H
appy New Year and HELLO 2016! This is the year that you turn it all around. This is the year you stop listening to the voices in your head that keep telling you that you can’t do something; keep telling you that you’re not good enough; keep telling you to keep coasting through life. It’s not easy, but once you make the choice to take the road less-traveled, (in whatever form that may be), the next step is just to show up! Take that class that you’ve wanted to take for as long as you can remember, pick up that instrument that intimidated you. Consider learning it. Show up at the gym, show up at the track, show up to that volunteer meeting that you’ve been waiting to take part in; just show up. As difficult as that may be for some, it will get even more difficult as you do things that challenge you and take you out of your comfort zone. The easy way will always be there waiting for you, but once you make the decision to make yourself better, you may never want to go back. I have always believed that there is an undervalued benefit that comes from putting yourself in an uncomfortable situation. Eventually, those situations become less intimidating but it takes a conscious effort to commit to making this a reality. This year, commit to making yourself better - in whatever form that may be and remember that when the dust settles, you’ll come out stronger than you were before. And I assure you that the dust will settle; it always does. A Nike commercial once commanded, “Drown out the voice of uncertainty with the sound of your own heartbeat.” That’s as deep and philosophical as I hope a Nike commercial ever gets, but it’s motivating and memorable to say the least!
Goals are important, and we continue to set ambitious ones in our local association, and part of the reason is that we have volunteers who continue to show up and take an active role in making sure this association is in better shape year after year without preconceived notions of what the association can do for them. 2015 was a busy year to say the least, but as an organization we have never lost track of making sure that we’re constantly giving back in any way that we can to our community. Most recently we utilized the funds raised throughout the second half of the year during various fundraising efforts for our annual Doc and Gayle Young Food Drive. We helped provide enough meals to feed over 1,350 families during Thanksgiving here in Austin. Huge thanks are in order to everyone who donated and/or helped out on delivery day. It was a long day but it always seems to go by quicker when you’re surrounded by passionate individuals and this event has its fair share of them. In addition our members are committed to helping Mayor Steve Adler’s vision to end veteran homelessness in our community and we continue to make progress on this front. I’m halfway through my term now, and it honestly feels like June was just a few weeks ago. I have a few goals that I hope come to fruition for this association, but
accomplishing them will not come without a little bit of hard work. I’m surrounded by individuals dedicated to doing what is best for the Austin Apartment Association, and in the end they help by serving as a compass, pointing the direction we need to go. Happy New Year once again, and I hope you take full advantage of any opportunity that comes your way in the upcoming year!

