Kicking off November 3 and running through November 14, the annual Foo Foo Fest is spearheaded and coordinated by local nonprofit, Arts, Culture and Entertainment, Inc. (more widely known as ACE). The event serves as an umbrella for the many of the city’s existing annual cultural events that typi cally occur in the fall and as an opportunity for newer events to contribute to the cultural landscape of Pensacola. Maria Goldberg, Foo Foo Festival board chair, is excited about the volume, diversity and qual ity of the events being presented as part of this year’s Foo Foo Fest “The great thing about Foo, is that it’s different every year,” Goldberg said. “There’s a little something for everybody, and

For 2022, ACE awarded more than $400,000 in Foo Foo Fest grants to 12 local arts and culture organizations, whose events and performances will serve as anchors throughout the 14 days of Foo Foo festivities.
In addition to the headlin ing events, the Foo Foo Fest committee also accepts applica tions from other nonprofit and for-profit entities interested in taking part in this year’s event as a “Friend of Foo.” Nonprof its or local for-profit businesses such as hoteliers, restaurants and bars who are interested in participating, and whose events meet the cultural mission of Foo

While the personal and creative impact of Foo Foo’s cultural contributions cannot be denied, neither can the economic impact. Dr. Rick Harper, an ACE board member and highly respected economist, recently discussed the results of several ACE commissioned research studies from Haas Center for Business Research and Economic Development at The University of West Florida regarding Foo Foo Fest. “The studies surveyed Foo Foo Fest attendees to assess spend ing by out of town visitors that would not have occurred absent the Festival,” Harper explained. “The Haas study of the 2021 Festival found Foo Foo Fest visitor spending was responsible for 136 net new jobs (spread across the local econ

By way of contrast, these figures are some eight to 10 times greater than the amounts shown in the Haas study of the 2016 Foo Foo Fest for these same metrics.”
Harper says the reason for the growth is clear—aware ness. “In 2016, only 38 percent of respondents said that they had been aware of Foo Foo Fest prior to their visit,” he said. “Of those who had been aware, 73 percent said it played a role in their planning. In contrast, the 2021 surveys showed that 89.5 percent were aware of Foo Foo prior to traveling, and 65 percent of visitors said Foo Foo Fest was the primary reason for their visit to Pensacola. ESCAMBIA COUNTY SEEKS APPLICANTS FOR THE CHILDREN’S SERVICES COUNCIL
The Escambia County Board of County Commissioners is seeking applications from county residents to serve on the Children’s Services Council (CSC). Applications are available online at MyEscambia.com or in person at the Ernie Lee Magaha Government Build ing, located at 221 Palafox Place, 4th floor. The application consists of several parts: an Escambia County CSC appli cation, a questionnaire for Gubernatorial Appointments and an optional resume. Both applications must be completed and submitted together to be consid ered for an appointment. The deadline to apply is Nov. 15, 2022, by 5 p.m. CST. On Nov. 3, 2020, 61% of partici pating voters in Escambia County supported the creation of the Children Services Council to be funded by an increase in ad valorem taxes of up to a maximum of 0.5 mil. The Children’s Trust of Escambia County will provide early childhood education, safety, devel opmental, preventative, health, and wellbeing services, including after school and summer enrichment programs.
The CSC is responsible for assess ing the needs of the children in the county and developing a strategic plan for addressing unmet needs, which must then be submitted to the Board. The CSC, like the county, must also go through the process of adopting a millage rate and budget in accordance with Florida’s Truth In Millage (TRIM) Act, and the CSC must submit an annual report to the Board as required by Florida law.
To be considered for the CSC, Flor
ida Statute criteria include the require ment that nominees have been residents of Escambia County for the previous 24-month period and are willing to submit an annual Statement of Finan cial Interests Form. Florida Statutes also require that gubernatorial appointments are representative of the demographic diversity of the county’s population.
After the application deadline of Nov. 15, 2022, has passed, the eligible appli cants will be compiled for the Board’s consideration during the Dec. 8, 2022, meeting. The Board of County Commis sioners will nominate six applicants to be submitted to the Governor for review and potential appointment.
Following the Board’s selection, the County Administrator will then send a letter to the Governor and the Governor’s Appointments Office with the list of six nominees to be considered for appoint ment to the CSC. All of candidates will be notified of their nomination. In accor dance with Florida Statutes, the Gover nor then has 45 days to make a selection or request a new list of candidates.
Per Section 125.901, Florida Statutes, the Children’s Services Council (CSC) shall consist of 10 members, including:
• The superintendent of schools; A School Board member as appoint ed by the School Board;
The Department of Children and Families District Administrator, or his or her designee;
• A judge assigned to juvenile cases as appointed by the Chief Judge;
• A County Commissioner as appoint ed by the Board of County Commis sioners; and
• Five members appointed by the Governor from candidates nomi nated by the Board of County Com missioners to serve a four-year term.

