Letter from the Editor Dear Readers, In the Letter from the Editor in the August 2011 issue, I wrote about how to deal with your friends in business. Your friend Sarah had just started a business selling free-range eggs. I suggested that instead of acting like an astute consumer and asking for a discount, you should make her feel good and support her new business by paying the full price. Sarah was not selling computers, air conditioning systems or water filters that you may not have needed at the moment. She was selling eggs! I wrote that many people are not sensitive enough to understand what goes on in the mind of the new entrepreneur and how fragile they can be during the early days of a new business. This time I want to go a bit further. Over a year ago, El Al posted by mistake a ridiculously low price for their tickets. Many people wanted to know the law and the halachah for those who purchased the ticket at the posted price. We had a discussion in my family and we concluded that had we bought tickets based on a mistake, we would certainly pay the difference or we would cancel the purchase no matter what the law. A few weeks ago, we bought a Shabbat suit for my son. Later on, we received a call from the store owner who said that his employee had made a mistake with the price. He told us that the price was almost 50% more of what we paid. I immediately thought that this was similar to the El Al case. We simply would not benefit from an honest businessman’s mistake. The options were clear – we pay the difference or we return the suit. For us, this goes beyond the law or our rights under halachah. Selling the suit for the mistaken price would have created a financial loss to the owner. How hard do our hearts have to be to not care about our neighbor’s parnasah? Who knows what the owner’s financial situation is and how a loss like this could affect him if he is going through a hard time? We learn in the Gemarah (Eiruvim) that a person really shows what he’s made of when he is drunk, when he is angry and through his pocket. We have an incredible opportunity to show who we really are and to make a Kiddush Hashem every time we care for the people we do business with as much as we care for ourselves. Can We Be True Israelis?
Introduction by Nicole Levin (an American-born, Israeli-trained real estate attorney and one of Bizness Magazine Experts) I have been writing a column on legal real estate issues in this magazine for the past few years. As I am an Israeli attorney, I have always dealt only with the Israeli legal side of things. Due to the large number of U.S. citizens among Biz readers, I thought that it was important for some thought to be given to the U.S. side of things. Since I am not a U.S. attorney, I asked my colleague, Felicia Seaton, a U.S. Estate and Tax attorney, to explain the ramifications of our actions on our U.S. taxes. n today’s mainstream Israeli culture, it is almost expected that a parent purchase an apartment for each adult child. However, if one or both of the parents is a U.S. citizen, this could prove quite tricky and certainly requires meticulous prior planning due to additional taxation. Here’s why. Many people are surprised to find out that the U.S. government is interested in how one provides for a child. Many ask whether the U.S. government will ever know that they have purchased or given a child a home. According to U.S. law, taxes are owed on any transfers made by U.S. citizens and green card holders of over $14,000 (total) per year to any person, even one’s child. And soon, in the very, very near future, the U.S. will start to know everything about your finances. So yes, the U.S. is interested and will know. U.S. Federal Gift Tax Any U.S. citizen may gift (transfer without full and adequate consideration) $14,000 per year, per recipient, no matter what the recipient’s citizenship or relationship to the person making the gift without any U.S. transfer tax applying. This tax applies to all U.S. citizens, no matter where they reside, where their money is, and no matter how much or how little of a relationship they have had with the U.S. This applies to the transfer of anything – cash, investments, real estate, etc. While there are some very specific exclusions to this tax, purchasing a home for one’s child is not covered by any of them. If a U.S. citizen or a green card holder gifts more than the annual exemption amount of $14,000 to any one recipient in any given year, the U.S. Gift Tax applies. This is approximately 40% of the value of the gift on the date gifted. For example, Jake and Adina Salomon (fictitious names), both U.S. citizens, wished to make a down payment of $200,000 on an apartment for their oldest, Moshe, who had recently gotten married, and is also a U.S. citizen.

