Joe Hankins and Emilyn Siemon were crowned Belle Plaine High School’s 2014 homecoming king and queen at Monday night’s coronation in the school’s north gym. They were crowned by 2013 king and queen – Zach Bahr and Hannah Johnson. This year’s other king candidates were Dylan O’Brien, Ben Wagner, Alec Lorenz and Kincade Retzer. The other queen candidates were Kaylee Shields, Megan Berger, Shannon Egan and Rylee Pumper. The guest speaker was BPHS math and Spanish teacher Mitch Miller, who provided the audience with a humor-filled speech with topics ranging from refereeing flag football games to moms to iPad use in the classroom. Miller also presented a football to the cross country team, which will relay the ball from the home of Friday night’s football opponent (Tri-City United) to Belle Plaine to be presented to the football team at Friday’s pepfest. The pepfest will start at 2:30 p.m. in the school’s south gym. Monday’s emcees were Alyssa Meierbachtol and Ben Stier.

grees for the start of this Saturday morning’s fourth annual Scenic Byway Half-Marathon and 5K races in Belle Plaine. As of noon Monday, approximately 220 people had preregistered for the races. If you have not yet registered, you can do so online (Belle Plaine Festivals and Events) or in person starting at 7 a.m. Saturday at Court Square Park, headquarters of the day’s activities. The cost for the Half-Marathon is $50 and for the 5K it’s $30. There will also be a Kids Fun Run, the cost of which is $10. There’s also a two-person relay option for the Half-Marathon, the cost of which is $70. The Kids Fun Run (for ages 10 years and under) will start at 8:45 a.m., followed by the HalfMarathon at 9 a.m. and the 5K at 9:20 a.m. All races begin and

Custom medals will be provided to all halfmarathon participants, and all participants will receive a race day shirt. A pre-race packet pickup will be available this Friday from 4-7 p.m. at Oak Crest Elementary School, where the Belle Plaine Lions Club will be sponsoring an all-you-eat pizza fund-raiser from 5-7 p.m. The cost is $8 for seventh-graders through adults, $6 for grades 1-6 and $2 for kindergartners and younger. Volunteers are needed to help with various duties on Saturday morning. Assistance is needed to help with registration or handing out items to the

City Council Accepts Mn/DOT’s Contribution to Bridge Cost Neil’s Pub to Become Neisen’s Corner Bar by Dan Ruud The city of Belle Plaine added another $702,000 to its coffer to pay for the future construction of a bridge near the intersection of Highway 169 and County Road 3/Meridian Street. The city council Monday night unanimously accepted Minnesota Department of Transportation (Mn/DOT) municipal agreement program funds totaling that amount. In April, the council authorized the expenditure of up to $26,000 for the city engineering firm of Bolton and Menk to proceed with the preparation of a document (Appendix E). The purpose of the document was to pursue potential funding

sources from the state for the construction of the bridge. As it turns out, the city has received the maximum amount from Mn/DOT ($702,000), including $52,000 for engineering and inspection costs, etc. from Mn/DOT. City Administrator Holly Kreft reported that 15 projects were submitted for funding awards and that Belle Plaine was the only one to receive the maximum amount. She added that the only other project in Scott County selected for funding was for the signal improvements at the intersection of Highway 169 and County Road 17/Marschall Road in Shakopee. Kreft said the Belle Plaine bridge project must be let for bids no later than June 20, 2016, otherwise, the Mn/DOT funds will not be available. Kreft also reported that Scott

County recently released its capital improvement plan for review and comment, and it includes $735,110 for the Belle Plaine bridge project. That and Mn/DOT’s contribution will be used to offset the estimated $5 million cost of the bridge. The council will hold a work session after its regular meeting on Nov. 3, during which staff will provide an update on the project’s potential funding and timing. In other business Monday night, the council unanimously approved on- and off-sale, Sunday and 2 a.m. liquor licenses for Neisen’s Corner Bar that will be opening at the present site of Neil’s Pub at 101 East Main Street. High School League Board Tables ‘Transgender’ Policy Until Dec. 4 Belle Plaine School Board to Discuss Issue Monday Saying it wants more time to hear from people with varying opinions on a proposed policy governing participation of transgender students in league activities, the Minnesota State High School League Board of Directors tabled a decision on the issue until its Dec. 4 meeting. MSHSL Board Chairman Scott McReady, the activities director at St. Charles High School and Belle Plaine’s representative on the board, believes some form of policy on transgender participation is likely to pass when the issue is discussed again. He bases that belief on discussion during last

