More than 60% of trucks pulled over by police in Burnaby in 2020 were taken off the road after failing inspections, compared to 52% for the Lower Mainland as a whole. Other cities in the region have dedicated commercial vehicle enforcement units, but commercial vehicle safety did not make it into Burnaby’s 2020 Community Safety Plan. In this special report, we take a closer look at what that means for Burnaby’s roads.

‘Very, very concerning’: Truck safety in focus Continued from page 1 ready to fly off around a corner, trucks with wobbly tires, trucks with unsecured cargo that could shift and flip the vehicle onto whoever happens to be beside it, trucks on steep hills (like Royal Oak Avenue and Cariboo Road) where they’re not supposed to be, truckers that keep getting caught on their cellphones, big trucks with air brakes that don’t work. “There are times that I’ll be under there and I’ll ask them to hit the brake and the brakes don’t even activate, period; there is no movement in the brake pads, nothing,” Connolly said. Connolly, a member of Burnaby RCMP’s traffic enforcement unit, has become the detachment’s resident expert in commercial vehicle safety since training to become a Commercial Vehicle Safety Alliance (CVSA) inspector in 2019. He said he started methodically tracking statistics from his enforcement activities when he saw how little information there was about commercial vehicle safety in B.C. compared to the U.S. “It became clear from the statistics I was obtaining that it was a concern, that there was very, very concerning numbers that we were seeing,” he said.
NO DEDICATED UNIT The city’s public safety committee started hearing about Connolly’s work in May 2019 in quarterly police reports, and Connolly himself has given two presentations. The committee routinely hears that more than half the vehicles checked in the city during commercial vehicle enforcement blitzes are taken off the road. Yet the issue of commercial vehicle safety is not mentioned at all in the city’s 2020 Community Safety Plan or its July 2021 draft Transportation Plan. Public safety director Dave Critchley said the Community Safety Plan “is not intended to capture all of the various initiatives/concerns of each (department) they are currently working on,” but the city is reviewing the plan, and commercial vehicles “have been raised as part of that discussion.” Connolly would like to see Burnaby RCMP establish a dedicated commercial vehicle unit as other Metro Vancouver police agencies, like Vancouver, Delta and New Westminster, have. He said police agencies have created the specialized units because Commercial Vehicle Safety and Enforcement, the provincial agency responsi-

ble for commercial vehicle enforcement, isn’t adequately resourced to do the job. The B.C. General Employees Union, which represents 185 members at CVSE, also told the NOW the agency is understaffed. MORE TRUCKS, FEWER INSPECTORS But the Ministry of Transportation and Infrastructure said CVSE “continues to be a robust and resilient organization.” “CVSE is active in all areas of the province, providing education and enforcement programs aimed at continually improving safety of commercial vehicles on B.C. highways, as well as progressing economic viability of the industry,” stated an email from the ministry. But staffing at the agency hasn’t kept up with an increase in truck traffic in the province. According to ICBC, there were 49,130 heavy
trucks (11,795 kilograms or heavier) registered in the province in 2003; in 2020, there were 68,000 – a 38% increase. There were also 120,000 lower weight commercial vehicles (between 5,000 and 11,794 kilograms) registered in the province last year. But there are actually 39 fewer inspectors today than there were in 2003. And the number of inspections conducted by the agency has dropped, too, from 26,635 in 2003 to 24,161 in 2019/2020. (COVID “will have had some impact” on the latest 2019/2020 inspection numbers, the ministry said.) COORDINATED APPROACH For local Mounties to pick up the slack with a dedicated commercial vehicle unit would take a “significant amount of training and experience,” according to Critchley,
and he said it’s up to the local detachment to “determine the operational deployment of their resources.” After months of training in 2019, Connolly is currently the only local Mountie qualified to do level 1 CVSA inspections, but he has been training his fellow traffic unit officers to perform level 2 checks. “It does everything I do except crawl under the truck and start looking at the stuff underneath, the transmission, the drive line, the brakes,” he said. Over the last few years, traffic sections around the region have also gotten together for commercial vehicle enforcement blitzes in each other’s jurisdictions. Since commercial vehicle safety is a regional issue, that approach just makes sense to Connolly. “That truck, maybe it’s coming from Abbotsford and it’s going through to
Vancouver, and, if those problems are there, well, then it’s a danger the entire way,” he said. Burnaby’s location, right in the middle of the Lower Mainland, may be the reason the number of trucks taken off the road here was about 10 percentage points higher than in other cities in the region, according to Connolly. Burnaby RCMP hasn’t “ruled out” a specialized commercial vehicle unit in the future, according to a statement from the detachment, but its focus is currently on supporting Connolly’s training work with other officers and his collaborations with other police agencies. “The current system allows our traffic unit to balance (commercial vehicle enforcement) with other priority duties, such as speed, impaired driving, and distracted driving enforcement,” read the statement.

