Lessons in Grit

“Excellence is never an accident. It is always the result of high intention, sincere effort, and intelligent execution; it represents the wise choice of many alternatives - choice, not chance, determines your destiny.” -Aristotle (quoted by Freeman Hrabowski III) When I received an invitation to attend the investiture of the sixth president of California State Polytechnic University, Pomona I was excited to attend. The investiture ceremony is a centuries old ritual steeped in tradition at which honors or ranks are conferred. This ceremony was to formally install into the Office of the President Dr. Soraya Coley, the first woman and first African-American to hold the position. Freeman Hrabowski III, the dynamic keynote speaker, president of the University of Maryland, Baltimore County and one of Time Magazine’s Most Influential People in the World, captured my attention from the moment he stood at the podium and quoted from memory a passage from Zora Neale Hurston, one of my favorite literary figures. Known as one of America’s most important educators, he reminded us that our work as educators is one of continuous learning, “Don’t ask what did you learn today. Ask did you ask a good question today?” Education is not about intelligence, he said, it’s instead about three things: 1. Curiosity 2. Continuous Learning 3. And Grit Grit...Mary McLeod Bethune, another historic college president had it, Hrabowski explained, as he described Ms. Bethune’s unwavering determination and commitment to her vision. After moving to Florida in 1904, Ms. Bethune was determined to start a school for girls. She made benches and desks from discarded crates, acquired other items through charity, and used $1.50 to start the Literary and Industrial Training School for Negro Girls. Bethune, the parents of students, and church members raised money by making and selling sweet potato pies, ice cream, and fried fish. The students made ink for pens from elderberry juice, and pencils from burned wood splinters; they asked local businesses for furniture. Bethune wrote later, “I considered cash money as the smallest part of my resources. I had faith in a loving God, faith in myself, and a desire to serve.” The school received donations of money, equipment, and labor from local churches. Within a year, Bethune was teaching more than 30 girls at the school. Later, that school became Bethune-Cookman University and she served as its first president. Over 100 years later the school continues to educate and graduate eager young people. Ms. Bethune’s story is a lesson in grit and so is Dr. Soraya Coley’s, a woman who was born in rural pre- civil rights North Carolina, where the messages she received in the segregated south were counter to the messages of hope and success she heard from her family and close-knit community. After earning a bachelor’s degree in sociology from Lincoln University and master’s from Bryn Mawr College’s School of Social Work and Social continued on page 8

Community to Celebrate Riverside’s Legacy at the 37th Annual Black History Parade, Expo and Car Show S. E. Williams Staff Writer housands of local residents are expected to line the streets of downtown Riverside when the 37th Annual Riverside Black History Parade, Expo and Car Show kicks off Saturday, Feb. 13 starting at 10 a.m. The theme this year, “Riverside’s Legacy” will highlight the rich and proud heritage of the city. Traditionally, parade-goers line up along the route excitedly waving and cheering on the procession, which is led by government and city officials riding in emergency vehicles followed by local high school drill teams, vintage cars, and other parade vehicles. Distinct automobiles from several local car clubs will be showcased, including Cochér Car Club, The Ultimate Riders, and 12-15 Euro cars. Also joining the line-up of classic cars this year is Hispanic car club “Bomb Life”. Kids will

