Riv. DA Mike Hestrin is Critical of Superior Court Judges’ Responses to a Scenario He Helped Create

Today we learned that since October 10, judges in the Riverside County Superior Court have dismissed more than 200 cases countywide due to a backlog of cases and wouldn’t you know it, District Attorney Mike Hestrin was quick to criticize their decisions.

The cases allegedly include everything from misdemeanors to felonies and involve a variety of crimes. There is some reporting that many of the cases were related to domestic violence but that is speculative. And although my thoughts are also speculative, to me it seems more probable that something else is at play here.

The state’s Appellate Courts have sustained a continuous backlog since the worst days of the pandemic when they were closed to protect lives across the state. This factor, coupled with

Earlier this year the American Civil Liberties Union (ACLU) exposed and criticized Hestrin for the grotesque amount of time and resources he’s spent prosecuting low-level offenses to make his numbers and [himself] look good. And like the overzealous prosecutor that he is, he did so despite the fact that–at least according to the ACLU– such crimes pose “little or no threat” to public safety and could potentially worsen longterm outcomes, according to the organization.

It is clear to many Hestrin critics, that he uses this ‘racket’ to bolster incarceration rates–rates that data show has largely and disproportionately targeted and impacted Blacks and other people of color in the county, while also increasing the “criminalization of mental illness and asserted that nearly 57% of those cases Hestrin should have declined to charge or otherwise diverted. In addition, among the cases reviewed, 13.9% of the adults charged were Black although Blacks

and his henchmen- bench of assistant district attorneys, send our youth to prison at a rate that is 2.5 times higher than the state average, and once again Black and brown communities were the hardest hit.

The charging of such low-level offenses against Black and brown people not only results in overcrowded jails, it certainly contributes to a backlog in the courts. As far as I’m concerned Hestrin is crying about a scenario he helped create.

In addition, with the spike in-custody deaths in Riverside county jails, Hestrin's insistence on charging low level crimes disproportionately against Black and brown people should be criticized for more than contributing to a backlog in the courts, it should also be considered a human rights violation.

Of course this is just my opinion. I’m keeping it real.

LA Clippers Start Season with Healthy Kawhi and George, In Good Position for Western Conference

Coach Lue will have a healthy Kawhi Leonard and Paul George to start the season

The 2022 Clipper basketball season will have a premium on the health of their players. Coach Tyronn Lue will have a healthy Paul George and Kawhi Leonard on the court to start the season. Previously, key injuries have kept them from winning crucial playoff games and advancing.

Leonard underwent a surgical repair of a partial torn ACL

Kawhi Leonard (Riverside MLK High School) returns to the court after suffering a severe knee injury in game 4 of the 2021 Western Conference Semifinals against the Utah. Leonard who underwent a surgical repair of his partially torn ACL in July 2021, has been cleared to resume playing. However, the Clippers will exercise caution as puts stress on the repaired knee.

Clippers missed the NBA playoffs

Paul George (Palmdale High School) was expected to take up the slack until Leonard recovered, however he suffered his own severe elbow injury and missed half the 20-21 season. Ultimately, the Clippers finished 8th in the Western Conference standings. The Clippers lost their “play-in” game last year to Minnesota, missing the NBA playoffs.

Reggie Jackson returns to the Clippers

A healthy Clipper basketball team still has that hungry, overachieving, underdog aura. With new additions of veteran guards Reggie Jackson and John Wall, the Clippers are loaded in the back court and have the pieces to contend in the Western Conference. Jackson returns to the Clippers, a team where he has thrived as a fearless 40% three-point playoff shooter. Five time All Star John Wall signed a two-year deal, adding experience and creativity to the back court.

Poised to challenge in the west

The Clippers have that unique combination of veterans, star shooters, team speed and hunger. From ownership to coaching, the franchise is poised to challenge in the west, as expectations are for nothing less than a deep playoff run and perhaps the NBA finals.

While on assignment for GamePro Magazine in 1996, Jon Gaede met former Black Voice Sports Editor, Leland Stein at a Los Angeles Lakers’ game. They formed a working relationship which has endured for 24 years. Sneak Preview and Grand Opening: Civil Rights Institute of Inland Southern California

Fifty-four years ago, Dr. Tommie Smith raised his fist during the 1968 Olympic games, an iconic image and action that became a symbol for racial justice, a struggle that Black Americans continue to face today. Dr. Smith will be the keynote speaker at the opening of the Civil Rights Institute of Inland Southern California (CRIISC) on Saturday, Oct. 22.