Jake and Adina each transferred $14,000 tax free to Moshe. Each also transferred $14,000 to Moshe’s spouse tax-free, for a total of $56,000. The remainder of the transferred amount, $144,000, had to be reported and declared on a U.S. Gift Tax Return and was subject to an approximate Federal gift tax of $37,000. Do I Have to Pay the U.S. Federal Gift Tax? Every U.S. citizen currently has a lifetime exemption amount for U.S. Federal Transfer Taxes (Gift and Estate) of $5.34 million. This means that a U.S. citizen can transfer a maximum of $5.34 million to other persons, tax-free, whether during life, by gifting, or after death via inheritance. Two married U.S. citizens have two exemptions and can therefore transfer a maximum of $10.68 million either during their lifetimes or after their deaths. Thus, Jake and Adina filed their U.S. Federal Gift Tax return but did not actually pay any taxes to the U.S. upon transferring $200,000 to their son as a down payment for his new apartment here in Israel. Although every U.S. citizen has a tax credit, all are still legally required to file the gift tax return. In addition, many U.S. citizens will need the entire amount of their lifetime exemption to transfer their wealth to their next generation. So plan carefully so as to get the most out of this exemption. This was not the case in Jake and Adina’s situation. There can be other scenarios where Israeli resident U.S. citizen parents will wish to ensure that their child own a home when starting out. Esti and Ron Tal (fictitious names) had already purchased several real estate assets in Israel by the time they came to see me. They wanted to transfer either an apartment, a house or a building lot to each of their children and came to me for advice on how to do so in such a way so as to eliminate their exposure to U.S. transfer taxes. that practitioners in my field face. Transfers can be made in full and gift tax returns filed. Transfers can be made in part, so as to avoid the need to file gift tax returns, but at great cost and effort. In any case, several professionals must collaborate in order to ensure, as much as possible, a significant reduction in both U.S. and Israeli taxes, so that both the parents and the child get as much value out of the real estate asset as they can. The Tals worked slowly and carefully with my office, a respected Israeli attorney, a real estate appraiser and a U.S. CPA in order to reduce, as much as humanly possible, their exposure to the U.S. transfer tax. Israelâ&#x20AC;&#x2122;s Real Estate Bubble It has been a long-time practice among U.S. estate planners to encourage their clients to transfer unappreciated property to their children. Generally, unappreciated property is expected to increase in value. Therefore, if U.S. citizens own real estate in Israel that is expected to increase in value, it could be quite beneficial for them to transfer ownership of such property to their children now so as to take advantage of helpful tax considerations. Here, too, professional advice is a must. The Knot of Israeli and U.S. Taxation All U.S. citizens must consult with Israeli tax professionals as well when transferring or purchasing property in Israel. While planning to reduce exposure to U.S. transfer taxes, Israeli taxes could increase. The Tals (see above) encountered this scenario and heeded the advice of a renowned Israeli tax attorney to reduce their exposure to Israeli taxation as well. Good Advice is the Key Many potential clients inquire as to whether I can handle the whole case. Alas, practice areas have become very specific nowadays and law spanning two continents requires quite the expertise. Moreover, there are very specific reasons as to why accounting and law are two different professions and both are needed when dealing with U.S. citizens and transfers to the next generation. Planning today will reduce your tax liability tomorrow. Every penny is worth it.All amounts mentioned above are in U.S. dollars. Setting the Price and Negotiating: Homeowners obviously know their homes better than anyone but that doesn’t mean that they’re the best salespersons for their properties. Some sellers are tempted to try a “For Sale by Owner (FSBO)” transaction because their local community is in the midst of a sellers’ market. They think that they can sell easily without help. Others try the FSBO route because they want to maximize their profits and avoid paying a commission to a realtor. Statistics show, however, that selling a home with the assistance of a professional real estate agent will garner you a higher profit, enough to cover the commission as well as put more money in your pocket. When trying to sell your home, the right price is the key to a quick sale with the highest offer. Trying to understand your home’s value by comparing home prices listed in the various newspapers or mailing lists will give you inaccurate info. You will most probably end up getting less for your property because you are working blindly without having real info. While you may be tempted to “test the waters” and put your home on the market at a high price, your home is likely to languish on the market and get a reputation for having a major problem. If you don’t sell within the first few weeks after listing your home, your eventual sales price is likely to be lower. If you overprice and can’t sell, you will then be pressured and eventually sell it at the last minute after numerous price drops – usually getting you even less than you could have gotten originally had you priced it correctly. Reuven is selling his home on his own. He will be happy with NIS one million, but decides to advertise it for 1,100,000 NIS so that he can “drop” the price if necessary. Shimon comes to see the apartment. He comments that various changes 12

need to be made. For example, the kitchen needs to be re-done, there is dampness in the walls, etc. He is trying to lower the price. The negotiations have begun. Shimon asks for the price and Reuven says, “1.1 million.” Shimon says, “No Way!” He says that similarly sized apartments go for 900,000-950,000 NIS. He offers Reuven 950,000 NIS. Reuven says, “No,” since the gap between that offer and the advertised price seems unreasonable. Reuven doesn’t know that after Shimon left, he told his wife that he would have taken it for NIS one million. Shimon doesn’t know that Reuven would have accepted that offer, as it was the original price he had in mind. They would have had a deal but don’t know it! There is a famous saying, “The first offer is the best offer.” But by now, there are too many emotions involved. Time goes by and Reuven, who is now desperate, wants to find Shimon again. If he ends up calling, Shimon will know that he did not get a higher offer — even by one shekel. He will know that he can offer even less. In the best case scenario, Reuven will end up getting between 950,000-1,000,000 NIS, way less than he could’ve gotten with a realtor involved who knew what was going on with both the seller and the buyer. Trying to manage negotiations on your own can cost you a lot of time and money. When you give an exclusive to an agent, you create a personal relationship where there is trust. He knows what your needs are and is there for you, looking out for your best interest. The realtor will give you a CMA (Comparative Market Analysis) through being aware of all the sales in the area and knowing the true market value. She was fully there with them. The laundry was still there but the stress behind it was reduced and her calmness had increased. We then worked on introducing mindfulness into other areas of Karen’s life. Karen was now calmer and so was her daughter. “I’ll do it later.” We always promise this to ourselves, knowing that that’s unlikely. We often rush around and have to move onto the next task before we’ve completed the first. As mothers, we are constantly multi-tasking — feeding the baby, making an appointment to the doctor, helping a child with homework and cooking dinner all at the same time – and did I mention laundry? Later, sure. Our simple daily routine can be exhausting, overwhelming and burdened with stress. According to Professor Mark Williams of Oxford University, all this rushing around means that the emotional part of our brains is on high alert all the time. It’s as if we are running away from a predator. But no one can run fast enough to escape his/her own worries. Karen*, a young mother of three children, was always anxious and stressed. She worried about everything regarding her children, from their development to how they would speak to each other. She blamed herself for all their problems, believing that she was not a good enough mother. But, when her eldest daughter began exhibiting the same early signs of anxiety and stress, she really started panicking. She didn’t want her daughter to go through what she was going through and knew that she needed help, so she gave me a call. After examining Karen’s ideas of what being a mother meant, we worked on setting more realistic and helpful expectations. We also started working on being more “mindful.” Mindfulness is being aware of what you are doing and paying attention to it. For example, when taking a walk, try to appreciate each step and take notice of all the flowers, trees and birds on the way. By focusing on what you are doing right now, you will stop worrying about what happened in the past or what will be in the future. Studies have shown that being mindful helps reduce stress, anxiety and depression. When you are stressed, you need to find a place of stillness within. Some simple mindfulness techniques can help you get there. Karen began practicing mindfulness. She chose to focus on bedtime storytelling to her children. Previously, she would rush through the stories because she was too busy thinking about the laundry that still needed folding or the phone calls she needed to

