Painted-over Ukraine mural to be replaced Cornelia Naylor

A Burnaby construction company’s decision to paint over a mural supporting Ukraine sparked an angry response and calls to police last week. The mural, painted by local artist Jordan Malcolm on plywood construction hoarding at 5977 Wilson Ave., attracted media attention after it was defaced with anti-Ukrainian graffiti. After hours of work, Malcolm had finished a new mural by March 22, according to social media posts, but that work was painted over the following day. Police were called to the site (Bosa Properties’ new Central Park House condo project) on the morning of March 23, according to Burnaby RCMP. The detachment said a person called police and reported a man was on their property and yelling at an employee. “Upon arrival, police spoke to all parties and learned that the company had painted over a mural on their property after discovering it had been

defaced.This information upset the person that painted the mural. An argument ensued and police were called,” stated an RCMP email. The detachment said the situation was resolved on scene after “discussions with all involved parties” and no charges are being forwarded. Bosa has since told the NOW Malcolm threw yellow paint at the blue wall during the incident. “There was an element of safety for the people on site that weren’t feeling particularly safe on the ground at the time,” Bosa Properties vice-president Jen Riley said in an interview. Riley said Bosa had decided to paint over the mural because it didn’t want the construction barrier to be caught in a “cycle of vandalism.” Since the March 23 incident, however, she said the company has decided to open up the space as a “temporary community canvas” for Malcolm and other artists to express “respectful” and “positive” messages. stricted to Sundays when construction is shut down. But the company won’t put any restrictions on references to the war in Ukraine as long as they’re

not disrespectful or negative, according to Riley. She acknowledged Malcolm’s original murals had been positive and respectful.

When she was asked why the company didn’t simply leave them up, she said: “The difference now is we understand there’s

more support for what this means.Without understanding what was behind it, we were simply ensuring that we weren’t in a cycle of vandalism on the site.” Despite a number of news stories about the mural, Riley said Bosa hadn’t known who painted them until after the incident at the site on March 23. The company has since met with Malcolm and is working with him on the community canvas project, Riley said. The project will run until April 18, when artist Scott Sueme will begin work on a more permanent mural. Riley said one of the reasons the construction barrier had been left blank in the first place was that Bosa had already picked Sueme to put up a mural there. Since work on the Central Park House project is still in its early stages, Sueme’s work could be up for years, according to Riley. The NOW reached out to Malcolm for comment but did not hear back by presstime.

‘Incoherent’ man uses kettleball to smash up brewery Cornelia Naylor

A South Burnaby craft brewery has reopened after a man broke into the business this week and wreaked havoc inside with a kettlebell. A staff party at Studio Brewing, on the corner of Beresford Street and Daisy Avenue, had barely wrapped up on Sunday night, when an alarm called police to the business at about 12:30 a.m. Monday, according to general manager Kathryn McKinney. Two exterior windows

had been smashed, and the suspect was still inside when officers arrived, according to a Burnaby RCMP statement. Police said the 33-yearold man was “incoherent and acting unpredictably” and it took a struggle and a Taser to take him into custody. McKinney, who has watched the brewery’s security footage of the breakin, said the man had used a kettlebell to smash his way into the building and then destroy things inside, causing “tens of thousands of dollars” in damage. In one bathroom, she

said he smashed a mirror, a sink and a toilet. “He wasn’t here to steal anything. He was just here to destroy things,” she said.

McKinney said it was clear the man “wasn’t of

sound mind,” and the staff party had wrapped up just half an hour before he arrived. “We’re very, very thankful that he did not run into any of our team members,” she said. “It’s really scary.” McKinney said no one at the brewery recognized the man. Studio Brewing was closed Monday but was able to reopen by noon Tuesday – with plywood covering the smashed windows – since none of the brewing equipment had been damaged.

