I

f you’ve been in real estate for at least a few years, then you likely know April is National Fair Housing Month. This is the month when we celebrate the signing of the Fair Housing Act in April 1968. While all of our members follow the law and provide equal services to all people, it is a good time to remind members and consumers about what fair housing means. Fortunately, you may read all about it on pages 24-27. We will also be having a series of webinars and Member Focus Monday shows covering the topic as well. Look out for more information about those soon. With low inventory and mortgage interest rates rising, I have been busy talking about all things real estate in the media. While interest rates are going up, we are still near historic lows. We were last above a 5 percent average mortgage rate for a 30-year fixed loan in April 2010, according to Freddie Mac. That is a nice run of time with such low rates, but real estate still sold prior to that. It may take some buyers out of the market as rates rise, but REALTORS will still be needed. You may read our most recent MLS report on pages 8-12. Whether you are one or are related to one, you should know that Millennials now make up 43 percent of home buyers, according to NAR research, which you may read on pages 28-29. Fortunately for us, Millennials are the generation most likely to use the Internet to find a home (HAR.com) and are the most likely to use a real estate agent. Make sure you read the article, so you know more about this important segment of the population.

Steady consumer demand drives prices to record highs and inventory back to its historic low BY DAVID MENDEL

The Houston real estate market completed its second month of the new year in positive territory, despite soaring prices and evaporating inventory. Home sales scored double-digit gains in February, but part of the strong showing was because the statistics compared to last February, when that deadly Texas freeze halted real estate activity for days, and in some cases, even longer. Undistorted by the weather factor were the continued squeeze on inventory, which returned to its all-time low, and pricing, which due to limited supply and ongoing consumer demand, soared to record highs. According to the Houston Association of Realtors’ (HAR) February 2022 Market Update, single-family home sales jumped 22.9 percent with 7,372 units sold compared to 5,997 in February of 2021. Compared to the last “normal” February – in 2020 – sales volume was

up 23.3 percent. With fewer housing options available for purchase, consumers placed heavy demand on single-family rental homes in February. Homes priced between $250,000 and $500,000 led the way in sales for the month, registering an 80.1 percent year-over-year gain. The $500,000 to $1 million housing segment came in second place, surging 72.3 percent. That was followed by the luxury market – consisting of homes priced at $1 million and above – which rose 33.5 percent. For months now, the lack of available homes below $250,000 has forced consumers to shop for homes at higher price points. In February, this tight sellers’ market pushed prices beyond the records set in 2021 to the highest levels of all time. The average price of a single-family home rose 13.4 percent to $395,871

while the median price increased 19.3 percent to $328,000. Sales of all property types jumped 25.6 percent year-over-year, totaling 9,299, and total dollar volume for February soared 43.5 percent to $3.5 billion. “Last year’s freeze may have distorted the February sales figures, but the fact remains that home sales throughout Houston continue to trend upward despite the challenges posed by limited inventory, record-setting pricing and rising interest rates,” said HAR Chair Jennifer Wauhob with Better Homes and Gardens Real Estate Gary Greene. “We are watching closely to see how the local housing market may be affected this month by surging oil prices and some of the other economic fallout of the Russia-Ukraine conflict.”

LEASE PROPERTY UPDATE Houston’s lease market had a generally strong February, continuing to benefit from consumers that have postponed homebuying plans until the market provides a bigger and more affordable supply of housing. Single-family rental homes jumped 23.8 percent year-over-year. However, leases of townhomes and condominiums declined 1.0 percent. The average single-family rent rose 6.5 percent to $2,052 while the average rent for townhomes and condominiums increased 7.9 percent to $1,767.

