THE FIRST DROP
CAN FOUR LOKO GO LOW-PROFILE? HERE’S THE GENERAL SENSE IN the malternative category in the weeks following an FDA ruling that the addition of caffeine to a finished alcoholic beverage product is a national no-no: How about we try a do-over? As the last cans of products like Four Loko and Joose (not to mention Moon Shot beer – sorry Rhonda Kallman) leave the shelves to be replaced by caffeine-free formulations, companies wanting to play in the category are going to find out fast if jacked-up alcohol content is enough to keep sales flowing. It’s a category reset that in some ways parallels last summer’s kombucha recall, and there’s likely to be a race to get updated formulations to the shelf. But in this case, there’s a more uncertain consumer response to those formulations on tap. That’s because the brands grew by playing with fire – and the fire eventually consumed them. In an earlier wave, the removal of caffeine was enough to halt the progress of Sparks and Tilt, the big-company entrants into the energy malternative space. But neither brand was really out long enough to create the buzz that Four Loko managed to cultivate on the Internet; its popularity and the potency of the booze might be enough to keep adherents coming back even in an energy-free formulation – especially since many Four Loko consumers ended up passing out anyway, despite the caffeine. Indeed, Phusion Projects, the maker of Four Loko, was a day ahead of the FDA in announcing that it planned to reformulate its products, and many folks suspect that it had an alternative formulation on tap the whole time. Atomic Brands’ President Don Duebler says his company, which had not yet launched its Mad Ballr when the FDA banned energy malternatives, had caffeinated and non-caffeinated formulations prepared, just in case.
4.BEVERAGESPECTRUM.DECEMBER.2010
But where things are going to get interesting is whether the authorities will give a pass to a company like Four Loko, which, while telling the public that it was “demonstrating leadership, cooperation and responsible corporate citizenship” by independently altering its recipe, still will contain enough booze in a single can to get Keith Richards through a two-week tour. Chances are that they won’t. That’s because you can take out the caffeine but you’re still making a product that appeals to rookie drinkers, many of whom are also amateur digital cinematographers. And there’s the rub: any of these brands that manage to stay popular long enough is going to produce the same kind of YouTube videos that both enabled Four Loko’s popularity and eventually accelerated its downfall. (You’ve seen them – kid either chugs Four Loko or sings about Four Loko, or kid has passed out with barf in hair.) It’s not the first time it’s happened to this kind of product – in my not-so-long-ago college days, it was Cisco that was pulled from the market because it was too strong and too easy for dumb undergraduates to drink (That we called it “Liquid Crack” instead of “Crack in a Can” once again indicates the role of packaging). But there wasn’t that same torrent of peer-to-peer media letting us all know about it. It never got as big. Which may be another strategy for these brands – maybe they could go low profile and stay off the radar, but chances are that would render them so marginally appealing they’d just eventually go back off the shelves, anyway. But don’t take my word for it. Here’s Robert McKenna, the Attorney General in Washington: “We continue to have concerns as to how these alcoholic beverages are marketed to young people,” he said, adding that
the packaging of such products closely resembles regular non-alcoholic energy drinks. “Just removing the caffeine and putting these products back on the market is not something we’d be happy with.” In other words, do-overs look like they might just have the same result. So be four-warned.