week’s lengthy board meeting. Over 30 states have policies dealing with participation of transgender students. The revised policy the MSHSL Board of Directors discussed Thursday (Oct. 2) is far more concise and direct than the twopage predecessor the board discussed previously, he said. The new draft creates a proposed policy where a transgender student identifies gender for participation in a similar fashion to identifying a change in gender on a driver’s license, McReady said. Belle Plaine School Board members will take up the issue at a workshop Monday (Oct. 13, 6 p.m.) in the District Center. The issue is intended to assure all students the right to participation in MSHSL activities, “regardless of their gender identity or expression,” according to the latest draft policy. McReady said the lack of a

clear-cut policy on assigning a transgender student to a team is obvious. “I don’t know who I would go to if I received a request today,” he said. Mindy Sparby, Belle Plaine’s activities director, said the policy must be consistent. “It should be the same in Belle Plaine as in Shakopee as in Ada-Borup,” she said.

The most recent draft policy the MSHSL board is considering states the assignment of a participant’s gender and the team the student participates on will be recognized based on “documentation from medical personnel, acting within their scope of licensure, that the individual has been diagnosed with gender dysphoria and is receiving appropriate clinical

Gifts Aimed to Bring Comfort to Children of Domestic Abuse Girls Scouts Hope Gifts Ease the Pain

A group of Belle Plaine Girl Scouts spent much of its summer and fall working on a project to help children in a tough spot hopefully feel a little better. Last Tuesday (Sept. 30), the girls and leaders of Belle Plaine Girl Scouts Troop 25151 and volunteers delivered the blankets, books and cards they had spent the summer collecting and making to the Southern Valley Alliance for Battered Women’s (SVABW) office in Belle Plaine. Seven of the 12 girls in the troop – all fifth-graders fundraised and sought donated books, cards with a hand-written note of encouragement, squeeze toys to reduce stress and materials to fill 100 bags for boys and girls of all ages. The bags are given to children when the alliance helps them

during a domestic dispute. The project is the first of three steps Girls Scouts have to complete to achieve Girls Scouts’ bronze, silver and gold awards. The Gold Award is the equivalent of the Eagle Scout available to Boy Scouts. Everything they donated came from community fund-raising. “We had a budget of zero,” said Molly Moonen, a parent of one of the girls. The project was the brainchild of the girls. Last spring, they stated holding brainstorming sessions on what possible projects and how doable each project might be. Ideas included a buddy bench at school, fixing up the dog park, volunteering at Childrens Hospital. “They wanted to do something that would help kids,” Moonen said. “They were all in.” When the idea of helping children whose parents were arguing came up, Moonen and Mary Ann Bigaouette, executive director of the Southern Valley Alliance for Battered Women, gave the children age-appro-

priate information about SVABW and domestic abuse. The children learned how domestic violence impacts children their own age and what they can do when they see signs of domestic violence. “It’s not just a service project, like raking leaves or picking up trash,” Moonen said. “This has an educational component.” The project also helped the girls demonstrate leadership and speaking. During the course of the project, the girls led parts of meetings where various elements of the project were discussed and plans were discussed and approved. “If they didn’t do their part, the project wouldn’t get done,” said Sara Fahey, one of the mothers assisting the Girl Scouts. Bigaouette said the organization was “honored” by the donation from the Girl Scouts,

Domestic Violence Awareness

Domestic violence is a matter of power and control, Bigaouette said. Belle Plaine-based Southern Valley Alliance got its start over 30 years ago. Bigaouette believes its important to recognize the domestic abuse prevention to keep people aware of the problem. Monday, Belle Plaine Mayor Mike Pingalore read a proclamation at a city council meeting recognizing October as Domestic Abuse Awareness Month. “The importance speaks for itself. Domestic violence is an important topic for all to remember,” said Belle Plaine Police Chief Tom Stolee. “It is important that we tackle this issue through awareness and education. It is important for us to stand behind SVABW and promote this message not only in our community, but throughout the State. Domestic violence is not just physical abuse, Stolee said, but includes verbal abuse as well. It is a difficult situation for those who may feel trapped in this type of relationship. “Once an individual has broken free from Domestic or verbal abuse can they start to put the pieces back together and start re-establishing their sense of self value,” he said. Southern Valley Alliance serves primarily women in