Escambia County Fire Rescue will hold a physical abilities test Monday, Nov. 14. The test will take place at Pensacola Fire Department Station 4, 1 N. “Q” St., at 8 a.m. and is open to anyone interested in joining Escambia County Fire Rescue.
Certified firefighters with a certifi cate of completion must sign up for the certified test. Those without any fire certifications must sign up for the cadet test. The certified test is also open to volunteer firefighters needing a physi cal abilities test.
In order to become an Escambia County Firefighter, participants must pass the test. Interviews for those who pass the test will take place the following day.

RYAN MATTOX SELECTED AS OSCEOLA GOLF COURSE MANAGER
Ryan Mattox has been selected as the new Osceola Golf Course Manager, responsible for overseeing the operation of the city-owned golf course and main taining an exceptional golfing experi ence for residents and visitors.
Mattox is the founder of Impact Golf Academy at Stonebrook Golf Club in Pace, Florida, where he developed a junior golf program in addition to providing instruction to adult golfers. He has a wealth of golf management experience, previously serving as the Head Golf Professional at Pensacola Country Club from 2012-2016.
His first day in his new role as Osceola Golf Course Manager was Monday, Oct. 17.

Mattox will also oversee employee work procedures, training and supervision, with a goal of improving the efficiency and effectiveness of golf course operations.

The National Association of Profes sional Employer Organizations (NAPEO) announced today that Britt Landrum III, president and CEO of Pensacola, FL-based LandrumHR, has been elected to the association’s Board of Directors during its annual member meeting on September 13.
Landrum is among nine new industry leaders elected to serve as directors on the association’s board for the 2022-23 term. NAPEO membership elected the new slate of candidates on September 13, 2022, at NAPEO’s Annual Conference & Marketplace in Palm Springs, California.
Landrum is an experienced PEO executive and well-known industry leader. He previously served on the NAPEO Board from 2013 to 2017 and has maintained an active role on several NAPEO committees. He also served
as chairman of the Employer Services Assurance Corporation (ESAC), the official accreditation and financial assurance organization for the PEO industry. TALLAHASSEE — After a federal judge rejected an earlier attempt, students, parents and teachers have filed a revised lawsuit seeking to block a new Florida law that restricts class room instruction on gender identity and sexual orientation.
The challenge, filed Thursday in the Northern District of Florida, argues that the plaintiffs have suffered “concrete harms” from the law (HB 1557), which spurred a fierce debate this year in the Legislature and has drawn national attention.
“They have been denied equal educational opportunities they would like to receive, in the curriculum and beyond, and they have been subjected to a discriminatory educational envi ronment that treats LGBTQ people and issues as something to be shunned and avoided, on pain of discipline and liabil ity,” the 60-page lawsuit said. “This type of overtly discriminatory treatment has no place in a free democratic society and should not be permitted to stand.”
U.S. District Judge Allen Winsor on Sept. 29 dismissed an earlier version of the lawsuit, finding that plaintiffs did not have legal standing. Winsor, however, said the plaintiffs could file a revised lawsuit.
The law prevents instruction on gender identity and sexual orientation in kindergarten through third grade and requires that such instruction be “ageappropriate … in accordance with state academic standards” in older grades.
Republican lawmakers titled the measure the “Parental Rights in Educa tion” bill. Opponents labeled it the “Don’t Say Gay” bill.
The revised lawsuit alleges that the measure violates constitutional dueprocess, equal-protection and First Amendment rights, along with a federal law known as Title IX, which bars sex-based discrimination in education programs.
Plaintiffs are two students in MiamiDade County and Manatee County schools, two lesbian couples with chil dren in Miami-Dade County schools, a woman with children in Orange County schools and two teachers in Broward County and Pasco County schools. The defendants are the State Board of Educa tion, the Florida Department of Educa tion and the school boards in Broward, Manatee, Miami-Dade, Orange and Pasco counties.

