Public Servants: When You Swear An Oath, You Make A Promise

W

hen I was in Girl Scouts, like all scouts in the organization, I made a promise. The Girl Scout oath, shared by every member of the organization, reflects the way Girl Scouts agree to act everyday toward one another and other people: On my honor, I will try: 
 To serve God and my country, 
 To help people at all times, 
 And to live by the Girl Scout Law. The Girl Scout Law outlines the way to act towards one another and the world: I will do my best to be
honest and fair, 
friendly, and helpful, 
considerate and caring, 
courageous and strong, and
responsible for what I say and do, 
and to
respect myself and others, 
respect authority, 
use resources wisely, 
make the world a better place, and
be a sister to every Girl Scout. As Girl Scouts, we tried to live by those words. I’ve been thinking quite a bit about oaths of office and swearing an oath since hearing the recent news of two San Bernardino city councilmen who were charged with felonies, and after watching a video of Moreno Valley police officers using what seems to be excessive force on a man in distress who would not exit his car. In all three cases, the individuals involved were officially sworn into duty to serve the public. What happened to the promise to serve the people you represent? When Councilman Chas Kelley used public campaign funds for personal use and then underreported his contributions, he lied to the people of San Bernardino and violated reporting laws that every elected official in our country is bound by law to follow. What happened to putting the public interest before personal interests? Among Internet stalking accusations, Councilman Robert Jenkins is accused of misusing his authority by creating false San Bernardino Police Department and Common Council memos. What happened to protecting and serving the citizens of your city? How many officers does it take to subdue an unarmed man? Is excessively beating him before handcuffing him necessary? Not only does the family of Raymond Johnson deserve answers, but the people of Moreno Valley do as well. In my family we were taught we couldn’t just be average, we had to be better. We had to study harder. Work longer. We were encouraged to strive to be exceptional. During my tenure as a Girl Scout, I took that three-finger pledge, and worked exceptionally hard to make the world a better place. I was 12 years old. It’s a shame that some of our current public servants are not as committed to upholding the oaths they swore and the promises to the public they made when they entered public service.

he City of Yucaipa will host its 2nd Annual Autumnfest (formerly Oktoberfest) on October 25-26, 2013 in the historic uptown district. Thousands will gather to enjoy music, food, and family contests. This event celebrates the traditional Yucaipa region fruit harvest time and will feature live music, dancing, festival competitions, and kids’ activities. It is sure to draw thousands of people for a full weekend of fun and relaxation. Mayor Denise Hoyt adds that “the Autumnfest is another opportunity for the community to come together in the historic Uptown to celebrate the season in style. It’s about sharing our history and looking forward to the future of Yucaipa”. Friday’s (Oct 25) activities operate from 6 p.m. to 10 p.m. and will feature the final farmer’s market of the year so be sure to pick up seasonal produce as it won’t return to the Uptown until the spring. The evening will also include food and merchandise vendors, live music (Band of Brothers), a beer garden, classic “shown ‘n’ go” car show, costume contest, and trick or treating. Saturday’s (Oct 26) activities operate from 3 p.m. to 10 p.m. and will feature youth games, pie baking contests, food eating and cooking contests, kids’ fun zone, food vendors, arts and crafts vendors, log sawing contests, a beer garden, queen stein and king stein hold`em contests, a performance by Chris Lozano and The Dixie Playboys, and Lights as the evening headliner with the best music from Journey and more for your listening pleasure. air Housing Council of Riverside County, Inc. (FHCRC) received an Education and Outreach Initiative (EOI) Grant from the U.S. Department of Housing and Urban Development (HUD). This grant enables FHCRC to offer free workshops, seminars, presentations and Town Hall meetings throughout Riverside County. FHCRC will conduct a Town Hall meeting at the Janet Goeske Center located at 5257 Sierra Street, Riverside, CA 92504, on November 15 from 6 pm to 8:30pm (dinner will be served). The town hall will feature representatives from the US Department of Housing and Urban Development, Riverside County District Attorney Office, the Banking and Real Estate Industry. The main themes of the meeting include: “Lessons Learned from the Foreclosure Crisis”, “Where Do We go From Here?”, “Predatory Lending