Scott and Carver counties. From January through September of 2013, the alliance and its staff assisted 541 victims of domestic abuse with its services. During the same period in 2014, SVABW staff assisted 561 people. Locally, the alliance helped 35 victims in Belle Plaine during the January to September, 2013. In the same nine-month span during 2014, SVABW helped 31 people. SVABW offers the people it serves services that include a children’s visitation center, support groups, legal advocacy, safe houses, Latina advocacy, assistance establishing a safety plan, and a crisis line where trained advocates are available to listen and help victims. Dem-Con Seeking Scott County’s OK for Landfill Expansion Scott County is considering a plan to allow Dem-Con to raise the ceiling on its construction materials landfill by 60 feet. The Scott County Planning Commission will consider the issue in a public hearing Monday (Oct. 13, 6:30 p.m.) at the Scott County Government Center in Shakopee. Dem-Con’s construction landfill is located at 3601 130th Street W., just southwest of the intersection of Highway 169 and County Road 78 in Louisville Township. The landfill dates back to 1985. In the 1990s, it was allowed to expand from the original 71 acres to 121 acres. The company’s request for the upward expansion says the additional 60 feet is needed to maintain acceptable grades is because of the width of the landfill at various points.

Dem-Con is requesting permission to expand upward to increase the longevity of the landfill. County staff is recommending conditional approval. Under current estimates and size the landfill has approximately 15 years of capacity remaining. The expansion will add an estimated 10 additional years of capacity to the landfill, the application states. The proposed height increase would not change operations or activities at the landfill, would not expand the site footprint, would not increase traffic, and would not change the accepted materials. cultural Educators (NAAE) announced the grant to BellePlaine Junior-Senior High School. The company plans to distribute $300,000 in grants to agri-science educators to fund training and classroom resources that will help them implement advanced agriculture curriculum. Mathiowetz will use the grant to purchase sensors that will help students measure and chart acidity, dissolved oxygen and other materials in their class work. The grant will also help teachers attend trainings and conduct end-of-course assessments. “It’s huge,” he said of the grant. “An investment like this doesn’t happen everyday.” Mathiowetz accepted the grant from Belle Plaine’s Tim Stier, a Pioneer sales representative, and Joel Dorn, local Pioneer account manager. “We expect agriculture teachers to be jack-of-all-trades as they must teach a variety of agricultural and natural resources related subjects while enhancing core-academic disciplines, such as science and mathematics,” said Dan Jansen, CASE project director. “However, our agriculture teachers have minimal resources to equip themselves and their classrooms to provide rigorous instruction. Harvest Coin Hunt Resumes

Grants for Safety-Related Transportation Projects Local communities and regional agencies are invited to take advantage of Minnesota’s $7.5 million competitive grant program intended to fund projects for pedestrian and bicycle facilities, historic preservation, Safe Routes to School and more, according to the Minnesota Department of Transportation. The Transportation Alternatives Program (TAP) provides funding for a variety of projects, including many that were previously financed under separate programs, such as Transportation Enhancements, Scenic Byways and Safe Routes to School. The grant solicitation process currently is open only to Greater Minnesota applicants. The TAP solicitation for the seven-county Twin Cities metropolitan area will open at a later date. Greater Minnesota applicants

should submit a letter of intent describing the key components of their project by Oct. 31, 2014. A regional representative will contact applicants to help review the project proposal and the steps necessary for delivering a federally-funded project before local communities and regional agencies submit a full grant application. Oberender Takes Deal, Pleads Guilty to Felony Gun Charges Under an agreement that sends him to prison for at least 40 months, Christian Oberender pled guilty in Carver County District Court Thursday (Oct. 2) to charges he possessed firearms and had them after being previously committed as mentally ill and dangerous person. Both of these charges stem from Oberender using a shotgun to murder his mother in 1995. In 1996, Oberender was adjudicated delinquent under extended juvenile jurisdiction for second-degree murder. He was civilly committed as a mentally ill and dangerous person in 1998. This prohibited Oberender from legally possessing firearms. The ruling means Oberender is criminally culpable for his own actions because he repeatedly lied on various applications to possess or purchase firearms. Judge Kevin Eide sentenced Oberender Thursday to the statutorily mandated sentence of sixty months in prison. By law, Oberender must serve 40 months of that sentence in prison and the remaining 20 months

