new eatery is preparing to open its doors in downtown Pensacola bringing fast, fresh and affordable food options specifically prepared for individuals to grab-and-go.

Occupying a historic 1940s-era cottage at 1617 West Garden Street, the Camellia Grab-n-Go will offer an assortment of fresh, southerninspired deli options fused with worldly flavors—all conveniently packaged to enjoy on-the-go.

“The Camellia menu will feature a variety of convenient hot and cold deli options inspired by flavor and family history,” Camellia Owner Steve Stein said.

Featuring freshly prepared cold salads, sides, spreads and sandwiches, the Camellia will offer a variety of elevated foods and snacks for individuals seeking a tasty take-out option they can enjoy at any destination.

“As a carry-out only restaurant, our goal is to provide service to those on the go, or those seeking destination dining at local places such as Blue Wahoos stadium, Bruce Beach Park, Legion Field, boat trips, Pensacola Beach, Opera al Fresco, Bands on the Beach, Blues on the Bay, Bands on the Bayou or dinner at home with family and friends,” Stein explained.

The menu will boast a variety of higher-end southern-inspired options, including everything from housemade spreads to an assortment of southern sides and artisan sandwiches, all of which will be served on freshly baked baguettes from Craft Bakery.

“If sandwiches are not your thing, you can also enjoy our meats and cold salads in bulk,” Stein explained. “Craft baguettes and pita chips will be available for the cold salads and variety of homemade spreads, which include baba ganoush, eggplant and artichoke dip, hummus, egg and green olive dip and a black olive tapenade.”

Regularly available housemade salads will include a balsamic coleslaw (no mayo), Moroccan mint carrot salad, black-eyed pea salad (aka cowboy caviar) and a simple, raw shredded cabbage and carrot mix.

Individuals will also be able to help themselves to an assortment of hot side dishes, such as organic cheese grits, red beans and rice with a Caribbean flavor profile, gumbo ya ya (shrimp, chicken and andouille) as well as an occasional soup or stew special.

The Camellia will have a variety of housemade condiments, including ranch dressing, salsa verde, tomato coulis and barbeque sauces from The Shed BBQ in Pensacola.

“Other small snacks and lite fares, such as cheese sandwiches and peanut butter and jelly sandwiches, mixed fruit cups and veggie sticks, will also be available for individuals looking for something a little more simple. Big Jerk Soda will serve as our local soft drink representative, alongside Coke products and iced tea options. Beer and wine for off-site consumption is in the works as well,” Stein said.

The carefully curated menu reflects an assortment of cuisines and flavors inspired by Stein’s beloved family recipes and dishes from some of his favorite restaurants, including a few from his college days, where he attended pharmacy school at Ole Miss.

Since moving to Pensacola from the high desert of the Oregon/ Idaho border in 2018, Stein has served as a cook for a number of local restaurants.

“I am a cook. I cook all the time and love it. Even after a long day of work, I’ll often find myself in my kitchen at home whipping up supper. I have always cooked but really got into it at Ole Miss and out west when I lived in Oregon, where the nearby dining options were

extremely limited and homogenous,” Stein said.

Stein’s goal is to offer fresh, fast and affordable foods that are not only perfect for meals and snacks, but also for entertaining. Each of the freshly prepared menu items will be packaged and stored in a set of large refrigerator-coolers inside the restaurant, providing a quick and tasty alternative to other take out options in the area.

“Our main goal is to get you in and out as fast as possible so you can get on with your work or good times. I would describe the Camellia as a cross between an elevated bodega deli and a brick and mortar food truck with a grocery food counter,” Stein explained. “We will have most items already prepared for you to grab, then go; however, there will also be a few specialty or modified preparations (i.e. gluten free) available for short order or advanced

ordering online, so you won’t have to wait around. It’s a small place, so our goal is to keep everyone moving.” Aside from online ordering, which Stein highly recommends, the Camellia will also provide the option for curbside pick-ups.

Whether you’re looking for something tasty for a picnic in the park or something to stock the cooler for a day out on the boat, the Camellia serves as the perfect pit stop for elevated snacks, sandwiches and salads that you can easily grab-and-go to enjoy at the destination of your choice.