Practices” and the “Importance of Homeowner Education”. Also, homeowners are encouraged to bring their questions, comments and real estate related advertisements as a way to identify and/ or demonstrate predatory lending and illegal housing tactics. The Town Hall meeting is free and handicap accessible. This is the last installment in a series of four town hall meetings that FHCRC conducted in 2013. Clean Air Award for Omnitrans Go Smart Program College pilot program recognized as” Innovative Transportation Project” San Bernardino

A

pilot program that more than doubled the number of local college students using public transit and eliminated an estimated 129 tons of pollution earned Omnitrans a Clean Air Award from the South Coast Air Quality Management District, presented on October 4, 2013. In 2011-12, Omnitrans initiated the “Go Smart” pilot program dedicated to transitioning local college students in the San Bernardino Valley to using public transit rather than driving to get to campus. Omnitrans partnered with California State University-San Bernardino, Chaffey College, Crafton Hills College, and San Bernardino Valley College to offer free, unlimited bus rides to over 50,000 college students. Approximately 1,450,000 trips were made by over 13,500 individual students in the pilot year. Students had unlimited access to the Omnitrans bus system with a simple swipe of their college ID card. During a typical week, 5,100 unique students rode Omnitrans which means that over 10% of students became regular transit riders, up from 4%

prior to the program. Over 25% of enrolled students tried the program at least once. Subsequently, ongoing self-funded Go Smart programs were established at each of the pilot program colleges and student ridership continues to increase over a year later. “Go Smart helps reduce transportation costs for students and removes lack of transportation as a barrier to education for some,” said Interim CEO/General Manager Scott Graham. “Gaining familiarity with public transit while a student also makes them more likely to use and support public bus service in the future,” During the pilot year Go Smart students logged 8.7 million cumulative miles! By taking public transportation instead of driving, this removed an estimated 129.2 tons of carbon monoxide from the air while also reducing the levels of reactive organic gases, nitrogen oxide and particulate matter. Side benefits included reduced traffic congestion near the partner colleges and reduced parking demand on campus and in surrounding neighborhoods. “Each year, we honor businesses and individuals who work unrelentingly to improve the

quality of the air,” said SCAQMD Governing Board Chairman William A. inthenews Community Seeks Answers from Moreno Valley PD In The Death of Raymond Johnson; Family Files Wrongful Death Claim

A Moreno Valley man was taken into custody the evening of October 11th and moments later he was pronounced dead. Moreno Valley

T

he death of Raymond Lewis Johnson, 41, has sparked public outcry and focused the spotlight on the Moreno Valley Police Department and the issue of police use of force. A YouTube video that was posted of the incident on October 13th initially shows two officers who responded to the scene struggling to subdue Johnson who is seen in the video beating and kicking the driver’s side door of his vehicle. Eventually there were as many as six officers aggressively handling Johnson to get him out of the car. This past Tuesday Johnson’s family announced plans to file a wrongful death claim against the

Riverside County Sheriff’s Department and the officers involved in his arrest. Moreno Valley’s services are contracted through the county agency. During the announcement held in Los Angeles, Attorney Rickey Ivie, representing Johnson’s wife LaWanda explained to the media, “Our objective is to hold the officers accountable for the excessive force used during the incident, which led to Mr. Johnson’s death and to bring closure to his family.” When individual officers who are trusted to uphold the law, violate a citizen’s rights, use excessive force, and cause the unjustifiable death of a citizen, those officers must be accountable.” Ivie told the Voice that an independent autopsy

showed blunt-force trauma to Johnson’s head from multiple punches and kicks, severe enough to leave a boot print on his chest. According to police documents and eyewitness accounts, Johnson was seen violently kicking his feet and striking his fists in an uncontrollable manner, causing concern to the fast food workers who reported the incident. The vehicle was parked blocking the drive-thru at a Burger King restaurant, located near the 23000 block of Hemlock Avenue in the city of Moreno Valley. According to a published police report, “due to Johnson’s physical size and agitated state, the officer requested additional officers to respond. continued on page 21