Open ARMs

n Israel they are called “Mishtaneh” (pronounced Mish-Ta-Neh). In the US, they are called “ARMs.” What really is an Adjustable Rate Mortgage? The name says it all. “Adjustable” means something may or will change. “Rate” is short for interest rate which refers to what your bank charges you for a given period to use the money you borrowed from them. Putting “adjustable” and “rate” together means that the amount of money (the cost) you are paying for the money you have borrowed may or will change. It is important to understand what will change, when that can happen and what it will mean for you. For example, if you take an adjustable rate loan from the bank based on three percent interest annually, ten years from now, on that same loan, the bank may charge you ten percent annually. Again, this is one of many possibilities. But what is definite is that you have no idea what it may cost in the future. The good news is that adjustable does not mean that your mortgage bank can suddenly decide on its own to triple your annual interest rate. The “adjustable” aspects are dictated by a number of factors which can give you some sense of when and why the interest rate might change. There are two primary factors used to calculate the interest rate paid with an adjustable interest rate mortgage. There is the Index (“Ogen” in Hebrew) and the Margin (“Hefresh” in Hebrew). When 16

added together, they determine the interest rate. What’s tricky, perhaps, is that there are different types of indexes, each of which behaves differently and which change based on circumstances. The Prime Interest Rate Index, which is determined by the Bank of Israel, is up for review regularly and can theoretically be changed at any time. If the Bank of Israel sees the need to increase or decrease the cost of borrowing, they will push the rate up or down. Conversely, the Bank of Israel can leave the rate unchanged for long periods of time if they do not see justification for a change. The Prime Interest Rate Index is an example of an index set by the government. In contrast, certain indexes, for example the London International Bank Offer Rate or LIBOR, are market driven and based on an international market of what interest rates are paid on certain loans based on the currency and length of time the loan needs to be paid back. This is an example of a market-driven index. Why are indexes increased or decreased? In the case of the Prime Interest Rate Index, you are looking at changes in the Israeli economy. More importantly, you are looking at the Bank of Israel‘s reaction to these changes to determine if your interest rate (and remember your monthly payment) will go up. In contrast with the LIBOR index, you need to look at what is happening to the economy of the country of the currency used e.g., the three- and six-month US$ LIBOR indexes which are very common in Israel. In order to anticipate change, you need to pay attention to developments in the US economy. The three- and six-month US$ LIBOR indexes are also examples of where the maximum frequency of change is predetermined, e.g., they are three and six months respectively. So, if you have a six-month US$ LIBOR index used in your loan, the rate cannot change more frequently than once every six months. There are indexes that change as frequently as every month and those as infrequently as every five or ten years. It is important to note that I have been illustrating how the interest rate changes. But, even with a mortgage that uses a ten-year LIBOR index, where the interest rate will not change for ten years, a borrower’s cost in NIS can change monthly because of the changes in the currency exchange rates. Similarly, a loan in NIS that is fixed for ten years but linked to the Madad (Tzamud Madad), even though it may be considered by the bank and even the Bank of Israel as a fixed rate loan, a borrower will see his monthly payment as well as his principle change based on inflation in Israel. Currency and indexing are two factors that affect the monthly payments even if the interest rates do not change. So we have the indexes used in Adjustable Rate Mortgages, the currency you are borrowing in and, if you are linked to Madad (Tzamud Madad), all affecting both the cost you are paying for the money you borrowed and how much money you need to pay monthly. Getting into the details of various indexes and their behavior is beyond the scope of this article. The point I want to bring to your attention is that as with any relationship, when someone offers you open ARMs, make sure they are appropriate for you.