Union pushes for provincewide vaccine mandate

The union representing local teachers wouldn’t stand in the way if the Burnaby school board made COVID-19 vaccines mandatory for school staff – but it will push trustees to lobby for a provincial mandate. The provincial government has left the matter of mandatory vaccines for school staff up to local boards. Education Minister Jennifer Whiteside has said there isn’t a public health order that would allow for a provincial approach. And Premier John Horgan said last week the province is “not the employer in this case.”
But Burnaby Teachers’ Association president Daniel Tétrault said leaving the matter up to districts is unfair. “It’s just unequal across the board,” he told the NOW. “What will end up happening is the districts where there probably needs to be a mandate, that have low vaccination rates, won’t adopt it, and districts that have already high vaccination rates might adopt it.” Tétrault said the BTA supports the position put out last Thursday by B.C. Teachers’ Federation president Teri Mooring, who said leaving vaccine mandates to districts is “the wrong approach.” “Any vaccine mandate would need to be provin-
cially implemented and done equitably,” Mooring said. “We can’t have unequal treatment of workers in the public education system.” That being said, if the Burnaby school board decided to make vaccines mandatory for all school staff locally, the union wouldn’t oppose it, according to Tétrault. “We would not stand in the way, but we would make sure that our members’ privacy rights were protected and that people were treated fairly,” he said. The BTA is encouraging all its members who are eligible for the vaccine to get it, according to Tétrault. “This is the best way
to protect not only you but your family and also the students who you are teaching,” he said. “We have a lot of students under 12 who can’t get vaccinated.” The BTA has gotten some calls from members concerned about a possible vaccine mandate, according to Tétrault. “Their concerns are around personal choice, about uncertainty about the effectiveness of the vaccine, but this is not a widespread sentiment here in Burnaby,” he said. Paul Simpson, president of CUPE Local 379, which represents local school support staff, said a “vocal minority” of his members, too, have raised concerns about a possible
vaccine mandate, but he said he believes the majority would support it. The union has a meeting on Oct. 16, when the issue will be discussed, according to Simpson. “At this point I can’t tell you I oppose a vaccine mandate or I support one,” he said. “Officially, I have not had that full conversation with my membership.” Burnaby board of education chair Jen Mezei told a committee of the whole meeting Tuesday that school board chairs will meet today (Thursday, Oct. 14) to discuss the matter. In a report from secretary-treasurer Russell Horswill, the committee heard the Ministry of Ed-
ucation has struck an ad hoc advisory committee to develop guidelines for schools to “inform an operational framework and establish a template” for staff vaccine mandates. “While individual boards of education have the authority to pursue mandatory vaccinations on their own, a coordinated approach across the province is being recommended,” stated the report. The board voted unanimously to direct staff to “review information received pertaining to mandatory staff vaccinations and report back.”

Topic: Should vaccines be mandatory for teachers?
The issue that most clearly shows a fundamental difference between the current version of an NDP government and the 1990s version of an NDP government comes to the front of the legislature every Wednesday afternoon. A small knot of people gathers to protest the logging of old growth timber, particularly in the nearby Fairy Creek area. When the legislature resumed sitting last week, a larger crowd of about 125 people protesting the same logging blocked all but one of the entrances to the legislature itself. It was essentially a non-event as MLAs, staff and visitors came and went through the main door throughout the day.The NDP cabinet met that day, the legislature conducted its business as usual, and the protesters shrunk in number throughout the afternoon. By 6:30, it was all over and everyone went home. This is all in stark contrast to the environmentalists protesting logging practices under the NDP government of the 1990s. The so-called “War of theWoods” in Clayoquot Sound onVancouver Island saw mass arrests, thousands of people protesting regularly at the legislature (they actually broke through security during the reading of a Throne Speech, stormed into the legislature upper rotunda, broke a guard’s hip and smashed the plateglass window on the front door of the chamber). Back then, the NDP government found itself hitting the panic button over and over again as the protests continued. Members of the caucus were upset about all the arrests and the party was worried it was losing many of its traditional supporters. The NDP government back then was constantly on the defensive when it came to fighting with the