Flu, Hantavirus and Zika

T

he Riverside County Department of Public Health has confirmed the county’s first flu-related death this season. Although there were 26 flu related deaths in Riverside County last year, current levels are normal. Officials, uncertain whether the victim received a flu vaccination, stressed vaccinations are the best way to avoid the illness. It also reminded how important it is to wash hands frequently and cover coughs and sneezes. Flu is not the only illness of concern this year. The Department recently confirmed mice collected in Beaumont tested positive for the deadly Hantavirus. It warned residents to be cautious in places rodents are known to inhabit as it is transmitted through rodent feces and urine. The virus can cause a potentially fatal respiratory infection. Experts are also paying close attention to the Zika Virus recently declared a global emergency by the World Health Organization. The virus is spreading rapidly and suspected of causing a serious birth defect— microcephaly. Babies born with microcephaly have unusually small heads and many also present with damaged brains. The birth defect has exploded in Latin American, particularly Brazil, concurrent with the spread of the Zika Virus. Last week, the Center for Disease Control confirmed the virus is not only spread by infected mosquitoes—it can also be transmitted sexually. The first case of sexual transmission recently occurred in Texas. There are confirmed cases of the virus in the U.S. including here in California—most involve recent foreign travel. Symptoms of the virus are similar to the flu. The Red Cross has implemented a 28-day-self-deferral requirement for blood donors who recently traveled to highly impacted countries. If someone develops symptoms of the virus within 14 days of donation, he/ she should notify the Red Cross immediately.

Congresswoman Maxine Waters to Give Opening Remarks in Support of Local Aspiring Student Photojournalists

Highlighted in Installation Featuring Works by Legendary Historical Chronicler Donald Cravens Palm Springs

C

ongresswoman Maxine Waters, will give opening remarks at a special reception for The Bridging Communities “Hallowed Grounds of African American Heritage” exhibit on Sunday, February 14, 2016 from 3:30-5:00 p.m. at the Palm Springs Art Museum, 101 Museum Drive, Palm Springs, CA. The exhibit addresses the evolving nature of photojournalist documentation of the American Civil Rights movement. Highlighting periods from the 1960’s Civil Rights era through to the contemporary Black Lives Matter movement, the display captures the impact of these life-changing events on the present social condition of Coachella Valley youth and delivers a response through their eyes. Intertwined with selected works of legendary photographer and historian Donald Cravens, the display will chronicle and give continuity to the fruits of the Civil Rights legacy through the eyes of photojournalists. Participating students, mentored by local cultural photojournalist and humanitarian Alfonso Murray, were selected from Palm Springs High School and the Palm Desert Africentric Rites of Passage Program. “I sought to align student’s goals with a purposeful social mission using photo essay,” says Murray, “I wanted to not only bring key social issues to light but to also make steps towards changing the environment around them.” Murray, whose personal photographic essay, “Justice for Trayvon Martin: A National Day of Action” is also included in the exhibit. Student photographic essays include “Black Youth Homelessness–A Silent Epidemic,” Lonnie Johnson; “My Stepfather Has Gifted Hands,” Andy G Villatero; “My Mother’s Journey with Lupus,” Kianna Escobedo; “Mentor Me–A Brotherhood Collaborative”, Rian Rollins; and, “Building Resilience in African American Families Africentric Rites of Passage”, Bryce Taylor.

SCE Says, “Secure Your Metallic Balloons” Rosemead

L

ast year there was an all time high of 924 power outages caused by free-floating metallic balloons. This surpassed a previous high of 714 in 2012. This Valentine’s Day, Southern California Edison (SCE) has urged customers to assure their balloons are tied to a weight as required by California law. Balloons should never be released outdoors because thousands of customers can be left without power when metallic balloons float into power lines and other electrical equipment— serious injuries and property damage can occur. At times, when contact with metallic balloons is severe enough it can bring down power lines. This happened at least 96 times last year. “Metallic balloons look harmless, but there’s no way to overstate how dangerous they can be when released outside,” said Paul Jeske, SCE Director of Corporate Health and Safety.

“Merchants should always ensure that balloons are property weighted and remind their customers to never release them outdoors.” SCE officials warn to avoid danger, never attempt to retrieve a balloon or any object you see tangled in power lines or inside a substation. Instead, call SCE at 800-611-1911 and report the problem. Also, never tie a metallic balloon to a child’s wrist—if the balloon contacts electricity, like a drop-line to a home, it can travel through the balloon and into the child, causing injury or death. Never attach streamers to balloons, latex or metallic. And, when you are finished with balloons, do not release them; instead, puncture them or cut the knot and throw them in the garbage—do not let them float away. If you see a downed line or dangling wire (even if it looks dead), never touch or approach it or anything touching it—call 911 immediately. More information is available at on.sce.com/ staysafe.