A 29-year-old man who pepper-sprayed a Burnaby Mountie before being arrested with help from a police dog’s bite last summer has been handed a two-month conditional sentence to be served at a drug-treatment facility and one year of probation. Yang-Ying NanWang pleaded guilty in January to assaulting a police officer with a weapon. He was sentenced Monday inVancouver provincial court. The charges date back to July 3, 2021. Just after 1 p.m. that day, Burnaby RCMP got a report of a pepper-spraying in the 4100 block of Dawson Street, according to agreed facts read out in court by Crown prosecutor Louise Gauld. A man had reportedly shot pepper spray in the direction of a Realtor showing some homes in the area.

After police arrived, an officer approached a man who matched the suspect description, Gauld said. The man then shot the bear spray in the officer’s direction before fleeing on foot. An extensive search ensued involving a police dog and a police helicopter, according to the facts. The man, later identified asWang, was eventually bitten on the lower leg by a police dog and arrested. Since being released on bail in July,Wang has been living at theVisionQuest drug treatment facility in Logan Lake, B.C. In a joint sentencing submission, Gauld and defence lawyer Chantal Paquette both called for a two-month conditional sentence, to be served at VisionQuest, followed by one year of probation. Gauld notedWang had been sentenced last April for robbery and had still been on probation on the day of the pepper-spray-

ing. Paquette saidWang had been in a state of drug-induced psychosis and “out of touch with reality” when he shot the pepper spray at the officer. She acknowledged Wang had a history of committing serious offences while under the influence of drugs but said her client has made “incredible progress” atVisionQuest. “He’s doing incredibly well. He recognizes how drugs have impacted his behaviour,” she said. B.C. provincial court Judge Laura Bakan accepted the joint submission. During his conditional sentence,Wang will have to stay atVisionQuest and abide by all the rules of that facility as well as a 10 p.m.-to-6 a.m. curfew. He is banned from contacting both of the people he deployed pepper spray at. He is also banned from possessing any weapons, including bear spray.

Community now Backyard chickens could soon be coming to Burnaby Jess Balzer

Chickens could soon be coming to more backyards across Burnaby. On March 22, the City of Burnaby’s social planning committee passed a recommendation that would pave the way for the keeping of backyard chickens.The committee has requested that council authorize staff to prepare amendments to the city’s zoning bylaw and animal control bylaw. If council approves the committee’s recommendation, that would be good news to nine-yearold Burnaby resident Luis Helmus, who appeared in front of the committee before the staff presentation on Tuesday and made his pitch as to why the city should allow backyard chickens.

Helmus said, during a PowerPoint presentation, that he has been doing tours of chicken coops to get a better idea of what they want and need. He noted chickens need a coop, like to be high off of the ground, lay their eggs in the dark and eat compost, food pellets and meal worms. “Farming seems fun,” he said. “Chickens lay eggs which are very nutritious, and they taste good. Chickens can be like a pet because they’re very cheap. Cats and dogs can cost thousands of dollars while chickens are just, like, $5.” He told the committee he thinks chickens are helpful because it means food is very close by, farmers can make more money and people can also learn responsibility. The issue of allow-

ing backyard chickens in Burnaby has been in the works for a couple of years. In June 2020, the social planning committee received correspondence, which included a petition with 173 signatures from residents wanting changes to city bylaws to allow backyard chickens. The committee sent the letter to staff and asked for a report outlining ways the city could support residents to produce more of their own food, including backyard chickens (for eggs). A new city staff report was provided to the committee with a proposed framework. Staff consulted with Fraser Health about the potential health risks relating to keeping backyard chickens, including mitigation measures.They have

consulted with the Ministry of Agriculture, Food and Fisheries, according to the report. This year, the ministry will require owners to register livestock, which would include poultry. “Ministry staff advised that this program is intended for large and small

scale livestock and hobby farms, including backyard chickens,” the report said. “There is no cost to register and obtain a premises ID number from the ministry.The responsibility will be on the owner to practise the safe and healthy keeping of chick-

ens, however, the ministry and local governments can facilitate risks by providing general regulations and educational resources.” The city also examined potential nuisances including pests, noise and odour with a Fraser Health medical health officer, the report states. “The review concluded that appropriate care, maintenance, sanitization and disposal of backyard chicken waste can reduce the potential of attracting pests and limiting noise and odour issues.” PROPOSED FRAMEWORK The proposed framework presented by city staff includes: ! Introduce/update definitions in the bylaws ! Only residents living in single-family dwellings are permitted to keep chickens as an accessory use

