A Burnaby man whose COVID 19 vaccine ex emption papers proved mostly useless for getting into events and businesses during B C ’s vaccine man dates has failed to convince a B C Supreme Court judge the province’s public health orders were uncon stitutional

William Robertson Pren diville, a Burnaby hiking guide who also works in building operations, and two other petitioners ap plied to the court to have a series of public health or ders dating from Sept 13, 2021 declared unconstitu tional and contrary to Can ada’s Charter of Rights and Freedoms, according to a ruling last week.

Woman handed suspended sentence for money she stole from Paladin Security by writing bogus cheques

A payroll administrator who defrauded a Burnaby security company of nearly $35,000 has been handed a six month suspended sentence and ordered to pay back half the money Surrey resident Alecia Cruz, 29, pleaded guilty in June to one count of fraud over $5,000 in relation to a series of bogus cheques she wrote between June 7 and Dec 23 in 2019 while she was a payroll and ben efits administrator at Pal adin Security, according to facts presented inVan couver provincial court on Sept 15 Cruz had worked at the company for several months

“After she left, the com pany discovered that she had generated 35 che ques totalling $34,566 60, where she had altered the payee to her co accused partner’s name, Joel Mor

gan,” Crown prosecutor Elise McCormick said Morgan, who has also pleaded guilty in the case but hasn’t been sentenced, was Cruz’s common law partner, according to Mc Cormick

Bank records later showed Morgan had cashed the cheques, kept some of the money and given some to Cruz In a joint submission, McCormick and de fence lawyer Adrian Pi

card called for a six month sentence to be served in the community as well as a restitution order in the amount of $17,283 30 Picard said Cruz had gotten into debt and was also supporting Morgan,

who is now 35 years old, at the time of the fraud

B C provincial court Judge Patricia Stark ac cepted the joint submis sion

The most egregious part of the crime, she said, was

that Cruz had been in a position of trust at Pala din.

“That company not only gave you employ ment, they trusted you You had access to funds and you took them, and you took a lot ” Stark said to Cruz.

But Stark also noted Cruz didn’t have a prior criminal record, had taken responsibility for her ac tions, was prepared to make amends and was a good candidate for reha bilitation

Stark also noted the fraud scheme hadn’t been a sophisticated one

“It was obviously and inevitably easy to discover and to trace, and that’s what happened,” she said

During her sentence, Cruz will be subject to a 9 p m to 6 a m curfew and other conditions

Morgan’s sentencing is scheduled for Oct 12 inVancouver provincial court

orders in general but rather the province’s “al leged unconstitutional failure to provide an ef fective, comprehensive and accessible regime for medical exemptions ”

Prendiville got his first COVID 19 vaccination, a Pfizer shot, on May 18, 2021 but began experi encing chest pain in the days that followed Ten days later, he was unable to breathe without assis tance, according to the ruling

“He was taken to hos pital and was advised that he was fighting for his life,” the ruling states

A cardiologist deter mined Prendiville had ex perienced an adverse re action to the COVID 19

vaccine and developed pericarditis He was told to avoid further COVID 19 vaccines.

His doctor submitted a COVID 19 vaccine med ical deferral form request to the office of the pro vincial health officer for Prendiville, and they is sued him a medical ex emption certificate

But Prendiville told the court his attempts to use the official paper largely failed

“He deposed that he has been turned away from the majority of busi nesses he attempted to ac cess utilizing the exemp tion certificate, and that store owners and facility managers to whom he has presented the exemption certificate have repeatedly

accused him of forging the document, stated they had never heard of anyone receiving such an exemp tion, told him to leave the premises, and refused him entry based on his vacci nation status,” states the ruling “Mr Prendiville

deposed that even busi nesses that granted him access with his exemption certificate did so inconsis tently He said that staff members would occasion ally ask him numerous questions about his per sonal medical conditions

before granting him ac cess or would simply de cide that they could not let him in because they were unfamiliar with the document ”

The province and pro vincial health officer ar gued the petition should be tossed, especially given that the health orders in question are no longer in effect, making the petition moot.

