In September, the council approved a preliminary 2017 property tax levy of $5,232,445, which would be a 7.4 percent increase over this year’s levy of $4,871,139.

Sundblad Guilty of Manslaughter, Assault in Infant’s 2014 Death Sentencing Scheduled for Feb. 14
A Belle Plaine man charged with killing his infant son in May of 2014 was found guilty in Scott County District Court of nearly all but the most serious charges he faced. Scott County District Court Judge Christian Wilton found Joshua Scott Sundblad, 26, guilty of two counts of firstdegree assault, one count of second-degree manslaughter and one count of third-degree assault (Wednesday, Nov. 23). Wilton found Sundblad not guilty of first-degree murder and third-degree assault. “This case can be summed up in one word, and that is tragedy,” Wilton said before issuing the verdicts. Carson Scott Bosquez Sundblad was 59 days old. “As a 59-day old, this child never stood a chance.” Sundblad’s trial was held this past spring. He selected a trial by judge over a jury trial. He remains at the Scott County Jail. Michael McDonald, Sundblad’s attorney, said the decision to have Judge Wilton decide Sundblad’s guilt or in-
nocence was based on the emotional nature of the case and the belief Wilton would deliver a fair, impartial verdict. “We certainly are pleased he’s being held responsible for causing of this child’s death,” said Scott County Attorney Ron Hocevar. McDonald was pleased with the not guilty verdict on the first-degree murder charge. Hocevar said prosecutors believed there was a strong case for the first-degree murder charge. Before the trial, McDonald noted the first-degree murder trial was based on information from a man being held in the county jail on criminal charges. McDonald said the man’s credibility was suspect and that Wilton’s verdict proves that point. “We were a little bit disappointed with the guilty verdict on the other charges. We felt there was reasonable doubt there,” McDonald said. Hocevar said the details of the baby’s injuries in the medical examiner’s report was a key element in the guilty verdict on the manslaughter and assault charges. The findings supporting Judge Wilton’s verdicts will be available before the sentencing
scheduled for Feb. 14, 2017. Wilton ordered a pre-sentence investigation. Sundblad has the option of allowing a jury to decide his sentence or allow Wilton to set the penalty. Prosecutors Sarah Wendorf and Wes Abrahamson filed a motion Wednesday for an upward departure from state sentencing guidelines. Hocevar said the circumstances of the case and the nature of the baby’s death justifies the request for an upward departure of sentencing guidelines. He said prosecutors would make a case to Wilton for an upward departure at sentencing. McDonald opposes the upward departure, noting the sad nature of Carson Scott Bosquez Sundblad’s death and the not-guilty verdict on the first-degree murder charge. He also noted Sundblad has never been convicted of previous crimes. “As the judge said, this was a tragedy,” McDonald said. “This doesn’t lend itself to an upward departure.” Brittany Bosquez and her family declined comment on the sentence and proceedings until after the sentencing. Belle Plaine Police Chief Tom Stolee said the verdict represented “justice.”

EDA: Legal fee decreases ($500), facade improvement grant reductions ($4,000), consulting fee decreases ($4,000), postage ($200), marketing ($1,000). HRA: Incentive programs reductions ($1,000). According to the Minnesota Department of Revenue, the 2017 preliminary property tax levies for all Minnesota cities will total approximately $2.261 billion compared with $2.129 billion in 2016, a 6.2 percent increase. Next Monday’s public hearing is only for people who want to comment on the city’s 2017 budget and property tax levy. Any comments or questions regarding property and home valuations will be addressed at the county/city’s annual board of equalization meeting in the spring.

A New Agent in Town James Evans recently became the agent of Farmers Insurance in Belle Plaine, having purchased the business from Dianne Skelley. Evans, who most recently worked in financial services, said he decided to make a career change. “I want to thank Diane for her help with the transition and also for her years of taking care of the great people of Belle Plaine,” Evans said. He and his wife, Janice, moved to Belle Plaine in 2013. They have a 16-month-old daughter.
Jordan Hotel Plan has New Life A hotel plan that has languished for lack of an investor is back before the Jordan City Council now that funding to develop Grandstay Hotel is apparently in place. Jordan city councilors recently approved a site plan for the proposed hotel, the Jordan Independent recently reported. The building permit won’t be issued until Scott County OKs

Some of the plans for the hotel proposed for an open area adjacent to the intersection of Creek Lane North and Highway 169 (adjacent to Clancy’s Bar) have changed from the initial plans OK’d in April of 2015. It includes 51 rooms and six suites compared to 61 rooms in the original plan. It will have 126 parking spaces.

Southern Valley Alliance Holiday Fund-Raiser Volunteers at Southern Valley Alliance for Battered Women prepared over 700 poinsettias for delivery Monday at the organization’s Belle Plaine headquarters. The holiday plants will be delivered this week. The annual poinsettia sale is Southern Valley Alliance’s second biggest fund-raiser of the year. It will bring in about $10,000 for programming.