Preventing Childhood Obesity Dear Dr. Levister: Obesity among Black girls and boys continues to rise. What can I do as a parent or guardian to help prevent childhood overweight and obesity? To help your child maintain a healthy weight, balance the calories your child consumes from foods and beverages with the calories your child uses through physical activity and normal growth. Since the mid-1970s, the number of overweight black boys over the age of six has tripled. And today, one out of four black girls over the age of six is overweight. The ChildTrends Data Bank describes the consequences: Children who are overweight are at an increased risk of developing type 2 diabetes, cardiovascular problems, orthopedic abnormalities, gout, arthritis, and skin problems. Childhood obesity has been linked to the premature onset of puberty. In addition, being overweight can negatively affect children’s social and p s y c h o l o g i c a l development. A recent study found bullying a n d obesity i n children to be positively correlated, with physical a c t i v i t y

Children and adolescents who are overweight are at risk for becoming overweight adults. Overweight adults face many problems due to their weight, such as decreased productivity, social stigmatization, high health care costs, and premature death. In addition, overweight adults are at increased risk for type 2 diabetes, coronary heart disease, elevated blood pressure, stroke, respiratory problems, gallbladder disease, osteoarthritis, sleep apnea, and some types of cancer. Remember that the goal for overweight and obese children and teens is to reduce the rate of weight gain while allowing normal growth and development. Children and teens should NOT be placed on a weight reduction diet without the consultation of a health care provider. One part of balancing calories is to eat foods that provide adequate nutrition and an appropriate number of calories. You can help children learn to be aware of what they eat by developing healthy eating habits, looking for ways to make favorite d i s h e s healthier, and reducing calorie-rich temptations.

Where Do We Go From Here?

ongratulations are in order to Bessine Littlefield-Richard, the newly elected council member representing the citizens of San Bernardino’s 6th Ward. She was able to tap into that “homegrown on the west side” advantage that none of her opponents could overcome. I understand she is a fast learner who will represent us well and be a good voice on the council. Now that the election is over she will need the entire community to help her with her responsibility to govern and meet the needs of her constituents, which is not easy. Again I say congratulations and wish her well on this new journey. After each election I always ask myself the question: where do we go from here? It is the question Dr. Martin Luther King asked during the height of the civil rights movement, along with the sub-question: will it be chaos or community? He wanted us to think about which road we wanted to travel. It was a good question then and is a good question now especially in San Bernardino. I must admit it is not that dire a situation in San Bernardino, but it is a question we must consider with the city still in bankruptcy and a slow financial recovery for the region. The

city is not only recovering from its financial woes but from a string of recent scandals on the council as well as a recent recall election. In the sixth and seventh wards the new council member Bessine Littlefield-Richard and re-elected member Jim Mulvihill will have to bring their community together and will need everyone’s help to make that happen. They will also have to lead the city on the issues Bessine LittlefieldRichard of whether to adopt a new charter or not and how to create a business friendly climate in order to produce jobs. From my experience jobs do not create jobs but businesses create jobs and hire people. If that is to happen then we also have to educate our people and give them the tools and skills required to build businesses as well as to

the California State University system where she worked her way through the administrative ranks to president. “The Impossible Made Possible,” Dr. Coley’s chosen investiture theme, spoke to the nature of her journey from the rural segregated south to the leadership of one of the few polytechnic institutions in the country. “My journey compels me to keep the doors open for all who aspire to enter, regardless of background and circumstances, she said during her address, “Far too many live in the state of impossibility.”

