ANNOUNCES

AWARDS FOR TWO PENSACOLA PROJECTS

The U.S. Department of Transportation (DOT) recently awarded grants for two Pensacola projects through its Reconnecting Communities Pilot (RCP) Program.

A total of 82 projects in cities across the U.S. were selected to receive federal funding through the grant program. One of two local projects selected to receive funding was the Hollice T. Williams Stormwater Park Underdeck and Community Connector Project.

In late January, the City of Pensacola announced the $5 million grant award for the Hollice T. Williams Park project to complement and further fuel the construction of the Hollice T. Williams Stormwater Park to help reconnect Pensacola’s eastside neighborhood.

The Reconnecting Communities Pilot (RCP) Grant Program was established by the Bipartisan Infrastructure Law (BIL) to help reconnect communities previously cut off from economic opportunities by transportation infrastructure.

The goal of the program is to advance community-centered transportation connection projects, with a priority for projects that benefit disadvantaged communities, that:

• Improve access to daily necessities such as jobs, education, healthcare, food, nature and recreation

• Foster equitable development and restoration

The grant funds will be used to help fund the construction of the Hollice T. Williams Stormwater Park Underdeck and Community Connector Project. This project will remove the "under the highway" urban barrier beneath Interstate 110, thus uniting the Eastside neighborhood adjacent to the project area.

The total cost to complete the project is estimated to cost $10 million.

The project will focus on improving the 1.3 mile-park area and amenities, expanding and beau -

tifying the stormwater pond and connecting the park and pond to the surrounding neighborhoods.

Largely hidden from public view, Long Hollow Stormwater Pond is located adjacent to Hollice T. Williams Park, and is one of a series of retention pond areas that overflowed during a 2014 rainstorm. This overflow contributed to massive flooding in downtown Pensacola and untreated water runoff into Pensacola Bay. The Hollice T. Williams Design and Expansion project aims to address these and other stormwater issues by expanding the Long Hollow Pond and improving flood control throughout the park area.

"We have a vision of what the Hollice T. Williams Stormwater Park can become," Pensacola

Mayor D.C. Reeves said. "This is the first money we can use to make this more than a stormwater collection system. This enables us to connect the surrounding neighborhoods in a transformational way."

The city also proposes introducing a 1.7-acre multi-modal pathway network, a 9-acre public open space, a multi-use trail and Class 1 bicycle path to create a new connection to North Palafox Street to the park, which will provide direct and safe access for people traveling to jobs, resources and local destinations.

The project also includes proposed improvements to rail crossings, crosswalks, sidewalks, pedestrian-scale lighting and ADA upgrades.

"A few generations ago, this area under the interstate was a vibrant neighborhood, which we now know as the 'Lost Neighborhood.'

I'm hopeful that this project will culminate with a park design that is worthy of the people who lived— and live—there, and be an exciting, engaging community space for generations to come," Reeves said.

Over the past 20 years, several efforts have been made to improve Hollice T. Williams Park and its surrounding areas, which was left

when hundreds of residents were displaced during the construction of the I-110 overpass in the late 1960s and early 1970s.

The current park design effort, following the recent Equitable Development Framework Plan and the city’s new strategic plan, will work to involve residents in the planning process and integrate the history of the ‘Lost Neighborhood’ into the overall park design.

In addition to the $5 million capital construction grant awarded to the City of Pensacola for Hollice T. Williams, Bluffline Inc., a Pensacolabased nonprofit organization, was also the recipient of a $1.2 million grant to study waterfront access improvements along Escambia Bay.

Bluffline Inc. was one of 66 community planning grants awarded through the Reconnecting Communities Pilot program.

“This grant allows us to take meaningful steps toward fulfilling our mission of reuniting people with their environment and one another,” Director of Strategy for Bluffline Inc. T.S. Strickland said.

The Escambia Bay Waterfront Access Study will examine potential connections from the University of West Florida campus to Chimney Park and Corry Station, with plans to develop multi-use paths, pedestrian overpasses and water transportation networks.