In addition to being a record-breaking athlete, a historic figure and a coach, Dr. Smith is now an author of his new graphic memoir, “Victory! Stand. Raising my Fist for Justice,” co-authored by award winning writer Derrick Barnes.

“I hope these young folks will read it and understand that this is them, especially the young Black student or student athlete. They have to realize — because I came from a much more uncultured life [than] they’re living

now — they [have to] realize that they are blessed to be living in these times where people have died, so they could have the freedoms that a freedom fighter never had,” Dr. Smith explained.

Dr. Smith spent 32 years as an educator, and now he is proud to turn back and educate outside of the classroom. Dr. Smith explained that as a small child, he was always excited about the idea of “putting something on paper,” and with his graphic memoir, he is doing just that.

Redistricting’s Racist Power Grab, LA City Council Members, and a Tape that Exposed it All

Last week’s media storm and the subsequent reporting over a leaked audio taped conversation between Nury Martinez, then-President of the Los Angeles City Council, other council members as well as the President of the Los Angeles County Federation of Labor began a week of political backlash that continues to grow, deepen and reveal a political rat’s nest within the Los Angeles City Council.

The debacle began when the Los Angeles Times published an article along with portions of a more than 80 minute long tape. The main topic of discussion was the L.A. City Council's proposed redistricting map.

On the tape Martinez, Councilmembers Kevin de Leon and Gil Cedillo, along with President of the Los Angeles County Federation of Labor, Ron Herrera, are heard making racist and demeaning comments about almost every constituency in the city.

Redistricting, Incumbency and Power

The secretly recorded conversation–that took place almost a year ago–centered on the city’s redistricting plan that would not only determine the boundaries between districts and likely determine voter turnout and whether the outcome of elections will be amenable to the politics of incumbent council members. Los Angeles is an increasingly diverse city with people from all over the world living side by side.

The proposed plan has various city council members seeking to retain or expand their political power by limiting or diluting the power of other councilmembers using redistricting as a tool. Redistricting is an outgrowth of the Census that occurs every ten years as mandated by Article 1, Section 2 of the U S. Constitution. Population shifts (growth or losses) detailed by the Census determine the need for redistricting and maps, redrawn as a result, can at times, shift political fortunes.

Latinos, at 48.1% of L.A.’s population, and a majority of the city’s population are underrepresented on the city council. However, as the recordings make clear, people with heritage from Latin America and parts of the Caribbean have different needs, histories, desires and prejudices. The discussion was about who could be counted on and what to do to achieve the Latino council members’ goals.

On the tape Martinez describes a conversation she had where she suggested Councilmember Marqueece Harris-Dawson should attempt to move LAX from Councilmember Mike Bonin's district into his own. Martinez goes on to question the relationship between Harris-Dawson and Bonin and to say Bonin "..thinks he's Black.”

Later on the call Marinez calls Bonin, who is gay, "..a little bitch.." Martinez accuses Bonin of using his Black adopted child like "an accessory".

Councilmember de Leon then compares the child to a handbag, at which point Ron Herrera, President of the Los Angeles County Federation of Labor, can be heard saying, "They used to have those statues on the plantation didn't they?” This was followed by laughter.

In describing an incident at an MLK day parade where, according to Martinez, Bonin’s child is "all over the place", Martinez uses racially demeaning language to describe the child's behavior. Stating in

Spanish he was acting like a monkey. Martinez also took issue with the way the child was being raised and said, “They're raising him like a little white kid," and proclaimed the child needed "a beat down" and she could provide it.

Avoiding a hostile takeover

The group turns their attention to the ongoing legal problems of Mark Ridley-Thomas and what their approach should be regarding his successor. At one point Martinez cautions the group about not being perceived by the African-American community as a "hostile takeover . . .or they will come for us"

inside the Institute. There will also be a dedication ceremony for Assemblymember Jose Medina and a walk of fame that features 27 Inland region leaders.

“We’re excited with this launch, excited with this opening. We want exposure. The hardest thing is sometimes when you have this community space, you don’t have the visibility for people to know it exists to utilize it, so we want to increase our visibility, have a very engaged board and lots of volunteers,” said Sabrina Gonzalez, who joined the Institute in June as the first executive director.