THE BEVERAGE INDUSTRY IS A fluid, ever-morphing entity. What was the standard operating procedure previously is now as antiquated as the Fortran IV computer programming I almost failed in college in 1969. All facets of our business have evolved with new technology, production and formulation efficiencies, not to mention better strategic thinking. Issues like funding, effective routes to market, the aggressive acquisition appetite of the “Big Guys” and the rate of failure for brands have made for a difficult landscape. Nowhere has this been more pronounced than in the distribution arena. Over the course of the last few years, independent distributors have been swallowed up by the relentless quest for domination by Red, Blue and White. Distributors have spent years nurturing and developing brands only to have them pulled just when they are making their investments pay off. They are then forced to sell, or have to start over with new brands. New marketers have found it difficult to be taken in by houses, and when they are, the terms are often onerous. Going to market has never been harder. Yet, I’m the eternal optimist, and I’ve recently seen two models that give me hope. In October, I was invited to attend the Coast Brands Group conference in Newport Beach. The venue was spectacular, but what I observed was even better. The premise of the company is to aggregate and bring together dozens of independent distributors from up and down the West Coast and Sun Belt to work in tandem. The Coast team works with non-competing brands to present a portfolio for these 40-plus distributors to take on. They provide the market-
ing, handle the logistics and even have a national accounts team to go on calls, when needed. It is an incredibly efficient way to go to market. I’ve always felt that united we conquer, divided we fall. When marketers, distributors and retailers work together, it’s the proverbial win-win. The proposition of Coast Brands Group is to bring all the parties in partnership for a common good. I won’t go into any more detail, but their model was exemplary. The following week, I attended a different venue in Manhattan. For a few years now, I’ve heard tales of the power and prowess of the Northeast Independent Distributors Association, or NIDA. I always wanted to see how it worked, and I was finally invited into the inner sanctum. The members are a compilation of the strongest and best independent distributors on Northeast corridor. Befitting their stature, success and locale, the group members are no shrinking violets. The dynamic is different than the West Coast operation. Efficiency and opportunity are the keys here. Brand marketers are invited to present their wares to the group, a sort of one-stop shop. To brands, this is an opportunity to see the very people who can determine your fate all at once. The decisions are made on an individual basis, but their friendship, mutual respect and great dialogue enable them to critique the brands, see how they fit and act on them. These fiercely independent people have come together to better understand the marketplace and serve their customers better. I like that. As we head into 2011, I wish all of you a happy, healthy and safe holiday season. There is much to be grateful for.

Deals: Coconut Water Competition Continues
Honest Optimism on Coke Pickup; pessimism on Mate, Kombucha
As the end of the year approached, a major deal indicated that the race for coconut water supremacy was likely to continue into 2011 and beyond, as PepsiCo and co-investor Catterton Partners picked up a majority stake in O.N.E. (One Natural Experience). With founder and CEO Rodrigo Veloso still in place after the deal, the company is expected to take further advantage of the Pepsi network. O.N.E. had begun easing into that network in some regions as part of its experience in the Pepsi Beverage Company’s “Learning Labs” program, where it was being experimented with in Southern California and Florida. The deal was announced on Dec. 7, just a few days after it was revealed that competitor ZICO’s ties to the Coke system were also increasing, as the company has begun taking advantage of the Coke-owned Odwalla network as a delivery mechanism is several areas, and will start using Coke trucks in Southern California. Meanwhile, Vita Coco appeared to have put some of the supply problems that plagued all three companies over the summer behind it as it prepares to begin moving into DPSG houses; in fact, company president Mike Kirban recently told BevNET that he expected to have supply locked down through 2014 and that he expected to lock down at least $100 million in sales in 2011. While all three competitors say the category could be worth $1 billion down the road, there is still no brand that has hit nine figures, let alone ten. Chances are that they’ll keep shaking the coconut tree, however – with celebrity investors like record mogul Tommy Mottola putting money into O.N.E. and Madonna throwing cash into Vita Coco this year, and ZICO’s deal with former rapper and airline entrepreneur Jesse Itzler last year, there’s probably a lot of exciting ink yet to come for the category. Also on the deal front: a linkup between GIVE Water maker Ben Lewis and Green Shoots, a specialty DSD distributor who is working to place brands like Columbia Gorge juices and new brand Kombucha Botanica in accounts like Whole Foods as a UNFI alternative. Lewis is now a shareholder and board member of Green Shoots along with founder Nat Noone; meanwhile, Green Shoots will distribute GIVE and help Lewis develop new products.
As he discussed dumpster diving and shady hotel rooms as part of a presentation on staying independent as a growth strategy for beverage companies, Honest Tea “Tea-EO” Seth Goldman also talked about addition and subtraction: namely, his company’s addition to the Coke portfolio and its subtraction of SKUs from a pair of categories, kombucha and yerba mate. Kicking off Day Two of BevNET Live event in Santa Monica on Tuesday, Goldman highlighted how the indie brand is maintaining its identity despite a highly likely Coca-Cola buyout in 2011. Goldman also officially announced the company will be nixing its kombucha line and selection of mate teas.
