Gov. Newsom’s Broadband Initiative Is Bringing Internet Access Statewide to the Digitally Disadvantaged

In October, Gov. Gavin Newsom held a press conference in San Diego County to announce that the construction of the Middle-Mile Broadband Initiative had commenced.

A collaboration between California’s Department of Transportation (Caltrans) and the Department of Technology, the initiative's purpose is to construct a 10,000-mile-long broadband network to provide open internet access statewide by the end of 2026.

The Middle-Mile project was authorized by Senate Bill (SB) 156, announced by Newsom, Senate President pro Tempore Toni G. Atkins (D-San Diego), and Assembly Speaker Anthony Rendon (D-Lakewood) in July of last year.

"California is now one step closer to

making the digital divide a thing of the past," said Newsom. "This is about ensuring that all Californians, no matter the zip code they call home, can be part of the Golden State’s thriving and diverse economy."

Once the network has been constructed, the state will provide funding for "last mile" efforts which refers to infrastructure that connects the network to "end-use" entities such as homes and businesses.

The Middle-Mile Initiative boasts a $6.5 billion budget to extend and improve internet access for "unserved and underserved communities" such as Indigenous American reservations, some low-income neighborhoods, and rural areas.

"So, I really want to underscore that our stance on digital equity is that it's a 21st century civil right," Sunne Wright McPeak, President and CEO of the California Emerging Technology Fund (CETF), told California Black Media (CBM).

CETF is a non-profit committed to closing the digital divide. It is the only non-state agency serving on the California Broadband Council which identifies and deploys resources for internet access.

"We live in this whole space around the most digitally disadvantaged, which are often the most economically disadvantaged," said McPeak. "That persistent concentrated poverty

Much Anticipated MediCal Provider Manual for Doula Services Benefit Now Available

The Department of Health Care Services (DHCS) formally published the long-awaited Medi-Cal Provider Manual for the doula services benefit just before the benefit takes effect on Jan. 1, 2023.

After months of deliberation, revision and commentary among the DHCS stakeholder workgroup, an assembly of more than a dozen maternal health advocates, doulas, birth workers and community-based organizations, and the DHCS benefits division, the provider manual formally defines the scope of doula services, categorizes covered services under both the fee-for-service and managed care delivery systems. It also outlines doula enrollment eligibility criteria.

“The Provider Manual had really impactful stakeholder engagement that is crucial to ensuring the benefit is as equitable and sustainable as

possible. National Health Law Program (NHeLP) is very grateful to work with a wonderful group of community-based doulas and stakeholders who have shared their time, insights and expertise,” NHeLP Health Policy Analyst Alexis Robles-Fadet said via email.

On November 7, DHCS submitted the State Plan Amendment (SPA 22-0002) for doula services to the Centers for Medicare and Medicaid Services. The SPA covers a broad description of covered services under the doula benefit. Whenever the state plans to make a change to its program, an SPA must be submitted to CMS for federal approval. CMS has until February 5 (90 days) to review the SPA.

Civil Rights Leader Shares Thoughts on LA City Council Controversy as Protests Against De Leon Continue

The LA City Council continues to live with the after effects of a secretly recorded private conversation between several (now former) city council and labor leaders in which disparaging comments were made about almost every constituency in Los Angeles. The conversation centered around redistricting and political horse trading.

In the immediate aftermath of the tape becoming public, the President of the L.A. City Council Nury Martinez resigned from her seat, as did the President of the United Federation of Labor, Ron Herrera. Protests and requests for the resignations of those involved and censure followed. All of this occurred during the run up to an already contentious election.

After the Election

In June, before the tape surfaced, L.A. City Councilmember Gil Cedillo (one of those on the secret recording) had already lost his bid for reelection so he refused to resign, while the other, Kevin de Leon, refused to vacate his seat.

Councilmember de Leon's refusal to resign despite requests from both officials and the public have led to sustained protests in front of the councilmember’s home and city hall, interrupting council business. A scuffle between protesters and de Leon prompted newly elected LA City Council President Krekorian to hint at taking further action against protesters.

The Interview

Dr. James Thomas, a professor at Cal State University Los Angeles and President of the San Fernando Valley Chapter of NAACP recently spoke with Black Voice News about Councilmember Kevin de Leon and the L.A. City Council.

Thomas, who has been present at several protests, has decided to petition for a special election for Council District Six, Nury Martinez’s seat, and to run for City Council. Thomas said he does not expect the protests to end any time soon.

BVN: What damage do you think this controversy has done to the relationship between Black and Brown communities in Los Angeles?

