A North Burnaby strata has prevailed in a fight over who’s allowed access to the building’s discarded beverage containers
Jason Reddy co owns a Brentwood condo in the Escala at 1788 Gilmore Ave , according to a Sept 29 ruling by the Civil Res olutionTribunal.
Reddy took the build ing’s strata council to the tribunal over a $200 tow ing bill, arguing the strata had improperly towed his vehicle from a visitor’s parking spot
He also appealed to the tribunal for an order com pelling the strata not to lock up its bins for dis carded returnable bever age containers.
Reddy argued he is en titled to collect empties thrown into the recycling bins in the strata’s com mon property garbage room, but the strata said it has enacted a rule to make returnable bever
age containers the strata’s property
“Once you place a re fundable beverage con tainer in any such desig nated bin it becomes the property of the strata and cannot be removed
without the written con sent from the strata coun cil,” the rule states “Any unauthorized removal of a refundable beverage con tainer will be considered theft and reported to the RCMP”
The strata told the tri bunal a designated strata owner empties the bins based on an agreement with the strata, and par tial proceeds from the re funds are donated to char ity, but tribunal vice chair
J Garth Cambrey noted a copy of the agreement had not been provided for evidence.
Cambrey ultimately dis missed Reddy’s dispute, ruling the strata under the Strata Property Act
has the discretion to make rules “governing the use, safety and condition of the common property and common assets ”
The CRT is an online, quasi judicial tribunal that hears strata property dis putes of any amount and small claims disputes of $5,000 and less
candidates in this month’s municipal election, ques tioned whether the BCA had lived up to that com mitment
The party tweeted two photos of Mikelle Sasa kamoose (one of her with federal NDP Leader Jag meet Singh) and another photo of BCA members at an event with MLA and BC NDP leadership can didate David Eby
The tweet said the pho tos appeared to show the BCA campaigning on Truth and Reconciliation Day.

The suggestion she was campaigning on Sept 30 after encouraging oth ers to mark the day in a meaningful way was “of fensive,” she said
“I couldn’t just sol emnly commemorate that day and spend a beautiful day with my children, but now I have to defend my self and my community against lies,” she said
‘REASONABLE QUESTION’
One Burnaby campaign manager Kit Sauder said the photos in the tweet had been sent to the party on Sept. 30 by “a citizen” who told them they’d been taken that day
“An existing political organization that’s gov erned the city for more than three decades made a public commitment to not campaign on the National Day of Truth and Recon ciliation Photos were pro vided with the implica tion that they were, in fact, campaigning,” he said.
When asked whether One Burnaby had checked where the photos had come from, Sauder said
the party had “asked where they’d gotten them” and looked at what was in the photos
“The school board can didate has an Every Child Matters t shirt on, and so we feel that it’s a perfectly reasonable question to ask of the campaign,” he said When asked if he was satisfied with how much One Burnaby had re searched the source of the photos before posting the tweet, Sauder said:
“The campaign stands by the fact that we believe that it was a reasonable question to ask and that it’s the onus of the BCA to respond ”
For Sasakamoose, how
ever, the matter goes be yond campaigns.
“This is not about an election for me,” she said “For me, this is personal, this is who I am, this is my community You can’t triv ialize the trauma of an en tire community for some thing like that That’s not right. Regardless of whether there’s an elec tion Whatever is going on, that’s not right If we’re go ing to advance to reconcili ation, then people can’t do things like that ”
Saskamoose released a statement about the inci dent Friday afternoon, and the BCA is now calling for an apology from One Burnaby

