hen California Governor Gavin Newsom released his Safe Schools for All plan recently, he provided backup information about studies in support of a strategy for in-person learning in the spring. As the California Department of Public Health noted, “[The studies were] chosen for their rigor, rather than because they support a specific position regarding whether or not it is safe to be open.” The background rationale discusses why children get COVID-19 less frequently and experience a less severe form of the disease; notes how children with COVID-19 most often get it from someone in their household; highlights transmission among or from students is uncommon; and stresses low risk of transmission in elementary schools. The CDPH acknowledged its summary was not comprehensive but focused instead on the best evidence it had to inform Californians

regarding the safety of inperson instruction for students in grades 6 and below, but it left me wondering whether it considered a Centers for Disease Control and Prevention (CDC) report released in September that found a majority of kids in the United States dying of COVID-19 are Black, Hispanic, or Indigenous? Certainly, the CDC report aligned with what the CDPH stated about very few children who became sick with the coronavirus, die. During the study period this proved true—at (.03%), the deaths averaged less than one percent. However, very few of the children counted among the dead were White. Certainly if one of those counted among the lost was your child, the percentage would be meaningless. Yet, the CDC went further and continued on page 16

Highly Contagious Strain of Coronavirus Found in San Bernardino Two suspected cases of what is being described as a more highly contagious strain of the coronavirus, originally identified in England, was detected in San Bernardino County on Friday. The cases, identified among members of the same household in Big Bear, brought the total number of cases of this strain to at least six cases in Southern California. The COVID-19 variant strain labelled B117, seems to spread more easily and quickly according to San Bernardino County Health Officer Michael Sequeira who stressed how this makes following all safety practices related to curbing the spread more important than ever.� Word of the strain being found in Big Bear came only two days after Governor Gavin Newsom announced California’s first known case of the B117 variant was found in San Diego.

Riverside County Reflects on Those Lost to the Virus S.E. Williams | Excutive Editior

A

s Riverside County closed the books on 2020, leaders acknowledged the grievous loss of local residents to the deadly coronavirus. By Dec. 30, more than 1,985 individuals in the county had died from the illness including two children under the age of 18 years. Reflecting on these losses, county officials reminded residents how everyone collectively contributes to slowing the spread of the virus. The first coronavirus-related death in Riverside County was reported March 15, 2020 when an Indio resident in his late 70s lost his life to the illness. The two youngest deaths included a 12-year-old from Western Riverside County and a 15-year-old from the central part of the region. The oldest deaths included three, 104-yearold Riverside County residents—a man from Corona, another from Riverside and a female from the community of Mecca. In addition, the county has bid farewell to four county employees who died of the virus including two deputies, one probation officer and one engineer. “This disease doesn’t discriminate,” said Kim Saruwatari, Director of the Riverside University Department of Public Health. “We’ve seen deaths in the young and old. We’ve seen couples, family members and healthcare workers die from this disease. These deaths, combined with mental health impacts and economic losses, are painful reminders of how this disease has cost all of us.” Nine months into the pandemic, deaths among racial and ethnic minorities remain disproportionately higher among Native Hawaiian/Pacific Islander, Latino and Black residents. “Our hearts are with families, friends and neighbors who are grieving the loss of an important and special person in their lives,” said Riverside County Board Chair and Fourth District Supervisor V. Manuel Perez, expressing his sentiments about the magnitude of loss. “After a year of tragedy and hardship, we have hope for a better 2021. We remember and honor all Riverside County residents who have passed

from coronavirus this year and thank all the frontline workers and all who are doing their part to help overcome this pandemic.” In addition to COVID-19 related losses, the county experienced a dramatic increase in the number of fatal overdoses, an increase of 26.6% over 2019. The unemployment rate is also cause for concern, having risen to nine percent in December. This equates to the loss of 107,000