Gov. Ron DeSantis on Friday said the state will provide $1.3 million for infra structure improvements in Marathon that will help in the development of a 110-unit resort spearheaded by the founder of the Bass Pro Shops retail chain. The money from the state’s Job Growth Grant Fund will help Marathon widen part of U.S. 1, install sewer lines and increase wastewater capacity. “This new expansion will bring jobs, restau rants, entertainment,” DeSantis said while on Valhalla Island in Marathon. DeSantis was accompanied by Bass Pro Shops founder and CEO Johnny Morris, who has been working for years to open the mixed-use “nature-based” Valhalla Island Resort. “This isn’t just an over

“The principal problem is that most of plaintiffs’ alleged harm is not plausibly tied to the law’s enforcement so much as the law’s very existence,” Winsor wrote. “Plaintiffs contend the law’s passage, the sentiment behind it, the legislators’ motivation, and the message the law conveys all cause them harm. But no injunction can unwind any of that.”
The revised version, however, seeks to link the law with harm. As examples, it cited a decision by the Miami-Dade County School Board to reject a reso lution designating October as LGBTQ History Month; said one of the student plaintiffs, identified by the initials M.A., could not find a teacher will ing to sponsor the Gay-Straight Alli ance at a Manatee County school; and said Broward County schools removed LGBTQ-related books after receiving complaints from the conservative group Moms for Liberty.
Also, the lawsuit cited an Oct. 19 decision by the State Board of Educa tion to approve a rule that could lead to teachers losing their licenses for violat ing the law.
“The intended impact of this law is apparent,” the lawsuit said. “It seeks to undo the equal inclusion of LGBTQ people and issues in Florida’s schools and to impede policies requiring equal treatment and support of LGBTQ students. Presented with vague prohi bitions under the threat of litigation, schools and educators have been and will be chilled from discussing or even referencing LGBTQ people, and LGBTQ students have been and will be stigmatized, ostracized, and denied the educational opportunities that their nonLGBTQ peers receive.”
While lawyers for the state have not filed a response to the revised lawsuit, they disputed in a June court document that the Legislature “acted out of animus against LGBTQ individuals.”
“The bill reflects no governmen tal preference about what students should learn about sexual orientation and gender identity,” the state’s lawyers wrote. “Those subjects must be taught appropriately and, for the youngest chil dren, they may be taught by parents, not in public-school classroom settings. That is a legitimate (state) interest.”
Students, parents and a non-profit group filed a separate challenge to the law this summer in federal court in Orlando. U.S. District Judge Wendy Berger on Oct. 20 dismissed that case but, like Winsor, gave the plaintiffs an opportunity to file a revised version. The deadline for filing is Thursday.

TALLAHASSEE --- Florida motorists can expect to pay more at the pump as the state’s month-long gas tax “holiday” ends.
The average price of a gallon of regu lar unleaded gas Monday stood at $3.29, about a dime cheaper than at the start of October. But the AAA auto club said that likely will change quickly when the state’s 25.3-cent-a-gallon gas tax returns Tuesday, after being suspended in October by lawmakers and Gov. Ron DeSantis.
“So it stands to reason that when the gas tax is reinstated on Tuesday, drivers will see a 25-cent jump at the pump,” the auto club said in a news release.
The tax break helped reduce the aver age price of a gallon of gas from $3.39 to $3.17 over the first five days of October, but an announcement by OPEC and its allies to cut oil production put the brakes on savings.
With oil prices jumping 17 percent globally since the OPEC announcement, Florida’s average increased to $3.41 a gallon by Oct. 14.
Pump prices have slowly declined again after President Joe Biden announced plans to draw an additional 15 million barrels from the nation’s reserves by the end of the year to offset the production cut.
During a gubernatorial debate last week in Fort Pierce, Democratic candi date Charlie Crist criticized the tax holi day being held in the run-up to the Nov. 8 election.

