rchitect Martinez is the second of seven siblings and worked from a young age to help his mother as his father passed away when he was a young child at 9-years of age. Federico was born and raised in Torreon, Coahuila and proved himself a fighter when he survived polio at 2-years of age. He moves to Mexico City to study architecture where he would not only work for a famed architect and architectural firms but would also become close friends to celebrated architects. As we sit in his ocean-view office and admire his art collection which includes Goytia, Toledo, Tamayo, and many other talented and famous artists. Architect Federico G. Martinez recalls the day in which 32 years ago his high blood pressure made him move to Los Cabos where in lifetime of success he has designed and built dream homes for high-profile personalities.

Almost ready to go along with the rest of his day he picks a bottle of red wine from his 1,000 bottle wine cellar collection, he tells us he believes that life is meant to be lived at its most as he quotes his 96-year old mother “The only bad thing about life, is that it´s too short”.

One of his day activities after his retirement consists of waking up to enjoy the sunrise and shoot around 150 pictures of it and His appreciation and commitment to Los Cabos have made him an share five or six of them on social media. Ninety years ago on September 30, 1930 a local celebrity and socialite was born; being the youngest of eight, Mrs. Emma Palacios de Olachea came to this world marked by mythical stars of success and triumph.

er father, Mr. Joaquín Palacios Magro was born and raised in Madrid, Spain and later in life he married Mrs. Palacios mother, the young and talented Carmen Avilés Agúndez who was native to San Felipe, Baja California Sur.

Mrs. Palacios de Olachea´s life has been marked by early family achievements in the peninsula, as her grandfather Engineer Joaquín Palacios Gómez was a highlyrecognized personality in Southern Baja. With many local achievements he marked his name in Cabo´s history, as the man who determined the exact place and location of the now known Old LightHouse located within the Quivira community in Cabo San Lucas.


“Doña Emma” or “Emita” as her family and friends call her, was also gifted with a beautiful singing voice and the ability to perform and she mentions that she was always eager to participate in local talent shows in San José del Cabo. Ahead of her time and at a young age, she was also sports minded and participated in many marathons, while also becoming a javelin throw champion.

SHE ALWAYS MANAGED TO STAY IN TOUCH WITH LOCAL PEOPLE WHO SHE LOVED VERY MUCH.

Her basic studies took place in San José del Cabo and she later traveled to Mexico City to certify as a bilingual secretary. Once she obtained her professional certification she came back to her native land and married Mr. Abel Olachea Ceseña who was a well-respected rancher, business man and the owner of the local shop called La Josefina. Their family home was located in downtown San José del Cabo in house number 7, where the town square now stands. Their three children Miguel Angel, Patricia and Abel inherited their business talents and today they all lead successful luxury real estate careers. Mrs. Olachea is proud to share with us that in her lifetime she hosted firstlevel personalities such as the Mexican President Adolfo López Mateos, General Agustín Olachea and the renowned Mexican politician Hugo Cervantes del Rio, among many others. Her hectic days as a mother and a socialite kept her busy; however she always managed to stay in touch with local people who she loved very much. “Emita” recalls being the only bilingual woman in the area which allowed her to establish cherished friendships with celebrities like Bing Crosby and Kathy Thompson. During the early 80’s she worked for Fonatur which is the National Tourism Fund, where she learned about the urban planning of Los Cabos and this inspired her to create the local “Hospital de las Monjas y Dispensario”, which in English means, the Nun’s Hospital and Dispensary.

Doña Emma feels that her altruistic heart has allowed her to give to her community and that it was her charitable actions that also allowed her to meet Pope John Paul II, which was a lifelong dream of hers. As Mrs. Emma Palacios de Olachea is ready to rest after a hectic February afternoon, she shares with us her pride for her local roots and her love for Baja California Sur.

Grand Opening of The Rancho San Lucas Golf Club

n February 20, people came from near and far, to celebrate the grand opening of The Rancho San Lucas Golf Club and The Greg Norman Signature Golf Course, situated within the 834-acre master-planned community of Rancho San Lucas. Owning Real Estate in Los Cabos By Blake Harrington

Y

ou’ve been to Cabo a few times and with our perfect weather yeararound, beautiful beaches, stunning sunsets, and attractive lifestyle, you are now considering a more permanent move to Cabo. You are not alone! In the past 10 years, thousands of residents in Cabo have migrated from the United States and Canada making Los Cabos their home. Owning Real Estate is entirely possible and many foreign investors/buyers have come to the market to pick up on great deals in stable and safe Baja California Sur. The basics for foreign investment revolves around the method of purchase available for foreigners, a bank trust called the “Fideicomiso”. The Mexican government realized they needed to make foreign

investment available in Mexico and passed the Foreign Investment Act of 1993. Since the Mexican Constitution prohibits foreigners from owning property within 60 miles of the U.S. border, or within 30 miles off the coastline (as Los Cabos is), a secure form of holding title was needed and created with the implementation of the North American Free Trade Agreement (NAFTA) in 1994. The “Fideicomiso” is a trust, just like an estate trust in the U.S., which gives the Purchaser all rights of ownership and is the legal equivalent of Deeded Property, as we refer to it in the States. In order to obtain rights of ownership, the Department of Foreign Affairs in Mexico City issues a permit to the Mexican bank of the buyer’s choice, which allows the bank to act as “Purchaser” of the property. Simply put, the bank acts as the “Trustee” for the trust and the Purchaser is the “Beneficiary” of the

trust. The trust is not an asset of the bank - the banks only act as the Trustee to hold the trust. Just like living wills and estate trusts in the U.S., the Mexican bank, or Trustee, takes instruction only from the Beneficiary of the trust. The Beneficiary has the right to use, occupy, lease/rent and possess the property, including the right to build and improve the property as well. The Beneficiary may also sell the property by transferring the rights to another individual. The term of the trust is 50 years, but the trust can be renewed for additional periods of 50 years indefinitely, thus allowing long term control over the property.
