o say 2020 was a year of challenges would be an understatement, especially to those who lost loved ones to the deadly coronavirus. COVID-19 has robbed many of the once innocent belief that our institutions, preparedness and leadership would propel the nation and by proxy, the world, through most any crisis, and COVID-19 would be no exception. This year has taught otherwise. It is a lesson minorities in this country have known for generations because the government has consistently failed us; now, however, the suffering is widespread, and government’s failure is more apparent than ever to more people than ever. Yet, despite the painful and grotesque loss of loved ones in the most heartbreaking way, too many locally and around the country, continue clinging to business over life, capitalism over COVID-19, and death over life, as people
continue to suffer and die. Everyone understands the needs of small business owners and employees to be able to work and provide for their families. Yet, in a country with unlimited resources whose leaders prefer appeasing the desires of the wealthy over all else, it is a matter of leadership and choice and not providing a viable solution to this dilemma is also a choice—more money could be allocated toward the goal of supporting business owners and their employees without risking lives, but the government prefers not to. Instead, leaders have adopted an unspoken policy of acceptable loss that is unfathomable. 2020 offered hard lessons, yet during every storm there is hope. The Lessons of 2020 about the virus and how to treat it and vaccines are now being deployed with the promise of constructive improvements toward eventual virus containment though much remains unknown about long-term side effects of the vaccine or the illness. In addition to hardship and death, the virus helped shine a spotlight on systemic inequities and inspired a new group of warriors of all races, creeds and colors to join the movement for change. Whether showing up at the polls in record numbers, funding minority nonprofits, supporting minority-owned businesses, aggressively evaluating data to leverage for change, pushing for new/changed laws as it relates to criminal justice reform and policing, declarations from municipalities, businesses, nonprofits and others acknowledging racism as a public health crisis, and understanding more about the impact of adverse childhood experiences and toxic stress on minorities, etc. COVID-19 has also revealed the partisanship of many local leaders in select cities and at the county level who argue against placing the health and well-being of local constituents above the concerns of their financial backers, usually couched in the feigned desire to protect mom and pop businesses, even as these same leaders in some instances have failed to protect employees in their municipal workplaces. The same failure holds true for those employed in local jails and the inmates who are at the mercy of local sheriffs who have failed to protect them from this deadly virus. It is not surprising so many inmates and jail employees have fallen ill due to COVID-19 considering sheriffs in both Riverside and San Bernardino are in the mold of others around the country who feel they are the ultimate authority in their counties and do not need to comply with orders from the governor. Regardless of their failures one thing is certain, just as they were elected, when the time continued on page 18

California Could See 100,000 Hospitalizations in January Don Thompson | Associated Press
C
alifornia has recorded a half-million coronavirus cases in the last two weeks and in a month could be facing a once-unthinkable caseload of nearly 100,000 hospitalizations, Gov. Gavin Newsom and the state's top health official said Monday. Gov. Gavin Newsom, himself quarantined for the second time in two months, acknowledged that a state projection model shows hospitalizations in that range and said he's likely to extend his stay-at-home order for much of the state next week. Dr. Mark Ghaly, California's Secretary of Health and Human Services. said it's feared entire areas of the state may run out of room even in their makeshift "surge" capacity units "by the end of the month and early in January." In response, the state is updating its planning guide for how hospitals would ration care if everyone can't get the treatment they need, he said. "Our goal is to make sure those plans are in place but work hard to make sure no one has to put them into place anywhere in California," Ghaly said. It hopes to accomplish that by beefing up temporary staffing, opening makeshift hospitals in places like gymnasiums, tents and a vacant NBA arena, and by sending patients to regions of the state that might have precious remaining beds. Officials said residents can still play perhaps the biggest role by skipping holiday gatherings and practicing precautions to slow the spread. California is enduring by far its worst spike in cases and hospitalizations. All of Southern California and the 12-county San Joaquin Valley to the north have been out of regular ICU capacity for days. Those two regions are the ones Newsom are likely to have stay-at-home orders extended, meaning many business must remain closed, restaurants can only serve takeout and virtually all retail is limited to 20% capacity. California is averaging almost 44,000 newly confirmed cases a day and has recorded 525,000 in the last two weeks. It's estimated 12% those who test positive end up in the hospital. That
means 63,000 hospitalizations from the last 14 days of cases. The current figure is 17,190. The state's public health department in June released crisis planning guidelines for hospitals and other care facilities during the pandemic. It provides detailed guidance for how to manage
care decisions when resources are scarce. The goal is the best possible outcome for the largest number of people, the document says. The guidelines emphasize the importance of planning for crisis scenarios and of ensuring continued on page 17
Two Students of Music Changing Lives Place Third at the World Peace Music Festival Leo Cabral | Managing Editor