JT: What I saw Kevin de Leon doing was stirring up a Black versus Brown atmosphere that doesn't really exist. Folks like myself and others have been working hard in solidarity with the Black and Brown communities. I belong to a Black and Brown Clergy group. I went down to the border around Christmas Eve 2020. We talked to folks and ministered to people at the encampments, which was unbelievable to me because we were told by Donald Trump these were drug dealers. These were

women, some of whom were pregnant women, and children. These were not dangerous people at all. Yet, they were being contained by guards who I thought were the military. We have been working with Brown and Indigenous people for quite some time. If Black and Brown folks are going to have issues, it should not be because of something a politician does or says because the truth is, neither have fared well under Kevin de Leon’s leadership.

Communities of color have slightly less broadband access than White communities. While 17 per cent of Black households are without access to internet, 13 per cent of White households lack access, according to data from the U.S. Census Bureau's 2020 American Community Survey (ACS).

"Beginning construction on the Middle-Mile network is a significant step toward broadband equity and providing all Californians the opportunity to access critical information," Secretary of the California Transportation Agency Toks Omishakin said in a press release.

"High-speed internet is much more than a connection – it’s a lifeline that families need to work, learn, and access critical services," Omishakin continued.

McPeak asserts that high poverty urban areas are hard to reach and suggests that broadband infrastructure often neglects these neighborhoods.

Another piece of the puzzle is the private sector, California State Superintendent of Public Instruction Tony Thurmond told CBM.

"And because of the way internet service providers and other companies have tried to capitalize on the internet, that means that the U.S. has communities that have been without access to the internet for a long time, even though there's so much resourcing available," Thurmond said.

McPeak echoed the assessment and suggested how state officials can convince private companies to aid in providing open access for Californians by providing incentives to do so.

"One thing the state could do to get much more cooperation is what I call ‘step up or step aside,'" said McPeak. "And that would be powerful if there was that kind of bold leadership that's on the deployment side."

Thurmond called these companies to action to bolster state efforts.

"I think that the state is doing everything that it can, and our office is certainly taking the lead as it relates to our students, but we need everyone to help," Thurmond said. "And that means internet companies have to find ways to help build out pieces of the infrastructure that will reach the homes of Californians."

It’s the Law: California Enters 2023 With A Long List of New Rules and Regulations

While America already leads the world in laws and incarcerations, states never miss an opportunity each year to add a new set of “do’s and don’ts” to the ever-growing list of enforceable regulations. Once again, California is doing its part to keep America in first place with a list of new laws effective January 1, 2023 to regulate citizen behavior and provide an enhanced sense of safety in local communities.

Recognition

Beginning in 2023, California will recognize Juneteenth as a new state holiday on June 19. (AB-1655 ).

April 24 will be officially recognized as Genocide Remembrance Day in California. (AB-1801).

Also this year, the requirement for the governor to annually declare Lunar New Year as a state holiday is discontinued. (AB-2596).

Walking and riding

Jaywalking is now decriminalized in California. As a result, pedestrians can now legally cross the street outside of designated intersections under safe conditions. (AB-2147).

There are several changes to bicycle and vehicle laws in 2023, including bikes being allowed to cross streets on pedestrian signals, cities and counties can no longer enforce bicycle license laws. Also, drivers can now change lanes, when possible, to pass bicycles. (AB-1909).

Women and their bodies

California is now shielding pregnant people from both criminal and civil liability in the event of a miscarriage, stillbirth or self-managed abortion. (AB 2223).

In addition, employees are now protected from discrimination based on their reproductive health decisions, including using contraceptives. (AB 2223).

The Contraceptive Equity Act has removed requirements for employees to disclose those decisions as a condition of employment. (SB523).

Gender Bias

Families with transgender children and teens who come to California seeking medical treatment are now protected from out-of-state subpoenas or warrants. The same holds true for families that move to California to avoid consequences for having already sought such treatment elsewhere. (SB-107).

It is now illegal for companies to charge different prices for products based on the gender they are marketed to. This practice is referred to as a “pink tax”. (AB-1287).

Employment

The minimum wage in California increased on January 1, 2023 from $14 to $15.50 per hour. (SB-3).

It is now illegal for an employer to refuse to grant bereavement leave for up to 5 days for an employee upon the death of a family member. (AB-1949).

Hotels are now subjected to civil penalties if employees fail to inform police officials of sex trafficking at their establishment. (AB-1788).

California farmworkers now have expanded protections that allow them to vote by mail in union elections, rather than being forced to vote in person. (AB-2183).

An applicant no longer needs to be a citizen or permanent resident of the United States to become a police officer in California. You must, however, be legally authorized to work in the U.S.

“This change is needed to allow DHCS to continue working with stakeholders to further define and develop the benefit, implement needed changes to the Provider Application and Verification for Enrollment (PAVE) online system to allow doulas to enroll as Medi-Cal providers, seek and obtain federal approval and give Medi-Cal managed care plans additional time to plan for and implement the benefit. The new effective date will also allow for a more robust stakeholder engagement process to assist DHCS with implementation,” according to the DHCS website.