FEBRUARY MONTHLY MARKET COMPARISON February was a strong month for Houston real estate, despite year-over-year readings that were distorted by the interruption to real estate caused by the Arctic blast last February. Singlefamily home sales rose 22.9 percent year-over-year. When compared to the last “normal” February, in 2020, sales were up 23.3 percent. On a year-to-date basis, sales are running 15.4 percent ahead of 2021’s record pace. Most of the other monthly measurements were also positive. Pending sales jumped 23.6 percent. However, total active listings — or the total number of available properties — fell 10.7 percent as a result of the steady homebuying that never let up as Houston’s record-setting real estate year of 2021 ended and 2022 began. Single-family homes inventory slid to a 1.3-months supply versus 1.5 months last February. That matches the historic low that inventory maintained from March through May of 2021. Over the past year, its highest level was a 1.8-months supply in August 2021. Housing inventory nationally is at a 1.6-months supply, according to the latest report from the National Association of REALTORS (NAR).

SINGLE-FAMILY HOMES UPDATE Single-family home sales shot up 22.9 percent in February with 7,372 units sold throughout the greater Houston area compared to 5,997 a year earlier. Part of that sizeable gain is attributed to an interruption in real estate business last February resulting from the deadly Texas freeze. HAR compared sales volume to the last “normal” February, in 2020, and that reflects an increase of 23.3 percent.

Strong sales volume among higher-end homes pushed up pricing to historic highs. The median price climbed 19.3 percent to $328,000 while the average price rose 13.4 percent to $395,871. These surpassed the last record average price of $393,295 set in June of 2021 and the last record median price of $317,990 set in December of 2021. Days on Market, or the actual time it took to sell a home, fell from 48 to 41 days. Inventory registered a 1.3-months supply compared to 1.5 months a year earlier. That matches Houston’s lowest inventory level of all time – first reached last spring. The current national inventory figure stands at 1.6 months, as reported by NAR. Broken out by housing segment, February sales performed as follows: • • • • • •

$1 - $99,999: decreased 24.0 percent $100,000 - $149,999: decreased 53.5 percent $150,000 - $249,999: decreased 44.1 percent $250,000 - $499,999: increased 80.1 percent $500,000 - $999,999: increased 72.3 percent $1M and above: increased 33.5 percent

HAR also breaks out sales figures for existing single-family homes. Existing home sales totaled 5,765 in February. That was up 23.4 percent from the same month last year. Because that figure was likely skewed by the freeze effect last year, a comparison to February 2020 shows an increase of 24.0 percent. The average sales price rose 12.1 percent to $391,180 while the median sales price climbed 18.1 percent to $319,000. The average price is the second highest of all time while the median establishes a new record high. TOWNHOUSE/CONDOMINIUM UPDATE Townhouses and condominiums had another strong month of sales in February with volume surging 35.9 percent with 659 closed sales versus 485 a year earlier. With that figure likely distorted because of last year’s freeze, a comparison to February 2020 shows an increase of 40.5 percent. The average price jumped 22.4 percent to $266,366 and the median price shot up 26.8 percent to $225,000. Both are record highs. Inventory fell from a 3.1-months supply to 1.4 months.

The Houston Chronicle published news from HAR about the winners of HAR’s prestigious real estate industry awards – Jennifer Vickers, 2021 Realtor of the Year and, and Agatha Brann, recipient of the 2021 John E. Wolf Community Service Award. The February 19 article featured color photos of the winners that HAR provided.

A February 23 press conference held jointly by HAR, Crime Stoppers of Houston and Clear Channel Outdoor to launch an awareness campaign about the growing problem of rental scams garnered widespread broadcast and print coverage across the Houston market. HAR Chair Jennifer Wauhob spoke on behalf of the Association along with Immediate Past Chairman Richard Miranda, who presented his remarks in Spanish for the Spanish language media in attendance. Among those that covered the announcement were Fox 26 News, 11 News, Local 2, CW39, KUHF/Houston Public Media, 45/Univision, Telemundo, Información Spanish Newspaper and Houston Agent Magazine. Nearly One-Third of Americans Plan to Relocate BY MELISSA DITTMANN TRACEY