very year we get asked numerous questions on how to deal with our orthodontic appliances in preparation for Pesach. Cleaning your braces and/or retainers just might be the most critical part of your “spring cleaning.” All the ambition you showed by cleaning the inside of your toilet tank and boiling your door knobs would all be undone if you are sitting at the Pesach Seder with a full bagel from Erev Pesach shoved between your braces. While we encourage you to consult with your own Rav regarding the details of the cleaning process, the following are guidelines that we have developed over the years: Braces The most basic and most important part of cleaning your braces for Pesach is to make sure that there are no food particles between and around your braces. During the year we urge you to do this in order to avoid inflammation of your gums, bracket debonding, and cavities. On Pesach, you have the added bonus of avoiding a serious halachik problem. Your first step in cleaning your braces is to inspect your teeth and braces closely in a well-lit mirror to make sure that they are spotless. Food can collect behind your wire and behind the “wings” of your braces but not under the bracket itself. The most common area of food storage is between your bracket and your gums. So make sure to lift your lip when inspecting for food debris. The best tools for cleaning braces are still a standard, softbristle toothbrush and floss. Make sure your toothbrush is a soft type and in good condition. In general, your toothbrush or power toothbrush head should be changed frequently since the brackets on your teeth will quickly wear out the bristles. The American Dental Association recommends replacing your brush every three months, so getting a new one for Pesach is a great idea. got your braces. This tool slips nicely into areas between your brackets that can be hard to reach with a toothbrush. A few important notes Your metal braces are made of stainless steel, but boiling them or blow-torching them is VERY DANGEROUS. The best way to avoid a halachik problem with your metal braces is to avoid direct contact with hot chametz (on your braces, obviously) for 24 hours before Pesach. So let that post-apocalypse culinary delight known as Manah Chama cool down a bit before eating it on Erev Pesach. Assuming you clean your braces thoroughly, you should be chametz-free for the seder if you adhere to these guidelines.
Cleaned for Pesach Retainers Depending on what type of retainer you have, it is either made from plastic or a combination of metal and acrylic. DO NOT BOIL YOUR RETAINER. You should not be eating with your retainer in your mouth, so there should not really be a problem with chametz, assuming you clean your retainer with regular soap and water. We also have special retainer cleaning products available in our office for those of you interested in removing some of the saliva deposits that tend to accumulate on a retainer over time and getting that retainer to shine for Pesach. Pesach cleaning is a great opportunity to get into better oral hygiene habits. A clean smile is a healthy smile. wo unique and innovative dental clinics, one located in Jerusalem and the other in Tel Aviv, are now offering periodontal care for inflammations and gum disease using a method called “Medical Periodontology.” This method negates the use of surgical intervention and is based on checking dental plaque samples enabling an exact diagnosis of the cause of the disease. The sample-taking is painless and results are reported to patients immediately. The method allows the patient to view on a television screen everything that the doctor sees in the microscope. The clinic is run by two very experienced doctors: Dr. Claude Hayat, who made aliyah from France over 30 years ago and Dr. Yaakov Hababou, who also made aliya from France in recent years and who brought with him a methodology which he learned in Canada and which he has been using for 20 years. What is the meaning of the words “Medical Periodontology?” Periodontology is the science that relates to whatever is found around the tooth itself (the gums, the bone and the tie between them). Medical because gum disease is an infectious disease in every sense and the general health condition of the patient must be taken into consideration. Is gum disease mostly due to poor oral hygiene or lack of professional dental cleaning? Approximately 80% of the adult population suffers from gum disease to some extent. Good oral hygiene significantly lowers the chance of suffering from gum disease. But, since we are talking about an infectious disease, any one of us can get infected, even without any relation to the level of mouth care. Is mouth disease a local problem or can it expand to the rest of the body? We are talking about an infectious disease usually caused by dangerous germs capable of penetrating into the tissues. How do sophisticated microscopes help in the treatment of gum disease? We use highly magnifying microscopes (x1000) which enable precise identification of the cause of the disease which facilitates immediate effective care. The mouth is a particularly non-sterile environment naturally filled with germs. Can’t one live with them peacefully? We are not just talking about germs but also about bacteria and harmful parasites which can only be clearly identified by a microscopic exam. Our slogan is “from head to toe.” And that is exactly how it is at the store. I can only talk about what I have to offer and one of those things is quality. I will give you an example to what I am referring. There is a woolen suit which is considered expensive and there is polyester suit which is much cheaper. The woolen suit keeps over time. It doesn’t lose its color and it breathes much better for the simple reason that it is made out of wool, a natural fiber. The polyester suit wears out much faster and is much less comfortable. What is this fund that I have been hearing about? Baruch Hashem, G-d has given us the opportunity to help as much as we can. We do our hishtadlut to make people happy through a fund that helps needy families, such as orphans, and day-to-day problems. Part of an interesting teshuva from Rav Moshe Feinstein zt”l on insurance: The teshuva is in Igrot Moshe (Orach Chayim). Rav Feinstein zt”l gives a long introduction as to whether taking out insurance could be considered as lacking trust (bitachon) in Hashem. In a fascinating overview, he touches on many issues that are of vital relevance today and concludes (free translation): “Therefore, since Hashem Yitbarach has given the wisdom to later generations that there should be such a concept of insurance in the world, [through it] one can provide for one’s old age and for inheritance in a natural way. This is a good and worthwhile thing even for kosher, G-d-fearing people, who trust only in Hashem, who provides all material needs. For the one who buys insurance, this, too, is a part of Hashem’s “plan” and the trust in Hashem is that we should be able to pay the premiums each year and this is the bitachon that we must display. The following applies also to fire and theft insurance and also to motor insurance and such insurance shows no lack of trust at all…” (Copies of the full teshuva are available on request.)

What is covered? Theft, loss, break-ins, fire and water damage and third party liability. Many insurance companies are now offering special rates for clients who put in alarm systems and /or bars. Regarding alarms, we suggest that you find out exactly how they work (e.g. at night, on Shabbat, when you’re going away for long periods). Most good firms will give you a non-obligatory quote. Bars are quieter but they spoil the view! You should also check how much of a rebate you can get from your insurance company. Remember, even if you have optimal insurance, a burglary is always unsettling and traumatic and is best prevented completely.

He told us that he had never taken out insurance before this but that his father had insisted! Even though he was traveling to the U.S. shortly, we arranged that a shamai (assessor) come over and make a full evaluation. This was duly done and a full detailed assessment was sent to Y.R. Two months later, on Erev Yom Ha’atzmaut, while the family was at a concert, a fire broke out in their home. How? They had an American clock radio and VCR plugged into a transformer. The transformer (110 volts) was U.S. compatible and not Israeli compatible (220 volts). Two wires touched and the transformer shorted. Because it was not 220 volts, the electricity did not trip and a large fire broke out. Eventually, neighbors saw the smoke. The result was that the top floor was totally gutted; including very valuable collections, all the clothes, etc. Over NIS 150,000 was paid out to a man who “had never taken out insurance before!”

Future of our Children
By Harav Uri Broner, Rosh Yeshiva, Yeshivat HaKidma Hatechnologit Don’t we, as parents, sometimes have different wishes than those of our sons? We, as parents, would like to see our sons grow up to be G-dfearing individuals, that they be knowledgeable in Halacha, have the tools to build a faithful Jewish home, be sincere and honest individuals and have the ability to support their families with dignity. And what does our son wish? We assume that when a child is born and raised in a frum family, that he wants to be frum himself and have a family like his own family. In addition, young people are thirsty for learning and constantly seek that which will stimulate and activate their minds. They do not want to feel cheated or made to learn “stam” information and material that they don’t feel they will need in their adult lives. Therefore, when a young man understands that in order to be an Orthodox Jew, he needs to observe the Sabbath properly, he will be willing to learn all that is necessary to ensure that. This is not to say that he belittles the study of Nezikin, but rather that the laws of Issur v’Heter or those of Basar b’Chalav seem to him more relevant than those of Nizkei Hashor vHachamor. The same applies to secular studies. A boy can understand the need for mathematics, Hebrew and English in his adult life. However, he fails to see the need for additional general studies for the sake of a Bagrut certificate that may or may not benefit him in any way. Why does he also need computer studies? About twenty years ago, I was approached by a young father. He had bought a computer for his children and had the following request: I would like to enable my children to use the computer exclusively for educational programs and only “kosher” games. I do not want them to ever have any access to any types of violent games. I replied to this dear father that I would like him to acquire a car for me that would enable me to drive only to Jerusalem and to the kotel and to use it only for performing mitzvot. I would like him to ensure that I will never have the option of using it to drive to other inappropriate places. In our generation, we are all surrounded by computers. Even someone who does not bring a computer into his home cannot completely prevent his children access to computers and smart phones of varying sorts. So, too, the almost inevitable addiction to the challenges posed by computer games is an uncontrollable phenomenon. Many parents attempt to tear their children away from this addiction and return to the real world. However, it is beyond the power of the children to over32

