reetings BMHBA Members,

We are wrapping up another busy month and starting what looks to be another busy month at the association. This last month we continued to attend city meetings, participated with the Bismarck-Mandan Board of Realtors (BMBOR) and the North Dakota Association of Builders (NDAB) at the Capitol for Legislative Impact Day, co-hosted our annual Oyster and Chili Feed with legislators, hosted our first but not last Builders Only Social with the message of “rallying the troops”, attended the BMBOR Appraisal Panel, and I would be remised if I didn’t mention our 40th Annual Home Show. I would like to personally thank all of the committee members, staff, and of course vendors that worked hard and put in countless hours to achieve another successful event.

I’ve spent that last two months meeting with builders and board members, and visiting our committees to share my goal of getting more involvement and “All Hands on Deck”. The association has been doing a lot of advocacy work on our industry’s behalf and we are definitely stronger in numbers. All of this work is my attempt to identify and eliminate empathy.

Wikipedia defines apathy as a “lack of feeling, emotion, interest, and concern. Apathy is a state of indifference, or the suppression of emotions such as concern, excitement, motivation, and/or passion. An apathetic individual has an absence of interest in or concern about emotional, social, spiritual, philosophical and/or physical life and the world.” I don’t believe we have become apathetic, but I do believe that too often it is easy for us to take the stance that someone is fighting the fight or doing the dirty work and therefore we don’t need to get involved. My challenge to each of you is to assume you need to help take care of it, not assume that others will take care of the industry for you. If we all take this stance, we will be in full force. You can begin by marking your calendars for the upcoming events and attending them: • March 16: Build Day at the Capitol • March 23: Fun Night at Jerome Distributing

The SCIENCE and Art Behind SELLING The science of selling—tapping into what customers want and how to sell it to them—proved to be a pretty common theme at the International Builders’ Show. Learn more about the seven key areas that are likely to make your buyers’ hearts’ skip a beat, and what to keep in mind when designing your next home. Great Design Experts say that escapism, converged living, cultural influences and that both task oriented (functional) and experiential (emotion) spaces are currently leading the way in new home design. These other trends should be considered as well.

The Retail Experience In today’s fast-paced, short-attentionspan world, capturing the buyer’s eye and keeping them focused on the mark can be challenging. Marketing and merchandising plays a big role in this. Experts agree that offline, it should start with the sales center. The model home experience should be a

journey for the client. Using virtual and augmented reality in the sales center and throughout model homes or giving clients the freedom to explore on their own, at their convenience can make for a more unique and memorable experience. Location Homes and communities, both singleand multifamily, built within close driving or walking distance to public transportation, shopping, dining, schools and other amenities will always win with buyers (and renters).

Amenities Buyers, especially millennials, love options. The more distinct possibilities offered, even if it’s only two or three, the better your chances of staying competitive.

Focus on Women Research shows that women are the primary decision makers when it comes to consumer spending, and especially when it comes to home purchases. Keeping this top of mind at each phase of the design-build process should help sell more homes. (see infographic on page 9). Personalization Providing ways for buyers to make the space their own, like a memory wall or art alcove, will give them one more reason to fall in love.

Color Color triggers emotional response in humans. Play around with different colors in different rooms to hit the emotional hot spot for buyers. And look to the future; color in architectural design is changing shape. Learn more about how to take advantage of these new trends.

Bismarck Releases Revised Site Plan Policy

ast summer, the Bismarck-Mandan Development Association (BMDA) and Bismarck-Mandan Home Builders Association (HBA) partnered to develop and distribute a survey aimed at identifying potential barriers in the commercial and industrial development process.

Results of that survey were reviewed with building inspections, engineering and/or community development staff from those affected political subdivisions.

The City of Bismarck recently updated their Site Plan Review requirements and took into consideration comments from the survey and subsequent discussions. The new document includes, but is not limited to, the following changes: Site Plan Process Overview:

• A site plan waiver and/or storm water management plan waiver request minimum size threshold for buildings, additions and accessory structures has been reduced from 750 square feet to 200 square feet. In addition, during the waiver review process, the City may determine that additional information or review is needed and may request a full site plan submittal.

Review Fees:

• The review fees have increased and are outlined in the document. It should be noted that there is no fee for a site plan waiver request.

