e celebrated Columbus Day on Monday. Well at least some of us did. Honestly very few of us did. In fact, according to the Pew Research Center, Columbus Day, the day we commemorate the landing of explorer Christopher Columbus in the New World, is one of the most inconsistently celebrated U.S. holidays, and one of the most contentious. Since it became a federal holiday in 1937, organizations have protested it, cities have changed the meaning of the celebration, and many states have chosen not to honor the day at all. Just this summer the Minneapolis city council joined other city leaders across the country, in changing the name – and nature – of this day of remembrance. After changing the name to “Indigenous Peoples Day” Minneapolis City Councilmember Kshama Sawant told the local newspaper, “Learning about the history of Columbus and transforming this day into a celebration of indigenous people and a celebration of social justice… allows us to make a connection between this painful history and the ongoing marginalization, discrimination, and poverty that indigenous communities face to this day.” In Mystic Chords of Memory historian Michael Kammen reminds us that societies reconstruct their pasts with the needs of contemporary culture clearly in mind, rather than faithfully record them. The commemoration of our country’s “discovery” is no different. If you can call it that, since there were people already here who didn’t know they were lost. I believe the new term is “Columbusing” – when you “discover” something that has been around forever. In America’s national memory, as an icon Christopher Columbus has gone from the embodiment of adventure and innovation in the nineteenth century to the brutal tyrant of the native islanders he governed for Spain in the twenty first. In all countries history is intertwined with nation building. Holidays, French historian Pierre Nora says, like anthems, monuments and other forms of collective memory, reinforce national identity. But in a country as diverse as America there is no unified interpretation of these “sites of memory.” Because of America’s pluralism there are multiple interpretations of the same event, hence the shift from commemorating Columbus to celebrating the Indigenous people of this country. Perhaps we’ll all begin celebrating that day in the future. Paulette Brown-Hinds, PhD Photo by benoitmalphettes.com

Remembering Harold Hambrick, President of the Black Business Expo
H
arold Hambrick, Jr., President of the Greater Los Angeles Black Business Expo (BBX) and the second largest African American-focused consumer show in the country has died. He was 71. As president of BBX, Hambrick took pride in showing off the history, services and accomplishments of the Black community, which he referred to as “the family.” He promoted the show as a way to introduce “relatives” to each other and to those outside the family. The effort of the first Black consumer show to run in the Tom Bradley Hall of the Los Angeles Convention Center, was massive. In its heyday in the late 1990s and early 2000s, the show included up to 400 vendors and nearly 300 workers on event day, providing an array of services. “We allow folk to use their God-given talents to help us pull off one of the largest events held in celebration of the Black family,” he said. Hambrick’s work was driven by the word “family” for the past 45 years. From biological family to the entire African American family, his conversations revolved around the power of “connectedness;” how we’ve worked together in the past and how we must continue to work together in order to leave businesses and cultural
institutions from which future generations can benefit. As a demonstration of his support of the “community family” he could frequently be found at the events in the Black community, from book festivals to food festivals, to marketplace–type events and to music festivals - large and small.

