California Extends Unemployment Benefits by 20 Weeks

Sacramento, CA – Untold numbers of inland area residents have lost employment due to COVID-19. Under normal circumstances most workers are eligible for 26 weeks of benefits. Many California workers who have drawn benefits since the virus began to escalate in mid-March and are nearing the end of their eligibility period. In response to the virus’s ongoing impact on the economy and the number of Californians still off work, the state’s FED-ED program has extended those benefits for another 20 weeks. Individuals who exhaust their regular unemployment benefits will be automatically switched to the FED-ED benefit program by the state if they qualify. Those who do not qualify will be notified so the decision can be appealed. More information about the FED-ED program including a list of qualifications is available online. In the months since the onset of COVID-19 in California the state processed more than $9.3 million unemployment claims.

SBSC holds Virtual Town Hall Meeting Addressing Civil Unrest and Racial Inequality Saida Maalin | Contributor

he San Bernardino Superior Court county officials and leaders held their first virtual town hall meeting July 30 to discuss racism and civil unrest in the community and how each agency will take action towards these issues. “I have long been on the receiving end of some of the issues on the table for discussion today,” said Fifth District Supervisor Josie Gonzalez. “I can definitely speak to the challenges well camouflaged either within our working environment, living environment and entertainment environment and want to be very cognizant of the fact that as leaders we are aware of the changes that take place in our environment. We all know the only constant element in life is change and we also know as judicial, executive and legislative leaders and representatives of the people we have the responsibility to enable and implement said change.” The host and moderators of the virtual meeting were SBSC Judge Khymberli S. Apaloo, Judge John M. Pacheco and Judge Winston Keh. Panelists who participated in the virtual town hall included Supervisor Gonzales, 47th District Assemblymember Eloise Reyes, District Attorney Jason Anderson, Public Defender Christopher Gardner, Undersheriff Shannon Dicus, Assistant Executive Officer CaSonya Thomas of Health and Human Services, and San Bernardino County Bar Association President Eugene Kim. “This has been an opportunity for us to listen, in particular my office to listen to the community. One of the things I want to point out that I’m proud of what we’ve done since I’ve been in office for a year and a half our mission statement already includes the words ‘equal justice for all.’” said District Attorney Anderson. “We have started for the first time ever in SB County an independent review of all officer involved shootings that occur in our county and we’ve also established a community commission that will begin right away with 17 members in the community selected by the supervisors in

the county.” According to Anderson this was not done in reaction to anything and is being done because it is the right thing to do so that community

Unemployment Benefits and the Coronavirus

W

hile California families have been struggling with the COVID-19 pandemic, many have had difficulty filing or receiving unemployment benefits. Even getting someone on the phone to answer questions has been a struggle for many. The federal government has allowed states to change their unemployment benefits laws. It lets them provide unemployment benefits for situations related to the coronavirus COVID-19). And, the Coronavirus Aid, Relief, and Economic Security (CARES) Act has expanded benefits further. It authorizes: • Self-employed workers and gig workers to receive unemployment benefits • All unemployed workers to receive an extra $600 a week for up to six months • Unemployed workers to get an extra 13 weeks of benefits beyond the number a state currently

provides Pandemic Unemployment Assistance (PUA) is one of the federal CARES Act provisions that help unemployed Californians who are not usually eligible for regular Unemployment Insurance (UI) benefits. This includes business owners, self-employed workers, independent contractors, and those with limited work histories who are out of business or have significantly reduced their services as a direct result of the pandemic. This program includes up to 46 weeks of benefits from February 2, 2020, through December 26, 2020, depending on when you were directly affected by COVID-19. PUA launched with up to 39 weeks of benefits and an extra seven weeks was recently added. How to file for benefits. The fastest way to apply for benefits is through UI Online, just

as you would for regular UI benefits. You can also apply for PUA by phone, mail, or fax. For more information on how to file a claim, refer to the Unemployment Benefits Guide. If you qualify for regular UI, do not file a PUA claim at this time. If you filed for UI and received a notice that you have $0 in benefits available, visit PUA FAQs for what to do next. Help for veterans with disabilities. If you are a disabled veteran who has lost a job due to COVID-19, DAV (Disabled American Veterans) has established a COVID-19 Relief Fund. This small assistance relief program will provide up to $250 for those who qualify. Even though it is a small amount, it may help those who have experienced delays in receiving a check from EDD. Redlands Declares Racism a Public Health Crisis With a Vision for a Better Tomorrow

