Q. What new disclosure obligations do Vendors have when selling a property? The Sale of Land Amendment Act 2019 came into effect on 1 March 2020. This Act provides that a person must not knowingly conceal from a prospective purchaser any material facts about a property being sold.

Q. What is a Material Fact? A material fact is one which would be important to a purchaser in considering whether to purchase a property and which would ultimately influence that decision and the price they would pay. A fact would be a ‘material fact’ if the fact results in the property being rare or unusual, or if knowledge of the fact would impact a potential purchaser’s willingness to purchase the property. A fact may also be considered material if it is of particular significance to a purchaser such that the purchaser had specifically asked questions about the fact. As a result, the sensitivities of particular purchasers need to be considered by vendors. Some examples of a material fact could be if the property had: - Restrictions on access during particular times; - A history of contaminants used on the land such as agricultural chemicals; - Previously been affected by a bushfire or flooding; - Combustible cladding, asbestos or pest infestations; - Building work done without the required permits; - Been the scene of a serious crime such as a murder, extreme violence or used to manufacture illegal substances such as methylamphetamine or hazardous materials.

Q. What are the Penalties of failing to disclose a material fact? Any person who publishes any statement, promise or forecast which conceals any material fact and is found guilty could face a maximum penalty of $19,826.40 or up to 12 months imprisonment. The Bendigo Branch of the National Trust is asking people to contact the Branch if they have stories, photographs or artefacts relating to the Beehive Stores which operated from 1852 to 1987 in the Beehive Building in Bendigo.

BANDMATES COMMENCES IN GREATER BENDIGO The City of Greater Bendigo in partnership with VicHealth has commenced the popular Bandmates Victoria initiative in Greater Bendigo. During 2020 Bandmates Victoria - Bendigo will match people with disability or mental health issues aged between 18 and 25, with a volunteer who likes the same music, so they can access venues and enjoy live music together. City of Greater Bendigo

Community Partnerships Manager Steven Abbott said while Bandmates has been operating in Melbourne for some time, this is the first time the program has been implemented locally. “Often people with disability and or mental health issues are unable to attend live music or entertainment events unless they are with parents or support workers,” Mr Abbott said. “Bandmates Victoria -

The National Trust Branch will display these items as part of the Australian Heritage Festival to be held in April with many other heritage activities throughout Bendigo. COMMUNITY’S RIGHT TO KNOW

The community’s right to know the facts around Council’s in-principle decision to sell the Lyttleton Terrace council offices and land to the government to build a GovHub is essential to understand what is going on, but it appears our Mayor - CEO and the majority of councillors do not want informed residents. Cr Pethybridge sensationally revealed at the 19 February 2019 Council Meeting that council had been offered just over $5 million for the land by government, a property then worth up to $15million on the open market. Council had not sought a private valuation to our knowledge at that time and suggests the building are worthless. Go to our website www.bendigogovhub.com.au, where you will find 19 reasonable and responsible questions we forwarded to each councillor in early January this year. Thequestions were not casual thought bubbles but very specific and detailed, and were the result of our investigative work, and council answers (or lack of) to previous questions. Council should be delighted that residents take this level of interest, and are not just a “noddy”. We wanted answers, but we also wanted to gauge each councillor’s knowledge and understanding. After all councillors are voting on residents’ behalf, and they need to be doing that from an informed position, not relying on mayoral or group-think, or officer direction. The Mayor informed us the majority of councillors decided she should answer on behalf of all councillors. This was a defensive cop-out by either poorly informed councillors, or councillors afraid to be accountable; a democratic failure. The Mayor’s initial reply preferred to prance on in generalisations. She claimed many questions were repeats; we can assure readers they were not. She gave answers to questions we did not ask. Again, google our site at bendigogovhub.com.au to view the answers. You be the judge. We did not accept the Mayor’s poor reply. We sent a refresher letter challenging the Mayor to provide answers and to also note our dismay at the decision that the Mayor only respond. The Mayor took offence, scolded us, and refused to fully and comprehensively address the 19 questions. In our opinion, the Mayor also made deceptive cover-up statements like: “There has been extensive community consultation about the City being accommodated in the GovHub.”, and, “There has been strong community support for the project to proceed”. From July 2013 when council office consolidation was raised in the Independent Review, to the 19 February 2019 Council Meeting, council did not conduct one public consultation meeting about selling the council property or office consolidation. The Mayor on 1st April 2019 in reply to our correspondence of 22nd March 2019 refused our request to organise a public information and question and answer forum (Public Meeting) to hear speakers and gauge public support. We even suggested May 2 and the Town Hall as a suitable venue. So, we are no wiser about how understanding each councillor is on matters surrounding the proposed property sale. Read our letters and questions, and the mayor’s responses on our website. bendigogovhub.com.au Residents need to understand the dud GovHub deal that the Mayor, CEO, and majority of councillors are imposing on us all. Council initially could be paying annual rental of say around $1.3 million a year. Using past Australian Bureau of Statistics Consumer Price Index and the Reserve Bank inflation calculations as a guide, rental in forty years could be over $6 million annually, and we are left with no asset. Council admits the rental option “results in Council no longer owning the site (or buildings), one of the guiding principles established to access the available options.” Rentals will be worse when the government on-sells the GovHub to private investors.