Review Process: • The review time for an initial and complete site plan submittal has been reduced from 15 working days to 10 working days. • Revisions to the site plan will require a resubmittal of the entire site plan indicating any revisions made to the plan. • City staff will prepare and upload a report of all review comments to TRAKiT. This report will be available every Monday for owner and/or consultant review.

Plan Review Inactivity:

• A site plan that has been in the review process with no activity by the owner and/or consultant for a period of 6 months will be deemed inactive and the project will be closed. If it is the desire to reactivate the site plan, a new site plan and all applicable submittal items and fees must be resubmitted for review and approval.

Required Permits and Agreements: • Additional language has been added regarding downtown design review requirements for site plans located within the DC – Downtown Core and DF – Downtown Fringe zoning districts.

One change to note is that the City revised policy language from “Upon receipt of a complete submittal, the initial review may take approximately fifteen (15) working days; however, a complex project may require additional review time.” to “ten (10) working days;” It’s important to point this out not only because this was the single most commonly cited issue in our survey regarding the site development process, but also because it highlights the City’s willingness to work with our organizations to make changes important to our memberships. CITY & COUNTY Mandan Releases Economic Recap of 2016

esidential building.

The City Building Inspection Department issued permits for 303 new residential units in 2016, up 35 percent from the year prior and about equal to the 10-year average. Single-family home construction, at 123 units, was slightly behind 2015’s level of 131 units. However, multi-family permits were up at 137 units among nine projects, compared to 93 units in 2015. New manufactured homes account for 43 units with most placed in the new Meadowlands Park located north of Third Street SE and near Memorial Highway. Home construction activity was at its peak in 2013 when permits were issued for 652 total units. Commercial and industrial building. The city issued permits for new construction, remodeling and addition projects totaling $28 million. This was below last year’s record $52.5 million in permits, but still the third highest year on record.

Value of all building activity. The value of all projects for which building permits were issued in 2016 totals $75 million compared to $93 million last year. The record was $139 million in 2013.

Real estate sales. The Bismarck Mandan Board of Realtors reports a return to a “more normal” or “not so frantic” mode in 2016. The average sale price of residential property in Mandan was $229,659 compared to $238,469 for 2015. This is on 316 units sold, compared to 363 units the year prior. The average time on the market for 2016 was 60 days compared to 53 in 2015. The statistics include single-family home, condo, twin home and duplex sales reported through the multiple listing service. The City of Mandan Assessing Department recorded 847 property deed transfers for the year.

Local usage taxes • 1% sales tax. Total collections for 2016 finished the year at nearly $2.3 million, down 7.5 percent from 2015. Sales tax revenue for 2016 is still 50 percent higher than in 2010. Collections peaked in 2014 at $2.7 million. The City of Mandan also has an additional 0.75 percent sales tax that goes toward funding for a voter-approved sports complex. That portion generated $1.7 million in 2016, the first full year of collections. • 1% restaurant and lodging tax. Remittances are up 7 percent at $450,601, compared to $419,682 in 2015.

• 2% hotel occupancy tax. Collections are up 15 percent at $65,589, compared to $57,046 in 2015.

Taxable sales and purchases. Statistics on the 2016 fourth quarter will not be available from the North Dakota Tax Department until later this spring. The total through the third quarter was $192 million. That is down 7 percent compared to the same period for 2015, but comparatively stronger than state levels, down 26 percent for the first three quarters.

Job openings. North Dakota Job Service reported, 2,306 online job openings in December for the metro area, Burleigh and Morton counties. That’s down 2 percent from a year ago. For the state, there were 13,685 open and available positions in December, up 1 percent from a year ago.

2017 SPRING LOAD RESTRICTIONS APPROACHING The time of year for spring load restrictions to be placed on City of Bismarck streets and alleys is quickly approaching. Depending on the weather, spring load restrictions could be put into effect within the next two to three weeks. Contractors/truckers should consider moving their heavy loads in the very near future before load restrictions are placed on City of Bismarck streets and alleys. Restrictions will be lifted when roadbeds have stabilized enough to carry normal loads. The proposed 2017 load restriction map is currently being developed and will be placed on the City website prior to City of Bismarck load restrictions being put into effect. Mandan Outlook and East Opportunities Event A March 23 “Mandan Outlook and East Opportunities” forum will highlight area growth trends and market statistics. EMPLOYER ALERT: USE THE NEW I-9 FORM Because it wants to reduce errors and make it easier to complete the forms on a computer, the U.S. Citizenship and Immigration Services (USCIS) has published a revised version of Form I-9, Employment Eligibility Verification, and all employers are now required to use it.

