Arbitration may settle dispute between city, Waste Pro

Whether the city of Cape Coral has to pay its solid waste vendor $1 5 million in fees retained by the municipality in the w a k e o f c o l l e c t i o n c o m p l a i n t s w i l l b e decided by binding arbitration if Cape Coral City Council approves a proposed memorandum of understanding between the parties Wednesday

The city also assessed administrative charges against Waste Pro in the amount of $80,750 from August 2022 through April

City seeking members for Yacht Club Stakeholder Group

The city of Cape Coral is creating a stakeholder group to help shape the future of the Yacht Club

The group will help determine “which stylistic elements from the existing ballroom will be cons i d e r e d f o r i n c o r p o r a t i o n i n t o t h e n e w building(s)” and will include members of city staff, the city's appointed Youth Council and Cape Coral residents

School Board approves $2.4 billion budget; sets tax rates

The Lee County School Board approved a tentative budget of $2 4 billion for the 2023-24 school year during its first public hearing Monday night

The tentative budget, $2,444,171,374, breaks down to a General Fund of $1,142,749,696 for operations, 47% of the total budget; and a capital budget of $876,893,895, or 36% of total

The remaining components include internal services

3% of the budget total

required local effort millage includes basic required local effort of 3 1640 and a prior period adjustment millage of 018

The tentative proposed basic discretionary millage of 748 mills was also approved

The proposed capital outlay millage of 1 500 was also approved

The total millage will equal 5.43 mills, or $5.43 per $1,000 of taxable assessed property valuation

The total millage is higher than the so-called rollback rate, the rate at which the impact on owner-occupied home would remain flat The increase over the roll back rate is 11 17%

Budget Director Kelly Letcher explained the millage rollback rate is the rate which applies to the current year's tax rolls net adjustments for new growth, which will produce the same dollars as received in the previous year

The calculated roll back rate is 4 8844 mills The proposed rate for the 2023-2024 school year is 5 430 mills, a decrease of 127 mills from the 2022-2023 millage rate of 5 557 mills

"The new millage rate will generate an additional $41 9 million from the previous year because of the increase in the tax roll," Letcher said

The required local effort portion is 59% of the total millage, she said

"One of the things we like to point out is the change in the roll back rate from year to year," Letcher said "The tax roll this year is $145 billion and the required local effort portion is 3 164 We also have a prior period adjustment 018 for a total required local effort of 3 182

We also request that you levy 748 discretionary millage and 1 5 capital mills, which is the total 5 430 mills "

The millage is a negative 127 from previous years

"As the millage rate goes down from year to year, it is because the tax roll goes up As the tax roll goes up the millage rate will go down," Letcher said "We are given the amount for the required local effort from the state and you must levy that in order to participate in the Florida Education Finance Program "

With the millage rate that the district is proposing, if the tax roll was an 8 34% increase, and it was a $100,000 home, that new value is $108,340 Letcher said at last year's rate, the homeowner would have paid $555 70 compared to this year's $588 29, a $32 59 increase in their school tax

Homestead Exemption and Save our Homes only allows for 3% a year for owner-occupied properties So a $100,000 home would have a new value of $103,000 Last year's rate, the homeowner paid $416 78, compared to this year's $423 54, a $6 76 increase

According to the presentation, the required local effort millage of 3 182 would generate $443,197,701 in total

"While that does generate more than it did last year, the required local effort portion, as that goes up, our state funding goes down in the same amount," Letcher said "We will not generate any additional dollars from the required local effort than what the state says we can do through the Florida Education Finance Program "

The basic discretionary millage of 748 would generate $104,183,496 The capital outlay of 1 500 mills would generate $208,924,120 The total millage of 5.430 would raise $756,305,316 from total millage.