! Minimize the risk of predation through proper and secure coop construction ! Secure feed to eliminate the risk of pest intrusion and spoilage and attracting other animals ! Residents are permitted to keep a minimum of two chickens and not more than four ! Only hens (female chickens over the age of four months) are to be permitted ! No roosters are permitted ! No sale of eggs is permitted on the premises ! No slaughter of chickens is permitted on the premises ! Registration of chicken(s) with the Ministry of Agriculture B.C. Premises ID program is required ! Review the city’s information package on keeping of backyard chickens

Dish blocks man’s view

Dennis Morrel had a fabulous view from his Capitol Hill home until a neighbour decided to put up a 10-foot satellite dish on top of a rooftop balcony. Sticking above the roof line, the dish was a blot on the panorama of the North Shore Mountains and Burrard Inlet. Morrel complained to the city, but it turned out there was nothing in the bylaws to stop a person from blocking views with a dish protruding above their roof. But the city did inform the neighbour the dish needed a strong base.

Opinionnow Fix the doctor shortage Editor: As a retired 81-year-old relatively healthy male with a 79-year-old wife who has been unwell for some time, I implore the governent to make the doctor shortage concern the most serious problem we have in 2022. We, like many in the past, were blessed to have a family doctor here in New Westminster for over 30 years. At age 76 and somewhat unwell himself, he decided to retire. Like any business, I assumed that there would be a lineup of newly minted GPs ready to buy this ready-made 2,000-patient list together with a converted house for the office with unlimited street parking. But, alas, our doctor said there were no buyers at any price. So he closed up and sold the house. And I want to point out that he didn’t need the money. Apparently, graduating medical students knew that they could come into society, hang up their shingle anywhere and “cherry pick their patients.” And, alternately, they could simply join a “clinic,” work three to four days a week and go golfing. Great life, eh? They could also become specialists to reduce their hours while making more money, so not nearly enough GPs are coming through the system. Now I get to the root of the problem. So our doctor had no other doctors he could refer us to and suggested we pick out one of the

“clinics” and set up a “meet-and-greet” with one of their doctors, which we did. We met with a young doctor and set up a relationship through the clinic. Not knowing much about “walk-in clinics,” our new doctor, after one year, was overwhelmed. And we could clearly see that; however, he never rushed us at any appointment. But he left to become a hospitalist. At that point there were no other doctors at this clinic taking on new patients, so we were put on a “list.” In the interim, they assigned us a nurse practitioner. I had to take my wife into Royal Columbian Hospital on three occasions, and each time we were told that having a nurse practitioner was not suitable to look after my wife with her weak immune system and other specific illnesses. She needed a full-fledged doctor. So now, a few days later, we were called by another new doctor hired by the clinic to get the prescriptions. We asked if he could take us on as patients. He told us that he could not. Somehow, this clinic thing got out of control and simply does not work. They also have government quotas so many close their doors just after lunch. I guess they made their money. It can’t be cost-efficient for government when we pay for just a so-called telephone cure in just a few minutes. No face-to-face contact is simply unacceptable when it comes to your health. Bill Davis

Citynow Lawsuit filed over alleged counterfeit dumbbells Cornelia Naylor

In the fall of 2020, a customer walked into a Burnaby fitness equipment store and walked out with a set of adjustable dumbbells that would spark an international legal battle that has now entangled stores inVancouver, North Vancouver, Port Coquitlam, Surrey and Langley. The man bought the dumbbells at FitnessTown on Lougheed Highway, close to theVancouver border, according to B.C. Supreme Court documents. On Nov. 10, 2020, however, he contacted customer service at PowerBlock, an American company that makes adjustable dumbbells. “I just bought what I think are a pair of powerblocks from a Canadian fitness store called Fitness Town inVancouver,” stated his email, quoted in court documents. “However, once I got home I became suspect that they are knock-off versions.” In an ensuing email exchange, a PowerBlock representative asked the customer if he’d be willing to go back into the store and do a little snooping around. “Would you be able to go back into Fitness Town Burnaby and capture some photos?” the representative asked. “If this does go anywhere, you wouldn’t have to testify in any way, but we are just curious of the layout and stock displayed.We have PI’s going in, but our legal team needs to cover some tasks prior to entering, and we’d like to capture something before all product may be sold out.” The customer agreed to take videos of the store and to ship PowerBlock the adjustable dumbbells he had bought there. The PowerBlock representative then offered him his pick of PowerBlock products.