on supervised release. Oberender was also given credit against this sentence for time he has been serving in the Carver County Jail. In exchange for these pleas, the U. S. attorney has agreed to drop its federal charges. In addition, all 13 guns seized from Oberender are forfeited and Oberender must pay a $2,000 fine plus applicable surcharges. The plea agreement Thursday ended a 20-month legal battle in which the Carver County attorney appealed an adverse Carver County District Court ruling to the Minnesota Court of Appeals. The state’s appeal proved successful with the Minnesota Court of Appeals agreeing that the charges stand because the state never actively misled Oberender. Sheriff Jim Olson, having worked on the 1995 murder, recalled that Oberender was not entitled to possess guns, notwithstanding the fact the BCA did not have accurate records of the 1995 murder which allowed Oberender to pass various background checks. Olson followed up with the Carver County attorney to learn that in fact Oberender should not have guns and Oberender was arrested and prosecuted. The U.S. Attorney’s Office filed its charges against Oberender forBelle “lyingPlaine and buying” Herald firearms when the state charges were initially dismissed by the District Court. This ensured that Oberender would remain in jail pending the appeal. Had the state not won at the Court of Appeals, the Oberender would have faced federal charges for illegal gun possession.

While reading a variety of things this past week, I ran into a mention of October 9 as being the 74th anniversary of John Winston, the founder of the band known of the Beatles. You may have heard of them. If not ask your mom, grandmother, or come to your library. One of the things I like to do when running across something like this, is to see how many materials your library offers that are related to the particular person or topic. You can follow these steps to see one of the easy ways to do this. From any internet capable device, go to URL: www.scottlib.org and you will be brought to the Scott County Library System’s home page. I then clicked on “catalog & My Account” which is located on the top menu bar. I left the search parameters at the default levels of “Everything” and “All Fields” and in the blank “Search For:” box, I typed “John Lennon” and continuing to move to the right, I clicked on “Search”. This returned 37 titles. This represented a selection of books, CDs, and DVDs. Most of the offerings were directly Beatles related, if not specifically to John Lennon. Several titles were Beatles related in some manner or another. If you want to be more specific there are ways to do so. For instance, back where I left the search parameter set to “Everything”, I chose to set it to “Music” this time. The search tool neatly sorted out the CDs into a list for me. It is pretty easy. If you never have used the search tools, I would encourage you to try them. You can do it from home or come into your library. We can give you a quick tour and leave you to experiment. No one was able to find the hidden Harvest Medallion following last week’s publishing of the second clue. Published below, preceded by clues one and two, is the third clue. The Harvest Medallion Hunt is a prelude to the annual Belle Plaine Scenic Byway 5K and Half-Marathon races, which this year are scheduled for this Saturday. If the medallion is not found by Friday afternoon, a fourth clue will be available in front of the Belle Plaine Chamber of Commerce office downtown starting at 5 p.m. Friday. Last year, the husband and wife team of Don and Pam Meger found the medallion stuck underneath the sleeping child statue in front of the public library building downtown. Their find came after the publishing of the first clue. The search area is the same as for the Bar-B-Q Days and St. Patrick’s coin hunts, which is the Belle Plaine city limits. The medallion is about 2 inches in diameter and has “Belle Plaine Harvest Hunt 2014” inscribed on it. The prize for finding it is $100 in Belle Plaine Bucks. The medallion is located on public property and is not more than 6 feet off the ground. It’s also not located on the Historical House property or “inside” the Tiger Park baseball field. McReady noted school districts are required to offer separate dressing, shower and restroom facilities for boys and girls. The ad also claims religious schools are required to allow transgender students participate in MSHSL sports. McReady says state law allows religious schools to reject enrollment of a student based on gender identification or any other reason. But he was less clear on whether a religious school could allow a transgender student to enroll but prohibit participation on sports teams based on their own gender identification. “That’s a good question. I’m not sure,” he said. “That may be something we have to talk about with our staff or lawyers.”

standards of the school districts he was elected to represent. “I’ve listened to everybody. I’ve received 845 e-mails on this,” he said. “I’ve done my homework on this.”