Research, Dr. Coley worked as a research assistant for the Child Welfare League of America and served as the national director of the Child Abuse Prevention Project at the National Urban League. She later held positions at Lincoln University and Bryn Mawr before working at Mathematica Policy Research in Princeton, New Jersey. While commuting from New York and working, she also earned a doctorate in social planning and policy from Bryn Mawr’s School of Social Work and Social Research before joining

Long after the ceremony was over, the concept of “grit” lingered in my thoughts, especially the fortitude it takes to maintain a high level of determination and motivation over long periods of time despite experience with failure and adversity. A true lesson to learn during the month we have chosen to honor the history, legacy, and contributions of Black Americans like Dr. Soraya Coley. Leading the March towards Criminal Justice “Each of us is more than the worst thing we’ve ever done. ryan Stevenson’s inspiring and best-selling book Just Mercy shares some of the fruits of his lifelong fight to push our nation closer to true justice. In January our nation took two more steps forward in the ongoing struggle to treat children like children and ensure a fairer justice system for all, especially for our poor and those of color. In 2012 Bryan Stevenson won the landmark United States Supreme Court case Miller v. Alabama banning mandatory sentences of life in prison without parole for children 17-yearsold and younger. Until then the United States was the only country in the world that routinely condemned children convicted of crimes as young as 13 and 14 to die in prison. After that ruling most states that had sentenced youths to mandatory life sentences gave them the opportunity to argue for reduced sentences or apply for parole. Seven did not: Alabama, Colorado, Louisiana, Michigan, Minnesota, Montana and Pennsylvania. Three of these, Pennsylvania, Louisiana, and Michigan, accounted for more than 1,100 of the 1,200-1,500 inmates still imprisoned for crimes committed as children. A January 25 U.S. Supreme Court ruling in Montgomery v. Louisiana made clear that the Miller decision must be applied retroactively in every state. Supreme Court Justice Anthony

Kennedy wrote in the decision, “The opportunity for release will be afforded to those who demonstrate the truth of Miller’s central intuition — that children who commit even heinous crimes are capable of change.” One of Bryan Stevenson’s searing stories in Just Mercy is about a child sentenced to life in prison without parole. Ian Manuel pled guilty to armed robbery and attempted murder for a crime he committed with two older boys when he was thirteen. He was incarcerated at Apalachee Correctional Institution in Florida, an adult prison, and sent to solitary confinement: “Solitary confinement at Apalachee means living in a concrete box the size of a walk-in closet . . . If you shout or scream, your time in solitary is extended; if you hurt yourself by refusing to eat or mutilating your body, your time in solitary is extended . . . In solitary Ian became a self-described ‘cutter’; he would take anything sharp on his food tray to cut his wrists and arms just to watch himself bleed. His mental health unraveled, and he attempted suicide several times. Each time he hurt himself or acted out, his time in isolation was extended. Ian spent 18 years in uninterrupted solitary confinement”—despite calls from even his victim about his inhumane confinement. Tragically Ian Manuel’s story is not unique. The same day the U.S. Supreme Court decided Montgomery v. Louisiana, President Obama announced a ban on solitary confinement in the federal prison system for all children and youths, and for adults incarcerated for “low-level infractions” in an executive action that should serve as a model for all states and local jurisdictions. The President wrote solitary confinement “has been linked to depression, alienation, withdrawal, a reduced ability to interact with others and the potential for violent behavior. Some studies indicate that it can worsen existing mental illnesses and even trigger new ones. Prisoners in solitary are more likely to commit suicide, especially juveniles and people with mental illnesses. The United States is a nation of second chances, but the experience of solitary confinement too often undercuts that second

