I would like to start off this month’s President’s Message with an emphatic “Job Well Done!” to the April Education Seminar instructor Mr. Michael O’Connor. His extremely informative, educational, and practical presentation on ‘Code Upgrades: Meaning, Effects, and Strategies’ was well received by the 50+ attendees. It has been two months since our last luncheon and it was fantastic that our Membership showed up in force! Our next business luncheon is scheduled for Thursday, July 9, 2015, at the Lions Gate Hotel, where the Department of Insurance will be presenting ‘Insurance Fraud’. This luncheon is about a month and a half away, so please make sure to mark your calendars for what’s sure to be another excellent presentation!
My next order of business is to send a humongous “Congratulations!” to JM Environmental on winning the Eagle Sponsorship for this year’s SCA Golf Tournament. The Eagle Sponsorship is the “golden ring” of the Golf Tournament, and crucial to its success. So I believe a “Thank You” to JM Environmental is also in order.

Commissioner Jones’ statement on revocation of Blue Shield’s tax-exempt status SACRAMENTO, Calif. – California Insurance Commissioner Dave Jones made the following statement March 18, 2015 in response to the Franchise Tax Board’s decision to revoke Blue Shield of California’s taxexempt status:

“The Franchise Tax Board decision to terminate Blue Shield’s tax-exempt status confirms what I have said for years – that Blue Shield charges excessive rates and acts like a for-profit health insurer.”
Blue Shield is also dodging the payment of premium taxes, by taking advantage of a legal loophole that allows Blue Shield
to move its health insurance products from Department of Insurance regulation to Department of Managed Health Care regulation.
“The Department of Insurance collects premium taxes from all for-profit and non-profit health insurers. Blue Shield has moved most of its health insurance policies over to Department of Managed Health Care, to dodge my Department’s strong consumer protection regulation and our collection of premium taxes. We need to pass AB 1434 by Assemblymember Kevin McCarty to close the loophole that allows Blue Shield to move

its health insurance products to the Department of Managed Health Care to avoid the strong consumer protection oversight of the Department of Insurance and avoid paying premium taxes,” he added.
“Currently, the Blue Shield loophole costs the state $100 million in premium taxes annually. As a tax-exempt company with surplus of $4.2 billion Blue Shield was able to accumulate an enormous amount of money on which it did not pay state taxes by evading the tax on the premiums it collects.”

Code Updates CE Course Chalk-Full of Great Info OConnor illustrates depth and breadth of changes in practices & regulations at April SCA By Bryan Harrison
The California building code, and a plethora of related regulations, has grown from a concise single little handbook, to stacks of manuals over the past 35 plus years. Dealing with the volume, and navigating which codes affect which application has become a rather daunting task.
Longtime friend to the Sacramento Claims Association, and noted forensic engineer, Michael OConnor, presented a two-hour continuing education accredited course at the April 16, 2015 luncheon gathering of the SCA dealing with Code Updates.
The first hour included a buffet lunch, with the second hour left open as optional for those not needing the CE credits. SCA board members were pleasantly surprised to see that nearly everyone stayed for the full two-hour course. OConnor’s concise but thorough presentation captivated the crowd, making fascinating subject matter that could easily have been a snoozer. His range of topics and in-depth discussion of changes in building codes, flood regulations, electrical and much more had the crowd engaged from start to finish.
In absense of President Steve Moore, Immediate Past President, Bob Battezzato, welcomed the crowd and introduced presenter Mike OConnor.
SCA Secretary, Cathrin Nevin, and board member, Tami Umland, handled check-ins.

Personality Profile
John Miller, CFI By Bryan Harrison
John Miller is no stranger to dealing with fire investigations. As a former Fire Captain for Sacramento City Fire Department as part of his experience, John has investigated over 2,000 fire and explosion losses to date. His firm, John Miller Investigations, Inc., investigates the origin and cause of all types of fires and explosions. As a longtime fire investigator, John has seen and been involved in investigating a wide array of losses over the years. It all began back in 1972, he explains, when, out of high school, he enlisted into the armed forces.
“I joined the USAF (United State Air Force) and became a firefighter,” he shares.
Following his time in the service, this New York native found a home with the Sacramento City Fire Department. There he excelled . At Sac City Fire, he tells us, “I was promoted to fire investigator for three years. Then I was promoted to Fire Captain,” he says.
John retired from the fire department and started his own investigations company in 1998.
In addition to origin and cause, JMI handles retrieval, transportation, and storage of all types of related evidence, and provides evidence examination facilities as needed for losses throughout California & Oregon.
A Certified Fire & Explosion Investigator, John is a member of: the National Association of Fire Investigators; International Association of Arson Investigators; and is a recognized Certified Fire Investigator with the State of California Fire Marshal’s Office. As a licensed private investigator in California & Oregon, John is NFPA 921 & 1033 Compliant.
“I have testified in court as an

expert in fire investigations on several occasions,” he tells us.
Part of investigating so many fire and explosion losses is handling and managing the evidence that comes with them. “I have been responsible for the handling and storage of over 17,800 pieces of evidence to date,” he says. John holds true to a root philosophy. “I believe in finding the facts in all losses without prejudice,” he states proudly. “I handle all assignments personally, and I am starting my 17th year in the private sector. “

Join or Renew Your SCA Membership Now for 2015! The 2015 Sacramento Claims Association Membership Drive is now in full swing! Annual membership do provide a significant financial support to the organization. And, a strong membership helps to keep a non-profit like SCA viable and alive. Without all of us together there would be no SCA. “This organization could not maintain the strong standing we enjoy today without the support of all our members,” stated SCA President Steve Moore.
Overall membership and meeting attendance has been consistent and substantial. Still, the sense that there aren’t many adjusters at any given function remains pervasive.
“We continue to encourage the carrier claims people and independent adjusters participate, and to attend and become more involved,” Moore added.
“The Sacramento Claims Association is always committed to maintaining a high degree of professional courtesy within our ranks.”
The organization has been actively taking measures to continue to raise its standing within the community at large, as well, contributing to local charitable causes at every turn. There seems to be a bit of a revival of carriers supporting their claims people joining and supporting their local associations.