The Florida Education Finance Program is $932 million in total revenue with approximately $42 million of t h e t o t a l a n t i c i p a t e d f o r t h e F a m i l y E m p o w e r m e n t Scholarships Letcher said it was a $77 million increase from the previous year and $75 million of that is the increase for the teacher salary increase allocation

Letcher said the district will receive $8,933 per FTE and the base student allocation is $5,139 73, an increase of $552 33 She said they are funded by the state, 42% of the amount

Letcher said the sources of operating revenues is 60 92% local, 38 59% state and 49% federal

The final budget hearing will be held Wednesday, Sept 6, at 5:05 p m , at the School District of Lee County board room, 2855 Colonial Blvd , in Fort Myers

Lee School District continues to tweak media access policies

The School District of Lee County’s new Media Center Access form was further tweaked during Monday's School Board meeting in an effort to get language agreed upon for the start of the new school year

The district came up with two different forms following last week’s board meeting to provide a different option as a default if parents do not sign the form that tells the district what materials a student may have access to and to which they may not

The board gave consensus for the second form, which states, “My child has full access to check out books from the school media center except for those books that have been restricted based upon the determination of the book challenge process or those that require parent/guardian consent ”

Superintendent Dr Christopher Bernier said as soon as a parent clarifies their desire for their child, if different, they can change the option

“The board is acting in a manner and means until we have a parent signature on a document, the board is acting as ‘loco parentis’ assuming the child is not permitted to check out certain books,” he said

Board member Cathleen Morgan said with the second option the board is overriding the recommendation of the curriculum advisory committee

“With form B you are telling the student that the district is acting on their behalf and you are again overriding com-

munity input after a book has been evaluated,” she said “I think these forms are not accomplishing really what we want to do of educating the parents ”

In addition, Morgan said the form also includes the word “challenged” too much She said she would like to see the form changed to something along the lines of “Your child will have access to media center materials except for those books that have been restricted, or those that require parent, or guardian, consent ”

Morgan said the concern is the child who wants access to a book that has been reviewed and found appropriate for his, or her age.

“Why are we saying we are acting on that child’s behalf on accessing that book?” she said “I don’t think that is our responsibility That is not the authority we have been given ”

Morgan said she would start from the point of frequently asked questions about books children are reading First it would include “Can I restrict my child’s access to a book or author?” If yes, she said you can put that book in the Destiny system Another question would be “If I read a book in the media center that contains information a parent does not think is suitable for their child, how do they ask the school to remove the book?” The last would highlight information on how the parent can sign a form that now has limited access for their child

Storm-damaged Bailey’s Shopping Center on Sanibel torn down with plans for rebuilding in the pipeline

After sustaining heavy damages in Hurricane Ian and with a project in the works before the storm to renovate and redesign the plaza the Bailey's Shopping Center on Sanibel was recently demolished

On July 21, work started on tearing down the entirety of the buildings at the center, excluding the historic service station, which has been preserved It only took a couple of days to complete the task

“We are working on the foundation and that is quite an intensive process,” fourth-generation owner and operator Calli Johnson said last week, noting that it will take about a month to remove the rubble piles

“We don't know if the parking lot is going to be taken up,” she added “We're waiting to find that out ”

During the demolition, workers uncovered a wall from the old store with the words “Since 1899 ”

“People with long memories will remember that Bailey's center and Bailey's General Store faced Periwinkle (Way),” Johnson said, explaining that her family expanded upon the building over time and eventually the store's front ended up facing Tarpon Bay Road “It was just a neat piece of history ”

The damages from Ian were primarily the result of flooding and storm surge, plus wind-driven rains

“We had 6 feet of standing water in the store, as well as major roof penetration that damaged large areas of the store,” she said, noting that there was also lesser damage, such as broken windows

“The storm surge waters were so powerful that they actu ally b lew th e h u r r ican e- r ated f r o n t d o o r s o p en , ” Johnson added “When we arrived to secure the building, all of the entrances to the building on the front side were open ”

She explained that it showed how powerful Ian was

“The most important thing about the storm damage as a takeaway is nobody was prepared for the amount of water that came over the island,” Johnson said

Frank P Bailey founded the Sanibel Packing Company, now known as Bailey's General Store, as a packing and shipping facility for agricultural products in 1899 It was located on Matthews' wharf at the end of what is now Bailey Road, where the ferry arrived and departed with people, vehicles and items When a hurricane in the 1920s destroyed the store, Bailey's rebuilt next to the San Carlos Bay

