A Trumped-Up Newsom Recall and the Many Reasons to Vote NO!

W

hile we have all grown weary of COVID19’s unforgiving impact on our lives, as Californians we have not lost our sense of political purpose nor our grip on reality; and when it comes to the game of politics, we are not fooled by the significant role of Trumpism in the Newsom recall election. This is largely because recall advocates and their feigned and heavy-handed grievances against the governor are as transparent as glass. Few of us would say Newsom is a perfect politician, and neither are any of the others. However, few can argue that he has not acted with intention to make progress on his campaign promises. He presents as a liberal leader who has never claimed to be anything but that, and although he is yet to deliver on all his

the state; expanded the state’s anti-poverty program; established a framework for equity in school funding and extended rent and utility debt relief, among other justice-centered, equity-based actions. All of this is antithetical and offensive to the “White

In his inaugural address Newsom proclaimed, “We will aim high, and we will work like hell to get there.” Certainly, some of his work in progress is stymied by the unrelenting coronavirus. But let’s get real—this election is not about his work in progress. This election is not about his having gone too far to deliver on his liberal promises. And, in many ways, it is not about right-wing frustration with the mandates Newsom implemented to curb the virus’ spread, though they are being conveniently used to help motivate the virus-ignoring, anti-maskers in support of the recall. Finally, although there may be some corporate backlash in response to many of his liberal policies it does not account for the aggression driving the recall. What it is about, however, is what Newsom has done and may do as a forward-thinking governor. This is what has angered right-wing extremists and fueled their slavish and vitriolic recall campaign. Remember, Newsom halted the death penalty; put restrictions on police use of force; closed some prisons; is shutting down the use of private prisons by the state; has reimagined the juvenile justice system and closed many of those facilities; advocated for the largest stimulus ever enacted in

We do not have to imagine what California will become if Newsom is recalled and replaced by Trump acolyte, Larry Elder. Yes, Elder is an educated man, but by many measures, an educated fool with a loud-mouth and limited finesse. He is someone who regurgitates Trump ideology and then can hardly give a reasoned explanation for such positions as he tries to claim such beliefs and philosophies are his own, original thoughts. Any right-thinking Black man should be ashamed to align himself and embrace the vitriol of such an overt racist. In a way you almost feel sorry for someone like Elder who is lost in the fog of magic negroism. He is a classic example of how some people will sell their souls—and their Black cards—hoping for a seat at a table where the hosts—Trump and his right-wing extremists—have shown again and again for people of Elder’s hue, the table in the dining room is not for people like him unless he is carrying in a tray of “yes sirs” to serve as a side dish when called upon to do so. But, enough about this lost brother. I promised myself not to overuse my digital bits and bytes on Elder and his dangerous nonsense, and instead to use my voice to encourage my friends and neighbors continued on page 18

New Census Data Shows Changing Complexion of California; Political Power Shifts Edward Henderson | California Black Media

L

ast week, the U.S. Census Bureau held a press conference to announce its first local level findings from the 2020 data collection cycle. The new numbers -- which drill down to provide demographic information at the county, city, and block levels -- reveal that California is more multiracial, more urban and facing population shifts that will likely lead to redrawing the boundaries of the state’s congressional and legislative districts. Based on estimates the Census Bureau released in April, California is already losing a seat in the United States House of Representatives for the first time in the state’s 171-year history, bringing the state’s congressional delegation down to 52 members. That loss of one seat will also equate to a decline in the amount of federal funding California receives every year. Since August of 2020, the 14 members of the California Citizens Redistricting Commission have been working on the once-in-a-decade project of redrawing the lines of the congressional, state Senate and Assembly and State Board of Equalization districts. There are five Democrats, five Republicans and four people who are not members of either party serving on the commission.

