reetings BMHBA members,

Fall is in the air and elections are right around the corner.

We have elections for local, state and national leaders. When making your selections, be sure to vote for pro-housing candidates. We also have elections for our BMHBA board, be sure to get your name in the hat if you would like to be on the board and be sure to be at the Fall Awards Mixer & Board Elections event on Oct. 25 to vote. Our Government Affairs Committee is hard at work. They are keeping tabs on residential zoning changes, infrastructure financing and statewide legislative agendas. The next few weeks will be very busy as we vet the candidates.

2017 Home Show registration is open for last year’s vendors and will open to all on November 3rd. We have a new sign up procedure - it is all online and you can choose where you want be by looking at the floor map in real time. Thanks to Terri for her hard work to get it up and running.

Finally, I need to tell you how important it is that our membership gets involved as much as possible. Our committees and board work very hard to make our association successful and we are always looking for new ideas to implement, but sometimes there are great ideas that never make it to fruition because that person with the idea never voiced it. I challenge you make your voice heard; bring your new ideas to the table and help keep our association moving forward.

More stringent requirements to protect against natural disasters: There are thousands of IRC and energy code change proposals that officials will consider this month as the International Code Council (ICC) holds its public comment hearings in Kansas City, Mo.

two- family homes and townhouses back to the appendix of the International Residential Code, which is where they were before being moved to the main body of the code in 2009. This would mean fire sprinklers would not be required unless the state or local jurisdiction moved to adopt the appendix.

Fortunately, NAHB Construction, Codes and Standards volunteers and staff have waded through the hundreds of pages of documents and code-speak to highlight the ones we need to think about the most.

So far, only two states — Maryland and California — have mandated sprinklers in new one- and two-family homes: a reflection of their high costs and unpopularity with home buyers, as well as ongoing fire safety improvements in materials, products and practices.

CITY & COUNTY 2017 Budget Proposes Lower Property Tax Rate Despite Budget Shortfall The City of Mandan’s proposed 2017 budget calls for a decrease in the 2016 property tax rate for city services, despite a significant reduction in revenue from other sources. The proposed budget would cut they levy by nearly 7.5 mills, dropping to almost 59 mills compared to 66 last year. An existing home with a $250,000 value and an average valuation increase of 13 percent would see no increase in city property taxes. This excludes special assessments for approved projects such as street paving and reconstruction.

The 2017 budget reflects a difference of $1.2 million in total revenues from the 2016 budget. Total revenues are expected to be $31 million. Total expenditures are estimated at $30.1 million, a decrease of $928,000 from the 2016 budget. The City’s general fund is facing a $686,000 reduction in state aid distribution and a $396,000 reduction in highway tax distribution. The City plans to adjust for the budget shortfall by transferring $500,000 in hub city funds to the general fund. An additional $170,000 will come from the 1-percent city sales tax fund, $170,000 from the BNSF settlement fund, and $50,000 from the water and sewer utility fund. The general fund will absorb the difference. The City is expecting $4.2 million in hub city funding. The funding, which is designated to oil impact cities with a population of 12,500 or more, is determined by the percentage of oil and gas related employment above a base of 1 percent. Mandan has oil and gas employment of 8.02 percent. The latest proposal is to allocate it as follows: $1.3 million will be designated to public works facilities, $500,000 will be transferred to the general fund, $53,000 will be used to purchase a patrol car for the police department, and $10,000 will be We are excited and honored to have Shannon Coulter join our team of Real Estate Professionals. used to purchase a mower for the cemetery. Remaining dollars will be set aside for expenditures relating to the oil and gas impact on the city. A north side fire station project has been shelved due to staffing concerns.

The City’s Budget and Finance Committee is recommending a contribution of $4.7 million from property tax revenue toward a total city budget of $30.1 million. Property tax revenue is budgeted $198,000 higher with much of the additional revenue stemming from new construction entering the tax rolls and expired exemptions in 2016.

The first consideration of the budget was held on Tuesday, Sept.6 during the Mandan City Commission meeting. The second and final consideration is scheduled for an Oct. 4 meeting beginning at 5:30 p.m. and following a public hearing scheduled for 6 p.m. All meetings take place at Mandan City Hall, 205 Second Avenue NW.

