Child ID Kits, and various health screenings. For seven years, AAA’s Got Talent show raised money for the Red Cross through this springtime event showcasing talent of AAA members. Starting in 2019, AAA volunteers created the inaugural volunteer emergency response team for Red Cross. This group of trained volunteers will be specifically utilized to call on to respond to emergencies at apartment communities in our area such as fires, floods and other emergencies. The Food Drive is AAA’s longest-standing outreach program. In 1986, a small group of volunteers raised $600 dollars over several days to buy food for some apartment community residents in need at Thanksgiving. Thirty-two years later, the Austin Apartment Association’s annual Doc & Gayle Young Food Drive has raised more than $869,000 to purchase food for over 23,050 families and give financial support to food pantries in 10 counties surrounding Travis. Committee members ask for financial donations and coordinate several fundraisers each fall, including putting on

happy hours, a volleyball tournament and conducting silent auctions. The committee works on a $0 budget; all items and venues are donated by generous companies, businesses and individuals. Each year, 1,350 food packs are hand-delivered by volunteers to the Austin Housing Authority, the Texas Department of Protective and Regulatory Services Rainbow Room, SAFE Austin and Foundation Communities on the Tuesday before Thanksgiving. Along with the countless volunteer hours spent on our Community Outreach projects (we haven’t even mentioned our various monthly outreach projects with Ronald McDonald House, SAFE Alliance, Capital Area Food Bank, Austin Pets Alive and Keep Austin Beautiful), the Austin Apartment Association contributes financially to the Red Cross, SAFE Alliance, AISD and one other organization related to housing Austin’s homeless population – Front Steps was our recipient in 2018. It’s impossible to know the true impact of our community outreach projects, but be assured it will always be an important – and evolving - part of our association.

5 Strategies

to Maximize Your Resident Retention BY ASHLEY TYNDALL

A

good multifamily professional knows that resident retention is key to the success of the community and bottom line. Retaining residents is just as important, if not more so, than getting new ones. According to the National Apartment Association’s 2017 Income and Expense Report, the average annual resident turnover is 51 percent. Inevitably, move-outs mean additional maintenance costs and loss of rent. In fact, the cost of a single turn is typically in the range of $1,000 but can grow to $2,500 to $5,000 depending on the property, according to Property Manager Minutes. Additionally, in a 2017 survey by Satisfacts, the average turn cost was found to be $2,811 per unit. Reducing resident turnover doesn’t only make financial sense, but it can also lead to stronger long-term relationships with your community and added value to the property. Property Manager Minutes estimates that reducing turnover by one per month can save $20,000 in annual expenses and liberate 96 hours of work from the maintenance team that can be spent on other pertinent issues. However, solving the issue of resident retention is no easy task. The following are five strategies for multifamily professionals to maximize retention and enhance the resident experience in the process: 1. Develop a Strong Brand Identity & Resident-Friendly Website

A website is the centerpiece of a strong brand identity, which is why your multifamily property needs to make it the best it can be. Your website is likely the first place prospective residents will turn when researching your property, and the first thing current residents will share with friends when recommending your community. As more people access the internet via their

mobile devices, responsive web design will continue to be the most important feature for apartment websites. A good property website will be mobile-friendly, responsive, creative, and will drive brand recognition. 2. Distribute a Resident Newsletter

Newsletters aren’t just a tactic to market your property; they are a way to stay in front of your residents on a regular basis and offer them fun, resourceful information. Consider distributing a newsletter every week or month to offer reminders to residents of all the fun events taking place in your community. Your newsletter should be as fun and creative as it is informative. Take this opportunity to offer resident deals, amenity or property updates, highlight community events, and other value-add content. 3. Create & Maintain a Social Media Presence

Social media is important in attracting new residents, but it’s also critical in building loyalty. Today’s residents want you to meet them where they are most active, and right now that’s on social media. It’s not enough to create a profile and let it sit untouched or sporadically post pictures of your amenities. Savvy multifamily professionals will ensure they are actively connecting, engaging, and inspiring residents through their social media presence. Host special giveaways and contests, share relevant news, offer easy recipes, or highlight local happy hours. It’s important to position yourself as a trusted and valued resource to attract new residents and retain current ones. 4. Ask for Feedback & Make Improvements

No apartment community is perfect, and property managers can’t please everyone.