Thirty Years Ago This Week

The Belle Plaine City Council agreed that Monday evening at the firemen’s request to place a $300,000 bond referendum on the ballot at the general election on Nov. 6. The fire department was proposing to construct a 104- by 104-foot new fire hall. They changed the proposed location of the building from the Dr. John Fogarty land on Main Street to a 150- by 144-foot piece of land across the street from the Belle Plaine Commission Company sales barn, which was owned by Vern Nyblom and Wayne Hagerman. The estimated construction cost of the building was $240,000 and the land cost $24,000. Bonding, legal and other costs would bring the total project cost to $300,000. Construction of the Belle Plaine cable television system was expected to get underway immediately after the city’s franchise ordinance received certification by the Minnesota State Cable Board. City Administrator Dave Unmacht said the state cable board was expected to consider the ordinance at a meeting scheduled for Nov. 9. Contractors hired by the cable company began stockpiling materials at a location for the head-in site, located just behind and east of the Borough Bowl. The lower tier of basic service would cost subscribers $6.75 per month for 17 channels. The Belle Plaine Development Corporation would be hosting a visit by Gov. Rudy Perpich on Oct. 23. The Scott County Fiscal Management Committee decided that $663,543 be earmarked for investigating and prosecuting the Jordan child sex abuse cases in its 1985 budget. Area farmers got a good start on harvesting the previous week before rains moved in and the fall work came to a standstill. Roger Malz of the Malz Brothers Farm stated that their soybean harvest was about half completed and had attained an average yield of close to 40 bushels an acre. Filings for Belle Plaine city offices closed that Tuesday and races for mayor and council developed. Incumbent Mayor Fran Schuman would be opposed by Councilman Roger Martin. Running for the two council seats would be David Smith, Ivan Otto, Walter Hedblum, David Edberg and William Chard. Amy Elizabeth Novak, 11, of Belle Plaine, represented Minnesota at the Cinderella International Finals in Miami, Fla. Amy, the daughter of Mr. and Mrs. Tom Novak of Belle Plaine, won the creativity award and was the recipient of a scholarship from the John Roberts Modeling Agency. William M. Diers, 74, of Blakeley, passed away at his home Oct. 2. Mr. Diers was born July 17, 1910 at Blakeley to John H. and Mary (Franciscus) Diers. He was engaged in farming. Survivors included a brother, Virgil Diers of Belle Plaine, and nieces and nephews. Harry Schultz, 78, of Belle Plaine, passed away Oct. 2 at Fairview Southdale Hospital, Edina. Mr Schultz was born July 9, 1906 in Belle Plaine to Adolth and Minnie (Wolf) Schultz. He was engaged in farming in the Belle Plaine area until the early 1950s when he became engaged in the liquor business in Belle Plaine, operating what is now Neil’s Pub.

Fire on the Emil Klaustermeier farm between Bongards and Belle Plaine destroyed 58 hens and severely damaged the 16x40 poultry house. Mr. and Mrs. Fred Herrmann celebrated their 60th wedding anniversary at their home in Norwood. Miss Ramona Cecelia Ruhland, daughter of Mr. and Mrs. Math J. Ruhland of Union Hill, became the bride of Edgerton J. Choudek, son of Mr. and Mrs. J.J. Choudek of Montgomery. Raymond Lough, 55, member of a well-known former St. Lawrence family, died at his home in Dawson. Mr. and Mrs. Leonard Seck celebrated their 25th wedding anniversary at the auditorium of Zion Lutheran Church. Fred J. 90 Years Ago (1924)

Frank Kilduff became the owner of the old cereal mill property, taken in trade on 40 acres of land in Tyrone Township. Frank had hope of interesting some people in using the property. Henry P. Anderson and family moved here, the former to engage in well-drilling operations. The bus company was offering a rate of $1.50 round trip from here to Minneapolis or St. Paul during the month of October. William Buesgens bought 90 acres of his father’s farm on the north side of the river and took occupancy. The local Eastern Star celebrated with a card party on the 25th anniversary of their organization here. Fred H. Mensing moved to Devils Lake, N.D., to engage at his old trade as miller. Anders Lars Mellgren, a resident of West Union since 1864, died at the age of 88. At the time of his death he was the oldest member of the West Union congregation. A young people’s parish club was organized at St. Peter and Paul’s Church. The committee named to draw up plans were Leo Albrecht, Bernard Engfer, Laura Druke and Rose Engfer. A petition was being circulated to have Sibley declared as a state-aid road, the so-called lower road in Faxon from the Mann farm to north of the Belle Plaine bridge. Ton-litter contests were making headlines. Emil Mueller at the west side of Belle Plaine won second place in the Scott County contest. A litter of 10 of his pigs attained weight of 2,412 pounds in 180 days. At the church in Jessenland took place the marriage of Miss Mary McGuire and John Elmer Martin. Judge Andrew L. Holt and family, Minneapolis, were back for a visit with his sisters at East Union.

120 Years Ago (1894)

Politics was exciting more interest than had been shown in recent years. Mrs. Kate S. Whitlock and daughter moved from the farm into town. H.B. Conlon resigned his position as school principal to campaign for the office of county school superintendent. W.F. Freeman of Mankato was engaged to fill the school vacancy. The village of Arlington got wide newspaper publicity on the news that it had 15 widows living on Main Street, all owning the home in which each lived and all had money in the bank.