jobs. “Taking simple actions like wearing a mask, stop gathering with others outside the household and getting the vaccine will protect yourself and others from the virus,” Jose Arballo Jr. of the Riverside University Health System reminded residents. N E W S I N B R I E F Jury Trial Suspension Extended in Riverside County When the Southern California Region fell below the 15% ICU bed capacity threshold, triggering application of the COVID-19 stay-at-home order in Riverside County on Dec. 6, the following day Riverside County Superior Court suspended jury trials through Dec. 31, 2020. Currently, ICU bed capacity remains below 15% in the county and across Southern California as well. In response, the court found it necessary to extend its jury trial suspension order through Jan. 29, 2021. This order is only applicable to jury trials that have not commenced and does not impact any jury trials already in progress. Those, according to court officials, will be addressed on a case-by-case basis. The California Office of The Small Business Advocate (CalOSBA), which operates under the Governor’s Office of Business and Economic Development (GO-Biz), says small businesses and non-profit organizations across California that have been affected by the COVID-19 pandemic can begin submitting applications for relief grants ranging from $5,000 to $25,000. The application process begins now and runs through Jan. 8, 2021. The governor and the Legislature first announced the program Nov. 30. The funding to the organizations will be administered through Lendistry, a Black-ledand-operated financial firm based in Los Angeles. Lendistry is designated both a Community Development Financial Institution (CDFI) and a Community Development Entity (CDE) small business and commercial real estate lender. “As an organization dedicated to efficiently providing capital to underserved small businesses, and with a deeply experienced senior management team that mirrors the diversity of our home state of California, Lendistry is proud to partner with the CalOSBA in this bold and critical effort,” said Everett K. Sands, Lendistry’s founder and CEO. Sands, who has broad experience in small business and commercial lending, says since the onset of the COVID-19 pandemic, Lendistry has assisted over 19,000 small businesses in a dozen states. The organization has also deployed nearly a half-billion dollars in capital. “We are bringing the full force of our technology, expertise and relationships with partner CDFIs and community organizations to bear on CalOSBA’s landmark commitment to California’s small businesses,” he said. window for accepting applications to ensure the process is inclusive for disadvantaged minority firms. “Small businesses form the economic heart of every community. Despite Supreme Court Appeal, San Bernardino Faces Extended Stay-at-Home Order

s the coronavirus exploded across Southern California, San Bernardino County officials pushed back against state efforts to curtail its spread with the implementation of a regional stay-at-home order in early December. In an appeal to the California Supreme Court, local leaders argued the county is better positioned to make such decisions. In doing so, the board petitioned the court to find Gov. Gavin Newsom exceeded his authority under the California Emergency Services Act when he called for a stay-at-home order. Despite this effort, and though the Supreme Court is yet to respond, Newsom extended the stay-at-home order for all Southern California on New Year’s Eve. “If it is concluded that the act allows him to do so, the act is unconstitutional as it permits the delegation of the Legislature’s powers to the executive branch in violation of the California Constitution,” Board Chair Curt Hagman said in a statement. The Board further argued the county’s

size and geographic diversity should allow for fewer restrictions in communities with lower COVID-19 metrics than the county at large. Former county supervisor Josie Gonzales joined the Supreme Court filing as a private citizen which also accused the governor of having failed to produce science or data to support COVID-19 restrictions designed to address the current trajectory of the pandemic in the state. According to the county, “[It] seeks to reclaim its constitutional authority the board further claimed its constitutional authority to tailor regulations and orders which are specific to its residents based on facts which are unique to their locations rather than subject its residents to overbroad multi county governor implemented regionalized lockdowns.” Despite these protestations the Supreme Court has yet to respond, and as noted above, on New Year’s Eve the California Department of Public Health provided an update declaring that “(b)ased on ICU data, four regions, San Joaquin Valley, Southern California, Greater Sacramento continued on page 17