Sales tax buy-down The Mandan City Commission remains focused on lowering property taxes by fostering retail business growth. The budget committee’s recommendation for 2017 is to contribute 57 percent of projected sales tax revenue to property tax buy-down, as compared to the policy of 50 percent adopted in 2013 and contributions of 40 percent in 2012 and years prior. The sales tax contribution to the general fund budget for 2017 is pegged at $1.3 million in total. Without it, the mill levy would need to be about 17 mills higher.

Lowering mills to offset value increases The taxable valuation of Mandan property is estimated at $80.4 million in 2016, up from $68.4 million in 2015. There was a 13 percent increase in the total value of residential property. The increase to the total value of commercial property was 31 percent. Personnel impacts The 2017 budget does not allow for market or performance adjustments except for promotions, due to a reduction in revenues from the state of North Dakota. The hiring of additional employees is not included in the 2017 budget. The City will re-evaluate vacant or unfilled positions based on need, but intends to fully staff its police and fire departments. will be considered later in the year once city officials can better determine the level of potential cost share from the N.D. Water Commission for water treatment plant improvement projects and the timing of those projects. The water volume rate will increase by $0.10 per 100 cubic feet, and the waste water volume rate will increase by $0.05 per 100 cubic feet.

The overall impact for an existing residential property using 800 cubic feet or eight units of water per month is a $1.40 increase on the utility bill. The last time the volume rates increased was in 2013.

The solid waste utility fund which covers residential garbage collection and hauling services will see a base rate increase of $0.05 per month per living unit. The residential single-sort recycling service will see a base rate increase of $0.15 per month.

City services only a portion of local property tax bill City services account for about 24 percent of the total mill levy for Mandan property owners. School District, Morton County and Park District services account for the remainder.

At a time when countless college graduates are finding they are underemployed and saddled with crushing student debt, it is time for educators and policymakers to reexamine the widely held belief that a college degree represents the only road to success. The building trades offer a great career path. Regrettably, fewer students are seeking careers in the construction industry because many parents and guidance counselors are steering them toward a college pathway rather than a vocational route.

With the nationwide housing recovery now picking up steam, it is imperative that America trains more workers and leaders in the construction industry. The number of open construction sector jobs in March was 147,000, the third-highest monthly total since the Great Recession ended, according to the latest BLS data. There are programs available for students in the Bismarck-Mandan and surrounding areas that are focused on filling the labor void in the residential housing industry. Area high school students participate in home construction through the Bismarck Public School Career and Technical Center. Dave Peterson, Framing and Interior Carpentry Instructor, guides students in building a home

on site. From designing and drawing plans, to framing and finish work, students use handson study to build skills that will carry over to their future in the workforce.

Bismarck State College has made a significant impact on the home building industry for the past 30 years. The Residential Carpentry Program at BSC under the direction of Earl Torgerson, guides students through the complete construction of a single family home. Areas of study include methods and principles of building construction, construction math, blueprint reading, sustainable/green building, energy efficient building, materials, cabinetry, and drywall. The majority of time spent during the handson building of the home. In addition to carpentry programs, Bismarck Public Schools and BSC offer various areas of study that offer careers in the residential home building industry, including electrical, HVAC and welding. Girl Scouts Welcome New Home Buyers

A

s a prelude to Careers in Construction Month in October, BMHBA visited with a local girl Scout troop to visit with youngsters about home building and the many benefits that the many industry trades bring to community. On Sept, 18, BMHBA partnered with the Girl Scouts and the Theo Art School to decorate door mats.

The young ladies learned that there are countless career options in the building trades for men and women alike, and that the industry strengthens communities both financially and socially. In addition to the financial stability that comes with home ownership, studies have shown that home ownership has led to many benefits including increased educational achievement, civic participation, and even improved health. The positive impact that stable housing brings to a community is something to celebrate. In the spirit of the Fall Parade of Homes (POH), the decorated mats were displayed at each participating POH home and will be gifted to first time homebuyers by North Dakota Housing Finance Agency.

NATIONAL DEFENDER OF HOUSING AWARDS PRESENTED The North Dakota Association of Builders is excited to announce the inaugural recipients of the National Association of Home Builders Defender of Housing Awards. Sen. Heidi Heitkamp, Sen. John Hoeven, and Rep. Kevin Cramer all have been chosen to receive this honor in thanks for their support of the housing industry during the 114th Congress. Only 130 of the 535 United States legislators will receive this award for 2016.

