‘No. You Can’t Have a Raise’

Iknow it’s a cliche, but I have to ask, “Will wonders never cease?”

Those were my initial thoughts when I learned the Riverside County Board of Supervisors had actually “turned down” proposed 12.7% pay raises for Sheriff Chad Bianco and District Attorney Mike Hestrin.

And, as if the proposed raises for Bianco and Hestrin were not galling enough, the Board was also asked to consider 32% salary increases for Assessor/County Clerk/Recorder Peter Aldana, Auditor-Controller-elect Ben Benoit and Treasurer-Tax Collector Jennings. This, part of the same ask, was also denied.

An astute observation Board Supervisor Kevin Jeffries summed it up best when he astutely observed, “There’s nothing you’re gonna say that’s gonna convince me that an elected official, who knew what he or she was gonna get when they came into office, without even publicly asking for it, deserves a

Four of the five supervisors aligned against the increases while Supervisor Karen Spiegel abstained. It seems a “no” vote took more courage than she could muster.

When you consider there is a lingering sense of economic unease and concerns over inflation, it makes you wonder how out-of-touch Bianco and Hestrin are from the constituents they serve. Are they so blinded by their own sense of arrogance and entitlement, they feel voters owe them a near $35,000 annual increase? You wouldn’t think so, but obviously they do.

Obviously, one controversial message has failed to resonate

Despite calls to defund the police in response to demands for change and mitigation of police use of excessive force following the murder of George Floyd in 2020, police salaries are actually inching up across the country. Even President Biden has increased funding to police coffers as part of his COVID-19 relief. Therefore, it is not surprising that elected officials like Bianco and Hestrin who are part of the criminal justice system would want a piece of the ‘salary

CFP National Championship to be played at SoFi Stadium, Bowl Picture Clear

The changing landscape and refinement of college football’s “second season” will culminate on the evening of January 9th at SoFi Stadium in Inglewood, to produce the number one team in the nation.

The College Football Playoff (CFP) Selection Committee, under the guidance of Executive Director Bill Hancock, has diligently ranked the nation’s top teams and the end of season semifinal bowls that each will play. The four playoff teams are Georgia (13-0), Michigan (13-0), TCU (12-1) and Ohio State (11-1).

The bowl matchups have number two seed Michigan playing number four seed TCU in the Fiesta Bowl at Glendale, Arizona. Number one ranked Georgia plays fourth seed Ohio State in the Peach Bowl at Mercedes-Benz Stadium in Atlanta. The two playoff semifinal winners will go on to play for the National Championship at SoFi Stadium on January 9th.

Semifinal teams expected to provide the highest level of competition on bowl day

The last week of the college season did cause a shuffle, as the USC Trojans lost their PAC 12 Conference Championship game to the rising Utah Utes. This allowed the Ohio State Buckeyes (11-1) to be placed as the fourth seed, even though they lost to conference rival Michigan 45-23 at home. Nevertheless, these four semifinal teams are more than worthy and will certainly provide the highest level of competition on bowl day.

‘Tridemic’ Warning as RSV, COVID-19 and Influenza Cases Rise

As COVID-19 cases increase and hospitals are overwhelmed with hospitalizations related to Respiratory Syncytial (sin-SISH-uhl) Virus or RSV-related illnesses, coupled with a worsening influenza season, public health officials are warning the public of a “tridemic.”

RSV was discovered in 1956 and has been recognized as a common and seasonal respiratory illness, mostly among children, according to the U.S. Centers for Disease Control and Prevention (CDC). RSV symptoms include fever, cough, runny nose, wheezing and in young infants, difficulty breathing.

In combination with the COVID-19 pandemic and an early flu season, higher than normal cases and hospitalizations of RSV have been reported by hospitals across the state.

According to the California Department of Public Health (CDPH), the number of children who need hospitalization is currently outpacing hospitals’ ability to expand the number of pediatric beds available. The department noted that hospitals typically have about 35% to 40% open pediatric intensive care unit beds, but that number is down to about 20% statewide.

