hua hin, THAILAND AWOL has learned this week about a legal case that highlights an issue which has come to the fore in recent months, and that issue is the defamation laws in Thailand, and more importantly, how easy it is to be accused under these laws, which are far stronger than most foreigners are used to in other countries. For legal reasons we cannot go into much detail of the case in question, although we do hope that we can report on it once it has completed; however the basics of it are that a Belgian family, who were staying in Hua Hin, accused another man of indecently touching their young son, and this went to court and was subsequently dismissed by the judge. The family claim to have video evidence of the accused man confessing to this, but this has never been shown in court. The accused man then sued the mother for defamation, and this case is due to begin on 23rd March. The husband is now trying to raise funds so he can post bail for his wife, and details of that and the story from their perspective can be found online at www. gofundme.com/SaveMyLWife. Defamation refers to a category of claims based upon intentionally harmful or false statements “published� in spoken or written form to third parties. Thai law makes no general distinction between spoken (slander) and written (libel) defamation. Further, and of critical importance, is the fact that in Thailand a party can be subjected to civil or criminal litigation for defamation, or both. The defendant is invariably placed in the position of having to prove that their statement was true to escape liability, rather than what might be expected, the plaintiff having to prove it is false. If someone is found guilty in a criminal defamation case, they can face up to two years in prison and up to 200,000 baht in fines, which is no laughing matter.

A section for all you budding etymologists where each week the origin of a word or phrase is investigated. This week it is..... Jack the lad A conspicuously self-assured, carefree and brash young man; a ‘chancer’. The earliest use of the expression came in an 1840 song Jack’s the Lad, with such descriptive lines as: If ever fellow took delight in swigging, gigging, kissing, drinking, fighting Damme, I’ll be bold to say that Jack’s the lad. Who was Jack? Was he an real person? No one knows. It may be that ‘Jack’ was taken as a suitable generic name when the expression was coined, along the same lines as ‘Jack of all trades’ and ‘Jack tar’. If Jack were an actual historical figure the most obvious candidate would be the celebrated Jack Sheppard, the 18th century thief who was caught and imprisoned five times but escaped four times. in the process becoming a popular hero. He certainly had the credentials to be a real Jack the lad, having made audacious escapes and recklessly carefree robberies. Unfortunately for him, he was guarded day and night during his fifth incarceration and was hanged at Tyburn in November 1724. He was 22. Sheppard’s exploits inspired pamphlets, ballads, plays

Mags Meanderings: From Som Tam To Mushy Peas
apron strings If you have been in Thailand for a while you will probably have realised that Thai women can be very conscious of ageing. For some inexplicable reason at 50 they declare ‘I old lady’, and simply disappear from view. I have even heard 40 year olds declare that they are old ladys. It doesn’t matter that they may still be attractive, sociable and have full lives. Something inside them just says ‘hey - time to stay home.’ A generalisation of course, and a way of thinking which is probably becoming out dated. Yet it is a way of thinking which does to some extent still exist in Thailand. Unlike the UK, where the very opposite is happening. Those of you who, like me, are of a certain age, will remember having grandmothers who were always old. From their 50’s until the day they died they seemed not to change at all. They hardly ever bought new clothes, changed their hair, or went somewhere just for the hell of it. Now the tide has turned, and 60 somethings not only want, but expect, a better quality of life in their retirement. Unlike their grandmothers they have earned their own pensions, and armed with their bus passes are free to get out with friends and enjoy themselves. And why not? The number of British women over 60 who are getting their faces fixed is rising rapidly. Perms and blue rinses are definitely out, and role models range from Twiggy and Helen Mirren to Mary Berry. Unfortunately though, at the very time when British women should be free to enjoy retirement, their children begin to place extra burdens on them. Those grown up children need to work themselves, and increasingly depend on their mothers to provide child care for them. (Which sounds sexist - but the reality is that the responsibility does naturally fall on mothers and grandmothers.) The reasons for this social change are many and varied and could fill a book. Needless to say they include inflation and consumerism, but alongside those are equal rights and opportunities for women.

So has it all backfired? Has equality led to unrealistic expectations? There is certainly a trend in the UK for people to want the new house full of new things, with the designer baby and designer dog to complete the ideal vision of family life. The cost of it all is too often a secondary concern, with grandparents left to pick up the pieces at the very time in their lives when they should be free to do their own thing. We often say that Thailand is 50 years behind the West, and in many ways I believe that to be true. The question is - have Thai women actually got the balance right? Do many of them still accept that at a certain age they will disappear from the social scene to take on the full time duty of family matriarch - simply because that is the way things are done and have always been done. While in the UK women are increasingly faced with juggling family responsibilities with the kind of retirement they had once imagined they would have, and which is now alluding them. In case you need at least two Changs to ponder on all that, this weeks word is an easy one. ‘Titular’ - is having an important or impressive title but without the power or duties which would normally be associated with it. A good example being ‘the Queen is titular head of the Church of England.’