Better Sleep With The Right Pillow

N

othing kicks off your day better than getting a good night’s sleep. And sleeping with the right pillow can make a big difference. “Pillows can not only impact the quality of our sleep, but also how healthfully we rest and recharge,” says sleep expert Michael Breus, PhD, a clinical psychologist and author of Beauty Sleep: Look Younger, Lose Weight, and Feel Great Through Better Sleep. Getting a good night’s sleep can depend on the kind of pillow you buy. To the untrained eye, all pillows pretty much look alike -- but if you peek underneath the covers you’ll find a bewildering array of fillings, including soft, traditional down and feathers; latex foam; polyester gel and memory foam; even such exotic materials as buckwheat hulls. Experts say comfort is your primary consideration, but it shouldn’t be the only factor

to consider when buying pillows. You also have to think about neck support (most pillow types fall short in this department), potential allergens and long-term durability. Often, the most expensive pillows aren’t the ones that give you the best night’s sleep. Although all pillow types have their pluses and minuses, experts especially like latex and buckwheat pillows, which are firm, durable, adjustable and able to spring back to their original shape. Depending on your needs, you may also want to consider memory foam or natural fabric (cotton, wool or silk) pillows. Is it time to buy a new pillow? Experts say the general rule is to buy a pillow every 12 to 18 months. After two years, it’s definitely got to go. Some expert advice: If you sleep on your back: Back sleepers need thinner pillows, so their head is not thrown too far

forward. Also look for a pillow with extra loft in the bottom third of the pillow to cradle your neck. If you sleep on your side: Side sleepers need a firmer pillow to fill in the distance between the ear and outside shoulder. If you’re a stomach sleeper: Look for a very thin, almost flat pillow. You may not even need a pillow for your head, but consider tucking one under your stomach to avoid lower back pain.

huck Berry had a song in the late sixties called “Reelin and Rockin” and it was about having fun where anything goes. Well Chas Kelley and Robert Jenkins have been having personal fun while the City of San Bernardino has been “reelin and a rockin” from their inattention to duty and caring more about themselves and not the citizens of the city. In a city where the unemployment rate is in double digits, the poverty rate is over 30%, top staff are resigning from their positions, the public safety association is degrading the mayor and some council members, and the city is in bankruptcy, both councilmen disgraced the citizens and themselves when they were arrested and charged with felonies in two separate incidents. Kelley has since resigned from office. In my opinion Jenkins should as well. This has left citizens wondering what is to come on November 5th when they will elect some new leaders for the embattled city. Kelley was charged with felony perjury and took a plea deal that forced him to immediately resign from his council seat, drop his mayoral campaign, and agree to never run for public office again. He admitted to using $74,000 of campaign contributions for personal expenses. It was known in public that Kelley did not have a job for a long time and then when his boss, Neil Derry lost his county supervisor position, Kelley joined the unemployment ranks again. Kelley agreed at the FBI’s request to wear a wire and record conversations with other elected

officials and staff at city hall so more folks might be shaking in their boots right now. He was required to talk with the FBI before every council meeting since June so they have a lot of conversations to listen to. Kelley has also filed new campaign finance forms to amend those false statements previously submitted. This might give him problems with the IRS and state for unpaid taxes. Another San Bernardino Council member Robert Jenkins was arrested on 18 felony charges and 12 misdemeanors involving internet stalking, bullying against a former male friend. Not related to the federal charges, Jenkins, a public school teacher, in Riverside is on non-paid leave from his teaching job because his teaching credential has lapsed. His attorney Virginia Blumenthal said to the press that Jenkins is not guilty, but that will be decided in court. No reason has been given by Jenkins or Blumenthal as to why he allowed his teaching credential to expire. Because of these two arrests and one admitting guilt to the charges, citizens need to make sure campaign reform is on the agenda after the election. We also need to make sure our council candidates can afford to take the job and not use their campaign funds to fund their personal expenses. Just when you think it can’t get any worse in our city, something like this happens. With Kelley wearing a wire and recording conversations more news might be coming that will cause us to reel and rock some more.

