he preamble to the California Code of Judicial Ethics states, “Our legal system is based on the principle that an independent, fair, and competent judiciary will interpret and apply the laws that govern us. The role of the judiciary is central to American concepts of justice and the rule of law.” The document goes on to provide a list of Canons that judges and “judicial candidates” must adhere to. Cannon 3 states, “A judge shall perform the duties of judicial office impartially, competently, and diligently. This means the absence of bias or prejudice in favor of, or against particular parties. . . as well as the maintenance of an open mind in considering issues that may come before a judge.” It is not hard to imagine what happens when political extremism produces judges who, without a grip on the “impartial” slide down the slippery slope of the “political”. We need look no further than the U.S. Supreme Court for

an example of how political maneuvering has produced a cadre of Supreme Court justices so rooted in their political ideology that the idea of impartiality seems anathema to them. Local Justices The same questions of impartiality can also be applied when local district attorneys advocate for their minions to become Superior Court judges. Superior Court judges can oversee a variety of cases including all criminal cases such as felonies, misdemeanors, and infractions, like traffic tickets; all civil cases including family law, probate, juvenile, etc.; small claims cases and appeals as well as appeals of civil cases involving $25,000 or less. It begs the hypothetical question, ‘How impartial will judicial candidates be when they become judges riding on the winds of a key continued on page 12

n Friday, June 10, 2022, the Riverside County Black Chamber of Commerce and Green Smilez Loving Care Foundation are teaming with San Bernardino’s 66ERS minor league baseball team to present a combined community meet and greet, recognition ceremony and special tribute the Negro Baseball League in honor of its 102nd anniversary. The Inland Empire 66ERS of San Bernardino are a Minor League Baseball team of the California League and the Single-A affiliate of the Los Angeles Angels. The event will also include a recognition ceremony of Black Excellence honoring the achievements of individuals and their businesses. The celebration is being hosted at the San Manuel Stadium located at 280 S. E Street, San Bernardino, CA beginning at 5:30pm. Admission is $18. The importance of this celebration

The occasion provides an opportunity to showcase and celebrate the talents and achievements of Blacks who played the game of professional baseball during the years of segregation. Their organized efforts became a successful business enterprise generating millions of dollars in revenue and thousands of jobs in the Black community. The Negro National League and its athletes were an inspiring and grand success. They beat the odds, and represented the very best of the sport. The narrative of Blacks playing professional baseball are an important part of sports history. An enterprise of Black ownership launched and funded the Negro National League and Black baseball became known for showcasing a breakthrough style of speed, daring play and showmanship. continued on page 8

New Public Defender Building Opens in Downtown San Bernardino

an Bernardino County’s latest public building project aimed at expanding the county’s law-and-justice capacity opened Thursday, June 2. The facility will serve as the new headquarters of the county’s Public Defender and is located on the former site of the First American Title building. It is the latest addition to the downtown justice district and will allow the Public Defender to better serve its clients while also working to prevent first offenses and recidivism. Commenting on the new facility Board of Supervisors Chairman Curt Hagman declared, “This building and the Public Defender’s Office symbolize the County’s commitment to innovation and efficiency. This project will allow for cost-saving consolidation. Adult Services has been spread out over 3 different office locations.” Hagman noted how the new

building has allowed the Public Defender to move that team to a single location. “Also, the San Bernardino County Public Defender’s office was the first Public Defender’s office in the state to go completely digital with recordkeeping functions, and this building was designed to support that as well as the newest technologies,” he added. The three-story building located at 323 W. Court St., (across from the historic courthouse), has two floors of offices providing work accommodations for 120 county employees, while also having room for growth. State Assembly Moves to Eliminate Use of Toxic Chemicals in Everyday Products

egislators took another step toward controlling the intentional use of the toxic chemical PFAS in cosmetics sold in California recently when the Assembly passed cosmetics safety legislation, Assembly Bill 2771. PFAS are commonly identified as toxic “forever chemicals” because they do not break down in the environment and build up in the blood and organs. “Exposure to PFAS compounds, even in very low doses, has been linked to serious health problems,” said Assemblymember Laura Friedman (D-Glendale), who introduced Assembly Bill 2771. “I’ve authored this bill because Californians shouldn’t have to worry that they’re putting their health, or the health of their loved ones, at risk by doing something as routine as applying lotion or wearing makeup.” In 2018, EWG scientists scoured the Skin Deep® database, which provides ingredient lists and safety ratings for more than 85,000 cosmetics and personal care products, to see which contained PFAS. The report revealed the researchers identified 13 types of PFAS in more than 300 products. The products were found among more than 50 brands. “Prohibiting the sale of personal care products that contain these forever chemicals is a critical step toward reducing unnecessary exposure,” Friedman added. Forever chemicals are used in products like dental floss, lotions, cleansers, shaving cream, lipstick, eyeliner and mascara to purportedly improve durability, texture, condition or smooth skin, or make it appear shiny. Experts report cosmetics with the highest levels of PFAS are often marketed as “waterproof, wear-resistant or long-lasting”. “Concerns are mounting throughout the world about the toxicity and environmental persistence of PFAS chemicals. To tackle PFAS pollution of our bodies and the environment, all nonessential uses of PFAS must be restricted immediately,” said Environmental Working Group’s (EWG) Susan Little, senior advocate

for California government affairs. Little made these comments last October when Governor Gavin Newsom signed legislation restricting PFAS use in food packaging and paper straws beginning January 1, 2023. When Newsom signed the legislation last year it came more than a decade after experts warned of the health concerns posed by perfluorinated chemicals (PFAS) known to cause cancer and other harmful effects. However, despite the warnings, a report published by EWG in 2017 revealed fast food companies were continuing to use products including wrappers, bags, boxes, etc. coated with PFAS. Four years later, in 2021 California passed legislation to protect its residents. Also on January 1, 2023, manufacturers will be required to list–on their publicly available websites–any chemicals present in their pots, pans and other cookware and will be prohibited from making false marketing claims that lead customers to believe their products are PFAS free.