In addition to improving transportation access, Bluffline’s planning will align with ongoing Emerald Coast Utilities Authority (ECUA) projects to enhance environmental sustainability.

Bluffline Inc. has gained the support of local government officials, including City Councilman Casey Jones and Escambia County Commissioner Mike Kohler, who both drafted letters of support for the project. The $1.2 million grant is the first major win toward making the group’s vision a reality.

One of the group’s main ideas was to create a rails-with-trails path alongside the railroad tracks along the Escambia Bay Bluff. A Florida Department of Transportation study has previously ruled out that idea, but Strickland said the funds could be used to further explore the concept along with other alternatives, such as pedestrian bridges over the railroad to allow safer access to the beach at places like Chimney Park.

The initiative complements Bluffline’s existing efforts, including a pending $20 million EPA Community Change Grant application that would create a 70-acre public park and greenway at Jackson Lakes. The organization plans to work closely with the local community to ensure the project addresses their needs and priorities.

A total of $544.6 million in RCP grants were awarded to community projects across 31 states.

The RCP Program is the first federal initiative specifically designed to address the impacts of historic highway construction that divided neighborhoods and limited access to essential resources. The program supports planning and capital construction projects aimed at restoring community connectivity and promoting equity in underserved areas.

Both grants will be finalized by later this year, and the city reports that construction on Hollice T. Williams Park could begin as soon as next year.

BLUE WAHOOS ANNOUNCE 2025

COACHING STAFF LED BY MANAGER

The Miami Marlins announced the 2025 coaching staff for the Double-A Pensacola Blue Wahoos on Tuesday, led by new manager Nelson Prada.

Prada will be joined by pitching coach Jerad Eickhoff, hitting coach Jason Krizan, defensive coaches Jay Weaver and Ruben Someillan, athletic trainer Adam Sparks, strength and conditioning coach Brandon Remalia, video coach Britton Barthold and concierge clubhouse manager Alexandra Fletcher.

Prada becomes the seventh manager in Blue Wahoos history, succeeding Kevin Randel (2021-24). Prada enters his fifth season with the Marlins organization, serving previously as the manager for the DSL Marlins (2022) and Single-A Jupiter (202324). In 2023, Prada led the Hammerheads to their first Florida State League title in franchise history.

After a playing career in the Minnesota Twins system from 1995 to 1998, Prada began his coaching career in 2005. He managed the GCL Twins (2005-07) and Beloit Snappers (2008-12) before joining the Phillies organization in 2013 and managing the Williamsport Crosscutters (2013), Clearwater Threshers (2014) and GCL Phillies West (2018). A native of Maracay, Venezuela, Prada manages the Spain National Team in international competition and led them to their first European title in 58 years. In his home country he serves as the bench coach for the Cardenales de Lara, the reigning champions of the Venezuelan Professional Baseball League. Last season while leading the Hammerheads, he became just the 5th Venezuelan manager in MiLB history to record 700 wins.

Eickhoff and Krizan return for their second seasons as pitching coach and hitting

coach, respectively. Eickhoff joined the Blue Wahoos in 2024 after a seven-year MLB playing career that included time with the Philadelphia Phillies (2015-19), New York Mets (2021) and Pittsburgh Pirates (2022). Krizan, who made his MLB debut for the San Francisco Giants in 2022 after an 11-year minor league playing career, began his coaching career with High-A Winston-Salem in the Chicago White Sox organization in 2023.

Weaver joins the Blue Wahoos for his first season in Minor League Baseball player development. After a collegiate playing career at Southern New Hampshire University, he co-founded The Catching Camp, which provides instruction and programming for catchers at the amateur and professional level. He also served as an associate scout for the Los Angeles Angels from 2011 to 2016.

Someillan joins the Blue Wahoos after previously serving as an assistant coach at Jacksonville University, where he was a five-year starting outfielder from 2017 to 2021. The Miami native also coached at Nova Southeastern and the Jupiter Wave in summer collegiate baseball.