LAWSUIT Less than two months later, PowerBlock launched a lawsuit against Fitness Town for trademark violations, accusing the company of misleading the public into believing the “counterfeit goods” it had sold were genuine PowerBlock Dumbbells. The company claimed Fitness Town had “made a profit and been unjustly enriched” to the “deprivation” of PowerBlock, according to a notice of civil claim filed in B.C. Supreme Court. PowerBlock further accused Fitness Town of conspiring with unidentified other parties to get an unlawful and unfair competitive advantage over PowerBlock. It is suing Fitness Town for damages and for what it calls the business’s “wrongful gains” from the sale of the dumbbells. PowerBlock is also seeking court injunctions to stop Fitness Town from selling the alleged counterfeit dumbbells. In its response, Fitness Town – which has been an authorized PowerBlock distributor since as early as 2010 – denied PowerBlock’s allegations. James Newman (the sole director and officer of Fitness Town Inc., of which all the Lower Mainland Fitness Towns are whollyowned affiliates) has testified his company ordered various weights and other products, including adjustable kettlebells, from its supplier. Instead of the adjustable kettlebells, however, he said the supplier had sent adjustable dumbbells. He said Fitness Town decided to sell through the dumbbells and never order them again. “They were called Fitness Town Direct adjustable dumbbells, and he states instructions were given to store employees not to refer to them as PowerBlocks,” stated a

court ruling last week. ‘COMMERCIALLY SENSITIVE’ INFO Multiple applications have been filed in the case. In January, PowerBlock applied to the court for an order forcing Fitness Town to provide unredacted copies of a purchase order and invoice from Fitness Town’s Chinese supplier, Rizhao Land Sea Fitness Goods Co. Ltd, as well as unredacted copies of Fitness Town’s product sheet and sales receipts. Fitness Town argued the redacted purchase order, invoice and product sheet contained “confidential and commercially sensitive information.” It described PowerBlock’s application as a “fishing expedition” filed in the hope of finding evidence to support its sweeping allegations. Fitness Town also argued against releasing the redacted sales receipts. The company said it was concerned PowerBlock would offer those customers “improper incentives in order to solicit favourable evidence” as Fitness Town suggested PowerBlock had done with the original Burnaby customer. LATEST RULING In a ruling last Monday, however, B.C. Supreme Court Master John Bilawich ultimately ruled the customer information was “relevant and ought to be produced.” He also ordered Fitness Town to supply PowerBlock with non-redacted copies of the purchase order, invoice and product sheet. Bilawich called Fitness Town’s evidence about the commercial sensitivity of the redacted information “largely non-specific” and said the risk of disclosure could be mitigated with a specific confidentiality order if needed. The allegations of the two parties have not been proven in court.

An outpouring of affection has flooded the Facebook page of a Burnaby agricultural institution that has closed down after nearly 50 years. Hop On Farms at 5624 Marine Dr. provided fresh fruits, vegetables and flowers in South Burnaby, but it’s owners – the Hong family – have decided to retire. “After almost 50 years, Hop On Farms is sad to announce that we will not be re-opening this season and will be closing our store permanently,” reads a post on its Facebook page and website. “This was a very difficult decision, but the time has come for the backbones of our business to begin their long awaited and well-deserved retirement. Faced with many challenges over the years, we always managed to over-

When I was in Grade

6, I spent two weeks in Burnaby Hospital for a flare-up of rheumatoid arthritis.

