What Ben Franklin Can Teach Us About Good Citizenship

D

uring a recent conversation with a good friend, somehow we started talking about dinner parties and people – either historical or present-day figures - we think would be interesting guests. We both picked Benjamin Franklin at the top of our list and then started rattling off a litany of his inventions and accomplishments. A printer and typesetter by trade, he was responsible for authoring the first published political cartoon in the colonies, creating the first subscription library, inventing a heat-efficient stove, bifocals, swimfins, and verifying the nature of electricity among his many other accomplishments and as one of our nation’s founding fathers. Many people aren’t aware that his last public act was writing an anti-slavery treatise. He was arguably, during his era, the most interesting man in the world. And as I thought more about his public service legacy, I remembered the Junto he created. It was a think tank of sorts. Organized by Franklin, the group was made up primarily of his friends as a structured form of mutual improvement. Members were drawn from diverse backgrounds and fields of interest, but all shared a spirit of inquiry and a desire to improve themselves, their community, and to help others. Franklin’s Junto met once a week and conversation topics were organized around a series of questions, which became a springboard for discussion and platform for community action. Three significant concepts that developed from those conversations were the volunteer fire service, neighborhood security, and a public hospital. Shortly after that conversation I had lunch with Sylvia Martin James, who just celebrated her 80th birthday. Before lunch we toured the Grier Pavilion next to the mayor’s office at Riverside City Hall. She wanted to share with me some of the plans for the structure that she was responsible for envisioning and then raising the money and soliciting the support to create. The structure has become a well-used venue that reminds us of the city’s history of diversity and inclusion. And it is a focal point of the downtown cityscape. For as long as I’ve known her – over 30 years – she has been one of those civic improvement folks who I would imagine would have participated in Mr. Franklin’s Junto. And like Mr. Franklin and his group of friends, she always thinks community first. As I sat enjoying our lunch and thinking about the current condition some of our other Inland area cities are in with possible Brown Act violations, embroiled in corruption scandals, placing special interests over public good, etc. etc. etc., I couldn’t help but think of the lessons we as citizens can learn from historical figures like Ben Franklin and his Junto. There are various individuals and organizations active in the community today that like Ms. Martin James are concerned with community and civic improvement, two organizations that come to mind are The Group in Riverside and WAG in San Bernardino. They provide the platform and are constantly looking for new voices to add to the conversation, new minds to solve some of our pressing issues, and new ideas on how to engage their fellow citizens and move them to action. I hope you consider joining them.

Judge Orders Rite Aid To Pay $12.3 Million For Environmental Violations Riverside

R

iverside County District Attorney Paul Zellerbach, along with 51 other California District Attorneys and two city attorneys, announced that a San Joaquin County Superior Court judge has ordered the Pennsylvania-based Rite Aid Corporation to pay $12.3 million as part of a settlement of a civil environmental prosecution. “This office is committed to the protection of the county’s citizens from the unlawful disposal of these types of hazardous materials,” said Riverside County District Attorney Paul Zellerbach. “It is important that all businesses in the county understand their responsibility in the legal and safe storage, transportation and disposal of hazardous waste material. The DA’s Office will continue to do all we can to make sure these important safety regulations are followed by all businesses.” The judgment is the culmination of a civil enforcement lawsuit filed in San Joaquin County in September 2013 and led by the District Attorneys of Riverside, Los Angeles and San Joaquin counties, claiming that more than 600 Rite Aid stores throughout the state unlawfully handled and disposed of various hazardous wastes and materials over a 6 ½-year period. Those hazardous wastes and materials included pesticides, bleach, paint, aerosols, automotive products and solvents, pharmaceutical and bio hazardous wastes and other toxic, ignitable and corrosive materials. From 2009 to present, prosecutors and investigators from the Riverside County District