The Blue Wahoos begin their 2025 Southern League season on Friday, April 4 as they host the Biloxi Shuckers. Mini plans, group outings and season tickets are available now at Blue Wahoos.com and the Blue Wahoos Stadium box office. Single-game tickets go on sale March 1.

The Pensacola Blue Wahoos are the Double-A affiliate of the Miami Marlins. Founded in 2012, they have won Southern League Championships in 2017 and 2022. Their mission is to provide memorable experiences, and to make Pensacola the best place to live in the world.

HAZARDOUS WASTE AMNESTY DAY AT SOUTH SANTA ROSA SERVICE CENTER

Household Hazardous Waste (HHW) Amnesty Day will be held Saturday, March 8, 2025, from 8 am to noon at the South Santa Rosa Service Center, 5841 Gulf Breeze Pkwy. in Gulf Breeze. This event allows residents to dispose of HHW at no charge without having to drive to the Central Landfill in Milton. Residents may be required to remove items from their vehicles. Remember, HHW items can cause injury if handled improperly. These items usually have a warning or cautionary statement on their labels, such as flammable, corrosive, poison or toxic. The following items will be accepted and should never be disposed of with household garbage:

SCAM ALERT: FRAUDULENT MESSAGES POSING AS SUNPASS

Escambia County has received reports of fraudulent text messages targeting the public from persons claiming to represent SunPass. The messages are requesting prompt payment to avoid fees and contain a link to a fraudulent website in an attempt to collect information. Do not click any links in the fraudulent text messages. These messages are not sent by SunPass or Escambia County. Escambia County does not send text messages to SunPass or Pensacola Beach Annual Pass holders seeking information or action regarding their account balances or fees owed.

SunPass does not ask customers via text to make a payment or to take immediate action on their account. Messages from SunPass will come from the following email address or text number:

FEMA PUBLIC NOTICE FOR PENSACOLA BAY FISHING BRIDGE RESTORATION APPLICATION

The Federal Emergency Management Agency (FEMA) has received the subgrant application for Escambia County’s Pensacola Bay Fishing Bridge restoration due to damages by Hurricane Sally (DR-4564-FL PW 00698). Pursuant to Executive Order 11988 and 44 CFR Part 9.12, final notice is hereby given of FEMA’s intent to provide funding for this project under the Public Assistance (PA) Program.

An initial disaster-wide Public Notice was published October 21, 2020, for Hurricane Sally. Comments and other information received were fully evaluated by FEMA along with evaluation of social, economic, environmental, and safety considerations. This notice serves as a project-specific final notice for FEMA’s funding action located within the floodplain.

Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions. This action complies with the National Flood Insurance Program (NFIP) requirements.

Floodplain: Project is located in the VE Zone, otherwise known as Coastal High Hazard Area, and Open Water Zone, per Escambia County FIRM Panel #12033C0390G dated 09/29/2006. The project is also located in a wetland classification E1UBL (Estuarine and Marine Deepwater) as mapped by the National Wetlands Inventory, accessed 02/13/2025.

Proposed Work and Purpose: Escambia County will restore the structure back to its pre-disaster function, capacity, and footprint

by demolishing damaged components and installing one approximately 63,600 SF reinforced concrete pier replacement structure with the following components: approach slabs, superstructure, substructure, cleaning and coating concrete surface, composite neoprene pads, grout, reinforcing steel on structures, double T beams, prestressed concrete piling, deck expansion joint and covers, existing lighting removal, storage, and replacement, pipe handrail, fence gate, conduit, junction box, single post sign, painted pavement markings, lighting conductors, and light pole. Additionally, mitigation will be achieved through the Public Assistance funded repair to current codes and standards by upgrading the pedestrian loading from 85 PSF to 90 PSF.