chance. . . . In America, we believe in redemption. We believe, in the words of Pope Francis, that ‘every human person is endowed with an inalienable dignity, and society can only benefit from the rehabilitation of those convicted of crimes.’ We believe that when people make Marian Wright Edelman mistakes, they deserve President, Children’s the opportunity to Defense Fund remake their lives. And if we can give them the hope of a better future, and a way to get back on their feet, then we will leave our children with a country that is safer, stronger and worthy of our highest ideals.” Reaching that vision of America—the one that believes in redemption and hope and equal justice for all—is the goal Bryan Stevenson has been striving for throughout his life. His critical victories over 30 years exonerating innocent death row prisoners and helping ensure fairer treatment for others, along with his earlier success before the U.S. Supreme Court in Roper v. Simmons that banned the execution of children have convinced him you cannot make a difference and create justice until you get close to the people who are struggling. He has said, “All of my clients are broken. They’ve been broken by poverty. They’ve been broken by racism. They’ve been broken by inequality. They’ve been broken by injustice. . . . When you’re broken you need grace. When you’re broken you need love. When you’re broken you need fellowship. When you’re broken you need understanding. When you’re broken you need vision.” Bryan Stevenson is unwavering in that vision and in lifting his voice of great moral clarity at the forefront of the struggle. Every new hardearned and overdue victory should remind us all that we must keep moving towards greater justice for all.

$754 Million Cut to State Transportation Projects Will Impact the Inland Empire S. E. Williams Contributor

I

n January, the California Transportation Commission was forced to make major cuts to a number of transportation projects due to significant budget shortfalls—the result of falling gas prices. Cuts will affect transportation projects across the state including anticipated highway improvements in the Inland Empire. A total of $754 million will be unceremoniously carved from the STIP budget over a five year period. These are the most significant cuts to the STIP budget in nearly twenty years. The State Transportation Improvement Program or STIP is a five-year plan adopted by the California Transportation Commission (CTC). The plan considers future allocations of certain state transportation funds for improvements to state highways, intercity rail as well as regional highway and transit improvements. State law requires the CTC to update the STIP twice a year in even numbered years. In a press release that announced the cut, CTC explained they were driven to do this by drops in the price of gasoline. The natural outgrowth

of gas price reductions is a loss of the gas tax revenue directly tied to the price of gas. In 2015, the state’s gas tax fell from 18 cents a gallon to 12 cents a gallon. The CTC anticipates a further drop of approximately two cents per gallon sometime this summer. Every penny drop in California’s gasoline tax carves $140 million from the CTC budget. State and local transportation projects are impacted as a result. Transportation experts are concerned. As the price of gasoline continues to fall and consumers become even more dependent on vehicles powered by alternative energy, the state must rethink its strategy regarding how to generate the funding needed to maintain the state’s infrastructure. CTC officials agree the state’s gasoline tax has become a far less dependable source of funding. With this major cut, the CTC threw down the gauntlet in its challenge to the state to design an alternative that will generate the funding needed for the agency to do its job. It has called upon Governor Brown and the

state’s legislature to accelerate their efforts to identify an alternative revenue stream— the state’s highways and roadways must be maintained. There is no question falling gasoline prices are good for California consumers as is having safe highways in good repair, to not only allow for the movement of people but goods and services as well. And yet, there is another element to this critical equation—jobs. It is estimated that for every one billion dollars the state spends on highway and roadway repairs somewhere between 13,000 and 15,000 new jobs are created. This makes the issue of transportation funding even more impactful to the overall economic viability of the state. Last year, Governor Jerry Brown requested a special legislative session to consider transportation funding. His current budget proposal includes $36 billion for transportation spending in the coming decade. These dollars will be partly funded by an annual vehicle fee of $65. State legislators are considering a number of options to close the chasm that exists between the ever growing need for transportation maintenance and a shrinking revenue stream made worse by falling gas prices. Their ideas include higher taxes, the introduction of new fees, and an innovative proposal that shifts away from a gasoline tax to a tax based on the number of miles driven. As a matter of fact, Caltrans recently issued a call for volunteers to participate in a mileage tracking study designed to help prove-in the viability of such a proposal— for additional information regarding this project visit dot.ca.gov/road_charge/. As might be expected, conservative legislators in Sacramento are opposed to any new taxes. Of course, any tax proposal requires a two-thirds