BC NDP on defensive over crime MY VIEW KEITH BALDREY
It is not often that crime and public safety sur faces as a top of mind issue with the public, but that is what seems to have happened in recent weeks.
And that is potentially bad news for the BC NDP gov ernment, which has shown a curious inconsistency when it comes to tackling street crime In fact, it is conflicted with opposite views from within government on just how bad the problem has become
The first few question periods of the fall legisla ture session had the NDP back on its heels as the Opposition BC Liberals sensed a vulnerability on the ruling side We have not seen that dynamic very often since the NDP took power
in 2017.
Taking a tough stance on crime is a better fit for the BC Liberals, who have coined their own pet phrase (“catch and release”) to describe the seemingly revolving door of chronic offenders who com mit violent crimes and then are released back into their community in relatively short time
The NDP has bristled at this approach Premier John Horgan has accused the BC Liberals of coming up with “bumper sticker slogans” and nothing else to solve the problem but it seems to be effective, even if it can be misleading All of which brings us to the seemingly contradictory views of the problem held within government
On the one hand, assis tant deputy attorney general Peter Juk (he is responsible for the prosecution service) recently released a sev en page letter suggesting problems in the justice sys tem were nowhere near as bad as recent accounts and criticisms would suggest
That is all well and good But then the government commissioned its own re port from a former police chief and university profes sor and it came to almost the opposite assessment.
The authors, Doug LePard and Amanda Butler, concluded there is a serious lack of resources in the pros ecutorial side of the system and there is not enough con sultation with police when it comes to dealing with re
peated offenders and people with complex issues
While overall crime rates may be lower, the authors found that “violent” crime rates are up sharply, par ticularly in Vancouver and Victoria, where random stranger assaults are up a whopping 35 per cent from a few years ago
I get the sense the gov ernment is leaning towards LePard and Butler’s take on things But the proof of that will be revealed in next spring’s budget.
Given the whole issue has given the government pause, I’ll bet on some changes coming
Goodness knows the sta tus quo is not working

Swim BC pays tribute to Simon Fraser Aquatics
Editor: Burnaby based Simon Fraser Aquatics, known as SFA, is the small club that made it to the top.
After restructuring in 2018 and starting off with nine competitive swimmers it has grown to over 130 swimmers of all levels, ranging in age from nine and up.
On Oct 1 Simon Fraser Aquatics was selected by Swim BC as Club of the Year for the 2021 22 season Head coach Ryan Skomorowski accepted the award on Oct. 1 during the Swim BC conference held in Whistler
The club is very proud of all the swimmers who have been competing at divisional, provincial and national level championships. In accept ing the award, head coach Ryan Skomorowski said, “This award is the result of all the hard work from the coaches, swimmers and parents who have dedicated themselves to the world of competitive swimming”
The award is based on many factors but in cludes ranking at various levels of competition, increasing club membership base, registration of swim officials (parent volunteers) and the number of national qualifiers from the club
The competitive swim season starts Oct 8 with Simon Fraser Aquatics dedicated to continuing

the high level of performance, coaching and volunteer work that allowed the club to win this award.
We need to keep our youth engaged and train ing for the upcoming season The only issue we face is the lack of available pool time now that C.G. Brown pool is slated for demolition to make way for the new Olympic pool as its replacement We are working with the City of Burnaby to address these issues

Bystanders used their hands to dig out driv ers whose vehicles were covered by a load of dirt from a flipped dump truck trailer the afternoon of Oct 5, according to the Burnaby Fire Depart ment.
Emergency crews were called to the area of Grandview Highway and Boundary Road, less than 50 metres inside the Burnaby border, just after 5:30 p.m., according to assistant fire Chief Mark

“A dump truck that was coming northbound on Boundary ended up trying to round the corner onto Grandview Highway it was a tandem and the trailer section tipped,” Forsberg told the NOW “The full load of dirt ended up going onto on coming vehicles ”
The trailer itself didn’t make contact with the westbound vehicles, but the weight of the lost load was enough to inflict “pretty good damage,” according to Forsberg, with a Mercedes cross
over taking the brunt of the haul
“When our crew ar rived, our initial arriv ing crew, they said that there were pedestrians that were actually digging some of the vehicles out by hand,” Forsberg said
Four people were trans ported to hospital in sta ble condition, according to BC Emergency Health Services.
City works crews were called in to help clean up the mess, and traffic was impacted for hours, Fors berg said

For Burnaby photogra pher Barbara Lynn Pol lard, picking up a camera offered a way to refocus her life, giving her a means to get through her panic attack episodes
“When you have so cial anxiety and you have a general anxiety sort of like I have, there are situations that I come across that I find very daunting,” Pol lard said “The camera is a way for me to step back, bring up to my face, fo cus it and breathe through situations that I find very challenging.”