Our Lady of the Prairie Catholic Church will hold its annual Sing, O Heavens Christmas Concert on Friday, Dec. 16. The Youth Prelude begins at 6:30 p.m. and the Concert at 7:00. Come and bring your families to celebrate the Christmas season by enjoying adult and youth ensembles, youth choirs, the Our Lady of the Prairie choir, as well as Christmas favorites for all to sing. This concert is a fund-raiser, with all proceeds to benefit the Our Lady of the Prairie Parish Religious Education Program (PREP) and Catholic School Program. The Fund-raiser is sponsored by Catholic United Financial and will receive a matching grant of up to $1000. Following the concert, a wine and dessert reception will be held in the parish hall. Concert and reception admission are a freewill donation. We look forward to an evening of entertainment and celebration with our community.
The Belle Plaine Police Department and the Girl Scouts are sponsoring the third annual toy drive for needy local families and children. The drive runs Nov. 27 through Dec. 19. Last year, the Belle Plaine community donated over 300 toys. All toys should be new and unwrapped. Gifts are accepted for children up to 16 years of age. Realistic looking toy weapons and gifts with food, if donated, will not be distributed. Families in need of toys can come to the police department between Dec. 13-23 to pick out toys. Recommended gifts for preteens and teens include sporting equipment, board games, books, hand-held electronics and similar items. Mary Murphy Mary Murphy, at the age of 97, entered eternal life on Wednesday evening, November 23, 2016, at the Belle Plaine Lutheran Home. A Mass of Christian Burial will be on Wednesday, November 30 at 11 a.m., with a visitation starting at 9 a.m., all at St. John the Baptist Church 210 North Broadway, Jordan. Father Timothy Yanta will preside. Mary will be laid to rest next to her husband at St. Mary Cemetery, Minneiska, MN. Ballard-Sunder Funeral Home and Cremation, Jordan Chapel, proudly served and cared for the Murphy family. On May 16, 1919, Mary was born the oldest of seven children to parents Bernard and Lenora (Fuller) Sheehan on the family farm in Kellogg. On November 17 1951, she married Marvin Murphy at Incarnation Church, Minneapolis. The family lived in Bloomington before moving to the farm in the Jordan area in November of 1963. Mary and Marvin then farmed here for many years. Marvin passed away on March 24, 1988. Left to honor Mary’s life and mourn her death are sons, Pat (Stephanie) Murphy, Tim (Bonnie) Murphy; grandchildren, Bridget (Art) Hoffman, Emily (Illya) Shchegolve, Kevin (Angela) Murphy, Alissa (David) Thompson, Michael Murphy; great-grandchildren, Raegan Hoffman, Declan Hoffman, Kilian Hoffman, Aislan Hoffman, Kruno Murphy and Ana Murphy; sister, Doreen (Bud) Luther; sister-in-law, Deloris Sheehan; nieces, nephews, relatives and friends. Preceded in death and there to welcome Mary home in heaven is her husband, Marvin; parents, Bernard and Lenora; brother, Thomas Sheehan; sisters, Bernadine (Laurence) Lamey, Helen Cox, Lucille (Don) Schneider and Margaret (Dick) Wolf. Herbert R. (Hippy) Wagner Herbert R. (Hippy) Wagner, Minnesota entrepreneur, businessman, and owner of Jim’s Apple Farm and Minnesota’s Largest Candy Store, passed away peacefully, November 21, 2016 surrounded by his loving family, following a sudden illness. Visitation will begin at 9 a.m. on Saturday, December 3 at St. John the Baptist Catholic Church, 313 2nd St. E., Jordan, MN, and continue until the Mass of Christian Burial at noon. Presiding is Father Timothy Yanta. Interment at Calvary Cemetery, Jordan. Funeral arrangements with Wagner Funeral Home, Jordan, and McNearney-Schmidt, Shakopee. He continued to oversee the apple orchards, and pie-baking operations at the big yellow barn south of Jordan along highway 169 into his nineties. Born to Herbert and Agnes Wagner on August 23, 1925, he graduated from Jordan H.S., where he was elected class president in consecutive years, and attended the Dunwoody Institute in Minneapolis, majoring in Architectural Design. With the outbreak of WWII, and following studies at the Academy in New London, Connecticut, he became a commissioned officer in the United States Merchant Marine, sailing primarily on the North Atlantic from 1943–1945. His ship was the second one to enter Antwerp, Belgium during the Battle of the Bulge. One of his most poignant memories, as he walked through the city, was of children starting to follow him. Realizing they were starving, he gave away all his rations. These children in hardship affected him more than the ongoing German bombardment. Following the war, he opened

a family restaurant in Jordan, but on learning that the highway was expanding to go around Jordan, he made a pivotal decision to purchase acres of land to the north, in Scott County, an area which eventually became one of the fastest growing counties in the United States. With his brother and father, he designed and built Wagner’s Supper Club, a fine dining establishment, earning rave reviews in the Minneapolis Tribune, “After Last Night” by restaurant critic Will Jones. Simultaneously, the fledgling beginnings of apple orchards commenced with clearing the wooded, hilly land, which rose above the Minnesota River Valley, a perfect place for growing apples. Along with generous guidance from horticultural experts at the University of Minnesota, thousands of trees were planted. Partners in love, and for all his life was his wife, Dolores (Eischens), a registered nurse and graduate of St. Catherine’s School of Nursing. They were married on April 23, 1949. To accommodate their growing family, he designed a unique, spacious, open-floor-planned home in the 1950’s, complete with high ceilings, which housed speakers in every room, and from a central radio he also personally built, classical music was played throughout, and sometimes John Philip Souza marches in the morning to rouse (10) sleepy children. In the early 1970’s, he developed one of the first solar heating operations for the home, including 400 square feet of solar panels, which ran through Dolores’s lilac bushes. It was inspected and admired by engineers who came to examine. Largely a self-taught man, he genuinely grasped the importance of life-long learning. Books from the A to Z of Beekeeping (he had honey bees for the apple trees), to the Life of the Cure of Ars, a Catholic mystic, lined the family library, and in the summer he arranged for the local bookmobile to stop directly at home every other week. Valuing work and education, he and Dolores offered to fund the college education of their children, provided they worked summers and weekends on the farm and in the restaurant while in school. Nine Bachelor’s degrees, three Master’s degrees, and a PhD resulted from this deal. He served his church and community for many years, as elected School Board member during the building of the new High School in Jordan; and religious education instructor and trustee of St. John the Baptist Catholic Church in Jordan. He was a devout Catholic who mirrored the church’s teaching on social justice through his personal motto of “be good to people.” He was extraordinarily generous in large and small ways, from baking home-made bread and personally delivering it to the home-bound, to lending money to people who were “down on their luck” and could not get a bank loan for a business or home. He had a special place in his heart for the School Sisters of Notre Dame, as he explained, “ they were very kind to me as a child, and so patient in teaching my son, Tom, (now deceased), who was mentally challenged from birth. “ He is survived by his beloved wife of 67 years, Dolores; and their children, daughters, Mary W. Zbaracki of Duluth and Dr. Anne M. Sanquini (Richard) of Saratoga, CA; sons, Joseph Wagner (Lucy) of Jordan, James Wagner (Estelle) of Edina, Robert Wagner (Renee) of Belle Plaine, Anthony Wagner (Jackie) of Little Canada, William Wagner (Karen) of Chaska and Gerald Wagner of Belle Plaine; grandchildren, David Zbaracki (Dr. Anne), Joseph Zbaracki (Catherine), Clayton Wagner (Alissa), Christine Wagner, Sophia Wagner, Theodore Wagner and Elizabeth Wagner; great-grandchildren, Catherine and Adam Zbaracki; and brother, Bernard Wagner of Jordan. He is preceded in death by four-year-old grandson, Edward James Zbaracki in 1981; and sons, Thomas Robert Wag-

