Continuing uncertainties over American trade policy are one factor slowing the economy, and while the American Trucking Associations’ chief economist won’t yet say a recession is imminent, he does believe some fleets will go out of business.
Bob Costello, the ATA’s chief economist and senior vice president, said in an interview June 26 that businesses are starting to consider if they really need to expand and invest because of those uncertainties, even if they aren’t directly involved in international trade. “I think everybody at least knows that trade impacts them in all ways, right?” he said. “So even those that are saying, ‘Well, I’m not an importer from China and so forth,’ they still know it has an impact on the economy.” Coming on the heels of the Great Recession, the decade-long expansion is now the longest in modern history. Costello said the risks of another recession have increased, and though he stopped short of predicting it will happen, he added, “My concern is that we’re going to end up causing a recession by accident.” A freight recession, like the one that occurred in 2016, seems more likely than CONTINUED Q2 SUMMER 2019

a full recession in the short term. That year, the economy slowed but didn’t fall into a recession. However, the United States was not engaged in a trade dispute at the time. Costello doesn’t think a recession is right around the corner, “but certainly it’s something we’re watching closely.” In a speech to the Arkansas Trucking Association May 16, Costello was moderately optimistic, saying the economy is “slowing, but we’re still growing.” He said then that the economy was returning to an average growth rate of 2% – slower than 2018’s unusually strong gains, but still good. By the time of the interview June 26, however, his worries had increased. Asked about that earlier statement, Costello said, “I think the growing part is getting smaller and smaller.” The global economy isn’t growing as fast as the United States’, China is slowing down, and trade disputes continue. While the first quarter’s
numbers were OK, later data has not been as encouraging. May was particularly soft, and the first half of June wasn’t great either. The numbers might show a surge at the end of the quarter, which commonly occurs, but he expects them to weaken again after July 1. “Freight fundamentals are not as good as last year,” he said. “The spot market is particularly weak, but even contract freight now is softening significantly.” Among the major economic indicators, housing continues to be weaker than in the past. More homes were built last year than in any year since 2007, but the numbers were nowhere near the 2 million homes built that year. Factory output is slipping, and Costello said he may have to lower an earlier forecast of 1.5% growth. Unemployment is at a 50-year low and the economy is close to full employment, but he believes job creation is already slowing from more than 200,000 per month to 150,000. Only one of the four months

prior to the interview had reached the previous 12-month average. Demand has slowed somewhat, while trucking capacity has increased. Meanwhile, shippers want to get their money back after last year paying higher trucking rates, much of which went to drivers. Over the last 18-24 months, fleets have raised driver pay, which Costello said they should have done, and also

offered guaranteed minimum weekly pay. Walking back driver pay is very difficult, so in an environment where rates are stagnant or falling, some fleets won’t be able to make payroll – particularly smaller companies. “You could start to see a lot of trucking companies go out of business,” Costello said. He later added, “I think what you will see is, you will see some carnage in the industry in a falling rate environment.” Costello noted that while fleets are still purchasing trucks, cancellations are increasing. Fleets should add trucks only to meet their own demand. “There’s no reason to expand at the moment unless you’ve got a bunch of business coming in, but for the industry, not individual trucking companies, there’s no reason to expand,” he said. “There’s still a lot of replacement activity going on, and that’s ultimately not a bad thing at all.” If a recession happens, the trade war will be a contributing factor, Costello said.
The Trump administration is considering a 25% tariff on all imported autos, and the trade dispute with China continues. According to the Office of the United States Trade Representative, the trade deficit with China in 2018 was $378.6 billion. The Trump administration has imposed 25% tariffs on more than $250 billion in Chinese goods under Section 301 of the Trade Act of 1974, alleging unfair trading practices. China responded with tariffs of 5-25% on $110 billion of U.S. goods. Trump has threatened tariffs on another $300 billion, covering most Chinese exports. However, after meeting with Chinese President Xi Jinping June 29, he said those additional tariffs would not move forward – for now. But the uncertainty remains. Tariffs disrupt the supply chain of goods coming from China that are shipped by trucks. If goods become more expensive, the economy slows, consumption is reduced and truck volumes fall. At the same time, the United States exports fewer goods

