San Bernardino Sheriff Permanently Slams Door on Coroner Transparency
W
hen the baton was passed from former San Bernardino County Sheriff John McMahon to his hand-picked successor Shannon Dicus the ink was hardly dry from his official swearing in ceremony when the Captain of the Coroner Division issued a press release labeled, “Temporary Operating Procedure” announcing that although Coroner Division policy designates the division has the responsibility for approving and posting its press releases, it “recognizes that some deference is proper when other divisions are involved in certain incidents.” Was this a sudden revelation? That is difficult to believe, especially with this change coming just two days after the new sheriff was sworn in. Whatever the motivation for the implementation of the “Temporary Operating Procedure,” the coroner’s office determined it will refrain—a roundabout way of saying, “it will not” issue press releases involving suspected homicides and child abuse cases under investigation by other divisions—like sheriffs for example—and that all questions about these cases would be referred to the investigating agency.” County coroner/medical examiner’s offices are under the jurisdiction of sheriff’s departments by what has been described as “a default” in state law, although the same law also allows county boards of supervisors to separate the two entities. For example, the counties of Los Angeles, San Diego and San Francisco all have coroners that operate independent from their sheriff’s departments. In Riverside and San Bernardino Counties however, the coroner’s office is part of the sheriff’s department. The coroner’s office refusal to issue press releases involving suspected homicides and child abuse cases under investigation is of particular concern since the San Bernardino County Sheriff’s Department operating under a consent decree for the unnecessary and excessive uses of force against inmates and before he became sheriff, Dicus himself talked about the increase in inmate deaths in November 2021. Regarding child abuse, in 2019 the County of San Bernardino was ordered to pay to settle a child abuse case and in 2021 the IE Voice reported how for years, San Bernardino Children and Family Services purportedly placed as many as 59 kids in the home of a known sexual abuser. These two scenarios alone scream for more. . . not less transparency. Since the policy was positioned as “Temporary” in the July 2021 press release, I followed up to check the status of the change in late March. That is when I learned from San Bernardino County Sheriff Department

Public Information Officer Mara Rodriguez, that there was a decision to make the change permanent soon after the July 16 press release was issued, however, “No additional changes have been made to the press release procedure since 07/16/21.” Another prime example of the department’s lack of transparency and another reason for the public to demand change. When asked who had the authority to approve the change Rodriguez advised that, “San Bernardino County Sheriff’s Department Policy Sections 2.150.25 (Division Orders) and 2.150.30 (Division Policies) gives the authority to the commanders of stations and divisions.” Reading between the lines we know this really means the county sheriff since they all work for him. AB 1608 offers a solution Issues related to government transparency are nearly as old as time as are concerns over potential conflicts of interest between sheriffs and coroners, especially when coroners are charged with investigating the manner and cause of death in unusual circumstances, manner, and cause of all violent, sudden, or unusual deaths. In January a bill was introduced in the state Assembly to separate coroner offices from sheriff’s departments. The legislation, if successful, would ensure that death investigations are conducted objectively and reduce the perception (or reality) that the investigative process could be influenced by other law enforcement. Because sheriffs in California are elected, they have a base of support, including powerful unions that often protect them from the kind of oversight that police chiefs, who are appointed by city officials, are subjected to. On Friday Jackson was photographed by Bronx native, Lelanie Foster, a young Black photographer known for honoring the beauty of Black and Brown people in her photography. Following the bipartisan confirmation of Jackson, President Joe Biden and Vice President Kamala Harris joined Jackson and gave remarks and congratulations on her appointment. “It has taken 232 years and 115 prior appointments for a Black woman to be selected to serve on the Supreme Court of the United States,” said Jackson during her speech at the White House. “But we’ve made it. We’ve made it, all of us. All of us.” White House officials, when providing background about Fosters’ selection to preserve the image of Jackson at this pivotal moment in American history, touted her “unique perspective and sensitive approach to her subjects [that] allows for imagery that reflects intimately warm and organic moments in a most delicate human way.” Given Foster’s creative outlook and unique approach to photography, it was only fitting that she was chosen to take Jackson’s portrait. Foster’s photography gained momentum following her work on the film Queen & Slim, where Foster was handpicked to visually interpret the film through her photography.

fter a first vote failed, the California Task Force to Study and Develop Reparations Proposals for African Americans decided that lineage will determine who will be eligible for reparations. During the first session of the eighth, two-day meeting, five members of the task force voted in favor of lineage over race as the determining factor for compensation. Four members said no, 90 minutes after the first vote failed. The measure needed a two-thirds majority of the task force to vote in favor of the proposal for ratification. “The Ayes have it and the motion carries,” task force chairperson Kamilah Moore said following the vote. “So, the community eligibility will be based on lineage determined by an individual being African American, the descendant of a (person enslaved as chattel) or descendant of a freeBlack person living in the United States prior to the end of the 19th century.” Task Force members Moore, vice-chair Amos Brown, pastor of Third Baptist Church in San Francisco, and president of his local NAACP branch; University of California-Berkeley professor Jovan Scott Lewis; and San Diego City Councilwoman Monica Montgomery-Steppe voted in favor of the lineage qualifier. A split decision Sen. Steven Bradford (D-Gardena) broke the tie. He abstained from the process during the first round of voting, which ended up with four in favor, three against lineage, and two abstentions, the other being attorney Don Tamaki. Tamaki, Assemblymember Reggie Jones-Sawyer (D-Los Angeles), Los Angelesbased attorney Lisa Holder, and LoyolaMarymount professor Cheryl Grills, voted in favor of race as the deciding factor. Tiger Woods Emerges from Near Amputation to Play Masters