vote of approval. At this point, that level of cooperation from Republican legislators seems unlikely. A compromise solution is needed in short order to give the state’s highways and roadways the attention they demand. On January 27, the CTC sent a letter to state legislators explaining its fiscal dilemma titled “State Transportation Funding Crisis Continues to Worsen”. In its letter the commission strongly urged legislators to work together to develop a compromise that will yield a significant down payment on the state’s transportation infrastructure needs and provide for meaningful reforms to its transportation program. Announced CTC project cuts will impact the Inland Empire. In Riverside County it affects the French Valley Parkway Interchange Project along State Highway 15 in Temecula; Truck Climb and Descend truck lane lines along the “Badlands” segment of State Highway 60; and Phase 1 of the CV Link between Palm Springs and Coachella (CV Link is a 50-mile bicycle, pedestrian, and low-speed (up to 25 mph) electric vehicle pathway along the Whitewater River from Palm Springs to Coachella. The list for San Bernardino County includes the expansion of HOV lanes between Haven Avenue and Ford Street on State Highway 10; widening of the 210 Freeway between Highland Avenue and San Bernardino Avenue; Phase 1 of a 4-lane expressway at Kramer Junction on State Highway 58; improvements to the interchange on the 215 Freeway at Mt. Vernon and Washington Street; and finally, reconstruction of the Barton Rd. interchange also on the 215 Freeway. California’s transportation concerns have reached a near crisis level. As such, this is not the first time CTC raised these concerns to state officials. In its 2015 Annual Report, CTC

recommended the legislature approve additional funding to support the state’s transportation program. January’s letter was intended to be a stark reminder of the magnitude of CTC funding shortfalls and the urgent need to respond to the criticality of the concern. The agency stressed, “We have underinvested in our transportation infrastructure for the past several decades and have failed to fund needed repairs to an aging and failing system that we rely on to move people and goods in this state.” The commission further advised— the state has little capacity to pay for necessary road, transit and rail improvements required to meet the demands of a growing population and an expanding economy. In addition to the Governor’s budget proposal there are in fact, two comprehensive transportation bills pending in the state legislature. Each would provide more revenue and implement serious program reforms. Now, the governor and sponsors of the legislative initiatives must seek a compromise in order to gain approval of a package that will begin to address the state’s crumbling infrastructure needs. In its January correspondence, the California Transportation Commission summed up its concerns, recommendations, actions and expectations with the following closing statement, “Failure to act and to act quickly will have serious consequences for the future of California.” Without an effective and timely solution to this crisis state infrastructure will continue to crumble while much needed projects may experience years of delay. A lack of new revenue source(s) for the CTC will strangle the state’s ability to add roads, rail lines and public transit. The Voice will continue to follow this story.

Landmark Disclosure Bill Passes State Assembly Sacramento

T

he State Assembly has moved California one step closer to enacting the nation’s most comprehensive election disclosure law with the recent passage of AB700. Assembly Bill 700, the California Disclose Act, requires all non-candidate campaign committees to clearly and prominently disclose the identity of their top three true funders on their campaign advertisements. Under AB 700, all ballot measure committees and Political Action Committees (PACs) supporting or opposing candidates will be required to display the names of their top 3 true funders on a solid black background on the bottom third of the screen for a full 5 seconds in television and video ads. Each name must be displayed on a separate line in a large clear font without using difficult to read full capitalization. Similar disclosure rules will exist for radio, print and online ads, and robocalls. The California Disclose Act creates new rules for earmarking and tracking of contributions to committees in order to identify true funders who hide behind shell groups with misleading names. Advocates believe the measure will go a long way toward shining a bright light on dark money that continues to flood political campaigns and tilt them in favor of the wealthy and/or special interest groups.