The goal of the award is to recognize members of Congress who go above and beyond for the housing industry and to thank our lawmakers for the level of attention paid to home building issues and to our overall industry. Congressional members are nominated for the award by our state and local associations based on a variety of important criteria, including support and leadership on housing issues, as well as accessibility to the NAHB membership.

LEAD PAINT RULE, RENOVATOR TRAINING NAHB filed comprehensive comments with the Environmental Protection Agency (EPA) in September asserting that in its current form, the Lead: Renovation, Repair and Painting rule is an inefficient tool for achieving the environmental and health goals of the underlying issues. NAHB strongly encouraged EPA to perform a new economic analysis because, to date, there has yet to be a lead test kit on the market that qualifies with the rule’s standards.

Additionally, NAHB urged EPA to revise the unnecessarily complex and burdensome new renovator recertification requirements recently finalized by the agency and to ensure that certified renovators be provided the resources they need to comply with the program.

ON-THE-JOB TRAINING FUNDS AVAILABLE Job Service North Dakota has funds to help defray the training costs of hiring young adults, not attending school, between the ages of 18-24. Hiring young adults can present opportunities for you to train employees in the skills you need to meet your business needs. Employers receive a 50% reimbursement of wages for up to six months.

Whether you need an entry level position filled or a recent graduate, On-the-Job Training might be a tool to help you fill your positions.

HERE’S WHAT HAPPENED IN MIAMI Your NAHB Board of Directors had a busy four days in August as they met for the 2016 Midyear Meeting in Miami.

In addition to presentations from Republican presidential candidate Donald Trump and Democratic candidate Hillary Clinton’s economic advisor Gene Sperling, the board listened to economic forecasts and discussed plans to better position NAHB for the future.

NEW DATA AVAILABLE ON FIRE SPRINKLER MANDATES Voting members of the International Code Council will once again consider an amendment to move the requirement to install fire sprinkler systems in one- and two-family homes from the main body of the International Residential Code – where it has been since 2009 – back to the appendix.

It makes a difference because when a requirement is part of the main body, it’s much easier for states, counties and local jurisdictions to adopt it lock, stock and barrel when it comes time to update the building codes. When it’s in the appendix, the jurisdiction has to decide to amend the model code to include the requirement.

That’s not been an issue for fire sprinkler requirements, though. The overwhelming majority of states have decided that installing the systems should be an option, not a mandate, for home buyers. And the overwhelming majority of home buyers have decided that the systems are not worth the additional expense. This set of tables and maps produced by the NAHB Construction, Codes and Standards Department breaks it down: By either the code adoption process or legislative action, 44 states have rejected fire sprinkler requirements. Only two states – California and Maryland – require them for all new one- and two-family homes.

This report updates the report, Home Fire Sprinkler Cost Assessment (Fire Protection Research Foundation 2008). The primary purpose of this study is to review current home fire sprinkler system costs against the 2008 benchmark study to gain a better understanding of how increasingly widespread adoption of sprinkler ordinances impacts system cost. Using a larger sample size, the current study attempts to gain a better understanding of the impact of sprinkler ordinances on home fire sprinkler system cost and other factors that affect system cost. The current study examines 51 homes in 17 communities; the 2008 study examined 30 homes in 10 communities. In the 2013 update, the average cost per sprinklered square foot was $1.35. In the 2008 report, the average cost per sprinklered square foot was $1.61. Residential sprinkler system costs, 2008-2013

Delaware, Colorado, Illinois and Wyoming have not chosen to pursue statewide requirements, although Delaware builders are required to give buyers a cost estimate for sprinklers and install them if the buyer wants.

NAHB ENDORSES CANDIDATES FOR CONGRESS For the first time in its 74-year history, NAHB is officially endorsing candidates for the U.S. House and Senate in the upcoming Nov. 8 elections.

“As housing goes, so goes the economy,” said NAHB Chairman Ed Brady. “This election could determine if the housing and economic recovery stays on track or veers off course. When the 115th Congress convenes in Washington early next year, there will be plenty of unfinished housing business awaiting lawmakers. NAHB believes that Congress must focus on: • Reforming and streamlining the regulatory process.

