Colton City Council Hears Community Concerns
Votes to Maintain the TripleExtended Warehouse Moratorium Until It Expires in May 2023

In May 2022, the City of Colton declared an extension of its warehouse moratorium that began May 3, 2021, for a third time. Earlier this month, the possibility of an early termination of the moratorium was put on the table.
Since 2010, approximately 100 warehouses have been built across the Inland Empire, encompassing more than 12,500 acres, according to a data tool developed by researchers at the Robert Redford Conservancy for Southern California Sustainability.
Colton is one of a half-dozen cities in the Inland Empire to enact a moratorium against warehousing, after the community made their concerns known.
A period to identify solutions
A moratorium is a period of time that allows for expert assessment of the impact of the warehousing industry on the community. During the moratorium new warehouse expansion projects are halted. Once the findings and recommendations are provided to the City Council, a moratorium can be terminated. On Tuesday, Feb. 7, Colton City Council Members and residents gathered to discuss and vote on the possibilities of ending the moratorium earlier than planned.
At the beginning of the moratorium period in May 2022, an Ad Hoc committee was established to assess the impacts of warehouse development in Colton and develop recommendations that would benefit the community.
The committee met several times and drafted proposed regulations which were presented to the council for review. After taking the council’s initial feedback into consideration and revising their recommended regulations, the committee
disbanded. However, the item was not brought back to the council for either approval or further direction until the Feb. 7 City Council meeting.
During the meeting, Colton City Council members voted to allow the moratorium to continue until the initial end date of May 3, 2023. They also voted to adopt the recommendations – which include a 300 foot buffer zone between homes and schools as well as updated guidelines for warehouse design, parking, noise, and operational standards –developed by the Ad Hoc committee through its assessment of the warehousing industry’s impact on Colton.
All council members, except Mayor Frank Navarro, voted in favor of keeping the May 2023 termination date.
Environmental activists agreed that the City Council heard the community’s desire to extend
a halt on warehouses for as long as possible. However, Colton community members explained that their experiences show that moratoriums are not necessarily a definite or viable solution.
Some community members remain concerned
“[A lot of] community members are kind of annoyed and questioning… Why would you end it [the moratorium] and why does it have to end?” explained Marven Norman, the policy coordinator for Community Center for Action and Environmental Justice. He said, in theory, a moratorium is a window of time that allows for research and policy development. “It’s an assessment period, [that tells us] this is what’s happening and this is what we can do about it.”

Racist bullying incidents involving Black students at a school in Upland has caused great concern in the community. Most recently, racist drawings were given to a sixth grade girl in a Pepper Tree Elementary School classroom. One of the drawings stated “You’re my favorite monkey,” and another read “To my favorite cotton picker.”

Unfortunately, this is not the first time that Upland students have experienced racism. Just last year, a teacher was placed on leave after making anti-Asian comments during Lunar New Year celebrations at another school in the district.
According to an initial report, parents of students at the school are demanding action after it was discovered that this type of harassment has been ongoing.
“I’m hoping that the district does not brush this under the rug as they’ve brushed issues under the rug in the past,” said the school’s PTA president, Robin Allen. “We want to know what zero-tolerance means. This is not the first time a situation like this has happened. It’s not going to be the last time that this situation happens, but the most important thing is our response to the situation,” she said.
In response to the harassment and the ensuing criticism, the Upland Unified School District (UUSD) released a statement
reaffirming its commitment to diversity, equity, and inclusion (DEI).
The district clarified that the behavior was not part of any classroom assignment or activity and that they have taken disciplinary action and are investigating the incident further. UUSD says it remains committed to creating positive change and ensuring equitable learning for all students through ongoing efforts.
The UUSD has implemented several initiatives to promote DEI values, including revising policies on bullying, establishing an
equity task force, and providing ongoing training to administrators and staff on restorative practices and positive behavioral interventions and supports (PBIS). Additionally, the district has established an inclusion task force to address the needs of students with disabilities and promote inclusive environments.
The district has also taken steps to increase its diverse workforce, promote cultural proficiency, and celebrate diversity through cultural celebrations and learning experiences.

Op Ed: Big Business Must Stop Taking Big Tobacco Money

The Backstory
A 1953 study by Roper, B.W. found that only five percent of African Americans smoked menthol cigarettes. A 1968 poll of People’s Cigarette Smoking Habits and Attitudes by Philip Morris showed that menthol use among

