President’s Letter

reetings BMHBA Members,

It’s seems just like yesterday that Spring had begun and there was hustle and a lot of anticipation in the air for our prime building season. Fast forward a few months and Fall is here and most of those spring projects have wrapped up and we’re all busy trying to beat old man winter to get the last few houses in the ground and keep us busy through the winter.

The association has been busy this fall as well. The end of September saw the completion of our Fall Parade of Homes where we matched last fall with 33 homes by 25 different builders. I am happy to report that we did see a nice uptick in our attendance and by all reports there seemed to be excitement in the air. We introduced the Pink Ticket campaign this year where spectators could purchase a $20 pink ticket with $10 from every sale going to the Bismarck Cancer Center. We sold 100 tickets and presented a $1000 check to the Bismarck Cancer Center Foundation. I anticipate that this check will get bigger every year.

With the conclusion of the Parade always comes the need to celebrate and we did just Board President that at our Fall Awards Mixer & Board Elections event. We had a great time celebrating the success of the parade and I would personally like to congratulate the following winners: Boulder Homes, Apex Builders, Aspire Homes, Diversity Homes, Knutson Homes, Huntington Homes, Pinnacle Homes and Epic Homes. I also would like to thank the committee, our office team, each participating builder and the many sub-contractors that made our success possible. All of your hard work does not go unnoticed. At our Fall GMM we also saw the election of four board members. I would like to welcome new Builder board members Greg Meidinger and Joe Hillerson and returning Associate board members Susie Franklin and Greg Zenker. I look forward to working with them in 2018. In October we also hosted our Fall Building Officials Round Table. We have always seemed to struggle to get builder participation in this event so we switched up the format this year and we had a very productive meeting and the new format proved to be the catalyst.

Our association continues to work on cultivating community partnerships and we have had great success working with organizations such as Boy Scouts, Girl Scouts, and Bismarck Cancer Center. One of those relationship’s direct results is our partnership with the Symphony Youth Orchestra for the second annual Holiday Home Walk on Nov. 19, from noon to 5 p.m. Eight homes will be showcased in their holiday best. We also have youth musicians performing in the homes to help put everyone in the holiday spirit. Please also mark your calendars for:

Eliminate the Dust: COMPLYING WITH THE NEW SILICA STANDARD

A

s NAHBNow.com has reported, the Occupational Safety and Health Administration (OSHA) has decreased the permissible levels of exposure to crystalline silica for construction.

NAHB has told policy makers from the start that this wide-reaching rule will be difficult to meet and enforce. But it’s the law of the land, pending any change from NAHB’s legal challenge still outstanding.

Dan Johnson, CSP, managing partner of SFI Compliance Inc., a national safety consulting firm and member of the NAHB Safety Committee, told us what home builders need to know to comply with the new rule and avoid fines.

It looks like you’re going to be busy. It is a far-reaching standard, and a challenge to comply with in many ways. Home builders definitely need to be aware of this. Even if you use subcontractors, builders may still have oversight responsibilities for the jobsite. OSHA, under its multi-employer citation policy, calls that the “controlling employer.” As the CE, the home builder has general oversight responsibility over the jobsite, including the power to correct safety and health violations itself or require others to correct them. This creates potential liability for the builder if crystalline silica exposures above the permissible levels are present. What materials or actions create silica dust? Silica naturally exists in things like soil, stone and granite. It becomes an exposure issue for workers when dust is created from the many work processes of home building including drilling, chipping, sawing and sanding materials like tile, concrete, brick, stone, fiber cement siding and others. In short, it’s really about the dust. How can silica dust be mitigated to meet this rule? For your subcontractors, or you if it’s your team doing the work, it’s a matter of keeping silica dust out of the air so that it is out of the breathable zone of the worker. The two main ways to eliminate the dust is to vacuum as the dust is being created or spray water to keep it from going into the air. Both can be accomplished with add-on attachments to power tools or with the use of specific tool models. You can use a jackhammer with a water delivery system,

for example. Or you can use a shroud and dust collection system on a handheld drill.

What is your advice to home builders? I’d reach out to every single subcontractor I have and alert them in an email or other written communication and ask for written confirmation that they are aware of and complying with the silica requirements. And I’d save that documentation.