Dr. Gary Thomas Retires

L

ast week San Bernardino County Superintendent Gary Thomas announced that he would not seek re-election in 2014 for personal reasons, family and health. This I am sure will set off jockeying by some to seek this vacated position to lead the county on educational issues. I want to commend Dr. Thomas for his years of service to the children of the county and the

employees his office employed. He has served with distinction and provided leadership for others to follow. This is a big county and requires a person with a lot of energy and dedication to people. His early announcement gives us time to look at people who might make a good replacement. Happy retirement Dr. Gary Thomas.


pointofview Community Newspapers: Showing the Importance of a Good Story

I

learned about the importance of telling a good story – something local publications try to do each and every day – from a Tennessean who was a dear friend of mine. His name was Alex Haley and he became famous for telling stories, in particular those of his African ancestry in his best-selling novel, Roots. Perhaps most importantly, he lived his life by these six words “Find the good and praise it.” When I think about the good in our Tennessee communities – what makes them strong and special – hometown newspapers telling local stories certainly qualify. The power of stories is all around us. Alex Haley once told me that when I went to make a speech that if I told a story instead, people might actually listen to what I had to say. I’ve found that to be true. And small, hometown newspapers demonstrate the power of storytelling – both the good and bad facing their communities – in a way that can be difficult to come by in our 24/7 media environment. For Alex Haley, the power of stories came to him when was a child, listening to his grandmother and aunts tell the stories of his ancestors. He used to say that his Aunt Liz and Aunt Plus, sitting on the porch telling those stories, could knock a firefly out of the sky at 14 feet with an accurate stream of tobacco juice. Alex Haley went on to tell those stories in Roots, the story of Kunta Kinte – an African who was captured and sold into slavery – and his ancestors. For community newspapers, stories take on many forms. Our Founding Fathers wrote the First Amendment into the U.S. Constitution to protect the rights of the American people to organize and speak up and speak out. Local newspapers play a vital role in helping people do that – covering local government activity and sometimes unveiling

problems facing a community or its leaders. Our Founders even used local newspapers to speak out as they organized against the King, and wrote the Declaration of Independence. There’s also plenty that local newspapers do to bring people together. From covering local community events to telling the stories of local residents, small, hometown newspapers tell people what they need to know to feel connected to one another. Sometimes these stories can even inspire. And despite how much media has changed in recent years, local community newspapers can also do quite a lot to connect people to the outside world. I know this to be true as I work on fixing the federal debt, taking more decisions out of Washington and back to Tennessee and pushing back against the regulations that are throwing a big, wet blanket over the economy. I can’t always expect the voices in local newspapers to agree with me. But by asking questions and writing about issues of importance to Tennesseans (and letting me have my say in a story or opinion column once in a while) community papers provide an important service. And whatever the major issues of the day, good stories surround us always. I think back to my friend Alex Haley, and a man he met in Knoxville named Joseph Rivera. Alex found out that Joseph couldn’t read, so he taught him and then wrote about him in Parade magazine – a great example of his motto “find the good and praise it.” Tennesseans in communities all across our state could just as easily pick up a copy of their small, hometown newspaper. It’s important to see our shortcomings. But it’s also important to find the good and praise it, and local newspapers do that for their communities every time they go to print.

wo weeks after San Bernardino Mayor Patrick Morris outlined a detailed plan for the city’s recovery from bankruptcy during his State of the City address, the community was shocked by the news of not one city council member but two council members involved in alleged criminal activity.