I was feverish, covered in rashes and suffering from swollen painful joints; it was a frightening

experience for a child. I found great comfort from my nurses, pediatrician and familiar fam-

ily doctor who treated me as a whole person and not just my medical conditions.That’s when I knew I wanted to work in health care – to provide comfort to others in distress. After graduating from UBC 15 years later, and spending time with family doctors, I was immersed in the rich, moving stories of their patients. I recognized that these physicians had a perspective and approach unique among the specialties. You may have heard that primary care is longitudinal; we build mutual trust in relationships that can span a lifetime. In fact, the research of Barbara Starfield demonstrated that patients provided with good primary care have lower costs of care, improved access to appropriate health care and improved health outcomes. But your relationship with a family physician is also “latitudinal” with depth and breadth; our care is informed by our patients’ lived experience and we understand in the context of each whole life. Sadly, there is a serious shortage of family physicians across the country. I frequently hear from readers whose family doctors have moved or retired from practice.They are unable to find a new family doctor. Part of the reason is the increased stress associated with our work – par-

ticularly during the pandemic – with burnout rates among physicians at an all-time high. If you don’t have a family physician, it’s important that you know what screening tests you may have missed throughout the pandemic and recognize what symptoms do warrant medical attention. I’ll provide an update on adult screening tests that for many of us are long overdue and review the symptoms that should prompt a visit to your doctor.With this information, you could request an assessment with a physician at a walk-in or urgent and primary care clinic. A Burnaby couple’s persistence of 36 years finally paid off. Lana and Joery Leung are the latest winners of Lotto 6/49 after winning $6 million for the March 16 draw. They purchased their tickets at Lucky Mart on Nanaimo Street and East Seventh Avenue in Vancouver, where they have been buying their tickets from for years. “We got lucky that day,” Lana said during a news conference. The couple has played the same numbers, which are birthdays in their fam-

ily, for the past 36 years. They found out they won after their son had seen the winning numbers and asked if they’d bought tickets. “He found out someone from Vancouver won on Instagram, a few days after the draw,” Lana said. “He saw that they were our numbers, and he texted my husband to ask if he bought tickets for that draw.” Their son then came and asked them in person after his text message went unanswered. “He was mad and asked Joery while he was watching TV in bed,” Lana explained. “When we scanned the

ticket and saw the $6-million on the phone, we all started screaming and crying.” The Leung’s say they were planning on buying a new house before winning the lottery but now have changed their minds about leaving. “We can’t move now, because this is the house that we won the Lotto 6/49 jackpot in!” A news release says Lana plans to quit one of her two jobs while Joery will continue to work before they retire early. They also plan on buying their son a car and paying off their daughter’s mortgage.

Them bones, them bones, them … dense bones. For seniors, dense bones are essential to maintaining health and well-being. Our bones are constantly renewed through a natural process in which new bone cells replace old bone cells. As we age, however, this process becomes less efficient, and we begin to gradually lose bone tissue.This increases our risk for osteoporosis. The Healthlink BC website says that “osteoporosis is a disease that affects your bones. It means that you have bones that are thin and brittle with lots of holes inside them like a sponge.This makes them easy to break. Osteo-

porosis can lead to broken bones (fractures) in the hip, spine, and wrist.” According to Osteoporosis Canada, it is estimated that two million Canadians are affected by osteoporosis. Information provided by Osteoporosis Canada says people living with osteoporosis face a reduced quality of life, lowered self-esteem, reduction or loss of mobility, disfigurement, a lack of independence, and, in some cases, death – 28% of women and 37% of men who suffer a hip fracture will die within the following year. Unfortunately for women, we are twice as likely as men to break a bone because of osteoporosis. Research shows that while one in five men will

break a bone due to osteoporosis in their lifetime, at least one in three women will suffer a break. Women start with a lower bone density and lose bone mass more rapidly as they age. Others refer to bone deterioration as the “silent thief” because a person may not present any symptoms until they have a fracture, and by then the disease is already advanced. So, what can we do? The Public Health Agency of Canada says that “it is possible to prevent, delay or reduce bone loss through a healthy lifestyle. Assessing your risk for osteoporosis and related fractures can help you identify lifestyle factors that you can change.” Risk factors include be-