and services to China as that country levies its own retaliatory tariffs. Half of all U.S. manufactured products are for export. “You start doing this trade war stuff, those people get hurt,” Costello said. Moreover, tariffs directly increase the trucking industry’s costs. A 25% tariff has already been levied on trailer and container chassis. While trucks driven in the United States are built here or in Mexico, some parts come from China. Meanwhile, the next round of tariffs could affect 53-foot domestic containers – all of whom, to Costello’s knowledge, come from China. Costello said China is a problem that needs to be addressed – just not through a trade war. He said the benefits of trade outweigh the costs. “Yes, there are people that lose their jobs when some stuff goes overseas, but we have a good blue collar trade story in trucking,” he said in an earlier interview June 5. “It has added jobs in trucking. There are more port jobs. But on top of CONTINUED

it, as consumers we all benefit because goods are generally cheaper because they go to places that specialize in making certain things.” There has been some good news in recent months. The Trump administration had threatened to impose tariffs on Mexico unless that country addressed the flow of illegal immigrants across the border. That threat ended in June after Mexico agreed to take steps to limit immigration. Costello had worried that the tariff dispute was jeopardizing the United StatesMexico-Canada Agreement, President Trump’s replacement of the North American Free Trade Agreement. Leaders of the three countries approved the new agreement last year. Mexico has ratified the USMCA, and prospects seem good of it being passed by the Canadian Parliament. It still must be ratified by Congress. Had the tariff dispute continued, it would have been a “deal-breaker,” Costello said. Costello said he’s been spending a lot of time lobbying Congress on behalf of the USMCA, which he said is a better deal for the United States. While “90% of it is the same as NAFTA,” it reflects macroeconomic changes since NAFTA was signed into law in 1993, such as e-commerce. The other 10% doesn’t directly effect trucking. But political considerations could scuttle the agreement, and the window is closing. Democrats know passage would be a big win for President Trump in a year before a presidential election. They have appointed a group to try to move the process along, but Costello said they need to find a win politically, too. U.S. Trade Representative
Robert Lighthizer has met often with Democrats. If the agreement doesn’t pass, then NAFTA stays in place, but Trump could threaten to pull out of that agreement in what Costello described in his speech before the Arkansas Trucking Association as a “high-stakes game of chicken.” Doing so could lead to a court case. Cross border trade generates just under $13 billion annually for trucking and employs about 90,000 full-time equivalent employees in the U.S. trucking industry, 60,000 of whom are drivers. Mexico is the second largest U.S. import source, while Mexico and Canada are the two largest export markets. Meanwhile, according to Reuters, more than 75% of both Mexican and Canadian exports go to the United States. “We need a good, solid North American trade zone,” Costello said June 5, “so that this stuff doesn’t go to southeast Asia or China or India or Africa or places like that. … Relative to the United States and Canada, Mexico is a cheaper alternative in many cases, but it’s not the cheapest in the world by far. There are many cheaper places to produce. So we have to work as a trading bloc so that we can compete with the Europeans, the Asians, and keep production in the U.S. Because that benefits trucking, so it’s more of an indirect impact on us.” The economy grew at an annual rate of 3.2% in the first quarter, but those numbers were skewed by bloated inventories caused by companies stocking up on imported goods as a hedge against tariffs. Otherwise, actual growth was about 1.9%. “I’m hearing a lot of companies saying,
‘Our warehouses are plumb full,’” he said. “Go talk to warehousing companies. They’ll tell you they’re killing it right now because they are full.” The inventory-to-sales ratio fell from 1992 until the Great Recession as the supply chain became more efficient. It peaked in 2016, which led to the freight recession, and has since fallen as the supply chain worked off some of the excess. But inventories are still higher than they were during that long decline, and Costello does not expect them to fall that low again. The supply chain needs larger inventories to provide the quick deliveries consumers expect for e-commerce purchases. E-commerce is having an effect on haul length as well. The average dryvan truckload haul has fallen from 796 miles in 2000 to 507 miles in 2018, a drop of 36%. There were four months in 2018 when the average was below 500 miles, which has never happened previously. That reduction will affect driver pay, truck purchasing cycles, and profitability. If the economy heads toward a recession, the Federal Reserve can’t cut interest rates much to stimulate the economy because rates are already low. The Fed had been increasing them, but it stopped because the economy is slowing. The other option would be a stimulus package. “We just did a huge tax cut,” Costello said. “I don’t know what more they can do there. That’s another reason why I’d love to see them move on an infrastructure bill. That would be a stimulus, and that’s something that pays dividends for a long time – not just a temporary shot in the arm.” TTN