coverstory But for many residents who have been following city government and support a recall effort to change the leadership at city hall, the recent salacious headlines featuring Councilmen Robert Jenkins and Chas Kelley, comes as no surprise. Kelley, 44, of San Bernardino, pleaded guilty to one count of perjury and will spend 90 days in county jail and five years on probation for his “guilty” plea of failing to disclose monetary campaign contributions. Kelley had been campaigning for the upcoming primary election in November for the mayoral seat but dropped his bid amid the current charges. As a result of his guilty plea Kelley is precluded from holding any future elected or appointed position however, he will remain on the ballot for the Nov. 5 election. In an unrelated case, Councilman Robert Jenkins, 33, also of San Bernardino, was charged with 18 felonies and 12 misdemeanor crimes relating to stalking and identity theft in Riverside County. “It is a tragedy for our city,” concerned resident Barbara Babcock told the Voice. “We do not need one more black eye against San Bernardino, however I would say thank God it happened before the election and not afterwards. I think that other shoes are about to drop, but maybe not before the election,” she said. Councilman and Mayoral Candidate Chas Kelley Admits to Personal Use of Campaign Funds n investigation, which led to the filing of charges and the subsequent conviction of Kelley, was initiated by complaints San Bernardino County District Attorney investigators received in 2011. These complaints consisted of Kelley not reporting campaign contributions he had received. After further investigation, the amount of underreported monetary contributions Kelley failed to disclose was $74,222.76. Following his guilty plea, Kelley publicly stated: “I freely, voluntarily, knowingly and intelligently, admit that: From on or about January 31, 2007, through July 30, 2012, on numerous occasions, I committed perjury, by falsely stating as true

The Charter mandates a special election be held if a ward seat becomes vacant for any reason. The municipal code outlines when that election can happen which is no less than 90 days after the council calls a special election. This past Monday’s council agenda item called for a special election for February 4.

During Monday’s night council meeting, City Clerk Gigi Hanna brought a motion calling for a mail only special election to fill the vacancy for Kelley’s vacated Ward 5 council seat with a run off election to be held on February 5th. Councilman Jenkins asked to amend the motion to include at least two polling places for the city’s senior citizens. In 2011, there was a mail only ballot for the 2nd Ward council seat vacated by then-councilman Jason Desjardins. Desjardins resigned in February 2011 over a “conflict of interest” issue when a contract for his tow company with the city of San Bernardino came up for renewal. During that runoff election, now embattled Councilman Jenkins won his bid over running mates John Longville and Jerry Martin. Long Night of Arts and Innovation Brings the Arts and Technology Together

T

he City of Riverside hosted a second successful arts and innovation festival with over 500 people participating in the late night event that took place in over 20 locations in downtown Riverside, including the Fox Performing Arts Center, Riverside Auditorium and Events Center, University of California Riverside (UCR) Culver Center, Riverside Metropolitan Museum, downtown Library, Riverside Arts Museum, the Main Street pedestrian mall, and City Hall. The Long Night of Arts and Innovation featured 700 lectures, performances, and demonstrations by over 135 college professors, arts organizations, musical groups, and businesses. This year’s celebration included culinary demonstrations, a kids discovery zone, and interactive games. The event was inspired by the Long Night of Science in Riverside’s German sister city, Erlangen.

n an effort to encourage civic engagement and participation in the voting process, millennial led organizations Zealous Life and San Bernardino Generation Now held a voter education arts and culture event at Court Street Square in downtown San Bernardino in preparation for the upcoming election in November. The event featured remarks and presentations by some of the city’s local elected leaders and community leaders and featured demonstrations of visual art by San Bernardino based artists. Other organizations supporting the effort included: Inland Congregations United for Change, Young Visionaries, Youth Leadership Academy, and several arts organizations in San Bernardino. I