Growing up in an ar tistic family, she said that she had always been able to appreciate and recog nize art She gets a partic ular joy, she said, in wit nessing art that vibrantly fills spaces that would oth erwise be blank concrete walls She loves to cap ture these fleeting artworks before they are removed or covered over because “the graffiti is something that gets destroyed or cov
ered over or removed quite quickly in the city”
Pollard got her first camera when she was 10 years old; it was a way to keep her occupied during a family trip to the Mon treal Olympics.
Her first photos were of family members, historical places and monuments. But Pollard’s photogra phy has evolved much over time
“I would look for things that were more interesting to me, like writings on a wall or a drawing on a wall or something that caught my eye, like a colour,” she said “Or old, like old barns, old farm equip ment, things that have a history
“In all my photography, whether it’s something historical or whether it’s someone else’s art that I’m recording for perpetuity,
there will always be some sort of historical record of it ”
Pollard noted that graf fiti is a polarizing subject. While some value it as art, many people think of it as vandalism
For her, it’s a form of creative expression “It often speaks to what the art is,” she said. “It is someone’s creativity And it also reflects someone’s life and someone’s pain, depending on what they put on the wall So it’s sort of someone’s personal journey. Some people do art for healing, some peo
ple do art to express them selves and it’s all about perspective ”
Pollard served as an arts administrator for over 40 years, but a stomach can cer diagnosis four years ago left her re evaluating her life.
“When you are faced with the possibility of no longer being alive because you’re ill, it’s kind of a re awakening, in a way, so it’s about reworking a cycle of life, living your life to the fullest and finding the rea sons why you need to live your life to the fullest
“I find that reflected in
my work a lot as well I’m looking for that regenera tion ”
The pandemic was also a deciding factor in prompting her to switch careers, she explained Af ter theVancouver Interna tional Dance Festival was closed down, she mulled a transition to health care as she recovered from a third cancer surgery.
However, the time away from full time career in the arts has given the photog rapher a chance to appre ciate art in a new way, al lowing her to look at her art more objectively and
consider a new direction
“It’s given me a clearer understanding of of my time and where I want to focus my goals and my artistic dreams,” she said. “When I was work ing in the arts, it was of ten 14 to 16 hour days where I didn’t have time to take time for myself in my own art It’s given me an opportunity to go back through my hundreds of thousands of digital files and look at old pictures and decide what to do with them and how I want to go forward ”
Her work will be dis played during the sixth an nualVancouver Outsider Arts festival, which runs this weekend from Oct. 14 to 16 at Roundhouse Community Arts and Rec reation Centre
Pollard hopes people can visit the festival, get engaged with the art and support it.

The B.C. Liquor Dis tribution Branch’s (BCLDB) second local shop, which is the largest between the two, opened in Brentwood shopping centre on Oct 6
“This is the second gov ernment run, non medi cal cannabis store to open in Burnaby and the fifth to open in MetroVan couver after Port Coquit lam, NewWestminster and NorthVancouver,” said Kevin Satterfield, the BCLDB’s director of cannabis retail operations.

It’s election season but how easy is it to vote in Burnaby?
A Burnaby resident struggled to find the vot ing station at the Amazing Brentwood when she cast her ballot on the Oct. 1 advance voting day
The city’s chief elec tion officer, Lynne Axford, told the Burnaby NOW in an emailed statement that the mall provides a vot ing location to the city at no charge, as it has in past elections
The location in the mall changes from election to election depending on space availability
“Due to mall policy, we are limited in the informa tion we can hand out and
display in the mall,” Ax ford wrote
“However, upon hear ing concerns from a res ident, we have discussed the matter with mall man agement, and they have agreed to allow limited ad ditional signage and en sure information kiosk staff are providing direc tions and maps to anyone
asking about the voting lo cation ”
Axford said the city is working to improve ac cess to the voting location at Brentwood for general voting day on Oct 15

The City of Burnaby is looking to add side walks on Merritt Avenue in southeast Burnaby, but a local business has con cerns about the project Rhonda Lee book

Lee said sidewalks aren’t necessary for the street and will make it
more difficult for large de livery trucks to make it through
Merritt Avenue is home to a variety of auto repair and contractors’ shops
“I think the road needs to be repaired and the wa ter main should be up graded,” Lee said “But
putting sidewalks in? It’s not necessary”
The water main along Merritt Avenue is sched uled for replacement next year, and as part of that project, the city is propos ing upgrades to the road “to bring this street up to the city’s standard, which
includes curb and gutters, sidewalks and boulevard trees,” said ColeWagner, the city’s public affairs of ficer.