But Hinkson noted the province and PHO “could offer no assurance” the orders would not be rein troduced if COVID cases surged

In the end, however, Hinkson ruled to dismiss the petition

He said any harm Pren diville suffered “was not a result of anything done or

not done by the respon dents ”

“While he has encoun tered less than full accep tance of his temporary de ferral by businesses he has attempted to patronize, I am unable to find that this is the fault of the respon dents,” Hinkson said “In deed, the Province cannot be held responsible for the implementation of the Or ders by private businesses, nor can private businesses violate an individual’s Charter rights ”

As for Prendiville’s co petitioners, Hinkson ruled they had not fol lowed through on all the “available statutory rem edies” available to them, so their petition was pre mature

Poilievre faces an uphill battle

Now comes the heavy lifting for newly crowned Conservative Party leader Pierre Poilievre

Winning his party’s lead ership was a breeze Win ning over enough mem bers of the general voting public to form government is an entirely different task, and surely a much more difficult one

But make no mistake

Poilievre has instantly made the Conservatives competitive enough to worry the JustinTrudeau led Liberal Party, which has faced two weak chal lengers (Andrew Scheer and Erin O’Toole) in the last two elections

One of Poilievre’s big gest strengths is his abil ity as a communicator The trick for him now is to em ploy that skill talking about the issues that will resonate with voters who have not voted for his party in re cent elections.

During his leadership campaign, Poilievre spent much of his time talking about fringe issues such as vaccine mandates, the Bank of Canada governor, cryptocurrency and the World Economic Forum

He also willingly associ ated with extremists, or at least refused to disassociate himself from them

While this approach ob viously worked well in the leadership race, it is un likely to gain the same traction with the general voting public, particularly in urban areas where most electoral ridings are lo cated

However, if Poilievre can pivot and make such issues as affordability, tax ation and housing his top priorities, he may catch lightning in a bottle Many commentators think he will also mine the immi grant vote as both Liberal and Conservative govern ments successfully did in the past.

Working to his advan tage is that theTrudeau government’s best before date has likely expired

The prime minister’s own popularity has sunk to his toric lows, and it will be a challenge to rebuild his brand

Of course, the Liberals (and the NDP) will exploit and use Poilievre’s vulner abilities to the hilt

They will brand him as an extremist who refuses to distance himself from far right extremists like Jer emy McKenzie and James Topp They will paint him as the Canadian version of DonaldTrump, with all the distasteful and offen sive imagery and rhetoric that is associated with the former U.S. president.

Their inevitable attacks may get a rise out of Poi lievre and cause him to overreach or play into claims that he is wannabe demagogue who is not particularly supportive of democracy

It will be interesting to see if Poilievre continues his practice of not only ig noring the media, but pre ferring to attack it as one of the so called “gatekeepers” he likes to label what he calls the elite ruling class of Canada (the irony of mov ing himself and his family into the taxpayer funded Stornoway mansion be cause as Opposition leader he can do that appears to be lost on him).

Finally, it is far from clear whether Poilievre can keep any momentum go ing over the next several years before the next elec tion comes into view

The Conservative lead ership race by then will be a distant memory, as will trucker convoys, anti vax rallies and vaccine man dates

People may tire of his angry negativism and abra sive populism Or, perhaps they may warm to it

In any event, Cana dian politics has entered a new phase We’ll see if Pol lievre can expand his reach beyond a single political party

Councillors were disappointed the AG rejected their offer, but the province said the closure would save $2 million a year

Time to consider tax credits as remedy for doctor shortage

Editor: When I read about the family doctor shortage, and how the only option appears to be asking the federal government for more funding to pay doctors more, I can’t help but wonder whether other options are available to us at the community and provincial levels. At the civic level, can we not look at giving a property tax rebate to family doctors’ offices? What if those mass developments at Brent wood, Lougheed and Metrotown were to offer a rent rebate to family doctors?

Last but not least, what if the province were to offer a non refundable tax credit for MSP billing codes related to family doctor services?