Incentives for Select Healthcare Workers

ew Year’s Day brought sobering news for Californians—COVID-19 was taking the life of one Californian every 10 minutes. The sobering number of those afflicted with the coronavirus is overwhelming the healthcare system and exhausting its workers who risk exposure to the deadly virus each time they report to work. It is no wonder county officials worked with employee representatives to consider financial incentives as a way of acknowledging the risks and sacrifices these frontline healthcare workers are making. The San Bernardino County Board of Supervisors is expected to give final approval to three labor related side-letter agreements to provide selected healthcare employees employed by the county with COVID incentive differentials. Approval of the side letters will authorize these incentives for three separate work groups beginning with the California Nurses Association (CNA). The agreement with CNA will provide eligible registered nurses assigned to the Arrowhead Regional Medical Center (ARMC) an extra shift incentive. Those eligible include nurses in Inpatient Assignments,

Emergency Department, Trauma Unit, Dialysis, G.I. Lab and Cardiac Care Units. The agreement will exclude nurses who work in the Behavioral Health Unit and in non-inpatient areas such as case management, clinics, employee health, etc. For Nurse Unit employees, an extra shift is defined as a shift that the nurse was not regularly scheduled to work during a pay period; while for Per Diem Nurse Unit employees, an extra shift begins once a nurse has exceeded six scheduled shifts during a pay period. Nurses who work the extra shift shall receive a differential of $15 per hour for all hours worked during that extra shift. The differential, however, will not apply if the nurse calls off on one of their scheduled work shifts or takes an educational day during a pay period they have worked the extra shift. On the other hand, the incentive will apply when a nurse takes pre-scheduled vacation, holiday, PTO or other compensatory time and works an extra shift. Trial Set to Begin in $25 Million Student Claim Against Cal State San Bernardino S.E. Williams | Executive Editor

eginning Friday, Jan. 15, the California State University system will begin to defend itself in a $25-million case being described as possibly the largest civil trial in San Bernardino County since the onset of the coronavirus pandemic. The case is rooted in an incident from Sept. 26, 2018 when Marissa Freeman—who, at the time, was a 19-year-old student at California State University San Bernardino (CSUSB)—allegedly sustained brain and organ damage while participating in a class assignment. That day as part of her Kinesiology class assignment, Freeman and her classmates were required to take a run (approximately 5K) through the school campus during which she purportedly suffered a heat stroke and collapsed. The jog was part of a physical fitness test on the first day of class. Weather reports the day of the incident indicate temperatures reached a high of 93 degrees. According to court documents, her brain injury was

The school also claims the students were advised by the instructor to jog or walk at their own pace, to hydrate, stop for shade and not to push themselves. The case became more complicated when CSU cross-sued the first responders and medical team at the hospital who treated Freeman advising it was their negligence in treating Freeman that supposedly caused her injuries, not the actions of the class instructor who made the jogging assignment. Late last year CSU made an emergency request to delay the start of the trial claiming it had the potential to become a COVID-19 super-spreader event according to a report by the Southern California News Group. The request made its way to the California Supreme Court. However, on Nov. 24, the court denied the request and the case moved forward with the selection of a jury.

so severe she now requires around-the-clock care. In late January 2019, Freeman filed suit naming CSU and her Kinesiology professor, Angel Castro, as defendants. She claimed they not only failed to protect and warn her of the dangers of exercising in the heat, but also failed to provide medical care in a timely manner. Freeman’s attorney has noted there were other students who had no experience running long distances in hot weather. Provided the case precedes on Jan. 15 as planned, court officials have assured precautions are in place to guard against COVID-19. They include the installation of plexiglass dividers to separate staff from witnesses. Everyone involved in the trial must wear face masks and witnesses will be provided face shields and disposable covers for the microphone. In addition, everyone involved in the case will be required to sit no less than six feet apart and hand sanitizer will be readily available. Court documents also indicate witnesses who do not wish to appear in person will be allowed to testify remotely via Zoom. When the case goes to the jury for deliberation those activities will occur in the courtroom itself rather than a smaller deliberation room to allow for adequate social distancing. The trial is expected to last approximately six weeks. In addition to seeking a minimum of $25 million in economic damages, Freeman also seeks additional damages for pain and suffering.