The New Drug & Alcohol Clearinghouse:
A Push and Pull System BY DAVE OSIECKI / GUEST WRITER
Starting Jan. 6, 2020, all 500,000 of the country’s motor carriers, including owner-operators, will be required to use FMCSA’s new Drug and Alcohol Clearinghouse. Carriers will be required to pull information out of it and push information into it. And at first, there won’t be much information in the system. Government often moves slowly, and the Clearinghouse is no exception. Congress in 2012 directed the Secretary of Transportation to create it as part of a highway reauthorization bill called Moving Ahead for Progress in the 21st Century Act (MAP-21). It would take another four years before FMCSA published the final rule designed to implement the program on Dec. 5, 2016. Starting this fall, drivers and 1 6 • T E N N E S S E E T RU C K I N G N E W S
fleets can establish a Clearinghouse account before the new system goes into effect. The Clearinghouse’s purpose is to promote highway safety. It applies to truck drivers and also school bus drivers, construction equipment operators, federal employee drivers who have CDLs, and others. It also applies to Canadian and Mexican drivers who are required to comply with the agency’s drug and alcohol requirements. It will be especially valuable in helping carriers identify prospective drivers who have had a DOT drug and alcohol program violation working for an ex-employer, but conveniently left out that detail during the application process. With some limited exceptions, the Clearinghouse will contain violations reaching back five years, or until the driver has successfully completed the return-to-duty process, whichever occurs later. Motor carriers will be required to

query, or pull information out of the Clearinghouse at certain times defined in the rules. They must perform a “full” query each time they want to hire a CDL driver, but they’ll have to obtain the driver’s consent first. Drivers will have to log in to the Clearinghouse and check an electronic box allowing the carrier to view their records. This approach to driver consent is unique. Other motor carrier industry background checks such as those for motor vehicle records, past employment, and a criminal record allow drivers simply to sign their name on the bottom of an employment application containing certain consent-related information. One obvious and foreseeable problem with the Clearinghouse’s full query consent approach is this: What happens if a driver cannot remember his or her username or password when logging in to the system? Who among us hasn’t forgotten a bank
account or credit card password? If a driver is unable to access the system to provide consent, then the carrier won’t be able to check the Clearinghouse at that time during the hiring process. Full queries must occur each time a carrier hires a CDL driver. Carriers must also perform an annual “limited” query of each of their drivers, where they will check the system to see if any data appears. On a limited query, the system will merely confirm that information is available on that driver; if so, fleets then will be required to perform a full query to learn exactly what happened, when it happened, and if the driver has completed the necessary return to duty steps in order to operate a CMV. For limited queries, drivers can provide their consent when hired and will not be required to provide it for each individual, subsequent limited query. Carriers will be able to batch the limited queries for all their drivers, and many probably will. Regardless of how it is performed, carriers will have to perform this action at least annually. While fleets will be required to pull data from the system, they’ll also be required to push data into it. Any time a CDL driver has a qualifying violation, it must be entered into the system within three days. Those violations include a blood alcohol test of at least .04% concentration, a refusal to test for alcohol or drugs, or a fleet’s actual knowledge of a DOT testing program violation. Actual knowledge would include a carrier’s direct observation of use on duty and a driver’s admission of use on duty, among others. When a driver completes the return to duty process, that also will be entered into the Clearinghouse. Drivers will be able, under FMCSA’s rules, to challenge their report’s accuracy but not the accuracy of test results or their own refusals to test. Many fleets hire third party service agents to handle many portions of their DOT drug and alcohol testing program. CONTINUED Q2 SUMMER 2019

In fact, an entire cottage industry has developed around the DOT testing requirements. For Clearinghouse compliance, service agents can be authorized by motor carriers to perform the queries and report information to the system on their behalf. The new Clearinghouse-related requirements will be time-consuming. They will add burdens on carriers, as well as costs. In fact, there will be a cost involved each time a carrier queries the system, though the transaction costs for the full and limited queries has not yet been determined by FMCSA. Interestingly, fleets won’t be getting much for that money at first. When the system goes into effect Jan. 6, 2020, the Clearinghouse will be empty, and it will take a while for information to be entered. Only violations that occur after that date will be included. Meanwhile, fleets will continue to be required to inquire about a driver’s drug and alcohol violation 1 8 • T E N N E S S E E T RU C K I N G N E W S
history with previous employers during the first three years of the Clearinghouse implementation, or until Jan. 6, 2023. FMCSA’s Clearinghouse rules also contemplate what could happen if a fleet submits inaccurate information about a driver, perhaps as a retaliation tactic after the driver has left the company. If that happens, the carrier’s Clearinghouse registration can be revoked. While the carrier can remain in business, it will have to use an alternative method to determine if a driver applicant, or an existing driver within the fleet, is qualified. That method could involve contacting FMCSA and requesting the agency perform the check. As you might expect, there are special rules for owner-operators. They will be subject to all the requirements for companies as well as all the requirements for drivers, and they will have to designate a third party administrator to assist them in complying with the rules.