Remember, if it happens on your job, you have potential liability. If I walk up to my jobsite and see a dust cloud, it’s my responsibility in supervising the worksite and the overall build to stop that contractor and notify them they need to comply before continuing their work. Not all dust clouds are necessarily silica — some alternative products are on the market like drywall mud that contain no silica. But you need to check the product’s safety data sheet (SDS) to be sure. How prepared are home builders in the industry for this rule? I think this is still in a really early stage in terms of implementation by builders and contractors. It’s very important to go to OSHA’s website and to use the materials from NAHB to take the necessary actions to get into compliance. The 30-day “good faith” compliance period will end soon, so builders really need to get a firm hold on this. I also think there will be some surprises, especially among smaller builders. A guy doing 10 homes a year may not even know about this rule. I think this will catch those home builders off guard.

How have you seen builders and contractors going about meeting this rule so far? Any examples? We worked with a cabinet installer, who actually did a lot of the legwork and research herself and did a great job. She knew she drilled and installed material into concrete, therefore creating silica dust, and went to the Table 1 instructions from OSHA’s silica rule, and opted to buy a drill with dust collection system and knew she had to use a specific filter vacuum. So that’s the ideal scenario: A contractor identifies that an aspect of the work they do causes silica dust, and they seek out a means of keeping it out of the air. What about respirators? That’s actually a pretty tricky aspect

of all this. If you cannot keep all dust out of the air in the first place, you can use respirators to help keep the airborne silica out of your workers’ lungs and monitor the air content of your worksite for silica yourself. Under this method, your workers are also required to have medical evaluations performed on them if they wear respirators for 30 days or more in a year.

But keep in mind, if an employer chooses to use respirators, those respirators have to be used correctly. That includes being clean shaven to have a proper seal on the worker’s face, and ensuring the worker is trained, fit tested and medically cleared to use the respirator. Since it is more difficult to breathe with the device, heart and other conditions can make them dangerous to use. And again, you’re taking the risk that the worker will consistently and properly use the device, when they have a lot of other things taking their focus on the worksite. That said, it’s important to note too that for durations of exposure lasting more than four hours per day, and depending on indoor or outdoor conditions for the worker, respirator use may be a requirement of Table 1 — even if you are using dust collection or water delivery. You really have to do your homework.

How to do you go about helping your clients with silica compliance? We share the information I’ve mentioned here and the documentation from OSHA, and we help the client identify all the areas where silica dust can be created in their work process so that they know what to watch out for. We also have developed a checklist that home builders and remodelers can share with their subcontractors to help make them aware of the silica requirements and get their commitment that they are in compliance. Resources OSHA’s website has the details of the enhanced requirements that took effect Sept. 23. NAHB has a Silica in Construction Toolkit that includes helpful guidance and a set of tools and products sold by manufacturers to aid in compliance. These products and claims have not been verified by NAHB, but serve as a helpful start for home builders and contractors as a reference. November 2017 | Building Buzz

CITY & COUNTY Business Incentives and North Opportunities A Nov. 14 “Business Incentives and North Area Opportunities” forum will highlight programs to assist new and expanding businesses in Mandan as well as developments along the interstate 94 corridor.

Speakers will also provide updates about economic development tools, residential and business projects in north Mandan, available land and buildings, plus future roadway plans. ‘Railyard’ Entertainment District Proposed for West Main Mandan City officials are working with Icon Architectural Group to look at costs and revenues associated with potential implementation of a vision plan received in July. The City hired Icon last winter to assist with a plan for renovation and reuse of the former Central Market and Thrifty White Drug buildings.

After the cost and payback analysis, next steps include recruitment of developers and business tenants, then in 2018, pending City Commission approval, issuing requests for proposals to seek private sector investment in certain parcels and buildings. Updates will occur periodically at future City Commission meetings. Learn more about the proposed plan at www. cityofmandan.com.

Community Input on Stormwater Management Requested The City of Mandan is seeking community input on stormwater management issues. Mandan’s stormwater ordinances and engineering design methods were implemented in August 2006 to create an efficient and effective stormwater management program. These are in the process of being updated. Other considerations include future development and infrastructure planning, maintaining and creating flood control measures, water quality control, special assessments and managing overall system costs.

Under the 1987 Clean Water Act Amendments, the U.S. EPA developed regulations to address Stormwater that might impact water quality, commonly known as the MS4 Program (Municipal Separate Storm Sewer System). The City of Mandan is designated as an MS4 community by the State of North Dakota.

To measure awareness and obtain insight on how Mandan is doing, consultants assisting the City Engineering and Planning Department with a stormwater management plan are requesting that you respond to a series of question online at surveymonkey.com/r/ MandanStormwaterSurvey.


