A
recent study I saw predicted that nearly half of us would own an overseas property within the next three years. That’s an amazing figure, which goes to show the huge change in the way we all think about overseas property. No longer just a second home to retire to, nowadays we are buying overseas property earlier in life, and for investment as much as lifestyle reasons. Even first-time buyers, put off by high prices and the scarcity of good housing at home, are buying overseas. With all the turmoil on the stock markets, more and more people are seeing bricks and mortar as the best way to invest for the future. Why put your money in a bank and earn 5% on it if you’re lucky when property has a far higher historical rate of return than this? Why put your hard-earned cash somewhere it is doing you no good when you can invest in a beautiful home that you don’t only get to enjoy yourself, but also can rent to others? I’ve never been in the business of guaranteeing you all the riches of the world, and as owning property overseas becomes the norm, I don’t have to – we all know it can be a fantastic investment. What I am in the business of doing is trying to give you everything you need to make your overseas property “career” an exciting, fun and in all likelihood a profitable venture. ARTICLE I Buying Off-plan Property
Buying off-plan property As Phuket, Samui and the other resort areas are still growing constantly; new projects are being launched into the market, with the majority of them selling the units before construction has started. The main reasons for that can be to generate a certain percentage of the total project value in sales revenues to pre-finance construction costs. Some developers also need a certain sales record to obtain bank financing which does not necessarily mean that they don’t have the finances to develop their project but rather for fiscal reasons.
Why off-plan? Buying into a development at an early stage can have tremendous advantages. “Early birds” are getting benefits of prices often way below market price. The reason is that from pre-construction to completion of a project the prices can increase between 25-50 % which makes up a big difference. Apart from that, buying into a project has the additional benefit that those who come first can choose the best units. Often this cannot only be a personal advantage but also lead to better resale values as a better located unit always sells quicker and for a higher price. To buy a unit in the pre-construction phase can also have the great advantage that you can give your home an individual touch. If you want to change a layout, add rooms or features, change finishes like flooring. Investment buyers purchase units – often in bulk to get even further discounts – to resell them even before the project is completed. This can bring high profit margins for investors. In Dubai’s property boom some project units were sold 3-4 times before completion, each time with higher prices. When buying off-plan properties for investment purposes purchasers often “flip” the units meaning the purchaser sells on the units prior to the legal title transfer and makes a profit without becoming the legal owner of the unit. The main reason being is that investors want to save costs on transfer fees which can make up a distinct percentage of the profit when investing.
Risks Having pointed out the advantages of off-plan purchasing there are also some risks to it. Many buyers are concerned about the financial stability of the developer, his track record and reliability. Numerous stories from the past made clients cautious about investing in properties too early and maybe taking the risk of losing their funds invested in a project that is never going to be built. Agents as well as developers are now aware of these rising concerns and therefore only market players with a proven track record can sustain. Developers with track records of previous projects or other flourishing business’ that they operate give buyers a greater feeling of trust that their investment is safe. Also, a secured financing for the project is a good indicator on how secured one’s investment is. Therefore, especially Thai developers enjoy the advantages of bank loans to secure financing for their development which often results in stronger sales as they can start construction after having obtained bank financing and buyers see a movement in the development. There are various projects that have the financial backing of big investors and therefore also these projects enjoy the confidence of both, agents and purchasers alike. However, that does not necessarily mean that small-scale developments always have to carry a risk of never being built. To give buyers additional protection and peace of mind, more and more safety procedures enter the market. The common protection features are stage payments within a certain milestone of the construction of one’s villa or the whole building, incase of a condominium project. Furthermore, developers insurances can be obtained to secure client payments or sometimes escrow accounts are being offered to secure payments. When buying a completed unit or resale property purchasers avoid the risk of long construction periods or late completion. Often delays can occur due to weather problems, change of contractors or other unexpected problems which can push completion a few months behind. Buying an off-plan unit for investment purposes and quick resale can hold the risk of not being able to sell on the unit as fast as expected. To prevent from this, it is important to choose a top quality project which can stand out from the mass market and can be forecasted to sell again for a premium compared to the off-plan price.
Location, quality of the finishes and construction, management and position of the unit within the complex are key issues to be considered when planning to make profits out of short-term property investments. Glossy brochures, 3D-images and even animated movies all show how beautiful a project will look in the future. However, what comes out at the end can be very different from those previous images. Helpful tools are show units that show all material specifications used for the other units that are going to be build. Other possibilities include material boards that show wood, tile and other finishes or specification lists with a detailed description of the materials used. The latest government regulations for condominium projects have been adjusted to make developers liable to the accuracy of information presented in the brochure such as images, facts and features. This should give buyers additional peace of mind when choosing their dream property from a brochure.
Conclusion Off-plan buying is not for everyone as each purchaser has a different risk profile when looking to invest in all assets. Savvy investors try to maximize their returns and take bigger risks, as perfectly described in Markowitz’ portfolio theory by investing into projects at an early stage whilst others are willing to wait and pay a higher price to receive a finished product. However, those risks can be dramatically minimized by choosing the right product offered by a trustworthy developer or introduced by a knowledgeable and professional agent of trust. Then you cannot only have a great product for an excellent price but in most cases you can adapt your property to match your personal taste.