ing over 65, having a parent who had a hip fracture, being a smoker or drinking more than two units of alcohol per day on a consistent basis, being underweight or overweight, having bones which break because of a minor accident, having a spine fracture (usually detected by loss of height), and having low bone mass identified on an X-ray. A bone-healthy lifestyle includes regular exercise and physical activity, and ensuring that you get the necessary vitamins and minerals to prevent, delay and/or reduce bone loss. Also, you may want to get your doctor to recommend a bone density test, which can tell you how strong your bones are. Osteoporosis Canada advises routine bone den-

sity testing for all women and men who are age 65 or older. If you have a higher risk for fractures, it is best to start getting the test sooner. If you have been diagnosed with osteoporosis, it is important to reduce your risk of falling by making your home safer;

avoiding taking risks in the outdoors, especially during icy weather; and making sure you take care of your vision, hearing, and feet. Remember falls are the principal reason for injury-related hospitalizations among Canadian older adults.

Starting April 14, a free program – Choose to Move – that aims to get seniors active and moving is coming to Burnaby’s Cameron Recreation Centre. Based on scientific research by the University of British Columbia, this anti-aging initiative motivates and supports individuals 65 or older to move and stay connected with the community. Choose to Move aims to help seniors set and meet their physical activity goals by adding more movement to their daily lives. Participants will work one-on-one with a cer-

tified activity coach according to a customized fitness plan that works around their needs and skills.They will meet their coach regularly for checkins and guidance and connect with their peers for support. “Choose to Move is designed for those not currently active but want to get moving,” said Sue McIntyre, senior program coordinator at Cameron Recreation Centre. “It is different from other fitness programs because it is choice-based. Participants choose the activities that interest them.” Choose to Move is offered across British Co-

lumbia, with the support of the BC Ministry of Health, Active Aging Society, UBC’s Active Aging Research Team, and British Columbia Recreation and Parks Association. Researchers will monitor the Choose to Move program across the province and evaluate its impact on seniors’ health, mobility, and social connectedness. Travel and tech support scams top BBB report Different scams work with different age groups, Better Business Bureau report shows The Better Business Bureau released its report of the riskiest scams in North America – split into age groups. The report comes in March during Fraud Prevention Month. Here’s the breakdown: AGES 24 TO 64 ! online purchase scams ! cryptocurrency scams ! employment scams In 2021, cryptocurrency was the number 1 top riskiest scam in Canada, the second riskiest in North America and the second riskiest across the 25 to 64 age group. In Canada, it had a high susceptibility rate, at 69.6%, and the largest median dollar loss at $1,500 CAD – versus 66.2 % and $1,200 USD across North America. In speaking with victims, they shared that they fell for these scams because they seemed like an easy way to invest, promised extremely attractive returns and because the financial strain caused by the pandemic made them want to find other ways to make money. Employment scams

were second riskiest for ages 18 to 24 and third riskiest for ages 25 to 44 and 55 to 64, which may have to do with many experiencing job changes or looking for work throughout the pandemic. AGES 45 TO 54 ! online purchase scams ! cryptocurrency scams ! home improvement scams According to the 2021 BBB Canadian Risk Report, home-improvement scams had a high susceptibility rate at 63%, with consumers losing a median average of $661. Home improvement scams can start with a knock on the door, a flyer or an ad.The contractor may offer a low price or a short timeframe. Once started, a rogue contractor may “find” issues in the project that significantly raise the price. If you object, they may threaten to walk away and leave a half-finished project. Or they may accept your deposit and then never return to do the job. AGES 65+ ! Online purchase scams

Unfortunately, seniors often make good targets for scammers. Factors such as being alone, spending more time at home, having large savings and loss of mental sharpness make seniors vulnerable to scams. In 2021, seniors 65+ lost more money to scams than they did in 2020. It is important that at any age, consumers remain vigilant and do their due diligence when deciding on a purchase, big or small. A quiet but extremely loyal and kind man, he was most happy spending time with his family, watching sports or helping Anna with various projects around the house.