As a result of the same initiative, beginning January 1, 2024 manufacturers must begin labeling cookware that contains toxic chemicals on product handles or in coatings. “For the first time, cookware manufacturers must disclose on labels the chemicals present in the surface coatings of their products,” said Little. Very low doses of PFAS in drinking water have been linked to increased risk of cancer, reproductive and immune system harm and liver and thyroid disease. PFAS exposure is also linked to interference with vaccines and is associated with an elevated risk of breast cancer, increased cholesterol and other serious health concerns, explained EWG in a recent statement to the press. According to the nonprofit Safer Chemicals, at least 14 fast-food and casual restaurant chains with more than 123,534 stores and over $203.2 billion in annual sales collectively, have committed to eliminate PFAS in food packaging. continued on page 19

alifornia’s Task Force to Study and Develop Reparation Proposals for African Americans released an interim report on June 1 detailing the history and legacy of slavery across the nation and in Calfiornia. The report, nearly 500 pages long and divided into 13 chapters, examines the role and influence of slavery through the lens of a series of economic, political, social and cultural experiences, and scrutinizes how the remnants of slavery continue to generate barriers to African American prosperity. Assembly Bill 3121, the Reparations Task Force has spent the last two years examining what reparations in California could look like and who would be eligible. The interim report was submitted to the California Legislature and a final report will be issued by 2023. The final report is expected to include specific details regarding the monetary amount of compensation for eligible Black Californians. According to Task Force Chair Kamilah Moore, compiling the report took a year and is considered to be the “most extensive government-issued report on the African American community since the Kerner Commission in 1968.” Beginning with an analysis of the atlantic slave trade, the

Black neighborhoods — as “an enduring badge of slavery.” Preliminary Recommendations The report also includes a series of preliminary recommendations that identify ways to implement laws, repeal discriminatory legislation and eliminate other practices rooted in institutional racism. The recommendations include: Restoring rights to people who are incarcerated such as restoring their right to vote and being paid a fair market rate

California African American Freedmen Affairs Agency A final preliminary recommendation in the report calls for the establishment of the California African American Freedmen Affairs Agency that will be responsible for implementing the recommendations outlined by the task force. The cabinet’s role will be to “identify past harms, prevent future harm, work with other state agencies and branches of California’s government to mitigate harms,” as well as suggest policies designed to compensate for the harms. “Without accountability, there is no justice. For too long, our nation has ignored the harms that have been — and continue to be — inflicted on African Americans in California and across the country,” said California Attorney General Rob Bonta in a statement. “California was not a passive actor in perpetuating these harms. We must double down on our efforts to address discrimination in our state and nation and take a hard look at our own history, including at the California Department of Justice.”

It is important that Inland Empire youth, and many who grow up in challenging neighborhoods with limited opportunities, be exposed to positive events like the 66ers Negro League tribute to honor the legacy of their ancestors and be empowered by the organizations that bring them resources. Public recognition and highlighting the achievements of local businesses and the people who serve, motivate, encourage, and inspire, is another important element of this event as it is equally important for Black youth and others to see role models of professional success in the community. There will also be a fireworks display preceding the baseball game. This will be a family fun event where all are welcome. Role of pubic defenders in San Bernardino County Public defenders provide services beyond defense as part of their role in the criminal justice system. Those efforts include operating the county’s Parent and Child Connection Program, working with youth and neighborhoods through the “Let’s End Truancy Program,” and conducting record clearing clinics that remove barriers to employment for those committed to improving their lives. The public defenders’ team also includes social workers who work to help their clients obtain resources needed for stability and selfsufficiency, such as housing, behavioral health counseling, social services, and alcohol and drug rehabilitation. As noted on the county’s website, Public Defender Thomas Sone acknowledged the Board of Supervisors’ recognition of the need for a strong and well-funded Public Defender. police unions that fund/have funded his campaigns, to mishandling high profile cases involving children, to claiming misappropriateness in the 2022 Election in support of Trump’s Big Lie and the list goes on. Crisis of Connections The issue of judges and elections being intimately connected not only applies at the federal level in relation to presidential appointments of Supreme Court Justices, appeals and district court judges, but also locally, when District Attorneys put their thumbs on the scale in local elections for their favorite candidates for Superior Court judges. Judges are being elected in four Superior Court Offices in Riverside County this year including 4, 11, 26 and 28. There are ten candidates vying for these four positions. Six of the candidates, in other words, 60%, are not only endorsed by Hestrin but the majority of these candidates also enjoy the support of Hestrin’s incapable and incompetent side-kick and sheriff-who-aligns with-accused insurrectionists, Chad Bianco. You will not be surprised to also learn these same judicial candidates like their endorsers enjoy strong support of sheriff/police unions–we all know what “birds of a feather” like to do...mostly resist any efforts aimed at substantive and meaningful systemic reform.

If you have not voted For those of you who are yet to cast your June 7 primary votes, I encourage you to consider the following candidates to fill the open judicial positions in Riverside County who are not aligned with Hestrin and Bianco (who I believe have failed to serve the best interests of all county residents).
