.BLJOH B CVDL PVU PG 0UUBXB¤T OFX DSJNF CJMM he federal Conservative government is aiming to bring down a new omnibus crime bill that includes mandatory minimum sentences for even minor drug offences, such as growing as few as six marijuana plants. The bill would also remove some avenues to early parole and eliminate counting remand time served while awaiting sentencing. The plan has provincial bean counters scared straight: it is estimated the cost for locking up tens of thousands more people and keeping prison inmates inside longer will cost hundreds of millions of dollars for incarceration over the next few years, despite a falling crime rate. The Parliamentary Budget Office estimates that in the first five to six years under the new bill prison costs could run as high as $10 billion. All of which would have to be paid by taxpayers. As investors, we see an opportunity here and we need look no further than the United States, where private prisons represent the healthiest landlord returns in a country where the rest of the real estate market is in shambles. Since 1980, many U.S. states have been

enforcing mandatory minimum sentences and such laws as the â&#x20AC;&#x153;three strikes and youâ&#x20AC;&#x2122;re outâ&#x20AC;? ruling that locks people up for long periods even for consistently petty crimes. Since then the U.S. prison population has increased five fold. With 5 per cent of the global population, the U.S. now has 25 per cent of all people in prison. This is all good news for Nashville-based Corrections Corporations of America (CCA), the largest private prison company in the U.S. In the third quarter of this year, CCA reported a 2 per cent increase in revenue to US$433.5 million â&#x20AC;&#x153;driven by a 2.3 per cent increase in daily inmate populations.â&#x20AC;? The CAC only has 80,000 prisoners, mostly in the southern U.S., yet is on track to post revenue increases of more than 8 per cent a year. It may even be higher because of prison inmate growth in Georgia due to a recent crackdown on illegal immigrants. For each inmate in one of its prisons, CCA makes an average of US$58.29 per day. That is a better return than in most of the slumping U.S. hotel market. CCA is also buying state-run prisons, recently picking up a 1,798-inmate facility from Ohio for US$73 million, with a guar-

anteed occupancy of 90 per cent. So here is how a for-profit plan could work in Canada. The government would sell existing prisons to private-sector companies, which would then list their shares on the Toronto Stock Exchange. As the new omnibus bill drives more people into the slammer, taxpayers would buy shares in the prison companies and, instead of paying to lock more people up, would make a fat profit on it. All they would need to do is jettison their morals and their common sense, as has apparently already been done in Ottawa.

3FTJEFOUJBM PVUMPPL WESTERN INVESTOR he current downturn in Metro Vancouver’s housing market won’t continue into 2012, and the recession-like conditions from Vancouver Island to the Kootenays will change to a more balanced market next year.