DISTRICT 3 ENSLEY NORTH NEIGHBORHOOD CLEANUP ON AUG. 14

Join us in keeping our neighborhoods clean and safe! A neighborhood cleanup for residents in Ensley North will take place Wednesday, Aug. 14. This is a chance for residents to dispose of items such as old furniture, appliances and household waste free of charge. Yard debris is eligible for removal during this cleanup.

Only residents in the designated cleanup area can participate in the neighborhood cleanup. Please have all items for pickup at the curb by 7 a.m. on the day of the cleanup.

Items left at the curb outside of the cleanup area will not be collected. If you live in the targeted area, you will have received a postcard in the mail with more information.

Residents can view the boundaries of targeted cleanup areas as well as scheduled cleanup dates for 2024 on the Interactive Neighborhood Cleanup Map.

Items eligible for removal include:

• Household appliances and electronics

• Household junk and debris

• Bicycles and toys

• Old furniture and mattresses

• Barbecue grills

• Household hazardous waste (old paint, motor oil, chemicals, batteries)

• Tires (limit 10 per household)

Items NOT eligible for removal include:

• Building materials (concrete, bricks, blocks, roofing, drywall or lumber)

• Explosives or ammunition

• Auto parts

• Dirt or sod

• Vehicles or vessels

Since 2016, more than 6,915 tons (13,830,000 pounds) of waste have been disposed of through the Community Redevelopment Agency's Safe Neighborhood Program. During neighborhood cleanups, crew members and volunteers visit different neighborhoods in the county to remove a variety of debris and waste free of charge.

PUBLIC INVITED TO GIVE INPUT ON BIKING IN PENSACOLA

The City of Pensacola invites the public to complete a survey about biking in Pensacola to help the city become a designated Bicycle Friendly Community through the League of American Bicyclists (LAB) Bicycle Friendly America program.

The survey, which is the next step after applying to the LAB's Bicycle Friendly America program, is part of the city's ongoing effort to implement strategies outlined in the 2023 Active Transportation Plan — which identifies actions to help improve mobility in the city.

The program is a way for states, communities, businesses and universities to make biking a true transportation and recreation option for all and recognize those who make great strides in doing so. Serving as a major economic development tool for the city, a Bicycle Friendly Community designation will provide an opportunity to make the Pensacola community a vibrant destination for residents and visitors alike — a

place where people not only live and work but also thrive.

There are three levels of recognition available, gold, silver and bronze. If awarded, the Bicycle Friendly Community designation will provide a roadmap to improve conditions for biking and aid in creating a distinct vision for a better, bikeable community.

As part of the application review process, the program requires local jurisdictions to disseminate a survey created by LAB to capture local community sentiments on biking. Community members interested in providing their feedback can take the online survey at surveymonkey.com/r/BFC_2024 until Tuesday, Oct. 15. PERDIDO KEY CELEBRATES FIRST SEA TURTLE HATCH OF THE SEASON

Perdido Key celebrated its first sea turtle hatch of the season on Friday, Aug. 2. 70 hatchlings were confirmed to have entered the Gulf of Mexico, despite being disoriented by artificial lightning.

Nearly 60% of all turtle hatchlings will be disoriented by land-based lights, which can cause them to wander away from the Gulf of Mexico. Hatchlings that don't reach the water quickly risk dehydration, starvation and predation. Disoriented hatchlings can also stray onto busy roads, garages and swimming pools.

Permitted volunteers are trained in disoriented hatchling response and recovery. Still, naturally dark beaches are the best assurance for ensuring hatchling turtles make it to the water where they belong. 25 nests remain on county beaches, and August and September are peak hatchling season. Every hatchling counts! Help protect nesting sea turtles and other coastal wildlife by remembering:

• Lights Out! Both hatchling and nesting turtles need dark beaches to find the Gulf of Mexico. Leave the flashlights and cell

phones at home or use a red flashlight on the beach at night. Turn off beachfacing lights and close the windows and curtains to keep our beaches dark.

• Leave Only Footprints! Remove all furniture and toys from the beach when you're done for the day, including hammocks, tents, canopies, chairs, toys and sports equipment.

