ello fellow BMHBA members,

I hope each of you had a wonderful Christmas and a Happy New Year.

As we usher in 2016, we have to say a couple of big thank yous: first to Vance Vetter of Vance Vetter Homes. Vance served on the board for many years and in many capacities always putting the HBA first and foremost during his tenure on the board; the second to Drew Knutson of Knutson Homes, Drew has done the same as past presidents, setting the bar high for the next person in line and being a leader that we all can appreciate. Both have given their time for the benefit of the BMHBA! So, what does 2016 bring us? For starters, a new board member, Brian Eiseman of Stoneshire Builders. Brian, on behalf of the board, thank for accepting this great honor of serving. The New Year will bring us changes and challenges, including the 2015 ICC building code that will be reviewed and revised in 2016 for implementation in 2017. We will need all the input we can get before this new code is adopted by the local building officials, please be on the lookout for those requests throughout the year. I look forward to the quality conversations we will have with the buildings officials throughout this process. Your board has a renewed commitment to housing via consistent communication with our local building officials and educational offerings for our members. Resolve to GET INVOLVED

I’m going to provide you with a New Year’s Resolution that will help you professionally. If you are having success with your career, other resolutions will most likely be successful as well. The resolution? Get involved with your HBA. If your chosen career is within the home building industry I will stress the resolution one more time; get involved. The HBA is providing you with the opportunity to meet like-minded building industry professionals. No one person can go it alone and the strength the HBA provides, in numbers, is worth the involvement. You, the member, benefit from every single thing that our association accomplishes in Washington, D.C. and in your respective state capitols.

How you can help is quite simple; get involved! Each step below can be your individual resolution depending on which steps you’ve already taken: • Attend your general membership meetings. How can you expand your business opportunities if you’re isolated? Get involved!

• Network, meet people, engage in conversation, learn about others and have others get to know you. Word of mouth has always been the most trusted form of advertising (and its fee!). Develop your social capital. You quite possibly can expand your sales team and the cost is true reciprocity. This only can work positively for you if you get involved!

• Join a committee. Start off fun, possibly golf. You may be asking “how does joining a golf committee help me?” It helps you by bringing in net profits to the HBA which keeps its doors open and in turn helps you as one voice in your state capitol. It also

helps you to expand your networking and have others see you in a leadership light. You could also join committees that deal with the issues of our industry; political action, legislative, legal, etc. This helps you by gaining detailed knowledge of your industry. To blindly go out and not know what’s in the road is foolish thinking. The HBA gives you the education; get involved!

• Serve on your HBA board of directors and see how the HBA truly maneuvers in this highly legislated and regulated industry of ours. Serving on the board will help you with your business plans, short term and long range, if you look at it from the standpoint of improving your career. All you need to do is... get involved!

I can go further but if you’ve made it to the board level momentum will take you much further. By getting involved you have made one resolution that I know you can stick with through the year because you want to provide for your family or have to save the funds to start a family. You may want your home, built by a builder, to be secure in the knowledge that you are successful and you are making resolutions to keep being successful. There may be some who are reading this thinking “I’ve tried this and it didn’t work.” Many successful people have failed, many times and sometimes miserably. Determination is the key characteristic followed by passion and then knowledge. The HBA can’t provide the first two, that’s on you. However knowledge brings many things to those who want it. Knowing the HBA by getting involved will give you insight that those on the outside will never have. How’s that for a resolution result?

STATE NEWS CONSTRUCTION SECTOR SHARE OF GROSS STATE PRODUCT By Na Zaho

Nationally, housing accounted for 15.31% of the real GDP in the second quarter of 2015, with home building and remodeling (residential fixed investment) contributing to 3.21 percentage points of that total. It is also worthwhile to know the importance of the construction sector to local economies. The Bureau of Economic Analysis provides the geographic distribution of economic output due to construction sector, which includes both residential and nonresidential construction. Based on the most recent 2014 BEA data and NAHB estimates, construction made up 3.77% of economic output in 2014 as the housing market gradually recovers from the Great Recession, coupled with a steady increase in construction spending.

In 2014, the state with the highest construction share of gross state product was North Dakota, where construction contributed to 5.87% of gross state product. Louisiana ranked as the second highest (5.61%), followed by Hawaii (5.50%), Montana (5.37%), and Utah (5.17%).