ARTICLE I Phuket Zoning Regulations
Phuket zoning regulations Over the past decade, Phuket has seen a remarkable increase in construction and property development throughout the island. Like many places, Phuket does have zoning rules which regulates what can or can’t be built in any particular area. Concerns for the environment and structural integrity are one of the many reasons for having such controls. These are mainly covered under the umbrella of the Environment Quality Promotion and
Preservation Act B.E. 2535 (1992). Many of the zoning laws in Phuket have been introduced since 1997 and since then many local guidelines have also been introduced not only on a provincial level but also within each districts and sub-districts. In general, Phuket is separated into 8 different zones. Each zone contains certain restrictions which take into consideration not only environmental and safety rules but
also means to protect historical sites in and around the area. The rules also ensure property development on the island is sustainable and in harmony with its greatest asset, namely, it’s natural beauty. These zones provide a basic guideline as individual districts throughout the island do have specific regulations it must follow as well. The zones can be summarized as follows:

As mentioned earlier, there are a number of other restrictions in place in Phuket. From a consumer perspective, it is worthwhile for buyers to keep these issues in mind as well particularly when buying off-plan property. In order to ensure that the developer is able to build what they promise on paper, zoning rules should be taken into account.
Zoning is perhaps one of many important checks which have to be done in any due diligence exercise as this will affect the end result and could save a few headaches in the upon completion. At the end of the day, it is good to know that Phuket do have measures in place which protects the sustainability of the island. This would also, in turn, ensure that the property sector maintains its integrity and economic viability in the international arena.

The Phuket Property Market
With a population of round 322,000 registered people Phuket is Thailand’s largest island. Measuring 48 kilometers (34 miles) north to south and 21 kilometers (16 miles) east to west. Phuket is often described as “the Pearl of the Andaman Sea”, due to its natural beauty and white sandy beaches which are even in Thailand’s other resort areas hard to find. Phuket is an 85-minute flight away from Bangkok and is rated as the country’s wealthiest province after Bangkok Metropolitan Area. Historically, Phuket’s main source of income has been tin mining since the 16th century. Many of the old tin mining sites have now successfully been converted into projects like golf courses (Red Mountain) or real estate developments (Laguna). In recent past, rubber planting is a main source of income but is still far behind the tourism industry which forms Phuket’s biggest source of income. Phuket is one of Asia’s premier tourist destinations. Travelers from throughout the world are drawn to the resort island’s unmatched beauty, pristine beaches, first-class hotels, amazing diving sites, fine dining, vibrant nightlife, yacht marinas and excellent golfing. Visitors come from all over the world with Europeans (UK, Scandinavia, Germanspeaking countries), Australians and Koreans being the majority of tourists. Recently, there has been stronger numbers for travelers from the Middle East and Russia which is expected to rise in coming years. Since the Tsunami in December 2004 the island’s visitor’s number increased constantly, making a 11% jump year-on-year and hit the 5 million visitor mark in 2007. With a continous upwards trend in tourism numbers Phuket’s real estate market will certainly benefit as well. Phuket International Airport welcomes several direct flights from Hong Kong, Singapore, China, Russia and Europe which is a great addition to the well-established infrastructure on the island. Furthermore, there are daily between four and five landings of private jets on Phuket which raised discussions about a special private jet terminal at Phuket International Airport. Phuket is more and more developing into a destination for permanent residence for foreigners. The relaxed atmosphere, tropical climate and low costs of living offer great lifestyle for Expats. Central Festival and Jungceylon offer decent shopping for all needs. Central as Thailand’s pre-eminent commercial development group opened this great shopping mall in the centre of the island. Phuket offers a wide range of properties from small condominium units to superb villas with direct ocean front and all amenities a luxury home should have. Prices differ as much as the types of homes depending on location, branding and quality of the development.
Recent research shows that there are currently 3,712 first-hand units for sale in Phuket of which there are 1,677 condominiums (approx. 45%) and 2,035 villas (approx. 55%).
The majority of the units are within the 10 to 30 million price bracket for both, villas and condominiums which makes 2,194 units (approx. 59% of the total supply). The luxury property (over THB 100 million) segment only comprises of 97 units which equals 3% of the total supply.
Whilst condominium units reach a maximum price of below THB 50 million villas reach up to over THB 100 million, some of which have premium prices of over THB 300 million. Some exceptional properties command prices of up to US$ 25 million.