“RSV and flu, and now COVID-19, are on the rise – leading to the hospitalization of our youngest and most vulnerable Californians who need all of us to help protect them,” said State Public Health Officer and CDPH Director Dr. Tomás Aragón in a statement.

On Dec. 1, Riverside County reported the county’s first child flu-related death. The child was under the age of 10 and passed away at a local hospital where he was taken with respiratory symptoms. Health officials stated the child had been ill for a few days and tested positive for both influenza and RSV.

Black Voice News and IE Voice spoke with pediatric infectious disease specialist and health journalist, who does clinical work at Harbor UCLA Medical Center in Los Angeles, Dr. ChrisAnna Mink, to discuss the atypical winter season as hospitals battle a triple threat of viruses.

This interview has been edited and condensed for clarity.

BVN/ IE Voice:

Can you begin by giving a brief breakdown of what the Respiratory Syncytial Virus (RSV) is and what happens when the virus enters the body?

Dr. Mink:

RSV is one of the most common respiratory viruses for humans. Actually, humans are the only ones that get infected with RSV. It particularly causes problems for the very young and for the elderly. By age two, almost all kids on the planet have had some infection with RSV. For most of us, even for the little ones, it’s basically a cold, runny nose, a little cough, maybe a little fever, and in a week, you’re better. However, for teeny tinies — those under six months, especially those younger than two months — it can be quite devastating in that it doesn’t just stay in your upper respiratory tract, it gets down into your lungs and your lower respiratory tract. So, you’ll hear people say, ‘we had a cough that just wouldn’t stop’ or ‘my baby

was wheezing,’ all kinds of symptoms that just make it hard for oxygen to get down into their lungs. And that’s why it causes such significant problems for the littles.

This however, can also happen in any age group for people that have compromised immune systems or some heart or lung problems, and also for the elderly.

What happens is this virus kind of gets in from big respiratory droplets…[and] all of those little drops coming out of your respiratory tree can carry the virus. If you’re in close contact with someone, another human can give it to another human. The other way it can happen is if someone, and especially we see this with kids, if they put their respiratory droplets on the table or something and then you happen to touch it. It can live on that table or toy for a few hours and some data suggest up to 24 hours.

Disparities of Access to COVID-19 Therapeutics in Communities of Color

Ethnic Media Services hosted a media briefing in partnership with California Black Media and the California Department of Public Health on Dec. 8 to emphasize the importance and availability of COVID-19 therapeutic treatments, and give an update on the latest data regarding the disparities in access among communities of color.

During her presentation, Assistant Health Officer for the State of California and the Director of Population Health at the California Department of Public Health Dr. Rita Nguyen highlighted the progress that has been made in the development of COVID treatments since the start of the pandemic.

“I just wanted to take a moment to really recognize that we have an opportunity here to meet the moment,” Dr. Nguyen said. “This is the first winter surge of a three-year pandemic where we actually have treatments that are highly effective, readily available and free to the public, and we know that most folks aren’t accessing it.”

While COVID treatments exist and are available, some communities have difficulty accessing treatments as a result of not knowing where to get treated and not being offered the option by health providers.

A paper published in the U.S. Centers for Disease Control & Prevention Morbidity and Mortality Weekly Report (MMWR) on October 28, 2022 noted that racial and ethnic disparities persisted in outpatient COVID-19 treatment through July 2022.

The report also found that during April to July 2022, the percentage of COVID-19 patients greater than or equal to the age of 20 years old, who were treated with Paxlovid, was 36% and 30% lower among Black and Hispanic patients than among White and non-Hispanic patients, respectively.

Dr. Nguyen explained that the report noted that communities of color and communities with low-income are the least likely to be using treatment, but have greater risk for severe

outcomes as a result of COVID.

In reference to Dr. Nguyen’s presentation on the lack of access to COVID-19 treatments due to not being offered treatment options, Dr. Oliver Brooks, explained that people must advocate on behalf of themselves. Dr. Brooks is the Chief Medical Officer and past Chief of Pediatric and Adolescent Medicine at Watts Healthcare Corporation in Los Angeles, California.