Construction Debris Recycling Requirements Begin in 2016 Beginning October 2016 multifamily construction sites will be required to recycle at least fifty percent of the left over construction materials and related waste generated at the site. These recycling requirements will increase to seventy-five percent in year 2020 and ultimately ratchet to ninety-five percent by year 2030. The recycling requirement will be applied to all residential and non-residential construction projects larger than 5,000 square feet. This requirement threshold also applies to apartment unit rehab or remodeling which means construction waste recycling will be required only when the cumulative total rehab or remodeling work exceeds 5,000 square feet. According to the City of Austin, about 1,500 projects in excess of 5,000 square feet received city permits in the 2014-15 budget year and these projects generated an estimated 152,000 tons of material. Because state-by-state definitions differ on what constitutes “recycling,” national figures for recycling construction and demolition materials are difficult to obtain, but recycling requirements like the one passed by the City of Austin are commonplace in many rapidly growing metropolitan areas. These ordnances take aim at the familiar materials found in the waste stream which include wood, estimated to be 27% of total, and the remaining 73% consisting of cardboard and paper, drywall/plaster, insulation, siding, roofing, metal, plastic, pipe, concrete, asphalt, masonry, bricks, dirt and
landscaping material. The City of Austin believes that least 20 percent of all waste in the city is comprised of construction and demolition materials. Early drafts of the ordinance called for the fifty-percent recycling mandate to apply to both construction waste and demolition debris, but the Austin Apartment Association and other stakeholders requested that this requirement be delayed because the market for demolition debris is not robust enough to absorb all of the demolition material generated. In three years the City will study how the ordinance is working and will decided whether or not to include demolition debris in the recycling mandate while at the same time decide if the recycling requirement should be moved to seventy-five percent. Also slated to move in year 2020 is the project size threshold for compliance when all projects 1,000 square feet or larger must meet the recycling requirements. The cost impact to the industry is somewhat uncertain. Using the City’s estimates, the ordinance could increase construction costs by only 0.1 to 0.2 percent under the assumption that processing materials at a recycling facility instead of disposing of them at the landfill adds a penny per pound of material hauled. One staffer pegs the cost to multifamily construction at an extra $20 per ton of hauled material, which adds between 5 and 18 cents per square foot when building a new multifamily structure. Waste haulers that service multifamily construction sites concur that, due to factors
involving access to local landfills and material processing facilities, currently there is relatively small price difference between hauling construction debris to the landfill and hauling that same co-mingled waster to a recycling facility. While it is not known how long this narrow cost difference will remain, large price breaks and cost reductions can be quickly found if the waste hauled from a site is clean loads of wood, metal and concrete not co-mingled thereby creating an incentive to begin the recycling process at the site and move away from the business as usual approach of co-mingling materials. To show compliance with the ordinance projects will be required to submit a report, (typically completed by the waste hauler), identifying the quantity of materials diverted and disposed. Sites that do not comply with the ordinance could face a Class C misdemeanor and a fine of up to $500. There are several Austin Apartment Association members who perform waste hauling and recycling services and you are strongly encourage to discuss your waste hauling plans and options with them to ensure full compliance with the ordinance that goes into effect beginning October 1, 2016. You are also encouraged to contact AAA staff as the cost impacts and other unforeseen issues related to the ordnance become known so that any concerns and/or needed changes can be communicated to policy leaders.

Industry Update
Tenant Relocation Assistance Ordinance Being Drafted Planning and legal staff at the City of Austin staff have been directed draft an ordinance that would establish “tenant relocation assistance requirements” for developers that intend to demolish multifamily properties that would result in the displacement of current tenants. Citing how the “destabilizing repercussions of displacement affect many of the most vulnerable members of our community” the Council established some context for the ordinance by asking for a draft that requires developers
to provide at least six months advance notice to tenants of the final move-out date; allows flexible move-out dates to tenants within the six months after the final move-out date notice is given; and requires property owners to provide relocation and moving stipends to tenants. The draft is expected to be completed by February 2016 and once completed the stakeholder process will include two public meetings to solicit input from tenants and the development community and a public hearing before the Planning

Commission. AAA member input on this topic is needed. he Austin Apartment Association celebrated seven AAA members for winning the prestigious AAA Professional of the Year awards in a special ceremony during the annual Holiday Gala at the Hyatt Downtown Regency. The awards, presented by AAA President Gus Villegas and President-elect Theresa Ebner, were given to those eligible candidates who were nominated, went through an application process and then went through a peer-based judging process. Each of the 86 nominees this year is recognized as a leader in our field, and has proven their dedication to the industry by putting forth the time, money, and effort to further their professional development. What sets our winners apart from all nominees is their additional commitment to the Association as a whole. The winner in each category gives of him or herself through year-round involvement in AAA committees, participation at events, community service activities, and aids us in developing our next generation of award winners and association leaders.

2015 Maintenance Professional of the Year Carl Puckett, CAMT Rainier Management Carl has been a Maintenance Professional with Rainier Management for over five years. In his current position, Carl is oversees maintenance operations for six properties and has a staff of 14 employees. His supervisor says that Carl has shown a steadfast dedication and always goes above and beyond to succeed and to stand by his team. He was a 2015 Professional of the Year Finalist, is an active member of the Education Committee and earned his CAMT in 2015.
2015 Assistant Property Manager of the Year Kara Stevens, CAM Hardrock Canyon, Greystar Kara started in the industry in 2007 and has excelled in her current role of Assistant Manager. Through her outstanding customer service and commitment to residents’ needs, Kara has contributed to both her company and the industry. Her supervisor says Kara is a true leader with a strong work ethic and commitment to excellence. Kara has her CAM and is an active member of the Education Committee, the Community Outreach Committee and the Food Drive Committee.