That’s the premise drawn byWestern Investor from hours of interviews and conferences held over the past few weeks as experts tried to forecast an industry that not only defines Vancouver but is perhaps the most important economic engine for both the city and the province. At the Housing Outlook 2012 conference in Vancouver last month, analysts from Canada Mortgage and Housing Corp. (CMHC) sketched a scenario of suprising stability in the Vancouver and B.C. market for next year. The official forecast is for Metro Vancouver resales to rise 9 per cent and the average overall home price to increase 2.2 per cent from 2011 to $805,000. The average detached house price in the Vancouver area is expected to crack above $1.1 million in 2012. For all of B.C., housing sales are forecast to increase 7.4 per cent, with the average price flatlining at $559,500, after a 3.1 per cent drop this year, according to CMHC. Provincewide housing starts are expected to fall 2.5 per cent in 2012, to 26,700 units, though CMHC sees Metro Vancouver starts rising nearly 6 per cent next year to 18,000 units, led by condo and townhouses. Partially due to the housing sector, the unemployment rate in Metro Vancouver is forecast to fall to 7 per cent in 2012, from 7.7 per cent this year. Residential real estate is what keeps the economy here ticking, suggested Andrew Bibby, president and CEO of Grosvenor Americas. “Housing is the driver for Vancouver’s econ-
omy,” Bibby told the November Emerging Trends in Real Estate 2012 conference presented by the Urban Land Institute. He told of travelling south through the industrial landscapes of Seattle and California’s Silicon Valley and wondering, “What does Vancouver run on?” His suggestion that it is housing has merit: this year in Greater Vancouver sales of 33,000 resale homes will generate $26 billion. At the same time, annual new-home construction permits in the Lower Mainland are in the $3 billion range and residential construction directly employs 113,000 people, not counting realtors, mortgage brokers and other soft support. Home renovations are worth another $7 billion to the provincial economy. Another telling conclusion from the Trends conference: the best global real estate investment for 2012 is a single-family detached house in either Vancouver or Toronto. According to Citizenship and Immigration Canada, there is backlog of more than 300,000 Chinese residents who want to immigrate to Canada, and Vancouver is the preferred choice for investor immigrants, who must prove cash assets of $1.6 million. This year, an estimated 45,000 immigrants will arrive in Metro Vancouver, a level that should continue for years, according to CMHC. Langois said he has no doubt that he can find buyers for the 40 luxury homes at the Residences of Georgia. Confidence is also seen in the new-detached market. Buyers lined up in the rain for hours last month to buy new $600,000-plus houses in Coquitlam, according to a spokesperson for Morningside Homes, which sold 14 new houses in less than four hours. , n'SBTFS 7BMMFZ A buyers market has become entrenched in the dFraser Valley over the past few months, a signal of what is happening the further away one gets hfrom Vancouver. B.C.â&#x20AC;&#x2122;s capital city will see a modest recovery in 2012 after watching housing sales decline for three straight years. Total MLS sales are forecast to increase 6.8 per cent next year, while average resale home prices will remain nearly unchanged at $505,000, from a year earlier. Housing starts in Victoria will increase 8.8 per cent in 2012, but remain below the average over the past four years. Victoria will continue to have one of the lowest vacancy rates in Canada: 1.4 per cent in 2012 according to CMHC. It also has one of the lowest unemployment rates, at 5.4 per cent projected for 2012.

Both CMHC and Central 1 Credit Union are forecasting a weak recovery in the Central Okanagan, where sales have been falling steadily for three years, with resales down 5.4 per cent in 2011. Residential sales in 2012 are expected to come back to around 3,100 units, which would still be below the level of 2009. Prices will flatline at 2011 levels. Kelowna will be the bright spot, according to CMHC, which sees an 11 per cent leap in resales in 2012 with only a modest increase in the average price of a resale home, which fell 2.6 per cent this year to $512,000. The Kelowna vacancy rate is easing and is forecast to be 4.5 per cent in 2012, down from 5.5 per cent this year. The upturn hinges on

The tagline for Kelownaâ&#x20AC;&#x2122;s Big White ski resort emphasizes the one thing skiers are keen to know about when planning a visit to the ski hills of B.C.â&#x20AC;&#x2122;s Interior, or just about anywhere else in the province, too. But running a ski hill, and selling the real estate, is about more than snow, as Aviawest Group knows too well. The Victoria-based resort developer â&#x20AC;&#x201C; which owns the Pacific Shores in Nanaimo and Victoriaâ&#x20AC;&#x2122;s Parkside Resort â&#x20AC;&#x201C; sought protection from creditors at the end of October facing $90 million in obligations on a portfolio valued at $88 million. Pinnacle Lodge, its property at Sun Peaks near Kamloops, is the sole ski lodge in its portfolio, but Aviawestâ&#x20AC;&#x2122;s troubles are emblematic of an industry navigating a challenging downhill slope. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s been pretty slow for the past two or three years,â&#x20AC;? said Peter Nixon, manager of real estate development for Sun Peaks Resort Corp., which oversees about 1,300 units. During good economic times, 6 per cent to 8 per cent of those units might be available for sale. Right now, the proportion is running at about 12 per cent, with discounts of between 10 per cent and 25 per cent. Nixon believes those discounts arenâ&#x20AC;&#x2122;t bad given vendors are now realizing 90 per cent to 95 per cent of their asking prices for full-use ski condos. Some developers are slashing prices in half in order to attract buyers, though Nixon notes that Sun Peaks has been disciplined about how much new product it releases.