Among the changes in the new version, Section 1 asks for “other last names used” rather than “other names used,” and streamlines certification for certain foreign nationals. All U.S. employers must ensure proper completion of Form I-9 for each individual they hire for employment in the United States, both citizens and noncitizens. Both employees and employers (or authorized representatives of the employer) must complete the form. And while the changes make it easier to fill out online, there is also a printable version available.

form. Prior versions of the form will no longer be valid for use and employers who use it may be subject to all applicable penalties under section 274A of the Immigration and Nationality Act, 8 U.S.C. 1324a, as enforced by U.S. Immigration and Customs Enforcement (ICE). Other changes include:

• The addition of prompts to ensure information is entered correctly • The ability to enter multiple preparers and translators • A dedicated area for including additional information rather than having to add it in the margins • A supplemental page for the preparer/translator

The instructions have been separated from the form, in line with other USCIS forms, and include specific instructions for completing each field. Other enhancements include drop-down lists and calendars for filling in dates, on-screen instructions for each field, easy access to the full instructions, and an option to clear the form and start over. When the employer prints the completed form, a quick response (QR) code is automatically generated, which can be read by most QR readers.

IMPACT FEES RAISING CONCERNS ABOUT AFFORDABILITY With a growing number of communities reinstating and raising impact fees, the concern about affordability is also growing. And the challenges of scarce lots and tight lending standards are only making matters worse. Many lawmakers and community officials continue to turn to inclusionary zoning as a seemingly quick and easy plan they can adopt and impose on the housing industry, instead of developing a more comprehensive plan. Yet new research confirms that multiple strategies are needed to close the financing gap and make projects more viable. Prime examples of how the public and private sectors can work together to build mixed income, affordable neighborhoods are detailed in a new NAHB publication, How Did They Do It? Discovering New Opportunities for Affordable Housing.

NAHB also recently developed and updated additional resources to help builders and developers address some of the most pressing industry concerns related to impact fees and affordability, including: • The Impact Fee Handbook (updated in 2016) details several of the most common errors in calculations, inaccurate planning assumptions and illegal misappropriations of impact fees.

• Development Process Efficiency: Cutting Through the Red Tape guides members and HBAs through the process of engaging with local officials and the public to streamline the lengthy, complex and costly development approval process as a way of addressing housing affordability. • Smart Codes, Smart Process Checklist can be used as a conversation starter with local planners and officials to take stock of local plans and policies, and provides direction to more detailed reports.

Although employment and home price levels have returned to or exceeded normal, home construction during the fourth quarter of 2016 remained tepid in many markets due to regulatory and supply-side constraints, according to the NAHB/First American Leading Markets Index (LMI).

The index’s nationwide score inched up to .99, meaning that based on current permit, price and employment data, the nationwide average is running at 99% of normal economic and housing activity. However, when breaking down the three major components of the index, single-family permits are running at just 52% of normal activity, while employment is at 98% and home prices are well above normal at 147%. “Single-family permits continue to lag behind the other components of the LMI,” said NAHB Chief Economist Robert Dietz. “This is due to a number of factors, including regulatory hurdles and supply-side headwinds such as persistent shortages of lots and labor in many markets. As we address

CONVENTIONAL FINANCING CONTINUES TO CLIMB NAHB economist David Logan examined the Census Bureau’s report of quarterly sales of new homes and determined that nearly 71% of new home sales were financed with conventional loans in 2016: a nine-year high and up from 58.5% in 2010. Meanwhile, the share of new homes financed with FHA mortgages was down to 15.7%.

A recent survey of NAHB members found that their top two concerns this year are the cost and availability of labor and developed lots. Richard Van Osten, executive vice president of the Builders League of South Jersey, summed up the problem succinctly: “It’s been more difficult to find lots to build on.” Despite these challenges, the housing market continues to make gradual gains. The LMI shows that markets in 174 of the approximately 340 metro areas nationwide returned to or exceeded their last normal levels of economic and housing activity in the fourth quarter of 2016. This represents a yearover-year net gain of 60 markets. Moreover, 86% of markets have shown an improvement year over year.