When the store outgrew itself, Bailey's moved to its current location at the end of Periwinkle and the corner of Tarpon Bay, at the helm of second-generation owners-operators Francis and Sam Bailey The business continued to grow and it is now stewarded by third- and fourth-generation owners-operators

Johnson explained that her family and their store have been a cornerstone of the community for over a century and that before Ian, the building at the center had served the islands for more than 60 years

“We understand the profound sadness that this causes for the community,” she said of the structure being torn down, noting that her family and their employees also love Bailey's and feel the same

“It's really hard for a lot of people to see,” Johnson added

The community is invited to stop by Those who do are asked to follow safety precautions

“We welcome everyone who wants to come say goodbye to the Bailey's center as it was,” she said Viewing will only be available from the city's Shared

Use Path. As the center is a construction zone, it will not available for public access Be aware of the large trucks and equipment and exercise caution

“Please stay safe,” Johnson said

As for the future of Bailey's and reconstruction of the center, a project approved by the city about a year before the hurricane was designed around redeveloping but preserving the existing building

“The project that was planned before the storm has completely been scratched,” she said

Some aspects of the original design have been retained, while new elements are being proposed

“We are going to elevate all of the building, except for the service station which is staying where it is,” Johnson said, explaining that the elevation is a post-Ian proposed change “It'll be at least 10 feet ”

No longer working off the existing building, they could also pick the location for the front

“The front doors will be facing the corner of Periwinkle and Tarpon Bay,” she said

Tenant spaces will be available

“The tenant spaces will more easily flank the center store,” Johnson said “We have that lake in the back and we're hoping to make that more of a focal point for at least some of the new tenants ”

The outparcel restaurant will also be retained.

“That will be rebuilt as well and elevated, but not as much as the main center,” she said “Everybody really enjoyed having the restaurant on the corner right there, so we're looking to offer that again ”

The promenade from the restaurant to the center and porte-cochère in the original plan remain

“Our guests are going to look forward to shopping with us going up an elevator,” Johnson added of additional changes in the revised design “There will be parking underneath parts of the center ”

Green features in the original plan have also been carried over

“All of our equipment in the store will be state-of-theart, which will add efficiency to our operations,” she said, noting that they will reinstall the solar panels and even expand on the project “We rescued the solar panels from the solar farm on the roof ”

With a new plan and design, the project must go through the process all over again with the city, including consideration by the Sanibel Planning Commission and Sanibel City Council Johnson noted that they expect to submit the revised project to city staff for their review within the next month

“If the planning portion of this goes smoothly,” she said of input from staff, followed by green lights from the commission and council “We would expect to break ground in late 2023 or early 2024 ”

Johnson acknowledged that there were some concerns with their original plan

“People are concerned we're going to lose our charm,” she said “The building will be different, new, nice looking, but we're going to retain our history and our charm, as well as our commitment to quality products and service ”

“We're grateful for the support of the community through this,” Johnson added

While Bailey's undergoes the rebuild, the family continues to operate its store on Captiva

“We miss everyone, and we're doing our best to serve folks at The Island Store,” she said

Johnson noted that they have expanded the store's offerings post-storm to better serve the islands

“But we can't wait to be back at Bailey's,” she said of the full-service grocery and hardware store

Since the hurricane, Bailey's has also launched an online store

“If you can't wait to get back, we have some items to tide you over,” Johnson said

Public meeting to discuss future of Lee Civic Center complex Aug. 17

Lee County Parks & Recreation will host a drop-in style public meeting regarding the Civic Center complex from 6-8 p m Thursday, Aug 17, at the North Fort Myers Recreation Center, 2000 North Recreation Park Way, North Fort Myers

A public survey was created in March to garner public input on long-term options for the Lee County Civic Center complex The public meeting will give residents the opportunity to view the survey results and help give input on the future of the complex

BoatUS Foundation offers tips for dealing with the heat while out on the water

As the country continues to bake under record high temperatures, boaters often head to the water for respite However, some may be unprepared for what it takes to withstand a high-heat day Here are five tips from the nonprofit BoatUS Foundation for Boating Safety and Clean Water that can help ensure everyone’s safety as temperatures climb