It’s hard to believe that with the amount of damage that the tobacco industry has inflicted on the Black community, that there are still Black organizations accepting their funding. By doing so, these Black organizations enable the tobacco industry to portray themselves as allies to our community. They help silence our voices and efforts aimed at encouraging policymakers to take specific steps to protect our people, thus becoming complicit in our death and disease.
The problem with accepting these funds is the tobacco industry has a history of targeting and exploiting vulnerable communities, especially Black communities, through predatory advertising and marketing tactics. Our people must be aware that accepting money from the tobacco industry contributes to the ongoing exploitation of our people through their predatory practices of marketing menthol cigarettes and flavored cigars.
The African American Control Tobacco Council is calling on Black organizations to be
Blacks had almost tripled to 14 percent. A report by Brown and Williamson in 1978 found that it had tripled again to 42 percent. By the 2000’s, over 80 percent of Black smokers used menthol cigarettes.
Today, 85 percent of Black adults and 94 percent of Black youth who smoke are using menthol products. These striking statistics arise from the success of the industry’s predatory marketing of these products in our community, where there are more advertisements, and most disturbingly, menthol cigarettes are cheaper compared to other communities. In 2022, the use of cigarettes, cigars and cigarillos was highest among Black youth. These practices, coupled with buying the silence of some Black spokespersons for the past 50 years, have led to Black Americans dying disproportionately from

was taken to task for failing to protect those in custody during COVID-19, he allegedly promoted his brother over candidates with more qualifications, etc.
The list of grievances against the Riverside County Sheriff’s Department (RCSD) under Bianco’s leadership are as long as his arrogance and ignorance.
As Bonta noted, the investigation “will seek to determine whether RCSD has engaged in a pattern or practice of unconstitutional policing amid deeply concerning allegations relating to conditions of confinement in its jail facilities, excessive force, and other misconduct.”
Bianco believes it is all a witch hunt. Well, we will see. I think in his hubris he underestimated what can happen when a determined population bands together in pursuit of justice.
Bianco continues to believe his own hype regarding his reelection in a non-presidential year, gloating in his victory as if it resulted from some brilliant campaign strategy propelled by a delusion that it was an overwhelming vote of confidence from the community. This assessment, of course, is a result of his small mindedness in combination with his over inflated ego.
It does not take a political genius to know
that the election results actually evolved from a perverse coalition of historical low voter turnouts in non-presidential election cycles, combined with the electoral benefits of incumbency and the strong financial backing of police unions. This is what ensured his reelection. Bianco obviously took his victory as a green light to maintain his dismissive attitude toward the growing concerns of the community.
Now, rather than being humbled and humiliated by the prospect of being investigated and potentially taken to task for his failures, he remains arrogant and defiant.
In responding to the announcement by Bonta, Bianco admitted he was surprised. How could he be with all of the concerns brought to his attention by individuals, nonprofits and the press?
Surprised? That certainly says a lot about his perception. Humbled? Not at all. In his response/rebuttal to Bonta he was accusatory and defiant claiming that Bonta “cares more about politics than he does about transparency and the truth.”
That is laughable coming from Bianco. After all, what organization could be more opaque than the Riverside County Sheriff’s Department?

At a press conference on Thursday February 23, California State Attorney General Rob Bonta announced he is opening an investigation into the Riverside Sheriff’s Department seeking to determine whether the sheriff's office has engaged in a pattern or practice of unconstitutional or unlawful policing.
Bonta explained that concerning levels of in custody deaths, troubling allegations of excessive force, Riverside jails reporting their deadliest year in two decades and other misconduct too, led to the State Attorney General’s decision to open an investigation into the Riverside Sheriff’s Department.
“This investigation comes amid deeply concerning allegations relating to conditions of confinement in the office’s jail facilities, excessive force, and other misconduct,” Bonta said. “These concerns have been repeatedly voiced by community leaders, members of the media, families of those who have lost loved ones and more.”
“Some communities don't see or feel they are being treated equitably by law enforcement. It contributes to distrust and hurts public safety,” Bonta acknowledged, explaining, “When there is trust, that trust in turn contributes to increased public safety.”
“Unfortunately, today's announcement is necessary because that trust between Riverside County Sheriff's Office and the community it serves is in peril,” Bonta said, “Bottom line

whether you have a loved one in jail or are worried about crime in your neighborhood, we all benefit when there is action to ensure the integrity of policing in our state.”
“It is time for us to shine a light on the Riverside County Sheriff's Office and its practices,” Bonta declared.
“My office will use its full authority under the California Constitution to determine whether the
sheriff's office has engaged in a pattern or a practice of violating state or federal law,” Bonta promised, adding, “And if so, identify and compel the correction of any systemic violations of the community's constitutional and civil rights, we are launching this investigation today.”

