Gavin Newsom’s Penchant for No Bid Contracts
F
or a politician who advocates for fairness and equity, it is concerning that CA Governor Gavin Newsom appears to have a penchant for awarding no bid contracts. A no bid contract—at times referred to as a single source contract—is typically used to hire a vendor for a certain job. This method expedites the process because it bypasses the somewhat lengthy competitive bidding. No bid contracts can not only have a negative impact on the bidding process, they can also decrease the chances for startups, small businesses and women and minority owned businesses to win contracts with the government. Some also criticize no bid contracts as inefficient and wasteful. Despite these concerns, Newsom has awarded several. Although some may argue

For example, a combined $282 million no bid contract was awarded to UnitedHealth subsidiary OptumServe on top of other contracts--some no bid in 2020 and 2021. The UnitedHealth awards were criticized as unseemly because according to a CAPRadio report, “The company has contributed hundreds of thousands of dollars to Newsom’s reelection campaign and ballot measure committee since 2018.” No bid contracts by-pass the bidding process that is not only intended to secure the best price for the state but is also intended to serve as a safeguard to prevent favoritism. However, declarations of a “state of emergency” under which the state has operated during COVID-19, allowed the governor almost carte
to participate in Medi-Cal—including the Inland Empire Health Plan and Molina—both of whom serve Medi-Cal patients in the inland region, many insurers cried foul and consumer advocates wonder it the move is really in the best interest of low income residents who rely on Medi-Cal services. Critics of the governor’s agreement with Kaiser say it will allow Kaiser to pick and choose its clients, leaving some of the sickest patients for other insurers to cover. Others have argued that because Kaiser will be required to serve people on both Medicare and Medi-Cal their cases will be more complicated. Regardless of how that argument evolves, what appears undisputed is that Kaiser will grow its Medi-Cal subscribers by 25%. The sweet deal with Kaiser allows the

Riverside County COVID-19 Cases Explode in Wake of Coachella Fest

iverside County experienced a sharp increase in COVID-19 cases following the annual Coachella music festival that took place two weekends in a row. In the last 14 days, Riverside County has seen cases increase by 158 percent and has an average daily case rate of 312 new cases, according to the New York Times’ Case Tracker Map. The popular music festival attracted thousands of attendants from across California and beyond who gathered in the desert for the annual music event. After the festival was canceled two years in a row due to the pandemic, many were eager to attend this year’s event. Hosted in the city of Indio from April 15 through 17 and April 22 through 24, the festival welcomed more than 100,000 guests, not including people who flock to the valley to attend day parties outside of the festival. majority of cases in the county as reported by the Palm Springs Wastewater Treatment Plant’s weekly wastewater surveillance report. Palm Springs voluntarily participates in sampling its wastewater for the detection of COVID-19. Launched in September 2020 by the Center for Disease Control and Prevention, the National Wastewater Surveillance System (NWSS) was developed to track the presence of the virus in wastewater samples collected across the country. In doing so, local health departments can work to prevent the spread of the virus with the detection of the virus in wastewater. According to San Bernardino County Public Information Officer David Wert, San Bernardino County is currently working with the state to conduct wastewater surveillance and identifying ways to possibly increase this effort. As of April 26, 86.9 percent of the virus detected in the wastewater from the treatment continued on page 8

ayor Patricia Lock Dawson convened with U.S. Deputy Secretary of Treasury Wally Adeyemo and California Chief Service Officer Josh Fryday on Tuesday, May 3, 2022 in a roundtable meeting to discuss Riverside's $4.4 million Youth Job Corps Grant. The #CaliforniansForAll Youth Jobs Corps is an $185 million program that was launched earlier this year under Governor Gavin Newsom’s 2021-2022 Comeback Plan to employ youth throughout the state. The program intends to connect youth to job sectors that focus on climate change, food insecurity and COVID-19 recovery. “The idea is to give our youth access to training, access to mentors, access to positions