hen the City of Redlands declared, “Racism a Public Health Crisis,” it created a living document with transparency, milestones, and measures for success as a beginning to a more equitable tomorrow. Mayor Pro Tem Denise Davis and fellow councilmember Eddie Tejeda, after realizing they were each working on separate initiatives to address this concern, joined forces, combined their work into a single instrument and with input and support of many in the community, carried it across the finish line. “We started shortly after George Floyd was murdered,” Davis began. “The murder of George Floyd was completely shocking and devastating for much of America who have watched the video or who had heard of the video. And that, coupled with the work the Black Lives Matter movement has been doing for years, I think this was really a critical point where people across the country said we've had enough, this has got to stop. This

has gone on too long. These injustices are beyond comprehension and we need to move towards a solution now.” Davis described how she believes the pandemic has helped elevate this issue in interesting ways. “A lot of us are confined to our homes and I think it has given us an opportunity to really not look away from what's happening and what really matters out there. I'm glad more people seem to have the time and energy to be engaged in what's happening and paying attention in ways that we have not seen before in recent times.” When the Resolution was approved by the city council on July 21, 2020 it represented an historic milestone for the city. “To my knowledge there's never been a resolution specifically about racism with explicit terms like this one,” explained Davis addressing the continued on page 13

California Props 15 & 16 - Seizing the Zeitgeist

A

s cries for equity continue to reverberate around the nation and across the state, on November 3, 2020 California voters will consider issues related to equity in education when they weigh in on two important Propositions, 15 and 16; and if approved, will reinstate Affirmative Action and increase local funding for education respectively. Beginning with Affirmative Action, a “yes” on Proposition 16 will amend the state’s constitution by repealing the mandates of Proposition 209 passed by voters in 1996 which brought a devastating end to Affirmative Action in California. Proposition 209 limited access to higher education at state institutions of higher learning for Black and Brown students and restricted access of women and minority-owned businesses to state contracts among other disadvantages for minorities in the state. Since the implementation of Proposition 209 enrollment of Blacks and other minorities in the state’s public colleges and universities has decreased dramatically and, in the years since, Civil Rights groups have worked to overturn it. However, despite their best efforts, a coalition of Republicans and conservative Democrats coupled with outsized support of many Asian groups—concerned about how their students may be impacted if the state overturned Proposition 209—have worked and successfully blocked all efforts to undo it. This year, however, under the stewardship of California Legislative Black Caucus President, Dr. Shirley Weber (D-San Diego), the legislature broke through those barriers like an idea whose time has come, and succeeded in placing Proposition 16 on the November 3rd ballot, giving voters a chance to right its 1996 wrong. Proposition 16 looks to repeal the barriers to state contracts for women and minorities embedded in Proposition 209 and to provide equitable access to higher education for minorities. The seeds of the proposition were planted in the California Act for Economic Prosperity, ACA 5, authored by Weber, Ph.D. After successfully

passing through the Assembly, ACA 5 passed the state Senate June 24, following a lengthy debate. “The fate of Prop. 209 will now be in the hands of voters on November 3rd [as Proposition 16],” said Weber. “While it was sold as a civil rights law when it passed in 1996, Proposition 209 has cost women and minority-owned businesses $1.1 billion each year, perpetuated a wage gap wherein women make 80 cents on every dollar made by men, and allowed discriminatory hiring and contracting practices to continue unhindered.” Despite this daunting reality, when the Black Voice News spoke to the 1996 face and chief advocate of Proposition 209 former UC Regent and African American, Ward Connerly

near the legislation’s 20th anniversary in 2016, it was clear he would not accept the reality of the legislation’s devastating impact on Black Californians. To many, Connerly is a classic example of a Black man who attained a highly respected position of prominence owed to Affirmative Action and then pulled the ladder up behind him by advocating for the dismantling of a signature achievement of the Civil Rights era. Connerly’s comments in 2016 were as inexplicable as his advocacy for Proposition 209 two decades earlier. “As a UC Regent, who was a fiduciary,” he explained, “I took action to right what I saw as a wrong.” continued on page 17