he Eastside Healthy Eating and Active Living (HEAL) Zone is currently recruiting high school students 15 – 18 years of age to become a member of the HEAL Zone Youth Council. Members of the youth council will assist their local community in decreasing calorie consumption, increase healthy food and beverage consumption, and increase physical activity through developing and conducting workshops and demonstrations. The youth council meets monthly to discuss issues and coordinate activities at the César Chávez Community Center located at 2060 University Avenue. The Eastside HEAL Zone consists of a network of community partners collaborating to expand healthy eating and active living opportunities to Eastside residents. Through the development of a Community Action Plan (CAP), the HEAL Zone works alongside Eastside residents to highlight the benefits of healthy food choices and physical activity. In an effort to accomplish the objective, the youth council will have an opportunity to contribute to social media, hone leadership skills and network with other youth within California at the statewide Youth Advocate Network for Remembering Harold, continued from page 4
Hambrick took pride in the fact that people who might not have seen each other in a long time, would reunite at the Expo. Attendees could be seen chatting in the aisles, visiting the vendors or participating in one of the Expo’s signature events, such as the Tom Bradley Business Institute, the Tastin’ Black Culture Food Court, West Coast “Coolture” Fashion Show; West Coast Black Music Festival, West Coast GospeLive, Kids World, Black College Row, The Health, Sports and Fitness Pavilion, Black Writers On Tour, the Hair Show, Youth Summit and Auto Land. BBX also offered businesses an opportunity to connect with owners of Black Newspapers throughout the state. At the 2006 Expo, Hambrick pulled together a meeting with then-Governor Schwarzenegger and publishers of African American newspapers throughout the state to discuss issues of concern to the Black press. Louisiana, Hambrick graduated from a segregated high school with 50 classmates. Three days after graduation, he left the state to join his parents and siblings in Los Angeles. Realizing that he wanted to be a part of the developments in Watts, he left a job at IBM in 1967 to join the South Central Multi-Purpose Health Service Center, which later became Watts Health Foundation (WHF), and later Watts Health Systems (WHS). For more than 35 years, he served in several capacities, including Vice President of Public Affairs. He was involved with WHF/WHS in its heyday, when the conglomerate had several business interests, including BBX, purchased as a seven year old entity in 1996. Through his vision, and an increase in corporate sponsorship, the size of the staff increased and the Expo grew. While Hambrick is widely known for his role with BBX, he has been influential in the field of healthcare for more than 40 years. Since joining WHF/WHS, he has championed the cause of
access to health care for residents of low income communities. While serving as V.P., under the leadership of Dr. Clyde W. Oden, Jr., President and CEO of WHF/WHS, Hambrick traveled throughout California and across the country to ensure that the plight of the underserved was heard by governmental agencies and legislative bodies. Active in the California Black Health Network, he also served on the Community Advisory Council at Charles R. Drew University of Medicine and Science. Additionally, according to Dr. Oden, in the 1970s and 80s, Hambrick founded the Western Association of Community Health Centers and the California Community Health Institute (CCHI). He was co-founder of the Health Care Coalition for the Truly Needy and a member of the National Association of HMOs. Along with his work at WHF, he was immersed in all things Watts. egistration is still open for the 8th Annual DisAbility Sports Festival set for Saturday, Oct. 18, at Cal State San Bernardino. Registration is free to participants, ages 8 months to 84 years old, of all abilities at the DisAbility Sports Festival website event page at http://disabilitysports.csusb.edu/festival.html. Onsite registration will be available at 8 a.m. the day of the event, which will run from 9 a.m.-3:30 p.m. Parking is free in lots G and H, nearest to the athletic fields at the east end of the campus. Organizers expect as many as 1,000 participants, including more than 100 disabled military veterans, competing in at least 20 different sports, including wheelchair and standing basketball, tennis, soccer, wall climbing, swimming and hand cycling. Each sport and activity will be coached by an athlete with a disability, including Paralympians, and other elite-level coaches, which, organizers say, is a display of all the participants’ abilities. The purpose of the festival is to increase the sports opportunities for athletes with disabilities and thereby increase their quality of life and health, said Aaron Moffett, the festival’s director and founder who also is a professor of kinesiology at Cal State San Bernardino and a program coordinator for the U.S. Air Force Adapted Sports program. “The program has quickly become one of the largest sporting programs in the country for people

with any disability,” Moffett said. “The growth is due to the testament of the need for such programs, especially for wounded warriors.” “The reason that we do this is because it helps people focus on success and their abilities when sometimes people focus on perceived inabilities,” he said. “One of our military participants last year said that the event made him feel alive again since being back from Afghanistan. The power of sports can touch everyone’s life and that is why we have the DisAbility Sports Festival.” Also featured will be an Assistive Technology fair discussing how people with disabilities can use technology to improve their quality of life and more than 30 information booths from community programs and services that are available for people with disabilities and their families. Including volunteers, supporters, spectators and athletes, an estimated 1,500 to 2,000 people will come to the university for the festival. Molina Healthcare is the lead sponsor of the event. Other sponsors include CSUSB’s Rec Sports, Incight, and the Inland Regional Center. Participants may register online or download the registration form – available in English and Spanish – at DisAbility Sports Festival website event page at http://disabilitysports.csusb.edu/festival.html. here is no FDA-approved vaccine available for Ebola. If you travel to or are in an area affected by an Ebola outbreak, make sure to do the following: • Practice careful hygiene. For example, wash your hands with soap and water or an alcoholbased hand sanitizer and avoid contact with blood and body fluids. • Do not handle items that may have come in contact with an infected person’s blood or body fluids (such as clothes, bedding, needles, and medical equipment). • Avoid funeral or burial rituals that require handling the body of someone who has died from Ebola. • Avoid contact with bats and nonhuman primates or blood, fluids, and raw meat prepared from these animals. • Avoid hospitals in West Africa where Ebola patients are being treated. The U.S. embassy or consulate is often able to provide advice on facilities.
