Legal Notice Scott County has released the revised Final Environmental Impact Statement (EIS) and Groundwater Monitoring and Mitigation Plan for public review on a proposed aggregate mining operation called Jordan Aggregates Proposed Mining Operation. The project site is located in Section 8 and 17 of Sand Creek Township, Scott County. A copy of the revised Final EIS is available for review at the Jordan Library. A copy is also available for review during County Courthouse office hours in the Environmental Health and Inspections Department. This revised Final EIS is also presented on the Scott County Web site (www.co.scott.mn.us). The review period will be open for 10 business days from June 23, 2014 through July 7, 2014, as noted in the Minnesota Environmental Quality Board’s newsletter, the EQB Monitor. Publication of the EQB Monitor is scheduled for June 23, 2014. Comments on the adequacy of the revised Final EIS must be received before 4:30 P.M., July 7th, 2014, for consideration.

The Ordinance is as follows: 30.1 PURPOSE As authorized by Minnesota Statutes 86B.201, 86B.205, and 459.20, AND Minnesota Rules 6110.3000 – 6110.3800 as now is effect and as hereafter amended, this Ordinance is enacted for the purpose and with the intent to control and regulate the use of the waters of McMahon Lake, also known as Carl’s Lake (State Inventory Number 70005000) in Scott County, Minnesota, said body of water being located entirely within the boundaries of Scott County, to promote its fullest use and enjoyment by the public in general and the citizens of Scott County in particular, to insure safety for persons and property in connection with the use of said waters; harmonize and integrate the varying uses of said waters; and to promote the general health, safety and welfare on McMahon Lake. 30.2 DEFINITIONS For the purposes of this Ordinance, the definitions set out in Minnesota Statue Section 86B.005 are incorporated herein and made part of this Ordinance. Terms not defined by said Statute shall have the following meanings: High Water. An elevation of 965.2 feet NVGD 29 measured at the gauge located approximately 100 feet south of the Public Boat Launch on County Road 81. Shore. The line separating land and water which shifts as lake levels increase and decrease. The following terms are also defined in Minnesota Statute Section 86B.005. For current definitions see Minnesota Statute Section 86B.005, as amended: Slow No-Wake. The operation of a watercraft at the slowest possible
speed necessary to maintain steerage, but in no case greater than five (5) miles per hour. Watercraft. Any contrivance used or designed for navigation on water, except: (1) a waterfowl boat during the waterfowl hunting seasons; (2) a rice boat during the harvest season; or (3) a seaplane. 30.3 WATERCRAFT SPEED LIMITATIONS No person shall operate a watercraft at greater than a slow no-wake speed 24 hours per day within 150 feet of the shore when the lake level equals or exceeds the High Water level (965.2 feet NVGD 29) as measured at the gauge located approximately 100 feet south of the Public Boat launch on County Road 81. Such restrictions shall become effective upon publication in a local daily newspaper as a news item or on a specified date, whichever is later. All public watercraft accesses shall be posted prior to and during the time restrictions are in place. In addition, notice of said restriction shall also be posted at the County Government Center. When the high water level has subsided and has remained below an elevation of 965.2 feet NVGD 29 for three (3) consecutive days, said restrictions shall be promptly removed. 30.4 ENFORCEMENT The primary responsibility for enforcement of this ordinance shall rest with the Scott County Sheriff’s Office. Personnel, while acting in the performance of their assigned duties are exempt from the foregoing restrictions. 30.6 NOTIFICATION It shall be the responsibility of Scott County to provide for adequate notification of the public, which shall include placement of a sign at each public watercraft access outlining essential elements of the ordinance, as well as the placement of necessary buoys and signs. 30.7 PENALTIES Any person who violates any provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than five hundred dollars ($500.00). Belle Plaine’s Carlson Family Saw the Worst of the Storm (continued from page 1) for 28 years. He’ll continue to coach the girls’ varsity basketball team. Thursday, around 10 minutes before 10 a.m., Terry Carlson, Randy’s wife, and their daughter, Tanya, were upstairs at the house in Tyrone Township not far from Le Sueur. It was raining again and Terry was showing her daughter a photo she had just taken. Looking out the window, Terry saw mud and gravel sliding across the yard from the driveway. Then, it happened. “You feel movement and you just kind of freeze,” Terry Carlson said. The next thing she recalls was a snap of a tree south of the house and a crashing of trees and hillside as it slid into the house and through a 20 foot-by-8 foot section of dining room wall. The two women ran downstairs and saw the tree and tons of dirt and clay in the dining room. Stunned, they gathered their purses and car keys. Shock turned to terror when they smelled propane leaking from the tank adjacent to the house. Fearing the mix of gas fumes and damaged electrical wires or appliances could ignite an explosion, the two women fled for their lives. “We’re very lucky,” Terry Carlson said.