CORRECTION: Correction: A description of Alacer’s Emergen-C Splash product in last issue’s Functional Waters Brand News incorrectly stated the daily value of the vitamin C in a 16 oz. serving: it is 170 percent, not 70 percent. 8.BEVERAGESPECTRUM.DECEMBER.2010
Goldman was optimistic about Honest Tea’s future and explained that the Coca-Cola Company would most likely purchase the brand in February 2011. With annual sales trending toward $70 million for the company overall, he said he expected that they will go ahead with the deal. He mentioned that Honest Tea has presented a threeyear business plan to Coke officials and that they “appreciate Coke recognizing the brand’s value” and the purchase would be “a great opportunity to continue to build the brand and expand the team.” As for questions about the legitimacy of an organic, Fair Trade brand’s authenticity within the Coke system, Goldman said the purchase would continue to help Honest Tea to become relevant to a wider group of consumers and to bring it to places in which consumers currently don’t interact with the product – stores like Target, for example. In terms of product development, Goldman explained that Honest would be taking kombucha off the market, saying that maintaining legal alcohol levels in the beverage would have been too complicated due to the FDA’s decision to look more closely at beverages with the potential to contain alcohol. Honest Tea simply “didn’t have any interest in finding loopholes around these regulations,” Goldman said, and ceasing production made more sense, especially after learning that when left at room temperature, the beverage became more alcoholic. Kombucha was “not a direction in which we wanted to go,” he said. Also getting the axe are Honest Tea’s mate beverages, but the decision was more financial than regulatory: Goldman said the products were not performing as well as expected. As part of its development and growth strategy, the company plans to remove SKUs that aren’t up to par. In other words, the decision wasn’t really a big deal. However, Honest Tea isn’t only getting rid of unsuccessful products as it approaches 2011; Goldman revealed that they are launching a new, confidential product. “It’s never been on the market before,” he said.

BEVSCAPE INNOVATION • Product development & marketing news
BevNET’s Best of 2010 In a combined awards ceremony and postgame interview session, BevNET handed out its Best of 2010 awards during a dinner held as part of the BevNET Live winter event in Santa Monica. ZICO Coconut Water founder and CEO Mark Rampolla took home the award for Innovator of the Year following a period in which he navigated the brand through supply shortages plaguing the entire category by moving a concentrate version of his product into a new, more mainstream plastic bottle. Rampolla also entered into distribution agreements with Coca-Cola in key areas, matching its rivals O.N.E. and Vita Coco, both of which were able to increase their distribution footprints through PepsiCo and Dr Pepper Snapple, respectively. Meanwhile, product of the year went to GT’s Kombucha, a drink whose fastgrowing popularity came into sharp focus in the midst of category-wide turmoil resulting from a Whole Foods decision to pull all unpasteurized kombuchas from its shelves due to concerns that it contained alcohol. While the category is still finding its feet following the summertime supply disruption, BevNET chose GT’s products because of the breadth and intensity of the outcry among its fans after the product left Whole Foods to work on a new formulation. “For a lot of them, it seemed like it was the worst possible thing that has ever happened,” Craven said. Also recognized during the Best of 2010 awards were many products from the natural foods world, including lemonades, teas, CSD’s. The full list follows: Product of the Year GTs Kombucha

BevNET Live Wraps Up, Looks to Summer in NY
With more than 330 beverage professionals gathered in Santa Monica for two full days of learning and networking, and speakers ranging from Honest Tea founder Seth Goldman and Carl Sweat, CEO of FRS, along with Jones Soda CEO Bill Meissner and First Beverage Group CEO William Anderson, BevNET Live Winter 2010 offered too many highlights to be detailed without the aid of a multi-gigabyte Internet cloud for photos and video. Nevertheless, it should be noted that the event gave entrepreneurs in the industry a chance to flex their muscles and grab some much-needed recognition. Whether it was Anheuser-Busch distributors making it clear that new brands are the lifeblood of their growing total beverage strategy or investors indicating that there is more money than ever waiting to find beverage companies with certifiable potential, the two days on the beach were also two days in which competition and community could dwell side by side. Full highlights – including videos of speeches, panels, and breakout sessions, and a massive collection of photos from the event – are available at BevNET.com. The next event, BevNET Summer 2011, is scheduled for June 6 and 7 in New York City at the Sheraton Tower.