L

ate Monday evening, August 3, the U.S. Census Bureau announced updates to the nation’s 2020 Census plan that included enumerator awards and the hiring of more employees to accelerate the completion of data collection and apportionment counts by the counts statutory deadline of December 31, 2020. Despite the agency’s announced commitment for enumerator awards and additional hiring, U.S. Census Bureau Director Steven Dillingham stunned the nation with the following announcement, “We will end field data collection (door to door) by September 30, 2020.” Self-response options will also close on that date to permit the commencement of data processing. Under this plan, the Census Bureau intends to meet a similar level of household responses as collected in prior censuses, including outreach to hard-to-count communities. The announcement was stunning when one considers at least 40 percent of the nation’s households have yet to respond to the census questionnaire; and in light of the historic undercount of minority communities already being impacted by COVID-19, the potential for an even more grievous undercount could be devastating to these communities in the coming decade. Earlier this year due to the impact of COVID-19, the Census Bureau extended the decennial census count’s July deadline to the end of October. Even with an end of October deadline, census officials expressed concern about being able to accomplish a complete count—now, the window is a month shorter. The shortened census response window may impact efforts to increase census response rates in hard-to- count communities since there is now less than two months left to reach

people of color, immigrants, renters, rural residents and other members of historically undercounted groups who traditionally are less likely to respond. The bureau’s announcement was diametrically opposed to the position it took just three months ago when it asked Congress for a four-month extension to the December 31 reporting deadline, citing extraordinary times due to the pandemic. Due to the extraordinary nature of the pandemic the rationale behind the request was to help ensure the completeness and accuracy of the 2020 Census. “I’m very concerned,” said California

When asked by the Black Voice News on Tuesday to respond to the Census Bureau’s Monday evening announcement, CroftsPelayo explained, “I am deeply concerned that the U.S. Census Bureau’s decision to cut short the planned count will increase the risk of an undercount throughout the nation and especially in California.” She continued, “We know the most difficult work lies ahead—this is true during any census but especially in light of COVID-19.” She further highlighted how millions of households have yet to respond. “It’s critically important the 2020 Census take all the time necessary for a complete and accurate count,” Crofts-Pelayo stressed. “If not, millions will go uncounted nationwide – and – with the largest population of any state in the nation – California could feel the repercussions of these actions deeply.” To date Californians are performing above the national average in self response participation at 64.3 percent compared to the national average of 63.0 percent. Riverside County is behind the state average with a self-response rate of 61.7 percent; while San Bernardino County lags further behind with a self-response rate of only 60.7 percent. A sampling of response rates in a few local cities through August 3rd showed the City of San Bernardino continues to lag far behind the state average with a self-response rate of 58.3 percent; Rialto 64.8 percent; Fontana 66.8 percent; Riverside 66.1 percent; Perris 61.1 percent and Moreno Valley 64.3 percent. According to Connerly, he never had any delusions about what Prop 209 would accomplish and whether the attainment of its objectives would happen overnight or in a couple of decades. On this point he was right. In nearly 25 years, it has only served to deny Black and Brown students equitable access to the state’s public colleges and universities. Even as late as 2016 he still believed, “The problem [Black students experience gaining admission to UC schools] lies in the culture of the family,” rather than institutional and systemic racism as it relates to equality of opportunity. Yet, we need look no further than a series of incidents that occurred in recent years for clear examples of continued institutional and systemic racism regarding equal access to the state’s institutions of higher learning. It took a lawsuit by minority students and their parents in Los Angeles to expand access to Advanced Placement courses. Such courses give students an opportunity to take high-level classes for college credit and provides an added advantage for college admissions. In 2016 a state audit revealed since 2010, qualified and more competitive minority candidates were passed over for admission to the UC system and less competitive, international candidates with lower GPAs were admitted instead. And most recently, the nation watched as wealthy, predominantly White parents were charged in a wide-spread scheme where they paid thousands of dollars to buy their child’s admission to some of the state’s finest schools. Connerly claimed regarding the passage of Proposition 209, “I wanted to start the process of going back to the days when America aspired to be a ‘colorblind society.” Yet, he never identified when exactly in the nation’s history that was. However, according to Weber, far from being colorblind, Proposition 209 established barriers which prevented women and minorities in the state from fully sharing in the economic life of California. The timing of Weber’s legislation allows the state to capture the zeitgeist of this moment in history, the time for change in relation to this important issue could not be more appropriate. The murder of George Floyd in late May at the hands of a Minnesota policeman coupled with the widely disparate impact of COVID-19 on Black, Brown, Indigenous and other minority communities, has awakened many