As Scott County Chief Deputy, Mr. Hocevar oversees a staff of over thirty people. In the last 11 years, the County Attorney's Office has hired numerous women in support staff and attorney positions. Mr. Hocevar treats women and men equally in the workplace and recognizes each person's contributions to the Scott County Attorney's Office, regardless of gender. Ron is an excellent attorney and manager. Ron has earned the respect of his colleagues by treating everyone in the office fairly and with respect. Ron is the father of a daughter and a husband whose wife works inside and outside the home. It will be a seamless transition for Ron to go from Chief Deputy to County Attorney. Dear Editor, To the Belle Plaine School Board, On September 22nd The Equal Access of School Facilities Policy was brought into question specifically in regards to the Gay Straight Alliance (GSA) that meets during the lunch hour at the high school. The use of school announcements to inform students of GSA meetings and the involvement of faculty offering their time to answer questions about topics concerning the group was highlighted. At this meeting, school board member Joe Vandermark said that those who approached him didn’t agree with the group’s philosophical beliefs and expressed their concerns to Mr. Vandermark. Mr. Vandermark obliged this group’s concerns and argued the GSA group’s use of the district’s communication systems like Infinite Campus to announce meetings and the perceived involvement of school faculty were a breach of the Equal Access policy. The Belle Plaine Education Association strongly believes in the Belle Plaine School District’s mission statement “Expecting excellence from everyone, every day.” The mission of the public school is to educate ALL students. Educators and administrators have the power to ensure that their time in school is a safe and positive experience for each and every child, every day. By limiting a group’s ability to announce their meeting times or to allow faculty to assist in answering questions, we as an entity can not ensure that ALL students can find excellence every day. Furthermore, according to the school board’s page on our district site,“Our greatest asset is our dedicated, professional staff. Our faculty realize that students learn differently and do their best to meet each student’s individual needs.” (http://www.belleplaine.k12. mn.us/page/2459) Our professional staff work outside their contract hours for a variety of reasons to aid in the development of our students in and out of school. Asking staff to refrain from helping our students develop into successful adults is an anathema to meeting our students’ educational needs. If the Equal Access of School Facilities Policy can not meet the expectations of our school vision or standards, then the policy needs to be adjusted to incorporate this vision and these standards. Dear Editor, Arguably the most impactful economic development decision made by a Jordan City Council in recent history was passed on August 18th, 2014. The 20+ years of uncertainty has ended. The question of what is going to happen to the intersection of 169 and 282/CR 9 in Jordan has been answered. On August 4, the Jordan City Council moved to “Officially Map” the location of the intersection and passed the motion to legally record the location. Also, it is important to note that the City of Jordan Planning Commission and the Economic Development Authority recommended the Official Mapping of the intersection. This ends the bleeding of perpetually endless meetings with business owners, Council agenda items, consulting fees and expensive studies. No future City Council will be saddled with this task and the taxpayers will not have to carry the financial burden of the rising cost of those tasks. A location that protects our existing businesses and landowners in the area was determined and will be recorded on the plat maps of the area. Official Mapping (Platting) will protect our existing tax-paying businesses while preserving right-of-way for the location of the future intersection. This decision puts the intersection where WE want it and not where MnDOT may choose. Please remember what the effect of a MnDOT decision has had a few miles down the road from Jordan in our neighboring Belle Plaine; shuttered businesses. The reader needs not be reminded how a growing commercial area in Belle Plaine was crippled. The MnDOT answer to the intersection in Jordan was to remove at least one existing business at the intersection, close access to 169 at Creek Lane and dead-end Triangle Lane which would have made access to the businesses on Triangle Lane cumbersome and would have nearly severed our access to those businesses. MnDOT is required to acquire permission (Municipal Consent) for a particular city in which they are altering a trunk highway. This gives any future City Council “teeth” to direct the intersection to a location that has been predetermined. From MnDOT’s website: Municipal approval is required for any trunk highway project that results in any of the following within a municipality: • Alters access, • Increases or reduces traffic capacity, or • Requires acquisition of permanent right-of-way. • (Changing capacity means adding or reducing the number of through lanes. For example, adding auxiliary lanes is not a change in capacity). A number of years ago during a SCALE tour of Scott County by Developers, the overwhelming consensus from Developers was that the lack of development of this area in Jordan is absolutely due to the uncertainty of the future intersection. As a consequence, the landowners have not built near this intersection without knowing if their future investment in the property would face condemnation if the Minnesota Department of Transportation (MnDOT) would decide to place the intersection in an area of their (MnDOT’s) choosing. A large portion of the area that will now be preserved for this intersection is currently in the floodplain and is subject to very stringent building regulations. This would have made development difficult at best. The vote passed and ended as they commonly do for the positive welfare and future of our city; 6:1. It has been said that we may still be 20 years from the actual build of the intersection. However; there are options to expedite that particular timeline and they are being explored. The total amount to be assessed to benefitting property owners is $369,144.19. The rest of the tab will be picked up by the city through bonding. This year’s work included the reconstruction of Raven Street between Meridian and Walnut streets, Chestnut Street between Park Street and Commerce Drive, and Cedar Street between Park Street and Commerce Drive. One of the main things talked about on Sept. 15, during which three people addressed the council, regarded turf restoration issues, which City Engineer Joe Duncan said he and the contractor are aware of, and that all turf issues in the project area are being addressed. Duncan said the entire project area will be inspected and a punchlist developed for the contractor to tend to before