However, the properties that don’t listen to their residents or make improvements will see the highest turnover. Create custom surveys, hand out comment cards, run polls via social media or email, or utilize feedback management software to reach your residents and learn their likes and dislikes about the community. Remember, residents don’t care about how you obtained the feedback if you don’t execute on it. Initiate opportunities to gain resident feedback, then respond accordingly to make the resident experience a pleasant one. 5. Create an App for Your Apartment Community

Many of today’s tech-savvy residents don’t just want a mobile-friendly experience; they want mobile-only. With technology at their fingertips, it’s easy to lose their attention. Developing an app for your apartment community not only puts you top of mind and sets you apart from the competition, but it can help eliminate some of the pain points of apartment living. For example, residents can receive maintenance alerts, learn updates about the property and amenities, and pay rent on their mobile device. Continuous Support, Continuous Residents While these strategies can help you enhance the resident experience, it’s important to couple these efforts with updated amenities, quick service, and an attentive leasing team. Improving your resident retention will help build a strong community, one people will not only want to live in but will recommend to all their friends. Increasing resident retention rates is dependent on the property’s entire team making a continuous effort.

Don’t think of AAA industry courses and seminars as just “education,” rather as, “training for your career, your family, your company, your future employer and - most of all – for you.” While it may seem to go without saying, some people just need a little push – or personal justification – for education, so here are some great reasons for you to get industry training, why your employer should care, and how to ask for it.

Why (for the employee) • Brush up on your skills – learn about new trends, resources and tools that can make you better at your job • Networking – make new contacts in your field • Learn more about the industry than the scope of your current role Explore other areas of the industry Learn skills needed to get to the next level in your career • Stand out as an ambitus go-getter Purposing professional development can signal to your employer that you are serious about advancing and learning more about your industry • Stay engaged – taking time to invest in yourself can help you stay engaged and avoid burnout

Why (for the employer) • Employee retention – employees are more likely to seek advancement opportunities within companies that invest in them • Increased productivity – well trained employees are better equipped to face challenges • Morale booster – employees are happier when they feel their employer cares and is invested in their advancement

Based on the description I am confident I’d come back to the office with (desired skills), learning this would make me more efficient/better at (blank task). • If your supervisor has attended continuing education events, ask if you can go with them the next time something pertinent is offered • Let your ambitions be known If you have a goal such as earning a credential or being promoted share that with your supervisor especially during your review • Ask about opportunities that can help you achieve your goal

How to Ask • Ask if there is a budget for staff development/continuing education This is something that is often times mentioned when interviewing or on-boarding at a new job, be sure to revisit this job benefit and make sure you are making the most of your opportunities

poor presentation before a judge is dangerous; it will influence who prevails and whether all available relief is actually awarded. In short, a poor courtroom presentation can have a significant cost. That cost, moreover, will be more than monetary. Consistently poor presentations in court, and sometimes even just one, will negatively impact reputations. The phrase, “your reputation precedes you,” should be taken seriously. Judges are elected to conduct trials, and they remember what they see and hear. Since they move so quickly through the court system, we tend to forget that an eviction is a lawsuit. Often there are no lawyers representing the parties. Rarely are substantial sums of money involved in the typical residential eviction case. The primary relief awarded, that being possession, can be easy to take for granted. After all, the tenant’s lease only grants them temporary occupancy, with a scheduled date for it to begin and end. Success in an eviction suit, as in any lawsuit, requires thorough preparation and attention to detail. The detail, moreover, is not simply needed in the courtroom. There are many ways a lack of preparation and attention to detail will doom your case. Fortunately, the most common errors can be corrected. This article is written at the