Rather than passing the blame and respon sibility to a higher level of government, there may be potential options available to civic and provincial governments, and even to devel opers to make it more affordable for family doctors to set up shop here

2022 ANNUAL TAX SALE

The Local Government Act Sec. 645(1) states “At 10:00am on the last Monday in September, at the council chambers, the collector must conduct the annual tax sale by offering for sale by public auction each parcel of real property on which taxes are delinquent.”

A community music program in Burnaby has received a big boost $10,000, to be exact

Harmony for All, started by Coun Joe Keithley, helps residents who can’t afford musical instruments and lessons or who expe rience barriers to partici pation

The initiative aims to connect people through music, promote positive in teractions and build stron ger communities.

Instruments include acoustic guitars, electric guitars and basses with amplifiers, drum kits, uku leles, saxophones, key boards and synthesizers, clarinets, flutes, trumpets, trombones, violins and ac

In a social media post on Sept 14, Keithley is hold ing up a $10,000 cheque with members of the Burn aby Firefighters Charitable Society

“Great news: just picked up a $10,000 donation from the Burnaby Fire fighters Charitable Asso

ciation that will go to the music charity Harmony for All that I started,” he wrote

“This charity gets musi cal instruments and lessons to those in Burnaby that otherwise would not have the opportunity Here I am at Firehall #3 getting the cheque, thanks so much ”

The first residents of the City of Lougheed in Burnaby have moved into their new homes

On Sept 1, about 60 residents moved into the rental tower next to Lougheed Mall, one of four towers that make up the first phase of the 37 acre development

The four towers of “Neighbourhood One,” developed by Shape Prop erties, span from 31 to 57 storeys high

Condo units make up three of the towers; the fourth is made up entirely of 237 rental units

The move in on the rental tower is a milestone for Shape and the com munity, according to ex

“We’re incredibly ex cited to actually have res idents onsite and starting to build up communities,” Tullis said.

The rental tower move in is happening in phases throughout the rest of 2022

SFU students celebrate approval of gondola project

After years of student advocacy, the gondola to Simon Fraser University has been approved

The Simon Fraser Stu dent Society is revelling in the victory

“It would not be an un derstatement to say that this is probably the big gest accomplishment of student activists of the de cade,” said Gabe Liosis, former president of the SFSS

The gondola will re place the 145 bus, which currently operates ev ery five minutes during peak periods and moves about 1,000 passengers per hour

TransLink estimated the gondola will move

about 3,100 passengers per hour per direction

TransLink has bud geted an estimated $210 million for the project, which will have an annual operating cost of $5.6 mil lion

TRANSPORT NEEDS

Liosis said post second ary students are struggling not only with rent prices and the pandemic, but also with transportation, which is a huge barrier to accessing education

He said the Ma ple Ridge school district found a a high gradua tion rate from high school but low transition rates to post secondary and that a major factor was a lack of accessible and ef fective transportation

“This is a transit project that is going to drastically improve the quality of life for students now and for

generations to come,” Li osis said

Current SFSS presi dent, Helen Sofia Pa hou, said an SFSS report found that 80 per cent of students regularly use transportation to com

mute to school Osob Mohamed, an SFU alumna who advo cated for the gondola with SFSS, said the 145 bus was the “bane of (her) ex istence.”

Both Pahou and Mo hamed noted the ten dency of the large 145 bus to get stuck during the snowy winters on the mountain

“Year after year, differ ent student activists have wanted to pick (the gon dola project) up, because they all recognize the level of change that it’ll make for the community,” Lio sis told the NOW

SFU’s president Joy Johnson said the level of student engagement was exciting.

“It’s really had continu ity, which is given the

[student] turnover, quite unusual,” Johnson told the NOW

“When our 37,000 strong students advocate for a particu lar issue, there’s a lot of strength behind that,” Johnson said at the press conference

“And so I do want to take the time to thank our students for their ad vocacy on this on this project It’s really been incredible,” she contin ued, noting that stu dents signed petitions, held open houses, distrib uted pamphlets, presented toTransLink’s Mayors’ Council and spoke with involved communities

“You have demon strated the power of civil activism,” Johnson told the students

There’s no relief in sight when it comes to rental prices in Burnaby

According to Rentals. ca’s September report, av erages for both one and two bedroom rentals av eraged more than $2,000 per month in August $2,146 and $2,553 re spectively.