“In terms of treatment, it doesn’t work if you don’t take it or get it offered. So as a person, you need to advocate. You need to know about treatments,” Dr. Brooks said. “I believe that it’s really, really important to have that focus on ensuring that you do have access because the access will not occur if you don’t test, and if it’s not even offered to you.”

There are several free COVID-19 treatment options available to stop COVID-19 illness from

getting severe. Treatments must be taken within five to seven days of symptoms showing. Doctors recommend getting a COVID-19 test to confirm and then seek or ask about treatment options.

COVID-19 treatment options include antiviral treatments that “stop the virus from multiplying in your body and infecting more of your cells.” The antivirals are pills called Paxlovid and Molnupiravir that can be taken at home. In addition to antiviral treatments, there is Remdesivir, which is usually given by a health care provider by intravenous (IV) infusion. Remdesivir is given through IV on the first day, then once daily on the second and third day initiated as soon as possible and within seven days of having symptoms.

“Test — that’s crucial. You don’t get to a treatment until you test,” Dr. Brooks said. “I

Greater Public Oversight of San Bernardino County Law Enforcement Takes Backseat to Criminal Investigatory Process

Electronic Frontier Foundation, the leading nonprofit organization defending civil liberties in the digital world is taking its case to the California Supreme Court after an unfavorable decision by the 4th District Court of Appeal regarding its request to unseal eight search warrants authorizing covert surveillance using a cell-site simulator in San Bernardino County.

The quest for transparency and justice continues as the indefinite sealing of search warrants authorizing secret surveillance in the case of the Electronic Frontier Foundation (EFF) vs San Bernardino Superior Court heads to the California Supreme Court.

The surveillance in question is the warrant authorized use of cell site simulators. As the EFF explains, cell phones, when turned on, constantly seek out nearby cell towers even if the user is not making a call.

When a search warrant is issued for a target cell phone, cell site simulators (also known as stingrays) furnished with identifying information, searches for the target phone. When the cell site simulator is close enough, the target phone, as well as all other cell phones in range, will connect to the cell-site simulator as though it were a cell tower. This leaves any cell phone user in the vicinity vulnerable to intercept.

This is of particular concern in San Bernardino County. In 2016, for example, the San Bernardino County Sheriff’s Department used this technology more

aggressively than other law enforcement agencies in the state.

Following the story

On March 14, 2022, the article San Bernardino County Sheriff: Will Voters Make Their Own Choice in 2022? Part 1 was published where Fry informed the community that the San Bernardino County Sheriff's Department, without a warrant, used the Stingray device over 300 times between January 2014 and May 2015, and was one of the three biggest organizations purchasing surveillance equipment in the State of California in 2014.

A Brief History: EFF vs San Bernardino

On October 23, 2018, EFF filed a lawsuit against San Bernardino County, its sheriff, and its district attorney seeking to unseal search warrants involving the use of cell-site simulators. After unsealing some of the warrants, EFF finalized the case.

On October 8, 2019, EFF sued the San Bernardino Superior Court, the County of San Bernardino, and its district attorney, continuing its quest to unseal eight remaining search warrants from the previous case.

On January 15, 2021, San Bernardino Superior Court Judge Dwight Moore denied EFF’s petition to unseal court records, explaining that unsealing these specific warrants would complicate state interests, sources and methods, and pose dangers to confidential informants. The court found no other remedy except to keep these warrants sealed.

On March 25, 2021, EFF filed an appeal of Judge Moore’s ruling to the 4th District Court of Appeal. After hearing arguments between EFF and the San Bernardino Superior Court, the County of San Bernardino, and the district attorney, the 4th District Court of Appeals agreed with Judge Moore’s ruling.

What will the California Supreme Court Decide?

After the unfavorable decision by the 4th District Court of Appeal, on October 25 EFF requested the California Supreme Court to resolve conflicts in the court’s decision and uphold the public’s right to access judicial records.

The 4th District Court of Appeal Opinion, issued September 15, 2022, described EFF’s argument as

claiming the San Bernardino County Sheriffs have sought the highest number of search warrants in the state using cell-site simulators.

In doing so, EFF alleges the sheriff regularly asks the court to indefinitely seal the warrants using cellsite simulators, with the San Bernardino County Superior Court typically granting their requests.