Project Alternatives: The alternative that has been considered is the no action alternative. This alternative is not feasible as the area would remain vulnerable to flood risk, including property damage and hazards to human life and safety. With the no action alternative, the fishing bridge would not be restored and would not continue to promote recreational open space use, which would negatively impact the community. Alternate locations were not considered as the pier is functionally dependent upon its location within the floodplain.

Comments: This will serve as the final public notice regarding the above-described action funded by the FEMA PA program. Interested persons may submit comments, questions, or request a map of this specific project by writing to the Federal Emergency Management Agency, Region 4, 3005 Chamblee-Tucker Road, Atlanta, Georgia 30341 or by emailing FEMA-R4EHP-FLORIDA@fema.dhs.gov. Santa Rosa County Animal Services will implement new operating hours beginning Monday, March 3. The shelter will close at 4 pm on Monday, Tuesday, Thursday and Friday. Saturday hours will be changing to 11:30 am to 4 pm. Wednesday hours will not change. See new hours below with changes highlighted:

THE CITY OF PENSACOLA WELCOMES GL52 SERIES TO PENSACOLA BAY

The City of Pensacola welcomed GL52 sailboats to Pensacola Bay this week to test out local weather and water conditions ahead of the upcoming inaugural GL52 Southern Series in Downtown Pensacola March 20.

Thanks in large part to American Magic making Pensacola its new home, the city is now part of the growing world of professional sailing. Teams Wizard and Vesper, along with GL52 Fleet Manager Linda Lindquist, met with local media to discuss Pensacola as a new premier sailing destination and to give a sneak peek of the GL52s in action.

“One of our core missions is to develop American sailing talent — and that’s a

mission of American Magic as well,” Linda Lindquist said. “It starts with creating awareness, getting people around these boats, and seeing what they can do sometimes.”

The GL52 Series is a competition of high-performance sailboats comprising amateur and professional sailors, including those who have competed in the America’s Cup and Olympics. The two-part racing event will consist of six GL52s, each with more than a dozen crew members, with part one beginning March 20 and part two April 10. CITY OF PENSACOLA HOSTING FIRST PUBLIC WORKSHOP FOR LAND DEVELOPMENT CODE UPDATE

The City of Pensacola will hold a public workshop on Feb. 26, 2025, offering the public an opportunity to provide feedback on a major update of the City’s Land Development Code (LDC).

The LDC governs zoning, development review, subdivisions, parking, landscaping, and more, shaping how our city grows and evolves. Residents, property owners, and any other stakeholders who regularly use the LDC are encouraged to join us and share their opinions at this public event.

EXECUTION SET IN 1993 SEMINOLE MURDERS

Gov. Ron DeSantis on Tuesday signed a death warrant for inmate Edward James, who was sentenced to death in the 1993 murders of a woman and her 8-year-old granddaughter in Seminole County.

The death warrant came five days after the state put to death James Ford in the 1997 murders of a couple in Charlotte County.

James’ execution is scheduled March 20 at Florida State Prison, according to documents posted on the Florida Supreme Court website.

James, now 63, was convicted of murdering Betty Dick and her granddaughter Toni Neuner. He rented a room from Dick and committed the murders after a night of drinking.

Court documents said James came home and strangled the child and sexually assaulted her. He then went to Dick’s bedroom, where he intended to have sex with her. He stabbed her to death, the documents said.

James was sentenced to death in 1995 in the murders and also received prison sentences on other changes. State and federal courts rejected a series of appeals in the ensuing years.

In a letter Tuesday to DeSantis that was posted on the Supreme Court website with the death warrant, Attorney General James Uthmeier said that based on the past litiga-

tion “affirming the judgments and sentences of death imposed for first-degree murder, the record is legally sufficient to support the issuance of a death warrant.”

The death warrant likely will touch off a fresh round of appeals in the coming weeks.

Ford became the first inmate executed in Florida this year, when he was put to death Thursday in the murders of Greg and Kimberly Malnory at a Charlotte County sod farm.