Paul Franzen Paul Franzen, 82, of Union Hill, passed away peacefully surrounded by his family at The Lutheran Home in Belle Plaine. Mass of Christian Burial will take place on Thursday, December 1 at 11 a.m. at St. John’s Catholic Church in Union Hill with Father David Barrett officiating. Visitation will occur for two hours prior to Mass also at church, beginning at 9 a.m. Burial will take place at St. John’s Cemetery. Paul was born on April 16, 1934 in Minneapolis, MN to Adam and Ida (Fleischman) Franzen. He grew up on a farm outside Loretto and attended Rockford Public Schools until transferring to Northwestern Electronics, a trade school in Minneapolis. Paul married Rosemary Vossen on June 23, 1956, at Our Lady of the Lake Catholic Church in Mound. The couple lived in Edina for 13 years, during which time he worked for Honeywell as an electronics technician. They then bought a farm in Belle Plaine and had both dairy and beef cattle. He also worked as plant maintenance engineer at Empak in Shakopee for 10 years. Finally, he operated his own small business, Franzen Electric Machine, which he initiated in 1997 and worked until present day. An outgoing and friendly man, his business often saw friends and neighbors gathered in his shop; he was so appreciative of all of them. He was a man of varied interests; he loved animals and music, especially old time and polka. His love of music led him to join the Czech Area Concertina Club. Finally, he had a life long interest as a ham radio operator, renewing his license as recently as this year. Paul is survived by his wife of 60 years, Rosemary of Belle Plaine; children, Michael Franzen of Le Sueur, Mary Ann (Mark) Felmlee of Le Sueur, Jeanmarie (Norman) Neher of Elko New Market, Jon (Marilyn Nichols) Franzen of Belle Plaine; sisters, Joan (Arnold) Nimps of Kasota, Charlotte Blakeborough of Wayzata; brother, Joseph Franzen of Belle Plaine; eight grandchildren, David, Holly (Jordan), Daniel, Melissa (Matt), Jacob, Nathaniel, Isaac, Steven; three great-grandchildren, Paige, Evangeline and Avery. He is preceded in death by his parents, Adam and Ida Franzen; daughter-in-law, Anna Franzen; grandson, Timothy Pearson; and brother and sister-in-law, John and Linda Franzen.

James Thomason, 67, of Prior Lake passed away on Friday, November 25, 2016 at The Lutheran Home in Belle Plaine. Funeral service will be at 3 p.m. on Thursday, December 1, at the Kolden Funeral Home in Belle Plaine. Rev. Mark Johnson will officiate. Visitation will be from noon until 3 p.m. on Thursday at the funeral home. Interment with Military Honors will be in Oakwood Cemetery in Belle Plaine. Jim was born in New Prague on October 21, 1949 to Robert and Evelyn (Schmidt) Thomason. He attended Trinity Lutheran School and graduated from Belle Plaine High School. Jim enlisted in the Navy in 1969 and served on the USS Kitty Hawk air craft carrier for three years. He was honored to be the only man in his division to be chosen to be on the Kitty Hawk. He was given a Kitty Hawk driver’s license and was certified to take control of the ship under normal conditions. His smart seamanship and attention to duty had earned his the license. He was very proud of this accomplishment. Jim loved to go to auctions, garage sales, fishing and just being outdoors. He loved to take his Fatboy Harley for rides throughout the country. He also enjoyed visiting the Schmidt families in Blakeley. Jim worked for Thermo King for 45 years. After two years of retirement he was diagnosed with mesothelioma in January 2016. He fought a long, hard battle. He spent the last week of his life at the Belle Plaine Lutheran home with his family at his side. He is survived by his sisters, Beverley (Ray) Ince and Janice (John) Walerius; and brother, Roger (Jean) Thomason, all of Belle Plaine; sister-in-law, Kim Thomason of Hot Springs, AR; and many nieces and nephews. Jim is preceded in death by his parents; and brother, Jerry “J.T.”; two nephews, Chad Ince and Scott Walerius.