Although Payday Loans Have Declined in CA, A Rebound May Be Looming Breanna Reeves | Staff

C

alifornia payday lenders experienced a sharp decline in loans and borrowers in 2020 during the pandemic despite the initial rates of job loss and unemployment. The Department of Financial Protections and Innovation (DFPI) reported a 40 percent decline in payday loans in 2020, according to their 2020 Annual Report of Payday Lending Activity. “Payday loans are believed to have decreased during the pandemic for a number of reasons that may include factors such as stimulus checks, loan forbearances, and growth in alternative financing options,” said DFPI Acting Commissioner, Christopher S. Shultz, in a press release. Payday lenders experienced a loss of over $1.1 billion dollars according to 2019 total dollar amounts of payday loans. Pandemic Stimulus Provided Short-term Relief “That decrease is probably a combination of additional government payments, like the stimulus checks, and enhanced unemployment. Also, there are lower consequences for inability to pay your rent, or your student loans, and in some cases your utilities,” explained Gabriel Kravitz, an officer of the Pew Charitable Trusts’ consumer finance project. “Our research shows that seven in 10 borrowers are taking out these loans to pay for those recurring bills.” California residents’ dwindling dependence on payday loans may be attributed to federal and state-wide stimulus and rental assistance programs that assisted millions of people with paying rent and utilities and other pressing bills. However, such protections have ended or will soon end with the state returning to business as usual. “As the pandemic provisions are winding down, it is likely that we're going to see a rebound in the volume of loans and the number of borrowers,” said Kravitz. California is one of 14 states with high

payday loan interest rates, according to the Center for Responsible Lending (CRL). The CRL categorizes these states as “fall(ing) within the debt trap of payday loan interest rates.” State data for 2020 found that the average California borrower who took out a loan of $246 was in debt for 3 months of the year and paid $224 in fees alone, a total repayment of $470. Although the loan is advertised as being due in two weeks, it is actually due all at once, according to Kravitz. “And that takes up about a quarter of the typical California borrower's paycheck. And it's very difficult for someone who's struggling to make ends meet to lose a quarter of their paycheck, and still pay the bills like rent (or) buy groceries,” said Kravitz. “And so what ends up happening is, oftentimes, the borrower will take out another loan, on the same day and end up in debt for months instead of just two weeks.”

Who’s Affected? A report conducted in 2012 by the Pew Charitable Trust identified research findings on payday lending, including who borrows and why. One notable finding the report discovered was aside from the fact most payday loan borrowers are White, female and between the ages of 25 to 44, “there were five other groups that had higher odds of using payday loans: those without a fouryear college degree, renters, African Americans, those earning below $40,000 annually and those who are separated or divorced.” “And we also know specifically in communities of color, Black communities, Brown communities, that payday loan resellers have (been) located in these communities for quite some time,” explained Charla Rios, a researcher at the CRL who focuses on payday continued on page 8

Loan Forgiveness Offered to More Former ITT Tech Students

he Education Department announced Thursday it will forgive student debt for more than 100,000 borrowers who attended colleges in the now-defunct ITT Technical Institute chain but left before graduating. In a rarely used move, the agency said it will erase federal loans for borrowers who left the for-profit colleges during an eight-year window before their 2016 closure. During that period, the department said, ITT Tech lied about its financial health and misled students into taking on debt they couldn't repay. The action will offer $1.1 billion in loan forgiveness to 115,000 borrowers who attended ITT Tech, which had more than 130 campuses across 38 states. About 43% of those borrowers are in default on their student loans, the department said. "For years, ITT hid its true financial state from borrowers while luring many of them into taking out private loans with misleading and unaffordable terms that may have caused borrowers to leave school," Education Secretary Miguel Cardona said in a statement. Eligibility Students are usually eligible for loan forgiveness if they attended a college within 120 days of its closure and were unable to complete their degrees. But for ITT Tech, the Education Department is extending the window back to March 31, 2008. That date, the agency said, is when ITT Tech's executives disclosed a scheme to hide the truth about the company's finances after the loss of outside funding. It led ITT Tech to shift more costs to students, the department said, and it prevented the company from making investments to provide a quality education. ITT Tech shut down in 2016 after being hit with a series of sanctions by the Obama administration. Under the new action, eligible borrowers will automatically get their loans cleared if they did not attend another college within three years of the school's closure. Those who went