CITY & COUNTY Remove Campers, Trailers and Boats from Streets Prior to snowfall, please remove campers, trailers and boats from streets and sidewalks to accommodate for snow removal. Local ordinances prohibit or limit boats, motor homes, buses, campers or trailers parked on a public street between Dec. 1 and March 31. Violations are punishable by a fine and towing at the owner’s expense.

Residents to Get Garbage Totes As part of the renewed contract for residential garbage collection in Mandan, Armstrong Sanitation, will be delivering a 96-gallon tote to every household that receives curbside garbage collection during the week of Nov. 13.

A tote is a two-wheeled, heavy duty trash cart. A 64-gallon tote is available upon request by calling Armstrong Sanitation at 6638219. Residents also may request additional totes that would be billed separately on an annual basis by Armstrong Sanitation. Each homeowner is responsible for the tote he or she receives, so please note the number on your container. If a tote is lost, there will be a replacement charge for a new tote.

State of the Cities Scheduled

The Bismarck-Mandan Chamber of Commerce is hosting the State of the Cities event on Nov. 7 at the Ramkota Hotel. Mayors Tim Helbling and Mike Seminary will present statistics Mandan and Bismarck, respectively. Registration for the breakfast is available online at bismarckmandan.com.

Mandan Named City of the Year Mandan was named 2017 City of the Year by the North Dakota League of Cities (NDLC) during the League’s 2017 Annual Conference, Sept. 30, in Fargo. Commissioner Dennis Rohr accepted the award on behalf of the city. In his presentation of the City of the Year award to Mandan, NDLC Executive Director Blake Crosby outlined many recent accomplishments of the city. • In 2003 ordinances were passed to restrict exotic dancing

• 2004 brought closure to a long-standing legal battle with BNSF related to an underground fuel spill in the downtown area.

• As part of the remediation project, several properties were acquired and subsequently razed by the city. • The City Commission recognized that it needed a champion for business development and created such a position in 2006.

• 2008 saw the opening of a new middle school, a mixed-use building in 2010, assisted living centers and a Walmart supercenter opening in 2013, new elementary school in 2014, and a universal playground for all persons of all abilities in 2015.

• 2015 also saw the city and park district address the recreational needs of a growing community. With a combination of voter approval and public/private partnerships, Mandan has invested $36 million in recreational opportunities for residents and visitors. This investment includes a sports complex for use by local youth and a wellness center in partnership with the YMCA and a local healthcare provider that is available for all ages and abilities. The existing recreational facilities are being repurposed into a multipurpose gymnasium with volleyball and basketball courts and the existing football/track area will repurposed for two baseball diamonds. A new sports complex will be a further economic driver, giving businesses more reasons to locate in the area. • Recently, a former historic school has been sold to a developer that will lead its transformation into 39 affordable housing units.

• The city has developed a brochure for new residents who may have questions about housing choices, recreation and education and has installed 24 “wayfinding signs” to help orient and direct visitors.

• Citizen surveys have all indicated the desire for more eating establishments. In response the city created several incentive programs directed specifically for restaurants. This past year, six new eating establishments have opened or are in the process of opening. • Another recent major project dubbed “The Rail Yard” includes the re-facing of an existing building and plans for new construction of two additional buildings on-site. This project strives to bring life back to part of downtown that has struggled since losing its grocery store.

In addition to carpentry programs, Bismarck Public Schools and BSC offer various areas of study that offer careers in the residential home building industry, including electrical, HVAC and welding. The BMHBA recognized four outstanding BSC trade students at the 2017 Fall Awards Mixer & GMM. The 2017 BMHBA Scholarship recipients were Seth Privratsky and Bryce Fettig in the Carpentry program, and Mark Colvin in the HVAC program. Each student took home $1000 to continue their rewarding path to a promising career in the building trades.

Back in Action The membership has spoken, and Board members Greg Zenker with Northern Plains Plumbing, Heating and Air, and Susie Franklin with Choice Financial will be serving on the BMHBA Board of Directors for another term.

Zenker and Franklin were reelected to the Board of Directors during the Fall Awards Mixer & Board Elections event on Oct. 24. They were among a field of five candidates running for two Associate member seats that included Tracy Roberts of Guild Mortgage, Kevin Jacob of Northland Concrete and Heidi Rue of Superior Insurance. Zenker and Franklin currently serve on the Executive Board. Greg as a Past President and Susie as Treasurer. When asked what she was most looking forward to, Susie explained that in addition to standing next to Jeff and Rory in group photos, she is excited about, “Continuing to be a voice with a great group of Board Members in the ever-changing building industry.�

President Trump signed an executive order that would ease restrictions on association health plans and health reimbursement accounts to create more options for small businesses to provide health benefits to their employees.

