Man Found Guilty of Criminal Sexual Conduct Involving Girl A man awaits sentencing after a Scott County District Court jury brought back guilty verdicts on four counts of criminal sexual conduct involving a child. Thursday (Oct. 23), Emery Scott Whitt of Belle Plaine, was found guilty of criminal sexual conduct with a teenage girl. He lived with the girl’s parents and family in Savage from 2006 through 2008 and also in Chaska. Judge Michael Fahey is scheduled to sentence Whitt Dec. 1. “We couldn’t be more proud of the victim’s courage in coming forward,” said Scott County Attorney Pat Ciliberto. “Silence is an abuser’s best friend. It is our sincerest hope that this victim’s bravery will serve as encouragement to any other victims of such a crime. By coming forward, criminal acts against children can and will be diminished.” After a four-day trial that began Monday (Oct. 20), Whitt was found guilty on two counts of first-degree criminal sexual conduct with a girl under age 13. He was also found guilty on two counts of second-degree criminal sexual conduct.

Charges against Whitt came after staff at the Midwest Children’s Resource Center in St. Paul evaluated the child in October 2013. The criminal charges state he abused the girl over a four-year period. The child believed the abuse began when she was 5. The abuse, the charges state, included Whitt making the girl touch him in inappropriate places and him touching her in like fashion. It states Whitt would have the girl touch him inappropriately while he was naked and that he would undress the child. The charges also state Whitt, 46, “would hit and slap her and tell her not to tell anyone or something else would happen to her.” The charges against Whitt also included information he was being investigated in 2007 and 2008 for abusing his own children in Texas and that he is not allowed any contact with his own children. Scott County Human Services warned the parents of the girl in Savage that Whitt should not be allowed to be at home alone with the girl or her four younger siblings. Whitt was tried in Texas in March of 2012 for sexually abusing his 12-year-old niece. According to the criminal complaint, the trial ended in a hung jury. A new trial has not yet been scheduled.

Sibley County Board, First Commissioner District The District 1 Sibley County Commissioner race features newcomer Bobbie Harder of Henderson Township vying against Faxon Township board member Matthew McConnell and incumbent Commissioner Jim Nytes of Henderson Township. Nytes is running as a write-in candidate. The district includes Henderson (city) and eastern Sibley County townships of Faxon, Washington Lake, Jessenland and Henderson. What are the biggest challenges facing Sibley County and the First Commissioner District in the next 5-10 years and how can these be addressed in a cost-effective manner? Harder: The challenges we face today will continue for several years. This includes roads, bridges, and the management of excessive water runoff. The dam at Titlow Lake is approximately 100 years old. If the dam is compromised or breaks, the water will travel easterly which will severely affect property owners in the district. Dealing with the increased regulations from state and federal agencies (i.e. EPA, DNR, MNPCA), and how they affect the county needs to be addressed, as they can be detrimental, particularly from the EPA. For example, with the proposed new rules from the EPA, all water or occasional wetland will not be safe from regulation. The EPA’s regulations give farmers and property homeowners no certainty that their farms and yards are ever safe from federal regulation. Failure to comply can cost you $37,500 per violation, per day and that is fact. Can anyone afford such fines? Our expectation is that government must be fiscally responsible with our tax dollars. The cost versus benefit of a project must be considered. Using the experience of local business would be my preference. Many rules and regulations passed by government agencies will affect us financially. At times, it appears we have no recourse. I will be the voice of the district to contest excessive orders and mandates that affects the farmers, citizens, and our area businesses. McConnell: The biggest thing that I see is economic development. Currently Sibley County has a population of around 15,100. In 2000, we had around 15,356 and this is not a path of success for the county. We need to plan to attract a good mix of jobs and housing to provide Sibley County with the proper growth strategy. If the county keeps on this track, the cost of our infrastructure alone will leave us heavily burdened. Nytes: Rebuilding our county’s infrastructure after the recent flooding is a major challenge in the coming years. For example, bringing County Road 6 out of the flood line is one major focus of mine. condition when given from the state to the county. However, we need to ensure that this good condition is fine from our point of view. Culverts will need to be replaced, ditches cleaned, trees trimmed, and areas that are frequently affected by flooding will need to be raised. We also need to restructure our county’s government. Though this process will be challenging, it has already begun. Cost savings will occur through the consolidation of departments and at the same time no one would be terminated or lost through attrition.

We have some of the hardest working people in our country here in our county but they need more opportunities. The Henderson Classic Car Roll-In is an excellent example of a flourishing opportunity that any business, charity or town resident can take advantage of. McConnell: If elected the thing that would make me think it was a success is to see economic growth and urban sprawl. Harder: Economic development is done best by the private sector, not the government. The county’s role is to not micromanage our private property or dictate how to conduct our business. I support economically viable forms of energy that lower costs for residents and the county. This is a difficult and complex issue. With the shutdown of many coal plants, it is predicted within the next several years, electric bills will increase significantly and may double. I will do whatever is possible to oppose the increasing mandates, rules, and regulations from the state, which decrease our liberties and freedoms as a citizen. The more money farmers, businesses, and citizens have in their pocket will alone increase economic opportunities.

Much of the First Commissioner District received major flooding this spring, causing heavy road damage and impeding economic activity. What options should the county consider to alleviate this issue for residents and businesses in the next flooding event? McConnell: There was a lot of destruction to the First District as we all saw and experienced. One of the things that I see that could be looked into is cost study of raising the elevation of the Scenic Byway in the low areas. Nytes: As the current District 1 County Commissioner, I have already started to tackle flooding issues. I have spoken with an engineer who has seen our county roads, and I believe we should and can build our infrastructure to withstand 100-500 years worth of future flooding. The best part is we can do this using FEMA money currently available to us in wake of the recent flooding. We should build such a long-lasting infrastructure now because we may not get this supportive money after future floods. We need to do these projects right at this time so that it won’t have to be done at the cost of county taxpayers’ dollars later. Harder: An option for the district to look into is creating holding ponds in different areas of the county. This will assist in preventing surface runoff and erosion due to heavy rains. Some areas also suffered damage due to the debris, which came down hills and ravines such as carpet, appliances, and other trash. We need a more cost effective way for residents to discard these items. What should the county’s role be in economic development? Why? Nytes: Hiring Matt Jaunich as county administrator was a significant positive step for Sibley County in economic development. We now have someone in an office position who can act within hours to address new opportunities and questions versus having to wait weeks or months. Harder: I would consider my role as a county commissioner a success by influencing county decisions to be more fiscally responsible, hold the line on taxes, and making fact-based decisions on the real needs of the county. Greater success would be progress made regarding the items I have addressed in this questionnaire. Nytes: In the very near future, I want to raise County Road 6 out of the flood line. I have attended many commissioner and township meetings. In addition, I have been working on building relationships with leaders on a state and federal level. I will listen to you, research the issue, and then recommend sound economical solutions. When working in the field of banking, I gained valuable experience in the areas of auditing, accounting, human resources, and the legal process. This in-depth experience gives me a broad area of understanding. It will be an honor to be your representative at the county level. As a county commissioner, I will work harder on the issues that matter the most to us. Nytes: I am and will continue to be fully committed to improving the lives of our citizens in our county. It is a full-time job to be a county commissioner, and I have the time, experience and passion to be the District 1 commissioner once again. I have been very humbled by losing the primary by one vote, and I ask that you write in my name, Jim Nytes, on Election Day.