request of a well-respected Williamson County, Texas judge. That judge sees, on a daily basis, the value of you planning for the worst and expecting the best. That judge will know if you have read, and taken to heart, this article. Follow even some of the advice set forth below and you can conquer the eviction trial. This is true whether on-site personnel present the case in court, or they hire someone else to assume that responsibility. It all begins on-site, and management must ensure that the little things get done properly. There are essentially three types of eviction cases. One is based upon nonpayment of rent. The second is based upon conduct, having nothing to do with payment, but which violates prohibited conduct provisions in the lease and results in default. The third occurs when the resident holds over beyond the date the lease is scheduled to end, and neither a month-to-month renewal nor a renewal for a term will follow the originally scheduled expiration date. In each type of eviction case, there are certain essential tasks which must be properly performed. The nonpayment of rent eviction. The lease agreement will set forth the amount to be paid for rent and the payment deadlines. When these requirements are not adhered to, the landlord has the right to terminate a resident’s right to possession.

The Justice Court, when it considers your eviction case, will not award monetary relief to you other than for unpaid rent, court costs and attorney’s fees. If your resident has incurred late fees, has unpaid utilities, or other charges such as those which accompany a bounced check, they cannot be awarded in the Justice Court eviction case. Eviction based upon conduct violating the lease. Most leases have provisions setting forth conduct that, if it is engaged in, constitutes a default under the lease. For those who use the TAA lease, we are talking primarily about conduct violating paragraph 20, entitled Prohibited Conduct. This paragraph of the lease contains an exhaustive listing of what cannot be done by the residents during the tenancy. When the provisions of paragraph 20 are not adhered to, a default arises under paragraph 32.1(B) of the TAA lease. With the conduct-based eviction, it is important to deliver detailed notices of lease violation to the resident prior to commencement of the eviction. This enables you to prove to the judge that, within reason, you try to get the resident to eliminate his prohibited conduct, and that


you brought the misconduct to the resident’s attention before filing the eviction. When efforts to eliminate the bad conduct without having to evict were made but fail, the judge is likely to be more inclined to return possession of the rental unit to you as a result of the tenant’s default. When you are about to give a notice of lease violation, TAA makes different forms available. Regardless of the form you use, you are to provide details of what was done, which resulted in the violation of the lease. Specifics are needed in these notices. Do not simply put on the lease violation notice that paragraph 20 was violated. State the date on which the violation occurred, describe generally what happened, and refer to the specific section of paragraph 20 that was violated. For example, consider something along these lines: “On September 15, 2018, you got into a physical altercation with another resident near the pool area. This is a violation of paragraphs 20 (b) and 20(c) of your lease, because your altercation was loud and obnoxious behavior, and disturbed and threatened the safety of others. This lease violation places you into default under paragraph 32.1(B) of your lease.” The following language comes from paragraph 20 of the TAA lease itself. The lease violation must be detailed enough so that not only the conduct is brought to the wrongdoer’s attention, but the specific provisions of the lease that have been violated need to be pointed out as well. It is often a good idea, moreover, to include in the lease violation notice that you want to meet with the resident to discuss the conduct and lease violation by a certain date. Such a discussion may resolve the issue and preserve the tenancy. Perhaps the meeting will never occur, due to the resident refusing to a cooperate. This will only make it easier for the judge

to justify a decision to return possession of the rental unit to you when advised of that fact at trial. Eviction based upon holdover. The term “holdover,” according to paragraph 32.4 of the TAA lease, means to remain in possession beyond the date contained in the resident’s moveout notice or the landlord’s notice of non-renewal. It provides, in addition, for an increase in the then- existing monthly rent amount by 25% during

the holdover period, without notice, when you use the TAA lease. TAA has forms of notices to vacate available to you for any of the three types of evictions described above. It is advisable to use these specific forms, complete them fully, and provide details tailored to the basics of your eviction suit. The notice to vacate. Regardless of what the basis for the eviction case will be, an essential prerequisite is to give a notice to vacate. By law, the notice to vacate must provide the resident at least three days’ advance notice to move out. That law, however, enables the parties to agree to a longer or shorter period. Those who use the TAA lease have an