wo students of Music Changing Lives, a local music and arts youth program, won third place in a virtual music festival that included 3,200 participants worldwide. Zaiah Shepherd, 11, and Pedrito Fregoso, 8, both tied for third place amongst participants from around the world and split a cash prize of $175. The virtual World Peace Music Festival, hosted by the Rotary International District 5300, was started because of the COVID-19 pandemic and was held from Dec. 12-13.
“We thought we’d probably get maybe ten — twenty kids,” said Bruny. “ It was shocking, over twelve countries submitted entries and we had enough content for about a ten-hour show.” Josiah Bruny, founder of Music Changing Lives, was surprised by the number of participants who signed up. This was Music Changing Lives’ first time participating in the festival, and there was enough content to become a two-day event. The turnout inspired Music Changing Lives continued on page 17

Williams | Executive Editor overnor Gavin Newsom has tapped Assemblymember, Dr. Shirley Weber to serve as California’s Secretary of State—the first Black woman in the state’s history to hold this position. 2020 proved to be a year of social justice trials and coronavirus tribulations forcing leaders across California and the nation to find their moral centers. While many faltered in this quest, Black women once again stepped up and unapologetically pointed a way forward with courage, leadership, and determination; all the while, leaning on wisdom that has sustained a people for more than 400 years and kept the Democrat party relevant during times of moral crisis like these. Here in California among those most central to championing the

causes of social justice and economic equity stood Dr. Shirley Weber, Chair of the California Legislative Black Caucus, who represents the state’s 79th Assembly District in San Diego and serves as Chair of the Assembly Budget Subcommittee. When news of Weber’s imminent appointment to be the first Black woman in California to serve as Secretary of State, it was met with high praise. Advocates celebrate Weber as a champion who has proven her political acumen and leadership ability and established herself as a strong voice for all constituents especially Blacks and the underserved. Alex Padilla Makes History as 1st Latino to Represent CA in US Senate

alifornia Gov. Gavin Newsom selected Secretary of State Alex Padilla on Tuesday as the state's next U.S. senator, a historic pick that sends a Latino to the Senate for the first time in the state's history. While Padilla had been the favorite, a video released by Newsom's office shows him getting emotional after Newsom offered him the job, reflecting on the hard work of his parents, who came to the United States from Mexico and worked as a cook and a housekeeper. "It's a hell of an important perspective to bring to Washington," he told Newsom. Padilla, 47, was appointed to fill out the remainder of Vice Presidentelect Kamala Harris' term. She plans to step down from the seat in January ahead of Inauguration Day, on Jan. 20. Padilla will need to run for a full term in 2022. The appointment gives him an advantage, but he's still likely to face challengers; California's top-two primary system allows two Democrats to face off in a general election. "Through his tenacity, integrity, smarts and grit, California is gaining a

tested fighter in their corner who will be a fierce ally in D.C., lifting up our state's values and making sure we secure the critical resources to emerge stronger from this pandemic," Newsom said in a statement. Padilla's appointment gives a new level of representation to Latinos, who make up the state's single largest demographic group at nearly 40% of the population. But Newsom's choice of Padilla also means there will be no Black women in the 100-member Senate. Harris, who is Black and Indian, was the only Black woman in the Senate, and Black leaders had been lobbying Newsom to appoint either Reps. Karen Bass or Barbara Lee to replace her. "Secretary Padilla has a track record as a skilled legislator and a steadfast advocate for justice, and I believe he will be a powerful voice in the Senate for those who continue to be denied our country's promise of equality," Lee said in a statement. Be Prepared for an Onslaught of New Laws in 2021