Finally, there’s a yet-to-be-completed component for state CDL licensing agencies. When drivers obtain their CDL, or renew, transfer or upgrade it, state licensing agencies will be required to check the Clearinghouse to determine the eligibility of the driver to operate a commercial motor vehicle. Government enforcement agencies will also have limited access to driver records in order to enforce the regulations while also maintaining some level of driver privacy. On the heels of the ELD mandate, the Clearinghouse will be the next major change in an industry that often faces major changes and compliance challenges. In order for carriers to learn the details of the new Clearinghouse, FMCSA recently created an informational website for the industry. This site can be found at https:// clearinghouse.fmcsa.dot.gov. Fleets are encouraged to check it out, and subscribe for updates from FMCSA as the January 2020 compliance dates nears. TTN

Patrick Mendenhall believed the Tennessee Trucking Association had an opportunity: There wasn’t a clear path for young people to become involved and he had an idea to create a solution.
The 31-year-old fleet sales manager at Cumberland International Trucks in Nashville formed the Young Professionals Council last year along with about a dozen other young people in the industry.
Mendenhall had the idea to start the YPC about a year-and-a-half ago. Employed by the industry since 2010, he recruited industry friends, peers and competitors, then drafted a mission statement about what the group might accomplish. Today, that mission statement is, “To empower and build camaraderie through the professional development of its young industry leaders through education, mentorship and leadership opportunities while continuing to grow and strengthen the Tennessee Trucking Association.”

Mendenhall, now the chairman, said the group is helping form the TTA’s next generation of leaders. “I see a lot of us climbing the ranks of the Tennessee Trucking Association as we grow older and mature,” he said. “I think the Young Professionals Council is a steppingstone into leadership of the Tennessee Trucking Association.” Mendenhall found a ready and willing audience in the TTA’s leadership. He said when he pitched the idea to TTA President and CEO Dave Huneryager, he hadn’t completed two sentences before Huneryager said, “Oh, you’re trying to get a young professional’s group together. Absolutely!” Huneryager then made a pitch to the TTA’s executive committee and Board of Director, all of whom were also supportive. About a dozen young trucking professionals met Aug. 23, 2018, for their inaugural meeting. After a networking session then moved to a private area
and talked about what they wanted the YPC to accomplish. Mendenhall said everyone agreed the TTA needed more opportunities for involvement by young people. Everyone wanted to network, learn more about the organization and strengthen it. The vibe was upbeat. Among the participants were Donna England, TTA’s membership coordinator. The YPC has grown from about 12 early members to 20-25 today. While the first word in its name is “Young,” there is no age limit for participation. Mendenhall said the group has decided it doesn’t want to turn anyone away and to focus on inclusivity. The YPC is an avenue for those who are young and young at heart. Among Mendenhall’s future goals is to increase participation among members living outside of Nashville. Meanwhile, legacy TTA members have served in mentorship roles and attended the group’s quarterly meetings. Those have included
Cumberland International Trucks’ President Terry Minor, TCW’s CEO Scott George, Rush Enterprises’ General Manager Troy Dickens, Titan Transfer’s Chairman Tommy Hodges, and Mike McFarlin with M&W Transportation Co. All of its members are active. In fact, the group has no interest in attracting members who will be otherwise. As Coble, 36, the vice chair, explained, “We don’t look at this as something to be a resume builder for people. We certainly want people who are going to get engaged and try and help us to make a difference and really add some value to the things that we’re trying to do.” Joe Fisher, 39, a territory and service manager with Eaton Corporation and 14-year industry veteran, agreed, saying, “We’re looking to add members who will be active and engaged and really help spread the TTA’s agenda.” Coble, the great-grandson of his truck dealership’s founder, said the group’s