Due to concerns about the sheriff‘s use of the cellsite simulators, EFF petitioned the San Bernardino Superior Court to unseal the eight search warrants authorizing the sheriff’s use of cell-site simulators that were issued between March 2017 and March 2018.

At the San Bernardino Superior Court, EFF revealed they were able to unseal a number of these

search warrants, while eight remain under seal.

EFF argued that the trial court should have unsealed the search warrants under Penal Code Section 1534(a), Rules of Court, Rules 2.550 and 2.551, the First Amendment of the United States Constitution, the California Constitution, and common law.

Penal Code Section 1534(a) says a search warrant is to be executed and returned within 10 days after its issuance date, thereafter, the records shall be open to the public. After 10 days, the warrant, unless executed, is void.

EFF argued that the eight search warrants had to be unsealed under section 1534(a) because the warrants were executed long before EFF asked to unseal them.

But San Bernardino County argued the eight search warrants fall under “Hobbs affidavits" (an affidavit including details about a confidential informant) and should remain sealed indefinitely because they contain sensitive information about confidential informants and "official information.”

The 4th District Appellate Court agreed with the County, finding an exception to the public’s right to access court documents, and ruling that when a search warrant affidavit contains material about a confidential informant, the affidavit may be sealed to protect the informant's identity.

The Court explained that while granting EFF access to the Hobbs affidavits would have some public benefits, such as enabling greater public oversight of county law enforcement, these benefits are outweighed by the harm to the criminal investigatory process.

The court reasoned that the affidavits are full of information about confidential informants, facts learned from those informants, and information about the County's investigations and investigatory techniques. Thus, a "line-by-line redaction" of the affidavits is "not practicable."

California Rules of Court, Rules 2.550 and 2.551

These rules provide the court with a standard, procedures, and criteria to use when a request is made to seal or unseal a record, with exceptions for specific court records required to be kept confidential

The appellate court held that these rules do not overcome the trial court's proper finding that the official information in the Hobbs affidavits should remain sealed under Evidence Code section 1040.

As to EFF’s argument of the public’s right to access court records under the First Amendment, the appellate court explained that prior court rulings required the court to first determine if it (the court) had abused its discretion when it denied EFF’s request to unseal the search warrants under Evidence Code section 1041.

If the court had not abused its discretion in deciding to keep the search warrants sealed, then the First Amendment would not provide the public with the right to access the court record.

The appellate court explained that the court must weigh the government's interests in maintaining information confidential against the public's general right to access court records or a criminal defendant's right to challenge a warrant.

After reviewing the Hobbs affidavits, the appellate court found the San Bernardino Superior Court did not abuse its discretion and therefore, these materials were not available to the public under the First Amendment.

California Constitution

EFF argued that it has a right to the Hobbs affidavits under the California Constitution’s provision (Article I, Sections 2(a) and 3(b) (1)) protecting the people’s and the media’s right to free speech, to write and to publish as well as their right to access information about the public’s business conducted by their government.

The appellate court cited an exception in the law to protect the confidentiality of law enforcement and prosecution records.

EFF goes to the California Supreme Court

In an interview with IE Voice/Black Voice News, EFF’s attorney Aaron Mackey affirmed, “We fight for individuals’ rights to privacy, free expression, and innovation online.”

Mackey explained that EFF filed this case because it targets the heart of our privacy and the ability to know what our government is doing when it sets up and uses prying surveillance technology like a cell site simulator, which collects data from all cell phones within range.

“A cell site simulator is a really good example of how broadly law enforcement can invade everyone's privacy in a particular area,” Mackey warned.

Then there are people’s constitutionally protected freedoms, Mackey declared, like the people’s right to be free of unreasonable search or seizure of their person or their private property.

Additionally, Mackey explained that these tools can harm our First Amendment right to organize, to engage in lawful protest, and ask the government to fix problems.

He said that EFF is really concerned about how law enforcement uses cell site simulators which can collect personal information about you, the cell phone itself, what it's connecting to, the contents of phone calls, other messages, and communications.