Gerald “Jerry” R. Wagener Gerald “Jerry” R. Wagener, 79, of Belle Plaine, passed away Wednesday, November 23, 2016 at The Lutheran Home; Hope Residence in Belle Plaine. A Mass of Christian Burial will be on Saturday, Dec. 3 at 11 a.m. at Our Lady of the Prairie Catholic Church in Belle Plaine with Father Brian Lynch officiating. Visitation will be one hour prior to Mass with Burial to immediately follow at Saints Peter and Paul Catholic Cemetery in Belle Plaine. A luncheon will be served back at church. Arrangements by Wagner Funeral Home of Belle Plaine. Born in the borough of Belle Plaine on March 27, 1937, Gerald was the son of George and Virginia (Melchior). He was raised in the Belle Plaine area and attended Saints Peter and Paul Catholic School. In his working years, he enjoyed various jobs including hauling sod and milk. His most loved employment was at the CAP Agency spending 20 years doing light assembly. Gerald moved to Hope Residence in 1997 where the staff and other residents truly loved him. Everyone who came in contact with Jerry loved him! Gerald was a sweet, kind, generous, easy-going man that loved all kinds of music, praying the rosary, playing Scrabble and cribbage and was a faithful Minnesota Twins fan. Jerry is survived by sisters, Mary Hennes, Jean (Fran) Van Keulen, Rose (Don) Wacker; brothers, George D. (Annette) Wagener, Ross (Peggy) Wagener, Mark (Teresa) Wagener; many nieces, nephews, and great-nieces and nephews. He is preceded in death by his parents, George R. and Virginia; infant twin brothers; and brother, John. Pallbearers will be Jerry’s nephews and great-nephews.

Thomas F. Haraldson Thomas Franklin Haraldson, 92 of Le Sueur, passed away Wednesday, November 23, 2016 at Oak Terrace Senior Living in Le Sueur. Funeral services were on Saturday, November 26 at 11 a.m. at Zion United Church of Christ in Le Sueur. Visitation was from 4-7 p.m. on Friday at Kolden Funeral Home in Le Sueur and one hour prior to the service at the church. Burial with military honors was at Mound Cemetery. Tom was born July 7, 1924 to Frank O. and Irene (Skipton) Haraldson on a farm near Kasota, MN and they soon moved to Mankato where he attended school. He served in the Army from 1944-1946. Tom loved spending his summers and weekends on his uncle Will Miller’s farm near Kasota. On February 11, 1950, he married Joyce Ann “Pat” Peterson; daughter of Carl and Amanda (Pitmon) Peterson from Kasota. Together they made their home in Le Sueur and raised two daughters. Upon his return from the Army, he worked on his uncle’s farm then for Kenny Sunderman in Le Sueur, the Farmers Elevator, Le Sueur Foundry, and the Green Giant Can Plant. He returned to the Elevator where he remained for a total of 30 years including 15 years as the manager. He retired at age 63. He was a member of the American Legion for 60 years. Tom lived life to the fullest, loved his family, enjoyed his friends, and cherished his memories of earlier times and time spent “on the road.” He was a man with “giddy-up go” whose life was a great ride! Tom is survived by his daughters, Shirley (Chuck) Sigler of Hager City, WI and Carolyn (Ben) Christopherson of Belle Plaine; grandchildren, Jeff Sigler (Jodi Jones) of Red Wing, Jodi (Tim) Heth of Muscatine, IA; five great-grandchildren, Brianna, Jacob, Isaac, Nadia, and Ethan; brother-in-law, Robert (Donna) Peterson; and four nieces. He is preceded in death by his parents; wife; brother-in-law; and sisters, Alice and Azalia.

Ask A Trooper by Sgt. Troy Christianson of the Minnesota State Patrol Question: As a traffic safety official, I am very upset that people don’t realize that there is some significance as to what is going on with using the term “crash” as compared to using the word “accident” in news articles and other media. I see both terms used and I personally know that there is some intentionality about this. I know that you use the word crash for a reason, so can you do an article about this issue so that we can get everyone on the same page? Answer: This issue stems from a court trial over a decade ago that involved the intentional ramming of a police vehicle, which resulted in the death of a police officer. During the trial, an attorney mentioned that the incident was referred to by police in their reports as an “accident.” It also was reported by police on an “accident” report form, thus it was argued that the incident was not intentional and charges should be dismissed. Since that time, traffic safety officials in the state have been educating citizens regarding the difference between the words “crash” and “accident.” We know that human driving error causes the vast majority of crashes and are therefore pre-
ventable. Since these crashes are not accidents, we must use the correct term to define them. The Toward Zero Deaths program officials and local traffic safety coalitions have worked on this issue in all regions of the state. This effort continues at the Department of Public Safety, in particular the Office of Traffic Safety. Spokespersons at the Minnesota Department of Transportation also use the term “crash.” Although we continue to emphasize the word “crash,” the media frequently refers to them as accidents. This may be primarily due to the fact that they have grown up hearing crashes called “car accidents.” If everyone gets into the habit of using the word “crash” instead of “accident,” we will all be on the same page regarding this traffic safety term. You can avoid a ticket — and a crash — if you simply buckle up, drive at safe speeds, pay attention and always drive sober. Help us drive Minnesota Toward Zero Deaths. On Sept. 14, 1936, she was married to Victor Karnitz at St. John’s Catholic Church in Faxon Township. She was a cook for 11 years at Belle Plaine High School. Benjamin Schultz, age 73, of Belle Plaine, passed away Nov. 22 at the Belle Plaine Lutheran Home. Mr. Schultz was born Oct. 19, 1913 in Jessenland Township, Sibley County, to Louis and Emma (Langle) Schultz. He operated a salvage yard and a small trucking business for a number of years in Belle Plaine. Trumpeter swans had once made their home throughout Minnesota, but early settlers shot the birds for feathers and food. After a 100-year absence, trumpeter swans were back through a wildlife restoration program, but the bird’s fate was once again being decided by hunters. The BPHS girls’ basketball team lost its season opener to St. Peter 68-30. Julie Halquist accounted for nearly half of the Tigers’ points with 14.
An all-night party following the next Belle Plaine High School prom (1987) was the almost unanimous choice of over 50 parents who met to decide whether to have a party after the prom or graduation or no party at all. While the parents were meeting about the party, a group of about 15 students were meeting in another room of the school, and were invited to join the parents meeting when they were ďŹ nished. One of the biggest concerns of the students seemed to be the fact that parents would be working at the party and that the students might think that they’ll be under the microscope. The consensus of the parents was that would not be so. Because it was currently operating at a deďŹ cit, the Belle Plaine Ambulance Association had to raise its service rates from $3.90 in 1986 to $4 in 1987. “The ambulance advisory board advised that the rates be adjusted to get back into the black, break even or earn enough to save something towards buying a new ambulance without raising the per capita dramatically,â€? said Pat O’Laughlin, president of the ambulance association. Founded in January of 1975 with 26 members, the Belle Plaine Ambulance Association grew to 36 members by 1986. Five charter members – Gene Tikalsky, Helen Tiede, Stan Walton, Harold Wolpern and Greg Westlund – still belonged to the association after nearly 12 years. Earl Gerdes, a charter member who retired that summer, was an honorary member. The Hooper-Bowler-Hillstrom House would be decked out in holiday spirit with red candles and straw ornaments – traditions of a Swedish Christmas that holiday season. The Belle Plaine Historical Society would host its annual Christmas party with that theme intact on Dec.