to another college but did not earn degrees may be eligible but must apply for discharges, the agency said. Borrower advocates have been urging the Biden administration to broaden loan relief for students who attended shuttered forprofit colleges. The nonprofit Student Defense applauded the department's move and said the same should be done for students who attended other for-profit chains. "There are countless others who attended other predatory institutions who are still waiting. We hope the Department will continue to implement our recommendations to make things right for all of them, too," Alex Elson, vice president of Student Defense, said in a statement. Recent History of Student Loan Discharges It is the latest in a series of loan discharges targeting specific groups of students. In June, the Biden administration erased more than $500 million in student debt for borrowers who were defrauded by ITT Tech. That decision centered on claims that the company made

exaggerating its graduates' success in finding jobs. Earlier this month, Cardona announced he would automatically forgive student loans for 300,000 Americans with severe disabilities that leave them unable to earn significant incomes. But the Biden administration also faces growing pressure to pursue wider student debt forgiveness. Some Democrats in Congress are calling for the White House to use executive action to erase $50,000 for all student loan borrowers. Biden has suggested such action needs to come from Congress, but he has asked the Education and Justice departments to study the topic. Earlier this month, Cardona said that study is still underway. The Education Department has the authority to extend the window for loan forgiveness in cases of school closures, but the power has not often been used. After the closure of the Corinthian Colleges for-profit chain in 2015, the Obama administration widened the window back to June 20, 2014.

lending and predatory debt practices. “So they may market themselves as access to quick cash, but we know the harms that have exacerbated the racial wealth gap for these communities for quite some time.” Research from 2016 by the California Department of Business Oversight found that there are higher numbers of loan retailers per the population in communities of color than their white counterparts. “Almost half of payday storefronts were located in zip codes where the family poverty rate for Blacks and Latinos exceeded the statewide rate for those groups,” the report noted. “I think the really important data point from that California 2020 report is that the bulk of the revenue, 66 percent of the revenue, is being generated from borrowers who took out seven or more loans during 2020. And that shows the harm of that unaffordable initial loan, that first unaffordable loan generates additional loans in a sequence,” stated Kravitz. “And that's where the bulk of the revenue is coming from and that’s the core of the problem.” Although California has capped payday loans at $300, payday loans are continued on page 17

Recall Election Heats Up: Gov. Newsom Trades Fire With Larry Elder

ntil recently, Gov. Newsom’s strategy for responding to the litany of attacks he’s received from Larry Elder, the Republican frontrunner in the upcoming Sept. 14 recall election has been to not respond directly to them. Newsom’s responses have focused on his accomplishments, indirectly alluding to Elder’s attacks, and especially warning voters that if Republicans succeed in the recall Trumpism would be in charge of the state. But a little over a week ago, as Newsom spoke before phone bankers at Hecho En Mexico restaurant in San Jose he brought up a number of Elder’s positions that clash with the views of a majority of Californians. Elder, a former lawyer and Los Angelesbased conservative talk radio host, is opposed to a minimum wage. He is skeptical about climate change. He supports school choice and offshore drilling. He is against school mask mandates and would eliminate vaccination validation and mandatory testing for those who are not vaccinated. "He actually wrote an op-ed saying women are not as smart as men on issues of civic affairs, on issues of economics, on issues of politics," Newson said. Last week, Newsom’s campaign released an ad that features a picture of Elder with Trump. Elder has pushed back on the association with Trump. "The idea that they're trying to characterize my campaign as some sort of extension of you-know-who is unfair to me," Elder told ABC’s Eyewitness News. “I am an insurgent candidate – 1.7 million Californians signed the recall petition. A quarter of them were Independents and Democrats who voted for the man just two years earlier." Regarding Trump and the legitimacy of the 2020 presidential election, Larry Elder flip flopped after he told the Sacramento Bee's editorial board on Aug. 2 that he did not believe that Joe Biden stole the election. Later, on his talk radio show “The Morning Answer,” after

receiving backlash in conservative circles for disagreeing with Trump, Elder changed his tune. He claimed the Sacramento Bee sound bite had been edited. "So, do I believe that there were all sorts of shenanigans in the election? Absolutely. But Joe Biden is sitting there in 1600 Pennsylvania Avenue and Donald Trump is in Florida so let's just move on and try to figure out what we can do to win in 2024," Elder said. Casting the Blame on Newsom Elder blames Newsom for California’s homelessness crisis and the unaffordable housing market. According to him, Newsom is responsible for unreasonable COVID-19 restrictions and heavy-handed environmental regulations. Recently Elder went toe-to-toe with progressive radio host Tavis Smiley, who broadcasts from KBLA Talk 1580 in Los Angeles. Smiley challenged Elder on his opposition to reparations for African Americans for the