s residents of the coronavirus-weary inland region prepare to exit 2020 and enter a new year, it is also time to review a sampling of new laws taking effect in California intended to serve as guardrails for individual, municipal, employer, employee and/or corporate behaviors in 2021 and beyond. In a law-and-order nation like the United States, it is not surprising the country has more laws and regulations than any other nation on Earth. However, it may surprise some to learn California leads America with more regulations than any other state. Once again, the California state legislature was busy in 2020 debating and voting, up or down, on hundreds of new bills. Many were signed into
law and will affect inland area workers and their families in the coming years. The new laws soon to impact daily life include some changes in the motor vehicle code to laws addressing the ever-present threat of wildfires and their impact on thousands of residents in the state from a changing climate. 2020 legislative priorities also encompassed measures aimed at addressing, policing, criminal justice and other issues tied to systemic racism. News laws also cover a wide range of worker related issues including the establishment of minimum protections companies must provide to protect their employees from COVID-19, to how much time employees

AB 2017: Kin Care Leave Replaces previous law that limited employees’ use of their annual accrual of employer-provided sick leave for “kin care” (family) reasons to half. It is now up to an employee’s sole discretion as to how much of the accrued time they choose to use for this purpose. AB 2257: More Dynamex Exemptions (Amends AB 5) The categories of exemptions from the “Dynamex” independent contractor classification test are expanded to include the elimination of the annual 35-submission limit for freelancer writers, editors, newspaper cartoonists, still photographers, and photojournalists and also includes exceptions for others like the various jobs tied to the music industry.

Here are a few examples among the hundreds of laws considered this year that will be effective Jan. 1, 2021. AB 685: Employee "Right To Know" Employers are now required to notify employees and the public of a potential workplace COVID-19 exposure within a day. Employees must be notified in writing, inform them of their benefits and rights, and provide a comprehensive plan for disinfection. The company also has 48 hours to notify the local public health agency of a workplace outbreak. Those who fail to comply risk major penalties. Cal-OSHA is also authorized to close workplaces that pose a hazard to employees due to COVID-19. AB 979: Minority Board Representation California is pushing for greater diversity by now requiring corporate boards in addition to women, to also have at least one board member from an unrepresented community, self-identifying as Black, African American, Hispanic, Latino, Asian, Pacific Islander, Native American, Native Hawaiian or Alaska Native, or gay, lesbian, bisexual, or transgender. AB 1947: Extension of Time to File Labor Commissioner Complaints The window for employees to file complaints with the Labor Commissioner for claims of discrimination or termination in violation of Labor Code provisions enforced by the Labor Commissioner is

SB 1383: Family Rights Act Family leave protections are extended to employees at smaller businesses and the list of loved ones now qualified for protected family leave is expanded. Any business with five or more employees is now required to let their employees allow them to take family leave to care for grandparents, grandchildren, and siblings in addition to spouse, a registered domestic partner, child, or parent. Lastly, it provides leave related to active duty of a worker's spouse, registered domestic partner, child, or parent. AB 1512: On-Call Rest Breaks/Security Industry This law applies to those in the security services industry only. It amends the state’s rest break law to allow unionized security guards to remain oncall during their rest breaks. This new law repeals the California Supreme Court’s 2016 ruling in Augustus v. ABM Security Services that prohibited on-call rest breaks for covered employees. AB 2143: No Rehire Provisions/Settlement Agreements Last year, passed a law which prohibited the inclusion of a no rehire provision in settlement agreements of employment disputes. Next year modest revisions to the law will include an exception for employees found to have engaged in criminal conduct. AB 3075: Statements of Information The Secretary of State is now required to disclose—by posting a notice of the certification on the homepage of its internet website—information regarding any officer or director of the company with an outstanding final judgment for his/her violation of any wage order or provision of the Labor Code. SB 973: Pay Data Reporting Private employers with 100 or more employees are now required to submit a pay data report to California’s Department of Fair Employment and Housing (DFEH) by March 31, 2021 and each year thereafter.