Mrs. Frank Vancore, nee Theresa Albrecht, died at the Glencoe hospital. She was 73 years old. The marriage of Miss Luella Kruschke, daughter of Mrs. Sarah Kruschke, to Orville A. Heitkamp took place at Redeemer Lutheran Church. Joe Hahn was appointed to ďŹ ll the unexpired term of county superintendent of schools for Scott County by the county commissioner. unteer student teacher at the St. Benedictine Prep School in Newark. On Wednesday the three toured the city of Newark, visiting the Sacred Heart Cathedral. Wednesday night, Audrey, Katelyn and Nick were special guests at the Newark Abbey for their Thanksgiving feast with the priests, monks, sisters and staff of the Abbey and the Prep School. Thursday, they ventured into New York City for the 90th Annual Macy’s Thanksgiving parade. The parade featured Tony Bennett, and other music talent as well as the famous balloons that are icons of the parade. On Friday, they toured the Statue of Liberty on Liberty Island and Ellis Island, as well as the 9/11 Memorial and Museum. The Museum is built underground of where the Twin Towers actually stood. Saturday was another trip into New York for some additional sightseeing. Central Park, Central Park Zoo, the New York City Library were among the stops. It was estimated that 3.5 million people were in New York City for the parade and a weekend of shopping. Audrey, Katelyn and Nick traveled by train to the City which is only 30 minutes from Newark. Man Sentenced for Drug Possession A Belle Plaine man in possession of methamphetamine was recently sentenced to three years of supervised probation and community service. Scott County District Court Judge Rex Stacey sentenced Erik Brent Larson for fifth-degree drug possession, a felony, Nov. 23. A second charge, possession of drug paraphernalia (a petty misdemeanor), was dismissed. Larson, 42, will have to undergo a chemical assessment and agree to follow the recommendations from it as part of his probation. He must submit to random testing and agree to remain law abiding during his probation. He must also per-

form 80 hours of community service work. The charge stems from a call to police March 15. Police arrived at Larson’s home on the 1000 block of South Chestnut Street with a search warrant. The warrant was based on reported drug use at the home, according to the criminal complaint. It states Larson had a marijuana box/ dugout and a white straw that tested positive for methamphetamine on his person. There were five children in the residence at the time of the search, according to the criminal complaint. Larson said he and his wife had been in an argument and she left to take a walk. A portable breath test measured his blood-alcohol concentration at .08. Larson “admitted to meth. use during the search and helped police locate a meth. kit underneath the bed in the bedroom he shared with his wife,” according to the criminal complaint. “The meth. kit also contained NIK positive meth. residue.”

Master Naturalist Volunteer Training to Start January Do you enjoy learning about the natural world? If so, consider becoming a Minnesota Master Naturalist volunteer! Anoka-Ramsey Community College in Coon Rapids is hosting a Minnesota Master Naturalist Volunteer Training beginning Jan. 9. Minnesota Master Naturalist is sponsored by the University of Minnesota Extension Service and the Minnesota Department of Natural Resources. Master Naturalist volunteers complete a 40-hour hands-on class with expert instructors and fellow learners – studying natural history, environmental interpretation and conservation stewardship. Final certification comes with the completion of 40 hours of volunteer service. The program offers three classes that correspond to Minnesota’s three major ecosystems – entitled “Big Woods, Big Rivers,” “Prairies and Potholes” and “Northwoods, Great Lakes.”
This class will cover the natural and cultural history of the Prairies and Potholes region. We will provide an in-depth overview of the Prairie Ecosystem. Through the class, participants will develop their ability to observe nature and will learn tools to improve these skills. In addition, participants will improve their communication skills by sharing knowledge with other participants and working on a group project. Classes will be held Mondays starting on Jan. 9 through May 1. Field trips will be incorporated into the class schedule. The cost for the class is $275, including materials. Tigers Have Work Cut Out in Stacked MRC