atrocities of slavery and the financial losses Blacks suffered due to Jim Crow laws and systemic racism. Elder Does Not Believe Systemic Racism is a Problem “Systemic racism is not the problem,” Elder said. Instead, he blamed “the welfare state, which, he says, is the reason “the Black family unit” has been torn apart. While Elder conceded that statistics on fatherless Black family units could have been largely due to the after-effects of chattel slavery and Jim Crow laws in the past, he does not think those factors are relevant to the discussion today. Elder has long held the position that the racial wealth disparity is mostly concentrated at the top of America's wealth pyramid and is therefore not indicative of systemic racial bias. Lately, Elder’s campaign has been on the defensive. He is being investigated by the continued on page 18

Moreno Valley Cheerleaders Demand Accountability and Change in Wake of Racial Slurs and Insults Breanna Reeves | Staff

alley View High School in Moreno Valley cheerleaders were met with an onslaught of support and encouragement from community members and supporters on Thursday at the school’s first football home game of the season. Nearly two weeks have passed since Valley View cheerleaders were verbally attacked by cheerleaders and fans of Temecula Valley High School (TVHS) at a football game on August 20. Valley View cheerleaders were met with the racial slurs and verbal aggression when they were invited to sit with the opposing cheer team. Two Valley View cheerleaders, Sabria Rose and Kharissa Darden, who were on the receiving end of the verbal racial attacks spoke out via Instagram, penning messages about their experiences at Temecula Valley. “Why did my school have racial slurs used against them by people who do not know what the history/ meaning behind that word is?” Sabria Rose wrote. “Ask yourselves why did Temecula Valley High School students and fans make monkey noises towards two young Black women who just wanted to support your snack bar?” Independent investigations are currently underway by the Moreno Valley Unified School District (MVUSD) and Temecula Valley Unified School District (TVUSD). A statement received from Laura Boss, Public Information Officer for TVUSD read: “TVHS will investigate any incidents thoroughly and will be taking swift and appropriate action if deemed necessary. Our school district embraces diversity and strongly condemns hate speech and offensive, hateful language or racial intolerance of any kind on the sports fields, in school buildings or anywhere on or off school premises. We will hold anyone found to have used such language while representing any of our schools accountable for their words and actions.” MVUSD Superintendent Dr. Martinrex Kedziora said he was proud of the Valley View cheerleaders and the coaching staff who made

the decision to leave the football game after the incident. On Monday, following the football game, Dr. Kedziora and Valley View High School held a meeting for the cheerleaders and their parents to discuss what took place and had cheerleaders write statements. “I told them, like what Michelle Obama says: ‘When they go low, we go high,’” Dr. Kedziora advised. “And I said, ‘You demonstrated that with courage and conviction that evening because you didn't say anything to them and you didn't do anything to them. They did it to you. But I just want you to know how proud we are of you.’” With the leadership of the cheer coach, Kenya Williams, the district is hiring a consultant to work with students and offer additional support moving forward. Williams is a counselor at Valley View and is the coach who made the decision to leave Temecula Valley after the incident. “In all my years coaching, I have NEVER experienced such levels of disrespect and hate from an opposing school/team. Tonight, my girls were victims of racial attacks; verbally