• If You Dig It, Fill It! Large holes, trenches, and moats create dangerous obstacles for hatchling and nesting sea turtles. Avoid digging large holes on the beach, fill in holes after digging them, and flatten sand castles when finished building them.

MAYOR'S NEIGHBORHOOD CLEANUP COLLECTS NEARLY 56 TONS OF BULK WASTE

The July Mayor's Neighborhood Cleanup collected nearly 56 tons (111,690 pounds) of bulk waste, along with 127 tires and 541 gallons of paint. The cleanup took place Saturday, July 27 with five loads picked up from the Camelot, Creighton, Evergreen and Parker Circle areas, including portions of surrounding neighborhoods.

The Mayor's Neighborhood Cleanup allows residents in the cleanup areas to leave eligible items at the curb on cleanup day to be picked up by City of Pensacola Sanitation Services. The cleanup includes bulk items

LANDRUMHR 5K TO BENEFIT LAKEVIEW CENTER

Runners, walkers, and all those passionate about mental health are invited to join the Second Annual LandrumHR 5K Run/Walk on Saturday, Oct. 12. The 5K starts at 8 a.m. from the LandrumHR office in downtown Pensacola, located at 219 E. Garden Street. Proceeds from the event will benefit Lakeview Center, which last year served more than 27,000 adults and children with mental illnesses, drug and alcohol dependencies, and intellectual disabilities.

The LandrumHR 5K strives to promote awareness of the link between physical and mental health. According to the National Institutes of Health, exercise improves mental health by reducing anxiety, depression, and negative mood while boosting self-esteem and cognitive function. These health benefits can be achieved with as little as 30 minutes of moderately intense exercise – like brisk walking – three times a week.

“Last year’s 5K raised $15,000 benefitting much-needed behavioral health services at Lakeview Center, and we are thrilled to work with Lakeview Center on this second annual event,” said Britt Landrum, III, President and CEO of LandrumHR. “This event was designed to highlight the important integration between physical and mental health to the community. We’re encouraging people to run or walk the event with the goal of simply getting people moving.”

From Escambia to Walton County, Lakeview Center offers more than 60 programs ranging from inpatient and residential treatments to outpatient counseling, psychiatry, trauma care, treatments for substance misuse and 24/7 support for those with serious mental illnesses.

Today, Five Sisters’ Blues Café received $50,000 from the Backing Historic Small Restaurants Grant Program, a program presented by the National Trust for Historic Preservation and American Express. This funding will support a number of exterior renovations including a marque sign refurbishment, mural, front entry relocation with ADA improvements and exterior lighting upgrades. Five Sisters’ is one of 50 historic small restaurants across the country to receive a grant, and the only one in the state of Florida.

According to Collier Merrill, President of Great Southern Restaurants, “Receiving this grant is an incredible opportunity for Five Sisters as well as the historic Belmont DeVilliers neighborhood. This funding will help to continue the revitalization of this neighborhood all of which helps us to preserve our cultural heritage for generations to come.”

The Backing Historic Small Restaurants grant program significantly expanded its reach this year, doubling the number of grantees, including 13 new states, and has increased the total grant funding to $2.5 million, up for $1 million in prior years.

In its fourth year, the program now has reached nearly 125 historic small restaurants in every U.S. state, Washington D.C. and Puerto Rico. American Express launched the Backing Historic Small Restaurants program in 2021 in partnership with the National Trust for Historic Preservation to support historic and culturally significant restaurants during the pandemic. The program has since expanded its in scale and financial support to continue helping independently owned small restaurants serve their local communities for years to come.

“Small restaurants are vital to our communities, and their impact perseveres, as they continue to innovate and make their neighborhoods more vibrant and connected,” said Madge Thomas, Head of Corporate Sustainability at American Express. “This year’s grantees represent the rich traditions and iconic stories of communities across the U.S. I’m so proud that we’re able to help them grow and continue to build their legacy.”