1. Create shade. Direct sunlight can make the air feel 10- to 15 degrees warmer Reduce the time you spend in it If you don’t have a cabin or bimini top that offers sun protection, wide-brimmed hats; loose fitting, moisture-wicking clothing (try a UPFrated long sleeve shirt); or fishing neck gaiters are next best Of course, reef-friendly sunblock is a must for burn prevention

Have a way to communicate If you have an unexpected breakdown or other issue, this is not the time of year to be stuck out on the water Not only is the temperature a significant stressor, atmospheric conditions, especially in the afternoon hours, can bring sudden and powerful storms Ensure your VHF is operational, and bring your cellphone, keeping it dry and charged

County: repairs to athletic field lighting to begin, youth games to start by November

Repairs to the athletic field lighting at Lee County Parks & Recreation sites will begin this month in an effort to minimize impacts to youth leagues later this fall. According to county officials, most repairs will be completed by Nov 5, when the clocks fall back to Eastern Standard Time Lee County will use a combination of its own staff and outside vendors to complete the work in order to minimize the impact to youth sports leagues following the time change

Lee GOP calls for creation of a State Sovereign Bank

The Lee County GOP is calling for the creation of a State Sovereign Bank of Florida

The resolution passed at the organization's with “an overwhelming majority,” and calls on Gov Ron DeSantis to call a Special Legislative Session for the purposes of setting up the entity

“This proposed central bank would be run by the State of Florida, not the Federal Government, and would ensure a viable pushback against Central Bank Digital Currencies (CBDC). CBDCs are proposed digital currencies that would be tracked and controlled by the Federal Reserve and could potentially be used to eliminate cash altogether,” a release issued last week by the Lee GOP

“Governor Ron DeSantis has already taken actions forbidding the use of CDBCs by signing HB 7049 The proposed State Sovereign Bank would be an additional measure to protect Floridians from an overpowered central banking system ”

Whereas, Governor DeSantis has signed HB7049 into law forbidding the use of CBDC - Central Bank Digital Currency in the State of Florida; and

Whereas, the FedNow system has already instituted a 24 hour a day 7 day a week system for commercial transactions (at the present time) allowing for rapid consolidation of the banking industry; and

Whereas, the goal of establishing a Central Bank

“This proposed central bank would be run by the State of Florida, not the Federal Government, and would ensure a viable pushback against Central Bank Digital Currencies (CBDC) ”

Digital Currency (CBDC) is ultimately to eliminate all brick and mortar banks and to grant sole authority for the issuance of Central Band Digital Currency (CBDC)to the Federal Reserve Bank, to totally eliminate the use of physical cash and to eradicate competition in the banking industry; and

Whereas, Governor DeSantis is already working with an alliance of 18 States against the Biden administration’s most recent attempt through implementation of Central Bank Digital Currency (CBDC) to backdoor woke ideology of Environmental, Social and Governance into the United States’ financial system

Whereas, Treasury Secretary Yellen, the FDIC and Federal Reserve rescued uninsured depositors in large institutions which were deemed “too big to fail” and offered no assurance that they will similarly protect banks operating under sound banking principles; and Whereas, the inevitable devastation of banking systems facilitates a centralized control of money, decimates com-

petition, promotes federal monetary tyranny, the subsequent introduction of the FedNow system already is accelerating consolidation and erosion of our banking industry, we believe these proposals require immediate action

Be it Further Resolved:

The Lee County Republican Party calls upon Governor Ron DeSantis to convene a special session of the Florida Legislature (which the State of Tennessee has already called) to formally investigate the establishment of a Sovereign State Chartered Bank backed by the Sovereign State of Florida which could be set up to act as a backstop standing behind all State banks, facilitating the establishment of productive, profitable community banks, and acting as depository for gold and silver We propose that this depository provide a means to allow daily transactions in gold and silver to provide concrete alternatives to Central Bank Digital Currency (CBDC)

We respectfully request that Governor DeSantis consider a ban on the FedNow system or any other Federal Reserve instituted and controlled digital currency in the State of Florida, to protect publically traded banks from any further consolidation by predatory banks