S T O R Y SB-1384: Labor Commissioner’s Representation of Financially Disabled Persons The Labor Commissioner’s representation to arbitrations for claimants is expanded to include individuals who cannot afford counsel. It requires employers to serve petitions to compel arbitration on the Labor Commissioner and allows him/her to represent claimants in proceedings to determine whether arbitration agreements are enforceable. Other COVID-19 Related Measures AB 1867: Supplemental COVID Sick Leave Requires private employers with more than 500 employees, to provide up to 80 hours of supplemental paid sick leave to employees to use for specified COVID purposes. This law is already in effect. AB 2537: Acute Care Hospitals/PPE Public and private employers of acute care hospital workers must provide employees responsible for direct patient care with all personal protective equipment (PPE) warranted to comply with federal/state regulations and AB2285 would have motorist who approach a stopped emergency vehicle flashing its lights to proceed with requires employers to ensure the employees use it. Finally, the employers caution or move to another lane. are also required to maintain a minimum 3-month supply of required PPE equipment. Consumer Protections, Victims Rights and Criminal Justice SB 1159: COVID Workers’ Compensation Coverage Already in effect, this law extended the presumption of workers’ compensation coverage for COVID illnesses contracted by certain employees working outside the home and established new COVID-19 reporting requirements for employers. Motor Vehicle Rules and Regulations AB 2285: Move Over, Slow Down Law Any motorists whether on the freeway (already required) or on the streets (new) who approach a stopped emergency vehicle flashing its lights, are required to proceed with caution and move to another lane whenever possible. AB 2717: Motor Vehicles Unattended Children’s Liability Anyone who rescues an endangered child left in an unattended vehicle is now exempted from both criminal or civil liability for trespassing or car damage, provided they adhere to the following—the child being rescued or endangers is under the age of 7 and has been left unattended in a vehicle under dangerous conditions that reasonably could cause suffering, disability or death. This can include heat, cold and/or a lack of ventilation. SB 909: Hi-Lo Evacuation Warning Sound Emergency vehicles can now use a “Hi-Lo” warning sound to notify the public of evacuations in the event of an emergency—local enforcement agencies can use the sound, provided they obtain a permit from the California Highway Patrol.
AB 1281: California Consumer Privacy Act Although the bill extended the employer exemption from certain provisions of the California Consumer Privacy Act (CCPA) to Jan. 1, 2022, employers must still comply with the provision of CCPA requiring them to provide notice to applicants/employees of personal information collected and the purposes for which it is used. AB 2147: Expunged Records For Inmate Firefighters Inmates who work in prison fire camps are now given a chance to have their records expunged upon release. The law is designed to reward their service by making it easier for them to find employment upon release including among the ranks of professional firefighters. AB 2992: Expanded Protections/Domestic Violence, Sexual Assault Current law which includes employment protections and rights to time off work for victims of domestic violence, sexual assault, and/or stalking, is expanded to include victims of crime or abuse. Seeking a New Way Forward AB 3121: Slavery Reparations Establishes a new taskforce to study and consider the possibility of reparations to the descendants of slaves by studying the history of slavery in California and its impact on the descendants of those slaves across generations. It will not only hold hearings, it is also empowered to compel testimony and evidence.

Frontline Health Care Workers Receive Vaccinations
San Bernardino County is making progress in its efforts to vaccinate healthcare workers treating patients on the frontline by inoculating them with FDA approved Pfizer-BioNTech and Moderna vaccines. “We have already provided initial doses to literally thousands of health care workers throughout the county,” said Curt Hagman, San Bernardino County Board of Supervisors Chairman. “Our top priority is getting the vaccines to doctors, nurses, paramedics and our other heroes working in hospitals and emergency medical facilities.” According to Hagman, they expect to have all 112,000 healthcare providers in the county to receive their first doses of the vaccine within the next few weeks.