HOUSE VOTES TO OVERTURN OSHA RECORDKEEPING RULE In a victory for home builders and other members of the small business community, the House on March 1 approved H.J. Res. 83, legislation that would overturn the Occupational Safety and Health Administration’s (OSHA) recordkeeping rule known as the Volks rule. The rule would subject millions of small businesses to citations for paperwork violations, while doing nothing to improve worker health and safety.

REGULATORY, SUPPLY CHALLENGES INHIBIT MORE ROBUST HOUSING GROWTH

NAHB has vigorously opposed the rule from the start, and has led the charge along with scores of other industry groups who stand ready to fight this unlawful example of regulatory overreach. The rule attempts to extend to five years the explicit six-month statute of limitations on recordkeeping paperwork violations in the Occupational Safety and Health Act of 1970.

Subsequent court rulings have affirmed applicability of the six-month statute of limitations. Nonetheless, in a clear attempt to circumvent congressional authority and in spite of the court rulings, the agency proceeded with its rulemaking, which went into effect last month. NAHB urges the Senate to move quickly to introduce and pass a companion bill so that this legislation can go to the president’s desk and be signed into law.

A LOOK BACK — AND AHEAD — AT LOBBYING For 75 years, NAHB has worked to convince lawmakers to support legislation that helps the home building industry grow. And in an era where legislators on both sides of the aisle find it harder to work together, it’s even more important that NAHB lobbyists encourage and advocate for laws that offer a win for all: policies that promote more homeownership and rental housing opportunities.

“We have the luxury of working for an industry that wears a white hat,” says NAHB Executive Vice President and Chief Lobbyist Jim Tobin. “We’re an American-made product. There are home builders in every district in every state. We’re important to the tax base. We offer jobs. And our members are community leaders who aren’t just providing shelter, they’re providing stability and community leadership.” But just like in home building, the tools have changed. An ‘Arm’s Length’ Relationship

Thirty or 40 years ago, a friendly lunch was one way for both lobbyists and legislators to take each other’s measure and establish a sense of trust – and pave the way to talk the pros and cons of legislation or float ideas for improvement. A wave of reform in the mid-90s did away with this practice – and that still has farreaching consequences, said NAHB CEO Jerry Howard. “You can’t buy votes by taking people to lunch, or the ballpark or the theater. But what it did was solidify relationships and help develop trust. It allowed people to know whether lobbyists were credible conveyors of information,” Howard said. “Now, lawmakers are inundated with information, but they have less opportunity

to determine whether people [who deliver it] are credible. It’s one of the things that has contributed to the polarization on the Hill. Back in the day, a member of Congress would have gotten to know the lobbyists on both sides, and that makes for more balanced opinions. Now, all arguments must be more finely tuned and irrefutable, because you get far fewer bites at the apple.” Keep it Quick, Keep it Short

NAHB lobbyists still wear a path between the National Housing Center and congressional offices. But texts and emails are now the primary tools they use to get their messages to legislators. “For most [congressional] staffers, it’s their preferred method of communication,” Tobin said. It means messages need to be short and to the point. “You have to boil it down to a page, or a half a page. Attention spans are much shorter today,” he said. “Nothing will ever replace shoe-leather lobbying, but people are much busier, and they’d rather not have to take the time to interact with a lobbyist with meetings in the front office.” Less Balance, More Partisanship

Both political parties bear responsibility for gerrymandering and carving up congressional districts to make it easier for one party or another to gain a vote. It’s not like the old days, Howard said, when the balance in a typical district might be closer to 50-50. “There used to be a time when both Republicans and Democrats felt more of a moral obligation to be more moderate in their views, to try to find that middle ground,” Howard said.

“Now, it’s people from the extremes of both parties who are being elected, and that makes coalescing around a common view extremely rare. It’s dehumanized the process. Everything is ideological, and extremism has a much greater opportunity to prevail.” The Growth of Grassroots

Few things are more important to a politician than staying in office, so they want to make sure their constituents are happy. That means that regularly gathering a group of home builders to meet with their member of Congress and their staff is more important than ever.

