he passage of the Affordable Care Act affectionately referred to as “Obamacare” was a historic and monumental accomplishment when signed into law by former President Barack Obama nearly a decade ago on March 23, 2010. From the moment Obama put pen to paper—probably even before—members of the Republican party, launched and organized a systemic effort to destroy it. The rationale for their vitriol against providing affordable health care to millions of Americans through subsidies, ensuring health care coverage for individuals with pre-existing conditions; allowing young adults to remain on their parent’s health insurance until the age of 26, and expanding Medicaid coverage for low-income Americans among other benefits, has never been rationally explained. After dozens of legislative attempts and untold numbers of court challenges, the Affordable Care Act is hanging on ten years later—if only by a thread. Yet, even as the nation and the world faces one of the most serious international health
challenges in recent decades and just months before the 2020 presidential election in November, the U.S. Supreme Court announced last week it plans to hear one more case that threatens the viability of the Affordable Care Act. The Supreme Court has ruled in favor of the Affordable Care Act on two previous occasions and Democrats, with the support of millions of Americans, have kept the pressure on politicians to maintain it. The new case pending before the court could well be titled Blue vs Red or Democrats vs. Republicans; instead, it is called “California v. Texas.” In this case, Democrats led by California Attorney General Xavier Becerra, are defending the Affordable Care Act (ACA) against a lawsuit being backed by President Donald J. Trump and Texas Republicans. California is being joined in defense of the continued on page 17

Riverside Announces Health Emergency Due to Spread of Coronavirus Riverside, CA – Over the weekend Riverside County health officials declared a health emergency after a patient presented at Eisenhower Health in Rancho Mirage with the county’s first known locally acquired case of the coronavirus—a case not tied to the patient’s travel abroad or contact with someone who has travelled abroad. Another known case related to the county involved a county resident who was a passenger on the Diamond Princess cruise ship who is recovering in Northern California. On Friday March 6, 2020 the Murrieta Unified School District announced Murrieta Valley High School will be closed “out of an abundance of caution,” after an employee—who had recently travelled to a country impacted by a coronavirus outbreak—underwent testing for the coronavirus. In the meantime, at least 71 students are under self-quarantine. And on Monday, Riverside County health officials announced three new cases in the Coachella Valley. Last week, Governor Gavin Newsom declared a State of Emergency as the coronavirus (COVID-19) continued to spread across the state impacting more than 12 counties in the state and sickening more than 50 people. On Thursday the Governor directed all commercial and Medi-Cal health plans regulated by the Department of Managed Health Care to reduce the cost-sharing to zero for all medically necessary screening and testing for COVID-19 immediately. This includes waiving the costs for emergency room, urgent care or office visits when the visit is related to the coronavirus. Also, on Thursday, Congress passed a bill to combat the illness by authorizing the direction of $8.3 billion to national efforts. Although the administration is pressing forward in tandem with the public sector with the development of a vaccine for the illness, Health and Human Services Secretary, Alex Azar—in testimony before congress last week—said he could not guarantee it will be affordable for all, even though tax payers are subsidizing its development.

Corey Jackson To Become First African American Elected to Riverside County Board of Education Riverside
B
y any measure it is poised to be an historic victory. After being outspent by nearly $100,000, all indications point to nonprofit and Civil Rights leader, Corey A. Jackson, becoming the first African American ever elected to the Riverside County Board of Education. “The corporate charter school lobby tried to buy this election,” Jackson said. “The community fought back because our votes are not for sale.” Jackson, a specialist in youth development, culturally responsive interventions, and social justice issues, currently serves as the founder and Chairman/CEO of SBX Youth and Family Services whose mission is to break the cycle of poverty and violence through mentoring, education, and community organizing. Jackson is also an expert in Afrocentric interventions for middle school and high school adolescents. He further serves his community as the President of the Moreno Valley City-Wide Coalition and is Political Action Chair of the Riverside NAACP. continued on page 17

Mother of San Bernardino Terrorist Pleads Guilty

an Bernardino Mayor John Valdivia is continuing to serve under a cloud of suspicion resulting from allegations tied to charges of sexual harassment, fostering a toxic work environment, complaints of wrongful termination, and the list goes on. The mayor’s Chief of Staff Matt Brown who is cooperating with the investigation into these complaints has retained his own attorney. Brown, a longtime Republican political operative in the region with strong connections to in the epic Colonies scandal was once chief of staff to disgraced former County Supervisor and ex County Assessor Paul Biane. Brown would eventually become a witness for the prosecution in the $102 million Colonies case in which Biane was a suspect. He even wore an electronic device to record their private conversations. With this history it was not a surprise to learn Brown appears to once again be a key player in another political saga, this one involving