Burnaby’s newest polit ical party wants to freeze taxes and build, build, build townhouses, not towers
Incumbent councillor and One Burnaby founder Coun. Mike Hillman said one of his priorities is keep ing families together and to do it affordably
For Hillman, this means increasing density “gen tly,” he qualified within 15 minutes of transit, and elsewhere in the city, where he wants to make it eas ier to build more housing units on a single lot (like laneways and allowing an extra storey of height), with pre approved designs.
Kit Sauder, One Burn aby’s campaign manager, said Burnaby currently has about 38,000 existing sin gle family lots some du plexes, some with the po tential for laneway suites.
He said One Burnaby is proposing within the first 100 days to allow four housing units per residen tial lot (“four plexing”), and six units per lot (“six plexing”) within 15 min utes of rapid transit
“We estimate that over the course of the next 50 years, we’d be able to in troduce a minimum of 258,000 additional units, which means that we can double the population of

the City of Burnaby, with no midrise or highrise additional construction at all,” Sauder said, adding, “It’s townhouses instead of towers ”
“There’s no reason that it should be easier to buy a tear down and build a mansion on top of it, than to build a multiplex,” said Sauder
The party hopes to in troduce flexible zoning to allow corner stores, cof fee shops, child care spaces “on every corner in your neighbourhood ”
ONE BURNABY: FREEZE TAXES?

One Burnaby says they want to freeze taxes in 2023 as a response to the cost of living crisis.

Hillman acknowledged the city faces increased costs
He and Sauder point to Burnaby’s almost $2 bil lion in reserves, saying it’s time for Burnaby use the money to help its citizens.
Hillman added Burn aby also has a lot of statu tory funds (money which has its uses restricted by law): “Those things are all locked in as to what we can do with them. Do we actu ally ever sit down and say, ‘Are we getting the right value for those things and using those funds in areas that we need to?’”

Burnaby’s electoral dis tricts during the next B.C. election could look a lot different
The BC Electoral Boundaries Commission has released its propos als to change electoral dis tricts in the province in creating six new ridings, one of which would be in Burnaby.
The five other addi tional proposed districts would be in Langford, Langley, Surrey,Vancou ver andVictoria
If the recommenda tions are accepted, the seat count in the B C legisla ture would rise from 87 to 93
“British Columbia is a growing province,” com mission chair Justice Nitya Iyer said in a news release.
“The population has increased by more than 300,000 people over the last five years Our recom mendation to increase the number of electoral dis tricts in B.C. reflects that growth ”
In addition to the cre ation of six new electoral districts, the commission also recommended adjust ments to the 71 electoral districts based on the geo graphic demographic
The current local elec toral districts are: Burnaby Deer Lake Burnaby Edmonds Burnaby Lougheed Burnaby North
Under the proposed changes, the new ridings would be Burnaby Cen tre, Burnaby East, Burn aby NewWestminster, Burnaby North and Burn aby South.
The commission is pro posing Burnaby Centre be situated on the west side of the city and would fol low Boundary Road in the west; a line bounded by Highway 1, Douglas Road and the Lougheed Highway and Sperling Av enue in the north; Impe rial Street in the east and
Kingsway in the south Cascade Heights, Gar denVillage, Deer Lake and Buckingham Heights would be included in the Burnaby Centre district.
Burnaby East would be situated in the north east corner of the city, bounded by Kensington Avenue, North Road and the Burrard Inlet
The committee says it proposes adjustments to the district that would remove the neighbour hood of Eastburn and add part of NewWestmin ster bounded by McBride
Boulevard, East Eighth Avenue and Cumberland Street.
Burnaby NewWest minster would include the Kelvin, Eastburn and Glenbrooke neighbour hoods of NewWest and the adjacent Middlegate and Edmonds neighbour hoods in Burnaby
Proposed boundaries of the riding are Imperial Street in the north, Grif fiths Drive in the west, Sixth Avenue in the south and the line of McBride Boulevard and Newcombe Street in the east
Burnaby North would be located on the north west side of Burnaby and contain the neigh bourhoods of Burnaby Heights, Capitol Hill, Willingdon Heights and Brentwood Park
The commission has proposed balancing the population with neigh bouring districts by mov ing the portion of the current riding south of Highway 1, Douglas Road
and the Lougheed High way into Burnaby Centre
Burnaby South would sit between the Fraser River in the south and Kingsway in the north.
Included areas would be Metrotown, Suncrest and South Slope in Burnaby and Connaught Heights in NewWestminster
The commission says adding the area around Metrotown south of King sway keeps the rapidly growing SkyTrain corridor in one riding.
“Before we began our deliberations, we travelled throughout the province, meeting as many people as we could, seeking input on electoral boundaries
“We held 50 public meetings in 43 commu nities and received over 1,300 submissions,” Iyer added
“Our recommenda tions are the result of the considerations in the Act, the data we collected and the diverse perspectives of British Columbians ”