The National Trust for Historic Preservation, which administers the Backing Historic Small Restaurants grant program, selected this year’s grantees from a group of restaurants that operate in historic buildings or neighborhoods and provide cultural significance to their communities through their history, cuisine, and locations. Many of the 2024 grant recipients include establishments that are family owned or have been operating for generations.

ESCAMBIA COUNTY SEEKS APPLICANTS FOR THE ESCAMBIA CHILDREN'S TRUST

The Escambia County Board of County Commissioners is seeking applications from county residents to be nominated for gubernatorial appointment to the Escambia Children’s Trust. To be considered, applicants must submit the completed Escambia Children’s Trust application and questionnaire for gubernatorial appointments with an optional resume by 5:00 p.m. on Tuesday, Aug. 20.

The Board of County Commissioners will nominate three applicants per vacancy to be submitted to the Governor for review and potential appointment. Following the Board’s selection, the County Administrator will notify the Governor’s Appointments Office of the selected applicants and additional steps from the nominees may be required.

To be considered for the Escambia Children’s Trust, Florida Statute criteria include

the requirement that nominees have been residents of Escambia County for the previous 24 months and are willing to submit an annual Statement of Financial Interests Form. Florida Statutes also require that gubernatorial appointments are representative of the demographic diversity of the County’s population. Per Section 125.901, Florida Statutes, the Escambia Children's Trust shall consist of 10 members, including:

• The superintendent of schools;

• A School Board member as appointed by the School Board;

• The Department of Children and Families District Administrator, or his or her designee;

• A judge assigned to juvenile cases as appointed by the Chief Judge;

• A County Commissioner as appointed by the Board of County Commissioners; and

• Five members appointed by the Governor from candidates nominated by the Board of County Commissioners to serve a fouryear term.

STATE, LOCAL AGENCIES COULD FACE INJURY TABS

Florida senators have filed 17 bills seeking payments of as much as $28 million for people who suffered injuries and damages because of actions of state and local government agencies.

The proposals, a certain type of legislation known as “claim” bills, will be considered during the 2025 legislative session. The largest amounts of money are sought because of alleged negligence by the Florida Department of Children and Families that resulted in catastrophic injuries to children, but the bills also involve such things as injuries suffered in traffic accidents.

The bills are needed, at least in part, because of a state sovereign-immunity law that generally limits the amounts of money government agencies can be forced to pay in lawsuits to $200,000 or $300,000, depending on how many people are involved. Claim bills allow payments that are higher than the limits.

The 17 proposals were filed before a Friday deadline for claim bills. Other types of bills for the 2025 session will start to be filed later this year. Here are brief descriptions of the five largest claim bills:

— SB 12, filed by Sen. Joe Gruters, R-Sarasota, seeks $28 million to help care for a Sarasota child, identified by the initials L.P., who was stabbed 14 times by her mother in 2015.

The bill said the Sarasota Police Department, which had received a call about mental-health issues involving the mother, contacted the Department of Children and Families about possible child abuse. DCF employees went to the home “but failed to identify the mother of L.P., much less identify several forewarnings as to the mother’s mental health status,” the bill said.

Later, the mother tried to murder the 6-year-old child, including trying to disembowel her, the bill said. A lawsuit led to a jury finding DCF negligent in 2022 and awarding $28 million in damages, but the agency could only pay $200,000 without a claim bill.

— SB 2, filed by Sen. Ana Maria Rodriguez, R-Homestead, seeks $20 million because of injuries suffered by a Fort Myers child, identified by the initials C.C., who overdosed on his mother’s methadone in 2015.

The bill said the child was born in 2014 addicted to methadone because of his mother’s drug abuse and was hospitalized for a month in a neonatal intensive-care unit.

The Department of Children and Families received multiple reports before and after the child’s birth about the mother’s drug use and potential child abuse, the bill said.

In September 2015, when the child was 13 months old, he overdosed on methadone

and suffered brain and other injuries that will require “lifelong care,” the bill said. It seeks $20 million because of DCF’s alleged negligence.

— SB 18, filed by Gruters, seeks $14.926 million because of “catastrophic and permanent injuries” suffered in 2017 by a child identified by the initials H.H.

