A Burnaby strata’s 2022 an nual general meeting was “in valid,” but the BC Civil Resolu tionTribunal has declined to do anything about it.
Leslie Gordon, a co owner of an apartment at Central Park Place on Barker Avenue, applied to the tribunal for a declaration her strata’s 2022 AGM was in valid and an order for the strata to hold a “proper” 2022 AGM, according to a rulingTuesday
The strata announced in Feb ruary that its 2022 AGM would be held in March by Zoom.
Citing COVID 19 safety re strictions, the strata said own ers would vote ahead of time us ing two secret ballot forms. One was for electing the strata coun cil and the other for voting on two resolutions: the approval of the strata’s operating bud get and the transfer of $100,000 from the operating surplus to the strata’s contingency reserve fund (CRF)
Under a provision of the COVID 19 Related Measures Act, stratas are allowed to con duct electronic and remote meetings, but Gordon argued the strata’s 2022 AGM didn’t allow owners to participate, make motions, amend resolu tions, nominate themselves or others for strata council or cast votes as required by the Strata Properties Act, the strata’s by
laws and the COVID 19 Re lated Measures Act Tribunal member Kristin Gardner agreed “While the strata says that owners were permitted to speak at both the pre AGM meet ing and the AGM itself, I find that communication was essen tially meaningless, given the ad vanced voting process estab lished by the strata,” Gardner stated in a Nov 8 ruling “The voting ballots distributed in the AGM notice package were pre printed with the nominees for
the strata council and the word ing of the proposed resolutions, and owners could vote imme diately after receiving the no tice package So, there was no opportunity to nominate other council members or amend the budget or CRF resolutions at either the pre AGM meeting or the AGM.”
Although she found the ad vanced voting process used by the strata wasn’t allowed un der either the Strata Properties Act or the strata’s own bylaws, Gardner said the tribunal didn’t
have the jurisdiction to make the declaratory order Gordon was asking for Gardner also declined to set aside the election of the strata council at the AGM or the ap proval of the operating budget
“I find it would serve no meaningful purpose to set aside the election of the strata coun cil members or the approval of the operating budget,” Gardner wrote “I agree with the strata’s submission that by the date of this decision the strata coun cil members will have already
served a large portion of their term and the annual budget will have been implemented and uti lized. If I were to make an or der for a new AGM, I would or der it take place within 90 days. That would be approximately when the 2023 AGM will take place in any event, where a new strata council and a new budget will be voted on ”
While Gardner dismissed Gordon’s claims, she said Gor don was “successful on the main issue of whether the 2022 AGM was invalid” and there fore entitled to have her tribunal fees reimbursed by the strata Gardner noted the tribunal has ruled on “several” disputes about AGM voting rights dur ing the pandemic and “clearly found that strata corporations must hold general meetings in a manner that permits owner at tendance and participation ”
The CRT is an online, quasi judicial tribunal that hears small claims disputes of $5,000 or less and strata property disputes of any amount

The assessment found the detachment was al ready 2,685 sq m (28,903 sq. ft) too small for the detachment’s needs and would be 4,074 sq. m
(43,849 sq ft) too small 20 years from now
The study also found a number of other deficien cies with the old building, which was built in 1967 and served as a court house before being re pur posed as the Burnaby RCMP headquarters
“The renovations un dertaken to date have not fully addressed the under lying issues of space short age and a suboptimal lay
out,” states another RFP document
The city’s current five year financial plan has a total of $95 5 million ear marked for the replace ment of the RCMP fa cility, but there has been no public discussion of the project, and it has not been included in monthly updates on major civic building projects to the city’s financial manage ment committee.

In the legislature, Horgan and I often run into each other in the hallways, each of us leading impromptu tours of the place for people we often don’t even know At one point last year, he mo tioned me over to take over a tour he was giving to some of his constituents
“I totally forgot that I must be on a phone call with the
prime minister in a couple of minutes You have to take over,” he said, to the bemuse ment of his constituents.
Another time, I saw him pointing some things out to an elderly couple. I ran into them later and asked: “How do you know Mr. Horgan?”
Their reply: “Oh, is that his name? He said his name was John and that he worked here”
I told them that both were true statements I explained, to their astonishment, that the equivalent of their state governor has just given them a private look around
Finally, one of my favour ite Horgan stories involves a visiting Grade 11 class from Reynolds High School in Victoria, which he attended himself. I led a wide eyed
bunch of teenagers into his office one morning in October 2019
As he talked about what it was like being premier and a Reynolds High grad, I suddenly realized the annual “great shakeout” earthquake drill was about to begin in minutes and there were not enough desks for the kids to dive under for safety.
Horgan had an idea “Let’s go up to the cabinet room and dive under the huge table up there,” he said, and I led the students up the stair case and opened the cabinet room door
To my horror I walked in on a cabinet committee meeting. We were all speech less at this unbelievable vio lation of the rules when sud denly Horgan came bursting
into the room “Everyone out! Reynolds High is coming in!’ he barked at his startled ministers.
And so the ministers trooped out into the hall and the kids came in and sat around the giant table When the alarm sounded they dove under it, and Horgan dove under it with them He crawled around for several selfies with the students
When it was over, I led the kids out to where the ministers were waiting to go back in.
“That was soooo Horgan,” Carole James said, laughing
It certainly was. No one enjoyed being premier more than him.