Ben Jealous Endorses Democratic Candidate Bernie Sanders

ormer NAACP Chairman Ben Jealous has given a strong endorsement to Democratic presidential candidate, Senator Bernie Sanders. The Jealous endorsement could boost Sanders’ standing with the African American community and help give Hillary Clinton a run for her money with black voters in the primary. Sanders has continued to gain steam Ben Jealous among white progressives but has had some difficulty breaking through to black voters. The Jealous endorsement should help as the civil rights leader remains very popular in the African American community. Jealous, a Senior Fellow at the Center for American Progress was president and CEO of the NAACP for five years beginning in 2008. With his endorsement, Jealous joins a number of other prominent African Americans who also endorsed Sanders. In addition to support law makers in the critical primary state of South Carolina, included among them are professor, author and activists Dr. Cornel West, rapper Killer Mike, and former Ohio State Senator Nina Turner. As an independent Senator from Vermont, Sanders has always caucused with Senate Democrats and is a self-described DemocraticSocialist. A major part of his platform is focused on criminal justice reform. He is also a strong advocate of Medicare for all, strengthening Wall Street regulations, free college tuition and a host of other issues important to the progressive movement.

alifornia Democrats will come together February 26-28, 2016 in San Jose, California for their state-wide convention. U.S. Senator Barbara Boxer and former U.S. Labor Secretary Robert Reich are scheduled to address more than 3,000 attendees at this year’s convention. Sen. Boxer, who is retiring from the Senate after 24 years, will address attendees during general session on Saturday, February 27. Secretary Reich will be the featured speaker at the California Democratic Party Dinner on Saturday night. The delegates and observers will also have opportunities to hear from statewide, congressional and legislative leaders in addition to other invited speakers.

CalEITC4Me—Don’t Let Your Earned Income Tax Credit Go Unclaimed S.E. Williams Contributor undreds of thousands of Californians who did not make much money last year should still file state and federal income tax returns—many may be eligible for a refund. For the first time this year, California has joined the federal government in offering an Earned Income Tax Credit—a cash-back tax credit for low and moderate-income working individuals and families. Many of these residents may not be required to file, but may be eligible for a refund due to the Earned Income Tax Credit. CalEITC4Me is encouraging all Californians who worked in 2015 to file both state and federal returns. W-2 and self reported income is eligible for the federal EITC, but only W-2 income is eligible for the CalEITC at this time. According to the California Franchise Tax Board and the Internal Revenue Service, each year millions of dollars go unclaimed because hundreds of thousands of eligible citizens fail to file a return to claim their refunds. Many fail to file because they b e l i e v e they made too little, even though taxes were withheld from whatever wages they did earn. In other instances they may have made estimated tax payments and possibly overpaid. In addition, there are those who possibly delayed filing because there is no penalty for failing to file when you