come the draw inherent in this addiction, regardless of any promises they have given their parents. In oriental martial arts it is taught that if an enemy attempts to attack you, one should not block his blow but rather evade it and allow the opponent to fall forwards. Likewise, in our war against the current-day Yetzer Hara, since we cannot prevent or curb it, we must utilize the strength inherent in it in order to funnel it to positive purposes. In so doing, we can guide the child to do positive things with the computer and not leave him time to waste on nonsense. In addition, the study of computer software combines quantitative reasoning, creativity and competitiveness. These elements give a young man a sense of responsibility, self-confidence and a striving for excellence. Why is there such an absolute addiction to computer games? When I was a child in third grade, I received a computer game as a birthday gift. This game spurred me to gather eggs from four chickens that were laying eggs constantly. I recall setting a record when I collected 1,843 eggs for 40 consecutive minutes. To this day, I vividly recall the challenge inherent in this game. The computer actually fulfills some of our basic needs from our environment. We desire acceptance, that our surrounding not tire of us and that we always have a greater challenge in life. The computer never tires of you. It is willing to tolerate all your idiosyncrasies. As you progress more and more, it will give you an even greater challenge according to your abilities. Task Lighting This is focused lighting on top of the work area, on top of the stovetop and on top of the sink. Task lighting turns the kitchen into a more functional and easier place to work. The bright light and the focus of the task lighting will help you see better in your kitchen, whether to follow a recipe or to cut an onion. Halogen lights are ideal for creating task lighting. Their light creates a “sun,” natural and strong. And it is less tiring on the eyes than florescent lights. Atmospheric Lights Yes, there are atmospheric lights for the kitchen. Their purpose is for aesthetics and design rather than function. The idea is for this lighting to focus attention on the pictures, the dishes, the artistic needs and other design details such as the wall coverings on top of your counter. We call it dramatic lighting. Dimmers Atmospheric lighting, as well as general lighting, can both be installed with a dimmer. In that way, you control the atmosphere. O
ne of the nostalgic feelings of Pesach is opening up the cupboards, unwrapping the dishes wrapped in last year’s newspapers and glancing at the headlines, recalling old events and times. This nostalgic feeling soon passes with the realization that kitchen towels would have saved a lot of washing up. Though we spend weeks Pesach cleaning and making sure that the house is void of chometz, other possessions of ours, no less materialistic but somehow less tangible, are often left unattended. Financial portfolios, though usually void of leaven bread, also need to be cleaned up from time-to-time. Just as the headlines on the newspapers used to wrap the dishes change from year-to-year, a portfolio which is not adjusted to the times will often not perform at its best. Making sure that your investments are up-to-date with the times begins with some of the most basic of decisions, regardless of financial prowess, and involves far more sophisticated choices based on expertise information. Such actions are not reserved for those branded as “high-net worth” but for each individual on his own level. A very basic example is a simple choice. When setting aside amounts in CDs, should you choose fixed or variable rates of interest? If interest rates are at rock bottom but are expected to rise, you may, if choosing a fixed rate for a long period of time, find yourselves in a few months time locked into a low rate when the market offers something far more attractive. Reallocating investments is far more sophisticated than this minor example. The most fundamental factor which should affect your asset allocation and mix is the level of risk you are willing to tolerate. This level of risk changes according to age, immediate and future needs, and, of course, the current financial climate. If you expect to be marrying off a child in the near future, your risk tolerance level is probably lower; if you are thinking of buying a property or have to pay yeshiva fees, you want to guarantee that adequate funds are at your disposal. Similarly, if world markets are suffering due to political events, you may feel less secure and risk tolerant. In the event of such changes, the asset allocation within your portfolio should change. When talking of risk, psychologists often bring a new definition of “perceived risk.” Perceived risk is a risk with a hint of subjectivity. For example, someone living in the US will feel a higher level of risk investing in a local Israeli stock than an Israeli. This is due to objective and subjective reasons. Objectively, the investor has a currency risk (devaluation of the shekel against the dollar) which may affect the value of the investment. Subjectively, the US investor adds the risk of Israel as a smaller, more volatile economy (historically this has been the case) to that of the US. Someone living here feels that less. Therefore, newcomers to Israel may see local investments as a very high risk but after living here, that perceived risk may be much lower, creating a need to change the asset mix of a portfolio.