The bill said the Department of Children and Families received reports about issues such as drug use, neglect and abuse by the child’s mother and stepfather. After DCF closed two investigations and received other reports, the girl was hospitalized in September 2017 with head and other injuries and was “determined to be the victim of severe, prolonged, repeated, life-threatening physical abuse that caused permanent damage,” the bill said.

The mother and stepfather were charged with child abuse and other crimes and sentenced to prison, the bill said. The $14.926 million, if approved, would be put in a trust for the child, who was about 22 months old at the time of the abuse. The bill does not say where the abuse occurred.

— SB 28, filed by Sen. Jonathan Martin, R-Fort Myers, seeks $6.1 million from the South Broward Hospital District because of injuries suffered at birth by a child identified by the initials J.R.

The bill said the child’s mother, Darline Angervil, went to the district’s Memorial Hospital West in January 2014 when she was about 30 weeks pregnant and suffering complications such as high-blood pressure and headaches. The bill said she was diagnosed with the condition preeclampsia and underwent a cesarean delivery more than two days after being admitted to the hospital.

The baby girl weighed 2 pounds, 5 ounces at birth and suffered extensive injuries that require 24-hour nursing care, the bill said. Angervil filed a lawsuit alleging negligent care and reached a $6.4 million agreement with the district in 2023. The district paid $300,000, but passage of a claim bill would be needed to pay the rest of the money.

— SB 6, filed by Rodriguez, seeks $4.1 million after a settlement stemming from a Miami-Dade County bus hitting pedestrian Jose Correa in December 2021.

The bill said Correa was using a crosswalk at an intersection when a bus driver made a left turn and hit him. Correa suffered injuries that included requiring amputation of a leg below the knee, according to the bill.

Correa filed a lawsuit against the county and reached a $4.3 million settlement, the bill said. Under the sovereign-immunity law, the county paid $200,000 but would need legislative direction to pay the remaining $4.1 million.

IDALIA AND DEBBY LIKE ‘NIGHT AND DAY’

Nearly a year ago, Linda Wicker found her waterfront restaurant covered in 6 feet of mud and marsh grass after Hurricane Idalia slammed into Taylor County.

The Category 4 storm required four months of cleanup and repairs to reopen Roy’s Restaurant, which sits along the Steinhatchee River.

On Tuesday, Wicker said she was “blessed” after Hurricane Debby, a rainmaker that didn’t cause anywhere near as much damage as Idalia. She plans to reopen Roy’s, her family business for more than two decades, on Thursday.

“As things turned out, we are so thankful that there’s no damage,” Wicker said.

“We’ve just had some very loyal customers over the years, friends, family and we are going to be really happy to welcome everybody back,” Wicker added.

Debby made landfall Monday morning near Steinhatchee as a Category 1 hurricane with maximum sustained winds of 80 mph. It came after rural Taylor County last August also took the brunt of Idalia, which made landfall in Keaton Beach.

Debby moved across North Florida and into Georgia on Monday, dumping heavy rain. By midday Tuesday, the center of what had become Tropical Storm Debby was just south of Savannah, Ga., according to the National Hurricane Center.

Taylor County Sheriff Wayne Padgett said Tuesday the priority was getting electricity back on in the region.

“The biggest issue right now is power, getting power back up, getting people back home and situated and in the air conditioning where they can cool off,” Padgett said. Utilities were down to 89,000 customers in Florida without power, after more than 600,000 outages were reported, according to

Incoming Senate President Ben Albritton and a political committee he leads have appealed after a Lake County circuit judge refused to dismiss a lawsuit alleging that a Senate candidate was defamed by a mail piece linking him to China.

Lawyers for Albritton and the Florida Republican Senatorial Campaign Committee on Tuesday filed a petition at the 5th District Court of Appeal contending that Circuit Judge Dan Mosley erred in denying a motion to dismiss the lawsuit filed by Republican candidate Bowen Kou.

Kou is running in the Aug. 20 primary for an open seat in Central Florida’s Senate District 13. Albritton and the committee are backing one of his opponents, Rep. Keith Truenow, R-Tavares.

