Estate agency launches part exchange scheme PART exchange was first pioneered more than 30 years ago by house builders, and now, with a continued slow down in the housing market, Allitt Estate Agency has launched a part exchange scheme for the Fylde Coast. Justin Allitt, managing director of Allitt Estate Agency said: “We have launched this scheme in a bid to eradicate chains and specifically broken chains, which were such a feature of property sales throughout last year.” “Our vendors wanted to find a house but were worried that they would not be able to sell their own home in time.” With some national builders using part exchange schemes successfully over the last few years, Allitt Estate Agency first offered it to their clients a few months ago and had immediate results. I own a ground floor flat which has another flat above. Recently there was an overflow in the bathroom in the upstairs flat that caused damage to my property. This is the second time it has happened. The first time the landlord of the upstairs flat sent his agent round to assess the damage and organise repairs. This time he says it is nothing to do with his flat and will not even come round to assess the damage. I am an owner-occupier and we have the freehold between us. Please advise.

The landlord upstairs owes you a duty of care to take reasonable steps to prevent damage being caused to your flat. If you want
to get the landlord to carry out the repairs caused by the overflow at his expense you would have to take him to court on the basis of his negligence. You would then have to prove he was aware of the problems and the likely damage to your property and did nothing about it. But there is no point in seeking a remedy through the courts in an instance like an overflow of water. This is better dealt with by an insurance claim on your house contents policy. Even though the overflow came from upstairs, your own insurance should pay

Your insurer would either then subrogate on the landlord’s insurer to get their money back, because he caused the damage, or, provided he was actually liable at law, if he has liability insurance then that would pay. Obviously, you cannot claim on the landlord's policy, but you can ask him to pass the matter to his insurers.

to sell, but my co-owner is refusing to sell. Given that the deed wasn’t signed do I have any legal right to force a sale as per the conditions defined in the document?

Yes you can still force a sale, but to do so you'll need to apply to a court for an “order for sale”. However, I’m not convinced that forcing a sale is the best way to go. You’ll need to take legal advice, as will your co-owner, which can be expensive, and the chances are that you might not get as good a price for the property as you would if you both put it on the market voluntarily.