Attorney’s Environmental Crimes Unit -- along with deputy district attorneys, investigators, and environmental regulators statewide -- conducted waste inspections at Rite Aid facilities and at landfills throughout California. The inspections revealed that Rite Aid was unlawfully sending hazardous waste to local landfills. There were 39 Rite Aid stores in Riverside County at the time (one has since closed) and most were found to have violations. Under the final judgment, Rite Aid must pay $10.35 million in civil penalties and costs. An additional $1.9 million will fund supplemental environmental projects furthering consumer protection and environmental enforcement in California. The retailer will be bound under the terms of a permanent injunction prohibiting similar future violations of law. Under the settlement, Rite Aid will pay $344,000 in civil penalties and cost recovery to Riverside County environmental regulators and $1.3 million in civil penalties and cost recovery to the Riverside County District Attorney’s Office. Rite Aid was cooperative and has adopted enhanced policies and procedures designed to eliminate the disposal of hazardous waste products in California. Stores are required to retain their hazardous waste in segregated, labeled containers so as to minimize the risk of exposure to employees and customers and to ensure that incompatible wastes do not combine to cause dangerous chemical reactions. Hazardous waste produced by California Rite Aid stores through damage, spills and returns is being collected by state-registered haulers, taken to proper disposal facilities and properly documented and accounted for. Rite Aid has now implemented a computerized scanning system and other training to manage its waste to further assure that the public is protected. The case was handled in Riverside County by Deputy District Attorney Dale Hoy of the DA’s Environmental Crimes Unit.

ecently, Assemblyman Eric Linder, representing the 60th Assembly District in the State of California, honored The Toro Company for its support of “Smart Irrigation Month” and for its coordinating efforts with local water districts, cities and the State of California to proclaim the month of July as “Smart Irrigation Month.” For the first time since 2005, when the Irrigation Association first launched “Smart Irrigation Month,” the Governor issued a declaration recognizing July as “Water Smart Month in the State of California.” The intent was, as he stated, to help “increase water awareness throughout the state” and to “invite all Californians to practice more sustainable water consumption.” Recognizing the importance of using our water resources wisely, The Toro Company reached out to government agencies and elected officials at multiple levels to proclaim the month of July as “Smart Irrigation Month.” “If nothing else, we hope that by promoting ‘Smart Irrigation Month’ people will take a closer look

inthenews Kaiser Permanente Medical Centers to provide funding to support the Food Policy Advisory Council o­f SB County San Bernardino

C

ommunity Action Partnership of San Bernardino County’s (CAPSBC) Food Bank is committed to reducing hunger and malnutrition. Access to healthy food is a basic necessity for the health and well-being of all people. Since 1984, the Food Bank has been serving over 30,000 families a month by redistributing food through the USDA commodities program and donated food programs. The Food Bank also provides food to 33 congregate feeding sites (soup kitchens) throughout the county. These include locations such as Salvation Army, churches, schools, clubs, community centers, and domestic violence shelters. As part of CAPSBC’s commitment to nutrition, the agency is facilitating the establishment of a Food Policy Advisory Council for San Bernardino County. The Kaiser Permanente Foundation’s “Healthy Eating in Hard Times” program helped fund the formation of the council in 2011-2012, and CAPSBC is pleased to announce that Kaiser has once again renewed their support of this important council with a grant of $15,000 to continue this important work in 2013-2014. Under this grant, CAPSBC will be able to continue to advocate for healthy food access and healthy food policies for all county residents. Part of this work entails strengthening the San Bernardino County Food System Food Hub (Old Grove Orange), a partnership of local farmers and growers in this region which has historically been known for its wonderful citrus, apple and other fresh produce and fruits. Through the Food Policy Advisory Council, policies that affect the county food system, including transportation, environment, waste recycling, pollution, urban planning and economics will be examined. The council will work to identify food resources, programs and healthy activities for the benefit of our county residents, and especially for the low-income who often suffer from poor nutrition and health due to poverty. Affordable Care Furor Is Reminiscent Of Medicare’s Beginnings

Health online exchanges open with plenty of choices

espite unprecedented attempts to sink the Affordable Care Act (a.k.a. Obamacare) — enrollment for coverage on health insurance exchanges in California and across the U.S. opened for business on Oct. 1 — In many ways, this furor is reminiscent of Medicare’s beginnings in 1966. That law, passed in 1965, had just a year before it went live. There were plenty of naysayers and fears of potentially calamitous roadblocks. For starters, many physician groups called for a national boycott. That never took place. Many physicians quickly realized that whether or not this was “socialized” medicine, Medicare would pay for visits by many Americans who had not been able to afford care. The number of people 65 and older using physician services jumped dramatically, and doctors and patients both benefited.