Progress against polio is global good news
Editor: I am so weary of watching the news from around the world. It is simply depress ing I needed some good news and found it this morning in a report by the National Polio Emergency Operations Center Did you know that since the GPEI (Global Polio Eradication Initiative) was launched 30 years ago, we are witnessing an astonishing 99 9 per cent decrease in the global polio burden?
The polio eradication network showed remarkable resilience during the COVID 19 pandemic, however, the pandemic has resulted in vast and varying disruptions to essential health services.
That said, the fact that the world can come together for only the second time in history (since smallpox) to eradicate a disease gives me so much hope! While many of us feel the pinch of inflation, and can complain about the rising costs of food, we still find our way to a warm bed at night, and manage to have three solid meals a day.
Not so for so many people around the globe, and all the more reason that we must #KeepThePromise by increasing our Interna

RCMP release sketch of suspect in park incident

Burnaby RCMP has re leased a police sketch of a man who allegedly made inappropriate sexual com ments and a threatening gesture to three women at Deer Lake Park last month
The women were walk ing together on Oct 13, when the man allegedly approached them and made comments about the way they were dressed and then made a gesture like he was cutting his throat, according to po lice
There was no physical contact, and the victims were able to safely walk away from the suspect, police said.

vestigating this matter and has identified a person of interest in this case,” Burnaby RCMP Cpl Mike Kalanj said in a Nov. 9 news release “Our in vestigation is ongoing, but
we want the public to be aware that this happened and to report any similar situations to police ”
While the sketch is based on the suspect de scription from the Oct 13 incident, police said inves tigators are also looking into four other incidents where a man with a sim ilar description was also alleged to have made in appropriate comments to women near Deer Lake Park.

Police are working to determine whether the in cidents are linked
“Our officers would like to urge anyone who may have encountered a simi lar situation to contact our investigators,” Kalanj said.

Local dignitaries were on hand to welcome Rudy the Operation Red Nose Reindeer back to Burnaby last week after a two year COVID 19 imposed ab sence
Operation Red Nose, a by donation safe rides program that runs every weekend throughout the holiday season, was put on pause in the Lower Main land because pandemic re strictions over the past two years
But Rudy and his Oper ation Red Nose volunteers are back
“We know that holiday parties and gatherings are returning this year, which means it’s important to have options available to make sure everyone can get home safe at the end of the night,” Burnaby Mayor Mike Hurley said during the launch at the North Burnaby Legion Hall
Hurley called Operation Red Nose a “vital” road safety program.
Burnaby RCMP media spokesperson Cpl Mike Kalanj said an average of 65 people die in impaired driving accidents in B C every year
He urged drivers to take advantage of the Opera tion Red Nose program
“Make a plan.This is definitely a great alterna tive,” he said
Kalanj noted extra of ficers will also be out and about during the holiday season to catch those mo torists who still choose to drive impaired
This is the ninth Oper ation Red Nose campaign in Burnaby
The program was started in Quebec 39 years ago and came to B.C. 27 years ago
Altogether, B C volun teers have provided more than 100,000 rides to peo ple looking to get home safely after making merry “That’s more than
100,000 people that chose to call for a safe ride home,” said ICBC road safety program manager Robin Bell
Bell emphasized drivers who feel unable to drive safely for whatever rea son can catch a ride with Operation Red Nose “no questions asked ”
Each safe ride involves three volunteers: one to drive the client’s vehicle, one to navigate and one to drive a second vehicle that picks up the other two vol unteers
All rides are by dona tion, and proceeds from the Burnaby program go to KidSport, a non profit that provides grants so all kids can participate in or ganized sport regardless of their family’s income

The SFU Red Leafs midfielder has been named the 2022 Great North west Athletic Conference (GNAC) men’s soccer player of the year after an impressive campaign.
The junior from Uganda started all 17 matches for the Red Leafs this year, logging 1,519 minutes on the pitch
He finished with three goals on the year all from the penalty spot netting each opportunity SFU was given
Talisuna becomes the eighth SFU player to win the conference’s top player award since the Burnaby post secondary school’s program joined GNAC in 2010
“Mark’s role is to get us going in the way we want to play, and he is excellent at that,” Red Leafs head coach Clint Schneider said in a release
“He can be so dominant in games because of the way he plays, and how he moves When he is in a role where we need him to de fend, he is excellent in that as well
“Mark just makes things go because he’s always an outlet to play, and he’s so good that you can put him in tight spots. Him being honoured with a place on the first team is excellent. I’m excited about what Devin is go ing to look like when he’s healthy, and he’s got a cou ple years of football under his belt ”