The share of home buyers planning to move from one region to another has grown as many Americans look to relocate to more affordable regions of the U.S. Nearly one in three home buyers—or 32%—say they want to relocate, a record high, according to a new consumer survey conducted by Redfin. Remote work policies, new job opportunities, and ongoing shortages of affordable housing will likely keep Americans moving, economists say. “I predict the share of home buyers looking to move to a different area will continue to rise throughout the year,” says Daryl Fairweather, Redfin’s chief economist. “With mortgage rates going up and rents skyrocketing, moving somewhere more affordable is one of the only ways for many Americans to stay within their housing budget. Even work-

ers who are unable to work from home should feel confident about finding a job in a new location with the tight labor market.” As mortgage rates rise, aspiring buyers may feel more pressure to move. A separate consumer survey from the real estate tech company OJO Labs found that more than 50% of prospective buyers felt optimistic about buying a home over the next three months. Which markets are drawing the most interest among house hunters? Miami was the most popular migration destination of all major U.S. metros in January, according to Redfin’s analysis, followed by Phoenix; Tampa, Fla.; Sacramento, Calif.; Las Vegas; Cape Coral, Fla.; Dallas; San Antonio, Texas; North Port, Fla.; and Atlanta.

What Everyone Should Know About Equal Opportunity Housing The sale and purchase of a home is one of the most significant events that any person will experience in his or her lifetime. It is more that the simple purchase of housing, for it includes the hopes, dreams, aspirations, and economic destiny of those involved.

The Law Civil Rights Act of 1866: The Civil Rights Act of 1866 prohibits all racial discrimination in the sale or rental of property. Fair Housing Act: The Fair Housing Act declares a national policy of fair housing throughout the United States. The law makes illegal any discrimination in the sale, lease or rental of housing, or making housing otherwise unavailable, because of race, color, religion, sex, handicap, familial status, or national origin. Americans with Disabilities Act: Title III of the Americans with Disabilities Act prohibits discrimination against persons with disabilities in places of public accommodations and commercial facilities.

The REALTOR® Fair Housing Program The National Association of REALTORS® has developed a Fair Housing Program to provide resources and guidance to REALTORS® in ensuring equal professional services for all people. The term REALTOR® identifies a licensed professional in real estate who is a member of the National Association of REALTORS®. Not all licensed real estate brokers and salespersons are members of the National Association, and only those who are may identify themselves as REALTORS®. They conduct their business and activities in accordance with a strict Code of Ethics. The Code of Ethics: Article 10 of the National Association of REALTORS® Code of Ethics provides that, "REALTORS® shall not deny equal professional services to any person for reasons of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity. REALTORS® shall not be parties to any plan or agreement to discriminate against a person or persons on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity. REALTORS®, in their real estate employment practices, shall not discriminate against any person or persons on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity."

Article 10 prohibits REALTORS® from discriminating on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity in the provision of professional services and in employment practices. The Board approved a new Standard of Practice under the Article, 10-5, that states, “REALTORS® must not use harassing speech, hate speech, epithets, or slurs” against members of those protected classes.

If You Suspect Discrimination Call the Local Board of REALTORS®: Local Boards of REALTORS® will accept complaints alleging violations of the Code of Ethics filed by a home seeker who alleges discriminatory treatment in the availability, purchase or rental of housing. What does Fair Housing look like in 2022? BY AMBER BURTON ALFRED

HISTORY OF FAIR HOUSING On April 11, 1968, President Lyndon Johnson signed the Civil Rights Act of 1968, which was meant as a follow-up to the Civil Rights Act of 1964. The 1968 Act expanded on previous acts by adding in a prohibition on discrimination surrounding the sale, rental, and financing of housing based on race, religion, national origin, sex, and more recently was amended to include disability and family Status. We know this as the Fair Housing Act of 1968. Over the past 54 years, there have been numerous amendments to the Fair Housing Act and attempts to reverse the impact of the Act.