swiped by the introduction of the HST on July 1, 2010. Recreational properties are typically subject to the full tax unless buyers are acquiring them as primary residences (most werenâ&#x20AC;&#x2122;t, given that ski resorts are not, by nature, year-round communities). Moreover, many buyers who bought before the HST was adopted sought to avoid paying GST by purchasing units or shares in units through entities with business numbers. This allowed them to write off the sales tax, but also obligated them to collect HST on the sale of the units. â&#x20AC;&#x153;We saw a fair flurry of activity in the first six months of 2010 as we were climbing out of the economic problems of 2008. But after [implementation of the HST on] July 1, things slowed down quite drastically again,â&#x20AC;? Nixon said. The lack of transitional rules governing the phase-out of the HST in the run-up to March 31, 2013, has put a new damper on sales activity. â&#x20AC;&#x153;Thatâ&#x20AC;&#x2122;s been a challenge for people to deal with,â&#x20AC;? Nixon said. â&#x20AC;&#x153;Some developers ... are
actually offering to pay the PST portion, the 7 per cent portion of the HST for the purchaser, in order to get a deal now versus having people wait till the spring of 2013.â&#x20AC;? But the costs add up, especially in the face of downward pressure on pricing.

â&#x20AC;&#x153;I donâ&#x20AC;&#x2122;t think, necessarily, weâ&#x20AC;&#x2122;ve hit bottom yet either,â&#x20AC;? opined Harry Pettit, a sales associate with Prudential Kelowna Properties and longtime agent for properties at Big White. â&#x20AC;&#x153;Sales this year are up a little bit over the same period last year, so thereâ&#x20AC;&#x2122;s a little more business during the summer and fall than, say, last year. So maybe, hopefully, people are realizing there are some real bargains up there.â&#x20AC;? He has handled four-bedroom condos on the hill that would have fetched $300,000 not too long ago but are now going for $200,000. Another property, purchased for $585,000, sold for $430,000. The vendor swallowed the HST, too. Recently, prices were discounted by more than 50 per cent at Tuscany Villas, Kelowna. â&#x20AC;&#x153;There are some screaming deals up there, there really are,â&#x20AC;? Pettit said.
Some, however, are screaming and running away. RBC lenders in Ontario, for example , refused to countenance a financing deal their B.C. regional lending team approved â&#x20AC;&#x201C; for a top-notch client â&#x20AC;&#x201C; because the bank has backed away from ski hill properties, Pettit said. The buyer turned to a line of credit, maxed it out, and closed on the deal. Itâ&#x20AC;&#x2122;s buyers like that who give hope to developers like Howard Katkov, president and CEO of Red Mountain Resorts Inc. Katkov has seen his share of trouble since acquiring Red Mountain, a former community ski hill in Rossland. The province tags resort development as a key plank in the B.C. jobs plan, pledging â&#x20AC;&#x153;to aggressively market resorts and ski hills from across the province to increase in-and-out-of-market skiers to experience the incredible skiing opportunities in B.C.,â&#x20AC;? and Katkov is giving substance to those intentions. Red Mountain saw its best season ever last year, boosting EBITDA three-fold and topping 110,000 visitors. â&#x20AC;&#x153;The ski side of our world is very good,â&#x20AC;? he said. â&#x20AC;&#x153;It will continue, in my opinion, to be very resilient to the economic ups and downs of our global world.â&#x20AC;? And thatâ&#x20AC;&#x2122;s where heâ&#x20AC;&#x2122;s hoping the hillâ&#x20AC;&#x2122;s real estate will benefit. Just 100 of the 1,400 units planned for Red Mountain have been built to date. In 2008, Katkov slashed prices on units in his Slalom Creek complex and sat tight to weather the incoming storm. Elevate, a collection of 80 pre-fab homes released last year, has been taken off the market. Thereâ&#x20AC;&#x2122;s just $5 million in real estate on offer today, down from $18 million two years ago. â&#x20AC;&#x153;We canâ&#x20AC;&#x2122;t go up against the tide until the tide starts to swing,â&#x20AC;? Katkov quipped. Heâ&#x20AC;&#x2122;s focusing on building traffic and boosting business at the resortâ&#x20AC;&#x2122;s 120-person conference centre. â&#x20AC;&#x153;We think that experience will stimulate more destination visitors, and stimulate our real estate. Thatâ&#x20AC;&#x2122;s the strategy,â&#x20AC;? he said.â&#x2014;&#x2020;

WESTERN INVESTOR hen the Vancouver-based Commercial Real Estate Development Association (NAIOP) named Chilliwack as the “most improved” municipal district in the Lower Mainland for its industrial strategy this year, it likely came as no surprise to those who have worked with the eastern Fraser Valley community.