CAMPAIGN MATCHING FUNDS TOP $11.9M
Florida on Friday doled out $371,268 in the latest round of matching funds for statewide candidates, with Gov. Ron DeSantis and Democratic gubernatorial candidate Charlie Crist getting most of the money. The latest amounts brought the total this year to $11.92 million, the most ever for a single election cycle, according to the state Division of Elec tions. With $216,792 distributed to his campaign on Friday, DeSantis has received $6.77 million from the program. Crist got $132,852 on Friday and is up to $3.38 million overall. Republican Chief Financial Officer Jimmy Patronis pulled in $4,500 on Friday to bring his total to $212,826. Adam Hattersley, a

DeSantis, who signed the tax holi day as part of a larger package of tax breaks, has blamed global inflation and economic conditions on Biden Admin istration policies, which he said Crist supported.
“We have the fifth-lowest gas prices in the country right now because we did do a gas tax holiday. We’re proud of that,” DeSantis said during the debate.
DeSantis also pointed to a plan to ask lawmakers in 2023 to give frequent SunPass and E-Pass users a 50 percent monthly credit, which would be applied for a full year.
The state gas tax is used for trans portation projects, and the tax holiday was estimated to reduce revenues by about $200 million. The state plans to tap a surplus of general revenue to make up the lost money. Similarly, DeSantis wants to use the surplus to make up any reductions in revenues from his proposal to give credits to frequent toll-road users.
Florida’s average gas price of $3.29 on Monday compared to a national aver age of $3.76, according to AAA. Florida hit an all-time average high of $4.89 a gallon on June 13 before prices declined through the summer.
The lowest average prices Monday were in the Panhandle, while the high est prices were in the West Palm Beach, Gainesville and Naples areas.
The national average was $3.80 a gallon when October began and leaped to $3.90 after the OPEC announcement.
Democrat running against Patronis in the Nov. 8 election, has received a total of $157,540, with $8,974 sent his way on Friday. Republican Attorney General Ashley Moody picked up $8,150 on Friday to bring her total to $275,863. Her Democratic challenger, Aramis Ayala, isn’t participating in the program. The two candidates for agriculture commis sioner, Democrat Naomi Blemur and Republican Wilton Simpson, have not drawn money from the program. Nikki Fried, who lost a Democratic gubernato rial primary, and Daniel Uhlfelder, who lost a Democratic primary for attor ney general, also received matching funds. Under the program, matches are provided for contributions of $250 or less from individuals to statewide candi dates’ campaign accounts. Candidates drew $9.85 million in matching funds in 2018, $4.3 million in 2014 and $6.06 million in 2010.

TRANSGENDER TREATMENT RESTRICTIONS BACKED
TALLAHASSEE --- A key medical panel on Friday signed off on a draft rule --pushed by Gov. Ron DeSantis’ administra tion --- that would restrict Florida doctors from providing treatments to transgender people under age 18, setting up a final decision next week that likely will lead to a legal challenge.
A joint committee of the Florida Board of Medicine and the Florida Board of Osteopathic Medicine heard five hours of at-times raucous testimony from experts, parents and the public --- including trans gender men and women and people who have “detransitioned” --- before approving the draft rule.
The proposal, slated for a Nov. 4 final vote by the full medical boards, would prohibit doctors from prescribing pubertyblocking, hormone and hormone “antag onist” treatments for patients under age 18. The plan also would ban surgical treat ments for minors, which experts have said is rare.
Friday’s action came after the Florida Department of Health in July filed a peti tion seeking a rule-making process on the contentious issue of treatment for gender dysphoria.
The petition proposed prohibiting doctors from using medical interventions such as surgery or medications to treat minors diagnosed with gender dysphoria, which the federal government defines clin ically as “significant distress that a person may feel when sex or gender assigned at birth is not the same as their identity.”
The proposal given preliminary approval Friday would be prospective, meaning children already receiving hormone therapy or puberty blockers would be allowed to continue the treat ment. The committee discussed requiring parents to sign a consent form for such treatments to continue but did not final ize guidelines.
The committee also added a provision
that would allow minors to begin receiving treatments such as puberty blockers if they participate in a federally approved clini cal trial at a university-affiliated center. No such trials are underway in Florida, according to an initial review.
Chloe Cole, an 18-year-old from Cali fornia, was among the detransitioners who told of worsening mental-health problems, complications after surgery and lax medi cal care during or following treatment.
Cole said she had a double mastectomy at age 15 and urged the committee to adopt the proposal.
“All of the talk about mental health, selfperception, pronouns and ideology leads me to this question: Why is the mental health epidemic not being addressed with mental health treatment, to get at the root causes for why female adolescents like me want to reject their bodies?” Cole said.
But Mary Flynn, a consulting psychol ogist whose 12-year-old daughter is trans gender, defended gender-affirming care for children, when appropriate.
“It’s a joy to raise this beautiful child, and everything we’ve heard before is nothing that I’ve ever heard before in any support group, by any physician, by anything,” Flynn said. “If we did not have this medicine, she would not be alive. … What you’re talking about is waiting until age 18. Well, they won’t be here. This group commits suicide.”
LGBTQ advocates said the rule, if given final approval, would be challenged in court.
“Unquestionably there will be legal challenges,” attorney Simone Chriss, director of the Trans Rights Initiative at the Southern Legal Counsel organization, said during a news conference organized by the advocacy group Equality Florida.
Sujatha Prabhakaran, a Sarasota doctor who treats transgender patients, called the proposal “medically unsafe and cruel.” She said she is unaware of any clini cal studies, such as those outlined in the proposal, ongoing in the state.