NAHB has long led the fight in support of association health plans, which would grant small businesses access to better and more affordable health care plans, allow them to negotiate lower costs for coverage, and level the playing field for smaller firms that want to help their workers and their families with their health care needs.

Moreover, the executive order would expand the use of health reimbursement arrangements, which allow small businesses to offer pre-tax dollars to insured employees to help pay premiums and/or other out-of-pocket costs associated with medical care and services. The IRS issued guidance in 2013 prohibiting the use of health reimbursement arrangements and NAHB led the charge to pass legislation in 2016 that would not only reinstate their use, but also abolish punitive IRS penalties associated with them.

While the president’s executive order is an important step forward to address the issue of health care affordability for America’s employers, much more needs to be done to make the expansion of association health plans a reality. It is still unclear what actions federal agencies will take to implement the changes outlined in the executive order and how states will respond to the presidential directive.

With small employers struggling to find affordable health care in the marketplace, NAHB will continue to work with the White House, Congress, and state and federal regulators to ensure the president’s executive order can be enacted across the nation.

Recent NAHB analysis of Census Bureau data revealed the median lot value in 2016 was $45,000, matching the record high set the year prior. The previous high mark was $43,000 set in 2006.

Another record setter was the median lot size of homes sold in 2016, which dropped to an all-time low of 8,562 square feet (less than one-fifth of an acre). A variety of factors come into play such as local zoning regulations, land availability and housing demand. But regardless of their location, most builders are feeling the pinch. “Land prices are just getting asinine,” said a production builder in Utah, who asked to remain anonymous. “There’s a bubble out there, and it’s not in homes — the bubble is in land because that’s where people are getting ridiculous.”

The builder admits that even though his margins are “not even close to where they were back in ’04 and ’05,” business is still very good. As one of the top builders in his market, he’s building more than 500 homes annually despite the current cost and availability constraints for lots.

“There’s massive demand right now, but very little of it is for the large, expensive homes,” the builder said. “It’s mostly for the more affordable stuff because we’re seeing a lot of interest from younger buyers. But keeping prices low is becoming extremely difficult to do.”

For this builder — and for many like him across the country — finding municipalities that will allow higher-density developments is one of the biggest hurdles to building affordable housing and generating stronger profits. However, that entry-level segment of the market is often where demand is strongest.

“[Demand] just isn’t there for half-acre lots; it’s simply too expense to develop,” the builder said. “When I hear some of these prices, I [want to say], ‘Are you kidding me? You’re paying that per acre and at that density?’ It reminds me of ‘05 and ’06, to the point I’m backing out on deals because I just won’t pay that amount.” “I don’t know how or when, but it’ll slow down eventually. And when it does, a lot of [builders] are going to get stuck.”

HOUSING INDUSTRY COULD GET ‘CHOPPY’ IN THE MONTHS AHEAD

Despite ongoing positive market conditions, recent home sales data have come in below expectations. And in the months ahead, housing data is expected to be choppy as the economic impacts of hurricanes Harvey and Irma are registered. Contracts for sales of new single-family homes fell an estimated 3.4% in August. Though sales have trended flat through the middle of 2017, year-to-date sales are 7.5% higher than they were at this point last year. While inventory has risen to a healthy 6.1 months’ supply, affordability remains a primary concern, especially as interest rates will continue to rise into 2018. Similarly, the pace of pending sales of existing homes declined for the fifth time in the last six months, falling an estimated 2.6% in August. The low levels of inventory, particularly entrylevel homes, is restricting sales growth in both the existing- and new-home markets. The good news is that economic conditions remain stable, and recent NAHB analysis shows an increase of consumers planning to purchase a new home in the near term.

Single-family lot prices remained at record high levels in 2016, with half of the lots priced at or above $45,000. According to NAHB’s analysis of the Census Bureau’s Survey of Construction (SOC) data, the median lot value reached $45,000 for the first time in 2015 exceeding the previous record of $43,000 reached in 2006. The rising lot values are consistent with persistent record lot shortages that NAHB reported in July of this year. They are also consistent with significant and rising regulatory costs that ultimately increase development costs and boost lot values. It is also possible that home building shifted towards more urban and dense areas where land values are typically higher, and land development faces more stringent regulation requirements.