• Avoid contact with infected people. In particular, caregivers should avoid contact with the person’s body fluids and tissues, including blood, semen, vaginal secretions and saliva. People with Ebola are most contagious in the later stages of the disease. • Follow infection-control procedures. If you’re a health care worker, wear protective clothing, such as gloves, masks, gowns and eye shields. Keep infected people isolated from others. Dispose of needles and sterilize other instruments. • After you return, from an area where the Ebola disease has been confirmed, monitor your health for 21 days and seek medical care immediately if you develop symptoms of the Ebola virus. Scientists are working on a variety of vaccines that would protect people from the Ebola virus. Some of the results have been promising, but further testing is needed. the funeral business in the 1950s and 60s. The Hambrick Family Mortuary, started by Harold Sr. in 1975 in Gonzales, Louisiana, remains in full operation with the younger brother, Darryl as CEO. Hambrick Jr.’s siblings have other ventures, including two in Donaldsonville, LA: Hambonz Piano Room, a nightclub located in the business district and the nationally recognized River Road African American Museum, founded by Hambrick and his sister, Kathe. Another brother, George, owns two technical services companies in Southern California. And, brother Donald is the family’s legal counsel. Always one to celebrate his Louisiana history and culture, Hambrick was one of the founders of LALA (Louisiana to Los Angeles Organizing Committee Inc.) in 1988. In addition to being on its Board of Directors, he often served as the Master of Ceremony for the annual Mardi Gras Scholarship Ball. In 2005, he was selected as the LALA King. Hambrick would sport the appropriate regalia and participate with the Second Line dancers at selected events. His collection of New Orleans memorabilia included Mardi Gras Indian costumes and a Zulu headdress.
Watts was the center of activism and cultural pride, Hambrick became a part of the community’s energy, spirit and in later years, its revitalization. He was a strong promoter of the Watts Summer Festival and increased the profile of the Watts Christmas Parade and the Watts Martin Luther King Breakfast. Hambrick previously served as President of the Watts United Credit Union and was instrumental in the rebirth of the Watts Neighborhood Center (Mfundi Institute). One of his proudest achievements was his involvement in the re-birth of the Watts Coffee House. With a vision to provide a sitdown restaurant for the residents, Hambrick, through WHF, was instrumental in reopening the restaurant across the street from the original one that burned down in the 1965 rebellion. Located at 103rd and Wilmington (the previous site of The Relish House), the restaurant, since reopening in 1997, is a hub of activity with meals prepared by Chef and Manager Desiree E. Edwards. Hambrick was introduced to the world of business and entrepreneurship by his biological family; his father worked alongside an uncle in

Hambrick had already set his sights on getting to know “long lost relatives.” In 2008, he forged an alliance with Black Expos in several states and networked with them to raise the profile of Black business and educate African Americans about their spending power. A graduate of Pepperdine University with a Bachelor’s degree in Business Administration, Hambrick was also the owner of an income tax service in the Crenshaw district for more than 30 years. He leaves to cherish his memory, his wife, Marguerett, three children, Jeffrey, Sharon and Tyra, one grandchild and one great-grandchild, four siblings and a host of relatives and friends. Hambrick’s celebration of life will be held at 10 a.m. on Friday, October 17, at Victory Baptist Church, 4802 S. McKinley Avenue, Los Angeles. The Eulogist will be Rev. Dr. Clyde W. Oden, Jr., Pastor, Bryant Temple A.M.E. Church. The Officiant will be Rev. Theodore Peters, Harold’s cousin and Pastor of the Greater Liberty Baptist Church.