BOTTLED WATER 52 Weeks through 11/28/2010
The bottled water category appears to have picked itself up out of free fall, paralleling its sister category, enhanced waters. In fact, the category showed some advances that were led by private label – apparently commodity pricing continues to be the most important factor is the category’s growth. While that might be a tough pill for big companies to swallow, there’s still some good news at the high end: look at Smart Water, which has become a top-10 brand and continues to grow. Even Fiji, despite its recent troubles with tax structure abroad and high-end competition at home, managed to eke out a 3 percent gain.

DECEMBER.2010.BEVERAGESPECTRUM.15
The beverage business has given birth to some legendary odd couples. Tom First and Tom Scott. John Bello and Greg Steltenpohl. John Ferolito and Don Vultaggio. Typically, they’ve seemed to break down along the lines of the dreamer and the implementer, the marketer and the salesman, the English Major and the MBA. For entrepreneurs, it’s often a beneficial arrangement: even at Microsoft, Bill Gates had to have a Steve Ballmer around to scream at people. Building a successful operation is tricky, and it helps to have balance between the leaders who see opportunities and the ones who supply the muscle to get it done. Such a partnership has recently evolved at a pretty unlikely place, however, and under a radically different circumstance: Jones Soda, where Bill Meissner has recently begun work as CEO, trying to channel the legacy of brilliant marketing begun by company founder Peter van Stolk. Waitaminute. There’s no partnership at Jones Soda. Peter van Stolk hasn’t worked there in years. Isn’t that guy selling organic vegetables in Portland? Even van Stolk, reached for the story, made it clear that he had left Jones more than three years ago, which he termed an eternity in the beverage business. He wished Meissner and Jones well. 16.BEVERAGESPECTRUM.DECEMBER.2010
RESTORING AN ICON Under new CEO Bill Meissner, Jones Soda looks to get the easy parts right. By Jeffrey Klineman And it’s true that Meissner and van Stolk have never worked for the company together; in fact, the only thing they have in common are some JSDA shares. But if van Stolk isn’t working there, he’s still present. It’s been the impenetrable problem for his successors to wrestle with: van Stolk’s spirit runs deep through the brand. You can’t live it down, so you might as well embrace it, because even now the core idea, that the brand could resonate with consumers because its labels constantly showed them in the process of being who they are, is so strong that the Jones Soda DNA will always be van Stolk’s, much as the DNA of Microsoft will always be Gates’s. But rather than wrestle with that spirit, Meissner embraces it. In fact, if van Stolk has ever had a fan of what he was trying to do with Jones, it’s Meissner, who, for all his MBA training and operational acuity, has always aligned himself with the brands that tend to usurp the norm. “Honestly, since Jones first showed up on my radar screen when I was back at SoBe, I loved that brand, and I kept wondering when someone was going to do something with it,” he says. “I think it’s the best brand in beverage, and to be able to lead the team, and have people say that its brand promise has been filled, would be the ultimate.” Look at Meissner’s record, and you see he might be the one who can pull it off. At both SoBe and Fuze, Meissner was the guy who stayed behind even after the sale went through (to Pepsi and Coke, respectively) and the founders (SoBe’s Bello, Fuze’s Lance Collins) departed. He was the one who picked up the threads that the founders had left behind, the entrepreneurial spirit that made the brand into a success, and tried to weave those threads into the new organization. The result at Fuze was an undisputed success: the launch of the powerhouse NOS energy drink into the Coke system. And now Meissner is trying to pick up the threads at Jones, to somehow weave