Beachfront properties still command top prices and are rarely on the market. As beachfront land is scarce, especially on the sought-after west coast, it is difficult to find new projects with beach access. Resale units with direct beach access donâ&#x20AC;&#x2122;t remain on the market for long and are usually priced at several million US Dollars. Due to the lack of beachfront land on the west coast more developments are located on the east coast or off Phuket.
Especially the mainland across Sarasin bridge, Phang Nga, astounds people with natural beauty and wonderful white beaches less crowded than those in Phuket. There are a number of established resorts and developments and beachfront land is heavily increasing in price due to the high demand. Most of the new developments there have direct beach access and/or command stunning sea views. No wonder that Phuketâ&#x20AC;&#x2122;s most expensive property is located there.
That Phuket is still booming property market can be seen from the total take-up rate for villas and condominiums. Overall the take-up rate is 46%, despite the fact that most developments are sold off-plan or are just under construction. The highest take-up can be seen in the luxury segment. From THB 70 million to over THB 100 million properties (villas only) the take-up rate is over 70% of the total supply which is an impressive number despite the fact that this market segment only makes 5% of the total supply.
The mid-market segment of THB 10-30 million (43%) and THB 30-50 million (59%) still shows an excellent proportion of supply and demand given the fact that these segments represent 72% of the total supply. Significant is that projects in this price range are successful if they are well-located and offer facilities e.g. gym, community pool, clubhouse, professional rental management. Undefined projects that are not in good locations (developed area, close to beach and facilities) usually show slow sales performances.

Considering only villa projects it can be said that the overall demand makes 55% of the total supply. The high-end property segment (THB 50-70 million) shows the biggest gap in supply and demand with only
39% take-up. This is due to the limited number of properties in this range (only 69 units of which 27 are sold).
The overall demand for Phuket condominium units makes 38% of the total supply. This number seems rather low but given the fact that most developments are still in the (pre-)construction phase and Phuket has always been a pre-dominant villa market this reflects a good market situation. Luxury condominium units (THB 30-50 million) are being snapped up quickly with 53% already sold.

Apart from the advantageous freehold ownership structure condominium units enjoy a new wind by government regulations that enforce customer protection when buying into a condominium project. Basically, the amended Condominium Act shall strengthen buyer’s rights and provide standard provisions in regard to management of the Condominium by the Condominium Juristic Person (CJP) and its Manager. “Irrespective of the importance of each individual amendment under the new Condominium Act, the underlying consumer protection idea behind these recent amendments of the laws might be trend-setting in
The important amendments to the Condominium Act stipulate that developers must provide a secured access way from the adjacent public road to the Project, that developers shall be obligated to set up an office for the CJP and must provide their advertising materials to the CJP who shall act as control institution and verify that the completed project actually complies with the advertisements. Furthermore a re-definition of the term „co-ownership“ to „co-owner“, who can be an individual or corporate person to be registered with the relevant land office and mentioned on its individual condominium unit title deed as well as standard provisions have been implemented which shall regulate i.e. qualifications, nomination and suspension of the CJP’s Manager, voting and meeting procedures. „Such strengthened consumer protection laws should have a positive impact on the whole property market in Thailand and could play a decisive role in encouraging foreign investment in Thailand“, Michael Greth points out. New financing options are coming on the market, often from private mortgage brokers. This should give an additional boost to the property market. Generally, an overseas property in the first home country of the purchaser would be used as collateral to receive financing. The entire Phuket property industry is looking forward to an exciting new high season. With the global credit crisis and downs at the stock markets savvy investors look to change their portfolio to substantial assets. With the shape of a right dog-leg around a huge lake which can be reached in one but offers an exciting challenge. The new 9-hole course is a green for experienced golfers with low handicap.