r. Thomas Pierce recently spoke at fundraising event for Yes on Q & R at the home of Phil and Lynda Savage, sponsored by Residents for a Better San Bernardino. Below is Dr. Pierce’s remarks on Measure Q during Hardy L. Brown that fundraiser: “Thanks to all of you for coming, and to Phil and Lynda Savage for hosting this event. My name is Tom Pierce. I came to San Bernardino in 1976 when I was hired as an economics professor at Cal State San Bernardino. That was 38 years ago and I’ve lived in San Bernardino since my arrival. But, as I look around the room tonight, I realize I’m a relative newcomer. The Savage family goes back generations in San Bernardino, Gloria Macias Harrison was born here and she and her husband Bill have run a successful business in town for decades. Mayor Carey Davis was born here, Ernie and Dottie Garcia have lived here for decades, and Councilman Fred Shorett just mentioned to me that his grandfather was also a City Councilman. In fact, all of you here tonight have contributed to the community in major ways over the years in terms of both time and money. and R on Tuesday, November 4th. Measure Q seeks to rewrite Section 186 of the City Charter because the current wording of Section 186 makes it almost impossible for City Council to do its most important job – passing a budget that delivers a level of public services (police and fire, parks and rec, street maintenance, libraries, etc.) that add to the quality of life of San Bernardino citizens and taxpayers. Why does Section 186 make that budgeting task so difficult? Because it requires that police and fire salaries be set by forces totally outside the control of City Council. The 186 formula stipulates that salaries for specific public safety jobs in San Bernardino must be exactly the same as the average salary paid for those same jobs in 10 California cities of comparable population. The problem, however, is that none of those cities are comparable to San Bernardino in terms of their economies, tax bases, and household income levels. In 2011, for example, the median household income levels of the ‘comparable’ cities ranged from $47,000-$87,000; San Bernardino’s average household income was

less than $40,000. So Section 186 requires that we pay our public safety employees on the basis of what other, more prosperous cities say we must. What we can afford to pay never comes into play. That just doesn’t make sense. In effect, Council has absolutely no control over most of the City’s budget. No other city in California determines police and fire salaries that way. They all use the collective bargaining process – and collective bargaining has long been used to determine compensation for all other unionized San Bernardino City employees, besides police and fire. So Measure Q simply says: - let’s give City Council the flexibility to manage the budget in a way that provides the level of public services that citizens deserve; and - let’s determine public safety salaries in a fair way – the way that‘s used by every other California city. There used to be a saying around town that I bet many of you have heard: “It’s a great day in San Bernardino.” If we’re honest with ourselves, that hasn’t been true for a long time. We need to change that. And that process started with last year’s elections. We need to build on that momentum. There’s a long road ahead, but passing Measure Q is an absolutely essential step in the process. pointofview Building Partnerships Between Police Officers and the Communities They Serve
W
hat is community policing? In the wake of increased shootings in Ferguson and around the country, there has been a renewed public interest in the role of police, the extent of police brutality, and the prevalence of racial bias. These are not new issues, and in fact a number of organizations have been working for decades to increase trust between law enforcement and the communities they serve. Among these is the National Coalition Building Institute (NCBI), a nonprofit leadership program headquartered in Washington DC, whose leaders I spoke with recently. Founded in 1984, NCBI focuses on eliminating prejudice and resolving inter-group conflict. They work in cities across the U.S. and overseas to build the capacity of local leaders in schools, college campuses, police departments, and environmental organizations to lead preventionoriented workshops and to intervene in the face of tough inter group conflict. One of NCBI’s key programs, the Law Enforcement Community Citizen Project, focuses on building productive relationships between police and the communities they serve. The NCBI Law Enforcement Community Citizen Project was initially funded in 2002 by a grant from the COPS office (the office of Community Policing at the US Department of Justice) to work in Bethlehem, PA and King County, WA. Since then the program has been implemented in Atlantic City, NJ as well as numerous communities throughout Pennsylvania, Missoula, MO, and Seattle, WA. NCBI is called on to bridge the divide between community members and police officers. NCBI leads Train the Trainer programs, Welcoming Diversity and Inclusion Workshops, and Leadership Institutes for officers and community activists to educate them in skills to foster cooperative relationships. Some communities have contacted NCBI when there have been specific difficulties between white police officers and people or neighborhoods of color that have been singled out by police. From their experience, NCBI has learned that it is best to offer communities a prevention-oriented, trust building approach.