the brand back into the planning process at stores who cut the cord. Just a few months after it was nearly bought in a bargainbasement stock swap by fellow alternative soda brand Reed’s, Meissner says there’s still plenty to love about Jones. Since jumping to Jones from its Seattle neighbor, Talking Rain, about eight months ago, Meissner has killed off many of the pet projects that the brand engaged in over the last five years, notably “brainenhancing” Jones GABA and vitaminwater knockoff 24C. He’s downsized the marketing and operations staff in Seattle and focused hiring on a sales team that he hopes can rebuild the ties to distributors and key accounts who have always wanted just one thing – to sell Jones Soda Pure Cane Soda and WhoopAss energy drinks to a target group of 18-to-34 yearolds with a bit of sense and style. “All that monkey business up in Seattle notwithstanding, retailers put it on the shelf and it sells,” Meissner says. Atlanta Beverage’s Scott Wilkie, who began carrying Jones four months ago, agrees. “The chain part of the business is really important, and that’s where he’s revamped the brand. Awareness of the soda is really good,” he said. Meanwhile, to support execution, Meissner has accessed a $10 million line of credit and sold off one of Jones’ biggest assets, a trademark on customized labels, to a firm that plans to try to recoup – and share – funds from lawsuits based around infringements of that trademark. Recapitalized, slimmed down, and with a sense of purpose, Meissner seems to have Jones ready to go. “Everybody I’ve dealt with has seen a lot of enthusiasm about them coming back,” says Justin Bibeau, the head of the non-alcoholic beverage operation with Thorpe Distributing, an Anheuser Busch/ InBev distributor in Minnesota. “The major plus has been them coming in and being honest, saying there have been some
dark times, and that we’re re-launching.” The uptick has been noticeable, both in the brand’s share price, which has recovered from pennies to over a dollar, and in authorizations. Fanatical about re-activating accounts, for example, Meissner called from Florida for this story after taking a red-eye to try to get the brand back into Publix. “We have been thrown out of wholesalers, out of retailers, and we’re trying to repair those relationships now,” Meissner says. “But in no case have we heard, ‘it hasn’t sold.’ It’s more ‘we were promised this, we were promised that, and that didn’t happen.’” The problem for Jones was never about the brand. If it had been, van Stolk wouldn’t still be in demand as a speaker about branding ideas. Instead, and this is where Meissner believes he comes in, it’s about timing and execution. “They tried to overharvest the brand early,” he says. “There was this idea that we can put it on anything and it’ll sell. They had an enhanced water, they had brain enhancement with GABA, they had a tea and an organic play. They weren’t able to apply appropriate marketing pressure they were dividing it against eight
18.BEVERAGESPECTRUM.DECEMBER.2010
distinct marketing platforms.” Now that Meissner is in place to stop the bleeding, he is looking at where the opportunity might be for a revitalized Jones Soda. He believes it’s a brand that could own a 1 percent share of the energy drink category with the recentlyrelaunched WhoopAss, and enough chain authorizations to boost its presence in grocery from 22 percent to more than 60 percent. The idea is to run deep in the channels and with the consumers who have always loved Jones, and to get the once-brilliant company back on its feet (and, it should be noted, long-disappointed shareholders off its back). If 1 percent doesn’t sound like a lot, consider the scale: in a $4 billion category like energy drinks, that’s $40 million; with strong growth for CSDs in chain stores, he sees revenues growing from $26 million to more than $60 million. “We can top out at a half-billion,” Meissner says. “But right now I have $100 million in my sights.” As an example of the kind of execution needed to get the brand to those lofty marks, Meissner points out a merchandising coup he recently pulled off with Old Navy,
a company whose young, style-on-the-cheap shoppers in many ways correlate with the target consumer for Jones. In November, the company launched a program that would put Jones Soda coolers in Old Navy stores nationwide. It’s not an overwhelmingly large sales proposition, but it’s an idea in the spirit of the nimble marketing approach Jones might have employed in the past. “All the difficulty and challenge or nuance of this brand, that’s the hardest part, you can miss it – Jones has had a brand that connects with consumers since day one,” he says. “You mention Jones to a kid, and I challenge anyone to not hear them say I love it. There’s nothing like this brand – and all we didn’t have were the easy parts – the sales execution, commitment to the trade, return on investment – we had all the gold in the brand.” Maybe that’s easy for Meissner to say. After all, he’s the execution guy, not the crazy dreamer. But if he manages to grant Jones a new lease on life after all the time the company has had in the wilderness, there might be room to consider him and van Stolk as one of the greatest, oddest beverage couples of them all. Even if they never shared the lease. •
