Led Zeppelin to pay copyright legal costs

ed Zeppelin may have won the copyright war over its creation of “Stairway to Heaven,” but it’s lost its battle to recoup nearly $US800,000 ($A1.05 million) in legal fees.
Judge R Gary Klausner ruled on Monday that the band’s songwriters, record label and associated companies were not entitled to claim legal fees and other costs because the copyright lawsuit against them was not frivolous. A Los Angeles federal jury in June found that guitarist Jimmy Page and singer Robert Plant did not lift the introduction of “Stairway” from an obscure instrumental written by the late Randy Wolfe, founder of the band Spirit. The trust for Wolfe, better known as Randy California, claimed Page and Plant were familiar with his work and stole a riff from the short tune “Taurus” that
repeats throughout the first two minutes of their 1971 classic rock anthem. Wolfe’s trust had been seeking credit for the song and millions of dollars in damages. But jurors found the tunes were not similar enough for Led Zeppelin to have violated the 1968 copyright protection of “Taurus.” Lawyers for Led Zeppelin sought legal and other fees totalling $US793,000 after insurance companies rejected covering such an old claim. They argued the lawsuit was frivolous, it was intended to shake down the rock stars for money and that awarding defence costs would deter future meritless copyright claims. Klausner rejected those arguments, saying he had found the lawsuit had enough merit to go to trial and there was no evidence the plaintiff “harboured nefarious motives.”

Spiderbait promise to find urinating creep

ustralian rock band Spiderbait have promised to find the “creep” who urinated on a female fan at one of their Melbourne shows.

“I was really shocked,” she told 3AW on Tuesday.

Rare typo adds $$$ to Potter book

first edition copy of Harry Potter and the Philosopher's Stone containing a rare error is expected to fetch up to STG20,000 ($A34,000) when it goes on sale.
The edition is one of only 500 hardback copies printed which contains the mistake on page 53 of the repetition of "1 wand" in Harry's list of school supplies for Hogwarts, which was removed in subsequent editions.
Described as being in exceptionally fine condition, the copy of JK Rowling's first novel in the boy wizard series is estimated to reach STG15,000-20,000 at Bonhams Fine Books and Manuscripts Sale in London on November 9. Bonhams' Head of Books and Manuscripts Matthew Haley said: "As the first book in the series, Harry Potter and the Philosopher's Stone has a special place in the affections of the millions of readers across the world and the proof reading error about the wand in the first edition has, of course, become a treasured piece of Harry Potter arcana. "Like most enduring books aimed at younger readers, the Harry Potter books also have wide appeal to adults and there is a strong market among collectors for first editions. Carpageddon plan 'could kill native fish'

sing a herpes virus to wipe out European carp plaguing the Murray River could ultimately kill off native fish as well, a researcher warns. The plan, dubbed "Carpageddon", is slated to begin in late 2018 and will eradicate 95 per cent of the pest's population over the next 30 years. While the virus doesn't affect other fish, University of Adelaide research shows that decomposing carp, if they're left in the water, will dissolve oxygen levels. And this will endanger native species such as Murray cod, silver perch and rainbow trout, as well as crustaceans. "If we're removing oxygen from the water column, native fish will die because they have a
much lower tolerance to low oxygen levels than carp," PhD student Richie Walsh told AAP on Sunday. He said native populations would start to suffer with oxygen levels of less than 4mg per litre, and that huge numbers of dead carp could bring it down to at least this level.

It’s less effective in flowing rivers, but he expects that will be overcome as the technology is refined. “This is very much a trial phase and it will be solved quite easily given some more time,” he says. The test is no small development for the species, which may already be extinct in 50 countries. Northern Australia is one of the last places where it can still reliably be found. “We don’t even know if they still exist in many countries. Applying this approach globally will enable us to rapidly find threatened populations and prioritise their protection.” The testing technique is known as eDNA, or environmental DNA. Prof Simpfendorfer says its applications are not limited to fresh water or conservation applications. “There is a big push to roll it out globally. It has many other potential uses, such as detecting invasive pest species at ports.”

Gaming improves school grades: study O
nline gaming may be making students smarter but Facebook is no good for their grades, according to new research conducted in Melbourne. Associate Professor Alberto Posso, from RMIT’s School of Economics, Finance and Marketing, says moderate use of video games could help students to apply and sharpen skills learned at school. Posso investigated the links between gaming and school scores by testing 12,000 Australian 15-year-olds in maths, reading and science using the globally recognised Program for International Student Assessment. Data on the students’ online activities and habits was also collected. It was found the students who played online games almost every day scored 15 points above the average in maths and 17 points above the average in science. However, those who played every day didn’t perform quite as well, said Posso. It has been a theory among many psychologists that there are characteristics in games that can improve the cognitive ability of players, but there hasn’t been much empirical evidence to point towards whether there is an affect on not. Posso says his study, published in the International Journal of Communication, found that in terms of school grades, online gaming has a positive effect. “When you play online games you’re solving puzzles to move to the next level and that involves using some of the general knowledge and skills in maths, reading and science that you’ve been taught during the day,” Posso said.

he Harry Potter spinoff Fantastic Beasts is turning into a franchise of its own. Warner Bros announced on Wednesday that the upcoming Fantastic Beasts and Where to Find Them will get a sequel, planned to hit theatres in November 2018. Fantastic Beasts and Where to Find Them is opening this November. J K Rowling is making her screenwriting debut and will also write the sequel’s screenplay. Director David Yates is set to return, as well. Fantastic Beasts is adapted from Rowling’s 2001 book and an extension of the magical world of Harry Potter. The film stars Eddie Redmayne, Katherine Waterston and Ezra Miller.