Harriet Tubman’s Cabin: Finding the Home of America’s Real Wonder Woman

raminta Ross (1820-1913) known to the world as Harriet Tubman, was a conductor on the underground railroad, a nurse, a spy and leader of the Combahee River Raid. Considered the “Moses of her People,” Harriet was an exceptional human being—the real-life Wonder Woman. Had she been White, we would be able to glimpse her image from countless films, plays and stories. We would know where she slept. There would be places to pay homage. Until recently, this was only a dream. Now, a new archaeological exploration is giving hope of one day locating the home of one of America's true heroines. Harriet's life, unbelievable in a cinematic sense, echoes Joseph Campbell's "hero’s journey." Struck in the head while young, Harriet would be tormented with significant physical trauma for the rest of her life. In the book Harriet Tubman: A Life in American History, Kerry Walters writes: “Slaves were always subject to physical abuse, usually by overseers or masters, but not infrequently by mistresses and even White children... Harriet Tubman was viciously used by a woman to whom she was hired out when she was still only a child. At times, slaves were forced to physically assault fellow slaves. Solomon Northup, who escaped from slavery and wrote a memoir entitled Twelve Years a Slave, records being required to whip another slave with supervised savagery while his master's entire family, including small children, watched the proceedings with what struck him as sadistic pleasure.

Beaten slaves sometimes brutalized their fellows, and White children who observed their elders abusing slaves often fell into similar modes of behavior.” The assault left Harriet subject to seizures and visions making her story that much more remarkable. Following in her footsteps has been a long process. According to an Atlas Obscura story entitled "The Mystery of Harriet Tubman's Family Cabin," “[T]he excavations are taking place in the Blackwater National Wildlife Refuge, in Dorchester County, Maryland where Harriet grew up. The hunt is being led by Julie Schablitsky, chief archaeologist at the Maryland Department of Transportation State Highway Administration.” The search for Ben Ross's (Harriet's father) cabin began twenty years ago. By piecing together local oral history, newspaper articles and historic records, they now believe they're looking in a promising area, after searching for the Ross cabin in an area long believed to be her home with no luck. Governor Promises “Safe Schools for All” Staff | VOICE

ooking to the spring, California Governor Gavin Newsom has outlined a framework to continue and expand safe in-person instruction that includes a two-billion-dollar early action proposal to support school safety measures. The plan will support school efforts to continue operating safely in-person and to expand the number of schools safely resuming in-person instruction. The strategy rests on four platforms. They include funding to support safe reopening; safety and mitigation measures for classrooms; hands-on oversight and assistance for schools, and transparency and accountability for families and school staff. In addition to the new education safety framework, the governor announced a crossagency Safe Schools for All Team to be headed by UCSF pediatrician and expert on school safety for COVID-19, Dr. Naomi Bardach. Newsom claimed his education strategy is, “Informed by growing evidence of the decreased risks and increased benefits of inperson instruction—especially for our youngest students.” Developed in partnership with the Legislature, the governor also announced plans to propose an early action package to ensure schools have the resources necessary to successfully implement key safety precautions and mitigation measures. Components of the plan will be launched in the coming weeks. “As a father of four, I know firsthand what parents, educators and pediatricians continue to say: in-person is the best setting to meet not only the learning needs, but the mental health and social-emotional needs of our kids,” said Newsom. “In the midst of this pandemic, my Administration is focused on getting students back into the classroom in a way that leads with student and teacher health. By focusing on a phased approach with virus mitigation and prevention at the center, we can begin to return our kids to school to support learning needs and restore the benefits of in-person instruction. It’s especially important for our youngest kids, those with disabilities, those with limited

access to technology at home and those who have struggled more than most with distance learning.” The overarching strategy prioritizes bringing back the youngest students (TK-2) and those who are most vulnerable first as younger children are at a lower risk of contracting and transmitting

