Criminal Justice Leaders Fail Riverside County Part 2 – A Matter of Integrity “Integrity is usually defined as doing the right thing when no one is watching. A person who lacks integrity will make decisions based on how it will make them look rather than how it will benefit others. They look at their actions as a performance to be rated for approval rather than a step toward doing the right thing for the community.” - LaRae Quy he purpose of this two-part commentary was to weigh in on the failures of Riverside County’s criminal justice leaders, Sheriff Chad Bianco, and District Attorney Mike Hestrin. Last week I commented on what may prove to be a gross misappropriation of COVID-19 funding intended to benefit the community that Chad Bianco instead used to spruce up his fiefdom including the installation of bullet proof glass and security locks to protect the sheriff department from those it is supposed to protect and serve. (Source: Facebook) This week, I turn my attention to Riverside played a role in the termination of the second County District Attorney Mike Hestrin who will deputy DA assigned to the case, that Hestrin was need to do his own tap dance around another unaware of the it at the time and now that it has breaking hot button issue—allegations from come to light he has managed to keep a social former Deputy District Attorney Christopher distance as if it were a virus. hen Reverend Barry Settle, who leads the Allen Chapel AME Church in Riverside, was asked to partner with Alternatives to Domestic Violence to create a program to assist young people who are victims, it was no surprise. Allen Chapel has continued creating community, healing the broken, and fostering opportunities for growth and improvement since its inception in 1875, and the need to heighten focus on the issue of domestic violence within the broader Riverside community aligns with this mission. The Numbers Highlight the Need According to the California Department of Justice (CA DOJ) data, domestic violence calls to 911 for the years 2011-2020, the number of calls in Riverside County were down in 2020 from 2019 from 7169 to 6,344 respectively. Taking a longer view however, domestic violence 911 call had steadily trended upward for the most part since 2012 This downward trend, however, was reversed relative to domestic violence calls involving firearms and strangulations. In 2019 the number of 911 calls for assistance where one partner attempted to strangle or suffocate the other were 244 in contrast to 274 cases reported in 2020. To some extent, the CA DOJ data is limited. According to the DOJ Open Justice site, some information was not available for years prior to 2018. Statewide the trend was similar, overall 911 calls were down slightly from 2019 to 2020 while the number of calls related to the use of firearms and/or strangulation were up. There are also concerns that Covid-19 and the ever changing social and economic situation the pandemic brought with it continues to increase stressors that will increase the problem. During lockdowns, victims and their abusers were forced into more frequent contact with one another, perhaps making it more difficult to report crimes or call for help. In the Spirit of Service Speaking about his non-profit and how his ministry began to focus on the serious issue of domestic violence Settle shared, “The name of [the non-profit] is, In the Breech, and the mission is primarily focused on providing individuals, whether male or female, pathways to success in life. Helping them navigate through life, connecting their passions, gifts and talents to their purpose.” In the Breech does this by providing training, encouragement, and guidance to those they assist. The primary focus of the non-profit is to help youth and young adults. A New Focus Reverend Settle began his focus on the problem of domestic violence when he was invited by Florence White, Chief Executive Officer of Alternatives to Domestic Violence to sit in on a panel discussion with men who were victims and as he noted, “Possibly instigators of domestic violence.” He also attended a conference on domestic violence, intimate partner violence (IPV) and the church in San Diego with a colleague.

“It brought awareness and I was blown away that senior women were still dramatically affected by ex-husbands who abused them twenty, thirty years ago. I mean moved to tears. And it really blew me away that these individuals were in my congregation and I had no knowledge that they had even been affected by it.” - Reverend Barry Settle According to Settle, both experiences made an impact on him, however it was through his association with Florence White, that his mission began to grow. Settle was asked to assist with a new program specifically designed to help young victims and survivors of domestic violence, IPV, sexual assault and date rape, deal with the trauma. It is called the Chrysalis Program. It offers information, assistance, resources and help to those who need it. Reverend Settle assists with outreach. A role he is uniquely qualified for, through the church’s connection with other congregations not just in the Inland Empire but “... throughout Southern California…” Through his ministry and community connections, he hopes to identify those who are suffering with issues of domestic violence and provide them with assistance.