weird NEWS uK Political party is banned because its name is ‘offensive to women’ A political party has been banned from this year’s general election for using an incredibly offensive word beginning with ‘C’ in its name. That’s right. ‘Crumpet’. Right-thinking officials at the Electoral Commission called time on the Beer, Baccy and Crumpet party this week, sayingin a letter, ‘The review considered that the word ‘crumpet’ is likely to be considered as describing women as a sexual object. ‘The Commission has now decided it will remove, ‘Beer, Baccy and Crumpet Party’ from the register of political parties for Great Britain. In an ingenious defence, founder Ray Hall said, ‘C is for crime, R is for rates, M is for money, E education, T is taxation – it was a clever little gimmick really. ‘I’ve really been nobbled here – the timing is terrible. Everything is geared up for the Beer, Baccy and Crumpet party with the leaflets and the website and so on, and there’s only two months to go now. The party has an unusual list of policies including reducing duty on draught beer, and came 7th out of 14 parties in the Eastleigh by-election.

usa Woman dug up father’s grave to find hidden will but found only booze and fags A woman has admitted digging up her father’s grave to look for his ‘real will’. However, Melanie Nash, 53, didn’t end up any richer – she just found vodka and cigarettes. She was one of four accused in the plan to open Eddie Nash’s vault in Colebrook, New Hampshire, then rifle through his coffin last May in a scene a prosecutor compared to an Edgar Allan Poe story. Police said she felt she was shorted in her share of the inheritance after her father died in 2004. They didn’t find a will in the casket. Nash, who faced trial in March, instead agreed to plead guilty to charges of criminal mischief, interference with a cemetery, conspiracy, and abuse of a corpse. Her sentencing is scheduled for May 5. Two others pleaded guilty; a third person was acquitted. Nash told police she did not receive anything when her father died and had been thinking of digging up the grave for years to prove that her sister, Susie Nash, ‘hid the will.’ Susie Nash has said there was only one will when her father’s estate plan was done in 1995 and everyone involved knew about it. In a written statement to police last June, Melanie Nash wrote that she met up with the others to go to the cemetery. She wrote: ‘All this was done for the right reasons and I know my father would be OK with it.’ She ended her statement with: ‘What we all did was to dig up my father’s coffin, Eddie Nash, looking for documents. We did it with respect.’
Her lawyer argued her statements were given before she was informed of her right against self-incrimination. But a judge ruled that she freely came to the police station after a warrant had been issued for her arrest and voluntarily gave her statements. Eddie Nash, who died of a heart attack at 68, started an equipment business in 1979 still run by his family. He’s since been reburied. After her sister pleaded guilty, Susie Nash told The Caledonian Record that she is relieved the case is at last resolved but that the effects will linger. ‘It still leaves an impact on you,’ she said. ‘Every time I visit the cemetery, I will be thinking of this.’ usa Man calls police to tell them his wife stole his cocaine When you’re doing something illegal, it’s usually best not to alert the strong arm of the law. So Robert Collins no doubt wishes he hadn’t called police to report his wife for stealing his stash of cocaine. Unsurprisingly, cops took a dim view when the 39-year-old from Alliance, Ohio, called 911 to shop his wife. Instead of receiving the ‘justice’ he thought she deserved, blundering Collins was hit with two misdemeanour charges. He was also arrested for failing to pay costs in an earlier court case. Sounding very disorientated in the 911 call, released by Fox News 8, Collins said: ‘Me and my wife had a misunderstanding about something I bought. I bought some cocaine earlier and she wanted to take my cocaine.’ It did not take long for officers to come knocking, and they discovered a marijuana pipe at his address. But he was less co-operative when confronted with police, and refused to tell them why he had called 911. To finish a bad day for him, he was charged with two misdemeanor counts, alleging improper use of the 911 system and possession of drug paraphernalia. usa Cheeky Chihuahua sneaks into owner’s luggage A pet dog really didn’t want to be separated from his owner. So when she went for a trip, the cheeky Chihuahua sneaked into her suitcase, but was rumbled by airport security. Transportation Security Administration officers at New York’s LaGuardia Airport said the seven-year-old Chihuahua crawled into its owner’s case and curled up when she had her back turned while packing for a flight to Los Angeles last week. But as her black, hard-sided case was screened, it sparked an unknown contents alarm and was opened for inspection. The owner’s husband later collected the dog and took it home.

uK Aston Villa FC have announced details of an open top parade through Birmingham city centre following their 2-0 FA Cup quarterfinal victory over local rivals West Bromwich Albion. A club spokesman, Trevor Mount, claimed the atmosphere around the club was a throwback to its 80’s hey-day. “Saturday was like the halcyon European Cup days of the 1980’s, replete with thousands of mindless hooligans invading the pitch,” he told reporters. “But it only served to add to the nostalgic feel around the place.” “The manager, the club’s board and the club’s sponsors are simply ecstatic to see the fans buying into that 1980’s spirit.” “We only hope they carried on the celebrations by arranging a massive fight in a local car park having racially abused any foreign passers-by