agreement that shortens the notice from three days to one day. There is occasional confusion about whether or not you have discretion to vary the period of time a resident is given to vacate before the eviction case is filed. You absolutely have that right. You are certainly permitted to consider the conduct, whether that be criminal activity or nonpayment of rent, when determining how long you will give someone to vacate before you file the eviction case against them. It is not an act of discrimination to use different lengths of time in different notices to vacate. When the notice to vacate is given, extreme caution must be taken to ensure it is accurate, provides enough advance notice, and is properly delivered. Frequently, a resident at the eviction trial may contend that he or she did not receive the notice to vacate. If such an assertion is made, you must ensure that you have someone in court who can testify about how and when the notice to vacate was delivered. Your inability to do this, through testimony by a person with direct knowledge of the facts, will leave the court no alternative but to accept the resident’s sworn testimony that he or she never received the notice to vacate. That fatal flaw will cost you your case. If proper proof of delivery of the notice to vacate is lacking at trial, that fact alone may well doom the plaintiff in an eviction suit. If that happens, the eviction process will have to start again. You do not want this to occur. A new notice to vacate will have to be given, a new eviction case will have to be filed, new case filing and service fees will be charged, and the roughly threeweek waiting period between filing of the eviction and trial will restart, delaying your case and causing you more monetary loss.

It is often a good idea, moreover, to include in the lease violation notice that you want to meet with the resident to discuss the conduct and lease violation by a certain date.

If you take for granted the resident will not attend the trial, you will not be nearly as prepared as you should be.

Filing the eviction petition. Most justice courts have a form petition which can be completed to commence an eviction case. Completion of this document is self-explanatory. Near the bottom of the form petition, you will be asked to specify what it is you want. Here you want to be sure you put possession, judgment for any unpaid rent, (at least through trial of the case), and reimbursement for your court costs. You also will be asked whether or not you are seeking attorney’s fees. It is recommended you indicate that you are, and where it asks the amount of the fees you are seeking, insert the letters “TBD,” which stands for “to be determined.” If you elect not to use an attorney in connection with your eviction case, you simply will not ask for this relief at trial. If you do not ask for attorney’s fees when you file the case, however, and the need arises for you to have an attorney at trial, you will be unable to recover those fees from the defendant because they were not specified in your petition. Plan for the worst and expect the best. You should always assume the tenant you are seeking to evict, known as the defendant in the eviction case, will be present at trial. If you take for granted the resident will not attend the trial, you will not be nearly as prepared as you should be. The lack of preparation will prevent you from conquering the eviction trial and likely will cause you to either lose the case entirely, or have some element of relief to which you are entitled denied. Always pursue an eviction case that you filed through to a judgment at trial. If it was worth your effort to

document the default with lease violation notices and notices to vacate, and worth your time and money to file and serve the eviction, it is also worth completing the case. Even if the resident vacates after you file the eviction case, you are still entitled to a judgment for possession, plus unpaid rent, court costs, attorney’s fees and 18% interest under the TAA lease. Appearing in court. When you go to court, dress for success. The

right clothes exude confidence and control, and they will give you an added edge. Do not allow your opponents to look more appropriate than you for this day in court. Your first impression comes from appearance; you won’t get a chance to put on a more appropriate outfit once you enter the courtroom. Remember, your reputation precedes you. You will win your case with competent evidence. To begin with, assume the judge is completely unfamiliar

with your case. Local caseloads are so large that the judges do not have time to familiarize themselves with the facts before each trial. With that in mind, do this: simply state the background facts so the judge immediately understands what is at issue. Introduce the key documents themselves and bring extra copies. Specifically, you will want the notice to vacate and the lease. If lease violation notices have been given, you will want those as well. Use exhibit numbers, which you can handwrite on the document as Exhibit 1, Exhibit 2, etc. Emphasize key provisions of the documents with colored highlights and focus on rental amounts and due dates (TAA lease paragraph six), prohibited conduct (TAA lease paragraph 20) and default provisions (TAA lease paragraph 32). Show the judge you understand the issues by paraphrasing key provisions. What do I say? In a typical nonpayment of rent case, something along the lines of the following will work well: Good morning, Your Honor. I’m Mary Duffy. Tell the judge who is suing who and why. Tell the judge what you want in the judgment, which will be, in most cases, possession plus money damages. When the basis for the eviction is unpaid rent, state the monthly rent amount, the date of the last payment, and the amount of the current rent delinquency. Remember to emphasize that failure to pay rent in accordance with the terms of the lease resulted in a default under paragraph 32.1(A) of the TAA lease. This is the time when you tell the court the details of delivery of the notice to vacate, and hand the judge