• Ensuring that any tax reform efforts protect vital housing tax incentives that are needed to keep housing and the economy moving forward. • Easing tight credit conditions for home buyers.

• Enacting comprehensive housing finance reform.

NAHB will be working with its state and local home builders associations to coordinate announcing the endorsements. A full list will be available after all the endorsements have been finalized. NAHB does not endorse candidates for president.


Every new development project whether residential, office or commercial, places added demand for infrastructure and other public facilities such as roads, parks, schools and public transportation.

For much of the 20th century, the burden of paying for the additional infrastructure fell on the public sector, funded by state and local tax collections. Today’s development environment is different as governments routinely shift the burden of new infrastructure costs to the private sector. A series of cases out of Maryland shows just how far some public entities will go to transfer costs to private developers.

An engineering firm found that the District needed to construct a new bypass sewer main to help alleviate the overloading of the old sewer system, as well as provide additional capacity for new development. In 2004, the District decided to build the new bypass main at a cost of $3.2 million.

Around the same time, a handful of developers requested water/sewer allocations to ensure adequate capacity for new development. One of these developers estimated that his build would generate 9,400 gallons of sewage a day, or 0.27% of the 3.5 million gallon capacity of the new bypass. Rather than asking the private developers to pay for

So while existing users of the sewer system were paying less than $2/front foot, some developers were stuck paying thousands of dollars per year to subsidize the entire cost of the bypass. One developer, who requested an allocation in 2004 but ultimately abandoned his project, has been assessed amounts ranging from $18,000 to $20,709 per year between 2008-2015 on land that is currently unimproved. NAHB advances the position that regardless of how the government shifts this burden, it must meet certain constitutional requirements.

From the constitutional perspective, this is referred to as Nollan/Dolan/Koontz analysis, coming from three important Supreme Court cases. These three cases provide the basic principle: There must be a nexus and rough proportionality between government demands and the impact of a development.

For example, the Constitution does not allow a locality to force the builder of a single lot to build a four-lane highway just because of the traffic impact of the single lot. It must be proportional. A number of developers have brought lawsuits claiming that the District’s actions violate constitutional principles. However, the courts in this case have so far agreed with the District, ruling that Nollan/Dolan/Koontz analysis does not apply to front foot benefit charges.

DEVELOPERS PUSH BACK AGAINST BURDENSOME INFRASTRUCTURE COSTS

Despite the steadily increasing demand for housing, residential construction growth continues to be hampered by limited lots, labor and lending. Recent data suggest builder financing conditions are improving, but the larger hurdle of insufficient labor remains.

The volume of AD&C loans for residential construction – which expanded by 16% since the second quarter of 2013 – indicates easing lending conditions. However, the amount of lending is still much lower than in previous years.

In contrast, the most recent count of unfilled construction jobs (214,000) is near the post-recession high of 215,000 set earlier this year. This incessant trend suggests that lack of labor will continue to be a significant supply-side headwind into the foreseeable future.

MAKING ZERO ENERGY EQUAL A PERFECT 10

Z

ero-energy homes, also known as net-zero homes, produce as much energy as they consume on an annual basis, sometimes producing more energy from solar panels, wind power, or other sources. These homes are far from mainstream, but home builders like South Carolina’s Todd Usher, guest writer for this blog post, are leading the race to get them there. At Addison Homes, we’ve always been green – a progressive niche in a mostly conservative market. Our process of continuous improvement has moved us toward ever-deeper shades of efficiency.

So after a dozen years building the most energy-efficient homes in town – including our market’s first home certified by the Department of Energy’s Zero Energy Ready Home program — we decided to go greener still and built the first mainstream zero energy home in Greenville, S.C.

Designed to showcase zero energy as an attractive, attainable option for conventional consumers, this home combines all the smarts of next-generation high-performance with the savvy of stylish simplicity sought by today’s home owners. Call it green builder math: making zero energy equal a perfect 10 on current market trends. Here are a few lessons we learned while mastering this equation.

Base your quality system on best practices. Addison Homes is committed building homes to verifiable national standards: the Environmental Protection Agency’s Energy Star program, Indoor airPLUS and WaterSense labels as well as the Department of Energy’s Zero Energy Ready Home program.