Another concern was that the Medicare law required hospitals receiving Medicare dollars to take all comers, thus desegregating U.S. hospitals in one fell swoop. Federal workers and even the National Guard were put on call in July 1966 should disaster strike. But all was quiet, and Medicare contributed substantially to speeding up the desegregation of healthcare. Nearly half a century later, Medicare is — along with Social Security — one of the two most popular government programs ever and well accepted by the medical community. Moving forward, most Americans who shop for health insurance on new online (exchanges) marketplaces will have a wide variety of choices. Health care exchanges are part of the Affordable Care Act and are intended to help uninsured Americans research and comparison shop for

insurance plans. Many young people are now able to select plans that cost $100 a month or less when the insurance becomes available Jan. 1, 2014. Covered California will make it simple and affordable for you to purchase high-quality health insurance and access financial assistance to pay for coverage. You can shop online, over the phone or in person to find the right health care insurance option for you. Through Covered California, both individuals and small businesses can compare different health insurance plans. Individuals can learn if they qualify for federal financial assistance that can lower the cost of health insurance. inmyopinion Abigail Medina for San Bernardino School Board

bigail Medina is a very impressive mother of five and all of her kids are enrolled in the San Bernardino Unified School District. She is seeking a seat on the board of trustees. A strong volunteer on the district’s African American Advisory Council and the English Learners Advisory Council she is a voice for parents and students. She is founder of Talented and Gifted in the Inland Empire a private organization whose mission is to prevent the continuation of underachievers from being pushed aside or forgotten. When I sat down with her several months ago she informed me that all children could learn with the right policies adopted by the board and given good direction by the superintendent and staff. While parent involvement is critical in a child’s life, it means nothing if parents do not feel welcomed to be engaged in their children’s education. She has a dynamic personality and is passionate about why she should be on the school board. It is refreshing to see a parent who wants to be engaged in every aspect of her children’s education while being an advocate for all students. Many times people run for school board with

no children in the district or stay on the board long after their children have graduated. After serving on the board for twelve years myself, believe me it is good to have new parents elected to the board for greater understanding of how polices are being implemented and their impact on staff, students, and taxpayers. In my opinion Abigail Medina would be such a parent on the board to provide input into the discussion before policies are made and given to the superintendent for implementation. She also knows the difference between a policymaker and staff person, which is critical for harmony on a school board.

Roxanne Williams for City Council

R

oxanne Williams is seeking to become the representative of the citizens for the third ward as well as being a voice of reason when it comes to making policies on behalf of all citizens in the city of San Bernardino. This will be a welcome breath of fresh air for us in the city. The reason I say fresh air is the current council member John Valdivia is nothing but a peon for the public safety association, which is not a bad thing but when you will not even listen to opposing views, it becomes bad for the city and other employees. Now what we have is Valdivia being disrespectful to the mayor, council colleagues, staff and any one who has opposing views on working conditions, pay cuts to balance the budget, or services to other wards in the city. If it is not providing services to his ward, it is not good for the city. This type of leadership must be replaced with a more inclusive style of leadership on the council.

Roxanne is a mother of five and works as a public school teacher. She is also a volunteer in the community that she cares about. I believe this is the kind of leadership Roxanne Williams will bring to the council. I recommend you vote to recall John Valdivia and replace him with Roxanne Williams.

wo years ago last week, the state of Georgia ignored the facts, doubts and pleas of hundreds of thousands of people and killed Troy Anthony Davis. Today, on the anniversary of his execution, we rededicate ourselves to ending the immoral, biased and ineffective practice of capital punishment.

concluded that 77 percent of people executed since 1977 were people convicted of crimes involving white victims, compared to only 15 percent of people executed for killing blacks. A full 42 percent of the 3,100 inmates on death row are people of color. Furthermore, we know that the death penalty is a poor deterrent of crime. FBI data shows that all 14 states without capital punishment in 2008 had homicide rates at or below the national rate.

For 15 years, we fought alongside Troy to clear his name for the killing of Savannah Police Officer Mark Allen MacPhail. Troy remained adamant about his innocence to his last breath. As explained in the new book I Am Troy Davis, by author Jen Marlowe and Troy's sister, Martina Davis-Correia, the case against Troy lacked conclusive evidence after many of the key witnesses recanted testimony from the time of the original trial.

The only effective way to deter killings in our streets is to ensure justice is swift and certain. In order to do so, we must ensure both that we have police leadership that builds strong partnerships and trust with all communities and also that they have enough officers and detectives to ensure every homicide in every community is responded to with the requisite resources to find and catch killers quickly.