in the nation to issues of equity and lack of opportunity impacting these communities in all aspects of American life including, education, employment, housing, healthcare and more. With voter approval of Proposition 16 in November, California will finally be able to join 42 other states by allowing race or gender to be considered when accepting students to public colleges and universities and in the allocation of state contracts. With the passage of this legislation, the state will finally be back on track in its stalled efforts to overcome historical barriers to equity in education, employment—especially careers in public service—and, among minority- and women-owned businesses. The Black vote is going to matter in this cycle. Malia Cohen, California State Board of Equalization, commented about the significance of the Black vote in the coming election and stressed how much it will matter on this and other important issues. “There are many experts who expect record-breaking turnout. We need turnout,” she stressed again. “The only way we can accomplish this is with the ballot.” Speaking to the significance of Proposition 16, Assemblymember Weber shared, “Two years ago, only two corporations had an African American on their boards. If they are not on your board, they probably don’t work in your company,” she stated to emphasize the importance of substantive action. “It is not enough to say you are committed in words, striking down Proposition 209 is about removing barriers that prevent us from going to college.” More than 500 organizations across the state have joined a coalition in support of Proposition 16. In other states where race qualifications are considered in admissions, minorities have done exceptionally well. As one advocate declared, “To say race is not a factor when it is in everything that we do in this country is not true. Race and gender are the first thing people recognize when you walk in the door.” “Proposition 209 has hindered public policy, thwarted opportunity and maintained economic disparity long enough. It’s time to give voters a chance to right this wrong,” Weber declared. On June 25, UC Regents declared their support for an end to raceblind admissions. As the nation begrudgingly settles into this new normal we need to think outside the box for solutions—putting additional lives at risk, especially the lives of our children under the guise of education is anti-intuitive—it is against our basic instinct as human beings to survive, to protect our children at all costs. We can close our eyes and pretend this is not being driven by the economy, but we all know better. This should make us question who we really are. And, what are we really racing to achieve? We’ve already won the prize for the most irresponsible nation on the face of the earth in managing a deadly pandemic. The number of COVID-19 positive cases, outstripping most of the rest of the world combined, as well as the number of deaths in this nation is unconscionable. When it comes to the coronavirus we need to somehow get it through our capitalist heads, more is not better. We are not winning. We are not making “America Great Again” by risking more lives for the sake of the economy is not a strategy for success. If you do not believe it is about the economy consider this, teachers and parents will need to buy gas to transport children to and from school; school bus drivers will be back on the job buying even more gas to fill the school buses while earning their regular income to spend more on essentials and non-essentials as will teachers and administrators; farmers will be able to sell more to the schools and cafeteria workers will need to be on the job to prepare it—earning their salaries to buy more stuff whether essential or otherwise; kids will need school supplies, school clothes, wellness checks, vaccinations, and of course as is the way of America, security officers will be called upon to maintain campus security, and the list goes on. Each action, each item on the laundry list of what must be put in motion to open the schools will turn the giant wheel of the economy. What will be considered an acceptable loss in terms of

illnesses and lives lost this time around? It appears this nation has fallen down the rabbit hole described by Lewis Carroll in his seminal work Alice's Adventures in Wonderland. Yes, just like Alice’s experiences when she fell down the rabbit hole in Carroll’s childhood novel, the current circumstances are surreal. Before the dawn of 2020, many held firm to the belief that something of this magnitude— COVID-19—could not possibly happen in America, there were too many safeguards. Not in America.” Perhaps when we were children ourselves, had we paid closer attention to the conversation between Carroll’s Alice and the ‘White Queen’ we would have a better understanding of what happens when you fall into a rabbit hole where everything is upside down and backwards. We would have learned about the need to believe that nothing is impossible and perhaps we would have taken more aggressive steps to contain COVID-19 and be in a better position than we are today. "Alice laughed: "There's no use trying," she said; "one can't believe impossible things." "I daresay you haven't had much practice," said the Queen. "When I was younger, I always did it for half an hour a day. Why, sometimes I've believed as many as six impossible things before breakfast." Of course, this is just my opinion. I’m keeping it real.

It goes on to declare the city needs to continue implementation of policies and practices for employee conduct, for the equitable treatment of all people, that recognizes the common humanity of all people regardless of race and ethnicity, and there is a section committed to actively participate in the dismantling of racism by implementing annual training. “This came up as a bone of contention,” Davis explained, when the mayor asked her and Tejeda how they planned to pay for it. Like most cities, Redlands is currently in a difficult budget situation with the impact of COVID-19. Davis also learned recently there is online training available and the city has sent information about this training to elected officials and city staff members who in theory, are supposed to complete it. “I didn't even know about it until [last week] so that tells you something. But, I made the recommendation in the City Council meeting that we do more intentional, implicit bias training and that it not be just online modules, that we actually hire trainers.” Davis has committed to find funding to make it happen. “I'm going to need the city manager and the finance director to really comb through the budget.” She hopes there will be opportunities to reallocate some dollars but if not, “As a last resort, I certainly will pursue grant funding.” She affirmed her belief that it is not only important to receive additional, in-person training but that it is personalized to this moment that we are living in. Beyond training, other concrete steps outlined in the declaration include: assessing and revising city department policies, procedures and ordinances to ensure transparency on racial equity are core elements to ensuring that hiring practices provide greater opportunities for people of color to be employed; to further diversify the city’s workforce by ensuring diversity of race, age and gender within the city commissions; creating a system of reporting to measure progress toward achieving the goals