Barnes has published dozens of children’s books and said working with Dr. Smith on the graphic novel was the perfect opportunity. As states continue to ban books about Black experiences in America such as “The Hate U Give,” Barnes said he’s optimistic that this won’t last long, and that books and spaces like the CRIISC will teach kids about history.

“We don’t learn history to enrage people, to make people feel guilty or to point fingers. We teach history so that we won’t repeat all the negative things that have happened,” Barnes said. “And we teach history so that we can learn from all the good things that actually worked. I think it’s important for children and adults to see these images, to learn as much American history as they possibly can.”

The “Still I Rise: The Black IE Fight for Justice” exhibit will demonstrate the struggles of the African American community of Inland Southern California, with a sub-theme that focuses on the intersection of struggle among people of color and Black people in the Inland Empire. The inaugural exhibition “Still I Rise: The Black IE Fight for Justice” was curated by Dr. Vince Moses.

The Daniel Dexter Story Part 3

Memories and Reflections...A Family Copes With Loss Due to Gun Violence

Today, Faye spends most of her time at the hospital or watching her grandchildren, Daniel’s younger siblings, who are turning 9 and 11. Since their mother Lauren Taylor-Mayweather spends her days and nights at the hospital with Daelyn who remains in critical condition, the children moved to Faye’s home and will now attend school in Rialto.

Hours before Daniel’s death, his younger sister was graduating elementary school and looking forward to starting middle school in Adelanto, but today says she hates graduations and the month of June.

Faye says there is always a brief moment each morning when she wakes up that she thinks this is all a dream.

Denby Sr. had not been back to the park for over a month. He is

receiving support for the post traumatic stress he is experiencing.

“I kind of always find myself sitting back and thinking what could I have done? I'm finding myself looking at every car that comes out to the park now,” he says.

Spending time with his grandchildren and taking up his longtime hobby of bowling helps him feel better. Denby said he didn’t realize the impact of leaving the safety of his home that afternoon until he attended the funeral.

“I didn't do anything that I hope somebody else wouldn’t do,” he said.

Denby thought back to his own personal experience with gun violence.

Every single one of us that live in the Inland Empire needs to wake up and see what kind of jobs we have in our region,” said Ricardo Cisneros, member of the Inland Empire Labor Council.

On Friday, October 14 workers walked off the job at KSBD Amazon Airhub, the online retailer’s warehouse, to protest unfair and unsafe working conditions and to demand living wages. The warehouse is key to Amazon operations, with its close proximity to the San Bernardino International Airport, a major center of transport for the national logistics industry. Days prior, Amazon workers in Joliet, Illinois, also

walked out on the job to protest unfair labor practices.

The KSBD Amazon Airhub picketers protested against unfair and unsafe working conditions and demanded living wages. Community organizations and environmental groups also joined the picket in support of protesters including the Warehouse Workers Resource Center, Teamsters Union and The Inland Empire Labor Council.

The IE Voice photographed and highlighted different community voices involved in this fight as they shared their concern, hope, and motivation for improved working conditions.

Also included among the CRIISC exhibits is a series of three story maps sponsored by the Riverside African American Historical Society (RAAHS). The RAAHS project, stewarded by Shirley Coates, founder of the Society of Extraordinary Women and the Ignite Leadership Academy for Girls, was developed by a team of volunteers including Catherine Guidis of the University of Riverside; Candice Mays of Mapping Black California (Black Voice News); Jennifer Tilton of the University of Redlands; Dr. Vince Moses, Curator at CRIISC; and project lead, Stephanie Williams of Black Voice News.

The three interactive maps tell the story of how Blacks came to the IE in two waves of the Great Migration, the first occurred in the early 20th century and the second after WWII.

“I lost my niece to murder, somebody shot her. She was only 19. And it reflects back to her, wishing that I was there when it happened,” Denby shared. “But I realized that you can't be there 24/7. I hope and pray that somebody has the guts to step up and say something, or do something when things happen.”

At Daniel’s funeral service, more than one hundred people stood and applauded Denby after Dr. White, Daniel’s aunt, read a poem about the impact Denby’s act of compassion and bravery meant to the family.

“A Stranger to Me but No Stranger to God.”