This way, NCBI builds the ongoing capacity of law enforcement and community activists to work in partnership to increase safety for all citizens in the community. I spoke with Fabienne Brooks, who along with Guillermo Lopez, is co-director of NCBI’s Law Enforcement Program. Brooks is a retired Chief of Detectives for the King County Police Department in Seattle, WA. She was the first Black female officer in county history to be hired as a deputy, and throughout her career she made a point to immerse herself in the community that she served. The neighborhood she patrolled was the same neighborhood where she attended church and raised her family. After 26 years on the job, she retired and joined NCBI so she could continue her passion for community policing. Ms. Brooks told me that “an important part of community policing occurs when an officer recognizes that they are part of a community, and the community understands the same about the officer. It includes forming empathetic relationships between law enforcement and community members, which results in increased officer safety and safety for all members of the community.” The NCBI Law Enforcement Community Partnership project builds trust between law enforcement and community leaders by helping each side to understand the daily realities of the other. Each has a key story to tell. Each deserves respectful listening. By teaching listening skills and conflict resolution practices and by helping each side see the humanity and legitimate concerns of the other, trust and partnership increases. In addition, NCBI teaches specific skill sets that help each side to confront the biases they have learned about each other that get in the way of equitable treatment of the entire community-particularly the equitable treatment of people from different racial groups. NCBI believes in practices that will bring about institutional change not onetime trainings or quick fixes. As just one example of the outcomes of the NCBI’s COPS and Community project, consider what happened in Bethlehem, Pennsylvania. In 2005, a pool frequented by Latino young people had been closed for repairs and the young
people went to another pool. Within minutes, the mainly white life guards felt threatened by the presence of the Latino young people, called the police and the police, ignoring the pleas of the Latino parents for calm, called for increased back up. Ben Jealous A huge altercation Partner at Kapor Capital between the parents and & former President and the police continued for CEO of the NAACP months. The NCBI trained police/ community activist team was able to bring the parents and police together, and using their NCBI skills, bring about increased trust and understanding. In Ferguson, Former Chief Brooks sees an opportunity for an effective community-policing program to emerge from the chaos and violence of the past few weeks. “Now, there is a chance for police and the community to hear each other,” she said. “The focus needs to be on how people are treated. If you can train officers how to treat ALL people with dignity and respect - that is a victory.” Brook’s co-director Guillermo Lopez explained that community policing cannot be accomplished with the wave of a wand, “You don’t go in trying to change a whole department; you go in trying to change a few people, who eventually come to change the whole department. We can start by focusing attention and financial resources on organizations like NCBI, so they can continue spreading the word that emphasize the ‘serve’ aspect of “Protect and Serve”. “The establishment of a sustained value and practice for coalition building skills between Community and Law Enforcement is a pathway to conflict resolution and will create a climate which fosters violence prevention.” Joyce Shabazz, Consulting Associate Senior Trainer / Director Of Affinity Caucus Programs. As Brooks told me, “Police officers meet with the community, hear tough things, say tough things and confront their prejudices together - this is how we will move forward.”

