Terms and Conditions ‘Bugaboo Runner Competition’ From 1pm (AEST) June 1, 2015 until 5pm (AEST) on June 7, 2015 (“Contest Period”), Bugaboo Australia Pty Limited (“Bugaboo”) will organise the “Bugaboo Runner Competition” (“the Competition”).

Here’s what you should do. Log on to the Bugaboo Australia Facebook page and place your answer/comment (in 25 words or less )under the competition post to the following question: Describe your favourite place to run free with your child, and post a beautiful photo on the Bugaboo Australia Facebook page, including hashtags #BugabooRunner and #RunFree.

Terms and Conditions 1. These Terms and Conditions apply to the Competition. By entering the Competition, participants expressly agree to be bound by these Terms and Conditions. However, the Competition shall be void where prohibited by law.

2. The Competition is promoted and organized by Bugaboo Australia Pty Limited, suite 2, level 2, 156 Edgecliff Road, Woollahra, NSW 2025. ABN 151 298 28 280.

3. The Competition is hosted on the Australian Facebook page of Bugaboo. Participants need to Log on to the Bugaboo Australian Facebook page and place their answer/comment (in 25 words or less )under the competition post to the following question: Describe your favourite place to run free with your child, and post a beautiful photo on the Bugaboo Australia Facebook page, including hashtags #BugabooRunner and #RunFree. The winner will be displayed on the Australian Facebook page of Bugaboo and may also be featured on Bugaboo social media channels (Facebook, Twitter, Instagram, YouTube Flickr, etc.).

4. Bugaboo will moderate the Competition and reserves the right not to accept or publish any winner from the Competition that does not comply with these Terms and Conditions.

5. There is no purchase requirement to enter the Competition other than the usual Internet connection charges payable to the participant’s service provider and/or Telephone Company.

Qualifying Participants 6. The competition is open to residents of Australia only, aged 18 and above.

7. Employees of Bugaboo, including their relatives, agents and people connected with the creation or administration of the Competition are not eligible to take part in the Competition. Bugaboo reserves the right to verify the eligibility of all Participants.

8. By entering the Competition, the Participant hereby warrants that all personal details submitted by him/her are true, current and complete and that the e-mail address and phone number he/she submits are accurate and valid.

9. By entering the Competition, the Participant also hereby warrants that they will observe a polite attitude and will not post on any of the Bugaboo social network pages (Facebook, Twitter, Instagram) any comments that would be insulting, offending or content which would be contrary to the law. Any such comments will immediately be deleted.

10. Bugaboo, in its absolute discretion, reserves the right to disqualify any participant if it has reasonable grounds to believe the participant has breached any of these Terms and Conditions, has cheated or does not meet any of the conditions set out in these Terms and Conditions.

The Competition – entry and prize 11. The Competition begins at 1pm (AEST) on the June 1, 2015 and ends on at 5pm (AEST) on the June 7, 2015. Submissions received after this time and date will not be taken into account.

12. Limit of one entry per person.

13. The Competition is a game of skill and chance plays no part in determining the identity of the winner. All valid entries received during the Contest Period will be judged on their merit and the winning entry judged on creativity, and originality will win the prize.

14. A jury composed of Bugaboo personnel will select the winner of the Competition.

15. The winner of the Competition will be announced on the Bugaboo Australian Facebook page within 1 day of the competition closing date (5pm (AEST) June 7, 2015).

16. Bugaboo will notify the winner by email or phone using the information given in their competition entry.

17. The winner of the Competition will win a Prize (“the Prize”). The Prize consists of one Bugaboo Runner (demo model the colour is determined by Bugaboo) and one Fitbit Flex (the colour is determined by Bugaboo).

18. For the avoidance of doubt, no other costs will be assumed by Bugaboo. Nor will Bugaboo be responsible for any tax implication that may arise from winning the Prize.

19. If the Prize is declined or unclaimed by the winner, or if a winner cannot be contacted from the details provided within twenty four hours of notification, a replacement winner may be selected by the jury at Bugaboo ’s discretion from the other selected entries. The new winner will be notified by Bugaboo. The original winner will then be forfeited.

20. The Prize is non-transferable and there is no cash alternative. The Prize is awarded at Bugaboo’s entire discretion and no prize will be awarded as a result of improper actions by or on behalf of any participant.

Copyright 21. By posting/entering the photo in the Competition participant declares that: (a) he/she is the sole owner and author of the photo, (b) that participant is the sole owner of all copyright for the photo, (c) the photo is not subject to third-party rights and (d) the photo is original.

22. The photo does not contain any unauthorised, threatening, hatred-inciting, false, misleading, abusive, harassing, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content.

23. The winner grant to Bugaboo and its designees an irrevocable, royalty-free, non-exclusive, worldwide perpetual license to publish the photo (as entered, or as cropped by Bugaboo) on its website and on its social networks (Facebook, Twitter, Flickr, Instagram, Pinterest and YouTube, etc.) in the context of this Competition.

24. Participant confirms that each recognizable person and/or child depicted in the photo has granted permission to be portrayed as shown and that they have been informed of the Competition.

Liability 25. By taking part in the Competition, the Participant accepts that unforeseen technical problems linked to the use of computer networks may arise, including problems when connecting to the Internet. Bugaboo cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any participant entering the Competition. Bugaboo is not responsible for any problems or technical malfunction of any telephone network or lines, computer Wi-Fi systems, servers, or providers, platforms and/or platform operators, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site,

or any combination thereof, including any injury or damage to Participant’s or any other person’s computer or other mobile device related to or resulting from participation in the Competition.

26. Bugaboo gives no warranty or guarantee in relation to the Prize and accepts no responsibility or liability for elements of the Prize being amended by Bugaboo.

27. To the fullest extent permissible by law, Bugaboo excludes liability for all loss, damage or claim arising as a result of the Participant’s entry into the Competition or use of the Prize.

Data protection and publicity 28. Bugaboo reserves the right and the Participant expressly agrees that Bugaboo may use the name of the winner and/or their entry content. Use may include the Internet, such as Bugaboo’s website, its social network pages including Facebook, Twitter, Instagram, Flickr, You Tube etc. and all Photograph, publicity, magazines, catalogues or the likes.

29. By participating in this Competition, the Participant will only be providing information to Bugaboo. Bugaboo will store participant’s entry details in connection with this Competition solely for the purpose of competition administration, unless participants have given permission for additional use.

Cancellation 30. Bugaboo reserves the right in its sole discretion to cancel the Competition and/or to amend the Terms and Conditions or change the Prize at any time and without prior notice.

31. In the event of any dispute regarding the Terms and Conditions, conduct, results and all other matters relating to the Competition, Bugaboo’s decision shall be final and no correspondence or discussion shall be entered into.

32. If at any time one or more of the provisions of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out without affecting the remaining provisions.

33. These Terms and Conditions shall be governed by and construed in all respects in accordance with the laws of New South Wales and Australia whose courts shall have exclusive jurisdiction.