CURRENT UNFAIR HOUSING ISSUES Unfortunately, we are still tackling the issue of “unfair housing” practices. Today, we are grappling with the aftermath of unfair housing policies like redlining and ensuring real estate professionals know and understand fair housing laws. Richard Rothstein exposed government backed housing segregations issues like redlining in his book, The Color of Law. A few other issues impacting fair housing initiatives include, but are not limited to: • • • • •

Additionally, we collaborate with Texas REALTORS® and NAR, and organizations like the National Association of Real Estate Brokers (NAREB) and the National Fair Housing Alliance (NFHA) to strengthen our outreach efforts and provide resources for both members and consumers. HAR’s Professional Development Department offers webinars that provide information on fair housing rules and programs that can assist homebuyers who may have barriers to homeownership. In November 2020, NAR launched Fairhaven, a new fair housing simulation training for REALTORS® that uses the power of storytelling to help members identify, prevent, and address discriminatory practices in real estate. NAR Report Shows Share of Millennial Home Buyers Continues to Rise Key Highlights • Millennials now make up 43% of home buyers – the most of any generation – an increase from 37% last year. • Generation X bought the most expensive homes at a median price of $320,000. • The largest share of buyers purchased in suburban areas and small towns.

The share of millennial home buyers increased significantly over the past year. They are also the most likely generation to use the internet to find the home they ultimately purchase and most likely to use a real estate agent. This is according to the latest study from the National Association of Realtors®, the 2022 Home Buyer and Seller Generational Trends report, which examines the similarities and differences of recent home buyers and sellers across generations.1 The NAR report found that the combined share of younger millennial (23 to 31 years old) and older millennial buyers (32 to 41 years old) rose to 43% in 2021, up from 37% the year prior. Almost two out of three younger millennials – 65% – found the home they ultimately purchased on the internet, a number that gradually decreases with older generations. Eighty-seven percent of all buyers purchased their home through an agent. This number was highest with younger millennials (92%) and older millennials (88%). "Some young adults have used the pandemic to their financial advantage by paying down debt and cutting the cost of rent by moving in with family. They are now jumping headfirst into homeownership," said Jessica Lautz, NAR's vice president of demographics and behavioral insights. "While young buyers use new tech tools, they also use real estate agents at higher rates than other buyers to help find the right home and negotiate the terms of the transaction."

at 1,800 square feet. Across all generations, the largest share of buyers purchased in suburban areas (51%) and small towns (20%). "Not surprisingly, younger generations typically upgraded in size and price while older generations purchased more affordable properties," Lautz said. "The majority of all generations bought single-family homes at higher shares than other housing types, and younger buyers dispelled the myth that they are flocking to city centers. When it comes to location, the suburbs and small towns are the places to buy." Three out of five of recent buyers – 60% – were married couples, 19% were single females, 9% were single males and 9% were unmarried couples. The highest share of unmarried couples were younger millennials at 21%. Single-female buyers significantly outnumbered single-male buyers across all generations. The highest percentage of single-female buyers was in the silent generation at 27%. The study also found that first-time home buying among younger generations is on the rise, with over 4 out of 5 younger millennial home buyers – 81% – purchasing for the first time. Just under half – 48% – of older millennial buyers were first-time buyers.

Buyers from all generations agreed about the top reasons for using an agent: they wanted help finding the right home to purchase, negotiating the terms of sale and negotiating the price. The silent generation – those between the ages of 76 and 96 – as well as younger millennials were also more likely to want their agent to help with paperwork.

"While the pandemic allowed many potential buyers to save for a down payment, demographics played a key role," Lautz said. "There is a wave of millennial buyers who are aging into the traditional first-time buyer age range." Boomers made up the largest share of home sellers at 42%, although the percentage of millennial sellers is on the rise, increasing from 22% to 26% over the past year. Lautz noted that for the first time it is now more likely for an older millennial to be a first-time seller than a first-time buyer.

Those between the ages of 42 and 56 – Generation X – had the highest median household income at $125,000. They bought the most expensive and second-largest homes at a median price of $320,000 and size of 2,300 square feet, respectively. Older millennials purchased the largest homes at 2,400 square feet, and the silent generation bought the smallest

"Many factors can contribute to the decision to buy or sell a home," Lautz continued. "For all home buyers under the age of 57, the main driver was the desire to own a home of their own. Among those 57 and older, the desire to be closer to friends and family was the top reason, followed by the desire for a smaller home."