outlined in the resolution and communicating that to the greater community; supporting community efforts to amplify issues of racism; engaging actively and authentically with communities of color where they live; and, adding health equity and justice to the objective and purview of the appropriate city commission to address ways to improve the public health and welfare of all the residents through an equitable lense as prescribed in the city’s health resolution and to identify specific activities to further advance diversity. It is believed Tejeda added the last point because he wanted to see the city’s Human Relations Commission take on more of an approach to thinking about health and racism as a public health crisis. Beyond that, the city will continue its work with and support of Unity in Community, a group that is part of the city’s Common Vision Coalition. “Finally,” Davis concluded, “Our last bullet is building and strengthening alliances with other organizations that are confronting racism and encouraging other agencies to recognize racism as a crisis.” To this end, the city is considering membership in the Government Alliance on Race and Equity, a national network of local government agencies looking to achieve racial equity and advance opportunities for all. This is something modeled and approved by the County of San Bernardino and included in its declaration of Racism as a Public Health Crisis. “I recognize our [declaration] was more detailed, but I think we should be proud of the fact that ours was more detailed.” In the end, fellow councilmembers agreed with Davis and Tejeda, voting in favor of the resolution. “I wish this document could eradicate racism; yet, we know that it won’t,” Davis acknowledged and continued. “However, it is an important step in the process and I really am grateful we were able to pass this resolution in the city of Redlands. I think it means a lot to the community here and honestly, I’ve already received a lot of great, positive feedback.” “I look forward to more ideas, suggestions, and input from the community; and having this be something that moves us forward together

“Not everything law enforcement does is right, not everything that happens in the community is right,” Anderson said. “We’re here to try to manage injustice in whichever form it takes in terms of what I believe the role of the District Attorney’s office is.” According to Public Defender Gardner, lawyers and staff have been put through implicit bias training over the last few years because they believe it is important if they are going to represent people who look different than them to understand and make sure they are taking care of the defendants and understand what they are going through as much as they possibly can. “Just a couple weeks ago we went through a program with the National Legal Aid and Defenders Association where our entire staff went through a ‘race and bias and white fragility in the courtroom’ 2-day program,” Anderson said. San Bernardino County declared racism a public health crisis and the Public Defender's office is in support of the board of supervisors decision. “The Sheriffs support racism as a public crisis which was recently a resolution brought by the board of supervisors,” said Undersheriff Dicus. It is important for the community to know what community leaders are doing to implement the changes needed to overcome civil unrest and racial injustices. Panelists covered programs and policies with each department to help understand the structural threat of racism within our community. initiative on California’s November 3, 2020 ballot. Voters will also be asked to weigh in on Proposition 15, the California Schools and Local Communities Funding Act of 2020. The proposition would require commercial and industrial properties to be taxed based on their market value rather than on their purchase price as indicated by Proposition 13—it will maintain tax protections for all residential property—it protects all homeowners and renters. According to the Urban Institute, in 2017 about half of the state’s public-school students were Hispanic, and nearly 25 percent were White non-Hispanic. In contrast, those ratios were reversed when compared to the rest of the country. In addition, 60 percent of the state’s students are eligible for free or reduced-price school meals and thus, are considered low income compared to a national average of 52 percent; and at 21 percent, California has the highest number of English-language learners than any other state in the nation.

Beyond these factors, more than 75% of women with school-age children worked outside of the home and the children in many of these families relied on schools as their primary source of nutrition in 2019. These student populations—in addition to students with disabilities and those in foster care—require more funding to achieve an adequate level of support. As a result of the state’s size, diversity, and student needs, state and local governments must provide relatively high K–12 spending to achieve its desired educational outcomes. It is projected that Proposition 15 could generate up to $12 billion in most years, based of course on the strength of the state’s real estate markets. All those billions, however, will not flow to schools though it will go a long way toward boosting its revenue. The ballot measure calls for the added tax revenue to be allocated 40% to schools and the other 60% to other local municipalities. The measure has support of the California Teachers Association, the statewide Parent Teachers Association (PTA) and others.