few weeks ago Mila Kunis, Christina Applegate, Annie Mumolo and Kathryn Hahn were curled up on couches in a West Hollywood hotel discussing topics most mothers would prefer to avoid. The actresses, stars of the new comedy Bad Moms, were recounting some not so successful moments raising their children. Kunis and Mumolo told how they forgot to strap their daughters in their car seats, then took off down Los Angeles’ freeways without realising. Hahn remembers playfully tossing her baby son in the air and forgetting a fan was whirling above at high speed. “I almost decapitated my son,” Hahn sheepishly said. Applegate told how she tried to convince her five-year-old daughter Sadie it was OK to use dental floss picked out of a rubbish can.
“She said, ‘No, you just took that out of the trash can’,” Applegate laughed. “I’m like, ‘It was in there for two seconds and no-one has used it’. “She said, ‘It was in the trash can, Mum’!” Bad Moms, also starring Kristen Bell, Jada Pinkett Smith and Wanda Sykes, follows Amy Mitchell (Kunis) as she attempts to raise two children, hold a job, put up with a slacker husband and satisfy the high expectations of the head of the parent-teacher association (Applegate). When it all gets too much, Amy goes rogue, aligning herself with two other rebel mums. Applegate says there is too much pressure on parents and children to be perfect and the movie explores that. “Is it the internet?” Applegate asked. “Is it because everyone has an f-ing opinion about everything. “Are people so damn scared our kids won’t be perfect? “I don’t want my kid to be perfect because then she will be complacent. “I want her to always know practice is progress, it’s not perfect. “I think that’s what this movie is about. “It is OK to be a bad mum. “It is OK to fail. “We don’t need to be perfect

zzy Osbourne has revealed he is undergoing therapy for a “sex addiction” that nearly resulted in the disintegration of his marriage to Sharon Osbourne. The 67-year-old Black Sabbath singer said in a statement that he was “mortified” at the effect of his behaviour on his family.
The announcement came after hair stylist Michelle Pugh told People magazine she had a “very real relationship” with the rocker, lasting four years. Earlier this year, Osbourne moved out of the family home, with Sharon Osbourne suggesting in May that their 34-year marriage could come to an end. After reports of the split, the 63-year-old told US television chat show The Talk that she had “no
idea” if she shared a future with her husband. However, the couple later indicated they were back together. Osbourne said in a statement: “Over the last six years, I have been dealing with a sex addiction. I’m sorry if Ms Pugh took our sexual relationship out of context. “I’d also like to apologise to the other women I have been having sexual relationships with. “Out of bad comes good. Since the press exposed this, I have gone into intense therapy. I am mortified at what my behaviour has done to my family. “I thank God that my incredible wife is at my side to support me.”

n today’s report we provide an insight into the secrets behind some of the biggest winter gummy sharks we’ve seen in a while. I don’t recommend keeping these 20kg+ fish. However, don’t let that stop you targeting them as it’s a massive achievement due to their sheer size and power. These toothless sharks will smash the bait like a steam train; take off upstream in the effort to gain as much oxygen as possible, while fiercely shaking their head and tail with the intent of dislodging the hook. All of this occurs in a split second so be sure to be prepared. This leads me to the three main steps to capture the gummy shark of your dreams. Step 1: Preparation
there are some specific areas that produce good sharks at certain times. During summer and winter offshore is underrated as it can consistently produce 15kg+ fish. The key to track them down is to look for structure like a reef, a pinnacle, a gutter or hole of some sort. Basically something that will shelter bait fish from the current. This method can be used inshore as well. All you have to do now is present your baits without them spinning in the current, kick your legs up and wait. Being prepared is arguably the most important step towards landing any gummy Todd shark, especially a big one. Before you even think about targeting the shark itself, bait should be your main priority. Freshly caught bait is ideal as it still has 100% of its natural oils and odour. This is important for gummy’s as they rely on their sense of smell for hunting. This is also why they are referred to as the smooth hound shark. When it comes to specific baits, juvenile fish like yakkas, Australian salmon and silver Trevally are great with the inclusion of squid and eel. Most of these species can be caught in shallow water with sabiki rigs (squid jigs for the squid). If you don’t have time to catch these fish Seaford bait provides a very fresh alternative. Now that you’ve got your bait you need to rig up. A heavy rod is good to have when fishing Westernport due to the fast running current. So, 6-10kg or similar to that is a good place to start. Overhead and spinning combos are both good. As far as what rig to use, you can’t go wrong with a running sinker rig. It is also important to have a big enough sinker to hold bottom. 20 ounces is sometimes needed in Westernport! Although, 6-10 ounce depending on where your fishing and what depth is a good start. Next up is finding the gummy sharks. Step2: Finding the perfect spot In Westernport, gummy sharks cruise through basically everywhere. However,

News that Williams will miss New Zealand's entire Rugby Championship/Bledisloe Cup campaign after partially rupturing an Achilles tendon in the Rio Olympics sevens is major blow to the world champions, who were already casting around for a new centre combination. They were counting on Williams to be the main man in their midfield following the Test retirement of centre greats Maa Nonu and Conrad Smith after last year's World Cup triumph. All Blacks coach Steve Hansen's uncertainty over his centres was highlighted in the recent 3-0 home series win over Wales as he experimented with combinations in Williams' absence. A veteran of two successful World Cup campaigns, Williams had been expected to miss only the opening Test against the Wallabies in Sydney on Saturday week before making his return after sevens duty.