San Bernardino, CA Rafia Sultana Shareef, 66, of Corona—the mother of Syed Rizwan Farook the mastermind behind the 2015 terrorists attack that left 14 people dead and 22 injured—pled guilty last week for her role in attempting to cover up her son’s culpability. Shareef admitted she destroyed evidence when she shredded Rafia Sultana a map probably used by her son to plan the attack. For impeding a federal criminal investigation by altering, destroying and mutilating records Shareef may serve up to 18 months in jail. Farook and his wife Tashfeen Malik, who also took part in the attack, were both killed during a shootout with police following the massacre.

Coronavirus is in the U.S.: Protect Yourself and Your Family
Don’t Panic…Stay Calm…Avoid Spreading Rumors and Fear
T
he U.S. Centers for Disease Control and Prevention (CDC) is aggressively responding to the global outbreak of coronavirus-19 (COVID-19). The spread of the disease is evolving at a rapid pace. The most reliable information can be found at https://www.cdc.gov/ coronavirus/2019-ncov/summary.html The risk of getting COVID-19 in the U.S. is currently low. There is no vaccine. The best way to prevent the spread of this respiratory disease is to avoid being exposed to the virus. The CDC recommends everyday preventive actions including: • Avoid close contact with people who are sick. • Stay home when you are sick. • Cover your cough or sneeze with a tissue, then throw the tissue in the trash. • Frequently clean and disinfect touched objects and surfaces using a regular household cleaning spray or wipe. • Follow CDC’s recommendations for using a facemask. • The CDC does not recommend that people who are well wear a facemask to protect themselves from respiratory diseases, including COVID-19.
• Facemasks should be used by people who show symptoms of COVID-19 to help prevent the spread of the disease to others. The use of facemasks is also crucial for health workers and people who are taking care of someone in close settings (at home or in a health care facility). • Wash your hands often with soap and water for at least 20 seconds, especially after going to the bathroom; before eating; and after blowing your nose, coughing, or sneezing. • If soap and water are not readily available, use an alcohol-based hand sanitizer with at least 60% alcohol. Be prepared for a COVID-19 outbreak in your community and follow the recommendations of your local Public Health authorities to reduce the spread of the virus. Stock up on your daily medications. Poly High Students Claim Mock Trial Title 2nd Year in a Row Riverside
F
or the second year in a row, Poly High School won the annual Riverside County Mock Trial competition, outperforming Valley View High School which earned second place and Martin Luther King and Notre Dame High Schools who shared a third-place finish. Now the Poly High team prepares to head to the statewide tournament in Los Angeles on March 20, 2020. Each year Riverside’s Mock Trial competition is sponsored by the county’s Office of Education, in partnership with the Constitutional Rights Foundation, Riverside County Bar Association and the Superior Court. Since the county began hosting the competition in 1983, more than 14,000 students have participated in the competition. This year’s competition involved students arguing a fictitious case related to a spousal murder—People v. Matsumoto. Each team consisted of eight to 25 students playing the parts of deputy district attorneys, defense attorneys, bailiffs, witnesses, clerks and investigators. Student performances were judged by a panel of practicing attorneys and judges. The students were awarded points for their performances based on criteria previously established for the competition.

Prep School Counselor Fired and Charged Due to Child Porn Investigation

hirty-year-old Matthew Johnson a counselor at La Sierra Academy in Riverside was found in possession of over 600 child pornography images and arrested on suspicion of sending and selling them—some of the images showed minors engaged in sex acts. Johnson was fired by the school’s administrators when it was discovered he’d allegedly recorded male students in a restroom on campus. Johnson’s behavior was discovered by the Fontana Police Department’s Internet Crimes Against Children Task Force, that noticed him downloading and distributing child pornography via the internet. The Task Force executed a warrant at Johnson’s home where they found multiple electronic devices, evidence related to the download, and distribution of child pornography including images of prepubescent boys. A second warrant was executed at the school and officials seized evidence from Johnson’s office related to the charges.