“I’m not surprised actually but, as far as I can see right now, there are no trials here in Florida and I think that just points to, again, the stigma and discrimination that trans people face here in Florida,” she said.
Six experts invited to participate in Friday’s meeting had opposing views on gender-affirming treatment, with critics pointing to a lack of “high-qual ity evidence” to support it. Proponents, meanwhile, argued that years of studies and practice show the treatment to be safe and effective and that denial of treatment can be dangerous.
Treatment opponents contended that gender dysphoria is a mental health issue that should be treated with psychologi cal care.
“We’re talking about are there any randomized control studies” that compare groups of patients who received hormone therapy or puberty blockers to those who receive mental health treatment, said Michael Laidlaw, a California-based endocrinologist. “We don’t have highquality evidence, based on that.”
But Yale School of Medicine professor Meredithe McNamara disputed Laidlaw’s conclusions.
“To state the matter firmly and posi tively, gender-affirming care for gender dysphoria does meet generally accepted medical standards. It is not experimen tal or investigational. Gender-affirming care is supported by every major medical organization,” McNamara, who special izes in adolescent medicine, said, adding, “this consensus is based on a solid body of evidence” of more than 16 studies.
The panel ran out of time before agree ing on how to require “informed consent” from parents and children who already are receiving hormone therapy or puberty blockers.
“We recognize there may be actually some harm to stop,” David Diamond, a Winter Park oncologist who chairs the Board of Medicine, said. “These folks are undergoing treatment. … The intent is simply to say the rule allows you to continue, but please understand that you need to be aware of these complexities.”
Ed Tellechea, a longtime lawyer
for the medical boards, noted the state has informed-consent requirements for medical-marijuana treatment and cataract surgery.
“When we did those informed consent, we drafted these forms in multiple meet ings, and we’re not getting that right now. We’re getting the broad outlines of what you want to see,” he said.
Throughout Friday’s meeting, Florida Board of Medicine member Zachariah Zachariah, who chaired the committee, cautioned members of the audience who broke out in cheers or jeers.
For example, LGBTQ advocates erupted after Zachariah announced that public testimony had ended and refused to allow state Rep. Anna Eskamani, D-Orlando, to speak.
Zachariah chided Eskamani, who told the panel she is a lawmaker.
“You should know better. … You know how the House runs in the state of Florida. So you should obey the same rules,” he said.
Treatment for transgender people, and youths in particular, has become a fiercely debated political issue in Florida and other states. Prominent medical groups and the Biden administration support treatments for gender dysphoria, while many Repub licans such as DeSantis, who is widely seen as a top contender for the GOP pres idential nomination in 2024, maintain the treatments should not be provided to people under 18.
Also this year, the DeSantis adminis tration issued a rule preventing Medicaid reimbursements for gender-affirming care for transgender people of all ages.
That rule is being challenged in federal court.
During Friday’s news conference, Chriss, a lawyer who represents plaintiffs in the lawsuit, tried to reassure transgender Floridians and their families.
“We’ve got your back. We are actively litigating the Medicaid ban and we will fight this one as well, and these things cannot stand. These folks know that it’s unconstitutional. They know that it’s wrong and they’re doing it,” she said.