The lawsuit stems from a mail piece that the committee sent to voters that said, in part, “Why are Chinese donors (from all over the country) flooding Bowen Kou (Lake County state Senate race) with cash?” Kou, a businessman who moved to the United States from China, alleges in the lawsuit that the mailer communicated that he is “controlled by the Chinese Communist Party and takes money from China.”

But in the petition filed Tuesday, lawyers for Albritton, R-Wauchula, and the political committee said Kou’s lawsuit “materially misrepresented the clear language in the mailer, essentially rewriting it.”

“Boiled down, this case is about political speech made during an election by a political entity,” the petition said. “If the First Amendment to the U.S. Constitution protects one thing, it’s political speech.”

Mosley on July 29 issued a two-page order denying the motion to dismiss, saying that the lawsuit “is legally sufficient to set forth a cause of action for libel.” The order did not provide a more-detailed explanation.

The mail piece, which was sent in late June, also included a quote from a Politico report that referred to, “The ‘absolute explosion’ of foreign interference in U.S. politics.” It also included a list of Kou campaign donors, including people of Chinese descent, and said, “80% of Kou’s donations are from outside of Florida.”

The mailer included a graphic with arrows pointing to other parts of the United States and to China.

The lawsuit, filed June 28, argued that the “mailer is false and defames plaintiff by misleading voters into believing that Mr. Kou has received political donations from China. Plaintiff Bowen Kou has never received political donations from China, Chinese citizens, or members of the Chinese Communist Party.”

Also, it said the “mailer falsely states that the American Republicans of Chinese descent who have donated to Mr. Kou are living in China and are members of the Chinese Communist Party. The mailer does so by displaying a large arrow pointing to the nation of China on a map with an overlaying flag of China, a nation ruled solely by the Chinese Communist Party.”

But in Tuesday’s petition, lawyers for Albritton and the political committee disputed what they described as “conclusory” allegations made in the lawsuit.

“There’s a clear conflict between Mr. Kou’s complaint and the mailer. … According to Mr. Kou, the mailer states that he ‘received political donations from China.’ But the mailer makes no such claim. On the back of the mailer, only donors from Illinois, California, Indiana, New Jersey, Michigan, Texas, North Carolina, and New York are listed. None are from China,” said the petition filed by Tallahassee attorneys Mohammad Jazil and Michael Beato.

Also, the petition said the graphic with the arrows “doesn’t state (or even suggest) that Mr. Kou has accepted donations from any resident of China.”

“To bring this point home, if Mr. Kou’s allegations are correct, then he can point on the mailer to at least one listed donor, who donated at least one dollar, who also has a Chinese address,” the petition said. “The problem is that he can’t. The mailer contains no such information whatsoever on that point.”

Kou, whose campaign website says he owns nine grocery stores, has put about $1.14 million of his money into the race, a state database shows. Kou, Truenow, Republican Cheryl “CJ” Blancett and Democrat Stephanie Dukes are running to replace term-limited Sen. Dennis Baxley, R-Eustis, in the district, which is made up of Lake County and part of Orange County.

Kou is represented by lawyer Anthony Sabatini, a former state House member who is chairman of the Lake County Republican Party.

PowerOutage.us. Taylor County accounted for 7,900 of the remaining outages, or just over half of its utility customers. Suwannee County had 11,852 outages, Madison County was at 11,546, Columbia County had 11,194, Dixie County was at 10,595 and Jefferson County was at 8,797.

The Florida Municipal Electric Association, meanwhile, said Tuesday afternoon it had restored power to virtually all of the 80,000 municipal-utility customers who had outages.

While the state started recovery efforts, Gov. Ron DeSantis described Idalia and Debby as “night and day.”

“With Idalia there was debris everywhere,” DeSantis said during an appearance at Roy’s.

“This is a very heavily wooded area … There (were) trees down. There were things all over the roads. It was a lot, particularly in places like Taylor (County) and Dixie County,” DeSantis said. “As you get into North Central Florida, what I've seen (from Debby) has not even come close to that. And you wouldn't expect that. Idalia was just a hair under a Category 4 hurricane. It was a major hurricane. And it didn't leave the same amount of water that we've seen in other parts of the state, but it did pack a really significant punch. And so, ultimately, that's a good thing.”