These programs — backed by years of building science expertise — provide wellresearched practices that ensure we meet the promises we make to home owners regarding energy savings, comfort, indoor air quality and durability. These provide a perfect complement to our own internal quality processes and procedures. Build strong partnerships with vendors. In addition to its first-in-Greenville zero energy status, this project is the Southeast’s first Active House-certified home. We’ve benefited from strong partnerships with vendors, many of whom participated, for example, in a predrywall tour we hosted for the local HBA and Sales & Marketing Council. Marketing is a must. There’s always been a niche for extreme efficiency – and our goal is to bring that market to the mainstream by building an appealing example of what’s possible with zero energy.

Education is key: We’ve focused on defining what, exactly, zero energy means, how it works and, most important, how it benefits consumers in terms of monetary savings, health and wellness, and comfort. Signs throughout the model home, for example, highlight products and processes. Our website is populated with information about high-performance building science, including an energy dashboard that allows

visitors to view our solar photovoltaic system in action. In addition, we get the message out via social media channels and our twice-monthly educational newsletter as well as interviews and articles in local news media.

The final lesson is this: The market wants solar homes. Our first zero energy home is the model in a 16-lot subdivision where, as of this writing, all but two home sites have been sold and every client has opted to add solar to their rooftop. What’s more, the project has generated interest in renewable energy from our onyour-lot clients, too. “Build it and they will come,” we like to say – this might be cliché elsewhere, but here in Greenville, we never tire of saying so – and our project certainly proves this is a winning strategy.

Build zero energy and/or zero energy ready and clients will indeed come. We’ve learned that low utility bills are high on home buyers’ wish lists, and our model home shows that zero really is a perfect 10. APARTMENT ABSORPTION RATE REMAINS STABLE By Carmel Ford

NAHB Commends Sen. Wyden’s New Middle-Income Housing Tax Credit NAHB commended Sen. Ron Wyden (D-Ore.) for introducing the MiddleIncome Housing Tax Credit Act of 2016. The legislation builds on the successful Low-Income Housing Tax Credit by creating a new tax credit to spur the development of rental homes affordable to Americans with moderate incomes. The new Middle-Income Housing Tax Credit (MIHTC) would allocate funds to states based on population. State housing authorities would then follow a competitive process to allocate the tax credits to developers for new construction or rehabilitation projects.

Recently released data from the US Census Bureau’s Survey of Market Absorption (SOMA) shows that 54,300 privately financed, non-subsidized rental apartments in buildings with 5 or more units were completed in the first quarter of 2016. Compared to the previous quarter, completions (seasonally adjusted) decreased by 19 percent. However, completions increased by 25 percent yearover-year, from 43,300 in the first quarter of 2015

It is important to note that multifamily starts (structures with 5 or more units) were also down in the first quarter of 2016,

from its peak in the second quarter of 2015. The not seasonally adjusted absorption rate (percent of units rented in 3 months after completion) increased one percentage point to 58 percent in the first quarter of 2016. The absorption rate is slightly down year-over-year from 60 percent in the first quarter of 2015. In the first quarter of 2016, 6,200 subsidized or tax credit-related apartments were completed, which represents approximately 9 percent of total apartment completions. Completions of subsidized apartments and apartments associated with tax credits increased by 27 percent year-over-year.

How Fast Can You Move?

“Sen. Wyden’s plan would help spur the production of much-needed affordable rental housing for working American families,” said NAHB Chairman Ed Brady. “The new MIHTC would serve as a great complement to the Low-Income Housing Tax Credit, which represents the best of public-private partnerships and is the most successful tool for financing affordable housing.” Under Wyden’s bill, rents in MIHTC properties must not exceed 30% of Area Median Gross Income (AMGI). While the Low-Income Housing Tax Credit caps the incomes of those in qualifying projects at 60% of AMGI, the MIHTC would allow households with incomes that fall between 60% and 100% of the AMGI. “Sen. Wyden’s bill would help to revitalize this existing rental housing stock and to keep housing affordable and available for moderate-income households,” said Brady. “We urge the Senate to act quickly to advance this important housing bill.”

NDAB-PAC is excited to promote pro-housing legislative work and is thankful to our members for the impact we are able to make locally and across the state. BUILD-PAC is bipartisan, supporting both Democrats and Republicans who help promote and protect the housing industry’s agenda. During the 2014 election year, BUILD-PAC supported more than 370 pro-housing candidates, and 95% of these candidates won their seats in November.