Although the investigation is in the early stages according to Fontana police officials there is currently no evidence that any of the recordings were made on campus and none of the boys in the videos have been identified. School officials are fully cooperating with police agencies involved in the investigation. La Sierra Academy has a total student enrollment of about 555 students. Its student population is 27 percent Hispanic, 17 percent White, 28 percent Asian and 10 percent Black.

San Bernardino County has outpaced the rest of the state in employment since 2013 growing by 3.69 percent and the average wage has jumped by 2.7 percent year over year. Inc. According to San Bernardino County Supervisor Robert Lovingood, “Inc. Magazine recently ranked the Inland Empire No. 14 in the nation for net business creation and No. 16 nationally for job creation and wage growth. Inc. Nursing Home Outbreak Spotlights Coronavirus Risk In Elder Care Facilities JoNel Aleccia Contributor
A
n outbreak of coronavirus disease in a nursing home near Seattle is prompting urgent calls for precautionary tactics at America’s elder care facilities, where residents are at heightened risk of serious complications from the illness because of the dual threat of age and close living conditions. As of Monday afternoon, the emergence of the novel contagious illness at the Life Care Center of Kirkland, Washington, had left four residents dead and others hospitalized, local health officials said. A health care worker also has been hospitalized. In total, Washington state has reported six deaths, officials said. Officials previously said that of the nursing home’s 108 residents and 180 staff members, more than 50 have shown signs of possible COVID-19 infections, the name given the illness caused by a novel coronavirus that emerged from Wuhan, China, late last year. Visits from families, volunteers and vendors have been halted and new admissions placed on hold, according to a statement from Ellie Basham, the center’s executive director. “Current residents and associates are being monitored closely, and any with symptoms or who were potentially exposed are quarantined,” she wrote. The cluster of illness is the first of its type in the U.S., where 2.2 million people live in longterm care settings and may be at heightened risk because of age and underlying health conditions. “We are very concerned about an outbreak in a setting where there are many older people,” said Dr. Jeff Duchin, Health Officer for the Seattle and King County Public Health Agency. The American Health Care Association, which represents 13,500 nonprofit and forprofit facilities for seniors and disabled people, issued updated guidelines Saturday, in response to the Washington outbreak. The new virus is thought to spread primarily via droplets in the air, and the guidelines largely echo strategies recommended to stem the spread of other respiratory viruses, such as influenza. That includes frequent hand sanitation among staff and visitors, grouping people who become
ill in the same room or wing, and asking family members who are sick to avoid in-person visits. But members had been anticipating cases of the new virus, said Dr. David Gifford, AHCA’s Chief Medical Officer and Senior Vice President of Quality and Regulatory Affairs. “Clearly, it signaled that it’s here and that what people knew was likely to come is closer to them than before,” he said. COVID-19 has been identified in more than 85,000 people worldwide and led to nearly 3,000 deaths, including the first U.S. death reported Saturday in another Washington state man in his 50s. That man was not associated with the Kirkland Nursing Center, officials said. Studies of hospitalized patients in China suggest the median age of infection is in the 50s and that about 80% of COVID-19 cases are mild. However, a new summary in the journal JAMA, reported that the virus has a case fatality rate of 1% to 2% overall — and as high as 8% to 15% in older patients in China. That is alarming news for U.S. residents in long-term care settings, where illnesses caused by more common pathogens like norovirus and seasonal influenza often spread rapidly

among residents, causing severe complications. Immune response wanes as people age, leaving them more vulnerable to infections of all types. Dr. Karl Steinberg, a geriatrician who serves as medical director for two nursing homes and as Chief Medical Officer for a chain of 20 others in Southern California, said the news of COVID-19 cases at the Washington state nursing center is worrisome. “That’s very scary,” Steinberg said. “It worries me that once it gets going, it will be really hard to control the spread.” The situation may be akin to the spread of coronavirus on cruise ships, such as the Diamond Princess that was quarantined off the coast of Japan, with one key exception, Steinberg said. People on cruise ships can be confined to their rooms with minimal interaction with staff and fellow residents. People in nursing centers are there because they need help with activities of daily living, he noted. In the Washington state center, Duchin said, officials are advising health workers to separate cohorts of sick patients from those who remain well and to don personal protective gear, continued on page 18