the city signs off on the project, which won’t be entirely completed until next spring. Currently, the project is “substantially� complete, meaning the improvements are being used but final surfacing and punchlist items will be completed in the spring. In March, the council awarded the 2014 contract to William Mueller and Sons of Carver at the low bid of $1,074,444, which was $173,535 below the engineer’s estimate of $1,247,979. *Unanimously authorized staff to enter into an agreement with Central Tank Coatings of Elgin, Iowa, to clean the exterior of the city’s water tower near the Prairie Park softball field at a cost of $5,800. Public Works Superintendent Al Fahey reported that the lower half of the sphere of the tower is in need of cleaning. John Mason Spicer built Medayto Cottage in 1893 on Beautiful Green Lake. In the 1930’s, fisherman began commonly identifying their landmark for locating fishing spots as Spicer’s Castle. This lake home is tucked into the woods and fronted by 600 feet of lakeshore. Eunice Spicer Latham preserved many of the original furnishings. Some parts of the home have changed little over the years. It is listed on the National Register of Historic Places. It reflects the slow paced, gentle days of a century ago. Staff will give each participant their part in the mystery upon arrival, and explain the specific details. Homecoming Week kicked off on Monday in the Belle Plaine Schools with the 2014 Coronation ceremony. Congratulations to all king and queen candidates and to this year’s Homecoming Queen Emilyn Siemon and King Joe Hankins! Special activities are planned throughout the week for students culminating with a pepfest on Friday afternoon at the high school and the dance on Friday night. Good luck to our tennis team in their Section individual tournament play this week; to our cross country teams as they compete in the Conference Meet at Watertown on Thursday; to our volleyball team in action against Chaska and Norwood-Young America this week and to our football team who hosts Tri-City United on Friday night. It is amazing that we already beginning to near the end of the fall sports season! This past week, the Minnesota Schools assessments results using the Multiple Measurement Rating (MMR) were released by the MN Department of Education. The MMR scores are focused on overall growth in academic achievement by our students, on closing the achievement gap between sub groups of students and on achieving graduation status within four years of entering high school. In addition, the MMR assigns points for the overall level of proficiency that students have shown on their statewide assessments – the MN Comprehensive Assessments (MCAs). The scoring is calculated for each building based on their MCA results. For Belle Plaine that means we have scores for Oak Crest Elementary, our Junior High and our Senior High buildings. The proficiency scores are determined by comparing the proficiency results for each student sub-group against a predetermined target percentage. For each sub group that meets the target, points are awarded toward your MMR score. In order to be included in the scoring, each subgroup of students must have at least 20 students. For Belle Plaine, we typically only have large enough subgroup size in our white students and free & reduced meal eligible student categories. The growth domain measures the ability of schools to get student to meet or exceed expected growth over a year’s time. Each student receives an individual growth score in reading and math, and this domain uses the average school growth score in both subjects. This domain does not consider student subgroups. The achievement gap reduction domain measures the ability of schools to get higher levels of growth from lower-performing student groups than statewide average growth for higherperforming groups. Schools aim to have student group growth scores at or above the statewide growth scores and pay close attention to those student groups with very low growth scores. Finally, the graduation rate for each student group is compared to the 90% graduate rate target. Schools aim to have a Yes response in this category and if successful, receive the full 25 points allowed in this area. jessenland township board RE: Farming in the road right-of-way (ROW) The Board of Supervisors has observed some instances where tillage is being done in the ROW. The ROW extends two rods (33 feet) either side of the center of the road and exists in order that the roads may be properly maintained for the benefit of all who use them. Roadside mowing in the ROW is permitted, for the purpose of weed control or making hay, but tillage or crop production is not permitted (M.S.160.2715) as it may adversely affect road structure and maintenance. Anyone who damages or alters the ROW will be held responsible for all costs of restoration. The town board has no desire, or intention to go around checking every field with a tape measure, and appreciated the generally good farming practices of our agricultural producers. However, those places where excessive encroachment has occurred will need to be dealt with. The township may be marking or seeding some area’s going into this fall and next spring and requires that these be left undisturbed. Your full cooperation is anticipated and appreciated. Tigers Win Twice, Move Into Tie for First Place in MRC by Dan Ruud The Belle Plaine High School volleyball team cooled off what was a red-hot Sibley East volleyball team with a drama-filled five-set victory last Tuesday night in Gaylord. The win moved the Tigers into a four-way tie for first place in the Minnesota River Conference, which on Thursday was narrowed to a three-way tie, which the Tigers remained a part of following a 3-1 triumph over visiting Mayer Lutheran, dropping the Crusaders to 3-2 in the standings. Belle Plaine, Jordan and Sibley East are all at 4-1. The Tigers were scheduled to head to New Prague for a nonconference match Tuesday night after this edition of the Herald went to press. They will host Norwood Young America in a MRC match 7:15 p.m. this Thursday. Belle Plaine will take on Class 3A power Chaska 7 p.m. next Monday night in Chaska before closing the MRC season at winless WatertownMayer 7:15 next Tuesday. Tigers 3, Sibley East 2 The Tigers came from behind in the fifth set to narrowly knock off the host Wolverines 26-24, 14-25, 25-21, 23-25, 1614 last Tuesday night. “This entire match was one of the best we’ve competed in all year,” said Belle Plaine coach Cassie Koch. “Sibley East has a very competitive squad this year, and with likely shares of the conference title at stake, the volleyball was high level and the atmosphere was intense all night long. Our kids did an outstanding job of keeping their composure and finding the stamina to power through a very long match. Their hard work and faith in each other allowed us to pull off an incredible come-from-behind victory in the fifth set.” Kaylee Hentges led Belle Plaine in kills with 24. Also in double figures in that department were Dakota Poitra with 17 and McKenzie Koepp 10.