GRANTS AVAILABLE TO MAKE HOUSING ACCESSIBLE Grants are available from North Dakota Housing Finance Agency (NDHFA) to make accessibility improvements to properties occupied by individuals with physical disabilities. “NDHFA’s Rehab Accessibility Program (RAP) allows individuals with physical limitations to affordably make modifications to their home that will allow them to live more comfortably,” said Jolene Kline, NDHFA executive director. Recipients of the grant dollars can earn no more than 80 percent of Area Median Income, which varies by county. The maximum qualifying income for a single individual is $39,440 to $45,040. Eligible improvements include the installation of wheelchair ramps, door levers, walk-in/roll-in showers or grab bars, and widening of doorways. The funds can be used to upgrade either

single- or multi-family housing units. The improvements made must address the accessibility needs of the disabled household member. A maximum of $4,000 may be awarded with a limit of one grant per property in a fiscal year. Matching funds of at least 25%

of the total project cost are required. The NDHFA Advisory Board approved making $50,000 available for the program.

CITY & COUNTY MANDAN & BISMARCK CORRIDOR IMPROVEMENT STUDY - JAN. 26 A public input meeting for the Mandan and Bismarck Corridor Improvement Study will be held in the Veteran’s Conference Room at Mandan City Hall, 205 Second Avenue NW, on Jan. 26. Open house hours are scheduled from 5:30-7:30 p.m., with a formal presentation beginning at 6 p.m. The study will determine the existing traffic operations and evaluate traffic operations improvement recommendations for 10 roadway corridors in Mandan. A truck route feasibility study to divert truck traffic off Main Street in Mandan is also included in the study. CHAMBER TO HOST TOWN HALL ON INFRASTRUCTURE FUNDING

PLANNING & ZONING COMMISSION SEEKS APPOINTEE The Mandan City Commission will be considering appointments for one position to the Planning and Zoning Commission for a five-year term. Members of the local business community and residents are encouraged to confirm their interest in serving on the Planning and Zoning Commission with a letter summarizing their background and reasons for their interest. Letters should be submitted by Jan. 11 to Nancy Moser, Engineering and Planning Department at City Hall, 205 2nd Avenue NW, Mandan, or by email to nmoser@cityofmandan.com.

The Mandan Planning and Zoning Commission reviews plats, zone changes, annexations, development plans and other planning related issues and motions to approve or deny requests.

The Bismarck-Mandan Chamber will host a town hall discussion on infrastructure funding on Thursday, Feb. 11 in the Basin Electric Auditorium at the BSC National Center for Excellence in Energy. The meeting will begin at 5:30 p.m.

In late 2015, Mayor Mike Seminary brought forward the idea of a one-cent sales tax increase to fund street and road construction. This is one of four options identified in the Growth Management Plan developed by the city. The other mechanisms identified in the plan are: an increase in property taxes; a utility fee or additional impact fees on development. The town hall is open to Chamber members and the public. It will include a presentation on the issue and then a discussion of the various alternatives.

BURLEIGH COUNTY MOVES TO SIMPLIFY PROCESSES The Burleigh County Building/Planning/Zoning Department has been running through existing ordinances to streamline processes and simplify paperwork for contractors. The most recent suggestion from Building Official-Director Ray Ziegler was to create a fast track for approval of minor lot revisions. According to Ziegler, “[BMHBA] members will not be viewed as opponents and we will assist them in their endeavors. Simplifying the ordinance is one way.” Find the proposed revisions to 4. HOLIDAY OPEN HOUSE COMBINES

Charity & Fun Members filled Sixteen03 Main Events for the annual Holiday Open House on Dec. 11. In addition to a fun night with friends, members made charitable contributions through a wine tree for BSC Scholarships and a food drive for a local pantry. The wine tree, which was facilitated by Events Committee members generated $349 for our BSC Scholarship Fund and two large boxes of food was donated along with $163 in monetary contributions. ND PROFESSIONAL BUILDERS TO BE FEATURED IN US BUILDER REVIEW BROCHURE The North Dakota Association of Builders (NDAB) is pleased to administer this voluntary certification program established to recognize professionals in the home building industry. ND Professional Builders (NDPB) are listed in a special section on the NDAB’s website (ndbuild.com). It is the first place to which consumers are referred when they contact our office. In addition, NDPBs will be promoted throughout the year in publications and various methods. NDAB ANNOUNCES STATE AWARDS Clay Dietrich, member of the Home Builders Association of Fargo-Moorhead, and Ken Callahan, member of the Williston Area Builders Association, were respectively named “State Builder of the Year” and “State Associate of the Year” at the Annual Meeting of the North Dakota Association of Builders (NDAB). Also, Heritage Homes, members of the Home Builders Association of Fargo-Moorhead, was awarded the Builders Engaging Associate Members (BEAM) award. Dietrich, owner and operator of Dietrich Homes, Inc., is very involved in the local, state and national home builder’s activities. Dietrich is currently president of the Home Builders Association of Fargo-Moorhead and serves on the North Dakota Association of Builders Board of Directors. When describing his leadership style, Dietrich says, “We have focused on building a team dedicated to servicing clients and providing homeowners not only a beautiful home, but a wonderful building experience.” Callahan is a current employee of Montana-Dakota Utilities Co. in Williston, ND, and is an active community member. Working for MDU, Callahan says of his career, “My position with MDU allows me to work with contractors, developers, and everyone in the building industry not to

mention the associate members. I live by MDU’s slogan ‘In the community to serve’.”