The annual event honors music, competitive dance, crafts and food, but in addition, the Pow Wow offered a unique patchwork of Native American traditions. “The Pow Wow ensures that tribal cultures are not lost,” stated one attendee. The weekend-long event, which was free and open to the public, attracted approximately 15,000

attendees who enjoyed competitive dancing and drumming performances by men, women and children of all ages. Tom Ramos, brother of former tribal chairman James Ramos, works with other tribal members to coordinate the huge event. “The San Manuel Band of Mission Indians is honored to bring together members of tribes from throughout North America and members of our community,” said Ramos. “By coming together each year, not only do we celebrate and share our cultural traditions with each other, but we help keep our traditions alive by passing them on from generation to generation, and sharing them from tribe to tribe.” The San Manuel Band of Mission Indians have been hosting their annual Pow Wow to not only educate Native Americans of their history,

but the entire community. San Manuel Band of Mission Indians History he homelands of the San Manuel Band of Mission Indians has shaped their culture, traditions and present lives. The people at the San Manuel reservation are the indigenous people of the San Bernardino highlands, passes, valleys, and mountains who the Spaniards collectively called the Serrano, a term meaning highlander. The Serrano looked to nature and the land to provide the necessities of life including shelter, clothing, food and plants used for medicine. The Serrano people embraced the pine forests and flowing water of the high country. Their creation story tells of the first people who tended to their creator Kruktat as he laid ill and dying high in the mountains. When the creator died, the
T
featurestory people began to mourn and in their grief turned into pine trees. The nuts and acorns scattered by these trees became food for the Serrano clans who would follow these first people. Those Serrano who lived at Yuhaviat, an area of pine trees near present day Big Bear Lake where the creator died, were called the Yuhaviatam or the People of the Pines. Members of the San Manuel Band of Mission Indians are the Yuhaviatam clan, and like their ancestors, they maintain a special connection to the land. In addition to competitive performances, the Pow Wow featured non-competitive intertribal dancing and exhibitions including Bird Singing and Dancing, which is Native American music indigenous to Southern California and the Colorado River region. Singing has always played an integral role in the lives of the Serrano people. Unlike other American Indian musicians, traditional Serrano musicians do not use drums for rhythm but instead they fashion gourd rattles with palm tree seeds inside to make percussive sounds. In the past,
songs of the Serrano people were used to prepare for hunting the bighorn sheep roaming their ancestral land. These songs reminded hunters that if the natural systems were in order, the sheep would be there and they would not come home empty-handed. The San Manuel Band of Serrano Mission Indians has been successful in preserving many of these songs. To this day, songs are sung to describe social customs, creation stories and history of the region’s indigenous people. In recent times, elders from the neighboring Cahuilla tribe have taught bird songs to tribal members at the San Manuel reservation. Bird songs are sung throughout the Southern California area as well as the Mohave Desert and along the Colorado River. Bird songs are not directly about birds; rather the songs derive their name from the migration of birds that parallel the movement of people through their territory, telling the story of the creation, animals seen along the way, and sacred places. The crowd joined in on the fun as well, with prizes awarded in a spectator dance contest.
Below: Contestants competed for more than $250,000 in prizes at the San Manuel Band of Mission Indians’ 19th Annual Pow Wow. Men and women of all ages participated in dancing and drum competitions, including the Cruz Chacon Memorial Sweetheart Dance and Tiny Tots dance. HISTORY OF THE POW WOW The term pow wow is the white man’s version of the Indian word “pau-wau” which originally stood for a healing ceremony conducted by the spiritual or religious leaders of various tribes. When the white man started settling around Native American lands, they witnessed these pow wows. Soon, the “pow wow” term referred to any type of Indian gathering, regarding of its purpose. How the pow wow got its exact start is not known, but it was thought to have originated with the Pawnee tribe as a religious ceremonial meeting, filled with dancing and other rituals. Other Indian tribes adopted the practice of the pow wow and added their own traditions. Indians held these ceremonies to celebrate a successful hunt and to thanks the spirits for a bountiful harvest. Pow wows also spiritually prepared a warrior for an impending battle. Native Americans were big believers in all things living and spiritual and viewed life and death as an inevitable circle. Some of the pow wow ceremonies they conducted celebrated this circle with tribal drums, dancing, food, chanting and traditional healing rituals. They acted out ancient stories handed through the generations, which kept their history alive.