diverse members hail from many types of trucking-related companies. “I think that’s where our strength will come from is to approach some of our challenges from a lot of different perspectives, and I think we’re certainly off to a good start there,” he said. Since that first meeting, the YPC has hit the ground running. Members helped deliver more than 30,000 bottles of water after Hurricane Florence struck North Carolina. In January, it hosted a TTA/YPC Legacy Event at a

special events center owned by Minor. The event attracted nearly 50 people, including about a dozen YPC members. As of July 6, the group had already sold more than 150 tickets for a fellowship event at a Nashville Sounds minor league baseball game taking place on July 30. Some upcoming events include donating time and service to those in need at the Nashville Rescue Mission on Aug. 10 and planning a Topgolf fundraising event in October. YPC also hosts quarterly lunchtime meetings and
frequent after-hours get-togethers. At the YPC’s last meeting, members heard from George and Dickens about the Tennessee Trucking Foundation, the TTA’s charitable arm, and Truck PAC, its political action committee. Mendenhall said the 20 young professionals in attendance were very interested in what strategies are used in allocating PAC funds and how candidates are selected as recipients. By the time the meeting was over, the young leaders had a much more

comprehensive understanding of these two very important groups within the TTA. “Everyone learned something new there, and that is exactly what we were trying to accomplish,” he said. Fisher said seven YPC members attended the TTA’s Call on Washington Apr. 29 – May 1, and roughly 15 attended the Call on Nashville on Apr. 3. In both cases, young people were actively pushing trucking’s agenda. Without the YPC, those events mainly would have attracted older members. “The younger professionals wouldn’t have been there at all hardly if it wasn’t for the YPC,” he said. One of the Council’s objectives is to attract young people to the industry and to TTA. Connie Vaughan, government relations director of McKee Foods and TTA’s chairman, has asked some of the members to participate in a task force to consider changing the way the TTA markets itself. Mendenhall said the Tennessee Trucking Association “has a great story” that isn’t always told the right way. He said he felt that it just needed “a little jolt of energy.” “If we’re trying to enhance the industry to make it appealing to younger people, we’ve got to make it unique, and we’re going to have fun doing it, he said. A dozen or so YPC members along with two Tennessee’s Road Team captains brought a truck to the yearend career day at Nashville’s McGavock High School, which has an Academy of Aviation & Transportation. Next year, YPC members will participate in additional career day events to communicate directly with students about the trucking industry’s many opportunities. “I think having some younger faces, under 40, reaching out to the younger kids, I think was very beneficial,” said Sarah Heffington, 26, who works in business development with M&W 2 4 • T E N N E S S E E T RU C K I N G N E W S

Transportation Co., Inc. Heffington said there has been a lot of excitement among members from the beginning. Without a perceived pathway, these members didn’t know how they would fit into the TTA and therefore generally wouldn’t become active until they reached their 40s. “We’re excited,” she said. “We’re excited for the future. I think it’s getting us involved earlier and pushing us to be involved and share ideas when we normally might be quiet.” TTA’s Huneryager bought into the group’s vision from the beginning and remains a strong supporter. He told Tennessee Trucking News, “I could not be more impressed with the progress this council has made. Since inception, the enthusiasm and involvement the members have shown has been tremendous. I thank each and every YPC member for their effort and engagement. I would encourage all members, carrier and allied alike, to participate. I look forward to this group’s impact on our association’s future.” TTN

Tennessee Trucking Associations hosts its first-ever business expo at its upcoming convention in September This year’s 89th annual Tennessee Trucking Association Convention will feature TTA’s very first Expo, a valuable part of the convention that will allow exhibitors to promote their products and services while networking with convention attendees.

“This is our 89th annual convention,» said Donna England, Tennessee Trucking Association (TTA) membership coordinator. «The convention is where our members come together to learn and network.» “Over the years, TTA Allied Members have asked about being able to exhibit at our annual convention,” said England. “We added that opportunity for our endorsed partners first, and then for those who donate for our silent auction.” The silent auction held each year at the convention helps raise money to promote safe driving in the state of Tennessee. Says England, “I am super excited to offer this vendor showcase in our first expo. I think that it helps our wonderful members to see firsthand what some of our vendors offer.” This year’s expo will feature 20 vendors, who were selected on a first come, first service basis. All slots have been filled.