[and] provide on-ramps,” said Dawson. “I’m very impressed with a lot of the young people we meet today, but the idea is to even let them know what’s out there and the types of jobs that are available to them and then to get them prepared for those jobs.” The initiative allotted $150 million for youth workforce development across 13 of the largest cities in California including Riverside, and $35 million for programming in smaller cities and counties around the state. Criminal Justice System Fees are an Issue of Racial and Economic Justice

round the country, community-based organizations and government agencies, following the leadership of directly impacted community members, are making great strides to minimize the harmful impact of criminal justice system fines and fees. These fines and fees can include anything from drug testing fees to restitution interest, to probation fees. In 2020, San Francisco made all phone calls free for people inside jails. Also in 2020, Minneapolis implemented a program called “Lights On!” where people are given repair vouchers for a broken headlight or tail light instead of a criminal fine. These two examples demonstrate the success of community organizing efforts to eliminate criminal fines and fees, and instead create alternatives that better serve community needs. It is essential that as we eliminate fines and fees, we simultaneously build new systems of support and care that address the root causes of poverty. Fines and Fees Although fines and fees are often used interchangeably, they possess

different legal meanings. A criminal fine is a monetary punishment, like a speeding ticket, whereas a criminal fee is used to reimburse the county or state and is not technically considered a “punishment.” However, their impact is the same. Both criminal fines and fees disproportionately punish and target low-income communities and communities of color. According to the Ella Baker Center for Human Rights’ 2014 report, Who Pays?, the “vast majority (80%) of incarcerated individuals are low-income” and “nearly 40% of all crimes are attributable to poverty.” Our prison system traps communities in a cycle of poverty and incarceration, and criminal fines and fees play a large role in this cycle. If people cannot afford to pay their criminal fines and/or fees, then they will likely be charged more fines and fees, have their driver’s licenses suspended, lose their voting rights and/or have their justice involvement prolonged through incarceration or an extended probation sentence. n Thursday May 5, California State University President Dr. Tomás D. Morales hosted an intimate reception for family and friends of Black Voice News Publisher Dr. Paulette Brown-Hinds at the Spanish Art Gallery in downtown Riverside’s Mission Inn. Those in attendance gathered to not only celebrate the many accomplishments and achievements of Brown-Hinds but also in recognition her coming conferral of an Honorary Doctor of Humane Letters degree by the California State University Board of Trustees. Every year, each CSU campus may submit no more than two candidates for honorary degrees to the Board of Trustees. Members of the CSU Board of Trustees then make a final decision on these awards. Stringent selection process

The process of selecting a candidate for this honor is rigorous and lengthy. Regarding Brown-Hinds, the selection process began last fall when members of the university community and the general public submitted names of possible recipients of honorary degrees. The submissions were then reviewed by an Honorary Degrees Committee. “The candidates are selected by a special committee formed by the executive committee of the faculty senate,” explained Joe Gutierrez of the CSUSB Office of Strategic Communications. The committee consists of a provost or designee, five faculty members (one from each college), a member of the library staff, and a representative of the University Advancement office. During the process, committee members have freedom to also consult

matter. And not only do you matter, but we actually need you,” Fryday said during the press conference. “We have really big problems to solve here in California. We are facing an existential climate crisis. We are facing growing economic and racial and educational inequalities. And we need young people to serve our communities.” The grants are given directly to cities and counties who will develop and select job positions for youth. Community organizations and community partners will also play a role in helping cities connect youth to jobs such as Treepeople, an environmental nonprofit, Lighthouse of Hope, an organization that addresses houselessness and food insecurity and the C3 Initiative, a youth-centered STEM nonprofit organization. The youth corps program is open to youth who are 16 to 30 years old and who identify as a low-income individual, having difficulty finding employment, justice-involved or transitioning from foster care, among other eligibility
requirements. “What is true here in Riverside is true throughout the country — when you have local leaders like the mayor and nonprofits come together, you can create opportunity,” Adeyemo, an Inland Empire native, said. “And what the president always says is that our goal was to use the American Rescue Plan to give people the resources they needed to create that opportunity. And one of those opportunities has been through making sure that we invest in our young people.” According to the mayor’s assistant, Edward Coronado, Riverside is about 60 days away from launching the youth corps program. The program will provide jobs for youth year-round and the mayor’s office has already begun to request additional funding to make the program sustainable after the initial investment runs out. In the long run, Dawson hopes to see the grant spread across all seven wards of the city and see projects in each of the wards.