alley View High School in Moreno Valley (my alma mater) is going to begin bringing police dogs into the school to search students for drugs,” the alumnus shared expressing her concern regarding the importance of this story. The community of Moreno Valley is 57.9 percent Hispanic or Latino and nearly 17 percent African-American (according to 2017 U.S. Census data) and the idea of using police dogs to sniff out drugs on high school campuses may seem abhorrent to many of them. Few can argue that drug use among high school students is concerning yet many must also agree the history of how police dogs have historically
been used to instill fear and intimidation in African Americans, whether it was dogs in the service of slave catchers chasing Black men through the swamps of Louisiana; or dogs as the tools of Southern racists during the Civil Rights era; or the current day policemen on the streets of any inner city in America—the idea of being searched, hunted, controlled by police dogs is not an image Black Americans like to conjure—especially in relation to their children. Afterall, history tells us dogs were brought to America by European colonists who used them to intimidate and perpetuate violence against indigenous populations before they began breeding them for use against

S T O R Y chattel slaves. So, to acquiesce to their use on school campuses should raise alarm bells regardless of the rationale used to justify it. The IE Voice/Black Voice News recently reached out to Moreno Valley Unified School District (MVUSD) for clarification on the district’s policy regarding the use of dogs on high school campuses to screen for drugs. “The safety and security of our students is a top priority for us,” commented Anahi Velasco Public Information Officer for MVUSD. “We conduct the searches as a safety measure to maintain schools that are safe and drug free.” Yet over the years, several studies have indicated that not only are drug sniffing dogs prone to false alerts, but a highly controversial and inflammatory 2011 study by researchers at UC Davis published in the journal Animal Cognition found that—the detection-dog/ handler teams erroneously “alerted,” or identified a scent, when there was no scent present more than 200 times — particularly when the handler believed that there was scent present.” “It isn’t just about how sensitive a dog’s nose is or how well-trained a dog is. There are cognitive factors affecting the interaction between a dog and a handler that can impact the dog’s performance,” said the study’s lead author Lisa Lit, at the time was a postdoctoral fellow in UC Davis’ Department of Neurology. Lit expressed her belief that these cognitive factors might be as important—or even more important—than the sensitivity of a dog’s nose. During the study there were more alerts on target locations indicated by human suggestion. “Dogs are exceptionally keen at interpreting subtle cues, so handlers need to be cognizant of that to optimize the overall team performance,” noted the study’s senior author, Anita M. Oberbauer, Chair of school’s Department of Animal Science. According to the American Civil Liberties Union an earlier study conducted at a school district in the State of Washington found, “[D] ogs were incorrect 85 percent of the times they alerted to a substance.” A new study of drug sniffing dogs used to search automobiles in Chicago showed used for roadside searches of automobiles found a 56
percent error rate that increased to 73 percent for Hispanic drivers. This seems to reinforce concerns regarding human suggestion. In March 2019, it was reported gun and drug sniffing dogs were being used at more than two dozen schools across the county. Although there is concern that drug sniffing dogs can be influenced by the handling officer(s)’ racial biases there are other explanations that may contribute to their unreliability including poor training; a reward system that might incent dogs to react even when no substances are found; or the possibility of police officers feeling pressure to show how costly drug detection programs are working. Using drug sniffing dogs in public schools continues to raise concerns regarding expectations of privacy when students enter school grounds. According to Velasco, the drug-detection searches using trained canines occur at any middle and high school to protect the health and welfare of students. However, the use of drug-detecting dogs on school campuses continues to raise serious constitutional concerns. Do public school students give up all expectations of privacy when they enter school grounds? According to legal experts although such searches seem invasive, schools can use drug dogs on school campuses during unannounced, random searches, even though the Fourth Amendment prohibits unreasonable search and seizure. This is because the students do not have a reasonable expectation of privacy in the school. Also, courts have acknowledged the compelling interests of schools in maintaining a drug free environment. The ACLU however appears to disagree. In Kuehn v. Renton School District (1985), a precedent-setting ACLU case, the Washington Supreme Court held that it is unconstitutional for public schools to search large groups of students without individualized suspicion of each person searched. At the beginning of each school year, parents are presented with a 45-page Parent/Student Handbook that includes the following statement regarding Search and Seizure: “The Board of Education recognizes the
need to ensure a safe environment for students. Therefore, school properties including lockers may be inspected by school authorities in the interest of maintenance, health, and safety. Inspections for the location of weapons and dangerous instruments are matters relating to health and safety and may be regarded as reasonable purposes for inspection by school administrators. Students and their property may be searched when there is reasonable suspicion of a student being in possible possession of an item they should not have or if they have engaged in behaviors that would raise suspicion that the student may be in possession of a contraband item. . . Students should be searched in the presence of an administrator or designee and parents must be contacted, in a timely manner, after a search is conducted. Such searches may include the use of a metal detector, a dog trained to locate illegal or controlled substances, and a Breathalyzer used to determine blood alcohol content.” Parents who work their way through the 45page document of small print will find this notice on page 26 of the handbook. Also, according to Velasco, “Schools generally notify parents after the drug-detection search is complete.” Velasco also claimed she is unaware of pushback from parents or students regarding the searches. “I’ve had a few conversations with parents who inquired about it, but they understood and expressed support for maintaining alcohol and drug free schools.” The ACLU reports there is little or no evidence to support using drug sniffing dogs on school campuses to reduce or deter drug use or reduce drug-related crimes. In addition, school districts are historically cash strapped and the use of drug sniffing dogs is costly, by some estimates school districts can incur expenses ranging between $12,000 and $36,000 or more every year. Despite the questionable effectiveness of drug sniffing dogs on school campuses and evidenced by data, the use of drug sniffing dogs in public schools is becoming common place. As a result, privacy advocates believe interpretations of the Fourth Amendment will continue to be challenged in the courts.