Younger generations tended to move shorter distances when relocating. Among all ages, there was a median of 15 miles from the homes where recent buyers previously resided and the homes that they purchased. That distance was lowest among younger millennials (10 miles) and highest among older boomers (35 miles).

Overall, buyers expected to live in their homes for 12 years, down from 15 years last year. For younger millennials and the silent generation, the expected duration was only 10 years, compared to 20 years for younger boomers.

Debt continues to be a significant barrier for many when attempting to buy a home. Both Generation X and younger boomers delayed purchasing a home for five years due to debt, the longest of all age groups. Younger millennials had the highest share of student debt at 45%, with a median amount of $28,000. Twenty-seven percent of younger millennials cited that saving for a down payment was the most challenging step in the home buying process, compared to just 1% for older boomers. Nearly one in three – 29% – of younger millennials received down payment help in the form of a gift or loan from a friend or relative and 24% lived with friends or family, directly saving on rental costs.

Despite this hurdle, a vast majority of buyers have a positive outlook on homeownership. Eighty-six percent of all buyers reported they viewed a home purchase as a good investment, and roughly nine out of 10 people – 89% – said that they would recommend their agent for future services. "A truth across all generations is that homeownership is seen as a cornerstone of the American dream," said NAR President Leslie Rouda Smith, a Realtor® from Plano, Texas, and a broker associate at Dave Perry-Miller Real Estate in Dallas. "From building personal wealth and fostering communities, to strengthening social stability and driving the national economy, the value of homeownership is indisputable. Home buyers continue to turn to Realtors® as a trusted resource for helping find the right home and successfully navigating this increasingly complex process."

It was another very successful election for HAR Recommended Candidates who had a total of 24 wins and just 2 losses in contested races. In Congress, Rep. Dan Crenshaw, Rep. Randy Weber, and Rep. Troy Nehls each won their contested primaries outright and will advance to the general election. In the state Senate, Sen. John Whitmire and current state Rep. Mayes Middleton also won both of their contested primary elec-

he Texas primary election was held on Tuesday, March 1, 2022. The combined statewide turnout was about 17.4% with 11.3% of registered Republican voters and 6.15% of registered Democratic voters turning out to vote in the primary election. While the combined turnout number of 17.4% may seem low when compared to what we typically see in November, it actually set a record for the total number of voters in a Texas gubernatorial primary. However, even with a record number of ballots cast, we still had more than 14 million registered voters who did not vote. So, while we are happy to see more Texans voting in the primary, there is still an opportunity to increase turnout in the future.

Our only two losing candidates were at the county level. First, in Fort Bend County, incumbent Commissioner for Precinct 4, Ken DeMerchant, was unseated after not making the runoff in his race. Community Advocates Neeta Sane and Dexter McCoy now face off in the runoff election to determine the Democratic nominee in the general election. In Montgomery County, Commissioner James Metts was defeated outright by Construction Project Manager Matt Gray, who does not face opposition in the general election and will be the next Montgomery County Commissioner in Precinct 4.

There’s a System for That BY VERL WORKMAN

I don’t remember the first time I heard the following phrase, but the advice is sage: “If you do something more than three times, you need a system for it.” We rely (perhaps unknowingly) on many systems and processes in our everyday lives. Many parts of our lives have been made simple with automation. Some processes aren’t fully automated, but save us time and mental energy from having to figure out how to do them every day. For example, instead of keeping all my clothes in a giant pile, I have them organized by article in the closet so that they are easily accessible and I don’t have to waste time getting dressed. In our businesses, there needs to be a system in place for anything done more than three times. Whether that is onboarding team members, reaching out to leads or clients, or filling out paperwork, each of these procedures needs to be planned, implemented, and improved to fully benefit our teams and clients. After all, who wants to do business with an inconsistent, unresponsive, or inefficient company? To develop efficient systems in your business, follow this… process (you guessed it)…to get your team moving in the right direction.

Plan and Post the Procedure Imagine you want a standardized way to interact with a client for the first time. You’ll need to start by planning what the system will look like. Ask yourself:

Now it is time to write it down and post it where it is visible for everyone who needs it. They say, “If it isn’t in writing, it never happened.” The same holds true for systems, with a simple caveat — if the system isn’t in writing, it isn’t going to happen. Try to document systems with as much detail as possible, so it can be replicated by any team member.