2015 Property Manager of the Year Michael Garcia, CAM, CAPS The Pointe at Ben White, Capstone Michael joined the industry 10 years ago, spending the last eight working for Capstone. Holding positions from Leasing all the way up to Senior General Manager, Michael’s dedication speaks for itself. His supervisor says that Michael’s leadership style has earned him credibility with his team, as he leads by example and uses opportunities as teachable moments. The first to volunteer when there is any need, Michael demonstrates a strong worth ethic, persistence and intellectual integrity. Michael was a 2014 Professional of the Year finalist. He was awarded a 2015 Solt Scholarship and obtained his CAPS designation in addition to his CAM. 2015 Supervisor of the Year Brooke Mahoney, CAPS Greystar During her seven year tenure with Greystar Management, Brooke has gone above and beyond to ensure her clients are successful and her team members are motivated. Taking great pride in her work, she has high expectations of herself as well as her employees. While staying dedicated to her six properties in Austin and Copperas Cove, she has also remained heavily involved with AAA, TAA and NAA. She has her CAPS designation, was a 2014 AAA Professional of the Year Finalist and won RPM of the year at TAA in 2015. Brooke is also an NAA Lyceum graduate. Brooke serves on the Board of Directors of AAA as well as on many committees.

She is a courteous, organized and effective leader. Her peers have said that if AAA is doing something amazing, you can bet Terri is involved. Her untiring dedication to PSC, Food Drive and the Membership Committees are nothing short of amazing. Terri’s diplomatic ability to listen to ideas of others while offering constructive and helpful feedback in all situations results in her being an incredible cheerleader and contributor to AAA. Over the years, Terri has shown her commitment and growth through the Austin Apartment Association as a member of the Products & Services Council, co-chairing several events, serving on the AAA Board and Executive Committee, the Legislative Committee, the Leadership Committee and as the 2015-2016 AAA Vice President.

Donation makes creation of AAA Education Foundation possible
R
ich Ellmer, the 12th President of the Austin Apartment Association in 1975, remembers a time when the AAA was not as financially stable as it is today. As President of a young association he recalls a very tight budget, one part-time employee, and that most income was generated from monthly dinner meeting fees. (The only other significant source of income was lease sales, but most leases sold by the association were often pirated, which did nothing for the association coffers.) Rich clearly remembers one financial report to the board in which the checkbook balance was a paltry $1,900 - $200 better than the checkbook balance for one year prior. The majority of the members in 1975 were apartment communities renting to UT students and state employees. Today, our members provide housing to over one half of the residents of Austin.

Rich believes educational offerings through our industry association are by far the best in Austin compared to what other industries offer. Our industry may very well create more service industry businesses than any other industry in Austin. Few other industries have members – most without college degrees – who have started, own and run their own companies. No other industry educates and promotes from within as we do, or encourage professional development to the extent the rental housing industry does. We are unique in a way unlike other associations. His gift ensures many generations of future employees are well-educated and the multifamily rental housing industry remains a strong and successful one. Feeds 2015 1,350 Doc & Gayle Families at Young Food Thanksgiving Drive
O I
n 2015, the Doc & Gayle Young Food Drive surpassed the committee’s $50,000 goal and raised over $52,000 to purchase 1,350 food packs for hungry local families. Each food pack contains enough food to feed a family of five their Thanksgiving meal and for a few days after that. Once again the Turkey and Ham teams showed their competitive stripes. The Turkeys reclaimed the crown in 2015 by raising over $14,660 vs. the Hams and their $11,216. A great effort by both teams. The competition next year for our 30th annual food drive is going to be fierce! The Food Drive crew partnered with HEB to purchase over 34 tons of food again this year. HEB employees assembled 1,350 food packs and loaded them onto volunteer delivery trucks from CORT, HD Supply, Maintenance Supply HQ, Pro Valet Trash and Two Men and a Truck. The benefiting agencies this year were: Foundation Communities, The Housing Authority of the City of Austin, SafePlace, and The Rainbow Room. Families receiving the food packs were chosen by these four agencies. The great minds of the Food Drive Committee organized two happy hours (one South and one North), and a BBQ Plate Benefit, in addition to the numerous phone calls, emails, and letters asking AAA members to donate to this year’s drive.