The initiative is the brainchild of Reggie Webb, Founder and CEO of Webb Family Enterprises and owner of several McDonald Franchises. In the meantime, even with the ACA millions of Americans remain uninsured. Who is fighting for them? The private health care industry and Big Pharma, are among those who reap billions from Americans through their health plans while ignoring the suffering of those not covered. I count myself among the millions of Americans who believe healthcare is a right, not a privilege reserved for those who can afford it even as healthcare costs continue to skyrocket. As Americans, we should not be satisfied knowing millions of our brothers and sisters either still do not have access to affordable healthcare, or if they do, often cannot afford to fill their prescriptions or can be forced into bankruptcy as the result of a catastrophic illness. We must be outraged and not afraid to express that outrage. We must be loud and continue making our voices heard on this issue. We must be bold in our resistance to the destruction of access to healthcare as it threatens our personal and public health. It is unconscionable but true the Republican Party is willing to destroy a policy currently saving the lives of thousands of Americans each year merely because they so hate the idea ACA was implemented under the leadership of a Black man named Barack Hussein Obama. The brilliant James Baldwin said, “Hatred, which could destroy so much, never failed to destroy the man who hated, and this was an immutable law.” I agree with Baldwin—I merely look at today’s Republican Party for proof of his wisdom. Of course, this is just my opinion. I’m keeping it real.

Duchin urged older people and those with health conditions such as heart disease, lung disease, and diabetes to pay close attention to precautions such as washing hands frequently, keeping their hands away from their faces and avoiding people who show signs of illness. Just-released guidelines from the Society for Post-Acute and Long-Term Care Medicine, call for increasing hand hygiene, isolating infected patients, and making plans to ensure that health care workers stay home if they’re sick. The guidelines also call for screening visitors and daily temperature checks for residents and staff. Individual centers should remain in close contact with local health officials about appropriate actions, Gifford said. Authorities — and families — should think carefully before taking steps such as removing patients from nursing centers during an outbreak. “Evacuating a facility is not a benign event,” he said, noting that moving can be traumatic to frail and elderly people.
The nursing home cases are examples of community transmission of the virus, meaning the patients did not have a known history of travel to other nations where the virus is spreading or contact with a traveler diagnosed with the illness. Community transmission has now been detected in multiple states, including California. However, Seattle researchers reported late Saturday, that new genomic analysis suggests the virus may have been spreading in Washington state since mid-January, when a 35-year-old Snohomish County man who had visited Wuhan, China, was confirmed as the first U.S. case of the infection. “This strongly suggests that there has been cryptic transmission in Washington state for the past 6 weeks,” tweeted Trevor Bedford, a computational biologist at Seattle’s Fred Hutchinson Cancer Research Center, who is tracking the virus. He estimated there could be “a few hundred” infections in the state. At least 70 cases of coronavirus infection have been confirmed or presumed positive in the U.S., and officials with the Federal Centers for Disease Control and Prevention said Americans