One bedroom rent als increased 6 8 per cent between July and August and 21 6 per cent from the same months in 2021

Two bedroom suites have decreased 6 9 per cent during the past month and are up nine per cent in the past year.

B C has the highest av erage rental rate in the country at $2,578 last month

“There continues to

be outsized rent growth in Canada, with the aver age listing on Rentals ca nearly $200 more expen sive than a year ago,” the report says “The total number of listings on Rentals.ca is higher than one year ago, and the average listing is getting 38 per cent more pageviews, suggesting sig nificantly more demand than last year This year’s listings received almost 70 per cent more pageviews than the pandemic im pacted August 2020 fig ures.”

“With another interest rate hike from the Bank of Canada, potential buy ers are further dissuaded from purchasing, send ing more demand into the rental market.The hikes are having a negative im pact on job growth, which could keep rents in check if young Canadians find themselves jobless ”

The Real Estate Board of GreaterVancouver’s

(REBGV) August re port confirms the drop in house purchases as inter est rates rise.

The REBGV said 1,870 sales were completed last month, which is a 40.7 per cent drop compared with the 3,152 sales in August 2021

This year’s August total equates to a 0.9 per cent decrease compared with the 1,887 homes sold in July 2022

“With inflationary pressure and interest rates on the rise, home buyer and seller activity shifted below our long

term seasonal averages this summer,” REBGV spokesperson Andrew Lis said in a Sept 2 release “This shift in market conditions caused prices to edge down over the past four months.”

As of last month, Burn aby East saw a bench mark price of $1,109,000 (down 3.9 per cent com pared with July of this year) for residential/com posite homes.

Burnaby North recorded a benchmark price of $1,012,200 ( down 3.7 per cent com pared with July) while Burnaby South held a benchmark price of $1,092,900 (down seven per cent compared with July)

Burnaby North saw a benchmark price of $1,962,000 in August (down 5.5 per cent com pared with July) for sin gle family detached homes

Burnaby South was

over two million at $2,105,200 (down 0 2 per cent compared with July) and Burnaby East’s benchpark price was $1,130,000 (down 4 2 per cent compared with July )

Townhomes also saw drops in all three Burn aby regions with Burn aby South at a benchmark price of $964,300 (down 2 6 per cent compared with July of this year)

Burnaby East was recorded at $876,000 (down three per cent compared with July) and Burnaby North hit a benchmark price of $930,400 (down 1 3 per cent compared with July.)

Four more lives were lost in Burnaby to illicit drugs in July

The latest B C Coro ners Service report shows the city’s total has risen to 38 to date in 2022

In all of 2021, a record 77 deaths were tallied in Burnaby

Provincially, toxic illicit drugs claimed 192 lives in July, which represents a 31 per cent increase in deaths compared to June of this year (147) Nearly 1,300 people have died in 2022, which is a record for the first seven months of a cal endar year

The number of illicit drug toxicity deaths in July equates to roughly 6 2 deaths per day

“As they have for the past seven years, these numbers reflect the ev er present threat that il licit drugs pose to sub stance users across B.C.,” B C chief coroner Lisa Lapointe said in a news re lease.

“The unregulated drug market continues to be volatile and toxic, and anyone using drugs pur chased from illicit suppli ers is at high risk for se rious harm or death.We continue to urge those us ing illicit drugs to access drug checking services, where available, or visit overdose prevention sites, where available ”

The Lillooet, Mission, Terrace, Cariboo/Chilco tin and Powell River local health areas have the high est reported rates of death

The BC Coroners Ser vice says drug toxicity is the leading cause of unnat ural death in the province “In July of this year, we lost 192 lives to the poisoned drug supply These were our neigh

bours, friends, family and members of our commu nity.These are terrible losses,” Minister of Men tal Health and Addictions Sheila Malcolmson said in a statement.