“It’s always better than cold calls from your office,” Tobin said. “We need to build those relationships, so when I need a senator or a representative to take a specific action for the industry, we have the people we need to move our agenda.” New messaging tools make it easier for NAHB to target association members in specific legislative districts to encourage them to add their voices, and for NAHB to send emails to the legislators themselves. “We’re much more effective today,” he said. As part of the Midyear Meeting in Washington this spring, NAHB will hold its biennial Legislative Conference June 14, when builders, remodelers and their trade partners will meet with their members of Congress to talk about issues of importance to the home building industry. “I hope we break our attendance records this year,” Tobin said. “As an industry, we have a positive, affirming story to tell, and our members are the folks who need to get it across.”

HEARING LOSS PREVENTION GOES MOBILE The National Institute for Occupational Safety and Health (NIOSH), at the 2017 International Builders’ Show, announced a new mobile app that measures sound levels in the workplace.

The NIOSH Sound Level Meter app is designed to promote better hearing health and prevention efforts at construction worksites. Using a smartphone’s built-in microphone, the app pulls in and displays real-time noise exposure data. Stats shown include instantaneous sound level, equivalent sound level, time-weighted average and noise dose based on NIOSH and Occupational Safety and Health Administration limits. The app also provides basic information about noise and hearing loss prevention. NIOSH officials have said that the app could be especially helpful for employers interested in raising awareness among employees about noise hazards on the jobsite and how to better protect their hearing. The app is free, easy to use and gives users immediate feedback about sound levels and noise exposure where they’re working. It also allows users to save and share sound level measurement data with others via social media — which adds an element of fun. Currently, the app is only available on iOS devices. NAHB CANDIDATE STATEMENTS The NAHB Nominations Committee has certified two candidates for 2018 Third Vice Chairman: John “Chuck” Fowke of Valrico, Florida, who is a member of the Tampa Bay Builders Association, and Fred Hoppe of Lincoln, Nebraska, who is a member of the Central Nebraska Home Builders Association. The candidates will address the NAHB Board of Directors at the Midyear Board of Directors meeting in Washington, D.C. John “Chuck” Fowke John “Chuck” Fowke, a Florida custom builder, is president of Homes by John C. Fowke Inc., in Bloomingdale, Florida. Chuck and his brother David established the company in 1974.

He has served as chair of the Charity Women’s Crisis Center’s Addition & Renovation Committee and the Fellowship of Christian Athletes Showcase home. Also, Chuck has served on the City of Tampa Hurricane Codes Committee and the Workers Compensation Board.

I hope everyone that attended had a great time! March 16 we will be having our Builder Day at the Capitol event followed by our first board meeting of the year. This will be another great opportunity to spend some time at the Capitol, talk with some of your legislators, and maybe go to a committee meeting or part of the session that day. At this event we will have lunch with our legislators and their staff in the Great Hall from 11:30 – 1:00. If you are interested in sitting with a legislator on the floor, Kim could arrange that as well. Looking forward to June the NAHB midyear meeting will be held again in Washington DC June 13-17. Now is the time to plan to attend that event. The mid-year meeting will have all the usual committee meetings and the board of directors meeting. In addition to that, we have the opportunity to meet with our Congressional delegation and discuss the important legislation on the national level that affects all of us locally. There is a great deal of optimism at NAHB currently that progress can be made to pull back many of the regulations that have been hurting the housing industry! Eric Brenden

We welcomed ND Lt. Governor Sanford who graciously took time to meet with our group in an opportunity to start building a relationship with the Governor’s office. We have been working closely with the Secretary of State and the Attorney General’s office as well. As you have read throughout this newsletter, the theme is really about unity and building relationships across the state. Our voice is powerful when we join and rise together. One opportunity to show our strength locally and nationally I through our Political Action Committee or NDAB-PAC. NDAB-PAC recognizes there is strength in numbers and people who show they care and are concerned about the future of the building industry make contributions to NDAB-PAC because they believe that cooperation equals strength. You alone can’t influence the Legislature or Congress on issues that can devastate your business. NDAB-PAC is your front line of defense. It monitors legislative issues and works to protect and promote the building industry.