The Tigers finished sixth in the seventeam Minnesota River Conference last season with a record of 2-10. They were 4-22 overall, including a 42-point loss to St. Peter in the first round of the section playoffs. But Carlson is optimistic that his 2016-17 squad is the best girls’ team he will have on the floor in five years of leading the girls’ program, which includes four returning starters from last season. Included among them is the team’s lone all-conference player, guard Elizabeth Johnson, who is back for her senior year. The Belle Plaine floor leader averaged about eight points and four assists a game last season. Also back is fellow guard Paige Narveson, who gained honorable mention last year and is now a sophomore. The other two returning starters are senior guard Ireland Lambrecht and senior post Schuyler Sterk. The only starter not back is guard Alissa Schultz, who averaged just under eight points a game her senior year. Guard Anna Donkhong, who played in every game last year, also graduated. Joining Johnson, Narveson, Lambrecht and Sterk in vying for varsity playing time this season are senior Alexia Lenz (guard/forward), junior Maria
Larson (guard/forward), junior Alexia Siegle (guard), sophomore Lily Vinkemeier (forward), sophomore Sidney Schafer (forward), freshman Lizzie Hilgers (forward), freshman Jaylen Struck-Schmitz (guard) and eighth-grader Sarah Lenz (forward). In all, the Tigers have approximately 80 percent of their scoring back from a year ago. “Paige Narveson (12.1 ppg), Ireland Lambrecht (8.9 ppg) and Elizabeth Johnson (8.8 ppg) were our scoring leaders,” Carlson said. “We feel with them coming back, the new players on our team and the hard work they put in this summer, that we will be much better and more balanced scoringwise this year. “This is the best shooting team we have had since I have been with the girls’ program,” Carlson continued. “Top to bottom, we have more pure talent than anytime that I have been here. I think that our depth is very good. We have some very good younger players on our team with a lot of upside. We will be good on the perimeter. “We are not a very big team and are not real physical, yet,” Carlson continued. “We are working on being more physical and should get better there. Defending the paint and rebounding will be big for us this year.” Carlson added that his goal for the team is “to play hard and together every night and compete with confidence.” “If we do that, the wins will take care of themselves,” Carl-

Mayer Lutheran and NYA tied for the conference championship last year with records of 11-1. Both teams have all their all-conference players back. NYA, a state-qualifier in March, brings back MRC most valu-
able guard and now junior Kali Grimm, who averaged over 15 points a game. Also back for the Raiders are forward Bren Fox, point guard Shyann Wickenhauser and guard Abby Mackenthun. that are ahead from within their own conference, the Tigers look to improve vastly on last year’s record. “We have looked good in practice and are adding a few things offensively to our team and spending time on that,” Carlson said. “The kids are working hard and improving. As of now, everyone is healthy. We’re looking forward to the first game.” That first game was scheduled for Tuesday night at WatervilleElysian-Morristown after this edition of the Herald went to press. In fact, Belle Plaine will play it’s first three and seven of the first nine games on the road. Belle Plaine’s MRC and home opener is set for Dec. 6 against Sibley East. Assistant coach Carly Werner will be taking over the B-squad this year. “She has been coaching in our program for the past two years and has been doing a great job. Explosion Dance Team Goal: ‘Become United as One’
by Dan Ruud The Belle Plaine High School Explosion Dance team is preparing to light the fuse on another season, and will do so under the guidance of new head coach Shyler Egan. She has been an assistant coach in the program the past two years, taking over this season for Sibel Dikmen, who remains with the team as an assistant coach. Dikmen led Belle Plaine to the Minnesota River Conference championship in high kick, jazz and all-round last season. Among those who graduated from last year’s team are allconference honorees Ally Fink, Maggie Applegarth, Jenna Seaver and Ali Davis. Selin Dikmen is the lone allconference dancer back for 2016-17. Mia Pribyl, who was honorable mention, is also back. Belle Plaine returns most of its team this season, including kick dancers Pribyl, Hannah Witt,
Jamie Zahn, Kate Haege, Vanessa Rosales, Grace Wallert, Abbie Siegle, Rachael Eliason, Mai Nguyen, Filiz Dikmen, Selin Dikmen, Sara Ferguson, Allison Skluzacek and Lauren Kerkow. Also on the roster are Kaylee Shackle, Paige Gau, Kara Reitz, Faith Miner, Alaina Buesgens, Jaeyln Borresen, Kate Wright, Brooke Adamietz and Hannah Skluzacek. Many of the above dancers will also compete in jazz. “This team has several strengths,” Egan said. “First, they are extremely motivated. They are willing to put in the hard work at practice to get the results they are looking for at the competitions. They are also united as one team. They work together and build one another up. They help each other and support one another,” Egan said. The coach said the goal of the team is to “become united as
one.” We are working to build a team that empowers, promotes and exemplifies great dancers and girls. We band behind the quote, Never Me, Always We. Egan said the teams to beat in MRC this season include Randolph and Mayer LutheranWatertown. “Randolph is competitive in both categories, with kick being their strength,” Egan said. “They will come out strong this year looking for their first ever conference kick title. In jazz, Randolph did extremely well for only adding that style to their program last year. Mayer Lutheran-Watertown is also skilled in jazz and a top competitor.” As for teams to beat in section in both kick and jazz, Egan said Marshall, Hutchinson, Delano, Rockford and Waconia are in that group. “It has always been the same