Dear Mr. Denby, you are a stranger to me

A stranger who reached out to my nephew in a time of agony

Most people would have run the other way when they heard gunshots and all But you stood courageous when you realized two youth had taken a fall

Your kindness and response have brought comfort to our grief

I didn't want to imagine our dear Daniel lying there alone you see

We are in so much pain it feels I can't breathe And I just want to say thank you for giving some relief

My prayers for your family and blessings to come

To each in your household as you helped someone else's son

People don't realize the hurt we do feel When we couldn't say goodbye because death is so real

Knowing that you and your son did not hesitate to go

To see you could help in this time that was low While you are a stranger to me you are no stranger to God

Because only a man of faith would make the move on God’s nod

The service also offered a time for loved ones to take the mic and speak about Daniel.

Former teammates, cousins, and friends spoke, each one referencing his kindness and optimism in a different way. Many prayed for Daelyn’s recovery.

Daelyn is still in the hospital and has undergone a number of procedures and surgeries. He will soon be transitioning to a rehabilitation center for traumatic brain injury.

His mother, Taylor-Mayweather, is constantly by his side. Although she can no longer attend nursing school this fall, her education and career path has allowed her to advocate and fight for her son. The family has faith that Daelyn will recover as his condition stabilizes and he receives hyper-specialized care.

Daniel’s family says they could talk for hours about the person he was, and look at their

massive collection of photos and videos of him. They want him to be honored for the man he was and to counter the narrative portrayed by the media.

Daniel’s mother remembers him as intelligent and funny with a big heart and a brain built for science. “He was someone I could really have intellectual conversations with. I miss talking to him. Sometimes I look up and I’m like, ‘Daniel what do you think about this?’”

In the final weekend of July, TaylorMayweather returned to her mother, Faye's home after receiving Daniel’s ashes. She took a seat, holding his urn, a football that honored Daniel’s talent. He was an outstanding linebacker for Silverado High School in Victorville.

The mea culpas were not enough. Councilmember Bonin began calling for the resignations of all the involved councilmembers. "We are appalled, angry, and absolutely disgusted that Nury Martinez attacked our son with horrific racist slurs, and talked about her desire to physically harm him,” Bonin wrote in a statement with his partner Sean Arian. “It’s vile, abhorrent, and utterly disgraceful. The City Council needs to remove her [Martinez] as Council President immediately, and she needs to resign from office. Any parent reading her comments will know she is unfit for public office.”

The Los Angeles Chapter of the NAACP issued a statement asking for the resignations of everyone involved stating, "We will not sit idly by and allow our elected representatives to engage in these kinds of disgusting and racist behaviors".

dementia. The brothers used to take care of not only her physical needs, such as lifting her from bed to use the bathroom, but they also took her on drives because she loved the sunshine.

Daniel’s great grandmother, Faye’s mother, recently passed away, having lived to 93. “And I just buried my son at 22. He was robbed of that experience, to live a long life,” TaylorMayweather said.

In another photo from February, Daniel kneeled with his younger siblings, working with them on an art project. His younger brother says Daniel and Daelyn are his heroes.

“He was the kind of brother that if they called him at 10 p.m. to come play, he would drive the hour to come see them,” Faye said about her grandson. “Except maybe if he had work.”

The week that followed began with Martinez resigning as City Council President on Monday with no idea if she would retain her district seat. Ron Herrera too resigned from the Los Angeles County Federation of Labor.

The story continued to grow. By mid-week Martinez had gone from stepping down as City Council President to taking a leave of absence from the city council.

President Biden called for the resignations of all the councilmembers involved and California Attorney General Rob Bonta announced he would be investigating the LA City Council's redistricting process.

"As a father and human being, I am deeply appalled by the remarks made by some of Los Angeles’ highest-ranking officials. Their comments were unacceptable, offensive, and deeply painful. There is no place for anti-Black, antisemitic, anti-Indigenous, anti-LGBTQ, or any kind of discriminatory rhetoric in our state, especially in relation to the duties of a public official. As Attorney General, I am committed to doing my part to ensure the rights of the people of California are protected.”

In addition, they tell of how migration to the region continues today as Blacks move inland in the ongoing search for affordable housing. The maps also highlight the stories of many who fought the local battles for equity in housing, education, jobs, leisure and politics told as often as possible through audio and video of those who lived the experiences.