“It's important for the public to know when law enforcement is setting it up somewhere where there's a lot of foot traffic,” Mackey explained, giving an example of places where it's going to capture a lot more people than the target of their investigation.

The Electronic Frontier Foundation has argued the public’s right to access court records under the First Amendment to the U.S. Constitution. (rcfp.org).

The appellate court concluded that EFF had no right to access the Hobbs affidavits under the First Amendment or the California Constitution, or the California Rules of Court.

Common Law

Common Law refers to laws that were established in England from judicial decisions based on the customs of everyday life, and decency, that may not be in writing, but are recognized as part of a moral code. Common law is the foundation for the legal system in all of the United States courts, except Louisiana.

As to EFF’s argument that it has a right to the Hobbs affidavits under Common Law, the appellate court held the San Bernardino Superior Court properly denied EFF access to the Hobbs affidavits under the First Amendment, and did not abuse its discretion by denying EFF access under Common Law.

The appellate court explained the First Amendment is generally understood to provide a stronger right of access than the common law.

Basic Cell Site Simulator: Cell Phone Connects to Strongest Signal Strength

He explained that if we knew the date, time, and location of the cell site simulator, people may be able to realize their communications were likely swept up by law enforcement, a violation of their privacy.

“What about when law enforcement secretly conducts a criminal investigation, uses a cell site simulator to surveil, and then no criminal charges are filed?” he posed.

As the search warrant remains sealed after the investigation is closed, Mackey believes that the public has a right to understand what data was collected by the cell site simulator, and what happens to the data.

“The fourth district court's decision conflicts with other California appellate court cases involving search warrant affidavits,” Mackey objected, citing a famous 2005 decision involving Michael Jackson, where the court ruled that the public does have a presumptive right to search warrant affidavits.

“What we're asking the California Supreme Court to do, is actually review the case and set the law that would govern those records,” Mackey continued.

EFF wants the California Supreme Court to confirm these search warrant affidavits are public records, Mackey advised, then the only question is whether there's any factual reason why the record should remain sealed or whether it could be redacted to allow public access.

Antiviral pills must be prescribed by a medical provider. Once prescribed, a pharmacy like CVS or Rite Aid will provide the pills that are ordered. Health officials encourage those who test positive and who are at risk for severe illness due to COVID-19 to speak with their doctors about treatment options.

The CDPH estimates that the use of Paxlovid in California has prevented between 16,000 and 48,000 hospitalizations and between 4,800 and 10,000 deaths.

Disparities among older adults

In addition to ethnic and racial disparities with access to COVID-19 treatments, there is a disparity among older adults, 65 years of age and older, who account for nearly 90% of COVID-19 deaths in the United States.

“That’s nine in 10. The vulnerability of older adults to viruses is not new. As we age, we accumulate chronic conditions that cause us to have decreased reserves with which to compensate or recover from [stressors] such as infection,” explained Dr. Wynnelena Canio, who is the Clinical Rotation Director in Geriatric Medicine for the Family Medicine residency program at Kaiser Permanente in Santa Rosa, CA.

“A lot of older adults become more frail, losing more muscle mass and becoming more dependent on others after hospitalization, which leads to more disability and possible institutionalization.”

Older adults who are 65 years of age and older account for approximately 71% of COVID deaths in California, but make up 15.6% of the total population, according to state data from Dec. 8, 2022. As of Dec. 1, roughly 35% of older adults 65 years of age and older have received their bivalent booster dose.

“Please get your booster shots. A lot of older adults are not getting them,” Dr. Canio urged.

From what I understand, RSV has been around for a while, but recently, California is experiencing higher cases than previous years. Can you explain why that may be?

Dr. Mink:

We like to say it comes sometime between Halloween and Thanksgiving, and then it peaks up in the winter, January and February, and then tends to be gone, most of the time, by April. I don’t know where it goes the rest of the year. But this year is really different and a question I’m asked a lot by parents is ‘what's going on?’

Over the last two years, because of COVID, we did a lot of things with really conscientious hand washing and masking. Well, that not only kept away COVID, it kept away a lot of the other usual winter respiratory viruses. So, we haven’t seen a lot of RSV, or even a lot of influenza, in 2020 and 2021.