But while Debby wasn’t as destructive as Idalia, DeSantis said that doesn’t lessen the impact on people who have gone through both.

“To then have another storm come through as you're still picking up the pieces, even if it wasn't as powerful, it's almost like salt in the wound,” DeSantis said.

Flooding is expected over the next few days, which could affect homes and businesses across northern and central Florida.

At least four deaths in Florida have been attributed to the storm, with two in Dixie County, one in Hillsborough County and one in Levy County. A teen died in Levy County after a tree crashed through the roof of a mobile home.

The other deaths involved vehicle crashes.

Second Amendment groups and a Palm Beach County gun owner Tuesday filed a federal lawsuit challenging the constitutionality of a Florida law that bars people from openly carrying firearms.

Gun Owners of America, the Gun Owners Foundation and gun owner Richard Hughes filed the lawsuit in South Florida and contended that the open-carry ban does not meet a legal test that such restrictions must be consistent with the nation’s “historical tradition” of firearms regulation.

“Despite its reputation as a largely gunfriendly state, Florida inexplicably continues to prohibit the peaceable carrying of firearms in an open and unconcealed manner,” the lawsuit said. “The blatant infringement of the Second Amendment right to ‘bear arms’ runs counter to this nation’s historical tradition and would have criminalized the very colonists who openly carried their muskets and mustered on the greens at Lexington and Concord to fight for their independence.”

The lawsuit comes after Gov. Ron DeSantis and the Republican-controlled Legislature last year eliminated a longstanding requirement that people obtain state concealed-weapons licenses to be able to carry guns. But lawmakers did not allow people to openly carry firearms, drawing criticism from some Second Amendment activists who said the changes did not go far enough.

The lawsuit, which was first reported Monday by Fox News, names as defendants St. Lucie County Sheriff Keith Pearson and Thomas Bakkedahl, the state attorney in the 19th Judicial Circuit, which is made up of St. Lucie, Indian River, Martin and Okeechobee counties.

It cites the enforcement of the opencarry ban by Pearson and Bakkedahl, though it does not make clear why they are defendants and other law-enforcement officials are not.

The Florida Supreme Court in 2017, however, upheld the open-carry ban in a case stemming from the arrest of a man in St.

Lucie County. Justices, in a 4-2 ruling, said the state law "regulates only one manner of bearing arms and does not impair the exercise of the fundamental right to bear arms."

The new lawsuit contends that the 2017 decision was wrong based on U.S. Supreme Court precedents.

While Hughes lives in Palm Beach County, the lawsuit said he sometimes goes to St. Lucie County and would like to openly carry a gun while there. For example, it said he goes to a St. Lucie County nature preserve at least once a month with his dogs and attends a Port St. Lucie gun show.

The lawsuit relies heavily on a series of U.S. Supreme Court decisions since 2008. That includes a 2022 decision in a case known as New York State Rifle & Pistol Association v. Bruen that focused on the “historical tradition” of firearms regulation.

“According to the United States Supreme Court, the only way Florida can justify such an extreme restriction is to show a broad and enduring Founding-era historical tradition of governments banning the peaceable open carry of firearms by law-abiding persons, such that demonstrates that the Founders never understood the Second Amendment to protect open carry in the first place,” the lawsuit said. “That is an absurd proposition and a hurdle that Florida simply cannot bear.”

The lawsuit acknowledged that the U.S. Supreme Court has not decided an opencarry case, but it said the court’s “decisions nevertheless guide and control the inquiry here and demonstrate that the challenged statute is unconstitutional.”

The National Rifle Association is making similar “historical tradition” arguments as it challenges a 2018 Florida law that prevents people under age 21 from buying rifles and other long guns. A federal district judge upheld the law, but the NRA is challenging the ruling at the 11th U.S. Circuit Court of Appeals.

The Legislature and then-Gov. Rick Scott approved the age restriction after the February 2018 mass shooting at Parkland’s Marjory Stoneman Douglas High School that killed 17 people.

Herrera, against the above-referenced Defendants in an action for a declaratory judgment pursuant to Fla. Stat.