environmental movement. This is simply not happening today.The current NDP government has offered a collective shrug to the Fairy Creek protesters. A giant “meh.” Even though more than 1,000 people have been arrested (that is more than the number of arrests at Clayoquot Sound) for defying an injunction against the protests in the forests, it has had little impact on the NDP government. Aside from agreeing to defer the logging of some old growth timber, the government has had little response to the ongoing protest, other than Premier John Horgan regularly telling protesters to leave the area and to respect the local First Nations’ territory. That brings us to the key difference between the 1990s and the present day. The Horgan government has formally enshrined into law the United Nations Declaration of the Rights of Indigenous Peoples (UNDRIP), which greatly enhances First Nations’ rights. Fairy Creek is the traditional territory of the Pacheedaht First Nations, and it strongly supports local logging operations. Six times the Pacheedaht have asked the protesters to leave, including on the National Day for Truth and Reconciliation. Each request has been refused. Unlike its 1990s predecessor, the NDP government has put First Nations’ rights at the top of its priority list, well above any well-funded environmental protest campaign. As a result, unless the Pacheedaht change their position (highly unlikely) the NDP government will remain steadfast in its support for the current position, no matter how many of thoseWednesday afternoon gatherings occur. Seniors lose work crews
Local seniors were left high and dry when minimum security inmates at Oakalla prison were shipped to a Chilliwack minimum security jail to serve out their sentences.The seniors had come to rely on a program that saw low-risk offenders cutting their grass and doing other yard work for them for a little cash. A seniors group had even donated $200 in gardening tools to the program. Prison officials gave only two weeks’ before cancelling the arrangement, leaving one local pensioner with a half-finished deck.

Opinionnow You saved my wife’s life Editor: I’d like to recognize the following people who saved my wife’s life on the morning of Sept. 11, 2021. My wife, Flor-Rita Padilla, was working out with her boot camp buddies that morning at approximately 8 a.m. at Kitchener Elementary School in Burnaby. During her warmup, midstride, she collapsed. Two of her friends, Tania Zulkoskey and Diane Srivastava, immediately began CPR. They put her in recovery position and then began to clear out her mouth when they realize she was vomiting. My wife took two breaths and then stopped breathing. Tania immediately began chest compressions. Meanwhile, 911 was sending out a call to fire and ambulance. Captain Wisner from fire station 5 on Hastings was responding to the call that was initially reported as a fall. When Captain Wisner got to the scene, he saw that they were performing chest compressions, and they had to defib my wife three times before they got her heart to start to beat. My wife survived a heart attack at only 42 years. She will need some physical therapy and is still regaining strength, and there are some short-term memory defects that will improve with time. But she survived due to the heroic actions of Diane and Tania and Captain Wisner and his crew. They didn’t just save my wife’s life,

I’ve spoken to multiple doctors in ICU and emergency and they all agree, if CPR was not done and not done correctly, my wife’s survival would be slim, and if she did survive, her neural defects would impact her quality of life severely. We might as well walk Editor: Burnaby mom frustrated by city project’s ‘horrible detour’ to daycare, NOW opinion The City of Burnaby has so many construction projects that tie up traffic that getting around Burnaby has become as slow as getting around by foot in the Middle Ages. The city should do road construction projects that tie up major traffic arteries after 9 p.m., when traffic is minimal. If not, the city official in charge of these projects should be fired. He/ she is out of touch with the reality that roads around Burnaby have not been improved to cope with the city council-approved increased population densification. Does he/she even live in Burnaby? Burnaby Grade 12 student Linh Nguyen knows firsthand how important small businesses can be to a community – and not just to the local economy either. When she moved here from Calgary in Grade 10, Sushi Q, a small bubble tea shop close to Burnaby Central Secondary, became a kind of sanctuary for her as she went through the difficult process of making new friends at a new school. “I got to know the owners, and they were truly the most warm-hearted people you could meet, and they always treated me so well,” Nguyen says. “I don’t think they knew how much they meant to me, but it was nice in such an unfamiliar environment to have a place where I kind of felt like it was safe.” She even painted them a poster that they had hung up in the shop for a yearand-a-half. So, when she found out the shop had closed – one of thousands of small businesses across the country to go down because of the COVID-19 pandemic –
Nguyen was devastated. She did some research and found lots of stories about small businesses that had been in families for years shutting down because of the pandemic. “I realized it was a really big problem,” she says. She had taken a marketing class at school and done an internship at a marketing firm, and she wondered if she could use those new skills to help. Her idea was a novel one – a free, non-profit marketing agency and directory for small, local businesses. She couldn’t find anything like it on the internet. “I was terrified,” she says, “I was like, ‘Oh my god, no one’s really doing this. I don’t have a path that I can follow.’” But with help from two close friends (Macy and David Lam – no relation to each other) she got Connect MediaYVR up and running in April. So far, the group has worked with four small, local businesses, providing free marketing services, including social media management, content creation and advertising management.