an Bernardino City Unified School District (SBCUSD) Superintendent Harry “Doc” Ervin will retire at the end of the current school year, according to an announcement made on May 3, 2022. Ervin’s last day as superintendent will be July 1, 2022. He stepped into the role of superintendent last year after the Board of Education unanimously appointed him to the three-year position. With his early retirement, Ervin will have only completed one of the required three years. “When I joined the SBCUSD team, my goal was twofold. Ervin has served as an educator and administrator for more than 25 years across a number of counties including Kern, Monterey and Los Angeles. Progress despite tensions Four months into the start of his tenure as superintendent, Ervin faced backlash from community and board members during a meeting of the SBCUSD Board of Education on September 21, 2021. During the meeting, Ervin was accused of creating an atmosphere of insecurity among other criticisms. In October 2021, Ervin established a Listening & Learning Tour which welcomed ideas and input from parents about the “curricular, instructional, operational, socialemotional and wellness of the San Bernardino City Unified School District.” The statement noted that Ervin “spent several months gathering input from the community” and as a result of his findings, the district developed five comprehensive goals to strengthen student outcomes. He urged community members, school administrators and board members to join a task force. The task force developed a plan called the Framework for Excellence: Vision 2025, which is nearly complete, according to the district. “As I have said since I started my role here, SBCUSD has everything it needs to be a highperforming, urban public school system,” said Ervin. “I believe in the plans our team developed together with input from our school community. I believe they can be successful regardless of my decision to step away because this District is an educational community that wants transformational change.”

40 Criminal Justice Fees Eliminated This is just one example of the many criminal justice system fees recently eliminated by two new laws in California. The bills passed due to the extensive organizing and advocacy efforts by people with lived experiences. The bills eliminated a combined total of 40 criminal justice system fees, ranging from probation fees, to the cost of counsel, to electronic monitoring fees. The Families Over Fees Act (AB 1869) and the Budget Trailer Bill (AB 177) both ended the collection of the stated fees and discharged all related debt. Both laws went into effect within the past year: AB 1869 on July 1st, 2021, and AB 177 on January 1st, 2022. Both AB 1869 and AB 177 will eliminate a tremendous amount of criminal justice debt for Californians. A Call to Action However, there is still much work to be done. In California, there remain over 50 criminal justice system fees associated with the criminal punishment system. As organizers in California have successfully eliminated a multitude of criminal justice system fees, we need to also fund and uplift services and organizations that empower and support low-income communities. The agreement with Kaiser also comes as California is in the midst of a major MediCal transformation called CalAIM that offers services beyond typical Medi-Cal offerings like housing assistance, caregiver respite, food insecurity, etc. There are, however, critics of this program noting that Medi-Cal carriers can not only select what program options they will offer but also what Medi-Cal patients will be allowed to participate. The Kaiser deal must still be approved by state legislators and if successful, not only will the giant health care service provider have a choice of Medi-Cal patients it will serve but also under the provisions of CalAIM it will further enjoy the benefits of choosing which CalAIM services it will provide and to whom—a winning ticket all around for the company but maybe not so much for Medi-Cal customers and the other healthcare providers who serve Medi-Cal subscribers. The deal struck behind closed doors between the governor and Kaiser is currently working its way through the legislature. In my opinion, regardless of who negotiates them, no bid contracts are contrary to fairness and transparency. The Kaiser deal is not an emergency and could have been handled through the normal process. Of course this is just my opinion. I’m keeping it real.