“This week, as I meet

municipal leaders from throughout the province, I am grateful for those who have used the tools local governments have to help end the poisoned drug cri sis and prevent loss of life This crisis has hit all com munities in our province. Everyone has been af fected

“Since 2017, we’ve been working urgently to build a system of mental health and substance use care that works for everyone. In the past five years, we’ve opened more than 300 new adult and youth treat ment and recovery beds. More than 3,200 treat ment beds are available in British Columbia.

“The street drug sup ply continues to be terri bly, increasingly toxic In the first months of 2020,

the concentration of fenta nyl detected in illicit drug deaths was between four per cent and 8 per cent In July 2022, it increased to 23 per cent.That is why we continue to ex pand much needed harm reduction services, par ticularly safe supply and inhalation overdose pre vention sites, and we are leading the country on de criminalization of people who use drugs

Studio welcomes back young dancers

Burnaby non profit brings back programs for dancers aged 6 to 18 Communitynow

After a successful free eight week run in April, non profit Burnaby dance studio Dance Imagination opens its doors for kids ea ger to groove this month

The studio was hoping to celebrate its 30th anni versary in a grand fashion, until COVID 19 rained on its parade With classes moving online and outside the studio, Chris LePage, the co artistic director, is thrilled to bring back the kids to the studio

Children and teen agers between the ages of six and 18 can register for modern dance classes at different levels that run from this month to June 2023

The dance studio has

produced noteworthy per formers over the years who have gone on to perform around the world Studio organizers are hoping to help foster another gener ation of dancers after the two year pandemic hiatus

Unlike many dance as sociations that groom their young students for compe titions, Creative Dance As sociation’s primary goal is performance oriented and stays away from “competi tive” spirit.

The full year program begins on Sept 26 and will end in a special June 2023 showcase at the Shadbolt Centre

The studio is encour aging children and teens to put their best dancing foot forward as it opens its doors to dancers of all lev els of experience, through

registration on its website.

Whimsy, humour and upcycled garbage join forces to deliver a serious message about climate change in a new exhibi tion at Deer Lake Gallery

Members of ReVision: The Art of Recycling are holding a group show at the gallery starting tonight (Thursday, Sept. 22).

The works of 23 artists reflect diverse approaches to upcycling waste ma terials in order to create messages of engagement and hope The theme of the exhibition is Make Art Fun Again, with a focus on positive change as art ists speak out on the envi ronment

It includes an interac tive play zone to let visi tors get actively involved with the work

The show is curated by Burnaby Arts Council

Donations to cleat drive can be dropped off at select City of Burnaby facilities until Oct.10.

The Indigenous led non profit Hope and Health, which supports Indigenous children and youth who face barri ers to sports programs, is partnering with the City of Burnaby to collect do nations of new and lightly used soccer cleats

According to Hope and Health, many Indigenous youth can experience ob stacles to participating in sports, such as racism and economic barriers

The non profit cites academic research find ing that participation in sports leads to a variety of benefits for children, in

cluding better youth men tal health, more opportu nities to gain social skills and build positive rela tionships

Sports participation also reduces the risk of depression and addictive behaviours.

The City of Burnaby is collecting the cleats for Hope and Health’s Boot it Forward program, and has also encouraged resi dents to make a financial contribution to the Boot it Forward program

The non profit said it has distributed more than 750 cleats this year.

Burnaby man, 65, missing since Sept. 15; family ‘very concerned’

Police in Burnaby are continuing their search for 65 year old RajeshVerma, who went missing last week

Verma was last seen by family in the 8800 block of Armstrong Avenue at about 3:30 p m on Sept 15, according to a Burn aby RCMP news release

The investigation has led police to zero in on a specific time and area in NewWestminster, accord ing to the release.

Police are asking any one who saw or interacted withVerma in the area be tween Sapperton Landing Park andWestminster Pier Park on Sept 15 between 4 p m and 6 p m to con tact Burnaby RCMP.

“Our investigators are looking for any indicators of Rajesh’s demeanour and what direction he may have travelled,” Burnaby Cpl Mike Kalanj said