Implement and Improve After you have planned and documented your new process, it’s time to do the work. Sometimes the plan doesn’t work out in the way we want it to. That’s okay! If you have followed your system and you still don’t have the desired outcome, reevaluate your steps in the process to find what is missing. Often when we encounter challenges in our business, we are too quick to blame our people, but improvement will come easier when you know the difference between a process problem and a people problem. More often than not, it’s the process that needs improvement. With Deepest Sympathy Rusty Clark (Perry Homes, RE/MAX)

HAR extends condolences to family, friends and colleagues of retired member Rusty Clark, who has died at the age of 75. Howard Russell “Rusty” Clark, Jr. was born in Edinburg, Texas on February 4, 1947 to Howard and Dolores Clark. The family moved to Houston in 1954. Rusty grew up playing sports, received many athletic honors at Westbury High School and was offered numerous college scholarships before signing with Baylor University where he played football and baseball. He was awarded All Southwest Conference at Defensive End his sophomore year. However, wanting to play quarterback, Rusty transferred to the University of Houston where he also played football and baseball. He was voted MVP for 1969-70. Rusty was drafted by the NFL’s San Francisco 49ers after graduating from college with a business degree, but chose to play for the Canadian Football League in Edmonton, Alberta. Rusty met his wife, Connie, at Willow Meadows Baptist Church, where they were married in 1970. In 1975, their son, Jeremy Russell, was born. Rusty began working for a new home building company, Perry Homes, and in 1976, moved the family to a new development in Katy, which lacked a fire or ambulance service. Rusty obtained an EMT certification so he could serve as a volunteer. He received the Kelliwood Women's Association Achievement Award for outstanding volunteer service in the Katy area. He sold homes for several years before starting his own real estate company, serving as broker/ owner of Rusty Clark Realty World, RE/MAX 48

West and RE/MAX Fry Road for the next 25 years. Rusty was a member of Kingsland Baptist Church, singing in the choir. He served on the Board of Directors of the Memorial Parkway Community Association, was president of the Taylor High School Athletic Booster Club, was a member of the Fellowship of Christian Athletes and was sponsor and coach for Katy National Little League, also working with the Katy Youth Soccer Association and Katy Youth Basketball. Rusty is survived by his wife of 52 years, Connie Coone Clark; his son, Jeremy and wife Kristi; his siblings; Candi Leonetti and husband Damon, Christi Chrisman and husband Bill; his brother-in-law, Gary Coone, sister-in-law, Martha LaGrone and husband Ben; his adored grandchildren; Caden, Callie and Cessa Clark as well as his nieces; Casey Leonetti (Erik), Laura Leonetti, Mandy Chrisman, Amanda Edmonson (Matt), nephews; Josh Chrisman (Tracy), Cameron LaGrone (Amy), and other family members and friends. A memorial service was held on March 26, 2022 at Grand Lakes Presbyterian Church. Rusty’s complete obituary is available at https://legcy.co/3tDGSgw.

the age of 80. During her more than 40-year real estate career, Francisca worked for various companies, culminating with her own firm, Barras Properties, in the River Oaks area. Francisca was born on January 29, 1942 in Valleruela de Pedraza, Spain to Pascual and Alejandra Barras. Being the oldest of 12 children, she worked and studied from a young age in Madrid, London and Paris to provide the best opportunities for her family. Francisca arrived in the United States with her then-husband, Sam Henninger, of Kentucky. Her strong will, hard work, persistence and resilience paved the path for a successful career as a Realtor in Houston for over four decades. She saw every challenge as opportunity and served as a wise sage for family and friends. She approached life the same way she approached death: unapologetically on her own terms. Francisca is survived by her daughter, Nicole Henninger, and her partner, Glenn Smith; as well as her family in Spain- her sisters Paula and Gaby; her brothers Ricardo and Antonio; and her beloved nieces and nephews.