The South happy hour at Moontower Saloon and the North happy hour at Maverick’s raised an astonishing $10,252 through donations at the door and two silent auctions. Lunches with AAA Leadership sold in the silent auctions once again proved to be very lucrative. Football and basketball tickets, jewelry, getaway weekend packages…and of course “booze baskets”… were all a hit in the bidding wars. Clocking another winning year was the BBQ Plate Benefit. The committee sold 329 plates and 39 meal deals, raising a total of $14,685. On a Thursday in October, committee members met before sunrise to assemble plates and deliver all the orders. The delicious barbecue was expertly smoked by the Smokin’ Barrels team (i.e. Travis Fowler and friends), and the sides were provided complements of Rudy’s B-B-Q. Thank you to everyone who helped out. Congratulations to the entire 2015 Doc & Gayle Young Food Drive committee, who spent countless hours volunteering their time. Special thanks to the three chairs: Stephanie Naylor, Kim McGregor and Ben Wells. Also, thank you to the companies who hosted the two happy hours. 16. Who is a role model you look up to and why? Gus, because he works just as hard as anyone. I haven’t come across too many people in the supervisory role willing to sweat with the team. is your property required to recycle Find out about Austin’s Universal Recycling Ordinance
The City of Austin’s Universal Recycling Ordinance (URO) went into effect in 2012 with the ambitious goal of ensuring that all Austinites have access to recycling where they live and work. Nearly 75 percent of Austin’s trash and recycling comes from commercial and multifamily properties. The ordinance is a key component in the City’s strategy to achieve our Zero Waste goal of reducing the amount of trash sent to landfills by 90 percent by 2040. The ordinance includes a four year phase-in affecting the largest properties first. The ordinance establishes minimum recycling standards for multifamily and commercial properties to ensure convenient recycling is available to employees and tenants. As of Oct. 1, 2015, all multifamily properties with 10 or more dwelling units must ensure recycling is available and by Oct. 1, 2017, all commercial properties in Austin will be required to have recycling available. Austin’s commitment to Zero Waste goal is designed to reduce the City’s dependence on expensive landfills, decrease harmful greenhouse gasses and generate new jobs in our community. By recycling more, businesses may be able to reduce the number or size of landfill trash containers or need less frequent collection. Many affected properties have reported a cost savings by adding recycling and optimizing their collection services. To comply with the ordinance, affected properties are required to have convenient access to recycling and must offer collection of the following five materials, at a minimum: • Mixed paper • Cardboard • Glass bottles and jars •#1 and #2 plastic containers • Aluminum
In addition to the materials collected, property owners must also provide the following: • Sufficient recycling capacity (dependent upon property type) ° Multifamily Apartments = more than 6.4 gallons of recycling capacity per week ° Commercial Buildings = at least a one-to-one ratio of recycling to trash capacity • Information and signs in English and Spanish • Annual education for tenants and employees • Completion of the online Annual Diversion Plan between Oct. 1 and Feb. 1 each year Resources and incentives to make compliance easier The City’s Zero Waste Business Rebate provides a financial incentive to encourage businesses to exceed minimum recycling standards or establish recycling programs before their property is affected by the Universal Recycling Ordinance. Rebates up to $1,800 are available to help Austin businesses establish, expand or improve recycling programs. With a simplified application process, businesses can apply with a simple phone call. The rebate supports the Austin business community in meeting the requirements of the Universal Recycling Ordinance and implementing best practices resulting in costs savings for the business and substantial progress towards Zero Waste. Last year, 22 Austin businesses participated in the rebate program and received more than $28,100 for contracting for expanded recycling or composting collection services, purchasing recycling or composting containers and other projects to encourage more diversion from the landfill. “The Austin business community is working hard to recycle. This rebate helps support creative and innovative solutions to keep materials out of area landfills,” said Aiden Cohen.