Belle Plaine has qualified for state twice in program history. “The team has looked good at practice,” Egan said. “Practices are filled with a lot of information the girls need to incorporate into their routines and dance skills. They are great about going home and practicing to ensure these details are being met. They are very dedicated and are working hard.” Belle Plaine’s captains are Eliason, Pribyl and Selin Dikmen. “Those three along with the other seniors – Filiz Dikmen, Allison Skluzacek and Kate Haege – have excelled as leaders this year. The 2016-17 Panthers will look to flex their muscles behind a pair of junior returning state place-winners in captains Jackson Stauffacher and Tyler Buesgens. Stauffacher, the son of coach Jerold Stauffacher, wrestled his way to a 42-6 record and a state runner-up finish at 126 pounds last year as a sophomore, and he will be looking to add to his impressive resume that includes a 106-pound state-qualifying trip as an eighth-grader and a fourth place state finish at 113 as a freshman.
“Jackson has good leadership qualities and he is both physically and mentally tough,” comments Ripley. “This could be an exciting team to watch, and when Jackson gets going on the mat, he will most certainly be a big part of that.” And no stranger to Scott West excitement is Buesgens, who has been selected as the Panthers’ Mr. Excitement wrestler over the last couple of years. Buesgens wrestled his way to a 39-10 record and a fourth place finish at state at 182 pounds last year as a sophomore. Buesgens’ wrestling success did not end there as he had a big summer of freestyle and Greco wrestling for Team Minnesota, where in June he was a starting member on the Minnesota Cadet Greco National Championship Team and then went on to become a USA Fargo Cadet Freestyle All-American at 182 pounds by placing fifth this past July. Scott West will be looking for senior leadership and excitement to be delivered from Parker Huss, who is fully capable of delivering on both. As a sophomore, Huss wrestled his way to a fourth place finish at state at 106 pounds. “We are looking for Parker to help lead this team and himself to another level and back to the state tournament,” states Ripley. While his individual career has not been at the state caliber level, senior Deshawn Carter has proven to be one of the most important Scott West wrestlers during the last two Section 2AA Team Championships as he has come up with two of the biggest wins that helped propel the Panthers to the state
team tournament in 2015 and 2016. It was in the 2015 section championships final at Mankato East where Carter beat New Prague’s Stevie Kvam 7-6 to help the Panthers win a 32-31 tiebreaker criteria thriller over New Prague. In the 2016 section team semifinal at Hutchinson, Carter beat Waconia’s Alex Logelin 7-5 to help the Panthers shock #1-seeded Waconia 3423 before the Panthers went on to defeat Hutchinson 43-21 in the section championship. “Deshawn was wrestling really solid at the end of last year and placed fourth in the section individual championships as he went 18-17 on the year,” cites Ripley. “Hopefully, he can continue to step up and wrestle at that level and above throughout his senior year.” It will also be the senior year for Scott West heavyweight Ben Alexander, who went 11-12 in his junior campaign, and with the 2016-17 season beginning against New Prague, you only have to go back to last year’s meet in New Prague where it was Panther heavyweight Ben “I Got This!” Alexander closing down the 39-27 Panther victory with a thunderous and meet-ending head lock pin of Trojan Tony Wacker. “Ben did some good wrestling for us last year,” states Ripley. “We will need him to step up with the “I Got This!” attitude to close out meets with what is needed at that time.” The time is now for a trio of Scott West sophomores to step up and make their mark this season as all of them had winning records their freshman campaigns. That trio consists of Justin Stauffacher, who is also the son of coach Jerold Stauffacher, Tyler Shackle and Calvin Menke. The two lightweights – Stauffacher and Shackle – both finished third at the section individual tourney and had records of 28-12 and 31-6, respectively, while the
Good Luck Wrestlers! upper weight Menke went 2017. “These three will have an opportunity to take their wrestling to the next level and that would be the state level,” contends Ripley. “They form a solid core of sophomore wrestlers that can help continue the tradition of success that is Scott West wrestling over the next three years.” The last name of Fogarty has been a big part in the success of Scott West through the years, and although as a sophomore he only wrestled his way to an 8-12 record, look for Jack Fogarty to come out and attack opponents in that relentless Fogarty fashion as the junior is a leading candidate to win the Scott West Most Improved Wrestler Award. “We were really impressed with the way Jack wrestled on our summer camp trip this year and he has been tough during practices thus far,” states Ripley. “Jack has put in some good work in and out of the wrestling room and we are excited to get him and the rest of the Panthers out on the mat.” Lightweight Jacob Hill leads the freshman Panthers as he wrestled his way to a successful 15-6 record last year as an eighth-grader. Hill won the Lakeville North Invitational championship last year at 106

B.P. School Board OKs Three-Year Farmland Deal The Belle Plaine School District helped establish the going rate for farmland rental prices Monday night (Nov. 28) when it approved a three-year rental agreement for 73 acres with area farmer Randal Koll. The board unanimously approved the bid of $210 per acre in both 2017 and 2018 and $220 per acre in 2019. The district rented the land for $190 per acre last year. The school district land is located west of Oak Crest Elementary School and the Belle Plaine Athletic Complex. The district bought the land a few years ago for future development options, possibly a new high school someday. Until then, it plans to continue renting out the land. Koll’s bid was one of three the district received. Robert Schultz bid $180 a year to rent the land over the next three years. Malz Bros. Farms offered a bid of
$151 a year for 2017, 2018 and 2019. Bruce Mathiowetz, BPHS agriculture education instructor, said the bid is within the range of the rental market rate for the area. The University of Minnesota Extension OfďŹ ce said $208 per acre is the average 2015 rate for renting land in Scott County. In other action at the Nov. 28 meeting, the Belle Plaine School Board: • Paid bills totaling $2,250,320.75. • Hired Ryan Wolf as a longterm substitute from approximately Dec. 9, 2016 through March 3, 2017. Long-term substitutes are paid $194.14 per day. • Hired Kelly Vourlos as a long term substitute from approximately Oct. 26 through Dec. 22 for $194.14 per day.
Tri-City United School Board members recently voted to ask district residents about the programs, facilities, building community pride, spending tax dollars and more. The school board that serves Montgomery, Lonsdale, Le Center and neighboring townships recently approved a survey that will be sent out to residents. The eight-page survey will be sent out in January,
the Montgomery Messenger recently reported. Results are expected back in mid-February, in time for the board to review results at its Feb. 27 workshop. The survey will be conducted online. Access codes will prevent duplication. Paper copies will also be mailed out to residents who don’t want to answer questions online. In the wake of last spring’s failed building bond, the survey will be focused on facilities and what the district’s residents