and physically (non-violent),” Williams said in a Facebook post. “I am angry and I am hurt! I would love to say that I am shocked, but I'm not. I was honestly fearful of being at Temecula Valley HS.” Since the incident took place, some Temecula Valley students have shown support by holding a protest on August 23. Students have also raised money for the Valley View cheer team. While some Valley View cheerleaders have expressed gratitude toward Temecula Valley’s efforts, others are wary of the news attention these Temecula Valley efforts have garnered and shaped the narrative since the incident. “And what’s kind of bothering me is that, that's not our goal or our issue, that the cheerleaders need support. Our whole school on Monday reminded us of that we have our teachers, students, staff, superintendent, principal, advisors, all behind our back,” said 16-year-old Audrey Thomas who is a Valley View cheerleader. S T O R Y Incidents “And the fact that it looks like the media is switching the focus - that's a little bit concerning for me because instead of what happened, it's going to be like, ‘oh, they're protesting.’ And that's not the issue, it’s that change needs to happen,” said Thomas. “That school was racist towards our Valley View cheerleading team.” This is not Temecula Valley’s first racial incident. In September 2019, a Temecula Valley student spray painted a Confederate flag on a parking spot on school grounds. This incident was followed by a student spray painting a racial slur targeted at ​​Solona Husband, a Black TVHS student in November 2019. In August 2020, a video surfaced online which allegedly showed a TVHS student making racist remarks. “I want people to know that the history of racism at this school is so ingrained that it's still in effect today,” said Thomas. “I really hope consequences and change actually happen because that's the only way people learn - is action and change.” Audrey’s father, Elmer Thomas, was present during the meeting with parents and the cheerleaders that took place at Valley View. He was shocked to hear, firsthand from the cheer team, what had transpired at the football game. “I listened to those girls, I saw them, I looked into their eyes, I believe them. And so I want to do what it takes to get the justice that they deserve,” said Thomas. “But the way that they're standing up and demanding justice, that's something that I want to make sure that we all encourage. The school has filed a formal complaint with the California Interscholastic Federation (CIF) citing a series of incidents that took place at Temecula Valley during the football game. The complaint includes descriptions of the language used against Valley View, the lack of acknowledgement from Temecula Valley personnel and reactions from social media. “In summary, Valley View High School is asking for consequences for Temecula Valley’s High School and their negligent actions toward Valley View High School’s Varsity Cheerleaders, Varsity Football Team, JV Football team, and Valley View High School’s student spectators. We are not asking for a forfeit win,” the complaint stated. “We are looking for a change, in the actions of Temecula Valley View High School Principal

Based on the numbers, most of the changes coming to the state’s legislative districts are expected to happen where there has been population increases, slow growth or a loss of residents – areas in the rural northernmost regions of the state and in Southern California counties around or below Los Angeles. Growth across the Los Angeles area, for example, over the last 10 years has been slow, but some cities like Irvine in Orange County are now among the fastest growing in the country. Over the last 10 years, the complexion of California has changed significantly. Driven mostly by population growth among Hispanics, the state joined Hawaii, the District of Columbia and New Mexico as places in the United States where Whites are no longer the majority. The state’s Hispanic population grew from 37.6 percent in 2010 to 39.4 percent in 2020 while the White population dropped from 40.1 percent to 34.7 percent. The state’s Black population has also seen a decrease from a little over 6 percent to 5.7 percent. The current total Black population is now 2,237,044. California is also the second most diverse state after Hawaii, according to the Census Bureau. “As the country has grown, we have continued to evolve in how we measure the race and ethnicity of the people who live here,” said Nicholas Jones, director and senior advisor of Race and Ethnic Research and Outreach, Population Division, U.S. Census Bureau. Changes in the 2020 Census The Census Bureau implemented a significant change to the 2020 census data collection. considered to be financial traps for consumers, especially those with lower incomes, despite being labelled a “short-term” loan. Borrowers in California are charged two to three times more than borrowers in other states with reformed payday lending legislation. Payday Loan Protections Consumer protections for small dollar loans in California are nearly nonexistent, with the exception of the $300 payday loan cap and requirement of licences from lenders. SB 482, legislation for restrictions on consumer loans, was introduced in the state in 2019, but died in the senate in 2020. In 2019 California instituted a 36 percent rate cap for large dollar amount loans between $2,500 and $9,999 under the Fair Access to Credit Act, but Rios explained extending these protections to small dollar loans would be beneficial to consumers. In 2017 the Consumer Financial Protection Bureau (CFPB) introduced a rule that allowed lenders to determine if a borrower had the ability to repay a loan before approving the loan. However, in 2020, the CFPB rule was amended to clarify prohibitions and practices by debt collectors, eliminating some protections that were initially in place. “The CFPB currently doesn't have any kind of payday rule in place that would be protective of consumers. And that's a really important point because (the 2017 rule) would have guaranteed some look at the ability to repay these kinds of loans, which really plays into, kind of, that cycle of the debt trap and the fact that payday lenders are not looking at a person's ability to repay the loan before issuing the loan,” said Rios. “And thus starts the cycle.” Pew Charitable Trust research shows that the CFPB and California lawmakers have the opportunity to make small loans affordable and safer by implementing more regulations and instating longer installment windows. According to Pew, in 2010 Colorado reformed their two-week payday loans by replacing them with six-month installment payday loans with interest rates nearly two-thirds lower than before. Now, the average borrower in Colorado

