A

s property owners in Mexico, we know that hurricane season starts as early as May and tends to affect our coastlines until the end of the year with tropical storms on radar as late as November of each year. We also want to think about the extreme heat that Mexico brings onto the structures we own. By taking the proper steps to protect our most valuable assets in Mexico, we can help mitigate normal wear and tear that our structures endure in our tropical climate. Here are a couple of questions to ask yourself? • When was the last time I weather proofed my home? • When was the last time I sealed the roof of my home and checked for any leaks? • When was the last time I had any cracks patched or filled on any of my structures that could result in water infiltration in heavy rains?

PRO TIP 1 Seal up any gaps in doors, windows and pipes Windows remain one of the most common sources of leaks in our homes. Time and weather can cause the caulking that 4

seals in your door jams and windows to expand and contract. Over time, this causes caulk to crack, crumble or wear out, which leaves your home vulnerable to the elements. When it comes to heavy rainfall and flooding, you’ll want to do everything possible to minimize sealant gaps to prevent water or other debris from entering your residence. For less than $20.00, you can invest in a basic caulking gun and waterproof sealant. This can easily fix and maintain any potential cracks. When this sealant is applied, it will fill the open spaces around a window to form a durable, airtight and water-resistant seal. Also, check for gaps in areas where cable and telephone wires, outlets, vents, and pipes that enter the home. PRO Tip 2 Clean your home’s gutters and avoid water and moisture accumulation Common in Mexico is water accumulation. This is usually caused by a poor drainage design, either the gutters do not have the proper angle to drain the water away from the home or the extreme rain and wind from a hurricane is just too much for the gutters to handle and water back up occurs, far too fast. How do my gutters and drainage respond to heavy rains at my home or condo in Mexico? This question should be examined and tested to avoid water accumulation and standing water. Water accumulation is “No Bueno” for many reasons. The #1 reason is the threat of mold, still water and of course deterioration to structures and walls over time. Reducing the risk of flooding and long-lasting damage to your home or condo should be an annual task. Damaged, non-functional gutters may lead to foundation damage due to rain water that remains near the home and filters toward the foundation. After this water accumulates around the foundation, it will soak into the concrete. A proactive approach is key when owning a home in Mexico, particularly when it comes to gutter cleaning and proper drainage of water. Remember, it is always better to be on the side of caution when it comes to your home or condo in Mexico. Evaluating these areas of your home during off-season will help ensure you can avoid a potential disaster later. PRO Tip 3 Weather Proof My Roof Homes in Mexico for the most part have concrete roofs or Spanish tile over concrete. When we think concrete, we think fortress, unbreakable, strong. The reality is that water will find its way into your home if there is a crack or an opening in the roof. Even if your home is newly constructed, built in the last 5 years, it’s time to have your roof inspected. A proper inspection must take place first and foremost. When it comes to inspection and repair, it is recommended to contract a professional roofer that understands what to look for. A simple visual inspection is not enough as the tiles must be examined and tested. i

Capital Gains on the sale of your home in Cabo

S

elling your home anywhere is a stressful experience. Finding out at closing that your net proceeds is vastly lower than you expected is a dreadful and avoidable experience.

Capital gains tax is assessed on the profit gained by selling a property. It is possible, however, to reduce or eliminate your capital gains tax, but the process starts immediately after purchase of your home. Whenever possible, get legal with the Immigration Department of Mexico. Exemptions on capital gains tax applies to foreigners who have permanent resident status in Mexico, and of course, Mexican nationals. The exemption has a limit of 700,000 UDIS (investment units) per each seller, which is a variable rate, currently equivalent to approximately $240,000 USD. The exemption applies up to this amount of the sales price, and the exceeding portion of the sales price will still be subject to the capital gains tax. Next, obtain a factura (legal official tax receipt) for any major expenditures fixed improvements on your home. (in Mexico, only fixed improvements are deductible from capital gains tax, furniture & appliances are not deductible items). Because the requirements can change annually, retain these records, along with all your utility bills. Make sure your utility bills are in your name and show the correct address of your home subject to the sale. This is additional proof of residency. When you list your property, request assistance from your agent to obtain a capital gains exposure estimate. This can be obtained from many attorneys or Notario Publicos, w. Whoho might charge you a small fee for doing the capital gains tax study. In many cases, additional steps may be taken to minimize your capital gains tax. Knowing your position in advance helps mitigate the stress of selling your home. If you are currently listed, and don’t know your capital gains exposure, ask your agent immediately for assistance in obtaining this information. i

BUYERS, KNOW YOUR CONTRACT! by Julie Kershner

B

uying property in Los Cabos is an exciting venture, however like the saying goes, “don’t leave your brains at the border!” When writing the Offer to Purchase your dream property in Los Cabos, protect yourself. Be knowledgeable about the components of the contract.

Ask yourself:

1 How am I paying for this? Because financing is not readily available, the vast majority of purchases are made in

cash. Unfortunately, some agents don’t consider the source of funds. If there is a 3rd party involved in the process, i.e. a bank loan, relative loan, etc., make sure you include a financing contingency in the offer. Many times an agent will present a contract, and when I ask the source of funds the answer is a bank loan in the States. I reply, you should include a financing contingency and they are surprised, as the buyers are not asking for owner financing and will be wiring the cash to escrow. A financing contingency is protection for the buyer.

2 Another possibility regarding the source of funds, if there is a house closing involved and the purchase will be

paid from the proceeds of the closing, a house closing contingency protects the buyer.

If the purchase is for a house or condo, new construction or resale, include an inspection contingency. Even new construction may have issues to be corrected. An inspection contingency protects the buyer.

If you are purchasing in a planned community with an active Home Owners Association, be sure to obtain a copy of the Rules and Regulations. Perhaps there are restrictions against pets on property. If you have a beloved pet, this would be of great interest to you. A deeds restriction contingency protects the buyer.

If you are purchasing raw land outside of a master planned community, you probably would like to know the dimensions and location of the lot lines. A survey contingency protects the buyer. 10


6 If you are purchasing a furnished property, ask

for an inventory contingency. This insures there are no misunderstandings as to what items are included in the sale. An inventory contingency protects the buyer.

7 If the property is rented or has future rentals, insist

on clarifying the situation prior to mutual acceptance on a contract. A “tenant occupied clause� protects the buyer. There are many other items which may be needed, depending on the situation, but remember, a simple offer to purchase with no contingencies will not offer any protection to the buyer. Truthfully, in a real estate purchase, both parties want the same thing. The protections afforded to the buyer through various contingencies, also benefit the seller, as it clarifies the situation for all parties.