Legal Notices CITY OF BELLE PLAINE ORDINANCE 16-12 AN ORDINANCE REPEALING AND REPLACING SECTION 1109.06 OF THE CITY CODE PERTAINING TO BLUFF PRESERVATION On Monday, November 21, 2016, the City Council of the City of Belle Plaine approved Ordinance 16-12 Repealing and Replacing Section 1109.06 of the City Code Pertaining to Bluff Preservation. Ordinance 16-12 is available for review and/or photocopying during regular office hours at the City of Belle Plaine, 218 North Meridian Street, Belle Plaine, MN 56011; phone 952-873-5553. The Ordinance provides bluff preservation standards which are intended to manage, stabilize, and conserve defining features in the Belle Plaine landscape which provide stormwater discharge routes, scenic vistas, open spaces, wildlife habitat, resting areas for migrating species along the River Corridor. The Ordinance provides specific definitions of words and terms used in relation to bluff preservation. The amendment will retain an existing prohibition of land disturbing activities on blufflands and within bluff impact zones. The proposed amendment discourages development of slopes greater than 18 percent that are not blufflands. The proposed amendment requires certain stormwater best management practices be identified and employed when conducting certain activities on steep slopes. Ordinance 16-12 will take effect upon summary publication in the official newspaper of the City. Adopted this 21st day of November, 2016. Sheriffâ&#x20AC;&#x2122;s Office Hosting Youth Snowmobile Training Course The Scott County Sheriffâ&#x20AC;&#x2122;s Office is hosting a youth snowmobile training Dec. 17-18 for children, ages 11-15. The snowmobiles will be provided. Participants are asked not to bring their own snowmobiles. Children will be responsible for bringing the appropriate clothing depending on weather as well as a snowmobile helmet. Prior to attending this training, children are responsible for participating in online training. Information on the online training can be found by visiting this Web site: http://dnr. state.mn.us/safety/vehicle/ snowmobile/index.html Children will not be allowed to participate in the classroom review/performance test unless they have first completed the youth snowmobile safety online course. day through Friday between 8 a.m. and 4 p.m. Space is limited. The childâ&#x20AC;&#x2122;s full name, date of birth, address, and phone number are required to register. A parent must be available to sign a waiver at the beginning of the class. According to the Minnesota Department of Natural Resources (DNR), the online youth snowmobile safety training class is an introductory class designed primarily for the snowmobile rider with little or no experience in snowmobile operation. Students obtain and study the safety information on the interactive online course at their own pace in the comfort of their own home under the guidance of a parent or guardian. Depending on the youthâ&#x20AC;&#x2122;s age and experience, the online course should take approximately two to four hours to complete. Once they complete the on-
line course, students print out a youth follow-up voucher and register for a one day snowmobile safety class in their area. The one-day class includes classroom review of priority safety information and a performance driving course. A fee of up to $5 may be collected by the instructor for any fees they incur to conduct the class. Each student will also pay an on-line DNR fee of $5 upon completion of the course. Canterbury Park Wants to Get Off and Running With Early Start The Minnesota Racing Commission is considering a request from Canterbury Park to start its season a few weeks earlier than usual next spring. The commission is weighing a request for a 67-day mixedbreed meet slated to begin May 5 and run through Sept. 16, the Shakopee Valley News recently
reported. Canterbury Park has opened its season in mid-May the past eight seasons. The commission will review the trackâ&#x20AC;&#x2122;s request at its December meeting. Canterbury Park President Randy Sampson said the earlier start will be potentially good for the track by drawing new
stables of horses to an extended meet. Purses will continue to be enhanced, thanks to an agreement with the Shakopee Mdewakanton Dakota Community. Purses this year are again expected to top $14 million, thanks to the 2012 agreement with the tribe.
New Prague Pondering Predatory Offender Residence Rules In the wake of Le Sueur County discussing restrictions on where a person convicted of socalled predatory offenses may/ may not reside, the New Prague City Council begin a similar process. The council directed at its Nov. 21 meeting city staff to begin crafting an ordinance governing where people deemed as level 3 offenders, and possibly level 2 offenders may reside in the city, the New Prague Times recently reported. Level 3 offenders are deemed by the state

The city began the process because the anticipated release of people convicted of sex crimes from the Minnesota Sex Offender Program (MSOP) at the state hospital in St. Peter. A judge ordered earlier this year the state can no longer indefinitely commit people convicted of sex crimes to the MSOP. Predatory offenders can also include people convicted of kidnapping, sex trafficking, murder and other offenses. The New Prague City Council
will revisit the issue at its Dec, 5 meeting. Belle Plaine doers not have an ordinance governing where predatory offenders may reside. Belle Plaine police said the city has 20 people convicted of predatory offenses living in the city and outskirts of Belle Plaine as of Oct. 4. Sheriffâ&#x20AC;&#x2122;s Deputies Still Searching Lake for Missing Waconia Man
After a full day of searching Monday (Nov. 28), Carver County Sheriffâ&#x20AC;&#x2122;s deputies suspended their search of Lake Waconia for Andrew John Stifter, the Waconia man whose paddleboard and personal flotation device were found about 100 feet from shore Saturday afternoon. Deputies searched all day Sunday (Nov. 27) and continued Monday. They searched the lake and land areas from 9 a.m. to sunset. after a caller informed deputies she saw an unoccupied paddleboard about 100 feet off the shoreline. Deputies arrived and learned Stifter, 35, had gone to Lake Waconia to photograph wildlife from his paddleboard. Sheriffâ&#x20AC;&#x2122;s deputies could see Stifterâ&#x20AC;&#x2122;s paddleboard offshore, but could not see Stifter. Deputies were able to go out to the paddleboard on a patrol boat and observed the paddleboard was upright and anchored, with a personal flotation device tethered to the front of the board. The deputies began their search efforts for Stifter. The winter weather imposes many obstacles for both residents and Belle Plaine city staff. It is important to remember city policies and procedures regarding snow and ice removal. It is the responsibility of the owner and occupant of any property adjacent to a public sidewalk to remove any snow, ice, and/or rubbish no later than 12 hours after any obstructions have been deposited. Any removal by the city will be recorded and assessed against the property.
Parking will not be permitted on residential streets during a snow emergency, when snow has accumulated to a depth of one-half inch or more. Downtown parking will be posted as NO PARKING during a snow emergency. To ensure that your vehicle does not get towed due to violation of a snow emergency, the Belle Plaine Police Department offers a free program called Nixle, which allows an e-mail and text message to any cell phone regarding information on snow emergencies and/or community information.