This past October AAA celebrated our maintenance personnel members at the first annual Maintenance Huddle. The event was a casual affair held at the fun and laid back C. Hunts Ice House. Attendees were treated with two free beers and a free burger and fries from the P. Terry’s food truck. Over 150 AAA maintenance and supplier members enjoyed a pretty fall evening in the beer garden, played a little pool, threw some bones and had a couple of cold ones. ore than 160 industry leaders from around the state attended the threeday TAA Fall Board meeting in Dallas this past fall and to honor TAA Executive Vice President George B. Allen, CAE, who will be retiring December 31 after 35 years of service to the association. TAA Past President Ron Shelton, chair of the EVP Search Committee, announced that the Executive Committee had approved the recommendation of Chris Newton, currently president of the Texas Food and Fuel Association, as the new TAA Executive Vice President. Newton will join TAA January 1, 2016. At the board meeting, the delegates approved a number of changes to the TAA lease forms as a result of the 2015 Legislative Session and recent industry developments. The board also heard updates on a number of legal and legislative issues. All announced that TAA now represents more than two million units, a result of the TAA 2-Step campaign and hard work by local affiliates and members. AAA delegate Dwayne Stewart was one of the twelve members in the TAA Leadership Lyceum class which focused on planning, education, communications and community service.

A good beginning is a discussion of some questionable laws. They can be found in every state and country. They can make you laugh, make you cry, or just make you scratch your head. Did you know, for example, that in the state of Kansas, every legislator, public officer, and lawyer must take an oath stating they have not fought a duel with deadly weapons? I knew there was a reason why I did not take the Kansas bar exam. We mentioned a couple of songs. Beware, however, where you wear your dancing shoes. In the state of Massachusetts, for example, you may pay a fine of no more than $100 if you are found dancing (at all) to the “Star-Spangled Banner.” The state of South Carolina has an interesting law on its books. a woman by falsely promising to marry her. If he is found guilty, he will be charged with a misdemeanor, fined at the court’s discretion, or imprisoned for no longer than one year. Fortunately, depending on your point of view, there are a decent number of exceptions. For example, if the woman who received the promise was already married, or considered “lewd,” (a term which the South Carolina law does not define), the court cannot convict the male of the misdemeanor. In addition, the offender usually walks if no one can corroborate the woman’s testimony. By the time you are reading this Warren Report: Law in Order, this season’s college football champion for the year recently may have been crowned, and it may have been the Alabama Crimson Tide. Fortunately for the celebratory parade, (if in fact Alabama is our new national champion), it is illegal for a driver in Alabama to be blindfolded while driving a vehicle. Even if the vehicle is a parade float. Seriously.
Ohio laws, I suppose, are a bit more practical. In Ohio, it is against state law to get a fish drunk. That’s right, you can get drunk while you fish; but don’t you dare get a fish drunk. Does anyone know how that would be done, if one were so inclined? Perhaps fishing is not your thing. Why not try parachuting? Be careful, however, for unmarried women in Florida who parachute on Sundays can be jailed. Here is another law which seems to be stacked against women. In the state of Vermont, women must obtain written permission from their husbands to wear false teeth. You have to ask yourself, on what grounds would a husband object to the wearing of false teeth by his wife? Now I know why I do not practice law in the state of Vermont. I can honestly say that in all my years of practicing law in Texas, no one has ever asked me to draft a document granting permission to wear false teeth. Thank you, clients. Thank you.