wenty-five years ago, an 18-year-old Kobe Bryant faced Michael Jordan at the “Fabulous Forum” in Inglewood. In that same winter of 1997, a 21-year-old PGA rookie named Eldrick “Tiger” Woods, won his first Masters at Augusta Georgia. He won the event by 12 shots, a margin no script could write. Sadly, one of that year’s competitors is no longer with us and the other has just reemerged. Tiger remained in the hospital for three months, his ability to play or walk in doubt Perhaps no other modern athlete has galvanized the interest and popularity of a single sport like Tiger Woods. His impact on those who love to play the game and countless others simply fascinated by his persona, is extraordinary. On February 23, 2021, Wood’s vehicle rolled and tumbled some 150 feet into a Rancho Palos Verdes ravine, severely injuring his right leg. In the aftermath, surgeons seriously considered amputating just above the

ankle. Tiger would remain in the hospital for the next three months, as his ability to play or walk again remained in doubt. udge Ketanji Brown Jackson, 51, made history on Thursday when she was confirmed as the 116th Supreme Court justice, making her the first Black woman and first public defender to become a member of the highest court. The U.S. Senate confirmed Jackson’s appointment in a 53-47 vote. Jackson will replace Justice Stephen Breyer who announced his retirement earlier in the year. She
previously clerked for Breyer in 1999, and will fill his seat. He will complete his last term on the bench at the end of the summer, and Jackson will likely ascend the seat as early as June. “Her opinions are always carefully reasoned, tethered to precedent, and demonstrate respect for how the law impacts everyday people. Over the three days of the hearing, Jackson was asked about her religion, questioned about her “soft” sentencing in regard to pedophiles and her involvement in assisting four Guantánamo Bay detainees in filing unlawful detention petitions as a federal public defender. While Jackson endured hours of intense, and at times aggressive, questioning from members of the committee, she was also admired by members like Senator Cory Booker (D-NJ) whose closing speech during the hearing elicited tears from Jackson. “Today, you’re my star. Making history Over the span of 233 years, just two Black people — both men — have been confirmed to the bench since the Supreme Court was established in 1789. Those men were Thurgood Marshall in 1967 and Clarence Thomas in 1991, who still occupies the bench today. Today, Jackson became only the 6th woman to serve on the nation’s highest court, alongside Associate Justices Sonia Sotomayor, Elena Kagan and Amy Coney Barrett. Jackson’s nomination received support from three Republican Senators: Susan Collins (ME), Lisa Murkowski (AK) and Mitt Romney (UT) who helped push her confirmation to the court forward, joining the 50 Democratic votes. Initial support for Jackson’s nomination to the court by the public was among the highest of any recent nominee, according to a Gallup

I think it definitely sets the tone for those [who] come after her,” explained Che Wright, First Vice President of the San Bernardino Chapter of the National Association for the Advancement of Colored People. “[I]t shows us that things are attainable, the things that they thought we weren’t going to be able to accomplish — we are. n the Inland Empire and throughout the country, Black people are leading with new ideas in their respective industries with strengthening the Black Community as their North Star. Trevor Rozier-Byrd, CEO and Founder of Stackwell Capital, is a perfect example. RozierByrd spent a large part of his career in financial services and asset management spaces, which contributed to his desire to branch out and make understanding wealth more accessible. One of the tools he believes can help accomplish this is Stackwell, an app designed to educate and encourage building Black generational wealth through personalized options and solutions. continue him in that role when he stands for election this year. Is Dicus the sheriff San Bernardino voters want leading the county into the future? Someone who made one of his first acts to gag the coroner officials under the guise of a temporary order—and then stealthily make it permanent? ACLU’s Melanie Ochoa said it best when she noted how sheriff’s departments have a pattern of “refusing to be transparent or accountable, particularly when sheriff’s deputies commit misconduct.” I found it almost laughable that when the bill was introduced in January, although the California State Sheriff’s Association did not take a position at that time its representative did express concern regarding how the bill basically rids the counties’ of their ability to combine the offices of sheriff and coroner. The organization’s Director of Legislative Affairs expressed concern about the significant costs such an action would impose on counties. The cost is yet to be determined, but whatever it is, I’m sure the county could easily afford it if it was not paying out millions of dollars in settlement cases brought against the sheriff's department year after year for excess use of force and/or wrongful deaths. The way I see it, there are three options on the table. (1) Do not vote for Dicus and instead elect a sheriff that is not part of the old guard by choosing someone with a new vision for the future of policing in San Bernardino County. (2) Advocate for the passage of AB 1608, County officers: Consolidation of Offices legislation that will separate sheriff’s departments from coroners in California. (3) Or, put pressure on the San Bernardino County Board of Supervisors to do so. This year, don’t be a bystander, advocate for change. Contact your California Assemblymember and push for the passage of AB1608. Follow this link for contact information. Let your board supervisor know you want the sheriff department and coroner’s office separated. Follow this link for information regarding how to contact your supervisor. And finally, do not vote for Dicus just because he is the man county officials decided should be the sheriff. Review the backgrounds and policing philosophy of those in the race and select the person best suited for the kind of policing we need in San Bernardino County. Don’t let all the fear mongering about rising crime scare you into a bad decision. Yes, crime is rising but it is important that the community take a thoughtful approach to seeking a sustainable solution. A January report shows that although violent crime is up, it is not surging to the extent many would have us believe. Of course, this is just my opinion. I’m keeping it real.