n November 2019, Rochelle Kanatzar posted on Facebook expressing sadness for her nineyear-old daughter who experienced a jarring racial encounter at school that brought her daughter to tears. “I shared my daughter’s experience because I wanted to show everyone that, yeah, in fact, we do have [racism] here. And my nine-yearold daughter has experienced it. And she went to school one way and came back a little bit different because of that experience,” Rochelle said. After sharing her daughter’s encounter, Erin Maroufkhani reached out to Rochelle to discuss how they could take action and show Edison Rose, Rochelle’s daughter, and the community of Riverside, that “Black is beautiful.” Together, Rochelle, Erin and Shea Ellis organized the idea for the RISE! mural, a mosaic depiction of thirty plus African American portraits who have contributed to the Black community throughout history. The mural was unveiled in Riverside on July 21 and is one of the largest public art installations in the city. The mural’s name is inspired by Maya Angelou’s celebrated and widely respected, “Still I Rise” poem, Edison Rose’s favorite poem. The death of George Floyd, Edison’s experience, and the poem served as the focal points for the mural’s design and inspiration. During the ceremony, Edison Rose read the poem before the mural was revealed. “Tonight we’re here to unveil a magnificent piece of art that both honors and supports another step of diversity, inclusion and education for our community,” Shea said in her welcome speech during the ceremony. For Shea, her contribution to the mural was done “as a personal acknowledgement of what was happening in the world.” The mural includes portraits of Breonna Taylor, George Floyd, Ahmaud Arbery and Elijah McCain in recognition of the Black lives taken in 2020. “And for us, our focal point was George Floyd because we felt that in his tragic death, it was the catalyst for the world to kind of open their eyes to the injustices that African American people face and that Black lives do, in fact, matter,” Rochelle said.

The mosaic mural is the artistic production of 14 artists and took a little over a year to plan, design and complete. Due to the pandemic, artists were unable to collaborate in person, so instead they received a box of mosaic materials and relied on Youtube tutorials to complete their portraits. The mural was supported by the city of Riverside who provided funding for the mural and by a local tile company who donated mosaic materials. One of the contributing artists is Adeola Davies-Aiyeloja who created mosaic portraits of Maya Angelou, Rosa Parks and Amanda Gorman. Adeola’s first portrait was Maya Angelou because a lot of Angelou’s poems resonate with her. “[I’m)] also so proud to have something that represents so many of the African Americans in the city of Riverside. I can’t describe the feeling. It’s overwhelming, just the feeling,” Adeola said. “What I hope that they will take away from it is the openness, and really to look at the different portraits and look at the contributions.” Adeola was surprised and excited to see her own family in the crowd during the unveiling. Her nephew came and brought his children to see the mural and the different figures portrayed in the art. She hopes that parents of all ethnicities will bring their children to see the mural and teach them that Black history is American history.
“It’s really a springboard for them to be able to open their kids’ eyes and say, ‘These are people that made history, these are people that contributed to history and the African American community, but also in the American community because they are Americans. And we should look at everybody’s contributions,’” Adeola explained. Alongside the mural a plaque will be placed which will contain a QR code that will allow passersby to scan the code and learn more information about the people in the mural by providing resources, videos and reading materials. Rochelle also hopes that teachers will be able to use the mural as a way to develop curriculum around Black history. “We’re excited about the aspect of the mural being interactive. We encourage and want people who pass by to touch and feel the mural in its uniqueness. Each of us are unique tiles in continued on page 17