a highlighted copy. This is also the time when you tell the judge how the lease was violated, creating the default, supported by highlighted provisions of various lease paragraphs. End your presentation by asking for the specific relief you want: possession of the rental unit and monetary damages, which the lease states you are entitled to. It is easier when you know the judge can award only the unpaid rent, court costs and attorney’s fees (if any). If you accurately tell these amounts to the judge, they likely will be written into the judgment on the spot. What if the default is based upon prohibited conduct? The essentials of your case presentation will be very similar to those in a nonpayment of rent case. Here, however, the focus is on paragraph 20 of the TAA lease and specifically identifying the prohibited conduct that led to a paragraph 32.1(B) default. To effectively prove these things, you need eyewitnesses, police reports, photos, notices of lease violation, and specifics. The judge will want to know when, and in what manner, you brought the offensive conduct to the resident’s attention. If there is any question whether or not you did that, make that determination before you file the eviction. Anticipate a comment from the resident to the effect of, “I had no idea they considered that a problem. If they had brought it to my attention, I would have immediately stopped.” Think ahead. Put yourself in the shoes of the resident. How is the judge likely to react to conflicting stories? What can you do to make your evidence more credible? Consider using demonstrative evidence (i.e. things which demonstrate a point through more than words), such as photographs, recordings, copies of important documents, emails and text messages.

What additional witnesses can you bring? What should you emphasize to be convincing and persuasive? There will be conflicting stories, and the judge will be placed into a predicament of whom to believe. The best evidence, presented persuasively, will result in success. Conducting the trial. In an eviction, the apartment community or property owner is the plaintiff. The plaintiff begins and ends a trial; the resi-

The absence of the resident does not mean you are to remain silent. Remember, the judge likely will be unfamiliar with your case facts until you state what they are. Don’t try to transform the judge into a dentist, and require teeth be pulled for the facts to become known. In a short summary lasting two or three minutes, you will impress an appreciative judge and establish yourself as a trial professional. Facts win cases. If you send an eviction service alone to court, then no real evidence will be presented by that individual. Evidence comes from the mouths of people sworn to tell the truth, who then explain what really happened from firsthand knowledge. Even if the resident does not attend the trial, there is an expectation of fairness in the proceedings. Your burden may be eased when you have no opponent present, but it will not be eliminated.

The plaintiff bears the burden of proof, which includes evidence of who, what, when and where, followed by why and how (there is a breach of contract) which is equal to a lease default. Once you establish a lease default, the contract and law provide for you to prevail. Default judgment or contested trial. When the resident fails to appear, there is a default. Nonetheless, you must spend a little time establishing your case. Explain to the judge, in summary fashion, who you are, the basis for having filed the eviction, the facts that created the lease default, and what relief you would like awarded to you in a final judgment.

Your “professional package” inspires respect. Some advanced scripting can overcome your nervousness. Likewise, a little flexibility on your part, in the right circumstances, goes a long way. If you sense the judge may be hesitant to grant you the relief you seek, be proactive. Rather than force the judge to make a decision unfavorable to you, ask whether you can resolve the court’s concerns by offering to agree to delay getting the writ of possession, while still getting the judgment. This may eliminate a needless appeal. Such a proposal also would enable the judge, through an agreement, to allow a few extra days for the resident to vacate. The face-saving opportunity you have created for the judge by such flexibility will be appreciated then, and also in the future cases you will present in that court. Remember, your reputation precedes you. Make yours the best it can be, and conquer the eviction trial!