Once everybody took their masks off and got back together, all those viruses have come back with a vengeance, and that’s what we’re seeing. One of the highest rates of RSV is about 25

[cases] per 100,000 people, and we tend to hang probably maybe a fourth of that. It’s really out of control this year.

I have a teeny bit of good news for you. From the CDC data, it looks like maybe RSV has peaked and it’s maybe coming down a little bit. However, we really don’t know what’s going to happen with the holidays and everybody getting back together.

The bad news I have for you is that influenza is at one of those highest levels since maybe like 10 years [ago], like the 2009 pandemic that we had. So influenza, including in California, is at one of the highest rates we’ve seen in a long time. More bad news: COVID is also going up.

BVN/ IE Voice:

Are you noticing any trends among children with RSV such as a specific age group who is more vulnerable?

Dr. Mink:

About one to two per cent of all children born in the US end up with hospitalization with RSV. It’s something that we’ve dealt with forever. This year, we’re seeing a lot more hospitalizations or we have seen a lot more hospitalizations. Things have quieted down a little bit last week. I hope it stays that way.

I have to say not really a big difference from usual. And that usual being the kids that I mentioned to you: [children under six months of age], the ones that are very young and the ones that have some underlying health problems. The bigger kids, in association with asthma, is one of our big concerns because — it’s really interesting — kids that have had RSV are more likely to have asthma as they get bigger.

just smarter than we are. They will find ways to get into our bodies, unless we have some really good defenses. Right now, RSV is still smarter than we are.

BVN/ IE Voice: Do we have any defenses against RSV at all?

Dr. Mink:

Those mitigation steps that we all learned so well for COVID work. Wear your mask. Wash your hands. Keep your distance from people, especially if they’re ill, and if you’re the one that’s ill, stay home because we have so many viruses circulating. Some of them are really devastating like long COVID, and even influenza, can lead to death, especially if you have some underlying problem.

Actually, even for COVID, with our rates increasing, the CDC has put Los Angeles County and most of California, actually, back in medium risk and have officially recommended that mask wearing be done again in public or if you’re in a

For RSV, there’s a monoclonal antibody. I know we’ve heard a lot about monoclonal antibodies for COVID. There’s one that's been around a long time that we use on infants that have really high risk for hospitalization and death and those are the teeny tiny, premature babies. Something to talk to your doctor about is what should I do to protect my baby from RSV?

Also, I’m going to really encourage everyone to get their flu and COVID vaccines because the flu is devastating. So far this year, we’ve already had 14 kid deaths due to influenza this season in the country.

There’s some RSV vaccines in the works for research. There’s a couple that look pretty promising. I think Pfizer, one of the big makers of the COVID vaccine, is going to submit an application to the U.S. Food and Drug Administration (FDA) for review of their RSV vaccine.

If it were a typical season, I could say, ‘Yeah, Breanna, by February, these things are going to start declining.’ Things are weird. COVID comes and goes. So far, we haven’t figured out any particular pattern other than that if you’re immunized, the less likely you are to get severe disease, hospitalized or death, [but it] doesn’t totally protect you from getting it.

I don’t know what’s going to happen with COVID. With influenza, the season has started really early. We’ve been dealing with it since the fall and it’s still climbing. Typically, we peak in January, February.

What is most interesting is that Bianco and Hestrin both secured reelection this year during the June 7, 2022 Primary when, with extremely low voter turnout (28.74%), they eased passed the 50% margin and managed to retain their offices. The record shows they secured the voting of an extremely small percentage of registered voters in the county.

Small victories

Consider this: Bianco earned his victory with only 210,335 total votes or barely 16% of registered voters in the county, while Hestrin, on the other hand, was re-elected by even fewer voters, 185,041 total votes or 14% of registered

voters in the county.

With such small victories it seems they would be more focused on doing their jobs than seeking outrageous pay hikes even as their own Republican party simultaneously criticizes the economy and inflation.

To me this is just another glaring example of the duplicitous nature and character flaws of the law enforcement officials who lead this county. I’m grateful the Board of Supervisors recognized the folly of this request and voted against it.