Other important factors in reassessing your assets are the economic trends in individual countries. Many financial experts will recommend stocks based not just on the strength of the company but making sure that the country of origin of that company has a comparative advantage in its field. Germany, for example, is known for its cars and machinery. Israel is known for its technology. Canada has one of the strongest banking systems in the world. These fields change as demographics and national investments are adjusted. Portfolios should change accordingly. When Yaakov went down to Mitzrayim, things looked to be on the up. What was lacking was an exit plan. And, as we know, getting out was a whole different story. It is crucial to have an exit plan when dealing with investments. One of our biggest weaknesses, as humans, is greed. “Ezeh hu gibor, hasameach be’chelko.” Somehow, when investing, people always look for more. Often this procrastination leads to a fall. It is important not only to set goals but once achieving these goals, cash-in on the achievement and move forward. This is not only true about cash assets. A real estate asset, for example, may have been considered an excellent investment in the past. It is anyone’s guess as to where the market may go in Israel. But, if you feel that you have done well enough, maybe it is time to make a change. An exit plan, however, does not just include selling when you have made enough but knowing to cut losses when you are down. Although this is much harder, the old-school method of riding the market through ups and downs may be less relevant today with all the market manipulators, day traders and hedge funds revolutionizing prior theories.
Another point worth mentioning is inflation. In Israel there are umpteen financial tools available to curb inflationary pressures since the economy has had such high inflationary times. In the 1980s, when inflation was in three digits, it was said that it was better to take a cab than a bus because on the bus you paid at the beginning and in a cab you paid at the end, by which time the money was worth less! Most of the world, however, does not have such a wide range of financial products to protect you from losing purchase value. In inflationary times, this must be taken into consideration. In summary, your investment portfolio is like a beautifully newly planted garden. Pretty and colorful and everything well-blended. But, if you don’t take care of it, weeds will grow, flowers will die and the summer flowers will not blossom in the winter. The concept of flexible office space and delegated admin has really taken off in recent years around the world as an increasing number of people have realized how much it can save them time and money. Is this a growing trend in Israel? Yes. Israel appears to be no exception, although the idea seems to have taken longer to catch on. Some Israelis still seem amazed by the “amazing new concept!” Who can benefit from Serviced Offices? There seem to be several categories of individuals/companies who benefit from our Serviced Offices: • Established Companies/Individuals in Jerusalem: These companies are now able to concentrate on their work without the distractions of having to deal with administration and office management (such as setting up and maintaining high-speed, dependable internet/phone systems, AC, paying bills, hiring and maintaining secretaries, dealing with repairs). The company pays us one monthly bill which includes all of their monthly outgoings and significantly simplifies their bookkeeping. Some clients have commented that by renting through us, they have saved on at least one salary. • Olim and Foreign Companies: These companies particularly benefit from having our Hebrewspeaking staff take care of the unfamiliar and sometimes obstructive bureaucracy involved in office management in Jerusalem. • Start-Ups: These are probably the most suited to our monthly contracts as they don’t need to commit to long-term rentals when they are not yet sure how their ideas will develop. They also avoid having to invest in furniture and office equipment. “When I meet with a client we just need to agree on price. The rest they know from my references.” David, how many years have you been in the building industry? This is a family business. I have been in the construction industry since I was 14. I’m 52 now. So this is basically everything I have done in my life. How did you get started? By going along with my father to every project. He taught me the ropes. I learned from observation and from the direct information I received from my father. Do you have formal training? Yes. Many other builders stayed “in the field.” I wanted to be the best I could be. I learned architectural engineering and design. I wanted to be able to help our clients from the design stage all the way to the completion of the project. I wanted to understand what the architects, engineers and designers were doing in order to better service our clients. As people say, I did not want anyone to “tell me stories.” In which markets have you built? All over the country: Tzfat, Tel Aviv, Jerusalem, Bet Shemesh, Ramat Bet Shemesh, Givat Sharet, Heftziba, etc. We now focus on renovation jobs in the center and in Bet Shemesh as I live in the Rama. I’ve lived in Switzerland. That’s a way of life there. Experience and commitment to my word. There is absolutely no chance that I will not deliver what I offer. I define my company as “business with personality and proper attitude.” We understand that to continue building in the neighborhood you must be straight. Reputation is everything. Why do people say you are “Swiss made?” Because we deliver on time. Over the years I have developed a very special skill to spot any irregularity as it happens. This is why we never have to re-do any part of the job. We do it right the first time. Our motto is NO MISTAKES. That’s part of the secret of delivering the final project within budget and on time. What’s the main challenge for Anglos when they decide to build? To find a builder who is straight and understands their expectations for quality. A builder that can professionally communicate with them and with other professionals involved in the project. What’s the best advice you can give to our readers who are in the process of deciding to build or do a major renovation? Building your home is the most important investment you will ever make. Do your homework. Find the right professionals to work with you in each stage of the project. Save as much as you can but don’t compromise on the quality of people you work with. How about references? Plenty. We build on our reputation. I usually meet with potentials clients after they have done their homework and already know about us. The only thing left to be agreed upon is price. At what stage should people look for a contractor? As soon as they decide to build. “After I was exposed to Interior Design, I knew that I wanted to work in this field.” Interview with Assaf Edry from Doorsill Assaf, can you tell me a little about yourself? I am 37 years old and moved to this area from Jerusalem. I am married and have two children. What’s your business background? I began my business experience in the beverage industry in the area of logistics and acquisition management. After that, I made a career change to marketing and worked in the field of ceramics and interior design where I managed a number of projects for companies involved in that field. That is where I was exposed to the world of doors. How did the idea of opening a door store come about? And why in Bet Shemesh? “After I was exposed to Interior Design, I knew that I wanted to work in this field.” I identified Bet Shemesh as a developing city. I checked out the potential local market and saw that there was a large demand for quality doors. Last Rosh Hashanah we fulfilled the mitzvah of putting up a mezuzah on our door the day we opened the store. We also service the Jerusalem market from this showroom. The Ma Nishtanah question: How is Doorsill different than all other door stores? Doorsill is part of the La Porta national retail chain. We have the same standards of quality but are able to offer a lower price for our customers. At Doorsill we don’t compromise on quality. When a customer comes to us regarding a door purchase we start them off with the basics and explain to them how a door is built and the characteristics of wing doors and sliding doors. We match the customer’s needs to a specific door. The customer is then able to make upgrades by adding nickel lines, windows or sky lights. Installation and delivery are provided in a professional and courteous manner. Who is your typical customer? At Doorsill we work with builders, architects, interior designers and owners of private homes and apartments. What other products do you carry? We sell laminated parquet from Krono of Switzerland and an array of natural stone bricks. Where is your showroom? Why Do You Want to Be