for the job of Secretary of State. “With her,” Newsom advised, “California will continue to be a model for the nation in expanding democratic participation and access to the ballot box.” Weber steps into the role being vacated by Alex Padilla just named by the governor to fill the U.S. Senate seat being vacated by Vice-President elect Kamala Harris. Padilla makes history as the first Latino from California to serve in the U.S. Senate. Commenting on Dr. Weber as his replacement as Secretary of State Padilla stated, “I know she’ll bring experience and a commitment to protecting voting rights and expanding access to the ballot.” Adding, “Congratulations, Dr. Weber. Thank you for continuing the work to make California a beacon for democracy.” Weber’s focused and steady stewardship of the California Legislative Black Caucus is evidence of this commitment. As its chair, she was instrumental in prioritizing, supporting and/or amending legislation aimed at improving the quality of life for Californians. health screening materials for peace officers to include an evaluation for explicit and implicit bias against race, ethnicity, gender, nationality, religion, disability, and sexual orientation. • AB 979 requiring each publicly held corporation headquartered in California to have at least one director from an underrepresented community by the close of 2021. Padilla was first elected as California's top elections official in 2014 and won a second term four years later. In that position, he has overseen California's vast elections apparatus, including the rollout of a more robust vote-by-mail system. In the November election, California mailed a ballot to every registered voter. Prior to that, he oversaw the implementation of the Voter's Choice Act, a 2016 law that allowed counties to mail all registered voters a ballot. The state now has 22 million voters. Padilla lives in Los Angeles with his wife and three sons, ages 5, 7 and 13. His appointment will bring geographic diversity to California's representation in Washington. Dianne Feinstein, California's other senator, is from San Francisco, and politicians from Northern California have held some of the state's highest political offices for decades. Harris built her political career in San Francisco before moving to Los Angeles. Feinstein, whom Padilla once worked for, announced her support for his nomination in early December. He and Newsom have a long relationship. When Newsom first ran for governor in 2009, Padilla chaired his campaign. Newsom dropped out when former Gov. Jerry Brown entered the race and instead ran for lieutenant governor, a job he held for eight years. When he ran again for governor in 2018 in a competitive primary, Padilla endorsed him over other prominent Democrats, including former Los Angeles Mayor Antonio Villaraigosa. The campaign arm of the Congressional Hispanic Caucus and the Latino Victory Fund were among the groups advocating for Newsom to select Padilla. The document outlines best practices for "proactive triage" that must occur when a hospital has exhausted its resources. A basic graphic shows the first consideration should be whether a patient is actively dying or certain to die, in which case they should only be given palliative care. For patients not in that category, care providers are broadly asked to assess a person's prognosis of survival compared to others when determining how to allocate limited resources. Los Angeles County is among the hardest hit areas of the state but its hospitals aren't there yet, Los Angeles County Department of Health Services Director Dr. Christina Ghaly said Monday. They are in the contingency stage, which means shifting around staff and equipment. "You're ... doing things that you wouldn't otherwise do — canceling surgeries, redeploying staff, things of that nature," said Ghaly, the wife of the state health director. "It causes intense strain. It's exhausting for staff, but hospitals are able to do this by redeploying the resources that they have to the greatest extent possible." SKDKnickerbocker had ties to Joe Biden's presidential campaign, prompting criticism that Padilla was using taxpayer dollars with a political agenda. comes, they can be replaced by candidates more in alignment with the desires of all the people they serve, not just those with the biggest wallets. As we look to the future it is important to recognize what the collective trauma we experienced in 2020 does not have to keep us mired in dysfunction in 2021. Certainly, the virus has changed us, demands for police and criminal justice reforms have challenged us, calls for systemic and institutional equity propels us and experiencing life’s final common denominator on such a massive scale should unite us. Like generations faced with similar challenges throughout history, the question is whether we will choose to remain in the hopeless muck and mire of 2020 or reach with hope for better days to come? As the great jazz lyricist and vocalist Dianne Reeves said, “[A]ll the things you ask, you will know someday but you have got to live in a patient way. God put us here by fate and by fate that means better days… we are all moons in the dark of night, ain't no morning gonna come 'til the time is right.” 2021 marks a new beginning the right time for change but we must choose to make it so. As for me, I choose hope in the better days I know are coming and I am reaching for them with both hands. We laid a foundation for change in November. Now, it is up to us to keep working for a better tomorrow. Of course, this is just my opinion. I’m keeping it real.