Staffing the institute

“Another big goal is to program, to make sure that we build out staff, [that] we’re being intentional about how we hire, how we treat our employees and the work that they’re doing. And then we can build that programming so that we can continue to educate and capacity build, especially for the region or areas that have sometimes been systematically excluded,” Gonzalez explained.

“We want to make sure that this is a space for all. I’m looking forward to being on that end of it, too, like building up these programs and getting our oral history set up.”

The partnership

Developed through a partnership between the Wakeland Housing and Development Corporation, Riverside Fair Housing Council and the Civil Rights Institute, the site will be a mixed-use community space that will be an avenue for historical and cultural education in the community, the centerpiece of the new, five-story Mission Heritage Plaza, 72 units of affordable workforce and veteran’s housing and a new home for the Fair Housing Council of Riverside County.

The plaza will be the center of cultural discussions and social history exhibitions that highlight local Inland Empire activists and utilized as a space for educational programs and performances in partnership with local organizations and school districts.

When the controversial meeting occurred the city was in the midst of the redistricting process. A commission– appointed by the council– was charged with drawing up new district maps that would ultimately be approved or rejected by members of the council. According to an Associated Press report, at the time, Latinos, who made up nearly half the city’s population, only had four (or about 25%) of the 15 seats on the council, while Black people in the city who account for less than 10 percent of the population held three (or about 20%) of the council seats.

The recording made it obvious these councilmembers were angling, plotting, conniving to gain more Latino control. And now that the sentiments of the meeting participants are public, a dispersion is cast on the city’s entire redistricting process and its outcome.

Martinez responded to the news of Bonta's investigation by resigning from her district seat. Protests are taking place and the city council has been unable to meet. As of this writing Councilmembers Kevin de Leon and Gil Cedillo are refusing to resign, all of this with elections around the corner in November.

Community members speak

This reporter spoke to several Angelenos about the controversy.

In an older, tree-lined neighborhood near Jefferson Park full of turn of the century homes, we canvassed people in a shopping center on Washington Avenue, a typical enough location with small restaurants, a market and small shops that sell everything from tobacco to mobile phones.

We spoke with residents and listened to their concerns. Although their responses varied, none wanted to be identified by name. A young Latino man dressed in dark slacks and a white shirt on his way to work was asked if he had heard about what was going on with the city council. "Yes, but I'm not into politics that much," and went on his way.

An elderly Latina woman hadn't heard anything.

A middle aged, neatly dressed Black mother said she was following the story, "But I'm more concerned about defunding the police. There aren't enough police in the schools. As a matter of fact, I'm on my way to a meeting now."

While we were speaking an older Black man, casually dressed, gray hair covered with a cap and riding a bicycle on the sidewalk began yelling at a uniformed, Latino security guard. “You can't tell me what to do. I know people like you go around calling us monkeys." He got off his bicycle and went into a store.

When he returned I introduced myself and asked him if he knew what was happening at the city council. "Yeah,” he replied. “That's what I was talking about [regarding the security guard] trying to tell me what to do."

I asked if I could interview him? "Next time. Next time. I see you," he said as he got on his bike and rode away.

More from the community

A Latina woman dressed in sweatpants and walking her dog said she was following the story, "They should all resign," she said.

A young Black man in his twenties, wave cap on his head, dressed in a tan colored pants and matching jacket also believed those involved should resign, advising he’d heard about Martinez's resignation but added, "I wish she could have been fired."

As of Friday, October 14, the saga continues. Calls for the resignations of de Leon and Cedillo grow louder as does speculation as to who leaked the tape. Meanwhile the people of the City of Los Angeles wait.

For the LA City Council, It’s Just One More Controversy

The council already has several members under investigation, the most prominent being Mark Ridley -Thomas who was suspended without pay awaiting the outcome of his federal corruption trial.

Ridley Thomas’ case also involves a former dean of the USC School of Social Work. Both were charged in a 20-count indictment for allegedly facilitating a deal where Ridley-Thomas purportedly agreed to direct funding to the university in exchange for admitting his son, Sebastian Ridley-Thomas, to USC’s graduate school.

Protests are continuing as Los Angeles residents demand accountability for the anti-Black and other racist statements made by their elected leaders and continue to call for the immediate resignation of Councilmembers de Leon and Cedillo.