do not owe any taxes. To get a sense of how often this can occur consider the 2011 tax year—California had more unclaimed federal income tax returns than any other state in the nation. Even if you did not make much money last year, you may still be able to claim the state and/or the federal Earned Income Tax Credit. The only way to get this cash back tax credit is to file your tax returns. It is also important to know that if you earned income in recent years but failed to file a tax return because you assumed your wages were below the filing requirement, you may still be eligible for a return from the Internal Revenue Service (IRS). According to federal law, taxpayers have up to three years to file a return and claim a refund or amend a prior year tax return to claim tax credits like the EITC. The California Franchise Tax Board extends the same courtesy for four years. Citizens can claim the federal EITC up to three years back; however, since the Cal EITC is available for the first time this year, it is not eligible for retroactive filings. oming into Levi Stadium for Super Bowl 50 two giant photos grabbed my attention. Displayed enormously were giant photos of quarterbacks Peyton Manning and Cam Newton. Their massive photos only reaffirmed what I already knew, and that is, the NFL is a quarterbacks’ league. Well, Super Bowl 50 indeed had elite quarterbacks; however, this contest showcased elite defenses as the Carolina Panthers and the Denver Broncos each fielded what many note were the two best defensive squads in the league. The first half of the game both defensives just dominated. In fact, Denver scored its only touchdown after a monster hit and strip by Super Bowl MVP, Von Miller, that was recovered in the end zone by defensive end Malik Jackson giving the Broncos a 10-0 lead in the first quarter. How bad did the offenses featuring the quarterback of the future (Newton) and a future Hall of Famer (Manning) play? Denver, the winning team, made infamous Super Bowl history gaining 194 yards on offense, the fewest by a winning team ever. That number was 50 yards less than the record the Baltimore Ravens set in 2001. Even worse is the fact Manning’s team was 1 for 13 on third downs. Let’s look at Newton, who produced one of the best statistical regular seasons in the history of the league. He completed just 18 of 41 passes for 265 yards. He fumbled twice, was intercepted once and was sacked six times. Together the teams combined to set a Super Bowl record for most collective sacks: 12. The Broncos tied the Super Bowl record by recording seven sacks. It was officially set by the Bears in Super Bowl XX (1985 season) but the Steelers are also credited with seven sacks in Super Bowl X (1975 season) before sacks became an official statistic in 1982. Manning, who at 39 was the oldest quarterback to start a Super Bowl, said the game reflected the Broncos’ resilience. “This game was like this season in that it tested our toughness,” Manning said. “It tested our unselfishness. It’s only fitting it turned out this way.” After the game reporters cajoled Manning to take a position on his possible retirement, but he did not bite on that line of questioning concerning if this was indeed his last game. and me, Newton came into the post-game press conference in a serious funk and did not engage the mass of reporters. He gave one-word answers and after a few questions walked out the interview session. If I was Newton’s public relations person, I would have coached him to just come in and give respect to Manning, the Broncos, the Super Bowl itself and just lighten the mood with a funny quip. With their victory in Super Bowl 50, the Broncos are the ninth franchise to win as many as three Super Bowl championships. This was the eighth Super Bowl appearance for the Broncos, matching the record also shared by the Patriots, Steelers and Cowboys. Ironically Miller, who was the second overall selection in the 2011 draft after Newton, became the 10th defensive player in Super Bowl history to be selected as the Super Bowl MVP by tossing Newton on the turf with a purpose. Miller had 2.5 sacks, 6 total tackles, 2 forced fumbles, 2 hurries and a pass defended. The other three linebackers to be chosen Super Bowl MVP are Chuck Howley of the Cowboys (Super Bowl V), Ray Lewis of the Ravens (Super Bowl XXXV) and Malcolm Smith of the Seahawks (Super Bowl XLVIII). “He (Miller) was absolutely tremendous,” said Broncos head coach Gary Kubiak. “Our defense was just special, and they have been all year long. Miller is a hell of a player, but he has become a great pro, great man and a big leader on this football team. So, (I am) just very proud of everybody, but (I am) especially

proud of him.” Kubiak gave praises to his entire defense, noting that they were “very disciplined as far as our rush goes,” and he was extremely pleased at his team’s “effort in chasing Newton down, stopping the run, getting the turnovers, that’s the reason we’re standing here tonight.” Manning also becomes the first quarterback to start and win Super Bowls for two different teams. He also won Super Bowl XLI (2006 season) for the Indianapolis Colts. He is the third quarterback to start for two teams, joining Kurt Warner (Rams, Cardinals) and Craig Morton (Cowboys, Broncos). With the win, Manning became the first NFL quarterback with 200 career wins (186 regular season and 14 postseason). He had been tied with Brett Favre, a member of the Pro Football Hall of Fame Class of 2016, with 199. Panther’s coach Ron Rivera recalled how Denver got toasted by Seattle a couple years ago in the Super Bowl and he likened that experience to what his team went through. “We have to learn from this disappointment and continue to grow as a team,” he said, “and we have to go to work to take ourselves to that next level.” Only time will tell if Rivera and Newton will be a one hit wonder or they will indeed keep it coming.