In addition to his work with Chrysalis, the Reverend teaches for the Board of Examiners (Board) in the Southern California Conference of the AME Church. The Board is responsible for the training and education of those called to the ministry. Through his association with the Board, Reverend Settle has made identifying those who are victims and survivors of domestic abuse a priority in the ministry by teaching a workshop on domestic violence and the church, to student ministers. He also teams with Riverside law enforcement to refer cases involving victims of domestic violence or sex trafficking to his organization for assistance in overcoming the trauma inflicted by those experiences. A Path Revealed The path Reverend Settle is on regarding domestic violence revealed itself over time. “You know this isn’t something that I went after. I guess I kinda stumbled into this, actually like I said, through Florence White. What happened was during domestic violence month, I think it was in 2019, 2018, we had domestic violence awareness day. We held various workshops throughout the church that morning and I was very much moved at the number of women in my church who have been victims of domestic violence. It kinda brought [me an] awareness.” He continued, “I was just blown away that senior women were still dramatically affected by ex-husbands who abused them twenty, thirty years ago. I mean moved to tears. And it really blew me away that these individuals were in my congregation and I had no knowledge that they had even been affected by it.” According to Settle, this moved him to do more research and reading on the subject. “I thought that this would be a good thing to teach to the student ministers. I never learned it in seminary or in my Board of Examiners, but it’s part of my curriculum now.”

Making it Known Reverend Settle strives to teach and preach against the negative behaviors which lead to domestic violence. He explained he preaches it whenever something occurs in scripture that has to do with sexual assault or control of women. He encourages student ministers to mention it in their sermonic presentation or in their teaching. “You don’t have to do a whole sermon on it,” he noted, “but just to let the congregation know this isn’t right and kind of bring awareness from that perspective.” The Reverend recalled a time when a young person, a teenager attending his workshop, came to him afterwards to seek help for a relative, an aunt who she believed was being domestically abused. “So, we had interactions with her, provided her with resources that she gave to her aunt and told her she can have her aunt contact us.” According to Settle, to his knowledge the aunt never followed through, but he believes just making teens, society in general, aware that it is wrong is important. Settle is also the father of a daughter and he wants it to be known how he feels about the treatment of women. He describes his method as a meshing of both secular and theological approaches to domestic violence. He accomplishes this by pointing out in scripture where women are being controlled or abused and he makes the congregation aware of where he stands on the issue, perhaps making them less afraid to share their personal pain and problems stemming from domestic violence with him. The Allen Chapel Legacy Allen Chapel is one of the oldest predominantly Black churches in Riverside, California. It began in the home of Mrs Dobbs and opened its doors in November, 1875. But, when it comes to raising his voice against any former teammates in the District Attorney’s office who may have played a role in the alleged travesty, it is as if the Screen Actors Guild took Hestrin’s SAG card and he lost his public platform. Parker spent four years in a Riverside County jail on suspicion of murder due to possible misdeeds in the DAs office and now works as a dishwasher because it was difficult for him to find a job, with an arrest background for murder. In the meantime, those in the DA’s office have gone on with their lives apparently unphased by time stolen from Parker’s life. It is frightening the power these individuals wield despite the possibility or should I say, strong probability, they themselves have violated the law. Just for clarity, though previously a misdemeanor, in 2016 California made it a felony for prosecutors to withhold or alter exculpatory evidence. In the meantime, Hestrin must own a cat, because it appears to have gotten his tongue on this issue. While Hestrin Ignores this Issue, He is Extremely Vocal on Others Though, Hestrin’s silence is no surprise. He chooses to ignore this issue just as he has ignored reality that since the death penalty was reinstated in the U.S. in 1973, 156 death row inmates have been exonerated (an average of more than three per year) while he continues to bask in his earned reputation as the champion of the death penalty sentences in California and across the country. In many ways choosing to ignore the purported bad acts of former peers relative to the withholding of exculpatory information in a murder case, kind of fits Hestrin’s modus operandi. I would also note that again and again across the country death row inmates continue to be exonerated because prosecutors have withheld exculpatory evidence. When the Parker case was bouncing around the district attorney’s office between 2010 and 2014, Hestrin either operated in a bubble, was willfully ignorant of the concerns surrounding this case or, more likely