Candidates vying for a city council seat in the Oct 15 municipal elec tion are vowing to address transportation needs in Burnaby, a new HUB Cy cling Connection election survey shows.
Seventeen out of 26 (65 per cent) of the coun cil candidates took part in the survey.
This included Burnaby Citizens Association in cumbent councillors Ali son Gu, Sav Dhaliwal, Pi etro Calendino and James Wang, and BCA hope fuls DanielTetrault, An tara Deb, Reah Arora and Maita Santiago, as well as Burnaby Green Party’s Carrie McLaren, Jasmine Nicholsfigueiredo and Tara Shushtarian

Students still dealing with the emotional impact of the COVID 19 pan demic are getting some help learning to cope with stress thanks to a new Burnaby school district awareness campaign
The pandemic had a big impact on students’ men tal health, according to the district’s Safe and Caring Schools lead Nick Christ ofides
“The healthy outlets that kids relied on just weren’t there for a huge part of the pandemic things like athletics, fine arts and clubs that met in person, both at schools and in the community,” Christofides told the NOW “We know, anec dotally, that these kinds of
things made it harder for kids to process their emo tions and manage their stress because they didn’t have access to those things that brought them connec tion and joy, and, there fore, typically supported their mental wellness ”
The district decided to focus on stress manage ment this year start ing with helping students look at it through a differ ent lens
“When you ask students and adults about stress, many assume that it’s a bad thing The truth is much more nuanced Not all stress is bad. In fact, stress can be channeled to help you succeed,” Christ ofides said
Throughout the 2022 23 school year, the dis trict will host enhanced training and workshops
for mental health leads at each school and profes sional development op portunities for teachers, counsellors and learning support staff
For students, the dis trict has launched an awareness campaign fea turing posters with tips
on “making stress your friend ”
Some initiatives will be student led, including a mental health conference in the spring hosted by the district student advisory council, as well as smaller initiatives throughout the year put on by mental
health clubs at the city’s high schools
At Burnaby South Sec ondary, the mental health club is in the process of putting together “self care packages,” featuring items to help students unwind, including bath bombs, candles, tea and more
“My generation, they don’t really like to sit and watch people talk They like events, like doing something,” said co pres ident Sam Kim, a Grade 12 student who joined the club in Grade 8
Since the pandemic, Kim said more of his friends at school are in terested in ways to man age stress, especially now that they’re in the senior grades
The mental health club has grown as a result
“I think South needs
a mental health club be cause I know that many students aren’t really aware of mental health, and they really don’t know much about it,” said Grade 12 student Sean Chung, the other co pres ident of the club “I feel like mental health club is the best way to help ed ucate others about it and just spread it ”
South’s mental health club was founded in 2018 by Chung’s sister, Susan
“The club is an or ganic thing It’s grown because of students im pacting other students not because of adults,” said Amos Lee, the club’s teacher sponsor “We just support them They’re the ones that are helping each other out And that’s different, when they can get peer to peer help.”