f you were anywhere near Fontana on Saturday night and wondered what that powerful roar was coming from the Auto Club Speedway, it was the sweet sound of the fastest cars in the world competing in the MAVTV 500 IndyCar World Championship. Saturday’s Championship race was the final stop on a 16 city international racing schedule that includes such demographic opposites as Sãn Paulo, Brazil and Birmingham, Alabama. After 19 weeks of racing in 16 cities the season finale at Auto Club Speedway came down to 250 lightning fast laps around Fontana’s two-mile oval track. Helio Castroneves, season nine winner of Dancing with the Stars and my wife’s favorite in the #3 car was one the favorites to win the championship. Although Castroneves entered the race with only one win this season, many felt his mastery of the oval track would help him power past Scott Dixon, the season’s runaway top driver with four wins this season. IndyCar racing returned to Auto Club for its second season after debuting there in 2012. Last season’s race was held on Labor Day weekend and attendance was hampered by grueling triple digit temperatures. This year IRL moved Fontana to October and made it the season finale. The resulting beautiful October evening didn’t translate into more people. Saturday’s attendance was estimated at roughly 30,000, by any standard, a pitiful showing for a venue that can handle nearly 100,000 fans. Sadly, fans simply don’t know what’s going on with IRL racing. The IndyCar series was born in 1992 when the Indianapolis Speedway created the IndyCar name after years of bickering with CART and USAC the two major sanctioning bodies of the time. When IRL began racing in 1994 it was to be a less-expensive alternative to CART in open wheel competition. The split between IRL and CART obviously divided an already anemic fan base and wounded both bodies badly. Sadly, in my opinion, most auto-heads would agree that open-wheel racing is the most exciting and would support it just as vigorously as the more popular NASCAR racing. One of IndyCar’s success stories is the Long Beach Grand Prix held in late April each year. It has developed a strong following and attracts

thousands to the streets of Long Beach annually. The Auto Club 500 finale could be just as popular given time and a great marketing plan. Saturday evening’s battle between points leaders Helio Castroneves and Scott Dixon turned out to be a thriller. Both drivers entered the race basically tied with Dixon at 546 points and Castroneves with 521and at least four other drivers in striking distance should they falter. Castroneves and Dixon battled all evening with Castroneves nearly catching Dixon until he had to take a pit stop to fix a broken wing with only 25 laps to go. Castroneves couldn’t recover and finished sixth. Dixon turned his attention to red hot Will Power who led 103 of the 250 laps and made the MAVTV 500 IndyCar World Championship his third win of the year. Scott Dixon finished fifth earning enough points to hold off Helio Castetroneves 577 to 550 and won the 2013 IndyCar points title. G. Montgomery can blackvoicenews.com

Craigslist advertisement seeking sex partners that directed respondents of the ad to his former partner, Scott Head. They also allege that Jenkins created a fake internal memo from the San Bernardino Police Department using the names of two high-ranking police officials to appear as though he was also a victim of online harassment. Jenkins computer IP address is what eventually aided investigators in tracing the initial online advertisement along with a private investigator hired by Head to identify who was harassing him and his current boyfriend. The Craigslist ads were linked back to Jenkins at several locations including a computer at his parents’ home and his employer, Riverside County Office of Education where he worked as a special education teacher at Norte Vista High School. leadership at city hall, the news is vindication. “It gives further credence why we started the recall process and why the need for removing all the public officials is important,” Scott Beard, a leader of the San Bernardino Residents for Responsible Government, the group responsible for the recall effort told the Voice. “Obviously there will be a special election for Chas’ ward and it changes the dynamic for the mayor’s race. It would be interesting to see what City Attorney Penman will do, because I’m sure he will try to spin this in his favor. But the bottom line I think it gives us further credibility to why we are doing what we are doing,” he said. Members of the city’s community are skeptical. Ray Butler, owner of Ray’s Unique Barbershop in Moreno Valley told the Voice that the city of Moreno Valley is no stranger to alleged misconduct by the police department citing that prior to the barbershop raids a few years back, anyone of color needed to be aware and cautious of the law enforcement agency. “They do not react as a police department that’s willing to help people,” stated Butler. “I know they are trained to protect themselves first, but you don’t need 10 police officers to jump on a man.” As Johnson’s family begins funeral preparations, investigators are seeking any witnesses who may have left the scene prior to the police arrival.