For this analysis, the median lot values were chosen over averages since averages tend to be heavily influenced by extreme outliers. This analysis is limited to single-family speculatively-built homes by year started and with reported sales prices. For custom homes built on owner’s land with either the owner or a builder acting as the general contractor, the corresponding land values are not reported in the SOC. Consequently, custom homes are excluded from the analysis.

NAHB OPPOSES OMB PROPOSAL TO REFORM NATIONAL FLOOD INSURANCE PROGRAM The Office of Management and Budget Director Mick Mulvaney submitted a proposal to congressional leaders to reform the National Flood Insurance Program. NAHB Chairman Granger MacDonald issued the following statement regarding the proposal:

“While NAHB supports reforms to the National Flood Insurance Program (NFIP) that will keep the program fiscally sound and preserve rate affordability, we strongly oppose the new proposal by OMB Director Mulvaney to phase out new NFIP policies for newly-constructed homes. It would simply prevent home builders from being able to provide safe and affordable housing to consumers. By creating uncertainty in the housing market, this proposal would also harm local communities and

impair economic growth.

“New homes are built to more stringent safety standards and usually fare much better than the older housing stock in flooding disasters. Moreover, new construction policyholders pay full-risk rates, so they put more into the NFIP than they take out in claims. Why does OMB needlessly propose to penalize new construction? It would only hurt the fiscal soundness of the NFIP and fail to ease taxpayer burdens. “NAHB will continue to work with Congress and the administration to achieve needed reforms to the NFIP that will ensure it remains efficient and effective in protecting property owners, creates more stability in the housing market, and improves the financial viability of the program.”

NAHB REVISES POLICY AS TAX REFORM DEBATE HEATS UP NAHB unanimously voted to revise its policy regarding the nation’s tax code in light of recent discussions on tax reform between congressional leadership and the Trump administration.

The Oct. 3, 2017 vote by the Executive Board gives NAHB greater flexibility as the tax debate unfolds and stakeholders seek consensus to shape a tax code that best serves the nation’s consumers and small businesses. “This is the first time in NAHB’s 75-year history that we have been open to the idea of broader options regarding housing tax incentives,” said NAHB Chairman Granger MacDonald. “Now is the time to reform tax policy, and housing will not be left behind in this process.” NAHB supports a tax system that is simple and fair, and that promotes greater housing opportunity for Americans across the economic spectrum.

The tax policies that NAHB is promoting include:

• A homeownership tax incentive;

• The low-income housing tax credit, along with additional resources to meet the affordability crisis;

• Tax incentives for remodeling, including energy efficiency tax credits; • The exclusion of capital gains on the sale of a principal residence; and • Business interest deductions for small businesses.

NAHB CEO Jerry Howard joined Administration and industry leaders at a White House event Monday, highlighting the need to reduce the regulatory burden on businesses and the economy.

“Residential construction remains one of the most heavily regulated industries in the country,” Howard said. “We are pleased that the Trump administration recognizes the regulatory challenges placed on our industry and that it is taking steps to reduce these burdens.”

After the White House event, NAHB was invited to participate in three of 10 breakout sessions hosted by federal agencies, including the Labor Department, Small Business Administration (SBA) and Treasury, to discuss the specific regulations in need of reform. Here are some recent examples of how NAHB has been working with the Administration and federal agencies on this issue:

• Organized members to participate in SBA Advocacy roundtables held across the country, where members gave firsthand accounts of the problematic federal regulations they face.

• Submitted comments to HUD about which of the agency’s regulations should be repealed, replaced or modified; and met with HUD Secretary Carson to discuss regulatory and housing affordability issues. • Met with EPA Administrator Scott Pruitt to discuss steps to reduce regulatory burdens that are raising housing costs for home builders and home buyers.

“We look forward to helping this Administration deliver meaningful regulatory relief to the industry and, in doing so, generating substantial local economic activity and job creation,” said Howard.

Looking at single-family homes started in 2016, the median prices per square foot, excluding improved lot values, range from $164 for contractor-built homes in the Pacific division to $81 for speculatively built homes in the East South Central division. Per square foot costs exclude the cost of developed lot, so highly variant land values cannot explain the regional differences in per square foot costs. However, higher and rising regulatory costs undoubtedly contribute to higher per square foot costs.

Custom, or contractor-built, homes are built on owner’s land (with either the owner or a contractor acting as a general contractor). Consequently, contract prices of new contractor-built homes do not include value of improved lot and, typically, are lower than sale prices of spec, or built for sale, homes. To make comparison more meaningful, the cost of lot development is excluded from sale prices of speculatively built homes.