“I just figured, especially in the midst of a pandemic, businesses would not have the time or resources to invest in their social media or their marketing,” Nguyen says. “So we try to help with that. By growing their reach and their presence on social media, we help them connect to more customers.” Connect MediaYVR has also created a local directory, a website that

Burnaby is not getting the service it’s paying for from the Lower Mainland’s 911 dispatching service, according to the city’s public safety director. E-Comm is a multi-municipality agency that coordinates 911 service for police, fire and ambulance across the Lower Mainland and provides calltaking services for participating municipalities, including Burnaby. But public safety director Dave Critchley told the public safety committee last month the city is revisiting its relationship with the organization. “We currently have a contract with E-Comm, and they’re not meeting the expectations and requirements of that contract, and we’re exploring all options,” Critchley said.
Committee member HeymannYip had told the committee he spent two hours on hold during a call to the Burnaby RCMP’s non-emergency line in June and another hour and 45 minutes during a call in August while trying to report suspicious activity in the community. Critchley called those waits “completely unacceptable.” Burnaby Board of Trade representative Cory Redekop said board of trade members have concerns about the wait times. “There’s obviously the health and safety concerns of not getting through,” Redekop said, “but I’m even more concerned around the negative feedback loop we might be seeing here, where we’re not reporting the crimes, so we’re seeing the numbers going down – and how can we possibly assess where

Communitynow SFU students plan hunger strike for climate action A group of students at Simon Fraser University in Burnaby have given their school administrators an ultimatum:The university has four weeks to commit to a full divestment from fossil fuels or a hunger strike will commence on Nov. 1. Jaden Dyer, a fourthyear SFU student and media coordinator for the campaign, said: “Accepting our ultimatum will not only have an immediate impact, but a rippling one,
that will act to shift cultural attitudes towards the use of fossil fuels worldwide. So I hope that the administrators will prove to be the leaders they want today’s and tomorrow’s students to look up to – the leaders they want to go down in history as. Because how can SFU expect to raise the leaders of tomorrow if they are not willing to lead by example today?” Educational institutions around the world have

made this pledge, including Harvard University earlier this fall. The ultimatum delivered to SFU also involves administrators making a meaningful statement on fire safety on campus as a result of the new expanded tank petro-storage facility being built on Burnaby Mountain, Dyer said. The hunger strike will be held in the Academic Quadrangle, the central hub of SFU’s Burnaby
campus. Prior to the Nov. 1 date, a public talk will be held to recruit volunteers in both hunger striking and supportive roles. The momentum of the campaign will be used to encourage other students across Canada to engage in similar tactics to pressure their institutions to divest, Dyer said. veterans’ benefits.The son of a Second World War veteran, Burchell has been fighting for veterans’ rights for many years. “I am truly honoured to receive a Field Knight honorary rank from the Order of St George Cascadia Priory,” said Burchell, in a statement. “Canadian veterans need all the help we can give them, especially when so many of them face difficulties and challenges in getting the financial, emotional and mental support they deserve from the Canadian government.”

HUNGLE, Leo Leo Hungle passed away on October 7th at the age of 73 from Parkinson’s Disease. He is lovingly remembered by his wife, Sharon Armstrong, son Cary Hungle (Shannon), daughter Lori Seeney (Matthew), their mother Debbie, and grandchildren Austin, Garrett, Cruz, Kelsey and Quinn. He will also be greatly missed by the Armstrong and Gentes family, Sean (Cheryl), Tory (Sheldon), Desiree, Ben, Kelli (Kyle), Jordan (Jarvis), Taylor, Braxton, Charlie and Jason. He was predeceased by his beloved mother Doreen, in 2006. Leo was born in Marathon, Ontario, growing up in the young town on the northern shore of Lake Superior, built around the pulp industry. As a teenager, his family moved west to Kamloops where Leo finished high school and, after losing his father quite young, worked in the pulp mill himself to fund his university education. Leo graduated from UBC Commerce in 1972 and then worked in Human Resources for a number of private and public sector companies and organizations before arriving at Vancouver Shipyards, then shortly after, Seaspan in 1981. For Leo, his family always came first. He was an always a proud, present, loving and supportive father to Cary and Lori. This delight extended in the same way later to his grandchildren: his greatest joy in retirement. Leo was very lucky to be able to retire early and was young enough to enjoy the early years with his grandchildren and take many great trips as a family, something he always liked to do. Among his greatly enjoyed family travels was RV camping in the 80s, which gave way to California beach trips in the 90s, and finally to a great love of cruises and travelling the world with Sharon after he retired in the early 2000s. During his career as the Director of Labour Relations at Seaspan, Leo was an effective and skilled negotiator, while always remaining rooted as a kind, ethical, and thoughtful leader in supporting employees when they accessed Human Resources. In his over 20 years with Seaspan, he was exceptionally proud of his role there. He witnessed tremendous growth in the company during that time and played a strong role in establishing positive working conditions and new labour contracts, particularly during the expansion into Victoria. A long-time resident of North Vancouver, and then New Westminster in retirement, Leo will be fondly remembered by all those who knew him. The many who have reached out over the course of Leo’s illness, particularly this last year, to visit, offer support, or share memories, are testament to how many lives Leo has touched over the years. The family would also like to extend a special thank you to the staff of Buchanan Lodge for their kind and compassionate care. A celebration will be held at a later date. Leo will be greatly missed.