Belle Plaine Blanked at NYA by Dan Ruud The Belle Plaine High School football team’s hope of a share of the Minnesota River Conference championship was virtually erased following Friday night’s 21-0 loss at blustery Norwood Young America. What a difference a week makes in that the Tigers blew out Le Sueur-Henderson the previous Friday when temperatures were near 80 degrees and were accompanied by mosquitoes at kickoff. Shivering spectators at this past Friday’s game were witness to some of the season’s first snowflakes. The loss dropped Belle Plaine to 3-2 in the MRC, 3-3 overall. The Raiders improved to 4-1 in the conference, good for second place behind WatertownMayer (5-0) with two games to play. Tri-City United is also 4-1 in the standings, followed by Belle Plaine and Jordan both at 3-2. Belle Plaine managed to hang in the game through three quarters, and with the score still just 7-0, was within 30 yards of a potential game-tying score three times before being stopped on downs. Fullback Zack Storms scored the first two touchdowns for NYA, the first coming on a 1-yard plunge with 4:34 left in the first quarter. His next didn’t come until early in the fourth quarter, this time from 2 yards out.

An interception by Evan Worm set the Raiders up at the Belle Plaine 7 yard line late in the fourth quarter, which led to a short TD run by quarterback Isaac Hormann with 3:04 left in the game. The Tigers actually outgained the Titans. Belle Plaine had 236 yards of offense (181 rushing and 55 passing), while NYA had 224 yards – all on the ground. Tigers Compete in Two Meets by Dan Ruud The Belle Plaine High School girls’ and boys’ cross country teams journeyed near and far last week, traveling to Ney Nature Center in Henderson for a coed meet last Tuesday before making the 200-mile trip to Duluth for Saturday’s massive 64th annual Swain Invitational. The Tigers will compete in this Thursday’s Minnesota River Conference Meet at WatertownMayer. Races are scheduled to start at 3:30 p.m.

Asteria Inn & Suites Rejuvenating the Prairie Workers from the Minnesota Department of Natural Resources conducted a controlled burn on about 15 acres of state wildlife natural prairie last Tuesday. The site is located almost directly across Highway 19 from the Ney Nature Center in Henderson. The purpose of the burn was to free the prairie of young cottonwood trees and other undesirable vegetation that were springing up on the prairie. Such controlled burns are used to rejuvenate natural prairies.