Florida executed one inmate in 2024. Loran Cole was executed Aug. 29 in the 1994 murder of Florida State University student John Edwards, who was camping in the Ocala National Forest.

Florida did not execute any inmates in 2020, 2021 and 2022 but put to death six men in 2023.

They were Michael Duane Zack, who was executed for a 1996 murder in Escambia County; James Phillip Barnes, who was executed for the 1988 murder of a woman in her Melbourne condominium; Duane Owen, who was executed for the 1984 murder of a Palm Beach County woman; Darryl Barwick, who was executed for the 1986 murder of a woman in her Panama City apartment; Louis Gaskin, who was executed for the 1989 murders of a couple in Flagler County; and Donald David Dillbeck, who was executed for the 1990 murder of a woman during a carjacking in a Tallahassee mall parking lot.

‘WELCOME MAT’ ROLLING OUT FOR TRUMP LIBRARY

A proposal that would block local government oversight of the construction and management of an anticipated presidential library in Florida for President Donald Trump cleared its first Senate committee Tuesday. Without comment, the Senate Community Affairs Committee unanimously backed a measure (SB 118), filed by Sen. Jason Brodeur, R-Sanford, that would prevent local governments from regulating construction and operation of presidential libraries.

Brodeur said after the meeting he wants to ensure local governments don’t impose construction “impediments,” amid expectations that a library will be built in Florida, with Trump a Palm Beach resident.

“I think there's a history in the state of Florida from local municipalities giving President Trump problems with some of the zoning things that he's had, whether it's a helicopter pad or the size of his flag,” Brodeur said. “With us having the opportunity to actually have the first presidential library ever (in Florida), and there's so few in the United States … that this would really be a landmark thing for Florida. And we wanted to make sure that we had rolled out the welcome mat as best we could.”

In 2006, Trump fought Palm Beach after he put an 80-foot pole at the entrance to his Mar-a-Lago Club, according to The Palm Beach Post. Trump sued after the town said

the pole exceeded ordinances regarding height and location. A settlement resulted in Trump getting to put up a 70-foot pole in a different location at the club.

In 2017, Palm Beach approved, through a resolution, the creation of a helicopter landing pad for Marine One at Mar-a-Lago. The resolution, backed by the U.S. Marine Corps for security reasons, received some pushback, with one resident arguing helicopter landings would exceed the town’s noise limits.

Brodeur’s bill is filed for consideration during the legislative session that will start March 4. It would prohibit local governments from enacting or enforcing ordinances, resolutions or rules related to presidential libraries, except when such measures are authorized by federal law.

Rep. Alex Andrade, R-Pensacola, has filed an identical bill in the House (HB 69).

Currently, the Donald J. Trump Presidential Library is a website administered by the National Archives and Records Administration. It has been in operation since Trump left office in 2021 after his first term. He returned to the White House last month.

The national archives system runs 13 presidential libraries in 10 states. A library for President Barack Obama is under construction in Chicago and will be the 14th in the system.

Four of the libraries are tied with universities. Brodeur said he expects the Florida university system would “welcome” such a conversation.

FEMA CIVIL RIGHTS CASE TARGETED

The former head of the Federal Emergency Management Agency will ask a U.S. district judge to clear her in a lawsuit alleging the agency violated civil rights of Florida supporters of President Donald Trump in the aftermath of hurricanes Helene and Milton. Deanne Criswell, who led FEMA during the Biden administration, will argue that she is shielded from the lawsuit by what is known as “qualified immunity,” according to a court document filed Friday. Quoting two U.S. Supreme Court precedents, the document said qualified immunity “protects government officials ‘from liability for civil damages insofar as their conduct does not violate clearly established statutory or constitutional rights.’”

Then-Florida Attorney General Ashley Moody filed the lawsuit in November after reports that a FEMA supervisor directed aid workers to avoid going to homes in Lake Placid that had yard signs supporting Trump.