Dietrich and Callahan competed with other builder and associate members from Bismarck-Mandan, Dickinson, Grand Forks, Minot, and Williston. The awards are based on member spirit, civic activity, business accomplishments, and activities within the local, state, and national associations.

Tyrone Leslie, of Heritage Homes, was honored with the BEAM award for 2015. As long-time members of the HBA of Fargo-Moorhead they recognize that, “Our team works with associate members because we believe in working with the best in the industry to provide the best homebuilding experience for customers. The associate members are more aware of the changes in the industry and are able to bring the latest innovations and product improvements to our homes.”

7 STEPS TO MINIMIZE WARRANTY WOES Warranty services are a great way to give customers peace of mind and protect them against poor-quality construction. But what are builders to do to protect themselves from excessive liability?

Even the most skilled and wellintentioned builders can see things turn ugly with a home owner if something goes wrong on a new project or repair request. But builders can take certain steps to help them avoid these types of sticky situations. Put it in writing.

Every state has statutes and code requirements regarding warranties. However, these requirements are often open to the courts’ interpretation. To minimize variation, create your own written warranty with specific language and guidelines. A clearly defined warranty allows you to control warranty costs, limit liability exposure and outline the process for dealing with warranty service issues

Have an attorney review your warranty language.

Your warranty document is a contractual agreement between you and the home owner. Even if the document was provided by a third-party warranty company and has been time- and court-tested, it’s still a good idea to have your own attorney look it over. Establish a formal process for service request submissions.

Accepting verbal-only requests for warranty services can lead to miscommunication and tracking issues. But by requiring the home owner to submit a simple, service request form – whether it be a hard copy, online form or even through email – you can avoid such problems. The record should include general details of the request, as well as the date and time it was received.

After the request is received, generate a work order to be delivered to the appropriate internal warranty tech or subcontractor, and follow up with the home owner as soon as possible regarding the request.

Obtain the home owner’s signature once the work is completed. The technician should always obtain a signature certifying that the job is done and that they are satisfied. If the customer is not satisfied with the work, that should be documented as well, along with explicit details for follow-up review. Resolve disputes through a third party.

You can’t please everyone. And the last thing you want to do is engage in a lengthy and expensive lawsuit. Establish a process for settling disputes that all parties understand. The process should involve an impartial third party to resolve the dispute through mediation or arbitration (in states that allow such dispute-resolution procedures). Know your state laws.

Warranty terms may vary by state. There are no warranty requirements for contractors in North Dakota. Warranty repairs are noted in chapter 43 as follows: 43-07-26. Warranty repairs Required notice. Before undertaking any repair, other than emergency repair, or instituting any action for breach of warranty in the construction of a one-family or two-family dwelling, or an improvement with a value exceeding two thousand dollars to a dwelling, the purchaser or owner shall give the contractor written notice by mail, within six months after knowledge of the defect, advising the contractor of any defect and giving the contractor a reasonable time to comply with this section. Within a reasonable time after receiving the notice, the contractor shall inspect the defect and provide a response to the purchaser or owner, and, if appropriate, remedy

the defect within a reasonable time thereafter. The contractor shall provide the purchaser or owner written notice of the requirements of this section at the time of closing for the property or, in the case of an improvement, at the time of completion of the improvement. For the purposes of this section, “reasonable time” means within thirty business days after the notice is mailed or any shorter period of time as may be appropriate under the circumstances. Rely on the experts.

Your customers may appreciate you, but they also know you have a vested interest. To remain impartial and above the fray, refer their questions on material or system performance to the Residential Construction Performance Guidelines, or have a manufacturer’s representative examine the problem and talk to your customer. Taking the time now to define liability limits and establish warranty processes will save you and your business significant time and valuable resources in the future. The National Association of Home Builders (NAHB) applauded today’s announcement that the Environmental Protection Agency (EPA) has unveiled a voluntary Construction General Permit (CGP) stormwater compliance template for residential building lots of one acre or less.

All builders must seek CGP coverage for any construction activity “disturbing” over one acre, or activity disturbing less that one acre when that jobsite is within a larger subdivision or development. Builders must draft a Stormwater Pollution Prevention Plan, or SWPPP, that identifies all potential sources of pollution which might affect the quality of storm water discharges from the construction site. The new Small Residential Lot SWPPP template is for sites with no known roadblocks, such as the presence of endangered species, a historic building or a stream running through the property. Compliance options are presented in a user-friendly format.