K E E P I N G revealed a staggering racial disparity regarding children and COVID-19. Among the more than 390,000 coronavirus cases and 121 deaths among those under the age of 21 between February 12 and July 31, fully 78% were children of color. Although the Kids Count Data Center reports 50 % of children in this country are White, White children represent only 14% of childhood COVID-19 deaths. Founder of Advancing Health Equity, Dr. Uché, Blackstock, called the data horrifying but not surprising and stressed to the publication Insider, "Where you see marginalization and disadvantage, you're going to find coronavirus." Studies have shown correlations between segregated neighborhoods created from a history of relining policies, and higher rates of pre-existing conditions that make COVID-19 harder to fight. Most children who have died from the virus to date according to the CDC, suffered from at least one underlying health condition. The two most common were chronic lung issues (like asthma, for example) and obesity—conditions

associated with living in communities historically disadvantaged and marginalized. The CDC has offered the usual “blame the victim” explanation for why children of color are dying from the virus in greater numbers than White children, noting it is because they live in households with adults who are more likely to be essential workers. For minority parents the decision of whether to return their children to classroom environments is complex and nuanced particularly when placed in the context of education equity in general and most specifically regarding COVID-19. Though the risks may be limited particularly for White children, most children of color, like their parents, are at higher risk for coronavirus illness and death. Looking to the spring, parents of color should continue monitoring COVID-19 data and its potential impact on children of color in the coming months. other politician to guide your actions regarding your children when it comes to education during this out-of-control pandemic—investigate and decide for yourself. We all look forward to the day this nation returns to a new normal. On that day we can only hope our children, when recalling their memories of the age of COVID-19 to their own children, will speak with reverence of the hard decisions their parent(s) made to keep them safe. State officials reminded ICU projections are calculated daily for regions that are eligible to exit the order. On Dec. 31, 2020, ICU capacity projections across Southern California were zero. This projection was based on four factors including “[the] current estimated regional ICU capacity

available, measure of current community transmission, current regional case rates and the proportion of ICU cases being admitted.” The State of California is broken into five regions for COVID-19 reopening consideration. They included Northern California, Greater Sacramento, Bay Area, San Joaquin Valley and Southern California. When a region's remaining ICU capacity drops below 15%, every municipality within the region must abide by the current stay-at-home order. Counties can move into the stay-at-home order sooner than the rest of their region, but not slower. In addition to the regional alignments, counties must still adhere to the four-tier reopening system established earlier in the year. The four tiers include: yellow, orange, red and purple. The restrictions within these tiers range from minimal COVID-19 spread in the yellow tier that allows for nearly all businesses to reopen indoor operations to the most restrictive purple tier indicating there is widespread COVID-19 transmission in the county and almost all businesses are prohibited from indoor operations. It is important to know even if a county is in a region not under a region-wide stay-athome order but the county itself is in the purple tier, the stay-at-home order still applies to the specific county in the purple tier. CDPH reminded California residents decreasing community transmission and increasing the health system capacity can help a region's projected ICU capacity so they can exit the stay-at-home order.

Where Riverside’s Food Insecure Can Find Assistance

F

ood insecurity is an economic and social indicator of a community’s overall health. In mid-summer, Riverside County’s SHAPE (Strategic Health Alliance Pursuing Equity) initiative reported at least 10% of area residents were food insecure—a number certain to have increased due to rising unemployment from the continuing spread of COVID-19. The U.S. Department of Agriculture defines food insecurity as limited or uncertain availability of nutritionally adequate foods or uncertain ability to acquire these foods in socially acceptable ways. There is little doubt poverty and unemployment are often predictors of food insecurity and data shows one in four Americans worry about having enough money to put food on the table. Food insecurity is also associated with chronic health problems in adults. These problems include conditions like diabetes, heart disease, high blood pressure, hyperlipidemia, obesity and mental health issues including depression.

Public health crises like the COVID-19 pandemic dramatically impact the health of socially vulnerable communities and, as noted by the University of California Riverside’s School of Public Policy, “The current COVID-19 pandemic has posed increased challenges for vulnerable Californians to access food.