The lawsuit named as defendants Criswell and former FEMA supervisor Marn’i Washington. Gov. Ron DeSantis last month appointed Moody to the U.S. Senate to succeed Marco Rubio, who became Trump’s secretary of state. The lawsuit, filed in federal court in Fort Pierce, alleged that a conspiracy existed that violated the rights of Trump supporters. It sought damages and a declaration that the defendants “conspired to interfere with the civil rights of Trump supporters in Florida” in violation of a federal law.

“While the facts will continue to come out over the weeks and months, it is already

University of South Florida President Rhea Law announced Monday she will step down from her post, as major changes continue in the leadership of Florida public universities.

Law, an attorney who had longstanding ties to USF, became interim president in 2021 before being named president in March 2022. Monday’s announcement said she will leave the presidency after USF conducts a search for a successor.

“During my tenure we established bold goals — and thanks to our talented, dedicated team of faculty, staff, administrators and students — we exceeded them, sometimes soaring beyond what many thought was possible,” Law said in a message to the university community. “After over 40 years as an employee, student, board member and chair, donor, volunteer and now president, I am filled with gratitude and pride for all we have achieved. Serving this community as USF’s eighth president has been the honor of my lifetime, and I look forward to cheering on the continued success of this incredible university.”

The announcement came on the same day that former Lt. Gov. Jeanette Nunez began serving as interim president of Florida International University and a week after former state House Majority Leader Adam Hasner was named president of Florida Atlantic University.

Meanwhile, the University of Florida and Florida A&M University are operating with interim presidents, and Florida Polytechnic University, Florida Gulf Coast University, Florida State University, the University of North Florida and New College of Florida have presidents who were appointed since 2021.

Monday’s announcement did not provide detailed reasons for Law’s decision to step down, but it listed a series of accomplishments during her tenure, including achieving a longstanding goal of joining the Association of American Universities and helping guide an effort to build an on-campus football stadium.

Weatherford, a former state House speaker, said in a prepared statement. “I am forever grateful that she was willing to accept this role, first on an interim basis, and then permanently after members of our community urged her to apply and supported her for the position. By every measure Rhea has been exceptional in leading our university to unprecedented levels of success. For more than four decades she has stayed connected to USF and we would not be where we are today without her.”

The Florida International University Board of Trustees on Feb. 7 chose Nunez to become interim president, replacing Kenneth Jessell, who had served as the Miami university’s president since 2022. Nunez’s first day on the job was Monday, with her resignation as lieutenant governor effective Sunday.

“On my first day as interim president of Florida International University, I write to assure you that my commitment begins and ends with our students, their success, and the overall success of FIU,” Nunez said in a message to the FIU community that was posted online. “Together, we will further cement FIU’s position as a leader in higher education in our state and throughout the nation.”

The state university system’s Board of Governors is slated Thursday to sign off on Nunez’s appointment as interim president and her contract. She would make an annual base salary of $850,000 and could receive a bonus up to 15 percent of the base salary amount, or $127,500, according to a copy of the proposed contract posted on the university system’s website.

Under state rules, FIU will have to conduct a search for a permanent president. While the FIU board on Feb. 7 did not specifically discuss Nunez serving as permanent president, trustee Dean Colson indicated the “probable results of the search are already known.”

The system’s Board of Governors on Thursday also will consider Hasner’s appointment as president of Florida Atlantic University. Hasner would make an annual base salary of $875,000, with the possibility of a $150,000 bonus, according to a copy of the contract on the university system website.

COURT BACKS DESANTIS ON MIGRANT FLIGHT RECORDS

An appeals court Wednesday overturned a circuit judge’s ruling that Gov. Ron DeSantis’ administration took too long in providing public records about a controversial 2022 decision to fly migrants from Texas to Massachusetts.

A three-judge panel of the 1st District Court of Appeal backed DeSantis’ administration in the dispute with the non-profit Florida Center for Government Accountability, which made two public-records requests in September 2022 and filed a lawsuit in October 2022 after it did not receive all of the documents.