The template can be used immediately in New Hampshire, Massachusetts, New Mexico, Idaho and Washington, D.C., where the agency has direct permitting authority under the Clean Water Act. NAHB staff will work with home builders in states with their own permitting programs so that they may soon use the streamlined template too. The new template-which at less than 20 pages is a fifth the size of many current SWPPPs-will provide a simplified menu of compliance options, such as reinforced silt fences, for typical small residential construction sites. Although the new template will not change any requirements in EPA’s CGP, it will greatly simplify the SWPPP writing process, saving small builders time and money.

“For years we have argued that EPA’s CGP is too complex for many of our members, who typically build about five homes a year,” said NAHB Chairman Tom Woods, a home builder from Blue Springs, Mo. “The permitting process is more suited to large land developers, rather than smaller companies that are building homes on individual lots within a subdivision,” he said.

Based on the recently released 2012 Economic Census data, new NAHB research shows that residential construction remains the industry of independent entrepreneurs with 81% of homebuilders and specialty trade contractors being self-employed independent contractors. Even among establishments with paid employees, the industry is dominated by small businesses, with 2/3 of homebuilders and three out of four specialty trade contractors generating less than $1 million in total business receipts. Among homebuilders, multifamily general contractors tend to be largest, with more than 55% of companies generating over $1 million and close to 23% generating more than $10 million in 2012. Less than 8% of for-sale builders (who build on land they own and control) and under 2% of single-family contractors (who build on land customers own) crossed the $10 million mark in 2012.

Under the most recent US Small Business Administration (SBA) size standards, the vast majority of residential construction companies qualify as a small business. The most recent small business size limits for all types of builders is $36.5 million, for land subdivision $27.5 million, and $15 million for specialty trade contractors. By these standards, almost all remodelers and at least 96% of homebuilders, 94% of land developers, and 97% of specialty trade contractors easily qualify as a small business. significant portion of the construction work to subcontractors who can more efficiently perform specific construction activities. In the case of singleâ&#x20AC;&#x201C;family general contractors and speculative builders, subcontractors account for more than a third of the total construction revenue. For multifamily general contractors, 63% of the annual construction receipts are generated by subcontractors. Specialty trade contractors who, by definition, specialize in specific activities (e.g., pouring concrete,

site preparation, plumbing, painting, and electrical work) subcontract out only 10% of the work. The cost of materials purchased by establishments for subcontractors is not included in the cost of construction work subcontracted out but rather counted in the net (in-house) value of construction work.

The construction industry is expected to experience a significant amount of employment growth over the next decade, according to new projections from the Bureau of Labor Statistics (BLS). According to the BLS, the construction sector is expected to add 790,400 jobs for the 10-year period from 2014-2024. This places the construction sector fourth among major industries.

Monthly News from the North Dakota Association of Builders

The Year Ahead Hello fellow NDAB Members! I hope your year is off ot a great start. I am very excited to be representing you as your 2016 President, and I look forward to working on your behalf all year long. First a little about me: I live in Dickinson with my wife, Becky, and my three children; I work as the Arnold Karsky General Manager for ProBuild and have NDAB President been working for the company for 26 years. I have been involved with our local HBA for a number of years and it's been a natural fit for me to get involved at the state level. I know we are going to accomplish many good things in the coming year, and I hope we can create more reasons for members to be involved at all three levels of the HBA, Local, State, and National. One of my goals for 2016 will be to foster our need to have housing in the discussion during the election process. We have a couple of committees that will help keep us informed on the election and other issues affecting the housing industry in 2016. NDAB-PAC, comprised of our Local Trustees, State Trustee John Korselman and State Alternate Trustee Vance Vetter, will be leading the charge in election seat coverage. At the state level, over the past several years we have been watching and keeping track of who has been voting favorably toward the home building industry, and we are beginning to see who is supportive and who needs more information or infuence. We know who is up for reelection and we will be deciding who we will support throughout the State, not just in the 6 local areas. It will be vital for us as an Association to influence and to inform legislators across North Dakota to work with us on issues affecting our industry for the upcoming 2017 Legislative Session. In 2015, Governmental Affairs Committee Chairman, Dan Lindquist and our Governmental Affairs Committee were already working on issues and other home building topics for 2016 and for the 2017 Legislative Session. In 2016, Jason Eid will be taking over as Chairman of the GAC, and will continue to lead with that continued focus going forward. The members of the GAC are going to be sending information and requests to our Local Executive Officers and they will send that information out to you. We need you to get involved, and we need you to reach out to our Legislators when needed. I am asking you personally to please make the call and send the emails. I see good things happening at NDAB and I know our voices will be heard. Here’s to a great 2016!

Randy also swore in the 2016 NDAB Board of Directors member and most importantly, swore in the 2016 state President Arnold Karsky from Dickinson. You will have the opportunity to get to know Arnold better through his monthly articles and he is one that is always open to hearing from you if you have any questions or concerns.