Those of you who have been following the evolution of concealed [gun] carry laws in Texas might find it interesting to compare such laws from the Lone Star State with those of Kentucky. In the state of Kentucky, it is illegal to carry a concealed weapon which is more than six feet long. Texas has no such restriction. Where, however, does one find a holster of that length? Prepare to be on your feet a lot too, for sitting with a holstered gun of that length may be challenging and quite uncomfortable. Getting a bit more local, have you been following the legal challenges to Uber, (the almost taxi company), in the City of Austin? I am not sure, but I do not think Uber is available as a transportation source in London, England. That’s too bad. In London, it is illegal to flag down a taxi if you have the plague. The way Uber is set up, there is no flagging down. For this reason, I think an Uber franchise in London might be quite successful, assuming the plague is still a problem in Big Smoke! www.austinaptassoc.com
Q: She had three children, right? A: Yes. Q: How many were boys? A: None. Q: Were there any girls? Maybe that one is an inside joke. Maybe you have to ask questions for a living for that to be funny. What about this exchange: Q: What is your date of birth? A: July Fifteenth. Q: What year? A: Every year. You might be asking yourself at this point, “Is this stuff supposed to be funny”? Be careful with your questions when speaking with some lawyers. Here is a true (although quite short) story: A new client had just come in to see a famous lawyer. “Can you tell me how much you charge?” asked the client. “Of course,” the lawyer replied, “I charge $200 to answer three questions!” “Well that’s a bit steep, isn’t it? “Yes it is,” said the lawyer, “and what’s your third question?” I think I’m beginning to understand what it’s like to be a comedian who tells a joke yet gets no laughter. Let me go back to Old Faithful, the actual laws themselves. In the state of West Virginia, do not attempt to substitute a ferret for a hunting dog. Anyone who hunts, catches, takes, kills, injures, or pursues a wild animal or bird with a ferret will face a fine of no less than $100, but no more than $500. Jailing is possible with that crime as well. You can be jailed for between 10 and 100 days if your ferret hunts with you while your dog stays home. Be sure your glasses are clean when you leave the house. I looked for unique landlord-tenant laws. Many of you will argue that we have several in the state of Texas.
In the state of New York, however, I found that it is unlawful for three or more people wearing masks to gather in public for a demonstration or to march in protest. This law was originally enacted in 1845, as a result of a situation where local tenant farmers disguised themselves as Native Americans and attacked and killed their landlords. Fortunately for New Yorkers, this law includes exceptions for masquerade parties. Have you ever known of a fashion conscious law? If not, you have not been to Flint, Michigan lately. In 2008, Flint Chief of Police David Dicks made headlines when he ordered his department to arrest anybody wearing “saggy pants.” Despite successful challenges to similar laws in other cities like Riviera Beach, Florida (its local ordinance was declared unconstitutional by the Florida state courts), the Flint, Michigan law is still in effect. Offenders there can face up to one year in jail. Belt anyone? Not all the weird laws are in the United States. Saudi Arabia, for example, is the only country that bans women from driving. News media there have complained how the prohibition forces families to hire live-in drivers. Those who cannot afford to spend the $300 or more a month for a driver must rely on male relatives to drive them to work, school, shopping or the doctor. Is there an Uber nearby? Looking for a law you can use when having a criminal background check conducted on one of your applicants? If your rental property is located in Cuba, articles 72 through 90 of the Cuban Penal Code address the crime of peligrosidad (English translation, “dangerousness”). These Penal Code provisions, under the heading, “The Dangerous Status and Security Measures,” call for someone to be sentenced for up to four years in prison on the grounds that the authorities believe the individual has a “special proclivity” to commit crimes, even though he or she might not actually have committed a crime! How’s that for justice? According to Aristotle, “Law is order, and good law is good order.” Is bad law, then, disorder?

According to a statement issued by The State Administration for Religious Affairs in 2007, the law, which strictly stipulates the procedures by which one is to reincarnate, is “an important move to institutionalize management of reincarnation.” With 2016 being an election year, do we know what our candidates are saying about institutionalizing the management of reincarnation? Isn’t that something you, as a voter, would want to know?

Okay, let’s switch gears here. I promised you some outtakes from courtroom proceedings where lawyers ask questions and witnesses give answers. Consider this actual exchange between a lawyer and a witness:
You may be thinking that too much negativity is involved with some of these laws. Well then, let’s end on a high note with a delightful law from the country of Denmark. There, hospitality is king. In Danish restaurants, you do not have to pay for your food unless, in your own opinion, you are “full” at the end of your meal. If not, you can legally leave the restaurant without paying the bill at all. Houston, Detroit, Cleveland, Memphis and Tampa are not located in the country of Denmark, but rather are in the United States. According to Men’s Fitness magazine, those five cities are the “fattest cities” in America. Having previously lived in Houston, I can say that it is quite challenging to find a Danish restaurant in that city! Now I think I may know why. I may be a week or so late on making a toast to happiness in 2016. That’s too bad. Better late than never, right? So, for each of you, may every day be happier than the last! May you look forward with happiness, and backward without regret. And to quote an anonymous partygoer from a recent New Year’s Eve party, “here’s to a merry, dancing, drinking, laughing, quaffing, and unthinking time!” May all of you, in 2016 and beyond, encounter Law In Order.