In the last weeks of Troy's life, the Georgia State Board of Pardons and Paroles received 663,000 petitions from people imploring the group to reconsider the execution given the sheer amount of doubt surrounding the case. World figures, including Pope Benedict XVI and former U.S. President Jimmy Carter, human rights groups and commentators urged the execution to be halted -- all to no avail. In the hours before his death, the NAACP held a rally and lobbied the Department of Justice to intervene on the grounds of a civil rights violation. The glimpses of sadness and quiet resolve I saw on the faces of Troy's family when his death became imminent will stay with me forever. The last time I saw Troy, he told me "This movement started before me, and it needs to continue, no matter what, until we destroy the machinery of death." While many of the supporters who stood in solidarity with Troy have put away their signs and returned home, the battle to end the shameful practice of capital punishment wages on in his name. Side by side with Troy's family, we remain on the frontlines of this fight to abolish a system that is ineffective and steeped in racial bias. Since Troy's death, we have made definitive strides in our effort to end the death penalty. We have worked with a diverse and multifaceted coalition of advocates including Amnesty International and the National Coalition to Repeal the Death Penalty fix our nation's broken justice system. Last year our work led to Connecticut repealing the death penalty. This year, Maryland became the first state south of the MasonDixon Line to do the same. Those two states now join New Jersey, New York, New Mexico and Illinois as the fifth and sixth state in six years, and the 17th and 18th in the nation to abolish the death penalty.

here is an old adage: “politics makes for strange bedfellows.” And when one tries to assess allegations of who is doing what wrong, and what sparked the recall efforts in the city of Moreno Valley, the scenario far surpasses “bedfellows.” The Moreno Valley recall effort has begun to play out like a real life reality television show with plenty of characters as ‘the problem’ and the dissenting voice being one of ‘change’. Concerned residents cite city council members Richard Stewart, Victoria Baca, Jesse Molina, and Mayor Tom Owings as the city’s problem. Council member Marcelo Co was also a target until he resigned from the council in early August after his arrest on suspicion of fraudulently collecting monies in government assistance to care for his mother.

One concerned citizen of Moreno Valley, Craig Givens along with several other leaders in the city formed a watchdog group in the city over what they believe to be alleged corruption in their city’s government. This group, the Concerned Citizens of Moreno Valley Advocacy Group, began recall efforts earlier this year with grassroots outreach, door-to-door petitions, and speaking with any city resident who would listen. With weekly demonstrations and meetings, events culminated in August of this year as angry demonstrators protested in front of the Moreno Valley City Council building with red and green shirts to signify not only their anger but also the council’s greed. “What do we want? RECALL! When do we want it? NOW!” they chanted in unison. To add to the citizens’ mistrust of those elected to uphold the public trust, just last week the Moreno Valley City Council appointed Yxstian Gutierrez to fill the vacancy left by Councilmember Co in a vote of 3 to 1. Mayor Owings called for a vote at last Tuesday’s council meeting without introducing Gutierrez, council discussion, or

public comment despite Councilman Richard Stewart’s protests. Gutierrez’s friend and now fellow Councilmember Victoria Baca nominated him. His professional background includes being a business owner and special education teacher for Moreno Valley. His nomination and approval as the replacement councilmember has caused the Concerned Citizens to raise the question of whether this move violates the Brown Act and further questions Gutierrez’s lack of experience in the public service arena. One vocal member of Concerned Citizens, Deanna Reeder, addressed a letter to the district attorney citing the council’s actions as a criminal violation of the Brown Act: “the Moreno Valley City intentionally violated Government Code Section

54954.2 also known as the Brown Act. They did this by intentionally withholding the name of the person they appointed to fill a vacancy on the City Council. And intentionally violating the Brown Act is a crime so I am asking that you investigate this as a criminal matter.” She continues: “After all public speakers for this agenda were done, Councilmember Victoria Baca made the motion to appoint to fill the vacant position. Mayor Tom Owings asked her if she had a person in mind. Baca replied yes and the Mayor asked her to make the motion to appoint the person she had in mind. The Mayor then ordered Jesse Molina to second the motion at least two maybe three times. Victoria Baca made continued on page 21

Loveridge as the breezeway outside City Hall was recently renamed “Ronald O. Loveridge Plaza� in his honor.

Riverside officials recently unveiled a plaque honoring Loveridge’s commitment to the city of Riverside among elected officials, community members and family. Loveridge’s commitment to the city of Riverside and its residents dates back to when he was elected to serve on the City Council from 1979 to 1994. He later was elected Mayor from 1994 to 2012. During his tenure, Loveridge helped add five new sister cities, showed his commitment to diversity with the unveiling of the Ismael Villegas, Martin Luther King, Ahn Chang Ho, Mahatma Ghandi, and Eliza Tibbets statues on the Peace Walk in the Main Street pedestrian mall; oversaw a public works initiative known as the Riverside Renaissance, and started the “mayor’s night out” events in which city officials visited the community.