‘We’re Alive . . .’
The rain and unstable roads near the house made their tip into Henderson a perilous journey filled with poor vision, finding a passable road and dodging downed trees and branches. Terry called Randy, who was supervising open gym at Belle Plaine Junior-Senior High School. Uncertain of the cell phone signal, she stressed, “We’re alive, but the house is gone” and for him to call 9-1-1 because of the mudslide. Randy Carlson didn’t have his cell phone with him while he was in the gym. When he got the call, he left the school in a blur. Because the roads between the Le Sueur Fire Station and Carlson’s house was “compromised,” Randy said Henderson firefighters responded to the call. By the time he and a sheriff’s deputy reached the house, they turned off the propane and
surveyed the damage.
Insurance Won’t Cover It
The Carlsons face the daunting task of paying for repairs to the house out-of-pocket because homeowner’s insurance won’t pay for damage caused by moving ground. The Carlsons have been allowed back in the house to retrieve their personal items and valuables. They are not allowed to go into the basement of the house. An inspection revealed a crack in its foundation. “They said it’s too dangerous,” Randy Carlson said. Randy grew up in town. Terry – her maiden name is Renneke -- grew up in the country. When they were married 34 years ago, Randy agreed they’d live in the country, a tranquil lifestyle he enjoys since they built the house in 2004 and moved there from a place they owned on Blakeley Trail. “We found the property and really liked it,” he said. “We thought we’d be here forever.” The decision whether or not to repair the house or move, Randy said, will come down to recommendations of three people – Tom Schultz, their builder; an excavator and a real estate agent. He’s not sure whether he wants the recommendation to go – rebuild or raze the house and start anew. “I don’t know what’s going to happen,” he said. “We’re in a holding pattern. It’s not going to be days, or weeks or months.” The Carlsons are trying to keep their spirits up. “There’s a lot of people who are worse off than we are,” Randy said. Friends, neighbors and supporters from the Belle Plaine and rural Le Sueur areas have offered help and support. The family is grateful to many people, from emergency responders to friends, family and supporters. The Carlsons are staying in a motel in Belle Plaine. They’ve received donations of food, gift cards and offers to help when needed. The assistance, he said, is humbling. “People are dropping off things, offering us help,” he said, “and you know you can never pay them back.”
Benefit Planned for Paul ‘Lumpy’ Lambrecht A fund-raising event will take place for the Paul “Lumpy” Lambrecht family on Sunday, July 13 from 2-6 p.m. at Minnesota Harvest Apple Orchard (8251 Old Highway 169 Boulevard, Jordan). Paul was diagnosed with stage 3 rectal cancer and is undergoing chemo and radiation treatments, which will be followed by surgery and more chemo treatments. The fund-raiser will include a
meal and beverages available for purchase. There will also be a silent auction and raffle, as well as face-painting and other kids’ activities. Paul, who will turn 49 on June 23, and his wife, Emily, have three children – Zach, 9, Teagan, 7, and Evy, 4.