Introduction to Koh Samui
Koh Samui with its area of 247 km² is a beach lover’s paradise just off the east coast of Thailand in the Gulf of Siam. Beaches
Chaweng Chaweng is the island’s largest and most popular beach and is also Samui’s longest, stretching over some 7 Kilometres from north to south. The beach itself is very relaxing but can get quite busy in high season during the high season. The centre of Chaweng beach road features the greatest selection of restaurants, bars and shopping. However there are plenty of bars and restaurants right on the beach, offering views of the Gulf and the night sky.
Lamai Lamai is slightly less developed than Chaweng due mainly to geographical constraints but still offers a wide variety of restaurants and nightlife. The main beach road features attractions such as health and meditation centres and a Thai boxing school. Many feel that this is the most beautiful beach on the island
Big Buddha & Choengmon Big Buddha Beach on the North Eastern tip of Koh Samui is also home to the famous attraction of the same name and is a peaceful and relaxing escape from the bustle of Chaweng. Further east is Choengmon with its calm and clean beach. There are a few small coves and bays to be found some of which have been developed into self contained resorts. Thailand’s third largest island has been on the radar of developers since the 1980’s and now boasts a well developed infrastructure of hotels, restaurants, international hospitals, bars, tour operators and shopping centres. The island is easily assessable with direct one-hour flights from Bangkok to Koh Samui Airport or the nearby port city of Donsak, which has an hourly ferry service to Koh Samui The resort island appeals to all types of travellers from all over the world. It is more than just a place to sun bathe and swim in the sea. Some of the other activities on offer include all types of water sports, great diving and snorkelling, elephant trekking, fishing, mountain biking, golf, extensive spa services and a vibrant night life including many bars with live music and tiffany shows. Bophut Bophut Village is one of the islands oldest villages and retains much of its charm. There are several seafront shop houses which have been converted into restaurants and shops giving it a unique character when evening comes. The white sandy beach and calm waters of the bay make this a popular spot for relaxing. It is also popularly known as ‘Fisherman’s Village’.

Koh Samui Land Price Analysis 2003-2007 Land prices in Koh Samui are expected to rise between 20 per cent and 30 per cent a year as a number of property firms expand their investment in sectors such as retail, residential-project developments, hotels and resorts. “By The Rules” The very latest information on Samui new zoning regulations whether you’re a property developer, an individual with a plot of land, an existing resident, or someone considering buying a property on Samui, the future development of the island is very important. It’s time to stop listening to rumours. Don’t have your enthusiasm and dreams destroyed by inaccurate, vague or incorrect