since it was brought to closure in 2014, hoped it would never resurface and if it did, people would glance over it and blame his predecessor. But, what about his responsibility since he’s taken office? As far as I am concerned, Hestrin has failed in his due diligence to the people of this county, regarding the inappropriate handling of the Parker case and the responsibility and/or accountability of those involved especially since they both hold high office within his jurisdiction. Judging From Hestrin’s Own Record, No Wonder He Ignores Alleged Wrongdoings by Former Peers According to Hestrin’s mission as the public prosecutor acting on behalf of the people of Riverside County he is pledged to, “vigorously enforce the law, pursue the truth, and safeguard the rights of all to ensure that justice is done on behalf of our community.” Well, that may be his mission, but it does not appear to be his goal. Hestrin has one goal—to stay in office and as it appears, by any means necessary. Regarding his failure to speak out in response to accusations related to the Parker case, maybe he just does not want to ruffle the wrong feathers. Hestrin and the boys (and girls) in blue may be tough on crime, but it appears, only certain crimes. There is a brotherhood among all agencies in this nation’s criminal justice enterprise that undergirds questionable behaviors like what is alleged in this case. Afterall, one of the issues raised regarding the handling of the case involved questions over the quality of work by officers involved. Hestrin appears to keep a sharp eye on his re-election potential and works overtime to keep his chief patrons - police unions - happy. Even the gross amount they have spent to support him over the years appears not enough to satiate his political aspirations or were deemed enough to fill his coffers during the 2018 election cycle. Hestrin grabs campaign contributions regardless of its source. For example, after accusing an engineering company, Urban Logic, doing business with the City of Beaumont of embezzlement, Hestrin claimed he “unknowingly” took $2,500 for his 2018 re-election campaign from Webb and Assoc., the engineering company awarded a $2.3 million dollar “no bid” contract selected to replace Urban Logic. Only after it was reported in the press did Hestrin claim “no knowledge” of the donation (it was funneled through a PAC) and agree to return it. However, this restitution rang hollow for many who recalled a similar event that played out previously, subsequent to his 2014 campaign, where he accepted donations from Jeffrey Darrow, owner of Certified Tire & Service Centers, who paid more than half a million dollars in civil penalties plus restitution for cheating hundreds of customers by performing unnecessary repair work on their cars. Of course, Hestrin claimed no knowledge then also and pledged, “I hold myself and this office to the highest standard of ethics. I think it’s the right decision to return the contributions in full.” It took nearly two years for that mea culpa, and I guess since it worked out so well for him, it was no wonder he tried again in 2018. Journalist H. L. Mencken once wrote, “The difference between a moral man and a man of honor is that the latter regrets a discreditable act even when it has worked, and he has not been caught.” continued on page 14

ugust marks National Black Business Month, a month in which Black businesses and Black entrepreneurs are recognized and celebrated for their successes, milestones, and historical progress. According to the Annual Business Survey data, “Blacks or African Americans owned approximately 124,551 businesses, with about 28.5 percent or 35,547 of these businesses in the Health Care and Social Assistance sector, the highest percentage of any minority group,” as of 2018. Throughout history Black businesses have endured systemic racism, redlining and even violence as evidenced by the Tulsa Massacre in which an economically thriving Black community in Tulsa’s Greenwood District was attacked and destroyed in 1921. This past year and a half has also disproportionately impacted Black