DHCS is also providing a demonstration series for doula providers to learn how to submit enrollment applications on the PAVE portal. Doulas or doula groups must enroll using the PAVE portal to submit fee-forservice claims. The first demonstration, “Introduction to PAVE for Doula Providers,” is available online. The second demonstration will be held virtually as a live session on Jan. 10, 2023 where doulas will be able to ask questions live and receive real-time responses.

As the launch of the doula services benefit draws closer, doulas and community-based organizations will be able to submit their applications to enroll as Medi-Cal providers, allowing them to formally bill for their services and support families with Medi-Cal. The majority of covered populations in California are served through Medi-Cal managed care plans, noted René Mollow, Deputy Director of Health Care Benefits & Eligibility, in an interview back in September.

Doulas will need required documents and/or attestations and will have to obtain a National Provider Identifier (NPI).

Qualifications for enrollment

Qualifications for enrollment for all doulas include: a copy of stateissued identification that demonstrates that doula is at least 18 years old; Adult CPR certification of completion by American Red Cross or American Heart Association; Infant CPR certification of completion by American Red Cross or American Heart Association; and certificate of completion or attestation of Health Insurance Portability and Accountability Act (HIPAA) Training.

Additionally, doulas will be required to submit specific qualifications depending on which training pathway they enroll in (Training Pathway or Experience Pathway). Doula services also require a written recommendation by a physician or other licensed practitioner “of the healing arts acting within their scope of practice under state law.” However, the licensed provider who submits a recommendation does not need to be enrolled in Medi-Cal or be a network provider within the beneficiary’s managed care plan.

Medi-Cal training for new doula benefit

Ahead of the new year, local organizations are preparing doulas, birthworkers and community organizations by hosting Medi-Cal training for the new doula benefit. Inland Empire Health Plan (IEHP) and Riverside Community Health Foundation (RCHF) hosted a Doula MediCal Provider Transition Training earlier this month to discuss the provider

Sykes attended the RCHF training to learn more about the Medi-Cal doula benefit. “RCHF has been great in providing timely and meaningful information on how to contract with the providers within the California Medi-Cal system for doula services.”

Sykes has been supporting families during birth for about 12 years in an unofficial capacity, but has been working as a doula in an official capacity for the last three years. Sykes is also part of the Sankofa Birthworker’s Collective of Inland Empire, a community-based organization comprised of birth workers who provide support and education to Black birthing people throughout Riverside and San Bernardino Counties. JT: I decided to get into the race because there needs to be an adult in the room and it seems like there aren't any. I think Nury Martinez did the right thing when she resigned. I think someone who is running should focus on healing, bringing the community together and focusing on the needs of the constituency. This is the problem with elected officials, they get into office and they forget the people who put them there. I believe you can be an outstanding public official by doing the things the community wants you to do.

Anyone convicted of misdemeanor child or elder abuse on or after Jan. 1, 2023, will be prohibited from possessing a firearm in California. Community impacts

In an effort to provide improved connectivity for low-income and underserved communities a blueprint will be created for deploying broadband, including expanded wireless access, throughout the state. (SB-717).

The Community Assistance, Recovery and Empowerment Act now allows family members, first responders and clinicians to seek a judicial order to treat individuals diagnosed with schizophrenia and other psychotic disorders. The treatment could include medication, housing and therapy. Those who refuse treatment could be placed in a conservatorship and ordered to comply with the treatment. (SB-1338).

An audit of all surplus state property is required to determine what land is suitable for housing construction. (SB 561).

The operation of California’s last functioning nuclear plant at Diablo Canyon may be extended by as much as five years. The extension authorization includes a loan of $1.4 billion from the state to Pacific Gas & Electric (PG&E) to operate it during the extension. SBCUSD’s, continued from page 3

five inductees, I was reminded of potential opportunities our students may never benefit from as a result of Doc’s loss from SBCUSD.

The Bakersfield City School District Hall of Fame says it recognizes former students noted for their professional accomplishments and “community members who distinguished themselves through their service to the district”. According to reports, the program is meant to inspire BCSD students to achieve their goals through a life of strong purpose and value.

Ervin served as BCSD superintendent for five years, beginning in 2016, until he took the role with SBCUSD in 2021. Prior to that, he spent 25 years as an educator and administrator.

Ervin, who spent his career championing equity and access to economically disadvantaged students from culturally diverse backgrounds, was also noted to have held district staff to high expectations

In addition to his accomplished career in education, Ervin was inducted to the Hall of Fame for having “established curricular, instructional and operational systems and structures to provide system wide sustainability and support teaching and learning”.

Such acclaim makes me wonder what opportunities for greater success are being missed by SBCUSD students, teachers and administrators as a result of Ervin’s early and strained departure. We will never know.

Of course, this is just my opinion. I’m keeping it real.