The objectives of the Ministerial Regulation are to provide sustainable guidance and control over the development of Samui; to maintain the uniqueness of the community; and to preserve the valuable environment, the quality of life and tourism.
Constructions prohibited in the yellow zones include: factories; gas and petrol storage facilities; animal breeding; industrial; entertainment venues; slaughterhouses; silos; waste disposal; or junkyards.
The main policy is to arrange an effective system of land utilization that is consistent with the future community expansion; to encourage the economic development of the island; and to develop a public utility network. The aim is to achieve this by: promoting Samui as the leading regional and international tourism centre in the southern area of the Gulf of Thailand; encouraging the Samui community to be a local management and administrative centre; preserving and maintaining the attractive environment, and natural resources, consistent with local traditions. And, in accordance with a sustainable development policy; maintaining Samui’s unique lifestyle, settlements, art, traditions and customs; encouraging and supporting conservation-tourism, the future development of tourism, and the role of agriculture; encouraging the development of quality, convenient and safe residential and commercial areas, with services and providing public utilities that are consistent with the community’s future growth and the economic expansion of the island. The future growth is to be controlled by: identifying important tourism areas and supporting and encouraging the conservation of those areas (the areas identified are high-density, medium-density, and conservation-tourism service communities); conserving and supporting tourism centres, including, but not limited to, surrounding islands, beaches, coastlines and mountains; determining the use of the land, encouraging the preservation of mountains, forests, coastlines and natural water resources; maintaining the ecological environment. And by conserving areas of importance in relation to religion, custom, tradition and public utilities; identifying the specific areas and encouraging the conservation and support of agricultural areas in famous, and unique agricultural products; identifying specific areas and encouraging the conservation and support of local communities in fishery and sea-related activities; by determining the use of land in different areas, and by controlling growth in the major and minor centres of the community, by organizing the balance of transportation and public utilities systems within those areas.It’s proposed that the introduction of 12 specific zones will enable all of this to be achieved. Each zone, represented on the map by a colour, will determine what construction is permitted, and the allowed purpose of any land or building within that zone. Each zone has a comprehensive list of specifically prohibited uses for the land within it. And there’s also a set of rules for each zone that must be complied with. It’s indicated that government offices and public utilities can be located in most of the zones, as and where they’re required.The zones are as follows:
In these zones the following rules apply: a.The total area of any buildings, except hotels, must not exceed 2,000 sqm and the height of any building must not exceed 12m b.Where the land is used for residential purposes, including hotels, apartments, and bungalows, the surrounding space must be at least 40% of the whole c. Where land is used for acceptable purposes other than residential, it shall have a surrounding space of at least 20% of the whole d. Where the land borders a public canal or public water source, the land 6m from the edge must not be used (except for the construction of water transportation facilities or public utilities) e. The land 10m from the coast must not be used (specific exceptions exist) f. Where the land is within 50m from the coast, no building should exceed 6m in height. And its total area must not exceed 75sqm, and the surrounding space must be at least 75 % of the whole (specific exceptions exist) Zone 2.1 to 2.4, in orange, shall be medium-density residential areas. Land here will be used as in the yellow zones. But the land used for other purposes in these zones must not exceed 20%. Prohibited buildings are also are similar to those in the yellow zones. But graveyards are added to the list. And the rules in these zones are: a), as above; b), as above, but the surrounding space must be at least 20% of the whole;d), e), and f) as above. Zones 3.1 to 3.11 will be high-density residential and commercial areas. Land here will be used predominately for commerce, residential and tourism purposes. And land used for other purposes must not exceed 15%. Again the prohibited list is the same as in the orange zones. And the rules are: a), d), e), and f) as above. Zone 4 shall be an industrial and warehouse area. Land here is to be used primarily for the purpose of industry (which includes any permitted factory provided for in the Ministerial Regulation addendum), community recycling factories and warehouses. In the event that the land is to be used for other acceptable purposes, a maximum of 10% of the whole land may be used. Residence, commerce and foster homes are included in the list of prohibited buildings for these zones. And the rules to be complied with are: a) and d) as above. Zones 5.1 and 5.2 will be specific industrial and warehouse areas.

And land in these zones is to be used for the purpose of a specific industry, which includes any permitted factory provided for in the Ministerial Regulation addendum, community recycling factories and warehouses. And in the event that land is to be used for other acceptable purposes, a maximum of 10% of the whole may be used. Prohibited buildings are as in the violet zones. And the rules are: a) as above. Zones 6.1 to 6.11 shall be rural and agricultural areas. Land here is to be used for agricultural purposes, or any activity relating to agriculture, residence and tourism. In the event that any land is used for other acceptable purposes, then a maximum of 20% of the whole may be used. The list of prohibited buildings in these zones is more extensive and includes: buildings for commercial purposes, except as part of a residential development. And they must be no bigger than 10% of the whole; any residential, commercial or industrial building with a floor space exceeding 2,000 sqm or a height of over 12m; residential or commercial building purposes, except as part of a residential development and equal to not more than 10% of the whole; condominiums, apartments or dormitories; or residences in commercial buildings except as part of a residential development and equal to not more than 10% of the whole. The rules for all green zones other than zones 6.3 and 6.9 are: a) and b) as above; c) as above, but with surrounding space of at least 50%; d), e), and f) as above. In Zones 6.3 and 6.9 among the list of prohibited uses are: any purposes of land allotment, except agriculture purposes; residential purposes, except for single house; and any business which may cause harm to health, under the laws regarding public health. The rules for 6.3 and 6.9 are: a) and b) as above, but the surrounding space must be at least 60% of the whole; and d) as above. Zones 7.1 to 7.7 shall be areas which will be kept open for public use and for the maintenance of the environment. Land in these zones is to be used only for the purposes of recreation, or any activity relating to recreation; the maintenance of the environment; or for the benefit of the public (with the exception of government owned water transport facilities). Those purposes prohibited here include: residential purposes; any building whose total areas exceeds 1,000 sqm or 12m height; residential purposes relating to condominiums, apartments, dormitories, attached houses, or commercial house types; waste disposal facilities; junkyards;