Downtown Riverside served as the official finish line to a life-size game board with participants as the game pieces during the recent 2013 Fireball Run Adventurally. The Fireball Run is an action packed, life-sized, 8-day, 14-city, 2,500-mile trivia game with the goal of aiding in a massive effort to help find America’s missing children. Forty driving teams competed for glory, bragging rights, and a plastic road sign, all while helping in the effort to recover America’s missing children. Every team is assigned a missing child and tasked with distributing posters along the route. The awareness campaign has aided in 38 child recoveries since 2007. The theme for the 2013 event was All Stars and Movie Cars, with notable Hollywood, exotic, and classic cars being on-hand at the finish line. Not the City Attorney who is responsible for making sure the Council adheres to the law. Not the City Clerk that is responsible for making sure candidates fill out their paperwork and are qualified for the City Council position. No questions or look of surprise from the City Manager or Assistant either.” The circumstances that sparked the creation of the Concerned Citizens and the momentum behind the recall are disturbing. Earlier this year federal agents served warrants at the homes of all Moreno Valley council members: Marcelo Co, Richard Stewart, Tom Owings, Victoria Baca, and Jesse Molina, as part of a corruption investigation. Agents with the IRS, FBI and U.S Attorney’s Office spent several hours collecting items including computer hardware. According to Riverside County District Attorney Chief Investigator Michael Moriarty, the raids were part of “an ongoing political corruption investigation,” and were conducted by the Inland Regional Corruption Task Force, which includes the District Attorney, FBI, IRS and U.S. Attorney’s office. Some searches were conducted under federal warrants. Others were performed through Riverside County DA’s office. Also included in the probe was private development company Highland Fairview and its president and CEO Iddo Benzeevi and his associates. Clearly, the Concerned Citizens aren’t giving up, and the council’s latest action to select, approve, and appoint a replacement for Council member Co without public input or public discussion of the process, just adds to the community’s mistrust of their elected representatives. One source, which spoke under anonymity said, “the corruption in Moreno Valley has been apparent for years and was quite visible during the Skechers approval process, during the redistricting process right after the 2010 census and in 2011. The Concerned Citizens questioned the legitimacy of a $100 million contract to build something where it is prohibited and where three schools have went through the EIR process and are ready to buy the property? The group alleges that the contract was signed knowing a back room deal had been brokered which is why such a contract was signed. The group alleges the city council knew the project was going to be approved; leaving the school deal in the cold. There are three other reasons cited for the recall effort as well: 1.) City council is being challenged for agreeing to pay ex-city manager Henry Garcia $430,000,00; for attempting to write a charter on their own with minimum citizen involvement; and for attempting to block the hospital complex on the March Joint Powers Land (Air Force Base) project, which by doing so comes at the expense of the citizens of Moreno Valley. sn’t it time to have leadership in San Bernardino that understands money and budgets? I have over 35 years of experience in successful accounting and financial management for both businesses and nonprofit organizations. I have earned a reputation as someone who knows how to solve budget problems and implement tough financial decisions. San Bernardino is my home -- I was born here, graduated from Pacific High School and received my MBA from CSUSB. Together with my wife of 40 years, we have raised our four children here, and taught them to serve their families and their community. I hold a leadership role in our church and serve on our local Boy Scouts committee. We need to work together with public and private resources to develop a community-wide plan that will keep our community safe, clean, and fiscally strong. As your next mayor, my leadership skills and fiscal knowledge will allow me to work with the City Council to implement a sustainable budget and lead us forward as a more prosperous city. Specifically, I have four overall platforms for what I will bring to the City as its Mayor: I Stand for a Return to Fiscal Sanity. San Bernardino needs leaders that understand how a budget is made and how to live with it. I will apply the same budget management strategies that I’ve honed as a Certified Public Accountant. I Will Bring Integrity and Professionalism to City Hall. San Bernardino deserves elected representatives that respect each other and can figure out how to work together. Petty bickering and outlandish theatrics have no place in City Hall. And I welcome the input and voices of the entire community, not just those with financial or political influence. We Must Work Toward Charter Reform. Changing the direction of our city means getting serious about charter reform. I will work to build a consensus that includes City Hall, city residents, and expert voices in the area of charters and city management. Business Will Come to a Safe and Secure City. We can revive the San Bernardino economy if we make the city streets safe again. I will focus business generation in downtown, around the University and near the airport, and take a pro-business approach in City Hall.