EQUAL OPPORTUNITY EMPLOYMENT: The District is an equal opportunity employer. The District encourages the participation of minority, women and disabled veteran businesses. COMPLIANCE WITH BID REQUIREMENTS: Each bid must strictly conform with and be responsive to the contract documents as defined in the General Conditions. The DISTRICT reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding or any requirements of these specifications as to bidding procedures. BID SECURITY: In accordance with California Public Contract Code section 22300, the DISTRICT will permit the substitution of securities for any monies withheld by the DISTRICT to ensure performance under the contract. At the request and expense of the Contractor, securities equivalent to the amount withheld shall be deposited with the DISTRICT, or with a state or federally chartered bank as the escrow agent, who shall then pay such monies to the Contractor. Upon satisfactory completion of the contract, the securities shall be returned to the Contractor. Use of the Escrow Agreement form in the bid documents without alterations is mandatory. Each bidder’s bid must be accompanied by one of the following forms of bidder’s security: (1) cash; (2) a cashier’s check made payable to the DISTRICT; (3) a certified check made payable to the DISTRICT; or (4) a bidder’s bond executed by a California admitted surety as defined in Code of Civil Procedure section 995.120, made payable to the DISTRICT in the form set forth in the contract documents. In the event of failure to enter into said contract or provide the necessary documents, said security will be forfeited. Use of the bond forms in the bid documents without alterations is mandatory. PREVAILING WAGE REQUIREMENTS: The DISTRICT has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in the locality in which this work is to be performed for each craft, classification or type of worker needed to execute the contract. These per diem rates, including holiday and overtime work, as well as employer payments for health and welfare, pension, vacation, and similar purposes, are on file at the DISTRICT, and are also available from the Director of the Department of Industrial Relations. Pursuant to California Labor Code Sections 1720 et seq., it shall be mandatory upon the CONTRACTOR to whom the contract is awarded, and upon any subcontractor under such CONTRACTOR, to pay not less than the said specified rates to all workers employed by them in the execution of the contract. WITHDRAWAL OF BIDS: No bidder may withdraw any bid for a period of ninety (90) calendar days after the date set for the opening of bids.
BONDS: Separate payment and performance bonds, each in an amount equal to 100% of the total contract amount, are required, and shall be provided to the DISTRICT prior to execution of the contract and shall be in the form set forth in the contract documents. All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure section 995.120. TELEPHONE/FACSIMILE: No telephone or facsimile machine will be available to bidders on the DISTRICT premises at any time. TIMELY DELIVERY OF BIDS: It is each bidder’s sole responsibility to ensure its bid(s) is timely delivered and received at the location designated as specified above. Any bid received at the designated location after the scheduled closing time for receipt of bids shall be returned to the bidder unopened. LOCAL HIRE AND APPRENTICESHIP: Local Hire: The DISTRICT strongly encourages its contractors to hire local residents as part of the contractors’ construction workforce, and to participate in apprenticeship programs. With respect to application of the DISTRICT’s local workforce participation goal , bidders attention is directed to the following: The DISTRICT’s Board of Trustees strongly encourages, within the constraints of federal and state law, “local hire” employment within SBCCD geographic boundaries. 2.A “local hire” is defined as an employee of the general contractor or any of its subcontractors whose residence is within the DISTRICT’s geographic boundaries (San Bernardino County and Riverside County) at any time – and ideally at all times – during the duration of the construction project that is the subject of this bid. 3.With respect to the discussion herein of the DISTRICT’s local hire goals, the term “contractor” refers to both the general contractor and any of its subcontractors working on DISTRICT construction projects. 4.Bidders on construction projects will be required to complete a “Local Hire Information Form & Checklist” which indicates the bidder’s effort to employ local hire. 5.To the extent possible and applicable and as permitted by law, bidders are expected to utilize the services of the Center for Military Recruitment, Assessment and Veterans Employment and its “Helmets to Hardhats” programs to serve as a resource for preliminary orientation, assessment of construction aptitude, referral to apprenticeship programs or hiring halls, counseling and mentoring, support network, employment opportunities and others needs as identified by the District. The District may request the awarded contractor to provide documents or other evidence to demonstrate efforts to comply with these requests. Apprenticeship Program: Unless such provision would conflict with a state or federal law or regulation applicable to a particular contract for a public works project, DISTRICT contracts for public works shall contain provisions pursuant to which each contractor or subcontractor shall make a good faith effort to employee apprentices who are enrolled in, and participating in, an apprenticeship program serving the San Bernardino and Riverside Counties, and approved by the State Department of Apprenticeship Standards. This apprenticeship requirement shall apply to any apprentice-able craft or trade in which the contractor employs workers in performing any work under the contract. A contractor may evidence its good faith effort by complying with California Labor Code Section 1777.5 and the implementing regulations, and by seeking apprentices from apprenticeship programs serving San Bernardino and Riverside Counties. A contractor employing apprentices pursuant to this section shall employ apprentices in a ratio consistent with the provisions of the California Labor Code or federal requirements as applicable for federal aid contracts. This section shall not be construed to exempt a contractor from any otherwise-applicable requirement imposed upon the contractor by federal or state law.