The National Museum of African American History and Culture
Across this country, tobacco companies are vigorously opposing public health policies that would protect Black Americans from these products, specifically the proposed FDA ban on menthol products. These same companies continue to strategically provide monies to Black institutions to create the illusion of being socially responsible and invested in our wellbeing.
Black institutions must reject funding from or any form of partnership with tobacco and vaping companies and hold them accountable for the harmful effects they’ve had and continue to have on public and mental health, the environment and social justice.
The National Museum of African American History and Culture is one of those institutions. They currently list Altria as a member of their Culture’s Corporate Leadership Council. It should be noted that Altria owns a 35 percent stake in JUUL Labs, the e-cigarette company that malevolently popularized e-cigarette usage among America’s youth. We are calling upon the museum to divest their funding portfolio of all tobacco industry contributions moving forward.
The museum undertakes highly commendable work to document African American life, history and culture. However, we must bear in mind that American history is forever interwoven with the enslavement of African people on tobacco plantations. Unfortunately, traces of that exploitation continue to exist to this present day, principally taking the form of marketing menthol cigarettes and flavored little cigars in the Black community.
The museum is not alone, it is only one example, and we are challenging all Black organizations currently accepting funding from the tobacco industry to divest. If current efforts to protect present and future generations are not realized, African Americans will continue to pay the disproportionate price of death and disease for generations to come.
A New Road Forward
In 2021 the AATCLC was joined by the Action on Smoking and Health, the American Medical Association, and the National Medical Association when we sued the FDA to compel them to take menthol off the U.S. market. Imagine our nation’s medical doctors joining with us to sue our own government to take these deadly addictive products off the market.
This August, the FDA is slated to make a final
ruling to take all menthol and flavored products off the market. We have a lot of work to do to ensure this happens and a large part of that is having the support of Black institutions.
Black people have been at the head of this fight, and we have made great strides in protecting the next generation from the industry’s emerging tobacco and nicotine products.

“We're lucky that we have these committees that are concerned for our environment. But as a resident, I wasn't a part of it,” said Colton resident Celeste Carlos. Activists said that there were zero community meetings in 2022 about the committee’s developments, so during the council meeting activists and community members alike pushed for more.
“What was the point of spending almost two years on this policy if we're going to leave gaps in the final leg?” asked Andrea Vidaurre, cofounder and policy lead at People’s Collective for Environmental Justice.
Vidaurre, who grew up in the Inland Empire, said that the current Ad Hoc committee’s recommendations leave loose ends.
“This ordinance has yet to figure out the truck routes, one of the largest concerns brought forward. Nor has it analyzed the current and future costs that trucking has on road damages and long term infrastructure costs,” Vidaurre said, adding that there are currently no requirements for local hire, a living wage or career pathways, which pose a future problem for what she sees as an evitable transition to automation in the logistics industry.

Colton community member and activist Gem Montes shared her disappointment at the absence of a community benefits agreement, an agreement that the city would develop through conversation with the community to identify their needs.
“We could decide on what we need instead of having somebody dictate to us,” Montes said. “Instead, we received a promise of a public benefits agreement over which we will have zero control when we are the ones that are impacted.”
A community benefits agreement is an agreement that protects and allows the community to benefit from warehouse development by implementing measures such as job placement priority to Colton residents as well as environmental regulations such as EV trucks.
"We asked for a community benefits agreement so we could decide on what we need instead of having somebody dictate to us," Montes said. "We are the ones that are impacted."
Inland Empire environmental activists remarked that the City of Colton essentially halted the development of new warehouses for two years, taking a step in the right direction and differentiating itself from most cities in San Bernardino County. However, many community members said that they share the same problems with oversight from their elected leaders that other communities across the Inland Empire experience in their fight against warehousing.
“I'm really tired of the city waiting until the last minute to open discussion,” Montes said.
Since the decision to triple-extend the moratorium, community activists reached out to Colton’s Planning Department regarding their availability for a community meeting to further discuss the ordinance. The department, however, said that the City completed the formal public review period on the agenda item and is now highly focussed on completing their responses to Housing and Community
Development’s (HCD) comments related to the Housing Element and working on current, active planning projects. They said that if the community had specific questions about the ordinance they could email them and “the City will respond in kind.”
Norman says it will be nearly impossible to make any further changes to policy around warehouse development in Colton at this time, stating there will not be enough time to form a new committee, have it meet and present updated recommendations to the council for feedback, all before the moratorium ends in May. He explained that another moratorium is possible, but a significant amount of time must pass before it can be implemented.
“We can't just keep planning for tomorrow. The impact is going to be so great that we're not going to be able to correct it,” Carlos said.

and soundly rejected the tobacco industry’s attempt to undermine Senate Bill 793, making their state the second after Massachusetts to pass legislation to take menthol and all flavored tobacco products off the market. We are working hard to encourage all states to follow suit.
Now is the time to take a stand and be a part of the solution: Stop taking tobacco industry money.
When announcing the investigation, Bonta stressed how “[I]nteraction and cooperation with the community is at the core of law enforcement’s work to provide public safety and create public trust.”
Bianco, on the other hand, claims the accusations are based on “false and misleading statements and straight out lies from activists and others, including their attorneys.” He gives the impression that the investigation is a trumped up inconvenience and he will be vindicated of any wrong doings.