W
hen going into business, the first thing you must ask yourself is, “Why do I want to be in business?” For many people, the main motivating factor is financial. While it is true that if a business is successful, the payoff can be big, there are many “ifs” — and a lot of hard work along the way. Many people prefer to work for somebody else, get a paycheck at the end of the month and go home with fewer worries. If you run a business, everything falls on your shoulders. There is no “punchout” at five p.m. or stress-free vacations. You are on call 24/6. This is true whether you own a doctor’s office or a restaurant, if you are a professional musician or anything else. Everything - advertising and marketing, bills, salaries, etc. – are all your responsibility. You will be working longer hours than you can possibly imagine. Keep in mind that this is all in the start-up stage when you are just trying to launch and get your first client. In a sense, a person needs to be a bit of a “masochist” to be successful. Do lots of research and think it through carefully before deciding. Sit down and spend a couple of hours meditating on this momentous decision. Maybe go to the beach or somewhere quiet. Turn off your cell phone. Do you want to be in business so that you can be your own boss (true, except for your clients’ demands!)? Do you think you can create your own hours? (Actually, you will end up working even longer hours than a paid employee.) Are you doing it for the money or the prestige? Have you researched and understood the risks? What if you fail? Can you afford to take the hit if you fail? Let’s take an example from the world of investors. “Rule Number One” when it comes to investing is that the investor must be able to recover if the investment goes sour. When you write that check, be ready to kiss the money goodbye. A person who can’t afford to lose the investment should not make the investment in the first place — as every investment is a risk. The same is true for anyone who invests in your company. The same guideline is true when starting a business. It could take many months or years before you see any profit or even a steady salary. How will you survive? If you are taking loans, how will you repay them if the business fails? Is your home at risk? Do you need to risk it all in order to grow a business? Do you want to start a business…because you are an entrepreneur? Most entrepreneurs I have met have a few things in common. First, they, like me, often have Attention Deficit Hyperactivity Disorder (ADHD) which is a problem with inattentiveness, over-activity, impulsivity or a combination. Fortunately, ADHD works well for me in the business world. Many successful entrepreneurs were or are ADHD, including Andrew Carnegie, Bill Gates and FW Woolworth, to name a few. Most entrepreneurs find it hard to work for someone else. They are just not built to work hard to make other people money. I know I can’t! I have tried. The last time was many years ago. I was newly married and wanted to bring in a regular pay check and assure my in-laws that I was responsible. It was understandable but, what a mistake! Personally, working 8-10 hours a day to make someone else money did not and does not sit well with me. I would rather use those hours to make myself successful, not somebody else. As with everything in life, it was a good learning experience. I understood who I was and who I was not. I don’t mind working harder in order to make a greater profit. But that isn’t for everyone. Once upon a time there was a fisherman who would relax on his boat every day by drinking a beer. Each evening he would bring back between 5-10 fish to eat or sell. One day a wealthy businessman on vacation approached him and said, “I’m going to do you the biggest favor of your life. I am going to buy you a bigger fishing net.” The fisherman asked, “Why do I need a bigger fishing net?” The businessman replied, “Listen, Son. I’ve made a lot of money through the years and you should listen to my advice. If you had a bigger fishing net you could bring back three to four times as many fish as you do in a day.” The fisherman asked, “Why would I want to catch more fish?” The businessman replied, “Well, if you bring back more fish, you could make more money. With more money, you

could buy a bigger boat, hire more fishermen and bring back even more fish â&#x20AC;&#x201D; making more money.â&#x20AC;? â&#x20AC;&#x201D;â&#x20AC;&#x153;Why would I need more money?â&#x20AC;? The businessman replied, â&#x20AC;&#x153;Because with more money you could buy a second boat and eventually buy a whole fleet of boats. Then, you could open up your own fish market by selling the fish and then you could start an exporting company to sell your fish virtually all over the world. You can make millions of dollars!â&#x20AC;? â&#x20AC;&#x201D; â&#x20AC;&#x153;And then what?â&#x20AC;? Feeling a little exasperated, the businessman replied, â&#x20AC;&#x153;Then you will have millions of dollars. You could relax and fish whenever you want!â&#x20AC;? The fisherman smiled and answered, â&#x20AC;&#x153;But thatâ&#x20AC;&#x2122;s exactly what Iâ&#x20AC;&#x2122;m doing now.â&#x20AC;? There is absolutely nothing wrong with working for someone else. Most people do it. In most cases it means fewer hours at work and less stress, more time for family and learning and a certain degree of job stability. These are all good things. Starting and running your own business can pay off big in the end but it often doesnâ&#x20AC;&#x2122;t. And it can take a long time to get there in any case. Figure out exactly why you want to start your own business and think on all the hard work and long hours that it will take to make it a success. In the end, I figured out that I am an entrepreneur -- with all the advantages and disadvantages that that entails. My skill set and talents include the ability to see future trends and generate ideas. I am able to take a concept from my head and do whatever it takes to build it into a real company. Being a people person, I also love to help people and to build relationships. Also, I believe very strongly in myself and have a â&#x20AC;&#x153;never-say-dieâ&#x20AC;? attitude. These are things that help me succeed as an entrepreneur. Everyone has his/her own talents and skill set. Do you have the skills and talents to be an entrepreneur? Be honest with yourself. Take a few minutes to write down what your skills and talents are. Donâ&#x20AC;&#x2122;t be bashful. Now is not a time for modesty. Do you have what it takes? What skills are you missing that you will need to succeed? Can you partner with or hire the people who have the skills that you are lacking? â&#x20AC;&#x153;The greatest leaders are the ones who hire ones smarter than them.â&#x20AC;? â&#x20AC;&#x201C; Shaquille Oâ&#x20AC;&#x2122;Neal The more clarity you have on who you are and what skills you possess (and lack) will enable you to make better decisions and whether and how you should go into business for yourself. BOTTOM LINE: Becoming an entrepreneur is not an easy way to earn a living. It takes special skills, determination and support in order to succeed. Make sure you have what it takes and you fully realize what you are getting yourself into before you decide to take the plunge. Chessed for All

ith the festive spirit of Purim (and its oriental flavor) still in the air, Kupa Shel Tzedaka’s staff and volunteers have yet to rest on the laurels of another successful Matanos Laevyonim collection and distribution campaign. It is time to ensure that no family in the neighborhood lacks for food and clothing this Pesach holiday. In truth, the Kupa’s committee has already met several times to consider the extent of the holiday assistance that will be distributed to each of the hundreds of families it helps year round. In addition, many families who manage on their own throughout the year have difficulty with the additional holiday expenses. These families as well will discreetly receive food and clothing vouchers to help them greet Yom Tov joyfully. What about the many other families throughout the neighborhood, some of whom might even rightfully accept charity and others who are not that needy? We live in RBS A, not in Beverly Hills! Large families and average salaries (at best) are the rule here, not the exception. Something must be done to help alleviate the financial strain that the Pesach holiday places on their finances as well. Keren Lev Yisrael’s annual Grand Pesach Food Sale is one of the many means that the Kupa Shel Tzedaka employs to help families stock up on Pesach staples at way below market prices. As 52