pays four percent of their next paycheck toward the loan instead of 38 percent. “I think probably the most important thing to focus on right now is what federal regulators can do: the Consumer Financial Protection Bureau can quickly reinstate its 2017 payday loan rule that would strongly protect consumers from the harms of those two week payday loans,” said Kravitz. Our analysis of the 2020 census results show that the U.S. population is much more multiracial and more racially and ethnically diverse than what we measured in the past.” America’s Diverse Population Across the United States, the results showed that the White population remained the largest in the country at 204.3 million with an additional 31.1 million identifying as mixed in combination with White. The multiracial population comprised the second highest population for the first time at 49.9 million alone or combined, surpassing the Black or African American population at 46.9 million. The U.S. population is now 57.8 percent White, 18.7 percent Hispanic, 12.4 percent Black and 6 percent Asian. There were several other notable findings

shared by the bureau during the presentation. The US Population is currently 331.4 million people, an increase of 22.7 million over the past 10 years. The 7.4 percent increase is the second lowest growth rate in history. Overall, national population growth was centered around urban areas over the last 10 years. California is home to three of the top ten largest cities in the country. San Jose stands at number 10 with a population of 1.01 million (a 7.1 percent increase), San Diego is at number eight with 1.4 million people (a 6.1 percent increase), and number two on the list is Los Angeles with 3.8 million residents (a 2.8 percent increase). For the first time ever, all cities in the top 10 (with the highest populations) have over 1 million people. According to the Census Bureau this first release of local redistricting data is in a legacy format that will be easier for experienced data analysts to navigate. in the Inland Empire to take this recall election seriously and to stress how important it is for them to vote NO. It does not take much to imagine what could happen in California if Newsom is recalled and replaced with a Trumpster. Just look at the chaos this nation lived through for four years under the Trump administration and the lingering damage his ineptitude, racism, sexism, avariciousness, penchant for plutocracy, and kleptocratic style of leadership has wrought. And, if that is not enough to energize you to complete your mail-in-ballot and respond to the first question, “Do you want to recall the governor?” with a resounding NO, and return it by mail right away, you should also consider what else could be in store for Californians if Republican extremists gain political control of the state. Today, California is among the most successful states in the nation when it comes to expanding voter access, but according to the UCLA Luskin Center for History and Policy that was not always the case. When California adopted its original Constitution in 1849 only White men could vote. When the 15th amendment gave Black men the right to vote in 1870, California was one of only two free states that refused to ratify it. This state has a long history of voter suppression based on race and class through voter registration laws. If we believe what is happening across the country in Republican led states where Trumpsters are working overtime to suppress the votes of people of color, young people and the elderly is real—do not believe the hype that it cannot happen here. Voter suppression is in the DNA of this state and we must fight hard to protect the progress we have made for all Californians in this regard. We must also remember some of the most rabid supporters of the Trump ideology hail from California, including Kevin McCarthy who represents the state’s 23rd congressional district and serves as minority leader of the U.S. House of Representatives. There’s also Devin Nunes who represents the states 23rd congressional district and who not only led the relentless Republican side-show known as the Benghazi Hearings that continued for much of the Obama administration. And, as the once ranking member of the House Intelligence Committee, he purportedly and inappropriately fed the Trump White House key information in relation to the first impeachment hearings. This Recall election is no accident. It is a tired reminder of how Republicans previously took control of California—through an off-year recall

election. The Trump extremists in their party will stop at nothing, pull out all the stops, bend any rule, violate any principle, to work their minority will in the state. It is now up to all of us to push back, to fight against this effort, to prove them wrong, to let them know we will not allow this recall approach to work again— not on our watch.