businesses due to the pandemic which forced many businesses to close, resulting in a 40 percent drop in Black business ownership. In spite of it all, Black businesses continue to grow and succeed. According to the Yelp Local Economic Impact Report, Black businesses and women-owned businesses have persevered despite the setbacks caused by the pandemic. The report noted that the rate of searches on Yelp in the U.S. for Black-owned businesses increased by 3,085 percent. Black business owners today can partially give credit to historic figures like Booker T. Washington and W.E.B Du Bois who established organizations and guidelines for the development and growth of Black enterprises. Stop the Newsom Recall- Just Say “NO!”
C
alifornia will hold a special election on September 14th to recall California Governor Gavin Newsom. The effort is being funded by the rightwing White supremacist leadership of the Donald Hardy Brown, Sr. Trump Republican Party. P u b l i s h e r This effort is happening on our watch, and it is up Emeritus to us to prevent the recall Photo by Benoit Maphettes from happening by VOTING NO in response to the recall effort. In other states they are passing laws to deny Blacks and other ethnic groups access to the ballot because of what Black voters did in South Carolina by electing President Joe Biden. Then, Blacks turned around and showed out “sho’ nuff” in Georgia. They were instrumental in not only electing a Black man, Rev. Raphael Warnock, but also electing a Jewish man, Jon Ossoff. Both men are now seated in the U.S. Senate representing the state of Georgia. There are many in this country, who believe these kinds of people are not supposed to be elected to represent the White people in Georgia—it sends the wrong signal to the Ku Klux Klan. So, make no mistake, this recall election is important in California because it will show those who would out-right deny our Black brothers and sisters in Republican controlled states the right to vote, “We stand in solidarity with the rights of all citizens to vote and elect our political representatives.” Here are important dates and information related to the Newsom recall: • All active registered voters in California will soon receive a vote-by-mail ballot for the September 14, 2021, recall election. County elections offices will mail ballots, beginning by August 16, 2021. • If you do not receive a mail ballot, you can request a replacement ballot by mail before Tuesday, September 7 by calling (800) 881VOTE (8683). Voters in San Bernardino can also call (909) 387-9300 or email MailBallots@
sbcountyelections.com. Be sure to include your name, residence address, mailing address, and date of birth. Voters in Riverside County who do not receive their ballot can also call (951) 4867200. • After September 7, replacement ballots must be requested in person at the Registrar of Voters office, an early vote site, or a polling place. The recall ballot will ask two questions: 1. Do you want to recall Governor Newsom? I am asking you to join me by voting NO! (If 50 percent or more vote NO, the governor will remain in office.) 2. Who should succeed Newsom (if he is recalled)? It is important to also question this question EVEN WHEN WE VOTE NO. This is because on the outside chance the recall is successful— this will be the ONLY opportunity we will have as voters to select a Democrat to replace him. Beware, however, when selecting a candidate in response to question #2 of a popular Republican candidate in “Black” face, the notorious Larry Elder. He is a ringer in the recall election being used by the Republican

Party to draw support from unsuspecting Black voters to help Republicans gain control. We are smarter than this and will not be fooled by the color of Elders’ skin—we know a Clarence Thomas, Ben Carson, or Tim Scott, when we see one. If you return your vote-by-mail ballot with prepaid postage, it must be postmarked by September 14, 2021. You can also return your ballot by depositing it to a secure ballot drop box, delivering it to a voting location, or to your county elections office. If you choose this option, it must be delivered by 8:00 p.m. on September 14, 2021. Visit https://caearlyvoting.sos.ca.gov for Early Voting and Vote-by-Mail DropOff Locations. Visit https://www.sos.ca.gov/ elections/polling-place to locate your polling place for in-person voting on Election Day. In-person voting locations will offer voter registration, replacement ballots, accessible voting machines, and language assistance to those who need it. Please do this for me and vote NO in response to this senseless recall election.

KEEPING IT REAL Criminal Justice Leaders, pt. 2, continued from page 9
There is little doubt the actions of those who were involved in the Roger Wayne Parker case in the Riverside County District Attorney’s office should be investigated to determine the validity of the complaint levied by the ex-deputy district attorney against them--the residents of Riverside County should demand it. In conclusion The residents of Riverside County deserve far better than the criminal justice imposters, Hestrin and Bianco, who currently hold such key positions in this county. Elected officials are supposed to be held to a higher standard yet here in Riverside County Hestrin and Bianco fail to rise to the minimal baseline in terms of ethics and integrity owed to the taxpayers who employ them. Of course, this is just my opinion. I’m keeping it real.

The congregation is AME or African Methodist Episcopal--the term African refers to the descent of its founders. The church itself is welcoming to everyone in the community. Allen Chapel carries the name of the original founder of the AME Church, Richard Allen, who established the first independent Black congregation in the United States in Philadelphia in 1816. Allen, who helped care for the victims of a plague of yellow fever in Philadelphia in 1793, could not know the echoes of healing and of service set by his acts would be followed by Reverend Settle and his church during the current time of plague. Reverend Settle, in the best traditions of the AME Church, community building, education and assistance to those in need, has helped improve the lives of those he has been called to minister to as well as society in general. In that way he carries on the idea of service and uplift begun with Richard Allen and for that we should all be grateful.