or vehicle servicing or manufacturing facilities. And the rules for these zones are: d) as above. And in zone 7.1 the additional rules apply: f) as above; g) in no case may the 10m space parallel to the coast be used; h) on land from 50m from the coast inwards, building must not exceed 6m in height, cover an area of more than 100sqm, or have empty space surrounding the building thatâ&#x20AC;&#x2122;s less than 50 percent of the whole plot of land. Zones 8.1 to 8.3 will be reserved forest areas, where the land is to be used for the protection and preservation of the forest, wild animals, water resources and any other natural resource, according to the resolution of the Council of Ministers. And in accordance with Thailandâ&#x20AC;&#x2122;s laws relating to the preservation and protection of wild animals, and the protection of the environment. Included in the prohibited list are buildings such as: hotels; buildings for residential, commercial, or industrial purposes; and condominiums, dormitories, attached houses, or commercial house types. The rules for these zones are: a) and d) as above. Zones 9.1 to 9.27 shall be areas for educational institutes. Land here is to be used for educational purposes or any activity relating to education; or for the benefit of the public only. And the only rule specified for these zones is that buildings must not exceed 12m in height. Zone 10 will be areas allocated for tourism, fishing and the maintenance of the surrounding environment. Land here is to be used for the purposes of the preservation of the environment; tourism or any activities relating to tourism; the benefit of sea life; seaside fishing; or the public benefit only. Zones 11.1 to 11.24 will be areas for religious purposes. Land in these zones is to be used for the purpose of religion or any activity relating to religion; education; or for the public benefit only. Rules here are: d) as above; and that no buildings in these zones should exceed 12m in height. Zones 12.1 to 12.29, as marked in blue, will be areas for government offices and public utilities. And the land in these zones is to be used for the purposes of state operations, any activity relating to the public utilities and public assistance, or public benefit only. Koh Samui Building Regulations Before construction of any fixed dwelling on Koh Samui, one must first obtain a building permit from the local municipality office, which is located in Nathon. The main purpose of obtaining such a permit, is all construction must adhere to strict guidelines, which can also vary from Zone to Zone Please see page 60 for reference to this. There are 4 main defined areas for construction
limitation, which we have outlined below. 1. All land up to 10 metres from the beach, the law states that there shall be no fixed construction.
3. All Land from the 50 metre mark up to 200 Metres back, the law states one can build to a maximum height of 12 metres with a maximum build area that cannot exceed 2000 SQM
2. All land from this 10 metre mark up to 50 metres back, the law states one can build a single storey dwelling that does not exceed the height of 6 metres nor the total build area exceed 75 SQM
4. All land located past this 200 metre mark, the law states one can build to a maximum height of 12 metres, with no restriction on built up area size.

In June we attended the “Smart International Property Expo” at the Hong Kong Convention Centre. There were a higher number of exhibitors than last year and we found a great interest in Koh Samui.
With this exhibition we were able to educate the residents of London into the benefits and lifestyle, of investing in South East Asia’s pearl in the gulf; Koh Samui.
It was a great achievement to make it to Singapore as the monsoonal weather conditions forced us to rearrange all our travel arrangements at the very last minute!
Due to the success of this exhibition Thailand Estates Corporation is proud to announce that we will be participating in many more exhibitions in the future, especially in Europe, due to the High demand for competitive overseas investment opportunities.