The case focused, at least in part, on requests by the center for phone or text logs that could provide information about communications by DeSantis’ then-chief of staff, James Uthmeier, related to the flights. Uthmeier was sworn in Monday as attorney general, after DeSantis appointed him to replace former Attorney General Ashley Moody.

The document filed Friday by attorneys for Criswell involved scheduling issues in the case.

As part of that, it said Criswell will file a motion for dismissal of the case, “asserting the defense of qualified immunity, among other defenses.”

The document only dealt with Criswell and not Washington, the other defendant.

While Criswell has not filed a response in court to the allegations, she issued a statement in November that said agency employees “adhere to FEMA’s core values and are dedicated to helping people before, during and after disasters, often sacrificing time with their own families to help disaster survivors.”

“Recently, one FEMA employee departed from these values to advise her survivor assistance team to not go to homes with yard signs supporting President-elect Trump,” the statement said. “This is a clear violation of FEMA’s core values and principles to help people regardless of their political affiliation. This was reprehensible. I want to be clear to all of my employees and the American people, this type of behavior and action will not be tolerated at FEMA and we will hold people accountable if they violate these standards of conduct.”

The allegations drew attention from congressional Republicans and the national news media. Helene hit Florida in September before moving into other states, including Georgia and North Carolina. Milton made landfall in Sarasota County in October before crossing Florida.

Leon County Circuit Judge J. Lee Marsh in late October 2022 said the administration did not properly comply with the state’s public-records law and gave it 20 days to provide records. But the appeals-court panel ruled Wednesday that Marsh erred in concluding that the administration’s “response was unreasonable and in violation of Florida’s public records.”

“Here, the final hearing (not initiation of the lawsuit) occurred only 35 days after the first public records request,” appeals-court Judge Rachel Nordby wrote in an opinion joined by Judges Brad Thomas and Thomas Winokur. “The public records sought were not singular documents or already composed files (like a court file where the records custodian merely accesses it electronically or pulls it off the shelf). This was a comprehensive request that, due to its scope, was going to take some time.”

The opinion also pointed to issues such as Hurricane Ian hitting the state in September 2022 after the Florida Center for Government Accountability, an open-government group, made the public-records request.

“The (governor’s) office has a duty to timely fulfill all public records requests, but considering the magnitude and scope of the center’s request — which coincided with the ongoing statewide emergency of a major hurricane — the office’s response time cannot be considered unreasonable,” Nordby wrote. “The center’s demand that its two robust records requests be completed within a week was unfeasible and impractical given the breadth of the requests and the circumstances

The center filed records requests Sept. 20, 2022, and Sept. 21, 2022, and alleged in the Oct. 10, 2022, lawsuit that the administration had not provided all of the records sought. The flights, which involved 49 migrants going from San Antonio, Texas, to Martha’s Vineyard, occurred Sept. 14, 2022.

In his Oct. 27, 2022, order, Marsh wrote that the governor’s office “has presented no evidence to the court of what direct steps it took to identify or produce records responsive to the public records request dated September 20, 2022, some of which have yet to be produced to the plaintiff.”

“The court finds that the EOG (the Executive Office of the Governor) is not in compliance with (the public records law),” Marsh wrote. “EOG’s partial production and response to the record requests were unreasonable. Specifically, the EOG has not made any production of a text or phone log of James Uthmeier as requested in the records request dated September 20, 2022.”

But in Wednesday’s opinion, the appeals court said the request for Uthmeier’s phone and text logs appeared to include his personal communications devices and that presumably, “not all phone calls or text messages from any personal devices would be public records.”

“Sorting the public from the private in two weeks’ worth of text messages and phone calls would not be quick,” Nordby wrote.

The appeals court said the governor’s office did not challenge another part of Marsh’s ruling that the administration made unnecessary redactions to records.

Marsh also ruled that the center was entitled to recoup its attorney fees and costs. Wednesday’s opinion sent the case back to circuit court.