with the weekly sales, Keren Lev Yisrael accepts orders from all residents of RBS A via its automated telephone system and website. The 120 items offered for sale are all top quality and familiar brand names. The sheer volume of KLY’s orders drastically reduces prices on items that range from produce to meat and from cleaning supplies to paper goods. More than 1,200 families throughout the neighborhood avail themselves of the huge selection and affordable prices. Families, affluent and needy alike, select the products of their choice. The Kupa Shel Tzedaka steps in to subsidize the orders of the neighborhood’s needy families, paying Keren Lev Yisrael for their orders in the amounts pre-determined by the committee. This form of Tzedaka is ingeniously discreet. On the day of the big sale, all arrive at the same pickup point; no one knows who paid in full, who added a donation along with their order and whose order was paid for or subsidized by the Kupa. The day of the big sale takes on the character of a military operation. Over 300 volunteers, a refrigerated truck and two forklifts participate in the distribution, keeping the lines moving along smoothly to facilitate the arrival and distribution of, literally, tens of tons of food and other products over the course of just six hours. Nachal Lachish is closed to traffic and there are two lanes – one for vehicular pick up and the other for pedestrian pick up. Volunteers serve in a variety of roles, with some handing out the items according to the customers’ lists, others packing the items into the trunks of cars and yet others running from station to station giving out water to thirsty volunteers (and customers…) and restocking the items. The festive atmosphere that pervades the neighborhood on ”Sale Day” far surpasses the standard pre-Yom Tov anticipation and joy. The untiring efforts of the volunteers laboring in the early spring heat are accompanied by smiles and laughter. The steady stream of new arrivals meets those departing with their holiday purchases and wishes of “Chag Kosher Ve’sameach” resound along the surrounding streets. Whether one is fortunate enough to pay for the family’s Pesach order in full, or whether one requires the discreet assistance of one’s neighbors through the Kupa Shel Tzedaka, coming home with a full shopping cart, trunk, baby carriage or what-have-you with plentiful Yom Tov supplies is accompanied by a feeling that is indescribably wonderful. Why was the Lehava Organization founded? The Lehava organization’s goal is to rescue Jewish girls in Israel before they go off to Arab villages. In only two years, the organization has rescued over a thousand girls — numbers which are growing every day, unfortunately. During the last two weeks alone, we received information on 44 new cases. How do you get reports about relationships between Jewish girls and Arab boys and how do you prevent them? It is usually family members or good friends who turn to us. We have a phone hotline, 054-849-7687, which takes calls 24 hours a day. Calls also reach our internet site and Facebook page. We organize lectures in schools and community centers. After every lecture, we are approached by girls who tell us about themselves or about other girls dating non-Jews. We also get a flood of phone calls as well. We warn against assimilation in places such as supermarkets and stores that employ minorities and beaches and places 56

of entertainment by putting up ads about the dangers of assimilation. The moment we get information about a girl, we start working. In most cases, the girls do not want to stop the relationship and do not cooperate. That is when we send in our operatives, our “magicians” who go to the girls — where they go to school or work — and then convince them to leave the nonJewish guys. Professionals are also sent out into the field to identify “victims” before they fall into the net. We never give up on any Jewish girl. We relate to every girl as if she were our own daughter — even if she’s already married an Arab and they have kids. We try to

convince her to go back to her mother. Can you give us some short success stories? N’s daughter was to marry an Arab whom she met on her job as a cashier in one of Jerusalem’s chain stores. When we found out that she was attending a wedding in the center of the country, our operative went there with her photo. He began a “chance” conversation with her and after a couple of hours he had convinced her to cancel the wedding and cut off her relationship with the Arab. H. left the Arab man she had been seeing but went back to him a year later. Two years later, and with 2 children, she again turned to us for help. Today,

sheâ&#x20AC;&#x2122;s completely recovered and helps us to save other girls. When we see her son attending a religious kindergarten, walking there with a kippa on his head and tzitzit, we know that we have saved another whole world. C. was a naive Jewish girl from a traditional family who met a Druze pretending to be a Jew on a dating website. They had a relationship for about a year. When she discovered that he was a Druze, it was too late. She had already fallen deeply in love with him. A lot of hard work was needed to convince her to get him out of her head. Can you characterize the girls who fall into the net? Fifty per cent of the girls come from problematic homes and fifty per cent are girls from good, normal homes â&#x20AC;&#x201D; secular, traditional, religious and ultraOrthodox. There are many girls from good families, from religious girlsâ&#x20AC;&#x2122; high schools, Beit Yaâ&#x20AC;&#x2122;akov schools, settlements and towns. How do you rehabilitate the girls you rescue? We bring those who converted to Islam back to Judaism. Afterwards, we examine the most suitable framework for each girl. Many are sent to Rebbetzin Baranes of the â&#x20AC;&#x153;Chemlaâ&#x20AC;? organization who manages a home for girls in trouble. She gives the girls the warmth and love they are so lacking. After a year or two, all of the girls recover, find a suitable Jewish boy and raise families. Thatâ&#x20AC;&#x2122;s our greatest joy! Suitable frameworks are also found for women with children. Why do you need money? Thereâ&#x20AC;&#x2122;s no doubt that the biggest mitzvah of charity is to redeem prisoners. Here we really do bring Jewish girls back home. Although the Lehava organization is built on volunteers and our money is not spent on large salaries or newspaper ads, our purpose is prevention. To that end we need informational materials and to cover the expenses of the operatives. We also try to finance the stay of the girls at womenâ&#x20AC;&#x2122;s yeshivot.