Chilliwack took the honours, shared with North Vancouver City, for recording an overall drop of 6 per cent in total municipal development costs compared with when a similar industrial survey was taken in 2009. Based on the re-zoning and development of a theoretical 100,000-square-foot warehouse on a 5.5-acre site, NAIOP found that the development cost charges (DCCs) in the City of Chilliwack worked out to $1.91 per square foot. This compares with $2.54 per square foot in nearby Abbotsford, and more than $4 per square foot in Surrey. The bottom line, when all fees and costs are tallied, is that it would cost about $270,000 to build the 100,000-square-foot warehouse in Chilliwack, or about $100,000 to $200,000 less in larger Fraser Valley communities. In relative terms, Chilliwack is also speedier on municipal approvals, taking 90 days from application to permit approval in the NAIOP survey, tied with Abbotsford as the quickest in the Lower Mainland. What the survey didn’t show, but which no doubt attracts the attention of developers, is that an acre of serviced industrial land in Chilliwack starts at around $550,000 per acre,
almost exactly half the price across Metro Vancouver. Also, unlike many municipalities in the Lower Mainland, Chilliwack has industrial land to spare, with five business parks developed over the past six years, totalling more than 300 acres. Even a â&#x20AC;&#x153;house with acreageâ&#x20AC;? in Chilliwack sells for an average price of less than $520,000, which may convince some to give up a similarly priced small condominium in Vancouver. Corney Les, a veteran realtor with Re/Max Nyda in Chilliwack, said that despite the low
prices the housing market remains slow, especially in the new-home market. According to Canada Mortgage and Housing Corp. starts of single-detached houses in Chilliwack have plunged 43.8 per cent this year: This is the biggest decline in the Lower Mainland, and pushed Chilliwack house starts down to just 182 units in the first eight months of 2011. Multi-family starts, nearly all condo apartments or townhouses, fared even worse, posting a 64 per cent drop to just 122 homes. This despite the fact that new-home prices in Chilliwack appear to be at rock bottom relative to Greater Vancouver, 90 minutes away. For instance, Higginson Gardens, a new development, offers three-bedroom townhouses from $294,000 and brand-new three-bedroom detached houses for less than $475,000. And new-home buyers can find even better
deals than that, Les said. â&#x20AC;&#x153;Some builders have cut prices on new detached houses to $369,000,â&#x20AC;? he said, adding that buyers can find new 1,500-square-foot townhouses for $225,000. â&#x20AC;&#x153; A lot of new prod uct is on hold until things improve.â&#x20AC;? Les added that ongoing construction on the Trans Canada Highway, expected to last another two years, has â&#x20AC;&#x153;really hurt business here in Chilliwack.â&#x20AC;?

Their excitement quickly turned to dismay, however, when they received the offer. Not only was it so far below their homeâ&#x20AC;&#x2122;s appraised value that it was both insulting and financially impossible to consider, the real estate agent representing the buyers insisted that his clients, who had recently arrived from overseas and wanted a home that was â&#x20AC;&#x153;ready to go,â&#x20AC;? wanted that price to include all of the dining room, living room and bedroom furniture. Disillusioned but willing to negotiate, John and Sarah countered at a price that they considered fair market value. Frustrated by the back-and-forth negotiations that were taking weeks instead of days, and shocked that there didnâ&#x20AC;&#x2122;t seem to be any respect for their familyâ&#x20AC;&#x2122;s personal possessions, John and Sarah eventually withdrew from negotiations. The potential buyers were genuinely surprised and disappointed that the negotiations, which they thought were moving along well, were stopped so suddenly. While this story is unfortunate, it isnâ&#x20AC;&#x2122;t unusual in todayâ&#x20AC;&#x2122;s global real estate market. With a significant portion of Canadian luxury real estate sales driven by foreign investment and immigration, savvy Canadian sellers are shifting their efforts to target these international buyers. Nowhere is this trend stronger than in British Columbia, where, according to Cameron Muir, chief economist of the BC Real Estate Association, close to 55 per cent of Canadaâ&#x20AC;&#x2122;s investor-class immigrants (those with a mini-
